The Universal Credit (Transitional Provisions) Regulations 2014 make provision for the treatment of Employment and Support Allowance (ESA) claimants when they naturally migrate to UC. Where this occurs claimants who are in receipt of the Work Related-Activity Component in ESA will have the Limited Capability for Work element in UC applied to their UC award from the start of their first UC assessment period and those who are in receipt of the Support Component in ESA will have the Limited Capability for Work and Work-related activity element in UC applied to their UC award from the start of their first UC assessment period.
