Question to the Ministry of Defence:

To ask the Secretary of State for Defence, what policy determines whether a disclosure by Service Police to a territorial police force is processed under Part 3 or Part 2 of the Data Protection Act 2018; and, where Part 3 applies, what procedures implement the requirements in section 38(2) to (5) to distinguish fact from personal assessment, distinguish categories of data subject, verify data before transmission, and provide the recipient with information necessary to assess its accuracy, completeness and reliability.

Given that one of the hon. Member's constituents currently has ongoing legal proceedings against the Department regarding these matters, it would be inappropriate to provide a response to these questions at this time.
