To ask the Secretary of State for the Home Department, if he will take steps to ensure that women who are held in police cells are supported by at least one officer who is a woman.

The Government is committed to ensuring that custody is a safe and dignified environment for all detainees, visitors and staff which operates professionally, respectfully and lawfully.

Police custody is governed by the Police and Criminal Evidence Act 1984 (PACE) Codes of Practice which sets out the legal framework for the detention, treatment and questioning of persons by police officers. PACE Code C requires that as soon as practicable after arrival at the police station, each detainee must be given an opportunity to speak in private with a member of custody staff of the same sex as them about any matter concerning their personal needs relating to their health, hygiene and welfare that might affect or concern them whilst in custody. Arrangements must also be made for ensuring that a girl under the age of 18 is placed under the care of a female member of staff.

As policing is operationally independent of Government, Chief Constables and elected Police and Crime Commissioners are responsible for the operational management of custody suites.

Question

To ask the Scottish Government whether it will take steps to reopen the “Radical Road” in Holyrood Park.

The Scottish Government delegated the management of Holyrood Park to Historic Environment Scotland as a Property in Care. This delegation includes decision-making relating to the ‘Radical Road’ which was closed in 2018 following significant rockfall and it has remained closed to minimise the health and safety risk posed by the active threat of rockfall. Historic Environment Scotland advised that there have been a number of further rockfalls on to Radical Road since the closure.

While managing the Park, Historic Environment Scotland is legally obliged to comply with all relevant legislation, of which health and safety is particularly important. Historic Environment Scotland has to ensure the health and safety of its visitors, staff and contractors.

Historic Environment Scotland also has a duty of care to people entering the Park, under the Occupier’s Liability (Scotland) Act 1960, in relation to dangers caused by the state of the Park, as well as a general civil law duty of care. The Occupier’s Liability legislation and the general duty of care were central in the decision to close Radical Road.

The risks in relation to the ‘Radical Road’ and other areas of Holyrood Park will be routinely re-assessed by specialist geotechnical engineers, and potential mitigating measures considered to inform future plans.

To ask the Secretary of State for Health and Social Care, what estimate she has made of the number of UK-born clinicians that have left the NHS in the last 12 months; and whether she holds information on the number that have moved abroad for work.

The numbers of leavers from the National Health Service, for staff employed in NHS trusts and other core organisation in England are published quarterly by NHS England as part of its NHS Workforce Statistics Collection. The data for the annual period to the end of June 2023 is attached.

Leavers data is presented for staff groups by the self-reported nationality of staff. This will not necessarily be the same as the place of birth of a member of staff but may a useful proxy. The data shows that in the 12 months to June 2023, there were 27,813 nurses and health visitors and 13,574 doctors who left service in NHS trusts and other core organisations who had a United Kingdom nationality. Other staffing groups can be access through the data linked.

The data includes staff employed by NHS trusts and integrated care boards but excludes staff directly employed by general practitioner surgeries, local authorities, and other providers such as community interest companies and private providers. The count of “leavers” includes staff leaving to work in primary care, to local authorities and to private providers. Each year there is flows of staff going each way between NHS trusts and other health providers. This is particularly important to note for doctors as data on leavers will include junior doctors moving on planned rotations and placements into primary care or other settings.
