My Lords, President Trump started a process by which the United States would leave the New START and open skies treaties, briefly mentioned by the noble Lord, Lord Reid. Is my noble friend the Minister confident that the UK Government can persuade President Biden to reverse President Trump’s decision on this matter and thereby maintain the strategic security that these treaties bring to us all?

My Lords, we recognise the contribution that New START has made to international security and strategic stability, and we remain committed to the open skies agreement. We believe that it benefits transatlantic security by building understanding and confidence through military transparency. We have been in close touch with the current US Administration while they have reviewed their involvement in the treaty, and we will continue those discussions with the new Administration.

My Lords, Zimbabwe continues to have high rates of gender assaults throughout the country. Can my noble friend say what progress has been made by a DfID-launched programme, started 18 months ago, called Stopping Abuse and Female Exploitation?

My Lords, I thank my noble friend for highlighting this issue. Even before the pandemic, Zimbabwe already had one of the highest prevalence rates of violence against women. We are investing in trying to help stop gender-based violence: as my noble friend said, we have funded a preventing sexual exploitation and abuse co-ordinator within Zimbabwe, and we are also working hard on a programme to stop abuse and female exploitation.

My Lords, the paper provides an update on the UK’s approach to the protection of civilians, highlighting the work being done across the UK Government over the past 10 years to move this important agenda forward. The United Kingdom is already implementing the work we have set out and we will continue to do so, be that through the UN Security Council and other multilateral fora or, indeed, by championing agendas such as the Preventing Sexual Violence in Conflict Initiative.

My Lords, the specific inclusion of children in the strategy for the first time is most welcome. What measures are the Government now taking to fulfil the commitment in the strategy to improve accountability for violations of children’s rights in conflict?

My noble friend has raised an important point. As she will know from her own time as Minister of State at the Foreign Office, the annual report on Children and Armed Conflict from the UN Secretary-General has highlighted more than 25,000 UN-verified grave violations against children. I am therefore proud of the fact that the UK is the largest single financial contributor to the Office of the UN Special Representative, SRSG Virginia Gamba, who I have worked with very closely. I can assure my noble friend that we continue to work on this as a key priority in protecting civilians in armed conflict.

My Lords, we are not able to confirm the media reporting of the recruitment of Syrian troops. We remain concerned about the recent ceasefire violations and of course deeply regret the loss of life. We will continue to monitor the situation closely.

My Lords, do the Government consider that Russia’s co-chairmanship of the Minsk Group peace process conflicts with its geopolitical interests in Armenia, including its basing of armed forces there and its supply of hydrocarbons to the country?

My Lords, Russia of course has long historical links with both Armenia and Azerbaijan. We do not consider that the co-chairmanship of the Minsk Group conflicts with its political interests. A peaceful settlement to the conflict should be in Russia’s interest and we continue to support the Russians in their role as co-chairs.

My Lords, in welcoming this important Statement of support for the people of Belarus and help for those who have been targeted by their Government’s attack on media freedom, I first ask my noble friend whether that help will also cover members of the arts and culture community who have been affected. Secondly, do the Government plan to appoint another UK special envoy on media freedom now that Amal Clooney has resigned?

I thank my noble friend for her question. On her second question, we are currently reviewing the position of the special envoy on media freedom. In the meantime, of course, the UK remains fully committed to supporting media freedom and standing up for the rights of journalists. On her first question, as I said, we are currently considering how best to support all members of society protesting in Belarus at the moment. I agree with her that we need to make sure that we continue to see free arts and culture, which is such an important part of society.

My Lords, I do not doubt for a moment that we will continue to have various debates on the new FCDO. The right reverend Prelate mentioned gender equality. As he will know, the Prime Minister is a strong advocate. Indeed, since he was Foreign Secretary his mantra has consistently been about 12 years of quality education for all girls around the world.

in aid spending. How soon do the Government plan to resume their funding for organisations such as the World Food Programme, which does such vital work to reduce food insecurity in east Africa?

My Lords, while noting what the noble Baroness said, I assure her that we continue to work with like-minded partners, particularly on participation for Taiwan in those organisations where statehood is not a prerequisite. Those include the World Health Organization. We also believe that Taiwan has an important role to play in the spheres of education and climate change.

My Lords, Taiwan has been preparing for a pandemic since the SARS epidemic in 2003. As a result, it has been able to tackle the terrible ravages of Covid-19 with great success. But at the World Health Assembly in May, the attendees, including us, were unable to learn about the methods of its success because Taiwan’s attendance as an observer was blocked by China. Will my noble friend please assure me that the diplomatic efforts of the UK will be used to try to prevent such a blocking from happening in the future?

My Lords, I share my noble friend’s disappointment and concern. As I have already said, we believe that Taiwan has an important role to play, particularly in how it has dealt with the Covid-19 pandemic. Therefore, we continue to lobby for its participation in meetings such as those convened by the World Health Organization.

My Lords, there are measures in place. If someone has been designated and they feel that needs to be reviewed it would go to a Minister, but the court systems exist to allow for that review. In all of this there is a parliamentary overview and, as I have said, there will be opportunities to debate designations. They will be looked at. On corruption, as I said yesterday, we are looking at other frameworks, including the UN frameworks. We will follow those in bringing new proposals forward in time.

My Lords, what analysis have the Government made of the implications of Article 38 of the new law for all of us in the UK? It appears to imply that if a non-Hong Kong resident travels to Hong Kong, either as a tourist or on business, they could face prosecution there for things that they had said or done legally in the UK.

My Lords, my noble friend is right to raise this issue, which was part of the Permanent Under-Secretary’s discussions with the Chinese ambassador. Does this apply just to those with non-resident status in Hong Kong, or does it apply not just to those people who have travelled elsewhere in the world but to everyone? That has not been made clear and we will continue to seek that clarification. We outlined those concerns in our meeting with the Chinese ambassador yesterday.

To ask Her Majesty’s Government what assessment they have made of the impact on human rights in Hong Kong of the national security law proposed by the National People’s Congress of China.

My Lords, the draft legislation passed last week by the People’s Congress of China threatens to be the death knell for “one country, two systems”, the framework agreed before Britain handed Hong Kong over to China in 1997 that protected its special status. The legislation would undermine Hong Kong’s high degree of autonomy and be a serious threat to human rights there. I therefore welcome the Statement made by the Foreign Secretary in the House of Commons on Tuesday that if China does not reconsider its approach, the UK will not just look the other way when it comes to the people of Hong Kong; we will stand by them and live up to our responsibilities.

I shall outline the following issues: the nature of the legislative process so far, what it means for Hong Kong and why the UK should take action to protect the freedoms of the people there. My main questions to the Minister today are as follows. What is the Government’s current assessment of the legislation’s impact on human rights in Hong Kong if it were to be enacted? What will they do next to fulfil the commitment made by the Foreign Secretary in the House of Commons and by the Prime Minister, writing in the Times newspaper yesterday? What factors will the Government then take into account when deciding on their next steps?

Last week the People’s Congress rubber-stamped a draft decision. That resolution will now pass to China’s senior leadership to be fleshed out into a draft law. The proposals outlaw behaviour deemed to be subversion, terrorism, separatism, assisting foreign interference or endangering national security. Charges such as these are often used in mainland China to detain dissidents and political opponents. It now seems that the era of Hong Kong’s political freedom could be over and that many could become criminals for actions that were legal until now.

Reportedly, Beijing wants the law to be implemented before Hong Kong’s own legislative elections in September. Direct imposition of the security law by Beijing, rather than through Hong Kong’s own institutions, would curtail the liberties of those in Hong Kong and dramatically erode Hong Kong’s autonomy and the system that made it so prosperous. Through the Sino-British joint declaration, we aimed to protect the city’s unique status and defend some of its key institutions, such as the Legislative Council and the court. The rule of law and an independent judiciary are the foundations on which Hong Kong’s success is built. Both are at risk from the draft legislation.

The legally binding joint declaration, signed by China and the UK, and registered at the UN, sets out that Hong Kong will have a high degree of autonomy. It also provides that rights and freedoms, including those of the person, of the press, of assembly, of association and others, will be enshrined in law in Hong Kong, and that the provisions of the two UN covenants on human rights—the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights—shall remain in force. But, as the Hong Kong Bar Association has pointed out, there is no assurance in the draft decision that the law will comply or be required to comply with those provisions.

If “global Britain” is to mean anything, it is vital that we maintain our values and uphold the agreements we signed up to. We have a duty to the people of Hong Kong to do just that. I have the honour to chair your Lordships’ Select Committee on International Relations and Defence. It was a privilege to take over the chair last year from my noble friend Lord Howell, who is speaking in this debate. He led us on our major inquiry into UK foreign policy in a shifting world order. The report concluded that the Government should work with China

“in a manner which is consistent with the rules-based international order”.

It also noted:

“In the longer term, the Government will need to weigh up the strategic challenge posed by China’s approach to its international role, and its impact on the rules-based international order, against China’s growing economic significance.”


In their response to our report, the Government stated that

“China’s position is sometimes at odds with parts of the rules based international system. Where China’s approach challenges important principles of the order, such as human rights—an important part of the international architecture—we and our allies speak up for our values.”

Given that, what will the UK Government do next? Ministers have already made it clear that they will commit themselves that if the Chinese Government go through with their proposed legislation, the UK will do the following. First, they will work with the international community on these matters. The joint statement by the UK, US, Australia and Canada last week was welcome, but how will they now develop that international partnership beyond the Five Eyes? Secondly, they will put in place new arrangements to allow British nationals overseas to come to the UK without the current six-month limit, which would include a path to citizenship. Does that include their dependants?

What impact, if any, will economic decisions have on the course of action the Government decide to take in fulfilling their commitments? Will they feel constrained by the vast flows of capital and trade between Britain and China? I would hope not and I believe that as we navigate the way ahead, we should continue to be an outward-looking country that is a champion of collective security, the rules-based international system and free trade, and a defender of human rights. Those are the values that have served us well and we should be constant in upholding them. I look forward to the Minister’s response.
