My Lords, on the last point, I am not sighted on that, but I will write to the noble Baroness if I have anything to add. There is an issue about the capacity for Bombardier to design rolling stock in the UK, but it is a matter for that company whether or not it maintains a capacity.

My Lords, are the Government aware that under the EU treaties there is no enforceable sanction against a country that refuses to pay a Brussels fine? So, why do we not behave like the French and award the Thameslink contract to Bombardier? Do the Government further agree that there would not even be the slightest risk, alas, that we would be ejected from the EU if we failed to pay any eventual fine? So, why do we not just go ahead and do it?

My Lords, the United Kingdom has never been fined in respect of an EU infraction and Her Majesty’s Government have no intention of allowing that to happen. I hope that the noble Lord fully accepts the benefits of competition. It would be most peculiar to keep accepting bids that were not competitive.

My Lords, I would like to keep this non-partisan. All Governments put pressure on the Government of the United States and other countries. I am pleased to say that we have had some success with Kazakhstan, which has managed to regularise its overdue parking fines.

My Lords, have the Government made a study of how the United Kingdom pays similar fines in other jurisdictions? Do we obey their rules: is it only they who do not obey ours? How do we stand elsewhere?

My Lords, the noble Lord makes an extremely important point. Our diplomats are very careful to pay all outstanding charges when they are overseas. We discourage any parking offences and in the United States our diplomats pay toll charges, which are equivalent to our congestion charge.

My Lords, I repeat the point that I just made. Diplomatic cars are inviolable. The other problem is that we could get into a tit-for-tat situation with our diplomats overseas. I suggest that that would not be a sensible course of action. It would be much better to continue to apply the pressure that we do.

My Lords, we are certainly not passing the buck. We have helped the mayor with a £5 million grant to deal with some of the technical issues; for instance, fitting particulate traps to London buses to deal with some the PM10 hotspots that I talked about earlier.

Can the Minister bring us up to date with the infraction proceedings against the city of Brussels which is, I think, the only major European city which still discharges all its raw sewage into its local river? Does the Minister agree that were the wind to be blowing in the south, this might have quite an effect on the Olympic Games?

My Lords, I concur with everything that has been said by the three previous speakers—an unusual event in itself, I think. Perhaps I may press the Government on a rumour that another so-called day in Committee may be offered next Wednesday, 25 May, when the President of the United States will be paying a visit. I cannot believe that that is a suitable time to hold another half-day or whatever on the Bill, and I look forward to the Government’s reply.

My Lords, all noble Lords know that business is organised by the usual channels. I agree that the House is working very hard at present and I can think of few noble Lords who work harder than the noble Lord, Lord Stoddart of Swindon. However, we have plenty of time to undertake valuable work on the Bill. In fact, we still have an hour and three-quarters, and it is not an unusual time of day to be considering such legislation. I do not believe that the House or the general public would understand if we went home an hour and 45 minutes early, especially if they worked out the cost of doing so. Therefore, I hope that noble Lords will agree to go into Committee.

My Lords, further to the Minister’s earlier Answer, will he explain—I am afraid that it is the same old question—why we cannot decide this sort of thing for ourselves? Why is it imposed on us by Brussels? Is it not getting beyond a joke?

My Lords, this is a shared competence, and the EU is bound by the principle of subsidiarity. EU actions should not be taken unless they are likely to be more effective than actions at national, regional or local level. We believe that member states are best placed to deal with local bus services.
