To ask Her Majesty’s Government what assessment they have made of the Organization for Security and Co-operation in Europe; and whether they have any proposals to improve that organisation.

My Lords, I thank all noble Lords for their participation. I am grateful to the Library for its helpful briefing note.

It is important that we are reminded about the OSCE and its functions, for the record. I acknowledge my fellow member of the UK delegation to the parliamentary assembly, the noble Lord, Lord Dubs, who continues his work and concern for refugees as vice-chair of the assembly’s migration committee. I also acknowledge the tremendous work done by another Member of your Lordships’ House, the noble Baroness, Lady Hilton of Eggardon; she is no longer a member of that delegation, but she carried out a formidable number of election observation missions. I declare my interest as the current president emeritus of the parliamentary assembly.

Arising from the Helsinki agreements entered into at the end of the Cold War, the OSCE now comprises 57 participating states. They are not member states because the OSCE does not enjoy legal personality, which can cause difficulty. The 57 states stretch from Vancouver to Vladivostok. It is the largest regional organisation recognised by the UN. There are three areas of work, or dimensions: the politico military, including arms control and countering terrorism; economic and environmental, including economic growth, good governance and co-operation to avoid disputes, for example over water; and the human dimension, including support for human rights and democracy. There is also cross-dimensional work, touching on cybersecurity, education and combating human trafficking.

Most of the OSCE’s staff are to be found in field missions or programmes in south-eastern Europe, eastern Europe, the south Caucasus and central Asia. There is also the vital special monitoring mission in Ukraine. The work carried out by the field missions is varied, whether it is helping states to establish democratic process, training judges and police, looking after minorities or helping to establish small arms and border controls. That is by no means a complete list.

In the OSCE, there are structures and bodies that support its work, including the High Commissioner on National Minorities; the Office for Democratic Institutions and Human Rights, which supports democracy and human rights; and the Representative on Freedom of the Media, who ensures that the states’ commitments to freedom of the media are observed. Since 1992, there has also been a new tool: the Court of Conciliation and Arbitration. As its name implies, its task is to resolve disputes between participating states. I see that it has not actually heard any cases, but it has been ratified by 30-plus participating states. Can the Minister tell us why, as an example to others if nothing else, the United Kingdom has not signed or ratified the Stockholm Convention, which established that court?

All this work goes on, and the participating states meet weekly in Vienna in a permanent council and other specialised structures. However, for decisions to be taken, consensus is needed. Although this was seen as a strength in the optimistic early days of the OSCE, it now has the ability to create deadlock. The optimism of the early days is behind us. There is no longer a general acceptance by all of the international norms and behaviour. Participating states have flouted the norms and ignored the borders of others. We have the issue of Moldova and the Russian-backed separatists in Transnistria. Georgia has two areas of its territory occupied by Russian puppet regimes recognised by virtually nobody but Russia. The dispute between Armenia and Azerbaijan flares up despite the best efforts of the Minsk Group, and Ukraine is constantly with us and causing concern.

In the autumn of 2020, agreement could not be reached in the permanent council to reappoint the four executive heads, so the organisation was left with no secretary-general, no director of ODIHR, no High Commissioner on National Minorities and no Representative on Freedom of the Media. Of course, dedicated staff carried on vital work, but the organisation was leaderless. My predecessor as president of the parliamentary assembly, Mr Tsereteli, issued a call for action in the lead-up to the 50th anniversary of the OSCE. It was supported by many distinguished players in the OSCE from Governments that had acted as the chair-in-office, not just the parliamentary assembly. The object is to examine ways in which the effectiveness of the OSCE may be improved. It is not to dictate the governmental side, but to endeavour to be helpful.

I am quite certain that the ills of the OSCE will not be cured without the full involvement and attention of the Governments of the participating states, but the OSCE never seems to be very high on their agendas. Perhaps that is because so much good work is done in the field and, indeed, by the permanent representatives in Vienna—including our own ambassador, Mr Neil Bush.

The Minster may tell me that, in the March 2021 integrated review of security and defence, the Government committed to supporting multilateral organisations that uphold national norms on security, including OSCE, and that we are one of the largest contributors to the special monitoring mission in Ukraine. Nevertheless, it is likely that the funding needs of the organisation will grow, not decrease, given the current situation within the region.

However, none of that goes to the working of the organisation, which has to be by consensus. There is provision for decisions by consensus minus one, but that has been used only once, at the time of the break-up of the former Yugoslavia. Consensus is the weakness and, at the same time, the strength of the organisation, but if it can be misused to hold up the continuation of the mandate of the special monitoring mission in Ukraine, agreement on the budget or the appointment of executive heads, the organisation does not function at its best. Indeed, coupled with the abandonment of the norms of international behaviour towards other states and, in the case of Belarus, norms of treatment of its own citizens, the ability to act effectively is severely curtailed.

The United Kingdom, with our ambitions to adopt a greater global role, should be well placed to raise our game politically within the organisation, put the future of the OSCE clearly on our political agenda and work with our friends on both sides of the Atlantic. I believe that the United States will prove an open door, as Congress has a very strong Helsinki Commission, which is fully involved in OSCE events and has a parliamentary involvement greater than that of any other participating state.

A start would be to ensure that the work of the OSCE was better known. Even in this building, how many people know or are interested? Because we need political leaders to be involved, I suggest taking the time between now and the 50th anniversary to build consensus for a summit. There is an annual ministerial council each year, attended by Foreign Ministers. The OSCE chair-in-office is a Foreign Minister of the relevant participating state. Our Library Note says that heads of state participate in summits, which set the priorities of the organisation. The last summit was in Kazakhstan in 2010; it was attended by the then Deputy Prime Minister, now Sir Nick Clegg, so, given the state of the organisation and the time that has elapsed, perhaps it is high time that we had another summit. I may be told that there are or will be difficulties and dangers in bringing these matters to a summit and giving those not so well affected to OSCE the opportunity to seek different political settlements not to our liking, but there are dangers and difficulties in doing nothing. I am sure that, if the OSCE did not exist, it would have to be invented.

I therefore ask Her Majesty’s Government what their assessment is of the political state of the OSCE. Do they have any ideas or ambitions to change the same, and will they move to bring the OSCE up the political agenda of our Government and that of the participating states, and discuss the possibility of a summit with our friends and allies with a view to this taking place in 2025, the 50th anniversary of the Helsinki accord?

My Lords, the noble Lord is again right to raise this issue. Last week we issued a joint statement on media freedom but also on the broader rights of human rights defenders, as well as calling for a cessation of the continuing raids, including on trade union offices. On specific actions we have taken already, we continue to use the mechanism of sanctions and are looking to act on it in accordance with other countries as well, and we will look at other measures we can take against Belarus while applying pressure on Russia, which of course supports the current regime in Belarus.

My Lords, I welcome the Minister’s support for the OSCE efforts, but in this instance there is a case for dialogue as well as sanctions. Have any Ministers met with Svetlana Tikhanovskaya, the leader of the opposition currently in exile in Lithuania, and offered her any assistance to achieve dialogue with President Lukashenko’s regime? Secondly, what are Her Majesty’s Government doing to support the chairman in office of the OSCE, who has offered, subject to Covid restrictions, to visit Minsk? I declare my position as president of the OSCE Parliamentary Assembly, which is itself ready to support efforts to achieve dialogue on reform in Belarus.

My Lords, on my noble friend’s second question, we have already urged Belarus to co-operate directly with the OSCE on implementing the recommendations. On his first question, my right honourable friend the Foreign Secretary has engaged directly with the opposition leader to see how we can further assist her efforts.

I declare my interest as a vice-president of the OSCE Parliamentary Assembly. My noble friend says that the Moscow mechanism has been triggered, but can she indicate whether the experts appointed to investigate matters will be allowed entry into Belarus, or will they try to conduct the investigation from outside the country? On a happier note, this week, the parliamentary assembly held a virtual meeting with Svetlana Tikhanovskaya and the head of the Belarusian delegation, a supporter of President Lukashenko. After initial recriminations about the past, there was a hint of willingness to talk about the future. Will my noble friend confirm that the Government will support all OSCE efforts to secure an initial dialogue without conditions to seek a way forward to meaningful and binding negotiations between government and opposition parties?

My Lords, we do not yet know whether the OSCE investigation will be able to access Belarus. We very much hope that it will, in order to be able to fulfil its independent investigation. The UN rapporteur has not been allowed access to the country, but we hope that they will be allowed access and will report back soon. My noble friend highlights the importance of parliamentary support, and I pay tribute to his and others’ work, which shows such good solidarity with the people of Belarus. I share his desire to see a binding and meaningful dialogue, and we will do all we can to help bring that about.

My Lords, the Government’s position remains that the issue of Taiwan is to be settled by people on both sides of the Taiwan Strait. As I said already, we continue to lobby for Taiwan’s participation in key organisations where it has a pivotal role to play.

My Lords, I thank my noble friend for the answers he has given, which suggest that we are very well disposed towards Taiwan. However, that is only one element. In the UK, we have seen the City of London withdraw its invitation to Taiwan to participate in the Lord Mayor’s Show and British Airways rewrite its destination listings so that Taiwan and, indeed, Hong Kong, are listed under China. Does my noble friend agree that we should be giving organisations such as the City and British Airways every support to resist this pressure from China, which is quite improper?

My Lords, individual companies and organisations will make their own decisions. The United Kingdom continues to acknowledge Taiwan. Whenever we categorise Taiwan we do so under the designation of country or region, and we will continue to do so. Individual companies will make their own decisions.

There is without a doubt growing concern globally about overuse of antibiotics. I believe that more than half of all antibiotics in the United States are used on farms, in many cases to keep animals alive that would otherwise not survive the conditions in which they are reared. The same has been true for many years across the European Union, including in the United Kingdom, where we have also been guilty of massive overuse of antibiotics in agriculture. We have taken great strides, working with the industry, to reduce the amount of antibiotics used in agriculture. The same is true across some countries in the European Union, but not all. Global awareness is growing. I believe that coronavirus has lowered our collective tolerance for risk. The noble Baroness is absolutely right that this should be top of the health agenda.

My Lords, I thank the Minister for his replies and for acknowledging that it is not only human health which concerns people, but the welfare aspects of the methods of keeping chickens and other animals and rearing beef. Can he again confirm that it will be a red line for the whole of the Government in any free trade negotiations with the United States that we do not change our standards? When we have completed those negotiations, will he also take on board that we need a robust statement on labelling so that customers know the methods of rearing and slaughter and can choose whether to buy?

The Government are looking very closely at labelling. It is a complex issue, but we are making progress and will be coming forward with something shortly. On standards, it is not so much that standards should not change but that we should always seek to improve the outcomes from an environmental health and animal welfare perspective. That could mean improving, changing or even streamlining regulations. We know that agriculture will be a tricky area, as it always is in free trade agreements, but we uphold very high food safety and animal welfare standards and we will not allow imports to undermine those standards. Our manifesto is clear that in all our trade negotiations, we will maintain our high environmental protection, animal welfare and food standards and we will hold firm in trade negotiations. That position has been reiterated time and again by the Government, not just by the department on whose behalf I am speaking today.

The right reverend Prelate raises an important human rights issue, and in particular the situation of the Uighurs in China. He will know that, as Human Rights Minister, I have consistently raised this issue, as has my right honourable friend the Foreign Secretary, both through bilateral engagement with the Chinese authorities and the Chinese Government, and through the Human Rights Council, as we are currently doing—yesterday a statement was made specifically on Hong Kong. We are working with other partners, a point raised by the noble Baroness, Lady Northover, to ensure that there is consistency of message and delivery. Where there are human rights abuses, we will stand up, with our partners, and challenge China, to ensure that the rights of all are guaranteed.

Concern about China’s actions in Hong Kong has been expressed in your Lordships’ House. Will my noble friend the Minister specifically indicate to the House this morning what steps Her Majesty’s Government have taken to establish an international contact group to put pressure on China to respect its legal and moral obligations towards Hong Kong?

My noble friend raises an important point about the responsibilities that China has. I assure him that we will push on that, not just through the contact group but through bilateral conversations with key partners. He will acknowledge that we remind China that the imposition of the proposed law in Hong Kong is in direct conflict with its international obligations under the joint declaration. As my noble friend knows, that treaty has been agreed by the UK and China, and registered with the United Nations. We will continue to push on that. My right honourable friend the Foreign Secretary has made clear the actions that we will take if China continues to persist in imposing this law.

I thank my noble friend for her introduction to this debate. There has been a lot of talk about establishing an international contact group to put pressure on China to accept its legal and moral responsibilities in its actions in respect of Hong Kong. I hope that the Government will accept that suggestion and in so doing include the participating states of the OSCE, the parliamentary assembly of which I am a vice-president, since many of its states—especially in the Caucasus and Asia, although not exclusively—are crucial to the ambitions of China in its belt and silk initiative. If we do that, it may well be that an alternative to China’s support for various developments will be needed from our democracies.

I look forward to hearing from my noble friend Lord Patten of Barnes, who is giving much-needed leadership on this matter.

My Lords, I am sure that all noble Lords thank the noble Viscount for securing this short debate and giving us the opportunity to discuss Ukraine, and that other noble Lords participating in it have spent much more time in Ukraine than I have. My experience of the country is limited to a visit in 2007 to Kiev, which I remember well for its wonderful collection of golden-domed churches and the splendid idea of pedestrianizing the main street for shopping on a Sunday.

However, as a member and a vice-president of the OSCE parliamentary assembly, I am aware of the situation in Ukraine, especially since the commencement of the illegal separatist movement in 2014. The actions of the Russian Federation have been regularly and roundly condemned in debate and by resolutions of that parliamentary assembly, which is not constrained by the consensus rule of the OSCE itself. The Ukrainian case has been robustly put by the leader of its delegation, Artur Gerasimov, in the face of bare-faced denials and aggressive responses from representatives of the Russian Federation. I believe that we should recognise the important role of the OSCE but it seems to be regularly ignored. I could not find a reference to it in all the many column inches of the report of last Friday’s debate on reconciliation in your Lordships’ House. The OSCE special monitoring mission has an important role. It was deployed in March 2014. It is unarmed and present in all regions of Ukraine, and its main tasks are to observe and report impartially and to facilitate dialogue between the different parties to the crisis.

In September 2015, the first forward patrol bases in eastern Ukraine were established. These bases increase the presence in eastern Ukraine and enable the monitoring of the Minsk agreements. However, plans to work close to the unsecured border cannot be effectively operated until security guarantees for the mission are provided by the separatists or the Russian Federation. Already, one monitor has been killed and two others injured by the explosion of an anti-tank mine in Luhansk. An important objective must be to get the Ukrainian authorities back in control of their border with the Russian Federation. Any devolution envisaged under the Minsk agreements cannot realistically take place until the authority of the Ukrainians is established. Illegal elections only exacerbate the situation and make resolution more difficult.

It is therefore worrying that the Russian Federation originally blocked the extension of the mission’s mandate, although subsequently an extension to 31 March 2019 was achieved. What diplomatic efforts are the UK Government making to ensure the mandate is extended, as further Russian incursions may take place without the evidence that monitors can provide? Is the UK acknowledging the special circumstances of the situation in Ukraine and willing to meet additional costs which the OSCE incurs in this vital work?

One of the most powerful weapons against the success of the secessionists will be that Ukraine succeeds in prospering as a modern state, enjoying economic growth with good relations with the West, including through the association agreement with the European Union. Will my noble friend the Minister say whether we have spent the £35 million promised to support political reform? What programmes have been initiated and are ongoing? Do the Government support any of the initiatives of UkraineInvest, proposed by a joint Lithuanian-Ukrainian team some 12 months ago? I understand that they were discussed in various government departments.

In the light of the open aggression by the Russian Federation in the Kerch Strait, the Telegraph reported that the Ministry of Defence was going to deploy troops and a Royal Navy ship to Ukraine. Has that deployment taken place and how many troops are involved? What precisely is their role and what are their terms of engagement? I acknowledge what the UK has done to date but given the importance of supporting Ukraine’s aspirations and ensuring that the Russian Federation’s attempts to destabilise an independent nation are not allowed to succeed, since the UK apparently has its own aspirations to exercise global influence, is it not time for us to have a comprehensive plan to assist Ukraine and not merely react on an ad hoc basis?

My Lords, I congratulate my noble friend Lord Howell of Guildford and his committee on this informative review of the situation in the western Balkans—or, as some in the region prefer, I am told, south-east Europe. I thank the noble Lord, Lord Hannay, for his comprehensive introduction to the report. I regret that I cannot bring the insight of my noble friend Lady Helic or the noble Lord, Lord Ashdown, to this subject but I nevertheless believe that the report is timely and that we have cause to be concerned about developments in many of the countries in the region.

As the report highlights, there is an ongoing risk of political, religious and ethnic conflict, nationalism and instability in a number of the countries. The threats and problems are well set out by the committee. The attention Her Majesty’s Government are now paying is welcome but, while they give assurances about our ongoing commitment to the region and support for the aspirations of the countries of that region to be members of the EU, I cannot see how our exit from the European Union will do other than make that more difficult. We intend to be deeply involved and may well try very hard, but we will be doing it from outside the EU.

My noble friend the Minister may refer me to the Framework for the UK-EU Security Partnership, which covers a number of the issues that are of concern in this area. However, that seems to be dependent upon negotiations and largely aspirational—perhaps he will point me to where it is not—and obvious questions will flow. How will we, as a third country, ensure that enlargement of the European Union to include the western Balkans will remain high on the EU agenda? The countries of the region have valued the UK’s resolute support for their inclusion into the EU and, despite the reservations of my noble friend Lord Balfe, I still believe that the prospect of EU membership is a driver for reform and the building of democracy in the region.

The new commission’s strategy for the Balkans is welcome but we will not be there to follow it through. How will we influence EU decisions over the accession of Serbia, a candidate country? How can it be admitted while it remains at best ambivalent and at worst hostile towards Kosovo, whose own European destiny remains in question while the problem with Serbia remains unresolved and other member states of the EU fail to recognise its independence?

How are we going to deal with the name question of Macedonia, to which reference has already been made? Yes, we have influence in NATO, but where will our influence and voice be in the councils of the European Union? How are we going to influence the European Union on foreign and security policy when Serbia deals with Russia in arms and other matters? These are EU matters over which we will no longer have a direct influence. The Government’s intentions are good but, unless something remarkable emerges from the negotiations over our future relationship with the EU, we will lack the ability to directly influence events.

I declare an interest as a member of the OSCE PA—the Organisation for Security and Co-operation in Europe Parliamentary Assembly—one of its vice-presidents and a former leader of our delegation. The western Balkans has been noted for some time by the assembly’s special representative in the region, Mr Battelli of Slovenia, as a cause for concern for all the reasons that have been discussed today and in the committee. The only reference to the work of the OSCE in the report is at paragraph 66 where its activities in Macedonia are mentioned. Otherwise the organisation gets no mention. The Government’s response is similarly reticent, only mentioning OSCE as one of the partner organisations with which we will work in the future.

Why does this matter? It is somewhat surprising as the OSCE, which is doing much work in the region, has missions or presences in Albania, Bosnia-Herzegovina, Kosovo, Montenegro, Macedonia and Serbia. To give your Lordships some idea of the significance of the OSCE in the region, I cannot do better than refer to its 2017 annual report. I will not try to enumerate all the work of each mission in each country, but it can be seen from the report that the work is varied. It includes helping states to improve their capacity to fight serious and organised crime, helping to prevent the trafficking of people and drugs, helping to build democracy and the rule of law, working with elected officials, school administrators, teachers and parents to reform education systems, monitoring violations of free expression in the media, and supporting judicial and constitutional reform. It does this to a greater or lesser extent in all the countries I have referred to. I shall give just one specific example: the demilitarisation programme saw the destruction of more than 90 tonnes of unstable conventional ammunition in Montenegro. The OSCE works to improve democratic procedures and to safeguard human rights through the work of its Office for Democratic Institutions and Human Rights as well as through its representatives for freedom of the media and for national minorities.

I am aware of the difficulties experienced in the OSCE, despite the dedicated work of our permanent representation in Vienna under the guidance of our ambassador, Sian MacLeod. The need for consensus and the obstruction of the Russian Federation makes the work difficult, but I ask the Minister to confirm that, despite the difficulties in its operation, HMG recognise the existence of the OSCE as a vital partner in the region, that they recognise that greater demands are being made on the resources of the organisation—particularly in Ukraine, which is not the subject of our debate today—and that our zero-budget approach may not be appropriate in these new circumstances. All the issues that the OSCE deals with are of concern, and expressed to be so in both the report and the Government’s response.

In the new global United Kingdom to which we aspire outside the European Union, the OSCE, stretching as it does from Vancouver to Vladivostok and encompassing 57 participating states, is an organisation we should support and perhaps ensure that its work is better known. The ministerial council meets only once a year in December. After a number of requests from the British delegation, in 2010 the Foreign Office started to issue a Written Ministerial Statement after that meeting, which was the only communication with Parliament about the OSCE’s work. I am therefore very disappointed that no such Statement was issued after the last Vienna ministerial meeting last December. Will my noble friend the Minister confirm that the practice will be reinstated, since if the Government do not attempt to inform Parliament about the work of the OSCE, its profile will remain low, even below the radar of parliamentarians, never mind the wider world?

My Lords, the Bill is a Government manifesto commitment and it must pass as quickly as is reasonably possible. I make that statement of the obvious lest anything I say subsequently should be construed in some way as an attempt to oppose the Bill. Having said that, I am afraid that I do not recant from my previous opposition to the idea of a referendum. I regret the Bill. I submit that it is unnecessary and, in the present circumstances, unwelcome.

It is unnecessary because of the European Union Act 2011, which has already ensured that there can be no transfer of powers to the EU without a referendum. It is unwelcome particularly because the Government have deviated from the 2010 position of the Prime Minister, who at that time was against an in/out referendum, and because it represents a success for those whose only agenda is our exit from the European Union.

I wish the Prime Minister well in his efforts to reform matters of concern to Britain and people of all parties. However, I fear that nothing he can bring back from these negotiations, short of a proposal to leave us outside the European Union, will satisfy those whose desire is to see us in precisely that position. It is unwelcome because, unless the result is a vote to leave, it will settle nothing: the Scottish referendum must have at least taught us that. For how long will we consider the issue to be settled: 20, 30 or 40 years? I submit that some choices and decisions made by nations cannot constantly be subject to review. Shall we demand a vote on membership of NATO, which commits us to taking up arms to defend a fellow member? Are we to argue that NATO is a post-war construct, entered into in different times and different circumstances, and that its role is now different from that envisaged by the founders? These are arguments often deployed in connection with the European Union.

Moreover, the referendum is unwelcome because the uncertainty created by the possibility of a British exit is not necessary. A competitive Europe, yes; expanding the single market, yes; a less regulated Europe, yes; but none of that demands treaty change. It merely requires determined working with our partners to negotiate changes to individual pieces of legislation. We will not challenge the fundamentals that would involve treaty change. Everyone acknowledges that that is politically impossible, in terms of both the timescale and the likelihood of obtaining unanimity. Lastly, it is unwelcome —and this is perhaps the greatest cause of its being unwelcome—because it brings into question our membership at a time when we need to be at the heart of the Union, working with our partners on the great economic problems and the problems of immigration, refugees and security, to name but a few.

It is often said—and it has been said this afternoon—that the EU’s original aims have been achieved: that peace in Europe is no longer threatened. Yet the growth of nationalism, extremism and the surrounding security problems must surely mean that we cannot take any of that for granted. The European Union has been a great driver for peace and democratisation in the continent, and it still is: ask the countries that want to join. When I meet parliamentarians from other countries at meetings of the OSCE, they cannot understand why we are putting ourselves in the position of a possible exit, and they are concerned that it might happen. I urge my noble friends in the Government to ensure that we make clear our wish to remain, not just by words but by deeds.

The migration and refugee issue is but one case in point. I acknowledge all that the Government are doing and their reasons for doing it in the way that they are. However, could we not just acknowledge that many small countries in the European Union and many of its neighbours are struggling with problems that are testing their capabilities and resources to the limits? If we are not to take any of the refugees from Europe, could we not offer some logistical assistance on the ground to show that, while we are not part of Schengen, we are not blind to the problems of our fellow Europeans? We can offer aid to the Caribbean, assistance to the Saudis for their prisons, put soldiers on the ground in Sudan, and offer China money to spread the word about British football. A little help for the Greek islands would perhaps be a little more appropriate and would certainly help our negotiations and the building of alliances that have already been said to be so essential in the process on which we have embarked. The case for membership has to be made now, not at the end of the negotiations. The out lobby is already working flat out because it does not care about the outcome: the only issue is whether it can win the vote to come out.

Much has been said this afternoon about the franchise. It is a strange Bill whereby the citizens of three EU countries, who are not UK nationals—the citizens of Ireland, Malta and Cyprus—will have a vote because they are Commonwealth citizens. In addition, there are non-British nationals—we do not know how many; at least, that is what I was told in answer to a Parliamentary Question I tabled in the previous Parliament—resident in the country who are Commonwealth citizens who have the vote. This is probably an issue for another time but, given that we are one of few countries, if not the only country, to allow non-citizens to vote in national elections, the parliamentary franchise needs an urgent review to examine the justification for allowing citizens of Ireland and the Commonwealth this right.

I hear the argument that to change the franchise might delay the vote, but in an age when you can be entered on the electoral roll only a few weeks before an election, some change should be possible, and it should be made in respect of UK citizens resident in other European Union countries. We already have a manifesto commitment to extend the franchise, and since the potential effects of withdrawal would impact on such UK citizens, they are entitled to have a vote.

As other noble Lords have said, we need independent factual information upon which the public may base their decision, and against which they may judge the statements of the in and out campaigns. We need to know what the Government will do if the vote is to leave. We need to know what they will seek. Voters must know what may change in the event of a no vote and the effect it will have on them. Crucially, it must be made clear that what rights are retained will depend on the outcome of the exit negotiations, and that it will be a matter not for us but for the other 27 member states. We will not have a vote.

I therefore hope that my noble friends will accept that although this Bill will, according to the conventions, pass, those conventions do not preclude amendments being sought and supported by many of us. There may be other Members from these Benches—not just me—who will attempt to improve the Bill where we consider it necessary. After all, those with a different view from mine fought their corner in the other place. I shall seek to fight mine here.
