My Lords, I will focus on the so-called Trump peace plan, which is of course nothing of the kind. It abandons prior US policy in the region. It has nothing whatever to do with fairness to the two sides. It is constructed to reflect Israeli power on the ground and abandons the norms of international law about the non-acquisition of territory through military force. The proposals would give US approval for Israel to annex the Jordan Valley and most of Area C, amounting to about 30% to 40% of the occupied West Bank. This contrasts with the 95% or so Palestinian control of the West Bank proposed by Bill Clinton in 2000.

This plan says it will retain existing Israeli settlements in the West Bank, not reduce them as international law requires. The new Palestinian state would have at least 600,000 Israeli settlers in it, all protected by the Israeli military. The involvement of the Palestinians in this plan was zero. The plan itself imposes on the Palestinians a large number of unrealistic obligations before they obtain a very small state with very little sovereignty. Israel would have “overriding security control”, with all entry and exit from the new state controlled by Israel. This Palestinian state would have no airport, Gaza would not have an independent port and Israel would control water and the electro-magnetosphere. The plan rules out any Palestinian capital in Jerusalem.

Unsurprisingly, the Palestinian leadership has totally rejected the Trump plan, seeking negotiations on a viable two-state solution based on 1967 borders, in accordance with international resolutions. The Arab League unanimously rejected the Trump proposals at its summit on 1 February and supported the Palestinian approach. Trump’s plan has been rejected by the African Union and the Organisation of Islamic Cooperation. Cyril Ramaphosa, the South African President, has likened the Trump proposals to his country’s apartheid experience.

Many Israelis have distanced themselves from Netanyahu, and the Trump plan is not in Israel’s best long-term interests. I shall quote from an email sent to me by Breaking the Silence, an organisation of courageous former members of the Israel Defense Forces:

“We were the ones who entered Palestinian houses in the dead of night and patrolled their villages in order to create a constant ‘sense of persecution’, as we were ordered to do. We were the ones who limited their freedom of movement. We were the ones who stopped and searched children whose only crime was to live their lives. All of these things were justified for ‘security reasons’. Now that the idea of annexation is on the table, the Netanyahu Government isn’t even trying to disguise its expansionist aspirations. Now it is clear to everyone: this plan has nothing to do with security, but rather its purpose is to perpetuate Apartheid.”


This strand of Israeli opinion gets little coverage in our UK media; nor does it get much attention from the UK Government. The Government’s response to the Trump plan at the end of January was somewhat muddled, to put it kindly. They have shown little understanding that if the international community allows Israel to proceed with the Trump plan without sanctions, it undermines the Government’s own position on sanctioning Russia over the invasion of Ukraine or any other future illegal actions. When will we see a more muscular response to the Trump proposals and their lack of regard for international law? Perhaps the Minister could draw some comfort from the letter published in the Guardian today from 50 former European leaders and Foreign Ministers expressing their serious concerns about the Trump plan.

My Lords, I, too, congratulate the noble Lord, Lord Steel, on obtaining this important debate and on his characteristically forensic analysis. I shall focus on Gaza, which I have visited several times, and on recent events there.

After a decade of blockade, Gaza remains an open-air prison—David Cameron’s description, I think—that was described by the UN as unliveable in. Half this prison population are children, who live without hope, and unemployment is at about 45%. Water is undrinkable and raw sewage pours into the sea. The great majority of people live on humanitarian aid. If they are lucky, they have four hours or so of electricity a day. The head of Israeli military intelligence, Herzl Halevi, has warned his Government that Gaza will “blow up” eventually.

Despite Gaza’s grim situation, the protests around Nakba Day on 15 May were relatively moderate. In so far as any protesters were armed, it was with catapults and stones, some Molotov cocktails, admittedly, and a few flaming kites. At a press conference on 10 May, the Hamas leadership congratulated its personnel on abstaining from gunfire—a rare event. It seems that only one Israeli soldier was injured. On the evidence available, little attempt was made to disperse protesters by non-lethal means such as tear gas or water cannon. In that situation, the Israeli military behaved like people auditioning for a Sam Peckinpah film, killing at least 50 Palestinians and probably more. Estimates vary upwards from 60 to 100 and include about 10 children. Many of those killed were shot in the back while running away or had their hands up. On Israeli intelligence’s own assessment, fewer than half of those killed were said to be, to use its own term, “Hamas militants”—whatever that means.

In addition, it was claimed by Time magazine in its edition of 28 May that,

“Israeli soldiers methodically cut down some 2,700 Palestinians”.

That number has subsequently risen. Some of the victims were children playing football too close to the border and some were health workers. This was not Israel defending its homeland; it was an international atrocity that needs to be investigated by the United Nations. Does the Minister agree that the UN should be involved?

We should not be surprised by this episode, because the IDF have form on the use of disproportionate force. For example, in 2014 another 2,000 Palestinians were killed in the Israeli invasion of Gaza, when Israeli deaths were about 50. The truth is that, after 50 years of illegal Israeli occupation, Palestinian lives now have a very low value for many Israelis. To many outsiders, Israeli soldiers look a bit like James Bond and seem to be licensed to kill by their political and military command structures. Those in authority politically know only too well that they face no effective deterrent response from the Governments of the US, the UK, Europe or other Arab countries.

We should perhaps reflect on the views expressed by the late and—by me—lamented Gerald Kaufman MP, who was the son of Polish Jews and whose grandmother was killed by the Nazis. Gerald once described Israel as a “pariah state” requiring the application of economic sanctions. After recent events in Gaza, I think that he had a point. As the noble Lord, Lord Steel, said, the UK Government should now follow Parliament’s lead and recognise a Palestinian state as a response to this latest Israeli outrage.

My Lords, we will mark the centenary of Balfour with pride. The Prime Minister has extended a guest of Government invitation to Prime Minister Netanyahu to visit the UK on the centenary. We are proud of our role in the creation of Israel. However, we recognise that the declaration should have called for the protection of political rights of non-Jewish communities in Palestine, particularly their right to self-determination. This is why we support a two-state solution.

First, I am sure that the whole House wishes the noble Baroness, Lady Tonge, a speedy recovery, and recognises the huge contribution she has made on Palestinian matters. I thank the Minister for her reply. She recognises, I think, that there was a conditionality on granting in the terms of the Balfour Declaration the establishment in Palestine of a national home for the Jewish people. That conditionality was very clear, as the declaration states,

“it being clearly understood that nothing shall be done which may prejudice the civil and religious rights of existing non-Jewish communities in Palestine”.

Does the Minister agree that successive British Governments, both under the British mandate and subsequently, have failed to deliver that declaration protection to the Palestinian people? Furthermore, should we not mark the centenary with a gracious apology from the British Government and Parliament for the suffering that that failure has caused and try to make amends—

My Lords, I, too, congratulate the noble Baroness, Lady Tonge, on securing this debate, and I congratulate her and the noble Lord, Lord Sheikh, on their excellent speeches. It is timely to discuss Gaza’s misery as events in Iraq, Syria, Libya and now Tunisia push Palestinian issues in general and Gaza’s problems in particular further and further into the public and political background.

I have been to Gaza and met Hamas representatives both there and outside Gaza. There are undoubtedly some pretty unpleasant people among them, but I can think of many political parties around the world that have unpleasant people in them. That is not an excuse for not talking to them. It is easy to forget that Hamas won a democratic election, supervised by the UN, in 2006, so we have been involved in not having discussions with that particular democratically elected Government.

We found at the end of the day in Northern Ireland that we had to talk to the IRA. We found that the IRA itself had splintered and that some of the most unpleasant people had gone off to do other things that were even more unpleasant than anything the IRA did in its heyday. That is no excuse in the modern world for refusing to discuss with Hamas and trying to forge some capacity to help Israel engage with Hamas. Standing on the sidelines hoping for better weather to arise in Gaza, which is what we do, does not seem to me to be a very credible strategy for a modern Government in Europe.

I want to spend the rest of my time picking up some of the issues about what we are allowing to happen in Gaza to its children. Their plight is terrible—the BBC will be reminding us bravely this week of some of the trauma that they have suffered. The US seems to have retired hurt from the Middle East and Europe now has to start to make up its own mind what it wants to do in this area.

The context is pretty terrible as far as Gaza’s children are concerned. The starting point in their plight is the civilian death and destruction caused by the Israeli military in July and August last year. This was not just the first conflict, it was the third such conflict in six years, with further destruction piled on that from the previous two. Let me quote from the March 2015 draft of a UN damage and needs assessment:

“During the 51 day escalation, bombardments, air strikes and ground incursions resulted in an estimated 2,260 direct casualties”—

that is a euphemism for killings—

“including 612 children … and 230 women ... 10,625 people were injured, among them 3,827 children … and 1,773 women ... 899 people were left permanently disabled”.

None of these dire statistics tells us anything about the casualties left over from the previous two conflicts or about those children and their mothers who survived all three but have been left severely traumatised by their experience. Studies show that mental disorders are consistently higher in Gaza than in Israel. These casualties would be a challenge for any healthcare system, let alone one so impoverished as Gaza’s. The last conflict alone killed and injured over a 100 healthcare workers, with ambulance drivers disproportionately affected. A WHO assessment of 87 health facilities has revealed that 25 have been severely damaged or destroyed, and goes on to say:

“El-Wafa Rehabilitation Hospital ... was specifically targeted and totally destroyed following warnings from the GoI to evacuate its patients and staff”.

WHO estimates the economic losses to the health sector at over $380 million. There is a chronic shortage of pharmaceuticals, supplies and spare parts for medical equipment. All this is on top of the damage to water and sewage facilities, housing, electricity and the food supply. Between 95% and 97% of the water supply is unfit for human consumption.

This is the context in which Gaza’s children are growing up: high unemployment, no prospect of jobs, traumatised, poor, with 80% of the population dependent on donor aid. Would we really be surprised if some of them turn to ISIL and Islamic Jihad, and would we really be surprised if those numbers increased? We are bringing on ourselves and helping Israel to bring on itself a move to extremism. This will do even more damage in Gaza and do damage to Israel itself.

My Lords, I am sure that we are all grateful to the right reverend Prelate for obtaining this debate and for his constructive, excellent and robust introduction. I should declare my interest at the outset as a trustee of the Council for European Palestinian Relations, an organisation that facilitates visits by European parliamentarians to see at first hand the circumstances in which Palestinians live, in Israel, the Occupied Territories and, indeed, in the external refugee camps. The circumstances in which thousands of Palestinian women, children and vulnerable older people live in many of these areas are, frankly, an international disgrace.

Those of us who regularly raise our concerns about the treatment of Palestinians within Israel and the Occupied Territories are regularly accused of a lack of balance, or told of Israel’s right to defend itself, or reminded of the firing of rockets by Hamas into civilian areas. The disproportionately high levels of Palestinian deaths and casualties, compared with those suffered by Israelis, are consistently and conveniently overlooked. There is always another side to the stories: the Palestinians cannot unite, Hamas is formed of terrorists—even though, somewhat inconveniently, Hamas won a fair and democratic election with international observers in 2006. It is Israel that is the real democracy—an island of democracy in a sea of Arab autocracy. We must not be too hard on Israel, if we want the virtually non-existent peace process to achieve progress and to keep alive the seriously damaged two-state solution. That is the context in which we have come to this kind of debate. Yet year after year, the Palestinians living in this shining example of democracy are seeing their already modest human and civic rights eroded further and further. They are supposed to put up with this without protest. The international community continues to accumulate more and more documents setting out the abuses of Palestinian human rights undertaken by, or at least with the collusion of, the Israeli Government. These catalogues of abuse are simply ignored by Israel, despite strenuous diplomatic efforts on the part of the UK and other Governments to bring them to the attention of Israel’s Government.

The Library’s excellent briefing for this debate identified some of the documentary evidence of Israeli abuses of civic rights and protection of its own citizens. The variety of the sources—UN, US state department, FCO, international human rights organisations, and brave Israeli internal organisations ashamed of their own Government’s behaviour—all lend testimony to the same set of messages, which were extremely well set out by the right reverend Prelate. We are spoilt for choice as to which pieces of documentary evidence we want to alight on. It is striking how little independent counterevidence the Library has been able to find in assembling its excellent briefing.

I want to pick on one document in particular from the Library’s briefing, from the FCO. It quotes from page 206 of the FCO’s April 2012 report to Parliament on human rights and democracy in different countries. In that document the Government drew attention to their continued concerns on Israel and the occupied territories. I quote:

“Our particular concerns included Israeli demolitions and evictions of Palestinians in East Jerusalem and the West Bank; the human rights effects of restrictions on Gaza; the increase in the number of attacks by extremist Israeli settlers; the treatment of Palestinian suspects within the Israel justice system; the high proportion of civilian casualties and fatalities resulting from Israeli airstrikes on Gaza”.

By comparison, they did identify abuses of human rights within Gaza and the Palestinian authorities, but these abuses were modest by comparison with this particular catalogue. I ask the Minister to look at what the FCO, her own department, is citing: the concerns are not the kind of concerns that most British Governments have had with so-called allies and friends. They are on a scale which is fundamentally different in terms of the human rights concerns. Many of the discriminatory actions set out in the various reports are of long standing; but some are more recent, as the right reverend Prelate identified.

I have another example. In March 2011, the Knesset passed laws that authorised rural Jewish and majority communities to reject Palestinian Arab citizens and other “unsuitable” applicants from residency and imposed fines on any government-funded institution, including municipalities, which provide health and education for those commemorating Nakba, the destruction of Palestinian villages and the expulsion of their residents, after Israel’s declaration of independence. That is a recent example of the kind of discriminatory behaviour that is being passed through the Israeli Parliament.

The heart of the problem of Palestinian discrimination is that the status of Palestinians under international human rights instruments, to which Israel is a state party, is that of a national, ethnic, linguistic and religious minority. But the basic laws of Israel do not recognise them as a national minority within the protections that flow from that position. The definition of Israel as a Jewish state makes inequality a continuing practical reality for Israel’s Palestinian citizens. Worse still, they are frequently—and increasingly—seen as a “fifth column”, simply because they are Palestinians.

I do not want to extend this catalogue of discrimination in the remainder of my time, because other speakers will no doubt do some of that. The question is—what should the UK, as part of the international community, do about this established and continuing pattern of behaviour and discrimination? It is a pattern of illegal, inhumane and abusive behaviour. When South Africa was engaged in this kind of behaviour, the international community was so shocked that it imposed sanctions of various kinds to try to change that behaviour. We have tried to brush this issue aside, but we cannot go on finger wagging at the Israeli Government and getting very little in the way of response. The time has come for the UK and its EU partners to start thinking about something else, which is assembling a graduated set of economic and other sanctions to try to encourage the Israeli Government to attend to their duties as a democratic state in terms of removing some of the discrimination against many of their non-Jewish citizens.

Much of the argument in this House in recent times was that we needed to wait for the American presidential elections and get the Americans to help us take this forward. If you listened carefully to the Obama presidential campaign, the speeches made in that campaign made it clear that the time had come for America to do nation-building at home, not abroad. We have to understand that we cannot necessarily rely on activity on the part of the US in terms of pressure on Israel to change some of its behaviour. We have to be a bit more grown up, work with our EU partners, and think about what we as Europeans want to do in trying to encourage Israel to reverse the trend of discrimination against its Arab citizens.
