Offences against Children: Private Prosecutions
Wednesday 17th July 2019

Asked by: Andrew Griffiths (Conservative - Burton)

Question to the Ministry of Justice:

To ask the Secretary of State for Justice, pursuant to the Answer of 24 June 2019 to Question 266816 on Offences against Children: Compensation, what estimate his Department has made of the number of private prosecutions brought by victims of child sexual abuse in the week commencing 2 January 2017.

Answered by Edward Argar - Minister of State (Ministry of Justice)

Centrally held information does not identify whether or not prosecutions were brought forward privately by victims of child sex abuse. To identify whether the relevant cases would require manual searching of court records, which would be of disproportionate cost.

Officials within my Department would be happy to extend an invitation to my Honourable Friend, the Member for Burton and Uttoxeter, to discuss what data is available and its limitations.

Offences against Children: Compensation
Tuesday 25th June 2019

Asked by: Andrew Griffiths (Conservative - Burton)

Question to the Ministry of Justice:

To ask the Secretary of State for Justice, pursuant to the Answer of 10 June 2019 to Question 260612 on Offences Against Children: Compensation, if he will name the judge in each of the 26 cases.

Answered by Edward Argar - Minister of State (Ministry of Justice)

The judiciary are statutorily obliged to consider making a compensation order in all appropriate cases and this obligation is outlined in sentencing guidelines which are set by the Sentencing Council. The judiciary must give reasons where no such order is made. However, both the imposition of compensation orders, and decisions as to amount, are at judicial discretion. The separation of powers and judicial independence are key to upholding the rule of law therefore it would be inappropriate for MPs and Ministers (as members of the legislative and executive branches) to seek to influence the judiciary in the exercise of their powers. Therefore, it is not appropriate to provide the names of the judges in relation to each of the 26 cases

Offences against Children: Compensation
Monday 10th June 2019

Asked by: Andrew Griffiths (Conservative - Burton)

Question to the Ministry of Justice:

To ask the Secretary of State for Justice, pursuant to the Answer of 18 February 2019 to Question 220844 on Offences Against Children: Compensation, (a) what the conviction was for and (b) how much was awarded in compensation in each of the 26 cases where a criminal compensation order was issued.

Answered by Robert Buckland

The amount of compensation awarded for child sexual abuse offences where a criminal compensation order was issued in 2017 can be viewed in the table attached.

Compensation rarely appears as a primary disposal, it is almost exclusively a secondary disposal and will usually be accompanied by another sentencing outcome such as immediate custody. Data presented in this PQ response is from administrative court records and needs to be considered in the context it is collected. In some court cases especially for the most serious offences, courts may prioritise recording of the primary disposals (such as custody, community sentences etc.).
