I am grateful to the hon. Gentleman for that question, but respectfully he is completely wrong. It is not the same level of funding as 2010. Let me try to explain it to him and his constituents. The £1,500 per pupil extra by 2024 is £1,500 more than in 2019-20. That is a significant investment in the future of this great country.

To reflect that, we will allocate—as I was saying on recovery—£2 billion extra to support young people who are struggling to catch up on missed learning, following the existing investment in tutoring and training for great teachers. That is in addition to the 6 million tutoring courses and 500,000 training opportunities we have already made, which takes overall investment specifically dedicated to pupils’ recovery to almost £5 billion. That includes an additional £1 billion of catch-up funding that goes direct to schools so that they can best decide how to support education recovery for those of their pupils who most need it. Teaching unions wanted that additional flexibility—I thank them for that—and I listened to them and made representations to my right hon. Friend the Chief Secretary to the Treasury. As they told me, this funding might pay for specialist small groups, or hiring staff to lead extra-curricular activities outside the school day. In that way, an average secondary school could receive about £70,000 a year in additional cash. That is money that can make a real difference to young lives. Evidence shows that the pandemic has had a significant impact on older pupils who have the least time left in education. We will be investing £800 million in extending the time they spend in colleges.

It is no secret that the most important person in any classroom is the one standing at the front of it, which is why this settlement enables us to raise teachers’ starting salaries to £30,000. We promised that in our manifesto and we are delivering on that promise. That is in addition to a salary boost of up to £3,000 tax free to teach maths, physics, chemistry and computing, which we have already announced, to increase the number of teachers in subjects that are facing the greatest shortfall. It will also build on our groundbreaking teacher recruitment and retention reforms. We want our brightest and best graduates to be queueing up to be teachers. We now have far more compelling reasons for them to do so.

As a former families Minister, I care passionately about giving children a great start in life. That means giving families every support. I have seen for myself on many occasions the incredible effect that our investment can make on helping struggling families. Around 300,000 of our most vulnerable families will be supported with an extra £200 million boost to the Government’s flagship supporting families programme, which supports families through complex issues that could lead to family break- down. That is an approximately 40% real-terms uplift in funding for the programme, taking total planned investment across the next three years to nearly £700 million. As I said, we are being driven by three things: skills, schools and families.

I welcome my right hon. Friend’s commitment to the supporting families scheme. The certainty around that for the long term will be very beneficial. He will recognise, as a former families Minister, that the big pressure on local government budgets is not social care—I wish I could spend the money, but I cannot employ anybody—but children’s services. The cost is growing exponentially. We need to move to more proactive preventive services, such as supporting families. Will he make a commitment to ensure that the transition in local government to preventive services will continue beyond this Budget? It is very welcome, but it has to be a long-term trend. Will he commit to supporting local government to do that?

My hon. Friend is absolutely right and I thank him, not least because of his deep experience in local government. We will continue to engage with the MacAlister review and we will take very seriously the points that my hon. Friend made about the pressures on local government.

I welcome the opportunity to speak in the debate and endorse everything said by my right hon. Friend the Member for Harlow (Robert Halfon) about schools and education. On those issues, he is always bang-on. Since the Budget, I have had positive conversations in particular on the transition between BTECs and T-levels that I hope will be reflected by the Secretary of State’s comments tomorrow. There are many opportunities there.

I welcome the many positive announcements in the Budget, which has been largely well received by residents. It set a good and clear direction to help take the country forward post covid. In particular, I welcome the business support measures, business rates cuts, changes to alcohol duties, the freeze on fuel duty and other measures that will impact on the cost of living and support businesses to grow and innovate. At some stage, we will have to reform business rates fundamentally. The measures announced in the Budget are positive and will support businesses—high street businesses in particular—but business rates are not fit for purpose. I had positive conversations last week on that with the Financial Secretary to the Treasury, and I understand that a review is to take place. I look forward to seeing that in due course.

I also welcome the personal support for the lowest paid, with a £1,000 pay rise and a tax cut for working people on universal credit. The average wage packet in Mansfield is way below the national average, and thousands of people will benefit from those changes. I am grateful for those announcements.

I welcome the significant capital commitments on transport and infrastructure, although I am slightly concerned that it seems that only areas with combined authorities and devolution deals are eligible to get the best of that support. We have some positive announcements for Nottinghamshire: Mansfield will submit a bid for the next round of the levelling-up fund, as will Nottinghamshire County Council, and we look forward to positive news, hopefully. There was a huge multibillion pound investment in devolved mayoral authorities. However, the east midlands does not have that, so the area that historically has had the lowest level of investment misses out.

Do not get me wrong—I am not moaning. I think that passing powers down to local level and giving capital funds to accountable local leaders is a good thing. If I do have a moan, it is that we do not have one, and we want one in Nottinghamshire. We have a plan for that, and I want the Government to get on and give Nottinghamshire a county deal so that we too can benefit from such support. I remind Ministers of the fantastic levelling-up package that the east midlands offers with our freeport, our development corporation and our huge plans around Toton supported by the integrated rail plan. Altogether, that is more than 100,000 jobs and £5 billion in gross value added. The plan exists and is all on track, and a devolution deal for Nottingham—which, by the way, is a bigger geography than the Tees Valley Combined Authority or the Cambridgeshire and Peterborough Combined Authority—would give us huge economic clout. It is a chance to invest for us, to get on a par with other parts of the country. We want a deal, we have the unanimous support of local leaders who have all made significant resource commitments for that, and we have a plan to deliver better public services. I will keep banging on about it until we get one—I am sure that Ministers will indulge me.

I turn to public services, which are the theme of the debate. There was positive news in the Budget, with £4.8 billion in grant funding to local authorities both very welcome and perhaps more generous than many had expected. That will help us to tackle things such as the cost of the minimum wage rise for care staff, which runs into the millions. I also welcome the commitment to new family hubs and the Start4Life programme that will benefit children and families who really need it.

I said in an intervention that certainty for the supporting families programme and investment in the development of early years staff is fantastic. In particular, early years staff development has been a problem for a long time, so the more we can do to support that sector, the better. We must continue the commitment to proactive and preventive services. In truth, children’s services, not social care, are causing every upper tier council leader in the land the biggest headache on budget setting. There are many challenges in social care, but, if I had loads of money, I could not spend it because I cannot recruit the staff. The challenges there are deep and long term.

The problems with recruiting were raised by East Riding of Yorkshire Council, and one reason why it is asking the Government for more money is that it wants to be able to offer higher wages to try to compete with organisations such as Amazon, which attract workers who would previously have worked in care.

I thank the hon. Member for that intervention, which pre-empts something I will come to. In effect, I will make the same point later in my speech. The truth is that next year we will underspend on social care, because we cannot recruit the staff to pay them, even if we had the money. In children’s services, demand is growing exponentially. The complexities and costs are becoming increasingly difficult. There are also significant additional needs for school places for children coming from Hong Kong, and significant care issues for asylum-seeking children. The children’s budget of every council in the land is overspent.

I therefore welcome measures focused on early intervention. I would love to talk to Ministers about supporting the transition towards a set of more preventive services. I welcome the announcement in the Budget, but we must continue the trend of having a better attitude to risk management and how we support families in their homes before we get to that acute stage. That change of approach and culture will save money in the end, but it will require more up-front resource.

The Government could support Nottinghamshire and the whole country by letting us pilot new proposals and ideas in the space through a county deal. We have thoughts about how we might like to do that, working with organisations such as the National Youth Agency, the charitable sector and our great Nottinghamshire universities to change the game and learn some lessons. I would welcome conversations with Ministers about that.

On social care, and the point made by the hon. Member for Kingston upon Hull West and Hessle (Emma Hardy), councils need teeth to get the money. More funding is welcome, but at the minute that funding is going to the NHS, whose backlog is in large parts due to the limits of social care. We cannot get people out of hospital and into appropriate homes or care packages, and we cannot offer sufficient preventive interventions. People end up in hospital, which is not the best place for them, because social care does not have the resources to provide emergency support or to fetch Mrs Miggins and put in place a care plan for her; instead, she ends up going off in an ambulance.

The Government could help tackle the NHS backlog by backing social care. As it stands, it appears that we must go with our begging bowl to the integrated care system to ask for funding from the national insurance rise for services such as supporting hospital discharge or response teams that can offer care in the home rather than an emergency response. The funding is aimed at the NHS backlog and, although it needs to fund those social care interventions to be successful, we seem to be at the NHS’s mercy on whether it gives us that funding. I hope that Ministers will tackle that imbalance in the White Paper. It is hugely important to the transition and new approach to social care that we get that right, because the two are not separate services; they interlink closely.

We will meet a cliff edge in a few weeks, when the requirement for care staff to be vaccinated begins. I have raised that issue a few times. In Nottinghamshire alone, 1,000 staff or more could be no longer eligible to work in a sector that already has a 12% vacancy rate. Is it riskier to have an unvaccinated care worker or not to have a care worker? We may face that challenge. I know that there are financial mitigations to try to help, but, as I have said, we cannot recruit. We do not set the wages—largely, services are commissioned from private providers—and people can get £1.50 an hour more at Amazon than working in the care sector. I have said to Ministers before that we need to consider carefully whether it is right in effect to force a lot of people out of a profession that is already struggling with recruitment and with getting the right staff in the right places.

That said, there are many fantastic interventions in the Budget. I touched on many of them. However, those challenges will not go away. I therefore look forward to conversations about them with Ministers across various Departments in due course. There are real positives to take, with the Government continuing to support jobs and individuals. The OBR tells us that the interventions throughout the pandemic made a huge impact on protecting people and keeping them in work over the last 18 months. The plan for jobs has been incredibly successful so far, and I trust that that will continue. I welcome the many measures in the Budget that will impact positively on my constituents and look forward in due course to discussing in more detail with Ministers some of the challenges that I raised.

This Government remain fully committed to great care, free at the point of need, which of course is the founding principle of the health service. We remain fully committed to working to ensure that our healthcare system and our social care system are properly funded and staffed for the future. Our commitment to providing world-class public services extends to people of all ages, and that is reflected in our wider work on social care.

We have pledged an extra £4.7 billion by 2024-25 for schools, and I congratulate my right hon. Friend the Secretary of State for Education on securing a good settlement that will include nearly £2 billion of new funding over the spending review period for education recovery. That brings total education recovery spending to almost £5 billion. We are also providing £500 million to support the very youngest and their carers and to invest in family help. Last week, my right hon. Friend the Member for South Northamptonshire (Dame Andrea Leadsom), who has been such a brilliant advocate for this cause, described those measures as fulfilling

“a fantastic pledge for every baby.”—[Official Report, 27 October 2021; Vol. 702, c. 317.]

I could not agree more.

I welcome the positive interventions in early years and for young people in the Budget in particular, which are meaningful. If we are going to support that change for the long term, we need to support local authorities to transition to that early intervention approach, as laid out by my right hon. Friend the Member for South Northamptonshire (Dame Andrea Leadsom). I trust that the Minister will confirm the Government’s commitment to doing that.

I absolutely will, because there is sometimes said to be ambiguity about levelling up. It is clear to me that it is about life chances through life, from cradle to grave. It is about jobs, prospects, investment in skills and jobs, and all of that comes from the start of life. I know that my hon. Friend will be doing a fantastic job in Nottinghamshire to help to deliver that.

Just to reiterate, this Government are not disputing the value of the arts either to our economy or to our society. I want to fully confirm that on the record. We have asked the OfS to consult on altering the high-cost subject funding to enable a reprioritisation of some subjects towards the provision of high-cost subjects that support the NHS and wider healthcare policy, high-cost STEM—science, technology, engineering and mathematics—subjects, and subjects meeting specific labour market needs. I reiterate that this accounts for only approximately 0.05% of higher education providers’ total income.

I am committed to levelling up education, and see strong multi-academy trusts as the best vehicle for achieving this. That is why we are investing £10 million in four high-needs areas, including Ashfield and Mansfield, to improve pupil outcomes. Up to half of this will be channelled through the successful trust capacity fund.

I welcome the news that Mansfield and Ashfield will get a share of that £10 million fund to drive school improvement in disadvantaged areas and to boost academic outcomes for our young people. That is very welcome indeed. The other half of this conversation is perhaps about the non-academic side—the cultural enrichment, extra-curricular activities and raising of aspirations that might support young people to reach their potential. What opportunities might exist in that kind of space for our schools to access support?

My hon. Friend is absolutely right to point to the enrichment that goes on in so many of the most successful schools right across the country. That is why we are absolutely committed to trying to work with trusts from across the country to target areas such as Mansfield and Ashfield to bring the most successful trusts into those areas to drive up educational attainment. We look forward to working with him. I will be delighted to sit down with him to discuss what more we can do to drive not just academic attainment across schools in his constituency but the rich cultural offer that schools can offer their pupils, which is incredibly important for all children.

It is a pleasure to serve under your chairmanship, Mr Robertson, and to speak in this debate, covering a number of petitions about both the return to school and this year’s assessments.

Obviously, the impact of covid on our schools, and therefore on our children and young people, has been huge. I would argue that it is perhaps still being underestimated. As I have said before in this place, personally I would not have closed schools. Being out of school for months has had a huge impact on the more than 1,000 vulnerable children in Nottinghamshire—that is just the county, excluding the city, so the number might be twice as high—who are known to children’s services for one reason or another. There was a spike in the number of abuse referrals to children’s services following last summer’s lockdown, and I have no doubt that that will happen again now. We owe it to those children in particular to put them at the heart of our plans for recovery.

This is not just about vulnerable children; the issue has affected all children. I am lucky enough to be the father of two primary aged boys—

It is not only vulnerable children who have been impacted by the lockdowns. I am lucky enough to be the father of two primary age boys, and they have been lucky enough mostly to continue to attend school, as my wife has worked on a supermarket shop floor throughout, but even they have missed their social lives and have missed out on a lot of experiences. They have seen both their education and development impacted. This time in the lives of our children and young people is hugely important, whether it is early development as a primary school student mastering the academic basics, learning to make friends, understanding the school environment and how to act around other people, or whether it is a teenager studying for major qualifications while also coming out of their shell and becoming an adult and finding themselves. How much more difficult must it be for them to begin to find their independence and their own self separate from their parents when they are forced to spend every day at home with them and they do not get to go and do anything else?

In terms of what we do about it—this is the key going forward—the Government have talked a lot about academic catch-up and tutoring, which is welcome, but the biggest challenge that parents and teachers have raised with me is a social one, not an academic one. Teachers have told me that children have forgotten what it means to be in school—how to act and behave—and having to relearn all of that after having changed those behaviours as they are not used to being around groups of people, seeing their friends or being in the classroom. They have shrunk back into their shells after having spent so much time on their own, and it is a challenge now to draw them out again. That means we need to focus not only on academia but on the social side of things.

We should offer more support to extracurricular activities, including sport. Let us not forget the health and fitness impact, too, and the inequalities that will have grown as a result of lockdown and the inactivity that came with it. We could start by looking seriously at how we can open up our sports facilities. Some 40% of our nation’s sports facilities remain locked behind school gates at evenings and weekends.

We have to focus on transitioning children back into the classroom when they need it, and supporting teachers to do that. Children moving to secondary school this year, for example, will have missed so much of the transitional process that they normally would get. The Government could promote and support things such as nurture provision at both primary and secondary level to help children adapt and ease into school life at their own pace, rather than being chucked in at the deep end. I hope the Government will be able to support schools to deliver some year 7 transition as much as possible for the end of this year.

A few years ago, the then Health Secretary, my right hon. Friend the Member for South West Surrey (Jeremy Hunt), launched a programme of introducing and expanding mental health support in schools. I spoke to the Schools Minister recently about that. Will he update the House on any discussions about whether that plan, which at the time seemed wide ranging and positive, is considered still to be adequate, or can we speed it up and extend it in the light of the struggles that many will face as a result of the pandemic?

On the issue of academia, the Prime Minister’s idea of one-to-one tutoring could be great if it could be done as an addition to the social support that is needed. It will be important to work across schools, colleges and universities to ensure that there is a recognition of the challenges that young people have faced and of the difference between grades given this year compared with other years, because clearly nobody should be disadvantaged as they seek to move on to the next stage of their lives.

All of that calls into question some of what we do around our assessment. I am no detractor from testing at all—I think it is important—but we saw the major challenges faced as a result of so much of our assessment being built only on exams at the end of the year. In the absence of those, there have been all sorts of problems. Obviously, other countries have different systems. Some have an ongoing system of teacher-led assessment as a matter of course. I wonder how the Minister feels those countries might have compared in terms of the challenges of assessment through this period.

I particularly question whether there is really a need to formally assess year 2 students, for example. Also, in the light of covid, perhaps we should be more willing to trust our teachers and to rely on their ongoing assessment as to what children in their care need. They are better placed to assess the ability and the support needed by children at a young age than an exam paper is, particularly if the needs of those children at four, five or six years old are more social as opposed to academic. Perhaps that is something we could look at. Teachers’ knowledge of what their students need will be more important than ever as we seek to recover from the pandemic. Both teachers and students would benefit from having that trust in their relationship within schools to help support children.

There are lessons to take from online learning, too. Although some have struggled, others have loved it and have excelled. They have attended, whereas they might not have done before. There may be a role for using remote learning permanently in some instances. My local college reported excellent attendance among some of the students who had not been engaged or showing up before; it reported excellent work and excellent progress by, for example, many students with autism, who might have struggled in a classroom environment but found online learning really positive. Across the board, but perhaps particularly for post-16 and with SEND pupils, we should review how remote learning could benefit young people. I know that is part of the Prime Minister’s plan for independent and individual tutoring.

Finally, I will touch on skills. I welcome the Government’s further education White Paper, which has some excellent proposals for boosting and supporting further education. The Minister knows my view that many children would benefit from more access to technical and vocational education as part of their curriculum within school or from being allowed out to college earlier in their school life. I have always felt that is an opportunity for the 18% who currently leave school with no qualifications at all to do something different, and to fall in love with education through learning in a way that is directly linked to the world of work or to things they enjoy.

Given the impact on so many children who have been out of education for so long and the challenge of getting them back into the classroom and comfortable in the classroom again, I hope the Minister will give consideration to how that might work, not only as a chance to get young people back into learning after covid, but to complement the FE reforms that have been brought forward by the Government and to help all our young people to get the most out of education in the long term, including that 18% who previously have not managed to get those qualifications through traditional schooling.

With that, I will wrap up. I finish by saying that this is hugely important and, as I said at the start of my speech, we owe it to all our young people and our children to put them at the heart of our recovery plans. Ultimately, they are the ones who will have to deal with this for the longest, for the future of our country, our economy and all of us, and they should be front and centre of every decision we make as we look to recover from this pandemic.

It is a pleasure to serve under your chairmanship, Mr Betts. I thank my hon. Friend the Member for Waveney (Peter Aldous) for obtaining this important debate.

Further education is hugely important not only for the economy and for the levelling-up agenda post-covid, but for the long term. Skills and education are the key to the long-term shift if we are to truly bring some of the most disadvantaged parts of our country up into line with everyone else and give people the opportunities they need and deserve. My hon. Friend the Minister is ably leading some hugely positive work in the Department for Education right now, including shifting the dial around further and higher education and the balance of what we advocate for our young people––where we push them in terms of education.

We know that HE outcomes are not as good as we would hope in many cases. There is a huge opportunity through further education and technical and vocational skills to advance and to get better qualifications and earning power at the end of it all than many young people get from HE. That includes the new T-levels and the better access to apprenticeships for SMEs that was in the recent lifelong learning announcement. That plan also includes the level 3 entitlement for adults. For communities like mine in Mansfield, where a huge proportion of adults do not have level 3 qualifications, that will give them the right to go back, for free and funded by the Government, and access skills and retraining that will help them get a better job or get back into work post coronavirus. The lifelong learning loans element will help adults to access higher levels of qualifications if they wish. That is hugely important.

It is very welcome that West Notts College in my constituency has had its first capital funding for a very long time. That has gone down very well. My hon. Friend the Member for Waveney rightly pointed out the connection between the wider regeneration piece––town deals––and the skills and retraining agenda. We hope Mansfield will invest some of its town deal money in things like student accommodation, new skills and retraining commitments, and new premises to supplement the work being done by Nottingham Trent University and West Notts College in partnership, which is bringing better FE, better technical qualifications and HE degree qualifications to Mansfield so that young people can access them on their doorstep. That is all hugely positive for the future.

The Government are doing good work in this space and we can add to that post-coronavirus things such as the kickstart scheme and additional funding to support apprenticeships and promote those opportunities to business. There is some really good stuff, and it is key to the regeneration piece, to levelling up our country and to supporting communities like Mansfield.

The Secretary of State is bang on when he says that FE needs that boost and to provide an equal level of opportunity to the HE sector, into which young people are so often pushed whether or not it is the right thing. We need to make the case from this place, from Government and from business that FE presents a huge opportunity for young people to get into work and to get the skills and help they need for good employment opportunities.

My ask for the Government is to work with good college leaders on local priorities. I keep raising the example of West Notts College and its work with Nottingham Trent University, which is a really positive example of what could be done elsewhere. It would be great to have the Minister along, as we have discussed before, to see that when it is possible.

We need to look at the apprenticeship levy. We have made it easier for SMEs to access that funding to bring apprenticeships into smaller businesses. The regular feedback on the levy is that it is complicated and that businesses need help to access that money.

On age, I have never understood why we think FE and technical and vocational skills are so brilliant post-16, but are so averse to letting 15 or 14-year-olds have a go at these subjects. That would be really positive and help a lot of the most disadvantaged young people who are disaffected at school to find a reason to stay in education. There is some really good stuff happening in this space and I thank the Minister for all the work she is doing. I look forward to working with her in future.

I beg to move,

That this House has considered ensuring that the Equality Act 2010 protects children from disadvantaged backgrounds.

I raise this matter today because, in truth, I am not convinced that it does. In fact, my view is that the misapplication and misinterpretation of the Equality Act 2010 has led to the exclusion of some of our country’s poorest people. Whether by flaw of design or subsequent false interpretation, the Act does not deliver what was intended. That is not something we should shy away from just because it is difficult or because it cuts against the popular narrative on diversity. It is important. If we listened to that narrative—the one that holds sway in the media and on Twitter—we would be forgiven for believing that protected characteristics in the Act are things such as black, Asian and minority ethnic, female, or lesbian, gay, bisexual and transgender. That is how usually it is put across, even by our institutions, by businesses and even by Government Ministers and Departments on the odd occasion. In truth, that is not correct. The characteristics listed, in fact, are race, sex, sexuality, among others. In fact, a white heterosexual male has just as much protection under the Act as a black, gay female. It is equal, hence the name.

Sometimes it seems like nobody knows this. It is actually quite mad. Rather than the Equality Act 2010 existing to prevent discrimination, an awful lot of people in influential positions—even in our national institutions—seem to be under the impression that the Act and its provisions on positive action give them the right to actively discriminate in favour of certain groups. Discrimination on the basis of those characteristics is, of course, illegal, whether it has “positive” as a prefix or not, but it seems commonplace. For example, there are countless scholarships and bursaries for higher levels of study offered only to BAME students. That is not positive action, I am afraid; that is discrimination. There is a difference. Encouraging under-represented BAME students to apply for scholarships, yes; excluding all white students from a scholarship on the basis of their race should be a no. That is the very definition of discrimination, and it is even worse when, without the lens of identity politics, it is actually the disadvantaged white children who struggle most to access higher education, not BAME children. That positive discrimination favours a group that already does better statistically, and at the expense of the most under-represented. But as I have said, that is commonplace. The Act, or at least its interpretation and implementation, is fundamentally flawed.

According to research by the writer and commentator Douglas Murray, the Act has, in the main, tended to support and promote those who are already closest to their destination, rather than digging down into supporting those in genuine need, perhaps due to the lack of provision around socioeconomic circumstances. There is a socioeconomic duty in the Act, in section 1, which puts a duty on public bodies to exercise their duties in a way that is designed to reduce socioeconomic inequalities. However, that section has never been enacted. I am not a legal expert and I am sure there is a reason for that: perhaps some unintended consequences that would occur if it were enacted, or perhaps a perception that it is unnecessary—a public body should already be doing that. I know that is not directly in the Minister’s brief but, following the debate, can she ask the Equalities Minister to write to me on the issue?

It seems clear that socioeconomic status or social class is, in fact, the greatest indicator of life chances, but that is not a protected characteristic nor is it enacted in section 1. I am sure that there is a reason.

My hon. Friend is making an excellent speech and a very good case, not just on the specific points he has mentioned, but on the wider principle of making sure that the Equality Act actually works. I wish to add to his list the issue of geographical disadvantage. Often, where a person is born in this country—not just the family they are born into but the geographical disadvantages—is a key factor that very often gets overlooked and does not get addressed.

My hon. Friend is absolutely right. A person’s access to services, for example, can be limited or decided by where they are lucky enough to be born. A key point I am making throughout this speech is that those differences in equality of opportunity exist outside of the protected characteristics enshrined in the Act and that there are other reasons people might not have that same opportunity that we should be addressing.

A lack of provision around socioeconomic equality in the Act and the perverse consequences of the misinterpretation of protected characteristics and positive action means that it can often seem like every other group in society has support and is protected by the Act apart from the most disadvantaged white children, and white boys and men in particular. Recently, UCAS statistics showed that only 9% of white boys on free school meals go to university. The second lowest was white girls on free school meals at 14%. White boys from disadvantaged backgrounds are most likely to drop out of school with no qualifications and have the lowest rate of achieving GCSEs, followed by disadvantaged white girls. In contrast, black or Asian girls have the highest chances of going to university. If those statistics were reversed, I guarantee that there would be an uproar. In BAME groups too, boys tend to do worse than girls.

Rates of grammar school entry is another area in which results differ based on ethnic background. Disadvantaged white British children enter grammar school at the lowest rate of any major ethnic group. Disadvantaged Indian pupils are four times more likely to attend, and Chinese pupils are 15 times more likely. Again, across all races and ethnicities, boys are lower in the rankings than girls.

In education at least, the constant false interpretation of the Act, which promotes positive action for BAME and female pupils, seems entirely backwards. Disadvantaged white boys are statistically faring the worst. They are under-represented at universities and in our public institutions, and their life chances are most limited because they are most likely to have no qualifications.

The popular narrative of white privilege is regularly wheeled out, and it is assumed that those poorest white children do not face discrimination on that basis, but in fact they do. If we step outside the Twitter bubble, we are faced with the stark reality that, through that kind of rhetoric, our society is ignoring what is statistically one of its most vulnerable demographics. As it happens, those lads are more likely than anyone to chuck themselves under a train, and that is not a coincidence.

It could be argued, if one were so inclined, that the Act, or at least the unfettered misapplication of it, has played a part in exacerbating this problem. I have long argued that identity politics is divisive and unhelpful, and the Act enshrines it in our law. It does not recognise the individual needs of the most disadvantaged people, and it actively supports the advancement of others through so-called positive action based not on their actual individual needs or disadvantage, and not on any actual discrimination or barriers they face as individuals, but on the basis of broad assumptions based on their physical characteristics.

The identity politics—the lumping of people into boxes, rather than considering their individual circumstances—that is enshrined in the Act is deeply troubling. We have seen it manifest itself in other ways that have become part of the popular narrative recently. But it is surely the case that privilege or hardship are not based on which of these characteristic boxes a person ticks but are down to their wider individual circumstances—things such as socioeconomic background or geography, which my hon. Friend the Member for St Austell and Newquay (Steve Double) mentioned. Socioeconomic status and social class are more indicative of a person’s life chances than their physical characteristics. Physical characteristics play a part, of course. Discrimination, racism, misogyny and homophobia exist, but they are one part of a more complex picture—one segment of an individual’s life experience and opportunity. We should help people based on their actual needs, not on guesswork based on flawed metrics. The interpretation and implementation of the Act is deeply flawed.

I am fed up to the back teeth with identity politics. I do not want to be stood here saying, “White kids this,” and, “White kids that.” I value all kids and their futures, and the support they get should be based on what they need, not on the colour of their skin, their gender or any other grand narrative that we concoct to make ourselves feel better. Separating black and white, gay and straight, male and female in that way is combative and unhelpful, but it sometimes feels like I have to highlight white disadvantaged kids and their plight, because otherwise they do not seem to get a look in.

If we talk generally about disadvantage, the system and our legislation—this misinterpretation of the Equality Act—always seem to bring the discussion back around to the BAME, female and other misinterpretations that we have enshrined in law. If we do not say “white kids”, the popular narrative and the system seem to leave them behind—and have done so in many cases—in favour of a fundamentally flawed diversity agenda, which is hugely frustrating and, in many ways, wrong.

In closing, I want to ask the Minister some questions. I do not know the answers, and I do not expect her to know the answers, but I hope they will be taken away for consideration. As an Education Minister, she will no doubt have some remarks about the points I have made about education, which I would welcome. The Secretary of State has been clear about his wish to support more disadvantaged white working-class boys into university, for example, if that is their aspiration, and that is very welcome.

I have some questions about the Equality Act itself, and I wonder whether the Minister can take them away and perhaps raise them with colleagues in the Government Equalities Office. First, why has the socioeconomic provision within the Act not been enacted? If it is flawed or inappropriate in its detail, how can we fix it? What protections can the Act offer to those who face barriers and discrimination based on being poor, being in care or other hardships that are not recognised in this law? Secondly, if the answer is “none”, will the Government look closely at the implications of that section of the Act and seek to amend it in a way that offers such support?

Thirdly, will the Government review the implications of amending the Act to remove or change any damaging positive action elements that go way beyond preventing discrimination and, due to the constant misinterpretation of those who claim ownership of it, appear in practice to condone positive discrimination to the exclusion of some of our country’s poorest people?

Finally, at the very least, the Government should consider clearly restating the actual aims and nature of the provisions of the Act, laying out the reality, challenging the false rhetoric around it and requiring their own officers and institutions to implement it in a fair and balanced way. There are fundamental flaws in the way the Act is implemented, whether owing to poor design or poor interpretation. Left unchallenged, that has made things worse for some of the most vulnerable children in our society. This narrative has led, for example, to fee-paying schools rejecting charitable support for disadvantaged children based on their race, and we have heard in recent weeks that it has led to racial segregation in UK businesses, such as Sainsbury’s. It is unhealthy and a backward step. Something needs to change.

I congratulate my hon. Friend the Member for Mansfield (Ben Bradley) on securing this really important debate. As he knows, ensuring equality of opportunity is a topic that is close to my heart. I feel privileged to be part of a Government that holds this important issue as a real priority.

The Equality Act provides protection to all children, as well as to adults. We must get away from the perception that protected characteristics in the Act are there only to protect certain groups and exclude others. For example, a white boy at school is covered by the Act in the same way, and to the same extent, as his BAME classmates or schoolgirls of any race. If a white boy from a disadvantaged background feels he has been treated less fairly in educational work compared with his female or BAME peers, he has a means of redress available to him, initially through informal routes, but ultimately at a tribunal if it is felt to be necessary.

My hon. Friend the Member for Mansfield asked about the elements of the Act that relate to positive action. The Act enables positive action to help to ensure that all groups of society are fairly represented, but that is not the same as positive discrimination, where one group might be unfairly favoured over another. Positive action is designed to enable the promotion of a level playing field. An example of positive action is when an employer wants to address the fact that it does not have any disabled apprentices; the employer can favour the recruitment of a disabled applicant over a non-disabled one, provided that their applications are broadly of equal merit. That is positive action.

Positive discrimination is unlawful under the Equality Act, however. If people have evidence of positive discrimination, they should take such cases to the courts or tribunals and call out breaches, to help to ensure that the positive action provisions are used only as intended. The provisions were supported across Parliament when the legislation was brought in in 2010. We support them as a means of levelling up the playing field for disadvantaged groups, but it is really important that the public and private sectors understand the lawful use of positive action. The code of practice and guidance exist for that purpose.

My hon. Friend the Member for Mansfield also asked, most perceptively, about the socioeconomic provisions in the Act. Social status is not one of the characteristics protected by the Act, and we need to be careful not to use it as a vehicle for social engineering rather than as a shield against discrimination. A duty of that kind would more likely result in public bodies trying to retrofit a levelling-down agenda, rather than offering better opportunities for all disadvantaged groups and levelling up.

Positive action is designed to enable opportunities to be given, as opposed to positive discrimination, which is unlawful. That is why it is so important that the guidance is clear on the subject. We need to promote the level playing field and enable levelling up, and not encourage behaviour that could constitute levelling down.

We need to avoid taking a tick-box approach. Amending part 1 of the Equality Act would not necessarily lead to what my hon. Friend seeks, because there is a real danger that it could create a tick-box mentality, which might be seen as an acceptable substitute for meaningful action. We want to avoid such distractions and concentrate on real help. I assure him that the action he has taken today has ensured that the Government will keep both the legislation and the guidance under review.

We are also improving our approach to equalities. We are reshaping the Government Equalities Office, bringing it closer together with the race disparity unit and the disability unit to create an equality hub. We need to move away from the idea that we are simply dealing with groups that already enjoy Equality Act protection, and instead ensure that we are looking at individuals across the country and identifying those who are most in need, what their biggest barriers to success are and where there is unequal delivery of public services. We want to examine issues such as geography, as my hon. Friend the Member for St Austell and Newquay (Steve Double) mentioned, where communities in certain areas risk being held back. We also should be focusing on analysing the data, looking closely at individual dignity and opportunity and also at areas such as income and background, so that we have a more holistic view.

We understand, however, that pupils from disadvantaged backgrounds, including boys, may face greater challenges at every stage of education. We are committed to addressing those challenges, levelling up education standards and improving outcomes.

Absolutely. One of my passions is the early years of development, and too many children, especially those from disadvantaged backgrounds, are falling behind in those early years. It is then so hard to close the gaps once they have emerged, and evidence shows us that what happens in a child’s pre-school years—those very early years—are the most important and have a huge influence on later outcomes. That is why the Government have been making record investments in early education, including 15 hours of free education for all disadvantaged two-year-olds as well as three and four-year-olds. It is also why we have doubled the amount of free childcare available to three and four-year-olds for working parents.

These investments have led to a real improvement. The latest early years foundation profile shows that the proportion of all children reaching a good stage of development by the time they start school—year 1—has gone up from 51%, or one in two children, in 2013 to nearly 72%, or two in three children, in 2019. Furthermore, over the same period, the gap between the children who are eligible for free school meals and their peers at age five has narrowed from 19 percentage points to just under 18 percentage points. Indeed, the same is true in school: because of the education reforms that were mentioned by my hon. Friend the Member for Warrington South (Andy Carter), 86% of schools are now judged to be good or outstanding, compared with only 68% of schools in 2010. As a result, the disadvantage attainment gap has narrowed by 13% at age 11 and by 9% at age 16, and it has narrowed at every stage from early years to age 16 since 2011. However, we know there are still issues in other areas, so we have committed an extra £18 million to the £72 million opportunity areas programme to transform the life chances of young people in 12 of the most disadvantaged areas of the country—those with particularly low social mobility.

My hon. Friend the Member for Warrington South also mentioned the very important issue of exclusions. It used to be the case that looked-after children—children in care—had the very highest rates of permanent exclusion, and we are making sure that those children in care, who often have the worst life outcomes, are supported to succeed in education. For example, we have put in place virtual school heads, designated teachers for looked-after children, and extra funding through the pupil premium plus for this group. The virtual school heads, in particular, have made a significant impact since they were introduced in 2014. Data shows progress across maths, reading and writing for looked-after children, and today, looked-after children are less likely to be permanently excluded from school than all other children. Interventions of this nature are making a real impact on some really disadvantaged groups.

However, we know that the disadvantage gap is at risk of widening because of the pandemic. Lack of digital access is of particular concern, and that is why we have committed over £160 million to support remote education access and provided nearly half a million laptops and tablets to those most in need. We have also announced the £1 billion covid catch-up fund, of which £350 million is going into the national tutoring programme. That will particularly focus support from high-quality tutors on disadvantaged and vulnerable children who are most at risk of falling further behind. The first group of tutors starts on 1 November, and I strongly urge all my hon. Friends to ensure that schools in their constituencies are aware of that element of the catch-up programme and ensure that the vulnerable students in their area receive support.

I do not expect an answer to this, but I want to highlight a challenge. The poorest school in my constituency in the poorest catchment is very keen to access support for IT, tutoring and everything else, but 25% of parents within the school are illiterate and they do not want to take laptops home because they fear that the laptops will be stolen, or that they will targeted by gangs involved in drugs on the estate where they live. There are children on free school meals, and then there is another group of children who have this huge disadvantage. Will the Government consider that group, who will not be able to engage with laptops and tutors? Is there something else we can do to help them?

My hon. Friend raises an excellent point. This is why the national tutoring programme will bring extra resources into schools to help young people. That will be on top of the £650 million catch-up fund that has gone to all schools. It will provide extra tutoring and support—one on one, or in small groups—for those individuals, for whom it is so important. This is a deeply challenging time, and we absolutely understand that we need to make sure that the attainment gap does not unnecessarily widen any more. We have spent a decade trying to close it, and we need to make sure that it does not spring apart again, particularly for the cohorts of children that my hon. Friend mentions.

I am enormously grateful for my hon. Friend’s support for this agenda. He has raised important concerns. I particularly note his questions, which we will take up with the Equalities Office. I hope I have helped to explain the difference between positive action, which is allowed, and positive discrimination, which is not. I point him again to the need for continual work on the guidance on this subject, and I will make sure that I continue to raise these points with the Minister for Equalities, my hon. Friend the Member for Saffron Walden (Kemi Badenoch). I hope my hon. Friend the Member for Mansfield is happy that the Government’s response today echoes his concerns. We have taken steps to underline the importance of supporting the most disadvantaged and vulnerable, and to make sure that all children from all backgrounds, including the most disadvantaged, have the best opportunities in life.

The hon. Lady rightly raises an important point, and under equalities legislation there is a duty on universities to ensure that there is proper and fair provision for all students. That is what we would expect from all universities. I wonder whether she would be kind enough to share with me the details of the survey. I know that my hon. Friend the Minister for Universities would very much like to follow this up in a meeting with her to discuss it in more detail. As we have touched upon in terms of the availability of devices and the £100 million fund, I certainly hope that youngsters who are suffering with disability would be a top priority for any university, but I look forward to my hon. Friend taking this further in discussions with the hon. Lady and hopefully offering her full and total reassurance on that matter.

Much has been made of the short-term impact on students and on universities, but there is a long-term impact too, and we have known for a while that for increasing numbers of university students the graduate outcomes are not great. This health crisis is only going to exacerbate that problem, so will my right hon. Friend take this opportunity to examine the choices that we are offering to young people as they leave school and what the proper role for universities in our education system might be?

My hon. Friend knows very well that, while I am a passionate advocate for universities, I cannot help feeling that we must never ignore the great opportunities that are offered through our further education colleges and through apprenticeship routes. For far too long, this area has been ignored. We need to see changes, we need to see improvement and we have to make sure young people realise that sometimes these opportunities are as good as, and in some cases much better than, going to university. That is what we are looking at delivering and what we are going to deliver as part of this Government’s agenda.

The pandemic has raised a huge number of challenging and unprecedented problems that the Government have had to grapple with. They have had to create countless schemes and programmes to support us and to keep us safe, and are now having to find ways to unravel it all while the playing field continually changes around them. These have been necessary responses to questions that the pandemic has asked of them, and they have had to do it in record time.

With schools, there is no easy answer. Nothing will ever be able to cover, even in the short term, for the amazing job that teachers across Mansfield and Worksop do, week in, week out. With schools being closed, we knew that children’s learning would suffer. We knew that ever-tightening restrictions were going to make it impossible to hold exams. We can look back now and say that maybe it could have been different, but at the time the widely accepted truth was that we must close the schools and plan for an alternative system of assessment.

The Ofqual formula was an imperfect solution to an impossible problem. In hindsight, it was not right that those from lower-income areas had their grades disproportionately affected. It was not right, clearly, for a child to get a U for an exam they were never allowed to sit. That was hugely problematic. Hindsight is a wonderful thing. Perhaps it could have been done differently. But the Government employ experts in the form of Ofqual to manage these processes, and at the time those at Ofqual were offering reassurances to Ministers that it would be okay. They have since apologised for getting it wrong. They too are only human, and every other nation of our United Kingdom had come to the same conclusion.

What this says to me on a broader level is to do with the problematic nature of these structures of government run by a kind of quangocracy that we have had for many decades now, which blurs the lines of accountability and decision making. I hope that the Government will address that over the course of this Parliament.

I was glad that Ofqual agreed for teacher-assessed grades to be awarded to pupils who were unable to sit exams. That was the correct way to proceed given where we have ended up. It is still not perfect—it throws up questions about grade inflation and impacts on universities in future years—but we have eventually got to the right place.

I know at first hand from my own experience how long and hard Ministers and officials in the DFE have worked to try to rectify the problems. I know how many phone calls my hon. Friend the Minister for Universities, for example, has made to universities to try to get them to go back and make more offers to students and to support them. I know how much time Ministers have offered me to raise concerns, ideas and issues, and I am very grateful to them for that. Nothing is perfect in a pandemic, and I know that what has gone on has been incredibly frustrating, but I have seen how committed the Department has been to trying to make it work. We should all be grateful for that. The key thing now is that lessons must be learned from these challenges. Let us look at the relationship between FE and HE, at the admissions process and at the Government’s decision-making structures and ensure that we do these things better in future. We also need to draw a line and move forward, in the best interests of our children and young people, which I know the Secretary of State is committed to doing.

I have written to my hon. Friend the Minister with responsibility for further education, about West Nottinghamshire College and how Education and Skills Funding Agency restrictions are limiting how it can support progress in my community. Will the Secretary of State commit to working with me to help the college find a way to navigate these barriers and fulfil its potential in delivering the best possible FE for our community in Mansfield?

It has been incredibly impressive to see the turnaround at West Nottinghamshire College and the work that has already been undertaken. I would be more than happy to work with my hon. Friend to see what opportunities can be created in the future for this college, which has had some difficult times, but is very much looking to the future with optimism and with a real sense of purpose in delivering the very best for young people in his constituency.

It is a pleasure to follow my hon. Friend the Member for Ruislip, Northwood and Pinner (David Simmonds), and I wholly endorse his words. The case for supporting the most vulnerable children is more important than ever. I have always argued that the compulsory education years are a key time for the state to intervene and equip young people with the skills they need to be independent adults, with the opportunities and personal responsibilities to make a success of their lives. For those leaving school this year and in coming years, that is likely to be more challenging than normal, and we must offer extra support so that those young people are not left behind. Many teachers and school leaders have been working hard to understand and implement huge amounts of guidance and changes, and to support children as best they can in difficult circumstances. I know the whole House is incredibly grateful for that work.

The funding boost across our schools will be welcomed and is much needed. The planned increases will now be supplemented by a £1 billion covid catch-up fund to help schools provide additional support for students who will have missed up to six months of education. I am pleased we have been able to get children in key transition years back into school, but hugely frustrated that all children were not able to go back, as that will have a major impact. The commitment to having all children back in school in September is vital. As my right hon. Friend the Member for East Hampshire (Damian Hinds), a former Secretary of State said, if we can, we must get back to a programme that is as full as possible to support our children in September, with all the rounded support and activities that come with that.

Across the age range, support must focus on the most disadvantaged children, because we know that the existing attainment gap will only be exacerbated by time off school. Children who were struggling pre-coronavirus because of chaotic home lives, for example, will have found things even tougher, and we cannot allow that to impact on their long-term life chances any further.

The promise of targeted and funded tuition can be of great benefit to those children, and I hope it will be taken up as widely as possible, along with the £650 million that has been made available for schools to use flexibly. Although that offers an additional challenge for schools, I think it is the right approach. Schools and school leaders know the children best, and they know what is likely to be the best support for their school communities. Combined with a relaxation of the rules on summer clubs, and the reopening of youth provision, that is a major step forward. The challenge is now a logistical one, as schools will have to bring in external providers, find venues, and in many cases try to facilitate that work by pooling resources between schools or across local authorities to get the best provision. That will be a huge challenge in the coming weeks.

My hon. Friend is another splendid advocate for this topic. Does he think that school buildings are some of the most under-utilised buildings in our local areas, and that the third sector can play a huge part in helping to support the work he suggests?

My hon. Friend is right, and I remember from my own time at primary school that external providers came in successfully to do things such as sport and PE. That seems to have disappeared to some extent, whether because of funding or other issues, but a great deal can be done with external providers. I would particularly push for youth work to be a bigger part of our school community and work more closely with our schools and teachers.

On the summer programme, much emphasis has been placed on academic catch-up, which is hugely important, but as chair of the all-party group for sport, it would not be right for me to ignore the importance of regular sport and activity for the mental and physical health of our young people. Some children will have been out and about during lockdown, taking advantage of that hour of daily exercise to try new things and be active, but many others will have been far less active than normal. I am pleased that the Government have committed to the PE premium funding, which was confirmed this weekend. Keeping kids healthy, and teaching the importance of regular exercise and activity, is just as important as the academic side of things, and it needs to be part of catch-up planning. As my hon. Friend the Member for Stoke-on-Trent North (Jonathan Gullis) said, this might even be an opportunity to make more of the school estate and, when school facilities are open over the summer, to open those sports facilities that are often locked behind school gates at evenings and weekends to the wider community. Perhaps we could consider that in more detail.

I would welcome a steer from the Minister about the welcome £1 billion funding for capital investments, how my local schools might bid or access that funding, and when the timescales and plans will be laid out, so that as a local MP I can support them to secure some of that funding, which I know they feel is much needed.

I have only a short amount of time left to speak, so I apologise for rushing Madam Deputy Speaker, but I wish to welcome the approach to further education that Ministers have articulated in recent weeks. We must consider the role of skills in further education—including in our colleges—as more of a priority, and finally accept that the endless drive for all children to go to universities is not always helpful. Further education, including adult learning and retraining will play a huge role in the coming years—I know that West Nottinghamshire College in Mansfield takes that very seriously and is being incredibly proactive and looking for positive intervention. I have laid out a number of ideas on this issue privately to Ministers, and in various recent publications. I think that will be beneficial—many of them are in line with what my hon. Friend the Member for Bury South (Christian Wakeford) said earlier—and I hope that as we lay out new programmes and funding, those ideas will be taken into account.

In this House we all understand the profound impact that this pandemic has had on people’s lives. Supporting those on lower incomes and vulnerable families is at the heart of everything that we do as a Government. We have taken unprecedented action to support individuals and also to support families. We stepped in to pay the wages of over 9 million people through one of the most generous schemes anywhere in the world. We have launched self-employed income support schemes. We have increased universal credit and working tax credit by over £1,000 a year, injecting more than £6.5 billion into the welfare system. This Government have been firmly and wholeheartedly on the side of those who need help and support at every stage of this pandemic. We have provided millions of families with the support they need to pay their bills, keep their homes and feed their families. At times of crisis, we must think, above all, about the most vulnerable in our society. No one in this House, on either side of the Chamber, ever wants to see a child go hungry. We are all united in that simple view.

Let me remind hon. Members of the Conservative party’s record on free school meals. From 2014, free school meals were offered to further education students for the first time ever in the history of the free school meals programme. We extended free school meals to all infant children in England’s state schools, and an extra 1.5 million children are now receiving a healthy school lunch as a result of that decision. In our response to covid-19, we have for the first time provided free school meals for those who are currently at home.

We must remember that free school meals are not about providing financial support for families; they are there to support a child’s education. Receiving a healthy, nourishing meal is a critical way of helping a child to focus and to learn in school. It helps to enable a child to fulfil their potential, which is essential if we want to break the cycle of poverty from which far too many children right across the country suffer.

My right hon. Friend is correct to say that the will to support these vulnerable children is felt across the House and that it unites us all. I have one concern that I hope he will alleviate. Many of the most vulnerable children do not live in happy, healthy households. We often find that those children—the ones that schools normally look out for—are in a position where their parents are not necessarily going to use those vouchers in the right way, and the current system seems to have no safeguards against that. My constituency has one of the highest levels of domestic abuse and one of the highest levels of addiction anywhere in the country. Can we add, before the summer, a mechanism to ensure that the vouchers are used for healthy meals for vulnerable children?

I can assure my hon. Friend that measures are in place to ensure that the vouchers are not used for things such as alcohol, cigarettes or gambling. That is an important protection. He touches on an important point, because one of the greatest strengths of our free school meals system, where children get a free meal at their school, is ensuring that it is a healthy meal and it is there to support the child.
