I beg to move,

That this House has considered e-petitions 234627, 234797 and 235653 relating to the BBC.

It is a great pleasure to be here under your chairmanship, Mr Wilson. All three petitions relate to the BBC. One calls for a public inquiry on what the signatories perceive as bias in the BBC, another calls for the abolition of the licence fee, and the third is about the restoration of free TV licences for the over-75s.

As we have previously debated the licence fee, and with it a number of accusations of bias, I do not propose to spend much time on it this afternoon, because lots of people want to speak. But let me be clear: as Harold Wilson said, public inquiries take minutes and last for years, and they seldom solve anything—certainly nothing as subjective as perceived bias. Although the BBC sometimes gets things wrong, as any organisation does, I do not believe it is inherently biased in its news and coverage of current affairs. Indeed, we ought to remember that the BBC’s news coverage is looked at around the world as a beacon of straightforward, unbiased news reporting. As a country, we ought to be proud of that. If it has a bias, it is probably towards London, as those of us who have sat through items about London stations on the national news will know. It does not reflect the regions and nations of this country well.

The hon. Lady just said that we ought to be proud of the BBC. Does she acknowledge that, as a country, we are very proud of it? Not only is it one of this country’s most popular institutions, but it is a source of great credit for this country around the world. Whatever mistakes it makes, they should be framed by that overall attitude.

I agree. The reason for the BBC’s popularity is that we maintain the model of public service broadcasting. People who want to get rid of the licence fee ought to remember that a public service broadcaster is free of commercial and sponsorship influence in its news, and that it provides a far wider range of channels and radio stations than that provided by broadcasters that aim at niche markets. In fact, the BBC’s output has to cater for a whole range of tastes, including minority interests.

There is no doubt that the decision to end free TV licences for the over-75s, and to restrict them to people in receipt of pension credit, has damaged hugely the BBC’s reputation. The decision has been met with almost universal condemnation. In fact, only the Taxpayers Alliance, which seems to get a lot of its funding from people who do not pay British tax, is in favour of it. Nevertheless, the real villain of the piece is not the BBC, but the Government. In 2017 they fought an election on a manifesto that promised to maintain free TV licences for the duration of this Parliament, knowing full well that in 2015 they had entered into an agreement with the BBC that made it impossible.

Does the Secretary of State understand that the dismissive answers that the Under-Secretary of State for Pensions, the hon. Member for Watford (Richard Harrington), gave about the problems faced by WASPI women are a slap in the face to women who have worked all their lives and in many cases have retired to look after sick or elderly relatives, thus saving this country millions of pounds? It is time that Ministers recognised that those who have done the right thing ought to be looked at and their situation alleviated.

Since the original legislation was passed more than 20 years ago, and since the Pensions Act 2011, the Government committed £1.1 billion to lessen the impact of the changes for those affected. In the end, we have to address the issue that having the same pension age for men and women is fair, and that at a time when we are all living longer it is necessary, if we are to keep a credible pensions system going, for the pension age to go up gradually for both sexes. [Interruption.] I am sorry that many people in the Labour party do not seem to accept those basic facts of arithmetic, but they are basis facts and the mitigations that were put in place mean that no one has seen their pension age change by more than 18 months compared to the previous timetable—[Interruption.] For 81% of those women the increase will be no more than 12 months. Finally, for the hon. Member for Denton and Reddish (Andrew Gwynne) who is shouting from the Front Bench, other countries have done this faster than the UK. In nine European Union countries, including Germany, Denmark and the Netherlands, all of which run extremely sophisticated welfare systems, the state pension age was 65 for women as far back as 2009, so the Labour party will have to accept these basic facts.

I am pleased to report to my hon. Friend that we are making significant progress. Increased use of the victim surcharge means that more money is available for victims’ services than ever before, and we hope in time to double the amount that is currently available from £50 million to £100 million. I am sure that the whole House will welcome the fact that the extra money will come from offenders themselves.

As the Minister will know, those who deal with victims of domestic violence fear that the services they currently receive will not be maintained when police commissioners take over the provision of support for victims, and those in areas such as Warrington still do not know how much money will be provided in April. Is he prepared to give the House a commitment that support for those very vulnerable victims will be maintained?

Obviously that will be a decision for individual police and crime commissioners, but they will all be very aware of the need to help, in particular, the most vulnerable victims. As I have said, not only will the total budget available be greater than ever before—[Interruption.] The hon. Lady says that I am not deciding how the budget is distributed. No, I am not: the decision is being made by elected people at local level, and I think that that is more likely to provide locally sensitive and tailored services than a decision made by someone sitting in London.

The Government are committed to putting victims first at every stage of the criminal justice system. We are implementing a wide range of reforms to make sure that victims and witnesses get the support they deserve and to ensure that their voice is heard. This includes work to improve awareness of, and access to, support services and special measures in court, and the piloting of recorded pre-trial cross-examination of vulnerable and intimidated witnesses.

The hon. Gentleman needs to differentiate services that protect women from violence and specialist provision for those dealing with forced marriages. They are two parts of the same thing, but the current evidence is that specialised services for black and ethnic minority women—services that they feel more comfortable accessing because the people there understand the cultural background—are being closed at a greater rate than other refuges. That is a worry.

My point to the Minister is that the legislation is all very well, but unfortunately, unless he ensures that there are services to allow women and girls to make use of the legislation and access the services they need, the Opposition will be forced to conclude that the Government will the ends but are unwilling to fund the means. We need a much more joined-up approach from the Home Office, the Department for Education, the Department of Health and the Department for Communities and Local Government if the legislation is to protect people in future. We do not oppose but welcome the Government’s new clauses, but that is the test we will apply to the Government.

Fees for criminal record certificates etc

‘In Part 5 of the Police Act 1997 (criminal record certificates etc), in section 125 (regulations), after subsection (1) there is inserted—

“(1A) In prescribing the amount of a fee that—

(a) is payable in relation to applications under a particular provision of this Part, but

(b) is not payable in relation to applications made by volunteers,

the Secretary of State may take into account not only the costs associated with applications in relation to which the fee is payable but also the costs associated with applications under that provision made by volunteers.”’.—(Damian Green.)

I rise to oppose the motion. I should like to start, as my hon. Friend the Member for Reigate (Mr Blunt) suggested, by outlining the overall context of services for victims of crime, of which the criminal injuries compensation scheme is just a part. The Under-Secretary, my hon. Friend the Member for Maidstone and The Weald (Mrs Grant), has pointed out throughout the important debates on this subject that support for victims and witnesses is a high priority of the Government.

At the beginning of this year, the Government launched a consultation, “Getting it right for victims and witnesses”, which set out a wide-ranging and ambitious reform package that will see us move from the previous one-size-fits-all model for supporting victims, with priority being given instead to the victims of serious crime, to the most vulnerable and to the most persistently targeted. Our reforms will also see police and crime commissioners using their local knowledge to ensure that victims get the services they need. There will, for example, be an increase in the use of restorative justice. There will also be a new victims code setting out clearly what victims should expect from the criminal justice system—not least that they should always be treated with dignity and respect.

How is it treating a victim with respect if the children of a homicide victim, for example, could lose their compensation if the parent had worked all his or her life and then been out of work for a short period in the three years before the crime?

I shall come on later in my speech to the individual criticisms made of the changes, if the hon. Lady can be patient.

To return to the overall context, more victims will have the opportunity, through greater use of the victim personal statement, to tell the courts how crime has affected them. There will be compensation for victims of overseas terrorism and, following the recent announcement by my right hon. Friend the Secretary of State, there will be a new victims commissioner—directly to address the point of the right hon. Member for Tooting (Sadiq Khan)—who will present the views of victims clearly, with integrity and with force to Westminster, to Whitehall, to the media and to the public at large.

On top of all this—and more, such as putting funding for rape support centres on a sustainable footing and opening new centres, with more to come where there are gaps in provision; and such as ensuring better support for the victims of human trafficking through a contract let last year with the Salvation Army—we will raise up to £50 million extra from offenders to pay for more and better services for victims. The changes to the victim surcharge came into effect on 1 October, which means revenue will start to be received next spring, building on the success we have had over the past year in raising money for victims through the Prisoners’ Earnings Act 1996—some £800,000 so far, with more to come.

The consultation also set out proposals to reform the criminal injuries compensation scheme. It announced that for victims of overseas terrorism, there would be a scheme for existing victims going back to 2002 and another scheme for future victims. We published the Government response to the consultation in July. In sum, this record demonstrates that we are determined, as we said in the consultation, to get it right and ensure that victims of crime get the help they need to cope with, and recover from, the effects of crime. That is the context.

I have given way enough, and I know how many Members wish to contribute to the debate.

Those who sustain injuries of a more permanent nature will generally still be able to claim, because if an injury has a lasting impact it usually appears again further up the tariff. Let me also restate the point I partially made to the hon. Member for Strangford (Jim Shannon): tariff awards for sexual offences and patterns of physical abuse will remain at their current levels wherever they currently apply in the tariff. That will enable better protection for victims of domestic violence, for example, who very often are subjected to more than one assault. We have certainly defined the eligibility more tightly so that only those direct and blameless victims of crime who fully co-operate with the criminal justice system process obtain compensation under the scheme, and I think that is right.

Various points have been made about dogs, but the one that cannot be repeated often enough is that under our charges the authority will pay only where the dog was set on the victim by its owner—in other words, where it was used as a weapon—because this is meant to be a compensation scheme for criminal injuries. As I explained, the ability of victims of sexual offences to apply for compensation needs to be preserved, and we have done that.

One point that I have not yet addressed relates to loss of earnings. The scheme has never compensated the actual value of lost earnings, but these payments still account for a large part of the cost of the scheme. The payments are intended not to put the applicant back in the position they were in prior to the injury but to provide a safety net. There are, of course, other benefits provided by the state for which applicants may be eligible, but in making our changes we are no longer reducing loss of earnings payments to take account of those other benefits.

I have briefly mentioned the hardship fund. We recognise that some very low earners, be they employed or self-employed, may, as a result of the removal of bands 1 to 5, find themselves in real and immediate financial hardship. They will need short-term assistance, so we will make payments for up to four weeks’ absence from work, which will enable those most in need to keep their heads above water while they recover from their injuries. The fund will be administered by the Criminal Injuries Compensation Authority, at no additional cost, with a referral function provided by Victim Support. Applications will be processed quickly and payment made promptly, ensuring that debt is not accrued.

As I pointed out earlier, even those on low pay who are receiving statutory sick pay can be plunged into debt. In the past, their compensation in the lower bands has at least gone some way to relieving that debt. The Minister has to answer the question: why does he believe a victim of crime should be plunged into debt that they cannot get out of simply because they have been a victim? Offering them support services, however good, does not pay their bills.
