Urgent Question: To ask the Secretary of State to make a statement on the maintenance and repair of service family accommodation.

I thank the hon. Gentleman for his urgent question.

The provision of safe, good quality and well-maintained accommodation is an irreducible minimum when it comes to supporting our armed forces. It is essential to operational output, recruitment, retention, and morale, which is why providing such accommodation is a core priority of the Ministry of Defence.

More than 96% of the MOD service family accommodation of 46,000 properties meets or exceeds the Government’s Decent Homes Standard. Only those properties that meet this standard are allocated to service families. However, it is unacceptable that some of our personnel and their families are not receiving the level of accommodation services—in the form of maintenance standards—from our suppliers that they deserve and, in particular, are suffering from a lack of heating and hot water. I have spoken to a number of our personnel, from a range of ranks and circumstances, and I share their indignation. It is not acceptable.

MOD contractors are under a legal, but also a moral, duty to resolve heating and hot water problems. What are those duties? Emergency calls should be responded to, and the issue made safe within two hours. An emergency is an incident that threatens imminent risk of injury to persons, or that presents a high risk of extensive damage to property or the environment. Urgent calls should be responded to as soon as possible and within 48 hours. Those are the terms of the contract that were agreed, but our suppliers in too many cases are failing to meet those requirements. We expect and demand that our suppliers do better, and we will do everything we legally and properly can to force them to do so. Let me be clear: no home should be left without heating or hot water for more than 24 hours. Should it not be possible to resolve the issue quickly, alternative forms of heating and sources of hot water, or alternative accommodation, must be provided.

Rectification plans were triggered by the Ministry of Defence earlier this year following concerns about contractor performance. Since then, access to temporary heaters for families without heating has been improved. A total of 1,500 additional heaters have been purchased, and they are being dispersed at various locations based on several factors, including where there is a high density of homes.

Secondly, there is an increased use of temporary accommodation to support families with vulnerable people, or where some form of heating cannot be restored in a reasonable time. Thirdly, more staff are being recruited by Pinnacle, VIVO and Amey and, following a call to the National Service Centre about a heating or hot water issue, families will be contacted by a qualified engineer to support the diagnosis of faults, enable remote fixes if possible, and arrange an appointment if a remote fix cannot be achieved. All families will also be provided with temporary heaters, or offered alternative accommodation, should a fix not be possible.

Fourthly, I can confirm that compensation will be paid to families to cover any increased energy costs caused by the use of temporary heaters. VIVO, Amey and Pinnacle are, I know, in no doubt about Ministers’ profound dissatisfaction at their performance. I have met them already and I am meeting them again later today. This is not any old contract. This is a contract to support the accommodation of British service personnel and their families—the people who answer the call of the nation to step up and defend us when required. These contractors must improve. They will improve, or they will face the consequences.

I thank the Minister for his response. There will be complete agreement, I am sure, on the importance of looking out for those amazing men and women who serve in our armed forces and, critically, their families as well. The Minister will be well aware—he alluded to this in his statement—of the volume of concerns about the state of service family accommodation and single living accommodation. It is particularly concerning given the recent freezing weather and proximity to Christmas, but it is also at a time when our armed forces continue to be busy, not least, potentially, with commitments to Military Aid to the Civil Authorities.

Some shocking recent accommodation cases include: recurring black mould causing viral infections in children; crumbling roofs leaving houses exposed to the elements; burst pipes flooding homes; and broken boilers in sub-zero temperatures. What is worse is that, currently, there is no reasonable way to report and resolve those problems, as there are waits of two hours on Pinnacle’s helpline, if callers can get through at all. Even when a report is lodged, there is no guarantee that a repair will happen urgently.

Such are the concerns that have been expressed about the inaction of various contractors, there is evidence of soldiers signing out sleeping bags. No single contractor is responsible for repairs and maintenance, meaning that there is no central responsibility. However, there is central accountability, and, ultimately, that lies with the MOD.

Those who step forward to serve deserve and expect better. I look to the Minister to act urgently, by which I mean today, to move heaven and earth to ensure that measures are being taken to alleviate this problem. Can I ask him to provide an update on whether the Secretary of State’s meetings with the Defence Infrastructure Organisation, Amey, Pinnacle and VIVO have taken place? If not, why not? Can he outline a plan for MOD intervention to ensure that the backlog of repairs is dealt with as a priority? Can he say more on how the Department will support service personnel and their families affected by these issues over the Christmas holidays?

The current standards of service accommodation are just not good enough. We are a very long way away from homes fit for heroes. The Government must do better.

I thank the hon. Gentleman for those remarks, many of which I completely agree with. He asks whether we will act today. I can say that the Secretary of State has met the DIO, Pinnacle, Amey and VIVO and that some of these issues were becoming apparent quite some time ago. In fact, a rectification plan was imposed in the middle of September. There were 480 or so elements of that plan, of which 200 have been complied with. That does not mean that the situation has been sorted—far from it—because when the cold snap came, we saw that it revealed more difficulties.

The hon. Gentleman asked about the backlog. I can say that the backlog of complaints peaked at a stunning 4,200 or so. That has come down to around 3,100, but I completely accept that that is far too many.

The real issue, it seems to me, is there must be prevention in the first place. In other words, the quality of accommodation must be good enough at the point that service personnel go into the properties in the first place. There are some indications of improvement in that regard. First, in addition to the standard £176 million for accommodation, the MOD has allocated £350 million over and above that annual sum to get on top of the maintenance issues. In July of this year, when 1,276 service personnel went into properties, 4% turned out on the day to have non-habitable failures; by December that figure had gone down to 0.6%. This is about ensuring that the properties are fit for purpose at the outset.

On the issue of mould, which the hon. Gentleman is right to raise, it is unconscionable to think that people should be moving into properties with any mould, and I am pleased to have had a clear assurance from DIO that that will not happen again. Now, if there is a report of mould, a fully qualified inspector should come in to do a proper report and alternative accommodation should be provided, if appropriate. I will end where he did: these are people who come to serve our country, and the least we can do is ensure that they have proper accommodation. I will do everything in my power to ensure that we honour that requirement.

I very much appreciate my right hon. Friend’s point. We have focused on individuals in the questioning so far, and I would like to point out that our principal concern is elucidating any systemic factors that have not been investigated fully as a result of the investigations we have had up to this point.

In particular, I would expect Lord Justice Haddon-Cave to be mindful of ensuring that we are compliant with our obligations under article 2 specifically, and articles 2 and 3 more generally, as we are required to be under our treaty obligations, and to learn things more generally about what went on that may help us to improve what we do. That is the reason for the investigation. It most certainly is not to pillory individuals or to seek to repeat the service investigations by the service police that have already been done, which have been externally and independently validated, if that brings any comfort to my right hon. Friend.

May I declare an interest as a former company commander with the special forces support group who served in Afghanistan? As such, I know that the overwhelming number of people who serve in our armed forces, and particularly in the UKSF, do so with huge distinction and extraordinary courage. As the Minister said, we can be very proud of their service. They rightly aspire to maintain the very highest of professional standards and adherence to the rule of law. After all, it is that which differentiates us from our opponents. As the Minister said, it is therefore necessary that, when serious allegations are made, they are investigated, but that needs to be done thoroughly and independently, so I welcome the statement that the Minister has made today.

Clearly, none of us would want to prejudge the inquiry, but, looking slightly to the longer term, has the Minister or the Department given any consideration to the potential merits of tasking the Intelligence and Security Committee to provide oversight of UKSF?

Christmas leave is precious, so can the Secretary of State or one of his Ministers confirm that any serving personnel losing their leave over the Christmas period in order to support MACA—military aid to the civil authorities—commitments will be properly compensated?

The hon. Gentleman will know about this because, I am afraid that, under Governments of both parties, we have been involved as former soldiers in meeting the consequences of strikes, whether the tanker strikes, fire strikes or ambulance strikes, which are potentially approaching. Yes, soldiers and sailors would prefer to be doing their day job of defending their country, but sometimes they are called upon when the unions put at risk the safety of parts of this country and do so over a festive period. Perhaps the hon. Gentleman can have a word with his hon. Friends on the Opposition Front Bench and ask them to get his unions to desist.

I thank the hon. Lady for her intervention. I would like to have a discussion about the glorification of terrorism with her outside the Chamber, and I thank her for raising it and putting it on the record.

We must recognise that everyone’s experiences and sacrifices are unique, and that the nature of the support they receive must reflect that. I commend the Government for acknowledging the need for targeted and specialist support through the introduction of the armed forces personnel in transition framework, which should ensure that seriously wounded armed forces personnel with very complex and enduring healthcare requirements who are transitioning into civilian life will continue to receive comprehensive support throughout their lifetime, although I and others would welcome assurances from the Government that integrated personal commissioning for veterans is being implemented effectively.

I congratulate my hon. Friend on an excellent speech. I am particularly pleased that she has mentioned the integrated personal commissioning for veterans scheme—IPC4V—which I know was set up with veterans such as Ben Parkinson in mind. Ben Parkinson is a hero and I have been in regular contact with him and his family for a number of years. I am concerned that worries have been expressed recently about whether Ministry of Defence funding is still in place to enable charities to provide the vital services that veterans like Ben need, as was the case previously. Does my hon. Friend agree that we must ensure that those veterans’ needs are always met? Soldiers like Ben Parkinson have done their duty to our country, and we must do our duty to them by ensuring that they get the treatment they need for the duration of their lives.

I thank my hon. Friend for that contribution. It is essential that that funding is there from the MOD, and I would like to work with him on this. I am sure that the Minister will do so as well.

I said at the start of this contribution that I wanted to talk about people, and I want to talk about a few of the people I have come to know and about their journeys, because it is important that their stories should be heard from these green Benches. I want to tell the House about Pete and the impact that his ambition has had, not just on him but on the support that service people and veterans like him are now able to access though a phenomenal organisation that I have been lucky enough to work with called 65 Degrees North.

Pete Bowker was a lance corporal in the Queen’s Dragoon Guards. When on tour in Afghanistan, the armoured vehicle in which he was traveling was hit by an improvised explosive device. As a result of the blast, Pete lost his right leg below the knee and was discharged in 2012. In 2015, Pete became the world’s first amputee to cross the Greenland ice cap unsupported. Pete was assisted by a team put together by the formidable Richard Morgan, a former Royal Marines commando. When Rich met Pete—that sounds like a film, doesn’t it?—in 2013, as part of a team taking part in a 10-day endurance challenge to raise money for wounded, injured and sick servicemen and women, Pete told Rich about his ambition to cross the Greenland ice cap and how he had struggled to get support for it, so Rich decided to help him, because that is what Rich is like. Even when he discovered that Pete did not know how to ski—imagine that!—which is pretty important for someone trying to get across Greenland, he still carried on.

The expedition to Greenland not only fulfilled Pete’s ambition; it started something bigger. Seeing the impact of the Greenland expedition, the team behind it saw the potential for adventure in rehabilitation, which is how 65 Degrees North began. In the years since, 65 Degrees North has helped more than 100 wounded, injured and sick service personnel and veterans realise their ambitions. Offering this community the opportunity to participate in challenging, unique and, honestly, arduous expeditions, which I do not think I could achieve, supports them to regain their confidence, change their behaviours and tackle PTSD by offering a form of participation centred on rehabilitation in which outcomes are clear, tangible and empowering—that is the word.

What we do in Defence is probably world-beating—I would like to think so—but Ofsted is involved in assessing training throughout Defence, including in phase 1 and phase 2 establishments. In general, Ofsted’s reviews have been pretty positive, and I am more than happy to share them with the hon. Lady if she would like me to.

I could not possibly conclude a debate such as this without mentioning Operation Courage. Launched in April 2019, the service helps veterans to recover from the hidden harms that conflict inflicts on mind and body. I know the hon. Lady is well aware of that.

Alongside Op Courage is our veteran trauma network, which offers veterans support for service-related physical healthcare problems. The network comprises 18 NHS veteran trauma centres and NHS specialist units, each with its own military and civilian expertise. I accept that that is not enough, and we are working on more to come, in particular a £5 million research fund. This area is a fruitful one for further research to improve the offer we are able to make to our servicepeople and veterans, and in particular to develop innovative surgical techniques, improve rehabilitation from blast injuries and adapt intervention technologies for mild traumatic brain injury, among other things.

I must briefly mention the creation of the National Rehabilitation Centre, which is very exciting. Working alongside the national health service, it will be a 70-bed specialist clinic unit bringing patient care, research, and training and education under one roof. I pay tribute to the former vice-chief of the defence staff, General Sir Tim Granville-Chapman, for his work in that area. I look forward to the NRC’s opening formally in 2024, but in the meantime there is much collaboration between the DMRC and the NRC.

On the point the hon. Member for Barnsley Central (Dan Jarvis) made about IPC4V, he seemed to suggest it was going to be closed down or downgraded, but I can assure him that is not the case. It was only launched in March 2019. He is right to mention Ben Parkinson as an exemplar, and I can reassure him about our commitment to it; we are even scoping extending the reach of the scheme, if that is of any help to him. I am more than happy to discuss the matter with him further.

I am grateful to the Minister for the response he has just provided. I know he takes these matters very seriously. Does he recall seeing an important piece in The Sunday Times a couple of months ago, written by David Collins, which raised specific concerns about the support provided to the most seriously injured veterans? I wrote to his predecessor about it and would obviously be very happy to write to him about it too. I just ask him to look at the points flagged in that article and satisfy himself that the necessary provision is in place for people such as Ben Parkinson.

Finally, we will strive to make this place the best in the world to be a veteran while offering the gold standard in rehabilitation services for all those who serve. When the call came, they answered. In their hour of need we must do the same.

I thought that somebody might ask that, so I asked my officials before coming to Committee. This is a consequential statutory instrument, which simply replicates what is currently the practice under the Armed Forces Act 2021. Without it, the new defence serious crime unit would not be doing the things that service police are already doing. One could argue that commanding officers should not be provided with reports about people under their command. However, in the 2021 Act and its predecessor, the Armed Forces Act 2006, Parliament decided that such a report should be provided. That is the reason we are doing this now, and changing primary legislation is not the function of this Committee. I am sorry if that is an unsatisfactory response to my hon. Friend, but I am very pleased he asked the question because, as I said, I had asked the same.

I think that the Committee will be interested in the victim and witness care unit, which will be set up under the DSCU. The unit will deliver support to victims and witnesses of crime. The unit is being developed in consultation with specialist external organisations, such as the Survivors Trust and the office of the Victims Commissioner, and is expected to be fully operational in early 2023. The regulations deliver on the recommendations of the Henriques review, and mean that the Ministry of Defence will be in a stronger position to respond to serious crime. We will be able to combine resources and specialist skills across the single services under one unit, and will provide an independent, more effective and collaborative approach to policing across defence. I will seek to provide further updates after the DSCU has become fully operational and, in particular, after I have visited in the near future, which I look forward to.

I welcome the points that the Minister is making. I think I am right in saying that the Government have said that the DSCU will be independently inspected by His Majesty’s inspectorate of constabulary. The Minister will know, as I do, that every branch of the armed forces takes seriously the issue of how their performance is evaluated and how they can seek to do things better in future. Can the Minister confirm that there will be an independent inspection? If that is the plan, does he envisage that the findings of the independent inspection, when it takes place at some point in the future—I am mindful that the unit has not even been set up yet—will be published?

Yes, I anticipate that this will be dealt with in exactly the same way as for any other constabulary, if that is helpful. I will move on to the second statutory instrument that we are debating, the Armed Forces (Court Martial) (Amendment) Rules 2022, because I am quite sure that they will be of interest to the Committee. The SI consists of the changes to the rules that apply to courts martial that were contained in schedule 1 to the Armed Forces Act 2021, with three of the four changes implementing recommendations from the Lyons review of the service justice system.

The first rule change implements Lyons’s recommendation that a six-member board should be required if the offence is a schedule 2 offence. These are serious offences, such as grievous bodily harm, which must always be referred to service police for investigation rather than being dealt with by a commanding officer, or that carry a maximum penalty of more than two years’ imprisonment. His Honour Shaun Lyons found that there was widespread agreement that the five-member boards, which currently try schedule 2 offences and offences carrying a maximum term of over seven years’ imprisonment, should be increased in size to six and reach qualified majority verdicts, rather than a simple majority verdict in which at least five of the six members have agreed.

His Honour Shaun Lyons also recommended that those boards try schedule 2 offences and offences carrying a maximum of over two rather than seven years’ imprisonment. He recommended that smaller boards, which will continue to consist of three or four members, should try all other cases and deal with sentencing in all cases where the defendants have pleaded guilty, as they do now. We accept this recommendation, which will allow the three-member boards to focus on the great majority of the service disciplinary offences contained in the Armed Forces Act 2006 and the less serious criminal offences that would normally be heard in the magistrates court in a civilian criminal justice system. Six-member boards will deal with the relatively small number of disciplinary offences that carry a sentence of over two years’ imprisonment, such as assisting the enemy or mutiny, as well as criminal conduct that would normally be tried in the Crown Court. We do not anticipate that lowering the threshold for when a six-member board is required—when the offence attracts a punishment of more than two years—will place an untenable resource burden on the single services, since the existing pools of personnel provided for court martial service are sufficient to meet the new requirement. However, we will monitor the situation for the first 12 months after introduction and consider whether any adjustments to the approach outlined might be required.

The second rule change has its background in the pingdemic that occurred during the covid pandemic, which highlighted the concern that three-member boards hearing cases lasting several days can be vulnerable to the unexpected loss of one member of the board. To deal with this, the Armed Forces Act 2021 gave judge advocates the power to add a fourth member to a three-member board.

In recent days, Russia has made a range of allegations against the UK and other international partners that are clearly designed to distract from the attention on Russia’s illegal invasion of Ukraine. I did indeed receive a letter from the Russians that seemed to demonstrate everything that has been announced by the Government either in this House or in the media going way back to the times of Op Orbital. As yet, I still await the groundbreaking evidence, but I do not expect it to come because we know for sure that Russia is involved in misinformation.

It is the right thing to do to refresh the integrated review. The Minister said earlier that he was not ruling anything in or out from a capability point of view, but does he agree that it would be wise not to make any cuts to capability until the integrated review refresh reports, hopefully before Christmas?

I took steps immediately to close the gap, if there was one, in that last year we purchased a significant number of new parachutes off the shelf. The hon. Gentleman will be aware, given his interest in airborne forces, that both the German and French air forces have on numerous occasions jumped out of A400s, and it is odd that we have not yet done that, so that is not the reason why this matter has not progressed. We are making sure that we have the right equipment and the right training for pilots. We are on track to do that, but I will give him an update. Just like him, I think it is incredibly important that the RAF gets on and does this.

I hope that I explained in my previous remarks the importance that Defence assigns to this, particularly when it comes to senior officers who may be complicit in some of the behaviour that we are discussing. This is very important: if someone’s career is on the line, it does affect their thinking fairly dramatically. I would also commend to the hon. Member the victim and witness care unit that will be established by December for the most serious offences, which will give people much-needed support that was previously lacking.

I welcome the Minister back to his post. Will he join me in noting the amazing achievement of Private Carter, who just last week became the first woman soldier to pass the all-arms pre-parachute selection course, P Company? It is a timely reminder of the outstanding contribution that women make to our armed forces. Does the Minister agree with me that every woman who steps forward to serve, whether in the Royal Navy or whichever bit of defence it might be, deserves nothing less than complete and total respect at all times?

I entirely agree with the hon. Gentleman. It is no mean feat even these days to join the armed forces as a woman. The challenges remain enormous, although I hope they are becoming less. I am particularly proud of my two daughters who are serving in the armed forces. Respect to them and strength to their arm.

I welcome the Minister to his new role. Specifically in response to the war in Ukraine, the Prime Minister made a commitment to update the integrated review, and we now know that Professor John Bew is leading a process from Downing Street that aims to report before Christmas. Given the concern expressed by Members across the House about potential loss of capability and personnel, does the Minister think that it would be prudent not to make any cuts to defence until we know what the outcome of that review is going to be?

As the hon. Gentleman knows, it is a commitment of the Government to increase spending on defence—to move to 3% by the end of the 2030s, with 2.5% on the way—but we have already increased defence spending by £24 billion in real terms since 2020, and there are no plans to cut the defence budget at this time.

My hon. Friend is right to observe the unique, often global, expertise of our mine-clearing capabilities. We have Ukrainians being trained in that right now in Portsmouth, and at the same time we are working with other Black sea nations in the same space. Obviously, with the Montreux treaty being invoked by Turkey, we cannot put military ships into the Black sea, but we are teaching and supporting Ukraine and our other colleagues in the Black sea.

There has always been strong cross-party support for our military assistance in Ukraine, and I am sure that will continue. Like the shadow Secretary of State, I clocked the commitment that the incoming Prime Minister made on 24 July to update the integrated review in response to Putin’s illegal invasion of Ukraine. Will the Secretary of State say a bit more about what preparations are being made to do that and, critically, whether in the interim there will be no cuts to capability, including personnel?

The size of the Army currently stands at about 79,000. There has not yet been a reduction from the 82,000 as such. In fact, I think it is higher than when I first started as Defence Secretary, so my record is in the wrong direction at the moment. We will obviously look at the issues around vulnerabilities. The integrated review identified Russia as our most pressing adversary, and I do not think that anybody is going to need to change that observation. If we receive more funding—I think the first preparation for battle will be with the Treasury, to make sure that we get the profile that makes the difference—I will of course be delighted to have a much wider conversation with all Members of the House about where they envisage us spending that money in order to make our armed forces the very best they can be. We have a role to play not just in Ukraine and Europe, but globally. That is one of our differences and I would be delighted to explore more with hon. Members.
