Written Question
Brexit
Tuesday 11th December 2018

Asked by: Dan Poulter (Labour - Central Suffolk and North Ipswich)

Question to the Department for Exiting the European Union :

To ask the Secretary of State for Exiting the European Union, whether the UK is able unilaterally to withdraw from the proposed EU withdrawal agreement; and if he will make a statement.

Answered by Kwasi Kwarteng

It is a matter of customary international law, by which the UK is bound, that unilateral termination is prohibited outside the terms of a treaty. The Withdrawal Agreement contains no provision regarding termination and therefore, once in force, the UK would not be able unilaterally to terminate it.

Leaving the EU

"There is a point of view—I think a legitimate one—that as it took us passing an Act of Parliament to enter the European Union, Parliament will also legally be required to pass an Act of Parliament to take us out. That does not mean those of us who take that …..."
