Northern Ireland (Executive Formation) Bill

"Having sat through the debate, I think it is quite clear that nobody really wants this Bill. It is a contingency Bill. We all hope that the discussions and meetings will bear fruit and that the Assembly and Executive will be up and running. We all want that to happen, …..."

Written Question
Offences against the Person Act 1861: Northern Ireland
Wednesday 27th June 2018

Asked by: Diana Johnson (Labour - Kingston upon Hull North and Cottingham)

Question to the Northern Ireland Office:

To ask the Secretary of State for Northern Ireland, whether she will exercise her power under section 26(2) of the Northern Ireland Act 1998 to repeal sections 58 and 59 of the Offences Against the Person Act 1861 in order to comply with the UK's international obligations under the United Nations Convention on the Elimination of All Forms of Discrimination against Women.

Answered by Karen Bradley

The Government has no plans to amend the law on abortion in either England and Wales or Northern Ireland.

Abortion has always been a devolved matter in Northern Ireland. The Government's priority is therefore restoring devolved government, so that the people of Northern Ireland, and locally elected representatives, can decide what is right for Northern Ireland.

In the previous Parliament—in March 2017—the repeal of sections 58 and 59 of the Offences Against the Person Act 1861 was debated after I brought in a ten-minute rule Bill. There was a vote in this Parliament, …..."

Offences Against the Person Act 1861

"Since I have been in Parliament, our debates about this issue have always been about restricting and reducing women’s right to abortion and right to choose. Three things have heartened me in the past 12 months, however. First, in March last year, we had a debate here on a ten-minute …..."
