Will the Secretary of State confirm that the Government remain committed to resettling 23,000 of the most vulnerable children and adults directly from Syria, the middle east and north Africa over this Parliament, in addition to asylum seekers and family reunion cases? Will she update the House on how many people have been resettled in the past year?

I reassure my hon. Friend that we remain committed to those numbers, ensuring that we protect and move people over from the region. We have, in fact, brought over 4,369 in the past 12 months. The last Labour Government capped their figure at 750 per year, and we are pleased to be doing five times that every year.

The hon. Gentleman knows, from his own personal experience, the efforts that go into countering terrorism—the resource, the man hours, the risks taken. As a Northern Ireland Member, he will also know that it is an “easier said than done” job. It is very hard to deal with all the threats every day, and people have to make judgments. It is important to understand that we can rarely advertise our successes, whereas unfortunately, in some cases, people choose to focus on other areas that come to light. It is important to remember that people make judgment calls in good faith to keep people safe, and it is not an easy thing to do. I have the highest regard for our intelligence services and police, who have to make life-and-death decisions every day without any reward, recognition or benefit.

Does my hon. Friend agree that this case shows the moral, legal and security dilemmas thrown up when someone is suspected of terrorism or of intending to commit an act of terror but there is not sufficient evidence to convict them, even in closed session? There were loud protests in favour of closing Guantanamo Bay, and now an outcry when a former detainee goes on to commit an act of terror.

There is always a balance to be struck in how we live in our society. Britain is open for business and open for trade, and that implies an element of open borders. We have to allow some to-ing and fro-ing for us to prosper. This is also about a balance between the rights of individuals and the rights of the state to interfere in people’s lives. It is a very tricky balance, and a live balance, that is struck every day, and we do it within the rule of law. We are grateful, as are any Government, when we get the House’s support for measures such as the Justice and Security Act 2013 that improve the accountability of our law enforcement and intelligence agencies. That is the challenge, and it will not change no matter who is sitting on the Treasury Bench. It is a balance we must always try to strike and do better with.

I want to make some more progress.

This year, we created the police transformation fund—the grant settlement is not the only source of money for policing—which has already provided investment to develop specialist capabilities to tackle cybercrime and other emerging crimes, and has provided a major uplift in firearms capability and capacity. The fund will increase by £40 million next year to £175 million. We will continue to allocate additional specific funding for counter-terrorism to ensure that critical national counter-terrorism capabilities are maintained. Counter-terrorism police funding continues to be protected and, in fact, will increase to £675 million in 2017-18. That reinforces our commitment to protect the public from the threat of terrorism. The House and the public can be in no doubt that the police will have the resources they need to do their crucial work, and will be given the investment necessary to provide a more modern and efficient police service.

I think my right hon. Friend will agree that we have the most professional armed police officers in the world. The statistics on fatalities bear that out. Does he agree that forces outside London must upscale their armed capacity to match the level that we have in London in view of the terror threat that affects the whole country?

This comes back to the point that it is important that local police and crime commissioners, working with their chief constables, are able to assess the operational needs for their area and to work across policing. The National Police Chiefs Council is doing very well in ensuring that police forces are working across areas, and that chief constables are working together for the benefit of the country. The Metropolitan police has a big part to play in that, being such a large part of policing in this country.

I absolutely agree. Dr Clare Gerada, who spoke at the presentation I held last year, said exactly the same thing: they already have duties to look after vulnerable people. By making Prevent statutory, we are pressurising them, which could lead to them being affected if, for example, they feel that somebody should not be referred in a particular case.

The hon. Lady is making a good case against Prevent. However, she said that it is not achieving anything. Will she set out the evidence for that assertion?

All I hear is that the people who are being affected are annoyed by it, and they are getting upset. It is not achieving anything because the communities we need to have on board are not. It is therefore a waste of time, money and resources.

If we want to deal with radicalisation, whether far-right radicalisation or any other fundamentalism, there are ways of doing that. However, we should not use this method, which criminalises people. For example, in schools we could have classes taught to everyone, not to particular groups, about the dangers of the internet. We do not talk enough about the amount of online grooming, pornography on websites, how many young people are being bullied in schools and how much sex texting is going on. All those things are part of safeguarding. We should invest in classes in junior and secondary schools where all the children get together and are taught about all the dangers they could face, so that they can discuss and deal with them together. That would mean we could prevent them from facing such issues, whether far-right, sexual or whatever. We should not do that in the way that has happened since the Prevent programme was rolled out.

I want to make two final points. All of these measures come from the fact that there are security issues. However, we must remember one thing. I know we are talking about the far right, but we must remember that while the measures all came out of so-called Islamic terrorism, 99% of the people who have died as a result of Daesh, al-Qaeda and other such groups have been Muslims, whether in the middle east or the UK. Far-right extremism has killed Muslims in Canada, USA, Norway, the UK and other countries. Yes, there is an issue with people having right-wing or fundamentalist views, and we need to challenge those views, but Prevent is not the way to do so.

We say that Prevent is about British values. I am not making a joke of this, but the President of the USA, through what he has said and his Executive orders, has contravened every single fundamental British value. When he comes to the UK, he should be put in the Prevent programme, along with his adviser, Steve Bannon, who is a right-wing fascist and white supremacist. Both should be put in the Prevent programme when they come to the UK.

It is a pleasure to serve under your chairmanship, Sir David. I congratulate my hon. Friend the Member for Telford (Lucy Allan) on securing this debate.

I recognise that there are concerns about Prevent, and I have heard those concerns from a range of different people. As a member of the Home Affairs Committee and as someone with an interest in this area, I have taken the time to speak to Muslim groups with the Committee, and to members of the Muslim community, police officers and teachers. I have not spoken to any far right extremists yet, but I am sure we will get some in to the Home Affairs Committee in due course.

There are two polar opposite views. Prevent is viewed as a vital tool in the fight against terrorism and absolutely essential, or it is said to be discredited because it targets Muslims and places unfair obligations on the public sector. It is important to note that Prevent is just one of the four elements of the Contest counter-extremism strategy that aims to stop people becoming terrorists or supporting terrorism or extremism. In answer to the point made by the hon. Member for Bolton South East (Yasmin Qureshi) about success, it is difficult to measure success when there is no counterfactual, but I am sure that the Minister will tell us about the success that the Prevent programme has had, because I have heard that from some of Britain’s most senior police officers.

It is important to start by asking what we would do tomorrow if we cancelled the Prevent programme today. I asked one of the most senior counter-terrorism officers in the country about this and he was very open-minded. He said, “If we do not like Prevent and we get rid of it, what do we replace it with?” We would surely want a system for identifying people such as the poor young girls from east London—the people who have committed no criminal offence but suddenly slide into radicalism and attempt to go off to somewhere such as Syria. We need a means of identifying them and preventing them from going.

On exactly the same point, those young ladies in the school were very bright. The teachers could not see anything wrong with anything they had done, so Prevent did nothing for them and would not have noted them.

That is right, but that is certainly not an argument for getting rid of Prevent. There are countless other cases in which the Prevent duty would result in issues being picked up. That is why there have been 1,000 voluntary referrals to Channel, where people have been channelled away from any risks. That is what the Contest strategy does.

This hypothetical was tested when the Home Affairs Committee went on a trip to the USA. Two members of the Committee who went on the trip are in the Chamber today. We asked the Americans what they did about domestic counter-terrorism prevention and whether they had a Prevent type of programme. The answer was no, they did not have such a programme. They recognised that that was a gap in their toolkit and they were actually looking at the British system, although the Committee members did point out some of the deficiencies and gave them some advice. Of course, the trip took place under the Obama regime before Donald Trump became President. If only President Trump were focusing on domestic terrorism, which is where the threat actually comes from, rather than banning people coming from seven countries with currently no risk of terrorism on American soil. However, the Americans are looking at a strategy because they do not have a system like Prevent on their soil at the moment.

I will turn to the two main objections. The first is that Prevent targets Muslims. It is right that 70% of those who have been directed to Channel for voluntary referrals have been Muslims and 15% have been far right extremists who are not Muslims. That fact does not mean that the Muslim community is being targeted, but I understand why members of the Muslim community, including the young people we met on the trip organised by the hon. Member for Bradford West (Naz Shah), felt that way. It is right that the Government should do more to publicise the cases of far right extremists who have been dealt with under the policy, because the people we spoke to on that trip simply were not aware of them, even though the cases were well publicised.

Equally, we have to guard against the reality that some groups such as Cage, a disgraceful organisation that gave evidence to the Home Affairs Committee, would make sustained efforts to undermine any replacement of the Prevent programme, just as they have done with Prevent. They have spoken out, criticised and been involved in threats against Muslim groups who stand up and support Prevent or elements of Prevent. They do that because they do not even accept that a problem exists that needs tackling by something such as Prevent in the first place.

My hon. Friend is making a very good speech. Does he agree that one of the successes of the Prevent programme has been—for example, in the health service—raising awareness of people who may be vulnerable? People with mental illness are particularly susceptible to adverse influences and potentially susceptible to extremists of all different types exploiting them. The programme has also helped to encourage partnership working between the NHS and the police, because there is often strong clinical judgment exerted and used in such cases.

I agree with everything that my hon. Friend said. That brings me to the second main criticism of Prevent—that it puts undue pressure on teachers, doctors and social workers. It is true that they are not policemen and are already under huge pressure—I know that teachers are, because my mother was one—because of all sorts of duties of the kind, besides their core one of teaching. However, they are the people with day-to-day contact with young people and they have the opportunity to notice what others, including the police, may not. That is why they have similar duties to report child abuse, female genital mutilation, forced marriage and the like. We rely on them to pick up things that others might miss or parents would not report.

The hon. Gentleman is right to say that teachers are among those who have regular contact with young people, and it should be part of professional practice to notice when children’s behaviour changes—such as becoming withdrawn or difficult. However, teachers and parents in my constituency tell me that the way the Prevent duty on professionals is perceived is breaking down trust between families, parents and schools. Does the hon. Gentleman agree that that must be addressed if the programme is to work effectively?

That certainly must be addressed, but I agree with my hon. Friend the Member for Central Suffolk and North Ipswich (Dr Poulter) that the Prevent duty has led to much greater awareness among professionals of what to look for and how to help. We need a way to pick up the signs of radicalisation before it is too late and innocent lives are devastated by being drawn into the ideologies in question. Prevent, the current system, certainly has issues that need to be worked through, and the hon. Member for Stretford and Urmston (Kate Green) raises a good point. There is a need for constant updating, but equally, if we were to replace Prevent it could only be with a similar duty. Whatever we replaced it with would come under sustained attack, and it is our duty in the House to stand up for the Government’s efforts as well as to scrutinise and criticise them as we are doing.

Will the Minister congratulate councils such as Kingston Council that have come forward to host vulnerable Syrian refugees, and also the families who have done so? Will he explain that it is still the case that refugees require individual housing, rather than joining a family in an existing house, for very good reasons? Lots of these people are victims of the most terrible atrocities.

My hon. Friend makes an important point. It is important, if this scheme is to work, that people do come forward. Many local authorities and, indeed, the Scottish Government have been incredibly generous in offering support and holding out the hand of friendship. We do need more, and we need more community groups to come through. I warn hon. Members that when charities and the third sector come forward, we do the correct due diligence to enable us to ensure that very vulnerable people are given exactly the support that they need, to make sure that the scheme is sustainable.

I am not ruling anything in or out; I am looking to make sure that we get the bespoke deal that is right for this country. I am not going to prejudge the outcome of the negotiations over the next couple of years. It is clear, though, that Europol is an EU agency supporting law enforcement activity, based in The Hague, to which we are a huge contributor. In fact, the current chief executive, who is an excellent lead for that organisation, is a British national.

While my right hon. Friend does not want to prejudge negotiations, does not his decision to opt into the recent Europol directive—the hon. Member for West Ham (Lyn Brown) and I served on the European Committee in which he laid out his case for doing so—show that the UK is willing to be an active participant in Europol for many years to come?

My hon. Friend makes a good point. As I clearly outlined in the Committee, the decision to opt in was made in the context of our being a member of the European Union, and at the moment, and over the next couple of years, we are still a full member of the European Union. It is important to make sure that we take the opportunity to play a full and strong part in that. We want to continue to play a very strong role as a partner for our colleagues across Europe, and indeed globally, particularly in law enforcement.

The prime objective of Europol is to strengthen and facilitate co-operation in preventing and combating serious organised crime and terrorism, in which we have a clear interest in playing an important part. I have yet to meet a senior police officer across our country who does not value our membership of Europol. By providing a platform for members to share intelligence and information, and through a strong analysis function, it offers unparalleled opportunities to prevent serious crime and to protect EU citizens, including those here in the UK. Concretely, this means that 86,629 suspected criminals were identified on the Europol information system in 2015 alone—up by 40% on the year before. There were 1,800-plus decisions for referrals of terrorist and extremist online content between July and December 2016 alone, with 1,600-plus removals, and numerous ongoing large-scale organised crime and trafficking cases. Indeed, the UK staffs one of the largest national desks in the organisation and is one of the biggest contributors of information to Europol systems.

Another mechanism that we have at the moment is Eurojust, which supports the fight against transnational, serious organised crime by co-ordinating multinational investigations and prosecutions. It works through a co-located network of national liaison desks staffed with prosecutors and investigators from across the EU. Later this year, we will start operating the EU’s Prüm system for the exchange of DNA, fingerprints and vehicle registration data, following this House’s overwhelming vote in December 2015 to join it. In 2015, we conducted a pilot of Prüm, exchanging DNA profiles with four other member states. This gave us an impressive number of hits, many against suspects who would not have been identified otherwise, and enabled the police to arrest people for a number of serious offences, including burglary and attempted rape.

Since 2015, we have taken part in the second-generation Schengen information system, which circulates law enforcement alerts around the EU in real time. This ensures that vital intelligence is shared internationally to help prevent threats from across the world. Joining has seen us arrest and extradite wanted people including drug traffickers, murderers and paedophiles whom we would not otherwise even have known about.

I thank my right hon. Friend for what he has said, and commend him for his many years of fantastic work on the Home Affairs Committee. I do not know what the plans are for further debates about immigration. Perhaps the Minister can enlighten us, because it will clearly be one of the central issues to be discussed. If it is included in the debate, that will affect the kind of deal or agreement that we secure, so it is important for us to have some clarity about what those plans are.

The right hon. Lady will be well aware that there are a number of different options for immigration from EU member states. I am sure she will not miss this opportunity to advertise the Home Affairs Committee’s “big conversation”. The Committee is travelling around the country to discuss the issue. It is also encouraging Members to contribute, and to urge their constituents to do so as well.

I am glad that a fellow member of the Home Affairs Committee has reminded me to say that people across the country need to become involved and have their say about what the right immigration options should be for Britain. We know that immigration is important for our future, but we also know that it needs to be controlled and managed in a way that is fair, and people have different views on how that should happen. My view is that there is rather more consensus than people may think, given the polarised debates on immigration that sometimes take place. We do indeed believe that all Members of Parliament should have their say as part of the process. We shall be holding regional hearings and evidence sessions around the country, and also urging Members to consult their constituents on what they want to happen as part of the future arrangements.

The Policing Minister set out a very broad-brush approach to security. My hon. Friend the Member for West Ham (Lyn Brown), the shadow Policing Minister, gave a forensic response, posing a thorough and detailed set of questions that were not really addressed in the Policing Minister’s initial outline of the position. He rightly talked about the value of our relationships and the importance of joint working, but we need much more reassurance from the Government that they are taking three crucial issues—Europol, the European arrest warrant and the databases—immensely seriously, because they will have huge implications for our security if we do not get this right.

There is no precedent for a non-EU member to be a member of Europol, but I should be grateful for confirmation from the Minister that there is also nothing in the treaties that would rule that out. If we are looking for a bespoke arrangement, perhaps he could confirm that there is nothing to prevent us from asking to continue our existing Europol membership, given the crucial role that Britain has played in shaping Europol in the first place, and in raising the standards of policing and cross-border policing in other countries across Europe to meet the standards that we have here in the United Kingdom.

As the Minister will know, the UK uses Europol more than almost any other country in the EU. We provide more intelligence, and play a leading role as well. Operation Golf, involving the Met and Europol, rescued 28 children who were being exploited by a Romanian-organised criminal gang network. Operation Rescue investigated the world’s largest online child abuse network and led to 12 arrests in the UK, safeguarding 230 children. That kind of work between British police forces and Europol is immensely important. I therefore urge the Government to pursue full membership of Europol, or at least something that looks, sounds and smells like it, so that it delivers exactly the kind of security arrangements we have at the moment.

We also need something that looks, feels, sounds and smells, and pretty much is the European arrest warrant, instead of reinventing something from scratch or having to renegotiate, as other countries including Norway and Iceland have done. It has taken them many years to do so, and the length of time involved in renegotiating those extradition agreements, whether with the rest of the EU or with individual countries, can cause huge delays and considerable legal uncertainty.

The Government are well aware of the importance of the European arrest warrant. Indeed, it was part of our discussion of justice and home affairs concerns over the past few years. I hope we will continue to make sure that we can respond to the up to 1,000 EAWs each year, which involve us being able to deport to other countries their suspected criminals, who would otherwise be able to find greater sanctuary here.

The most challenging area of all was raised by the police who gave testimony and evidence to the Select Committee: access to information and databases, and to that shared information across Europe. The temporary deputy assistant commissioner of the National Police Chiefs’ Council said:

“If we are curtailed in our ability to access intelligence systems that our overseas partners have put in place, we may risk people hurting children or committing harm because we cannot put that picture together. My response to you is yes, it increases the risk.”

My hon. Friend the Member for West Ham gave a thorough account of the databases and the challenges they face, including the European criminal records information system, to which my right hon. Friend the Member for Leicester East (Keith Vaz) referred; the second generation Schengen information system; the passenger name record directive; and the Europol information system. On that latter system, some of Europol’s co-operation partners can store and query the data in the centre, but cannot have direct access, which is what is so important.

If we are outside the EU and trying to set up a new bespoke arrangement, the European Commission will be forced to make an adequacy assessment. So once we trigger article 50 and are setting the new arrangements from outside the EU, we will expect an adequacy assessment by the European Commission under its current legal arrangements. However, as the hon. and learned Member for Edinburgh South West pointed out, there are some challenges with getting that data adequacy assessment in place. While that ought to be solvable given our shared objectives and security and intelligence co-operation, it another reason why it takes time to get this issue right and why we cannot simply assume that, because we have the same shared objectives, it will all be solved and it will all just come out in the wash.

If our objectives are to stay in Europol and the EAW and to keep access to those crucial databases, it would be helpful if the Government said that, rather than simply make broad-brush statements that we want to continue with co-operation around security. That would give greater certainty to our police and law enforcement officers about what they should be focusing on and planning for. The Minister will know that, if we are not able to do that, it will be important to have transitional arrangements in place. Frankly, if we do not have that, people’s lives will be at risk.

Let me leave the Minister with a final thought about the way in which the negotiations take place. I have raised my concern about the Home Secretary and Home Office Ministers not being present, and because there is shared agreement on the objectives both in the House and across Europe, I am concerned that this matter will be treated as a lower priority in the negotiations. It is not as controversial an issue as some others, which we will all row about. It will not therefore be one of the main things on which the Prime Minister will continually keep her attention. However, it must be taken immensely seriously, otherwise it will just slip between people’s fingers and we will end up with the details not being ready in time and it therefore not being sorted out.

My other concern is that this issue must not be used as a bargaining chip in the wider negotiations. There will be all kinds of rows, debates and trade-offs across Europe around trade, immigration rules and so forth, but we should not have trade-offs around security. It would be better if issues around security co-operation could be treated as a separate part of the negotiations, and could be dealt with as rapidly as possible to get some early security and show that the Government are giving the matter sufficient attention. Our Select Committee will hold further evidence sessions, and I am sure other Select Committees and Members will also be scrutinising this subject in detail.

Britain voted to leave the EU, but nobody voted to make Britain less safe. I know the Government will take safety and security seriously, but they need to be taken sufficiently seriously to make sure that we do not inadvertently get a gap in our security arrangements which ends up putting lives at risk. In the end, we are talking here about terror, security and cross-border crime, so this is about any Government’s first duty: to keep their citizens safe.

It is a pleasure to follow the right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper), the Chair of the Home Affairs Committee, on which I sit, especially as I agreed with pretty much everything she said.

Security did not feature especially prominently during the referendum campaign. I understand why that was: a lot of what we have been talking about is very complex and does not fit easily into a brief soundbite, and much of our security co-operation is not done through our membership of the EU. Our security against military threats from other countries is protected by our membership of NATO, other alliances and bilateral relationships. Our security in terms of terrorist threats is largely dealt with on a bilateral basis, country to country between intelligence agencies, as well as through multilateral agreements such as the “Five Eyes” intelligence alliance comprising Australia, Canada, Great Britain, New Zealand and the USA.

Those relationships are entirely separate from our membership of the EU and are in no way compromised by this country’s decision to leave. To that extent, I never subscribed to the claims of some on my side of the referendum campaign—the remain side—that we would suddenly become a very dangerous place in the event of a vote to leave, or indeed to the ridiculous hyperbole that ISIS would be delighted by a leave vote. Indeed, Mark Rowley, the assistant commissioner for specialist operations at the Met police and the UK’s most senior counter-terrorism officer, reported that there has actually been an increase in co-operation between European member states’ police and intelligence agencies since the vote to leave the EU. This ad-hoc co-operation was no doubt due to, and necessitated by, intelligence shortcomings before some of the recent terrorist atrocities in Europe.

To focus on the military and high-level intelligence co-operation and counter-terrorism that takes place outside the EU architecture is to ignore the many policing and criminal justice measures inside the EU structures, which make the police’s practical work of keeping us safe easier and more efficient. I have spoken to a number of police officers—in my previous work as a barrister, I acted for and against the police regularly—and I know many police officers, both locally and outside my own area. Some voted to leave and some voted to remain, but all share a clear desire for our existing EU police and criminal justice co-operation to stay the same, or to be replicated as closely as possible.

Just last night I was speaking to the president of the Police Superintendents Association of England and Wales, Gavin Thomas, at an event at which a number of Members were present. He cited the example of how access to European Union DNA databases has allowed checks that previously took days or weeks to be performed within 15 minutes. He is a full supporter, as are the leads of many other police staff associations and senior police officers, of maintaining our current policing and criminal justice relationships with the EU.

My hon. Friend makes a powerful point. Is he aware that similar evidence exists in relation to the Schengen information system? The National Crime Agency has stated:

“Loss of access to SIS II would seriously inhibit the UK’s ability to identify and arrest people who pose a threat to public safety and security”.

I entirely agree with my hon. Friend. In fact, I do not think that a single senior police officer or police organisation takes a view counter to the one he has just outlined.

Beyond the police—apart from some concerns about the European arrest warrant, which I do not share—I do not detect any desire among members of the public for any rowing back on our policing and criminal justice co-operation with the EU. I do not detect any such appetite within this place either. Certainly since I have been here, the only pushback—particularly on these Benches—has been on the requirement to submit to the oversight of the European Court of Justice. I will come back to that matter shortly, but to take it out of the equation for the moment, I doubt that there will be a voice of dissent in this place relating to the panoply of policing and justice co-operations we currently enjoy. Time does not permit me to go through each and every one of them, so I shall focus on just four.

Europol exists to assist law enforcement agencies in member states to tackle cross-border crime. It focuses on gathering, analysing and disseminating information, rather than on conducting actual investigations. The UK has 12 liaison officers at Europol’s headquarters in The Hague, which I was able to visit with colleagues on the Home Affairs Committee last year, including the right hon. Member for Leicester East (Keith Vaz). It is a very impressive operation indeed. It is important to note that Europol also has representatives from non-EU countries such as Norway and the US. We had a long conversation with representatives from the US and the Department of Homeland Security, who have a significant presence there. It was not immediately clear from that conversation that they were significantly worse off for not being a member of the EU. However, they certainly do not have the automatic right of access of EU member states to the Europol information system. There is a specific provision for them to have access on a case-by-case, supervised basis.

We were also able to meet online counter-radicalisation officers from the European Cybercrime Centre, an initiative very much championed by our Prime Minister when she was Home Secretary. The Europol information system is a central database with information on suspected criminals and objects associated with crime, such as vehicles. If a vehicle is suspected of being connected to a crime in Kingston, for example, British police officers can search the EIS to find out whether there is any information on that vehicle, or people associated with it, anywhere in the EU. In 2015, the UK sent and received 37,000 alerts through Europol channels, half of which related to high-priority threats such as child sex exploitation and firearms. As crime and criminals respect state borders less and less, the role of Europol in supporting cross-border co-operation will only increase and become more vital. It must be retained, with British involvement.

I shall move on to the Prüm convention. Like the EIS, Prüm allows and facilitates member states to search each other’s databases for fingerprints, DNA profiles and vehicle registration details. The UK has not yet fully implemented Prüm, although I believe that it will do so later this year, but we ran a pilot for DNA profile exchange in 2015. As I mentioned, I heard from a senior police officer yesterday that that has allowed checks that would previously have taken hours or days to be performed in 15 minutes.

The hon. Gentleman is the Chamber’s resident expert on Prüm. Does he agree that it is important that we continue to implement the terms of the agreement, irrespective of our decision to come out of the European Union, because it provides important data sharing on DNA and fingerprints? Does he agree that, having made the decision, we should continue with that process pending the negotiations?

Pending the negotiations, we should continue down the path of integration in all these policing and criminal justice measures. We have already done that in respect of Europol in a decision that was approved by the House last month.

I shall move on to another important measure: the passenger name records directive. This was explained to members of the Committee at Copenhagen airport. It is a common system for collecting and processing data held by airlines, including names, travel dates, itineraries, seat numbers, baggage and means of payment. These data are vital in tracking criminal and terrorist movements to prevent and detect crime. It is important to note that the EU has bilateral data sharing arrangements for passenger name records with the US, Australia and Canada. It is also negotiating an arrangement with Mexico, so there is no good reason why a non-EU country cannot participate in what is clearly a system that has mutual benefits.

The European arrest warrant has had a transformative effect on the ability of the police and prosecuting authorities to get those who need to face justice in the UK—whether relating to a prosecution or a prison sentence—back to the UK to do so. It bypasses the fiendishly complicated extradition rules that apply with respect to some other countries, because countries that are part of the European arrest warrant arrangements cannot refuse to extradite their own citizens, and there are legally mandated time limits during which extraditions have to take place. In 2015-16, 2,102 individuals were arrested in the UK and deported on European arrest warrants. Those were people we plainly did not want in this country. We have been able to repatriate more than 2,500 individuals from EU countries since we have been a member of the European arrest warrant system, including some well-known terrorists, serious criminals and paedophiles. There is a list of high-profile cases, but I will not go into it now. I agree with the hon. Member for West Ham (Lyn Brown) that this is the most effective extradition system in the world, and it would be madness if we were in a situation in which we had to leave it.

I am not an expert on this subject, but there is concern that, under the European arrest warrant, UK citizens could find themselves extradited to other EU countries in which the justice system falls far short of what we would regard as adequate. Does my hon. Friend have any concerns about that?

I am sure we will hear my right hon. Friend’s expertise in the defence field in a few moments. The starting point of the European arrest warrant system is that any country in it has a legal system that will give a British citizen a fair hearing, just as citizens of that country would have a fair hearing here. That is the starting assumption, and that was why the House approved our membership of the system. I accept that some people hold the view that my right hon. Friend describes—I mentioned that fact earlier—but, on balance, the majority of people in the House and in the country think that being a member of the European arrest warrant keeps us safer.

Perhaps my hon. Friend would like to know that that was the view of the Criminal Solicitors Association, whose members largely represent defendants, and of the Criminal Bar Association. They agree that, on balance, membership of the European arrest warrant system is an advantage because it is a court-led system that involves judicial overview, unlike the classic extradition system, which is an Executive process.

There are many other measures that I could mention: ECRIS; the Schengen II information system; the system for providing enforcement alerts, including for those wanted on European arrest warrants, which includes more than 70 million live alerts; and the European image archiving system, which is a database of genuine and counterfeit ID documents and travel stamps. In all those fields, I agree with the right hon. Member for Normanton, Pontefract and Castleford, that we should be aiming for full membership, or the closest possible approximation to it.

Turning to the UK’s position since the general election, the Government have put us in a good position to take forward policing and justice co-operation with the EU. First, in December 2015, we decided to opt into Prüm II. Secondly, in December 2016, we decided to opt into new regulations governing Europol, and I was pleased to sit on the European Committee that unanimously approved that decision. Thirdly, the Prime Minister set out yesterday how a global Britain will continue to co-operate with its European partners in the fight against the common threats of crime and terrorism. She made it clear that she wanted our future relationship with the EU to include practical arrangements on matters of law enforcement and the sharing of intelligence material with our EU allies. That came as no surprise because she personally led several such initiatives during her many years in the Home Office.

Clearly it is up to the European Union and others to decide whether to allow the UK to remain part of the policing and criminal justice architecture that we are debating today, but the case for the EU and EU member states to do so is clear. It is probably clearer in this area than in any other area of EU co-operation, not only because it affects the security of each citizen of every EU member state, but because the UK is at the forefront of each and every one of these criminal justice measures. For example, 40% of contributions to Europol’s shared intelligence come from the UK—we are behind only Germany—and the UK is the main contributor of intelligence in several of the most important areas. It would not be in the interests of any EU member state, or the EU as whole, to shut itself off from access to that vital intelligence in pursuit of some lofty EU principle or ideal—this is a matter of practicality. If the tables were turned and another country that contributed 40% of Europol’s intelligence—this intelligence helps British police officers to fight crime—were leaving the EU, I would be the first to call on our Government to do everything possible to maintain access to that intelligence and to preserve our co-operation with that country. Without wishing to labour the point, it would be an act of self-defeating nihilism for the EU to seek to shut the UK out of policing and criminal justice co-operation measures.

How could we co-operate outside the EU? We could either be allowed to remain a member of such measures, which would require EU legislation to be rewritten, or we could be given informal or bespoke access, which the US already has with Europol. Once any legal hurdles are overcome, the two main sticking points will be money and judicial oversight. As for money, I am clear that we should pay to play. If we are to benefit from Europol, for example, which has an office and staff in The Hague, there can be no question but that we should expect to pay. On judicial oversight, I understand that oversight of the European Court of Justice is a sticking point for many Members and for many members of the public who voted to leave, but that must be dealt with on a case-by-case basis, looking at each measure on which there is co-operation. When we enter multilateral agreements with other countries on issues such as extradition, there is often an international court that arbitrates, such as the International Criminal Court.

I do not believe that we immediately became less safe because we decided to leave the EU. The measures we are discussing are hugely beneficial to law enforcement. The police and the public want us to continue with them, and I am pleased that the Prime Minister agrees. The litmus test for me on this and all other EU co-operation is simple: if we were not currently a member of the EU, is this is something in which would we be looking to get involved because it would benefit British people? For all the measures we are debating today, the answer is a resounding yes.

There will undoubtedly be legal hurdles to overcome, but it is clear beyond peradventure that our side is willing. I hope that the EU will respond in kind and that the starting point for any negotiations will be not whether we should do it, but how we should do it. Some Members have demanded guarantees and more information, but given the consensus in this area, it falls on everyone in this House, particularly those with expertise and legal training, to contribute on the question of how we assist the Government to ensure that we maintain this vital co-operation in policing and criminal justice for the benefit of all our constituents in Britain, and of citizens in Europe as a whole.

I had not intended to take part in the debate, but I want to say a few words about Lords amendment 24. A lot of the debate so far seems to have been about whether section 40 should be implemented, but that does not actually have anything to do with Lords amendment 24, which is specifically about whether there should be a further inquiry into the behaviour and performance of the police in relation to their dealings with news organisations.

Leveson 2, as it is now colloquially known, has been put on hold until the conclusion of all the criminal cases, and the amendment rightly recognises that it would be wholly wrong to have any kind of inquiry that could jeopardise criminal prosecutions. However, most of those prosecutions have now been concluded and it is worth looking at the outcomes of those prosecutions when deciding whether there is a case for proceeding. Operation Elveden, which was the police investigation into corrupt payments from newspaper organisations, overwhelmingly resulted in the acquittal of the journalists who had been charged with those offences. I think only two journalists were convicted; the vast majority were acquitted. We need to bear that in mind, because the suggestion that there was a massive corrupt relationship has not proven to be the case.

The hon. Member for Rhondda (Chris Bryant) talks about the importance of weeding out police corruption and of having confidence in an institution of the state. I completely agree with him on that. I want to refer briefly to the case made by the relatives of Daniel Morgan when considering whether there should be a further inquiry. I have every sympathy with the family of Daniel Morgan, who was murdered, because there was considerable evidence of police corruption. I can entirely understand their wish to have his killers brought to justice. A Home Office panel is examining that case at the moment, and we await its conclusion. It may well be that further action needs to be taken to deal with police corruption, and I shall wait to see what the panel concludes. Let us bear in mind that the Leveson inquiry was an inquiry into the culture, ethics and conduct of the press. It was not an inquiry into police corruption.

The main issue that has dominated the debate has been the implementation of section 40, which is not covered by this amendment. I share the views that have been extremely well expressed by my hon. Friends the Members for Worthing West (Sir Peter Bottomley) and for Torbay (Kevin Foster). However, the Secretary of State has set up a consultation. It concluded today, but it will take some considerable time before the results are made public. I believe that there has been a very substantial response to the consultation, so I do not expect the Government to be in a position to announce any conclusions about the implementation of section 40 or about whether there should be a further inquiry until that work has been done. I suspect that it will take several weeks, if not months. It seems entirely premature to table an amendment requiring the Government to commit now to a further inquiry when we have not even begun to assess the results of the consultation. For that reason, I strongly oppose Lords amendment 24.

I support Government amendment (a) in lieu of Lords amendment 134. Having heard the hard-hitting accounts of my hon. Friends the Members for Cheltenham (Alex Chalk) and for Gloucester (Richard Graham) in their report on stalking, no one can be left in any doubt that the Government amendment should be carried.

Turning to Lords amendment 137, having represented the police and the prosecutorial authorities as a barrister, and having represented victims both as a barrister and as a Member of Parliament, I hope I can see the situation from both angles. I am entirely supportive of the victims code. Victims have generally been empowered since the code came into force as a result of steps taken by the previous Labour Government, and the beefing up carried out by the coalition Government and the Government of today.

My concern about Lords amendment 137 is that it would make the police and prosecutorial authorities responsible, and in some cases financially liable, for breaches of the victims code, even if they are not directly responsible. Under new subsection (3)(a), for instance, the police or the CPS could become responsible to a victim for delays caused not by them but by a third party, such as the defendant. Under new subsection (3)(b), the CPS could be held responsible if a defendant, or indeed another party over whom it has no control, treats a victim with a lack of “dignity and respect”. That often happens in the courtroom when a defendant gives evidence, or even through how a defendant instructs their lawyer to present their case, but that is a matter for the judge, not the prosecutor, to control.

New subsection (10) is even more concerning because it would require the Home Secretary to

“take steps to ensure that victims of crime…have access to financial compensation from public funds for any detriment arising from the criminal case concerned”.

That is not necessarily a detriment caused by the prosecuting authority, and there is no requirement of bad faith, recklessness or negligence on behalf of that authority. That is a big step both in principle and in practice. It is a big step in principle because it appears to impose a liability on one body for the actions of a third party over whom it may have no control, and it is a big step in practice because it exposes the police and prosecuting authorities to a significant financial burden at a time when we regularly have debates in this House on the need for greater funding for the police and the CPS. Paragraph 128 of the explanatory notes on the amendments explains that “potentially significant” financial burdens are attached.

Although I am an enthusiastic supporter of the victims code and the need to give victims the very best support, imposing a broadly defined liability—indeed, a financial liability—on the police and the CPS is not the right way to proceed without more thought about furthering the aims of the code. More thought is needed, and I am pleased that the Government will be introducing their own proposals to give effect to our manifesto commitment for a victims’ bill of rights. I am sure that that work will take account of the excellent work of the hon. and learned Member for Holborn and St Pancras (Keir Starmer) and his commission. I pay tribute to his work and to all the people involved, including a number of my constituents.

I think it extremely important to work with industries when introducing new laws, to prevent any unintended consequences that might have a knock-on effect on them.

This is very positive news. During the next festival season, people will be able to go and enjoy themselves, and parents sending their kids off to festivals around the country will be safe in the knowledge that throwing flares is an offence. I hope that the amendment will discourage the lunatics from doing that next year, and, once again, I thank Ministers for all their work.

I rise to support amendment 135, and I am delighted the Government have accepted Baroness Finlay’s amendment.

I am a barrister and have represented many bereaved families and public authorities at coroners’ inquests, but I had not expected this fairly niche area of legal practice to feature so prominently in my constituency casework after being elected as an MP. Shortly after I was elected, an incredibly dignified lady called Rosalind asked for my help because of inordinate delays in the west London coroner’s court in issuing her husband’s death certificate, which meant the insurance company was holding up funeral arrangements.

It is a pleasure to serve under your chairmanship, Mr Brady. I am grateful for your clear explanation as to the process. I obviously needed that today and I am dead pleased that you are in the Chair.

The Minister did not answer the question about why we are not having this debate on the Floor of the House, which the Opposition would welcome. We have argued consistently that participating in Europol helps to keep Britain safe. It is a vital tool in the fight against terrorism and serious organised crime. Opting into Europol’s revised governance framework will allow Britain to continue to participate in Europol and strengthen Europol’s capacity to help to tackle serious crime. We therefore support the Government’s decision to opt in.

Europol’s role is to facilitate the rapid exchange of criminal intelligence and security information between EU member states. Europol supports more than 40,000 international criminal investigations each year, and many of those cases are vital to British security. In 2011, police were able to identify links between an investigation in Northern Ireland and an investigation in Portugal after basic checks of Europol systems. That led to a large investigation of a west African organised crime group operating across Europe, west Africa and south America. There have subsequently been 25 co-ordinated arrests and seizures across Europe, and that gang has been well and truly broken up.

In 2012, a law enforcement agency received intelligence regarding a threat against an individual’s life in another EU member state and a probable suspect in a third member state. Checks of Europol systems enabled the speedy identification both of the intended victim and of the potential suspect, and law enforcement authorities were able to take swift action and save a life.

If I go on much longer, our Whip is likely to pull me down, but those two small cases show that Europol co-operation means that criminals and terrorists cannot easily use European borders to evade the intelligence and oversight of law enforcement authorities. Europol is a vital tool for ensuring that national Governments, not international crime organisations, are in control. In May, the European Council and Parliament adopted a new set of regulations, which updates Europol’s governance structure, objectives and tasks and will take effect on 1 May 2017. Those regulations make some important changes, and I will briefly outline the benefits of those.

As we know, cybercrime is one of the greatest challenges that our police face. It pays no attention to national borders, and the activity of an individual in one country may have perilous consequences for citizens in another. The European cybercrime centre estimates that cybercrime costs EU member states €265 billion a year. The new regulations will make it easier for Europol to help member states tackle cybercrime by giving that centre a clear mandate as a Union centre of “specialised expertise for combating” crime. Similarly, the regulations give the EU internet referral unit a clear mandate to tackle online terrorist propaganda.

I stress that the regulations do not allow Europol to mandate national investigations. Article 4 of the regulations states:

“Europol shall not apply coercive measures in carrying out its tasks.”

Article 3 makes it clear that Europol “shall support” national security forces rather than lead them, and national Governments are not required to share data if they think that would threaten their “essential interests” or jeopardise current operations. Taken together, those measures preserve Europol’s status as an information and data-sharing hub rather than a supranational crime agency. Indeed, the European Scrutiny Committee concluded that it is

“satisfied that the outcome achieved respects the division of competences between Member States and EU institutions”.

Although the benefits of the changes that I have outlined are important, the nub of the issue is that the regulations bring about substantive changes to Europol’s governance arrangements. Having spoken to the House of Commons Library staff and studied the European Scrutiny Committee report, I understand that if we do not agree to the regulations, Britain’s participation in Europol could be called into question altogether. There is indeed a process for ejecting us, or anyone, from Europol if the Commission and Council agree that our opt-out renders co-operation inoperable.

Put plainly, we could find ourselves out of Europol by May next year when Brexit negotiations will only just have begun. Indeed, the Minister implied the same thing on the 14 November when he notified the European Scrutiny Committee of the Government’s intention to opt in:

“Opting in will maintain operational continuity for UK law enforcement ahead of exiting the EU…and that law enforcement agencies can continue to access Europol systems and intelligence.”

Given the enormous benefits that Europol participation brings to Britain, the Opposition would not want to bring about any risk of the UK being ejected from Europol on 1 May. We therefore support the Government’s decision to opt into the new regulations.

As I am sure the Committee will know, the current director of Europol is a British man called Rob Wainwright. He took over Europol after a career serving major British security institutions such as NCIS and the Serious Organised Crime Agency. His career shows how European co-operation allows for British influence to spread abroad. Director Wainwright tweeted that the Government’s decision to opt in is

“Good for Britain’s security, great for police co-operation in Europe.”

I agree entirely with Director Wainwright. International crime did not stop on 23 June 2016 and, sadly, the threat of international terrorism persists. That is why I want us to remain part of Europol if and when we leave the European Union, and I want Britain to continue to lead the way in furthering police co-operation across the continent.

Unfortunately, the Government cannot guarantee our continued participation in Europol after Brexit. The Secretary of State for Exiting the European Union has offered warm words about maintaining security arrangements. In fact, he said that he wants us to “maintain or even strengthen” co-operation, as we have heard, but when he has been pushed as to whether that means we will continue to be a member of Europol he has not been able to make that guarantee. Instead he told the House that the Government will seek to

“preserve the relationship with the European Union on security matters as best we can.”—[Official Report, 5 September 2016; Vol. 614, c. 45.]

Does the hon. Lady agree that, whatever our Government want to do, the other 27 Governments would have to agree to our remaining in Europol? They would in fact have very good reason to do so, since we provide about 40% of the intelligence on which they rely. We are an extremely valuable and massive net contributor of the intelligence and information that they enjoy through their membership of Europol.

I am not going to disagree with the hon. Gentleman. I am not even going to play party politics with this. I am going to move on gently and seamlessly to say that I think that the Minister for Policing and the Fire Service is a competent and loyal advocate of Government policy, so I am sure he will say exactly the same thing as the hon. Gentleman. However, I must say that I do not find a pledge to do the “best we can” particularly reassuring when we are dealing with matters as fundamental as national security and the lives of British citizens.

I would press the Minister to go a bit further today, and say that preserving our security arrangements and maintaining British influence over security matters will be a top priority for the Government in their exit negotiations. I do not think that is too much to ask. Keeping citizens safe should always be the first priority of any Government. Europol and other forms of European security co-operation such as the European arrest warrant are vital tools to keep our citizens safe.

Whatever else the Government do in the negotiations, they must not leave us in a situation in which we fall out of Europol and start to co-operate less with our European partners on security matters. If that were to happen, the Government would be letting the British people down. Their ability to tackle crime and keep citizens safe would be diminished. The Government would be ceding control to serious criminals.

I thank the hon. Lady for her series of questions. I will take her last point first. On confidence, there is a huge amount that we can do in this House, and that is to get behind the inquiry. It is open for business. It is worth getting some perspective. Although I am really disappointed that one victims group has decided not to engage with the inquiry at the current time, I am hopeful that it will re-engage in the future. We must remember that it is one group. The inquiry is open for business and getting on with its work.

The question about the legal counsel is for the chair and the leadership of the commission. It is their responsibility to make sure that they appoint the people necessary to undertake the task. I am sure that the chair understands the concerns raised by Members and victims organisations regarding making sure that she gets on with resolving the issues so that the very important work that the inquiry is doing can come to a swift and really good conclusion.

Does my hon. Friend agree that the role of the Home Secretary, or any Secretary of State, under the Inquiries Act 2005 is to appoint the chair and the panel and to agree the terms of reference with that chair, and that for a Member to come to this House with an imperious and censorious list of questions, such as those we heard from the hon. Member for Wigan (Lisa Nandy), does not help the inquiry and totally fails to understand the law?

I thank my hon. Friend, who is a lawyer, for asking such an insightful question. It is very disappointing that Opposition Members are coming to the House and making such censorious claims when what we really need to do is get behind this independent inquiry so that it can do the job for victims and make sure that we all learn what more we can do to keep children in our country safe.

We certainly expect many hundreds more children to be brought across from France under the criteria that we have set out. I must repeat that the Dubs amendment specifically refers to refugee children. Many of the children who may currently be in France would not qualify for refugee status, which is why for the older children we have set that criterion. For the other children, the risk of sexual exploitation indicates that they are likely to be the most vulnerable, as are the youngest children. Again, the children that we are bringing across as part of the 20,000 from Syria are the most needy children, in my view.

Thank you, Mr Speaker. Will my hon. Friend congratulate Kingston Council on being the first council to call for every council to take 50 Syrian refugees and on already meeting its quota of vulnerable minors? Does not that compassionate attitude on the part of Kingston and other Conservative councils show how ill-judged and wrong the bombastic comments of the hon. Member for Swansea East (Carolyn Harris) were?

I congratulate not only Conservative councils throughout the country but, to be fair, councils of all political affiliations that have stepped up to the mark. It is great that they understand their responsibility. There is potential in the legislation to mandate councils to take children. That has not been the case and I do not believe it will be. I am pleased that so many local authorities have entered into the spirit of this great humanitarian need and helped with children up and down the country.
