That may well be true but I hope that the right hon. Lady, who is not too delicate a flower, can bear the almost unendurable pain of the criticism of the Minister with such stoicism and fortitude as she feels able, in the circumstances, to muster.

Last week, the Leader of the Opposition said that no self-respecting Labour MP could vote for the proposals, yet we are now being pressed on a confidential document, the production of which would undermine yet again our negotiating position. Does the Minister agree that to reveal the documents would make no deal more likely?

I thank my hon. Friend for asking that question. No deal is indeed made more likely by the House not supporting the Government’s position. As for the Leader of the Opposition, I think that MPs and the public are coming around to the idea that he is flip-flopping on these issues left, right and centre, and want a general election so that they can re-elect a Government with a strong Conservative majority.

Not just this Government will pay attention; I am sure the people of Scotland will pay attention to a vote against democracy. It is not the first time that those on the SNP Benches have ignored the votes of the British people, whether in the referendum in 2014 that they want to overturn or in the referendum of the United Kingdom in 2016. They seem to have a problem with listening to the democratic will of the people.

In my discussions with Associated British Ports, which manages the port of Immingham and the other Humber ports, there is a clear indication that they are well prepared in their contingency plans to handle any problems that may occur. Can the Secretary of State confirm that our ports are indeed well prepared for no deal and also that they can take much heart from the advantages, such as free-port status, that will be available post Brexit?

My hon. Friend is absolutely right. Before the reshuffle, I met the ABP and others looking at these issues, and their preparations are well advanced. He will also know that the Government have allocated additional funding for those ports, and he will be aware that, although in this place a huge amount of the debate tends to focus on Dover because of the vehicle flow through it, in terms of the containers and value of goods, the other ports are actually more significant.

I do not think that any Member of this House thinks that my right hon. Friend is anything other than virtuous in all that he does. In our commitment to bring forward the withdrawal agreement Bill, we have listened to the concerns of Members across the House and have reflected that in the draft legislation that is being prepared. It will be for Members to reach a decision on that or one of the two other alternatives—either we risk not leaving at all, which I think would be a huge betrayal of the 17.4 million people who voted to leave, or we leave with no deal, which would create issues for the Union and the economic disruption that would flow.

Many of my constituents tell me that they would not vote in a second referendum because they are angry and frustrated that Parliament has not delivered on the first one. Does the Secretary of State agree that a second referendum would continue the divisiveness and uncertainty, and would almost certainly not settle the issue, because the turnout would be smaller?

I very much agree with my hon. Friend on that. I would urge his constituents to vote, and to vote Conservative, in that election, but he is right to say that any such second referendum would be both divisive and not necessarily decisive. They have perhaps taken their lead from many Members of the House, who seem unwilling to confront the real choice that lies before them and vote, which is why they are seeking to have a second referendum.

What I am saying is that there will be consequences to both options. Revoke would involve a betrayal of democracy, going back on the commitments that this House has given and having a divisive, but not decisive, second referendum that could end up with the same result as before. Businesses are experiencing uncertainty, including in Dundee, where I was on Thursday. It has the fastest growing chamber of commerce in the United Kingdom, and people there want to see a deal and to see this country move forward. That is the way forward, but if we do not support a deal, a no-deal would have consequences. However, the much more severe consequences would be those for our democracy and for our international reputation as a country if we were to undermine such a major democratic decision.

Is planning still continuing for a no-deal situation, and is the Treasury providing adequate resources for it?

I can absolutely confirm to my hon. Friend that planning is continuing for no deal and that funding is allocated. It is important for the Government to use the time that we have between now and 31 October to ensure that we are prepared, should that eventuality arise, but it is in our interests to secure a deal so that that becomes unnecessary.

I direct my hon. Friend to the Government’s own published cross-Government analysis, which looks at a range of different scenarios. It is clear that there are opportunities for pursuing international trade that we can take only if we are outside a customs union.

Thank you very much, Mr Speaker. I was only just beginning to write my speech, but I shall muddle along. Needless to say, as an almost lifelong Brexit supporter, I shall be speaking against the proposal. I recognise that there are Members across the House who quite genuinely did not want to leave the European Union and who believe that the best interests of our country are served by being a member of that Union. That is a perfectly honourable position. What I find objectionable, however, is that some are quite deliberately seeking to frustrate the will of the British people that was so clearly demonstrated in June 2016. In my constituency, there was a 70% vote to leave. I am pleased about that, because I was one of them. I have campaigned long and hard to achieve this. I know I do not look old enough, but I did actually vote in the 1975 referendum, and of course I voted to leave on that occasion.

Is it not the case that many of our constituents, nearly 70% of whom voted to leave the European Union, as my hon. Friend says, now think that there is a stitch-up trying to deny the referendum result? That is a problem with Bills such as this. It is perfectly fine for people to talk about coming together, but when legislation proposed by people on the other side of the campaign would deny a way of leaving the EU, our constituents will only feel that this place is more out of touch with them and that this is all one massive stitch-up.

Moving on, some people argue for a second referendum, or a so-called people’s vote, as if the people did not vote on the first occasion.

I am not my hon. Friend’s constituency neighbour, but I thank him for letting me intervene. I agree that we had a people’s vote in 2016. I campaigned and voted for remain, but we must respect the vote and get on with leaving the European Union. However, many Labour Members are thwarting that even though they campaigned on a manifesto commitment to leave the European Union.

I thank my hon. Friend for that intervention. Although he is not my neighbour, he is of course welcome to visit Cleethorpes at any time. He will be made most welcome.

I was moving on to talk about a second referendum and the uncertainty and division that it would cause. I ask those Members who think that it would resolve the issue what would happen if a rerun with 16.4 million people voting remain led to them winning on a lower turnout. Would that satisfy the 17.4 million who voted to leave in 2016? Of course not. The uncertainty and division would continue, and we would be battling on for another 20 or 30 years about our future in Europe.

We must remember that the 2016 referendum was, to a great extent, an emotional vote. We had “Project Fear” telling the people that they would be worse off and that taxes would rise within days—hours, even—of a decision. However, the people said, “That’s fine. Let’s look at that.” We did not want to leave because of some potential downturn in our economy; it was a cultural issue. Our history, our structure of government, our Parliament and our judicial processes are all different, and we were having to make more and more changes to our established processes.

I am grateful to my hon. Friend for giving way. The vote itself was on our membership of the EU. It was not about our future relationship. All those emotional matters may well have been sold to the people during the campaign, but the vote itself was about our membership, so it cannot be prayed in aid when considering how our future relationship should be shaped.

Needless to say, I strongly disagree with my hon. Friend. The people voted to leave the structure of the economic union, and they wanted to slam the door closed. They wanted a clean break. They were not thinking about our future relationship; they said, “We’ve had enough of the existing relationship.”

My hon. Friend is making an excellent speech. I am sure he will agree that in addition to the emotion the people were proved right, because despite the predictions of doom and gloom in 2016, the economic reality since is that we have had a strong period of growth, and those investment decisions have been made in the full knowledge that we could be leaving with no deal on WTO terms.

I entirely agree with my hon. Friend.

They made that decision to leave, and they expected us to leave—they certainly expected us to be leaving in a lot less than three years. It has been suggested that if we go back and rerun the referendum, people will change their mind because of the economic arguments and so on. The reality is very different. We should recognise, as I recall the Attorney General saying on one of his outings in the House on this issue, that this has now come down to a political decision, and the political decision should follow the result of the referendum. There would be an enormous backlash against not just the party in power but the political classes if we are not seen to walk through the door before us marked “exit.”

I urge the House to vote against Second Reading and to continue the battle. If we end up with no deal, so be it.

The hon. Gentleman puts the same question a second time—[Interruption.] The point is that he talks about ending uncertainty, and the way to end uncertainty is for the Labour party not to go back on its manifesto and have a second referendum, because a second referendum will prolong the uncertainty. We may end up with the same result but just a further level of uncertainty as we go through a second referendum. What we need to do is back the deal, move on and give businesses—as he and I agree—the certainty they need.

Further to the Secretary of State’s comments about a second referendum, does he agree that there is considerable cross-party support opposing a second referendum?

As so often on these matters, my hon. Friend speaks a lot of sense. There is no consensus not just about a second referendum, but about what the question would be in a second referendum, because those supporting the second referendum do not even seem able to agree on what question would be put.

As always, I am very grateful to my hon. Friend. One of the advantages of these debates is that we can get such legal points across and put them on the record, and I am grateful to him for making that clear.

With a conditional interpretative declaration to a bilateral accord, the outright rejection of the declaration by the other party means the treaty would not come into force, as I said before the interventions. While there is every chance that the EU might object to a conditional interpretative declaration, that objection might fall short of outright rejection. I want hon. Members to listen to that very carefully, because I am trying to find a way forward for Mr Juncker. If they like, I am actually trying to save his face. I am trying to give him an opportunity to object, but not to indulge in outright rejection.

The EU could argue that attempts during negotiations to achieve an end date were rejected, and I am sure it might start by arguing that. It might also argue that an end date would be incompatible with the concept of the three protocols forming an integral part of the agreement, as provided for in article 182 of the withdrawal agreement. However, perfectly valid counterpoints to those objections exist. We would need to argue that our declaration is compatible with our commitment to use “best endeavours” —a very important phrase—to negotiate “alternative arrangements” so that, as provided for, the backstop applies “temporarily”, if indeed it is ever applied at all. That is a fundamental point.

The fact that the backstop would not necessarily come into force under the terms of the agreement means that, in my view, it is not actually integral to the agreement at all. The termination of the backstop within a reasonable amount of time is fully in accord with the agreement, rather than an amendment to it. I therefore think that the arguments in favour of the applicability of just such a declaration are very strong.

What about the European Union’s likely response to such a move? There are four main possibilities. First, it could accept our interpretative declaration and move ahead with obtaining the consent of the European Parliament to the withdrawal agreement. This might include making a political protest, while accepting the declaration’s legality and applicability. That is the ideal response so far as we are concerned. As guideline 1.6.3 states:

“The interpretation resulting from an interpretative declaration made in respect of a bilateral treaty by a State or an international organization party to the treaty and accepted by the other party constitutes an authentic interpretation of that treaty.”

In other words, we would have obtained a legally binding commitment from the EU to end the backstop—victory.

Secondly, the EU could reply with an assertion that the interpretative declaration is in effect an attempt to impose a unilateral reservation, and therefore has no legal validity, but at the same time agree to negotiate solely on the question of an end date for the backstop to solve this issue head-on. This would mean it had abandoned its previous insistence that no further negotiations were possible—again, a way forward.

Thirdly, the EU might reply that the interpretative declaration has no legal validity, but request further negotiations in the hopes of obtaining something of value in exchange for giving way on an end date for the backstop.

Unlike me, he is an eminent lawyer, and I am trying to get my head around some of the complexities of this issue. If we invoke this interpretative declaration and the EU objects, is that legally challengeable, and if so in what court?

I think the EU probably would object politically, but that is not enough. That is the point. If it does not want the interpretative declaration to have effect and provide an end date for the backstop, there is only one way out of it: it must refuse to ratify the treaty. A protest or talk of further negotiations is not enough, and that in a sense is the beauty of this. That is why we have these vehicles in international law, and why they have been used on several occasions in the past by countries such as Argentina and others.

There is no point protesting. My hon. Friend says that this is a complicated legal argument, but it is not. It is terribly simple. It is incredibly simple. Under international law one can say, “We interpret this treaty in such a way.” We can deposit that when we ratify the treaty. It is not a codicil as such or a letter; it is deposited with the treaty and has all the legal enforceability of a treaty. If those who are ratifying the treaty with us want to escape from its obligations, there is only one way out: they have to refuse to ratify it. I suggest—I will make this clear again before I sit down—that for political reasons the EU would be unlikely to do that, because it would put all the onus of a no-deal scenario on to it.

I thank the Chair of the Exiting the European Union Committee for his question, but it prompts me to ask in reply why on earth he is not backing the deal that delivers the certainty that all the businesses that he named have asked for. He needs to look once again at the deal, and deliver the certainty that businesses across the UK require.

When the Minister meets his opposite numbers in individual member states, does he take the opportunity to stress that they could stand down their plans for a no-deal scenario if the EU collectively showed some flexibility regarding the Irish backstop, so that a deal could then be settled?

Obviously, I look forward to getting a deal over the line, and as the Chair of the Exiting the European Union Committee knows, I believe that leaving without a deal is “sub-optimal”. In all conversations that every Minister has with representatives and Ministers from member states, we are pushing exactly the case that my hon. Friend mentioned.

The hon. Gentleman makes an excellent point about the huge importance of our automotive sector. We continue to engage with the automotive sector, both with the big companies and organisations such as the Society of Motor Manufacturers and Traders, and with the supply chain to ensure that we are taking their views on board. Securing frictionless access to the European market is so important to protecting those supply chains, which of course exist both in the UK and in Europe.

The port of Immingham in my constituency, measured by tonnage, is the largest in the UK. When I meet businesses on the port, they constantly tell me about the opportunities they foresee for Brexit to extend trade through the port. Will the Minister, and the Government as a whole, support them by talking more about the opportunities of Brexit, rather than talking down those opportunities as the Opposition do?

I tell the hon. Member for Great Grimsby (Melanie Onn) that I have not visited her constituency recently, but during the general election campaign, in Buckingham, in the market square in Winslow, I did buy, and then consume, fish that was, of course, from Grimsby.

Notwithstanding what the Minister has said and what her colleagues have said on previous occasions, she will be aware that in fishing communities there are still concerns that the Government will use fishing in some way and make further concessions. Can she give an absolute guarantee that there will be no further concessions on fisheries?

Again, I was very happy to visit my hon. Friend’s constituency as part of my travels as a Minister. Like him, I represent a coastal constituency, where we know that our fishermen work very hard to earn their livings. The Government have been absolutely clear that once we leave the EU and no longer abide by the common fisheries policy, we will be an independent coastal state managing our fisheries and controlling access to our own waters. I hope that that reassures my hon. Friend.
