Commons ChamberThe Government as a whole are giving a great deal of attention to regional variations in reporting. The Prime Minister and the Home Secretary have both made this a priority issue. Indeed, I am also aware that the Opposition have taken this issue very seriously, as we all should. There are reviews of why there might be inconsistencies in the reference rates. I wish to see those evened out. I also wish to see the agenda driven forward, as indeed I know does the Director of Public Prosecutions, and as did his predecessor.
2. On how many occasions he has referred a criminal sentence to the Court of Appeal as unduly lenient in the last 12 months.
In the period from 1 July 2013 to 4 July 2014 the sentences of 105 offenders were referred as unduly lenient and have either been heard or are due to be heard by the Court of Appeal. My office releases annual statistics for unduly lenient sentence referrals from the previous calendar year, and my office will release the 2013 statistics in the near future.
I am grateful to the Attorney-General for that answer. Can he clarify which type of offence has most often been referred to the Court of Appeal, and on how many occasions the Court of Appeal has increased the sentence? Will he confirm that his Department has received representations to review the sentence in the Rolf Harris case?
I can confirm that the Attorney-General’s office has received a request to review the sentence in the Rolf Harris case. I can give this clarification: for the same period, from 1 July 2013 to 30 June 2014, the type of offences most often referred to us are, indeed, sexual offences. That includes rape, indecent assault and assault by penetration and other offences. Thirty-one such cases were referred in that period, 25 of which have been heard, and all sentences have been increased. Six cases are yet to be heard.

So far as rescinding of the letters is concerned, that is not a matter for me. [Interruption.] No, it is not a matter for me, acting in my capacity; I accept that it could be a matter for Government, but it is not a matter on which I can give such an assurance to the hon. Gentleman.
On the question of case law, let me make the position quite clear. There is very well-established case law about abuse of process, and cases being stopped on the basis of an abuse of process, particularly in relation to assurances given that an individual might not be prosecuted for something, has not just suddenly emerged. It is perfectly well established in our law and indeed is part of our rule of law, for the very good reason that assurances given by public administrations may be binding upon them if they lead somebody to do something to their detriment.
In this case, as I have made clear, we took the view that there were arguments that could properly be put forward to the court that, although there was an error, it did not amount to an abuse of process and was not justified. The court has taken a different view, but I do not think that one can draw general conclusions about other cases from this case, which falls on its own individual facts.
First, may I applaud the Attorney-General for the way in which he has handled this case by authorising prosecutions? My question relates to what he has just said. If there are other cases with similar circumstances and similar letters, will they still be prosecuted in the light of the judgment and the fact that the Crown Prosecution Service has not challenged that decision?
As I have indicated, all the background facts relating to each letter that has been sent will be checked, and that should disclose whether any error has been made. I want to reiterate the point that if it were to emerge that no other letters contained errors the suggestion that those letters in some way amounted to an amnesty simply cannot be right. They would be mere statements of fact, and of the position that existed at the time at which those letters were written.

Commons ChamberIn relation to repatriation from north Africa and the middle east, the Attorney-General will know that, in 2012, 500 children were abducted from the United Kingdom contrary to UK court orders and taken to countries in such areas. What steps have been taken and what discussions have taken place with those countries about returning the children to the United Kingdom?
This matter does not fall within my departmental responsibility, and it would be best for my hon. Friend to raise that with the Ministry of Justice. I accept that there are areas of real difficulty in respect of children who are abducted, but that complex issue above all involves international co-operation and respect for the orders made by family courts in other countries.

Commons ChamberYes, I have had discussions with both the previous and the present Director of Public Prosecutions about this issue. It centres on the evidence. I can assure the right hon. Gentleman that if there is evidence on which a prosecution can be brought, it will be brought. The CPS takes the issue very seriously, but as he will be aware, the evidence has to be collected first by the police—and the CPS can help with that at times—and it has to cross the threshold on which a prosecution can be mounted. The difficulty in this area, as the right hon. Gentleman will be aware, is that this is a secret crime, often committed in a way and form that does not bring itself readily to public notice. I can assure him that the CPS takes this issue very seriously.
Has the Attorney-General held discussions with the DPP about the number of cases that are listed for trial but that do not go ahead because the Crown Prosecution Service has not complied with full disclosure? That is not fair to victims and not fair to the administration of justice or the taxpayer. What steps are being taken to resolve the issue, and how many such cases are there at the moment?
Yes, I have raised the matter on a number of occasions with both the previous and the present DPP. It would be best for me to write to my hon. Friend in respect of any statistics; they are not very easy to come by, unfortunately. One issue I often raise when I see some of Her Majesty’s judges on my visits to courts is a request for them to feed in to me any such examples rather than just to rely on anecdote. Nobody pretends that the CPS is a 100% efficient organisation, but I would like to take this opportunity to say that the last director left it in a much better condition than the one he inherited, and made substantial progress.

Commons ChamberI am aware of the comment about what might have been said in Surrey, but I reiterate the position of both the CPS and the Greater Manchester police, who investigated this matter: there is no reason someone should not receive counselling and every reason they should, if they need it. I know that my right hon. Friend the Home Secretary is aware of this issue being raised; I am obviously aware of it as well, and I can reassure the hon. Lady that we will investigate to ascertain whether there was a failure of communication on the part of anyone in respect of Mrs Andrade.
On the issue of sexual violence, the CPS website states that one in 10 women who experience sexual assault do not report it to the police. What is the Attorney-General’s Department doing, in line with other agencies, to tackle this?
As my hon. Friend will appreciate, the CPS gets it references from the police, so unless a case is referred to it, it cannot carry out an investigation. It works closely with the police, however, both to improve the conviction rates for rape—it has been consistently successful in doing that for some years—and to encourage people to come forward by ensuring that the victim support process available provides reassurance that people will be helped.

Commons ChamberThat is an interesting proposal from the hon. Lady, but, if I may say so, I would not seek to answer that question at the Dispatch Box today. It raises a number of ethical and practical issues to which, on the whole, I would want to give further consideration.
Will my right hon. and learned Friend give way?
I must make progress; otherwise I will not be able to do what I principally came here to do.
I want to deal with the point about the Grand Chamber in the Hirst case. The Grand Chamber declined, properly, to provide any detailed guidance on how to make our current regime compatible with the convention. It also made it clear that special weight should be given to the role of the domestic policy maker. Despite the difficulties that the House might face, we have a real opportunity, through debate, to shape the dialogue with the Court if we focus on the key issues.
I will now deal with the main legal issues on prisoner voting. I will set out the main points raised by the main judgments, because it might make the debate more difficult if the House does not have them in mind. I shall first outline the key points in the Hirst judgment, which dates back to October 2005. The Court took the view that it was well established that article 3 of protocol 1 to the convention, to which we are signatories, guarantees individuals the right to vote and to stand for election. The Court considered that to be a right, not a privilege. It also considered that that principle was important in ensuring an effective and meaningful democracy governed by the rule of law. It therefore felt that departure from the principle of universal suffrage risked undermining the democratic validity of the elected legislature and the laws that it promulgates. That might not have exercised us very much here, but in the context of the many east European states that have joined the European convention it is probably right to say that those are really serious, material considerations.
In the view of the Court, prisoners continue to enjoy all the fundamental rights and freedoms guaranteed by the convention. I do not think that either my right hon. Friend the Member for Haltemprice and Howden or the right hon. Member for Blackburn disagree with that. The Court’s reasoning, with which I appreciate many hon. Members disagree, is that, in view of the fact that the convention does not allow prisoners to be subjected to inhuman or degrading treatment or to have restrictions placed on their freedom of expression or freedom to practise their religion, a restriction on their right to vote should have the aim only of
“preventing crime by sanctioning the conduct of convicted prisoners, and enhancing civic responsibility and respect for the rule of law”.
The Court also recognised that the participating states had a wide margin of appreciation in deciding on such restrictions, but that that was not an unlimited discretion. It felt that the restriction should be proportionate and—this is the nub of the issue—that section 3 of the Representation of the People Act 1983 imposed a blanket ban, which was seen as being so indiscriminate as to fall outside the acceptable margin of appreciation.
I certainly do not want to prevent my hon. Friend from debating such an important issue. He must forgive me for perhaps being too much of a lawyer, but on the whole I tend to look at the terms of the motion, which are very specific and quite interesting. The motion first emphasises our respect for our international obligations, which I do not believe was included accidentally by the right hon. Member for Blackburn or my right hon. Friend the Member for Haltemprice and Howden. I assume that the motion thus encompasses our international obligations under the European convention on human rights. Secondly, the motion expresses what I take to be a view that we believe that our existing arrangements, which deny sentenced prisoners the right to vote, are fair, reasonable and proper and we wish to continue them. That seems to be the motion that we have to debate, and which we ought to debate, which is why I sought to answer the question in this way, although I accept that some wider issues could also be considered. At the end of the day, as I have also emphasised, the Government are bound by their international obligations. They have to think, sometimes laterally if not horizontally, about how to get themselves out of the conundrum of respecting the views expressed in this House while also wanting to see that the international obligations that this House wants to be respected are respected.
On that very point of international obligations, Lord Hoffmann has said that
“with support of other European states”
that have also been at odds with the Court,
“we can repatriate our laws on human rights.”
What steps are we taking to work with other European states that have also been badly treated to withdraw from the scope of the Human Rights Act 1998?
I am grateful to my hon. Friend, who is absolutely right; I have not had time to develop the point. Quite simply, negotiations have taken place concerning the difficulties facing the Court, in which the different countries making up the Council of Europe are, in many ways, expressing the common view that the Court is not functioning properly. Quite apart from anything else, there is a backlog of 120,000 cases. This matter is therefore not being ignored by the Government; we would like to make some progress to see whether reform can be achieved.
