The hon. Gentleman makes a good point. I assure him that we will seek to update the House as appropriate. Clearly, the first response should be made to the court and to the family, but I will pass on that point to the Secretary of State and urge him to make the decision clear to the House at the first opportunity.

A number of Members raised concerns about progress on wider legacy reform. I reiterate the Government’s commitment to addressing the legacy of the troubles in a way that focuses on reconciliation, delivers for victims and ends the cycle of reinvestigations that has failed victims and veterans alike. As with other priorities, progress on that has been affected by the circumstances of the past few months, but we are moving forward as quickly as we can.

The Government understand just how complex legacy issues are—that is why they remain unresolved, more than 20 years after the signing of the Belfast/Good Friday agreement. However, we are determined to get it right, and we remain committed to working with all parts of the community in Northern Ireland, including victims’ groups and families, to do so. I recognise the challenge to engage in that respect from the hon. Member for Sheffield, Heeley (Louise Haigh), and I can assure her that that engagement will be taking place.

It is vital that we now find a way forward that helps society in Northern Ireland to look forward together, rather than looking back to a divisive past. As the hon. Member for City of Durham said, we must ensure that, as we move this process forward, people can look forward to the future.

I have seen the report that the question refers to, and I know that the Secretary of State for Scotland discusses the Scottish Government’s priorities with them regularly at the Joint Ministerial Committee (EU Negotiations). There is considerable common ground between us on what we want to get out of the process, such as making sure that Scottish universities and business have access to the best of European talent, but it is disappointing that the report does not take the threat of a second independence referendum off the table, as doing so would be in the interests of Scotland.

The Minister will be aware that the figures in “Scotland’s Place in Europe” very much mirror those that were leaked earlier this week. In Scotland, the difference is that the Scottish National party Government do proper analysis and publish it. The analysis says that there will be a hit to GDP of 8.5% and that £2,300 a year will be lost for each person in Scotland. How many jobs have to be lost or under threat before this Government realise that they must back membership of the single market and the customs union?

The Government are seeking a successful deal for the whole UK, including Scotland. Four times as much of Scotland’s business is with the UK as with the rest of Europe. The worst thing for Scottish jobs and businesses would be to split up our United Kingdom.

I absolutely agree. A delegation from across the EU—from Spain, France and many other countries—came to my constituency to meet and work with our children. It was so incredible to see the friendships that were struck up and the experiences that were shared. The thought that my three-year-old niece, or any children that I have, will not get to experience that is heart-breaking. We should all reflect on that. What are the young people of the nations of the UK going to miss out on because of the poor decision making and the poor decisions that are being pushed by this UK Government?

The Executive powers provided in clause 8 put current UK international obligations under serious threat. As we know, the UK Government cannot be trusted to uphold international obligations. We have seen time and again instances of them turning a blind eye to our obligations. In Yemen, for example, more than 300 incidents that could violate international law have been tracked by the Ministry of Defence since the conflict began two years ago, yet the UK continues to sell arms to Saudi Arabia.

One of my hon. Friends talked about the Trade Union Act 2016 and how workers’ rights have been rolled back. When all this power comes back, supposedly, to the UK, what faith can we have that our rights and obligations will be upheld by this Government?

We have spoken about Erasmus, regulations and what our young people are going to do. I strongly believe that the whole rhetoric in this process has been damaging. Some of the phrases that have emerged, the slogans that have been put on the side of buses and the way that political discourse has developed during this period echo, sadly, the Trump Administration. That scares me and, I am sure, many others deeply. We hear that Brexit means Brexit, that it will be a red, white and blue Brexit, that nothing is agreed until everything is agreed, that there are economic impact studies, there are no economic impact studies—yes there are, oh no there are not—and that the post-Brexit trade deal will be the easiest in human history. We have had a political hokey-cokey on the grandest scale and who are going to be the ones who lose out the most? It is going to be the young people of our nations who have to deal with the impact of Brexit and clean up the mess that many in this Government seem hell-bent on creating. For their sake—for your children’s sake—and for the future of all our nations in the UK, let us stop this madness.

It has been a pleasure to listen to this wide-ranging debate and to hear some of the speeches, not all of which seemed to be specifically about clause 8. I compliment my opposite number, the hon. Member for Greenwich and Woolwich (Matthew Pennycook), who very accurately described the clause.

Does the hon. Gentleman not think that he and his Government have a responsibility to tell the people of this country who voted either leave or remain what the real impact will be? If he does not, will they not turn on the people who hid the information from them? Will he stop governing in secret, and make sure that the people who are running this country and the people who voted have all of the information and the truth?

I thank the hon. Lady for her intervention. I have always been clear that we have a responsibility to people on all sides of the referendum debate to deliver a successful outcome to our negotiations. However, delivering a successful outcome to our negotiations for the whole country does require keeping some information confidential for the purposes of negotiation.

The Government have consistently published information where we believe it is in the national interest to do so. We have already published 14 papers to address the current issues in the talks and to set out building blocks for the relationship that we would like to see with the EU both as we leave and in future. Those papers represent some of the hard work and detailed thinking that has been going on across Whitehall over the past 12 months. In addition, we have published technical notes shared with the European Union and may agree further joint publications with the EU as part of the ongoing negotiations.

But we must not forget that the House has voted repeatedly not to disclose material that could damage the United Kingdom’s position in negotiations with the European Union. Not only is that the approach taken by the UK; it is also the approach taken by the EU in its negotiations. The EU’s document, “Transparency in EU trade negotiations”, says:

“A certain level of confidentiality is necessary to protect EU interests and to keep chances for a satisfactory outcome high. When entering into a game, no-one starts by revealing his entire strategy to his counterpart from the outset: this is also the case for the EU.”

That once again drives home the need for a balance between transparency and securing the best outcome in the negotiations.

As the House will understand, many thousands of documents are being prepared across Government with regard to our exit from the European Union.

It is always a pleasure to serve under your chairmanship, Mr Bailey. I congratulate my hon. Friend the Member for Sittingbourne and Sheppey (Gordon Henderson) on securing this debate and on his excellent speech. He said that he was a simple soul, but he went on to demonstrate a grip of the facts and an erudition that rather belied that comment. He did a good job of not only representing his constituents but sharing the benefit of his commercial and negotiating expertise, which we welcome.

After the Prime Minister’s speech and the Secretary of State’s statement yesterday, I agree with the hon. Member for Livingston (Hannah Bardell) that it is a good thing that we debate these matters and the process of exiting the European Union. This is not the first time that I have stood in this Chamber in a debate while another debate on this process is going on in the main Chamber. That demonstrates the degree of parliamentary attention and scrutiny that the process is receiving.

On a point of clarification, I am pleased that we are now debating the detail, but I hope that the Minister shares the view—I am sure it is held by many people across the country—that it would have been great if we had had that detail in the run-up to the vote so that people had the full information about what this Tory Government are taking us into through this process.

The hon. Lady expresses an opinion about the past and the arguments that we had during the referendum. I think it is important to focus on the future and the process.

In the time that I have, I will make some brief remarks about the Government’s key objectives. First, in answer to the direct question that my hon. Friend the Member for Sittingbourne and Sheppey asked, I want to clarify that the Government are committed to respecting the will of the British people and delivering on the referendum result. That is why I welcome this debate and the opportunity to focus on the process and how we can get the best deal for the UK. As the Prime Minister has said, we will trigger article 50 and begin the process of leaving the EU by the end of March. That timetable has given us a bit of time to prepare the negotiating strategy and engage constructively with stakeholders. Yesterday’s announcements about our aims were informed by that consultation, which is ongoing.

We want a smooth departure from the EU and a new, positive, constructive and equal partnership for Britain and the EU—a partnership that will be good for Britain and good for the rest of Europe. That is why in her speech yesterday the Prime Minister set out a serious and ambitious vision of a new partnership with the EU for a global Britain, including a comprehensive plan covering our 12 negotiating objectives. I will not repeat them all, because all hon. Members will have followed that speech closely, but it is important that I reiterate their importance and, with the hon. Member for Strangford (Jim Shannon) in the room, say that one of the key principles is to maintain the common travel area with Ireland. In answer to the hon. Member for Livingston’s point—[Interruption.] I will not give way, because I have limited time to deliver quite a lot of detail, but in answer to one of the points that the Scottish National party has made regularly, the Prime Minister put an emphasis on protecting the rights of EU nationals in Britain and British nationals in the EU.

To deliver those objectives, officials in my Department and Ministers have carried out a programme of sectoral regulatory analysis and engaged with every devolved Administration and regions across the whole UK to identify the key factors for businesses, communities and the labour force that will affect our negotiations. We are also building a detailed understanding of how withdrawing from the EU will affect our domestic policies to seize the opportunities and ensure a smooth exit process.

As my hon. Friend the Member for Sittingbourne and Sheppey said clearly, the way to start a negotiation is not to tell the people we are negotiating with exactly what we plan to do. Indeed, the House agreed without a Division on 12 October last year that nothing we do or say should undermine the UK’s negotiating position. That was supported by a majority of more than five to one in a Division on 7 December. I welcome the support of my hon. Friend and the hon. Member for Strangford, and indeed that of the hon. Member for Greenwich and Woolwich (Matthew Pennycook), who sits on the Opposition Front Bench, for the article 50 process. My hon. Friend is right that we must leave the EU in accordance with the process set out in article 50 of the treaty on European Union, which he read out. That is the only lawful route for withdrawal from the EU under the treaties.

We expect the process to follow three stages: notification, negotiation and conclusion. First, we will notify the European Council of our intention to leave the EU under article 50. The Prime Minister has been clear that we will trigger article 50 by the end of March, and the House backed that timetable by a large margin in December. Triggering article 50 is the first step in making the United Kingdom a fully independent, sovereign country, free to make our own decisions. Our position remains that triggering article 50 is a matter for the Government, but as the House knows, we await the Supreme Court’s judgment, which I note is expected to be handed down next Tuesday. I do not want to comment on possible scenarios until that judgment has been made, but let me be clear: whatever the outcome, the Government remain committed to triggering article 50 by the end of March.

Secondly, once article 50 has been triggered, we will then negotiate a withdrawal agreement with the EU. Article 50 makes it clear that there are two years to negotiate such a withdrawal agreement. The Prime Minister has been clear that by the time the two-year period ends we also aim to have reached an agreement about our future partnership. Article 50 itself, as my hon. Friend pointed out, talks about taking account of that relationship in the withdrawal agreement. From that point onwards, we believe a phased process of implementation in which Britain and the EU institutions and member states prepare for the new arrangements will exist between us.

The Government’s priority is to ensure that we get the best deal for the UK. The UK is leaving the EU, but we are not turning our backs on Europe. If we approach the negotiations in a constructive spirit, as we intend to, we can build a partnership for a strong UK and a strong EU. Although we are confident that a fair deal along these lines can be achieved, we are clear that, for the UK, no deal with the EU is better than a bad deal. My hon. Friend has made his support for that approach very clear.

Thirdly, the precise timing, terms and means by which we conclude the process will be determined by the negotiations. However, the Prime Minister has confirmed that the final deal that is agreed between the UK and the EU will be subject to a vote in both Houses of Parliament before it comes into force.
