As I assume the right hon. Gentleman knows, that forms part of the discussions that are going on in the specialist committee, between us and the EU, to deal with these issues. Our view is that the regime should be very flexible, as Michel Barnier has outlined, in terms of respecting the unique position of Northern Ireland, because those goods going from GB to Northern Ireland are, by definition, very low risk, and we must ensure that we do not end up in a situation where it is presumed that 100% of the goods going from GB to Northern Ireland are what the EU would refer to as “at-risk goods.” That would be inappropriate for Northern Ireland businesses, would drive up prices in Northern Ireland and would restrict supply to Northern Ireland. That does not fit with the protocol’s outline of Northern Ireland remaining an integral part of the UK customs territory and single market.

At the moment, for Northern Ireland, there appears to be no certainty for businesses, and no certainty for the long-term future of the Good Friday agreement, as clearly any transporting of goods between north and south will now need to be checked somewhere and somehow. Also, in echoing the remarks of my right hon. Friend the Member for Maidenhead (Mrs May), there appears to be no certainty for the continuity of our country as a country that keeps its word and abides by the rule of law and international obligations. What certainty can my right hon. Friend give me that the Government understand the seriousness of these issues?

We, as a country, stand for international law and the order of the international system, and we always will. I think countries around the world are aware of that. They are equally aware that we are in these negotiations with the EU. Our focus is on concluding those in a satisfactory and suitable way in order to get a good outcome with a free trade deal, and good outcomes from the specialist committee that work for Northern Ireland. We must remember that delivering on the Good Friday agreement is not just about north-south; it is also about east-west and ensuring that there are no borders, north-south or east-west. That is why we have made the commitment on unfettered access, and that is what we will deliver through the UK internal market Bill.

My right hon. Friend is right to draw attention to the £150 million that has been set aside in the New Decade, New Approach agreement with regard to legacy resolution issues, but the funding of the pension scheme is of concern to all parties, as it was to the Select Committee. Can he confirm that he will ensure that, through the block grant, moneys that are required on top of the £150 million will be forthcoming so that justice can be done and the money paid in a full and timely way?

My hon. Friend the Chair of the Select Committee is absolutely right. This matter is devolved and it is for the Northern Ireland Executive to pay for through the block grant. Those discussions will go ahead in the normal way, but, as I have said, as the money is already there, this is something that the Executive can be moving on with. They can start getting this process going and start getting these payments out to the people who have already waited too long.

We are working with Northern Ireland businesses and the Executive to ensure that any new administrative procedures are streamlined, avoid any unnecessary burdens and do not affect any flow of trade. There should be no tariffs on internal UK trade because the UK is a single customs territory. For example, a supermarket delivering to its stores in Northern Ireland poses no risk whatsoever to the EU market. No tariffs would be owed for such trade. The principle needs to be formalised with the EU in the withdrawal agreement Joint Committee. We are talking to businesses, including via the engagement forum and other opportunities, to explore proposals to make sure that we maximise the free flow of trade.

Hello from Dorset. My right hon. Friend knows that Northern Ireland businesses want to prepare to make Brexit a success; the problem is that they do not quite know what they are preparing for. In reflecting on last week’s Select Committee hearing, is my right hon. Friend persuaded of the merits of providing stepping-stones between now and 31 December, so that business knows what to prepare for and in what timeframe?

As I said, we are working with Northern Ireland businesses and the Executive to support preparations for the end of the transition period at the end of this year. As we engage, including through the business engagement forum that we have already established, we will set out further details to help businesses to prepare for the end of the transition period at the earliest appropriate moment. I assure my hon. Friend that further guidance will be published this summer to make sure that people and businesses know what they need to do to prepare for the end of the transition period, which will be at the end of December this year.

The recent events of covid-19 have underscored the fragility of international supply chains, certainly with regards to PPE, when international demand is very high. Would my hon. Friend undertake at the appropriate time to discuss with his counterparts in Scotland, Wales and Westminster the opportunity to grow this important area of our economy, thereby creating future jobs and enabling us to produce enough PPE in this country with a UK badge?

My hon. Friend, the Chair of the Northern Ireland Affairs Committee, makes an important point. Of course, it is vital that we work on the international procurement effort with the devolved Administrations, as we have been, but it is also essential that we maintain our domestic supply. I pay tribute to businesses in Northern Ireland, such as Denroy Plastics, which the Secretary of State spoke to yesterday, and O’Neills, which he visited just before the outbreak and which has switched over its production lines to producing vitally needed PPE and is making a huge contribution already.

A strong economy requires access to a skilled, motivated workforce. Clearly, we have to ensure that the skills base in Northern Ireland is supported and grows, but will my hon. Friend assure me that the voice and needs of the Northern Irish economy will be heard loudly in the Home Office as we finesse our immigration policies?

The hon. Gentleman is right to question some of Ulster University’s ongoing projects, but on the other hand, Northern Ireland universities are among the best in the country. We need to support Ulster University and ensure that we deliver the project of getting the medical school up and running. That will be in the best interests of people in the north-west and more generally.

May I add my congratulations to my right hon. Friend and all those on both sides of the Irish sea, who have worked so hard to get us to this joyful place? My right hon. Friend knows that there is a huge pent-up demand among the people of Northern Ireland for change and reform in many areas that have lain stagnant for the last three years. How confident is he that there is the resilience among the official corps to deliver in a speedy way the changes for which the people of Northern Ireland have been waiting far too long?

My hon. Friend is right about the need for reform and change. I pay tribute to David Sterling and his team at the Northern Ireland civil service who for three years have had to step in in the absence of political decision making from the devolved Assembly and Executive. I also remind all those supporting the new Executive that, as well as funds, we must focus on reform, change and transformation.

I congratulate the hon. Member for Upper Bann (Carla Lockhart) on a fluid, cogent and passionate maiden speech. The attention that all quarters of the House gave to her remarks indicated the interest with which she was heard. She spoke with great passion about the issues on which she wishes to campaign in this place, with great warmth about her constituency and in tribute to her predecessor and my friend David Simpson, and with clarity and confidence about what motivates and drives her Unionism. On all those points she is to be congratulated, and I wish her much happiness in her years of service in this place.

A number of colleagues have referenced the deteriorating situation in the arenas of the public policy delivery of health, of welfare and of education and, as the hon. Lady referenced, the intolerably high level of suicides in Northern Ireland. I do not think anybody would suggest that the restitution of Stormont would solve all those problems at the stroke of a pen, but certainly I think all of us should be motivated in this place by the idea that local decisions taken by locally accountable politicians are in the best interests of those we serve, and therefore the imperative underlined by my hon. Friend the Minister, whom I must thank for updating the House, to reventilate on the crucial, pressing and urgent need to get Stormont back up and running is right. It is perhaps tempting fate to suggest that some of the rumours coming from the discussions in which my right hon Friend the Secretary of State is taking part indicate some cause for hope, but let us in our night prayers this evening pray that we do see some success and the restitution of Stormont.

I want to turn, albeit very briefly, to the argument, or conundrum, deployed by my right hon. Friend the Member for Forest of Dean (Mr Harper). I understand entirely that if the talks fail the default position will be a tendency to say, “Enough with deadlines; we can’t have any more deadlines, we now have to cut to the chase.” The easiest chase to cut to is of course direct rule, either officially or unofficially, to try to address the pressing issues.

While I understand the ease, and for some indeed the desirability, of that, it would in my judgment be a retrograde step. The devolution genie in this kingdom is very firmly out of the bottle and it would be both undesirable and possibly impossible to put that genie back.

I also think it would be the easiest thing to do for the politicians of Northern Ireland, where in essence it would effectively put on the back burner the imperative to try to find some workable solutions and accommodations to overcome the historical tensions—there would be no need for that because decisions would be taken in this place. That would not, in my assessment, just lead to a maintenance of the status quo; it would actually be a very significant step backwards to decades and years of acrimony, bitterness and the blame game.

I therefore suggest that if the talks ultimately fail—let us all repeat that we pray they will not—the default position will have to be fresh elections. They may very well throw up broadly similar results to previous elections, but we are in incredibly interesting times electorally, as last month’s general election illustrated. The stark and indeed startling fact that for the first time in its history Northern Ireland elected, albeit by a slim margin, a majority of non-Unionist representatives to this place shows that things can change, and change very rapidly.

The hon. Member for Upper Bann spoke about her determination to serve her community. I know that that determination will be shared by all her colleagues from Northern Ireland, whether they are from the Alliance party, the Social Democratic and Labour party, the Democratic Unionist party and, while they do not take their seats, Sinn Féin. I think the challenge from the electorate to all the political parties who hold true in their repetition of that motivation will effectively be, “Put your money where your mouth is. If that is what motivates you in public service, you will have to find a way to resolve whatever the outstanding hurdle is without defaulting to the easy get-out-of-jail-free option of direct rule.”

New elections may very well produce a continuance of the stalemate, but they could also act as the engine to break the logjam. While wishing the talks success, I urge my hon. Friend the Minister to resolve not to do the easy thing in those circumstances and to trigger fresh elections and say to the electorate, “You are concerned about deteriorating standards in education, health and welfare, high levels of suicide, and other areas of public life. This is now your opportunity to force your politicians to find a way of dealing with them through restoring Stormont. If they can’t, you may very well start to choose new politicians.”

A few moments ago, the hon. Gentleman referred to the outcome of the general election in Northern Ireland and to the number of pro-Union and anti-Union people returned to the House. Does he accept that when I was first elected 18 years ago the combined percentage of people voting for united Ireland candidates came to 42% and that in December last month it was 39%? The vote for united Ireland parties has gone down in those 18 years. He has just spoken about what might happen after an election to the Assembly, but will he outline how he thinks the problems would change, whatever the make-up of those dealing with the problems?

The hon. Gentleman makes a valid point. One can argue percentages till the cows come home, but in terms of bums on seats, as it were—or, in the case of Sinn Féin, non-bums on seats, if that is the right phrase to use—the figure speaks for itself. That should give us all cause for concern. It should also motivate those of us who share a strong belief in the importance of the maintenance of the Union and the unity of the United Kingdom to redouble our efforts, strengthen our arguments and make ever-more attractive the reasons to maintain the Union. That is as applicable in Northern Ireland as it is in Scotland, because as Unionists we face the twin challenge of trying to persuade a growing sceptical population that there is relevance to Unionism today and to its continuing. We cannot just walk through a fog of presuming that the status quo, almost of itself, will continue.

On what the hon. Gentleman asked, I think that last month the electorate, remainers and leavers alike, decided that they wanted an end to the impasse, throwing up some very peculiar and—as far as Government Members are concerned—very welcome results. When the electorate has had enough, they will pick up the stubby pencil at the ballot box and almost use it as a sword, as they use the ballot paper as a shield, to reassert what they want.

This point is possibly unpalatable to many: if politicians are prepared to not allow the restitution of devolution, because they seek to argue over points that for many in Northern Ireland will seem irrelevant or not as pressing as dealing with health, education and welfare, there is the risk that those electors will turn to politicians who are less hog-tied by those traditions and seek to break the impasse by having a new set of faces around the table. It may result in exactly the same sort of result, but if these talks fail we should default to fresh elections and not just write the electoral process off, as though it was just another way of staying the hand of the inevitable—the return to direct rule, the inevitability of which we should resist at all costs.

It is clear that there are reporting requirements in the functioning of the protocol, but, as is clearly set out in article 6 of the protocol, we want to ensure that we use the Joint Committee to reduce them and make sure that we have the absolute minimum burden. The protocol itself clearly gives the Government the ability to provide unfettered access. I shall address that in more detail as I go on.

Northern Ireland remains in the UK customs territory and can benefit from future trade deals that we strike with the rest of the world. The Prime Minister has repeatedly made it clear that the deal is good for businesses and individuals in Northern Ireland.

Does the Minister agree that it would be enormously helpful if the Government’s stance ensured that whatever regulatory regime is required, it is not only of the lightest touch but is as cost-neutral as possible? Therefore, there needs to be detailed discussion with Treasury colleagues to see what mechanisms may exist for reclaiming, either through the VAT process or offsetting against personal or corporation tax, in order to make it cost-neutral, with the understanding that we need to be able to do something.

That was a quicker speech than we thought it would be.

May I begin by briefly putting on the record that I think the House should have enormous appreciation for the hon. Member for Ealing North (Stephen Pound)? During my time in this place since 2015 he has been the steadfast rock with regard to Northern Ireland. I occasionally see him as the political equivalent of the Giant’s Causeway—nobody quite knows why he is there or why he is that shape, but we know that things would not quite be the same if he was not there. The House will miss him, and his interest in and knowledge of the affairs of Northern Ireland and the politics of the island of Ireland will be missed. [Interruption.] Yes, he is going to be a tourist attraction in his own right—and is already listed, I believe, as an ancient monument.

Our thanks should also go to the Minister of State, my right hon. Friend the Member for Ruislip, Northwood and Pinner (Mr Hurd). The idea of the Northern Ireland Office not having a Hurd somewhere near it is depressing and dispiriting, and I wish my right hon. Friend well. Although she is not in her place, as Chairman of the Select Committee I ought to repeat what I said in Committee this morning and express my eternal thanks to the hon. Member for Vauxhall (Kate Hoey), who has done so much on behalf of the communities of Northern Ireland over so many years.

I obviously support this budget. I echo entirely what the hon. Member for Rochdale (Tony Lloyd) said, and I also echo the concerns of the hon. Member for Birmingham, Selly Oak (Steve McCabe) with regard to the welfare cliff that we canter towards in a slightly unguided, uncontrollable way.

I will not read it out, but page 5 of the explanatory notes to the Bill sets out clearly why fast-tracking is necessary. We appreciate the reasons why, and we can rehearse and rehearse and rehearse in a rather odd political version of the film “Groundhog Day” the comments, “I wish Stormont was back up and running…Ministers are doing all they can to achieve that…Parties stand ready to come back”, yet we never quite get that over the line.

While we fiddle with that issue, everybody is aware of the problems in Northern Ireland with regard to welfare, the downturn in education and the acute issues with healthcare. If we are serious, and if talking about Northern Ireland as a part of the Union is something beyond words and some sort of abstract, we should worry that we have allowed the eccentric to become the norm and allowed a mindset to develop whereby emergency legislation, sticking plasters and ad hoc solutions have to be found. If this was taking place in Scotland, Wales, North Dorset or any of the counties of England, we would be up in arms. Front-page articles would be written about it and questions would be asked all over the place. The fact that they are not is a cause for concern. How can we ever hope to make the politics of Northern Ireland and public service to its taxpayers as normal and as mainstream in Ballymena as one might find in Blandford Forum in my constituency? We are never going to make the progress on peace, reconciliation and confidence building that is so desperately required.

I agree with what the hon. Gentleman says. He mentioned welfare a few moments ago. That is of particular concern to many people in Northern Ireland, particularly with regard to welfare mitigation payments, which were negotiated by a member of my party when he was Minister. They give rise to great concern, because in four short months, those mitigation measures will fall away. We need to take steps immediately and urgently to deal with that problem.

The hon. Gentleman is absolutely right. People in communities in Northern Ireland today will be worrying about the impacts of the end of the mitigations. They will be among the most vulnerable in the community, who have the least opportunity to ride even a temporary blip or gap in service provision, and they will be the hardest hit. We understand that we are adding to their justifiable reasons for concern and anxiety, because as well as Stormont not sitting, Westminster will not be sitting either. The ability of right hon. and hon. Members to hold the Secretary of State and his ministerial team to account on the Floor of the House, in a Select Committee or in Westminster Hall will be removed from us. A democratic deficit—an accountability vacuum—will be created for five or six weeks, and that presumes that on 12 December, there is a clear-cut result that effectively allows something to resume on Monday 16 December.

We do not know what the result will be; we could be in for weeks of horse trading, with the usually happy time of Christmas and the new year elongating the window when no decisions are taken into early in the new year. Those who can least afford any hardship are likely to be facing it, and having their burden of woe added to, without having any democratic forum in which their concerns can be expressed and the decisions—or lack of decisions—taken by Ministers can be questioned and challenged. That is the icing on the cake of the democratic deficit that is now becoming the norm, and of the tendency to deal with Northern Ireland as a perpetual emergency, which is subliminally, if you will, undermining the path of peace and civil stability that we all wish to see. We have to be careful: we are allowing this psychologically to become the norm.

I do not feel very gallant.

I seem to recall that two Secretaries of State ago I sat in this House and heard that direct rule would have to be imposed very soon, and here we are, 18 months later, still not there. The people of Northern Ireland must be really fed up with the fact that we cannot give them proper governance. Please, let us have direct rule if we cannot get the Executive working again.

I have enormous sympathy with what my hon. Friend says. Again, if these were normal times, that would probably have happened, but as we all know, when it comes to the delivery of politics and services in Northern Ireland, we push one and we pull the other, and it is a bit like water in a balloon: it moves around and alters but the shape remains vaguely identifiable. In theory, direct rule would be a good thing, bringing decision making and delivering policy change in real time for real communities, but of course that would provide grist to the mill of those, including some in the nationalist community, who like to castigate the British Government and say, “This is just the big imperial mother Parliament flexing her muscles and exerting herself”. So it is not, I am afraid, as easy as just deploying direct rule, as desirable as that would be for service output.

My hon. Friend is right, however, that at some point somebody will have to take a decision, and how we mitigate things would then depend on that decision, because this perpetual coma, limbo, purgatory—call it what you will—is not sustainable. These are citizens we should consider equal to ourselves on the mainland. This disruption in the delivery of governance, which we would not support or sustain for more than three weeks were it an English county division, cannot be allowed to become the norm any more. At some point, somebody will have to be brave and take a decision, knowing full well that we can please some of the people some of the time, but not all of the people all of the time.

I want to focus on the things that need to be worked through. Those things are immediate. Those things require time now, and they cannot be delayed. Therefore, my focus is on trying to work through a whole set of issues over the coming days and weeks.

It is clear that a general election this side of Christmas is going to lead to an extension of the timetable beyond the end of January for any chance of Stormont to be back up and running. In the Secretary of State’s mind, at what point will stumps have to be drawn, when energies have been expended and best endeavours have been deployed but success has not been forthcoming? We cannot leave the good folk of Northern Ireland without political direction and new initiatives on health, education and welfare, as the right hon. Member for Belfast North (Nigel Dodds) said. Where are we going to be on that?

My hon. Friend makes the important point that the extension of the Northern Ireland (Executive Formation and Exercise of Functions) Act 2018 comes to an end in the second week of January, so time is of the essence. We need to make the most of this time, and all I can say is that I will do whatever I can over the coming days and weeks to ensure that we get the Executive up and running and that we focus on that as our priority.

I understand that, and no one in the House will doubt my right hon. Friend’s sincerity in relation to that task or the good faith with which he approaches it. However, in the heat and battle of a general election campaign, there is no scope for those discussions to continue and, dare I say it, this could slightly prejudge the outcome. Were there to be a hung Parliament, or if the Labour party were to be in office, the whole thing would change again. Let us be frank: this early general election is not helpful to the timely restoration of Stormont.

I think I should move on with my speech, Madam Deputy Speaker.

Similarly, the decision on Ulster University’s proposal for a medical school on its Magee campus is a devolved issue, and the merits of the business case will have to be weighed up against all others that aim to address the overriding need for more medical school places. On 17 October, I met a range of stakeholders in Derry/Londonderry, and I am personally committed to seeing what I can do to assist with this ambitious project, which has secured political consensus across the local area. This Government remain open to testing the eligibility of contributing inclusive future funds towards the capital costs of the medical school.

In addition to the matters highlighted in the report, I would like to draw the House’s attention to other matters on which the Government have a duty to legislate—namely, the creation of a scheme for victims’ payments and new laws to introduce same-sex marriage and opposite-sex civil partnerships. As we discussed earlier, on 22 October the UK Government launched a public consultation on the legal framework for a troubles-related incident victims’ payments scheme, the consultation on which will run for five weeks. The UK Government would welcome comments from anyone with an interest or view, to inform the shape of legislation to be introduced by the end of January 2020. We must acknowledge and recognise the unacceptable suffering of those seriously injured in the troubles through no fault of their own, as part of wider efforts to support Northern Ireland in building its future by doing more to address its past.

The scheme is intended to provide acknowledgment to those who are living with serious disablement as a result of injury—both physical and psychological—in a troubles-related incident and to provide a measure of additional financial support. We are consulting on proposals for how such a scheme could be delivered. It is a core element of the Stormont House agreement’s proposals to help address the legacy of the troubles, and it is vital that we make progress across this and related matters. As I said earlier, we are not prejudging any element of the scheme; we are consulting to achieve broad consensus.

Following 21 October, a further duty in relation to providing for same-sex marriage and opposite-sex civil partnerships in Northern Ireland has also come into effect. The Government will ensure that the necessary regulations are in place by 13 January 2020, so that civil marriage between couples of the same sex and civil partnerships for opposite-sex couples can take place in Northern Ireland. From that date, we expect that couples will be able to give notice of their intent to form a civil same-sex marriage or opposite-sex civil partnership to the General Register Office for Northern Ireland. Given the usual 28-day notice period, the first marriages should be able to take place in the week of Valentine’s day.

Following concerns raised by the hon. Member for St Helens North (Conor McGinn) about the timing of a consultation on conversions from civil partnerships to same-sex marriage and marriage to opposite-sex civil partnerships, we are exploring whether we can consult shortly with a view to delivering the regulations as closely as possible to the previously mentioned regulatory timetable. Regulations to enable religious same-sex marriage ceremonies and to provide appropriate religious protections will also follow shortly, allowing a period of consultation so that the regulations can be tailored appropriately to the particular needs and circumstances of Northern Ireland.

Madam Deputy Speaker, I thank you and the House for your patience with this speech. I hope that I have made clear my undiminished commitment to see Stormont back up and running again. Northern Ireland needs its own locally elected representatives making decisions on local issues and making Northern Ireland’s voice heard across the United Kingdom.
