This follows on from a conversation I had with the hon. Lady and her constituency neighbour, the hon. Member for Richmond Park (Sarah Olney). We are well aware of Thames Water’s proposals for this scheme, which is still in a consultation stage. It is one of 17 strategic water resources options being considered across the Thames catchment, and I will be updated by Thames Water, as will the Secretary of State, when it has completed its consultation.

During my various meetings, including at the UK corporate headquarters of Bidfood in my constituency, exasperated businesses have expressed serious concerns about the damage being inflicted on them by the Conservatives’ ill-thought-through “Not for EU” labelling scheme. Along with increasing consumer confusion, it will also likely reduce choice and raise prices for shoppers. Secretary of State, why are this incompetent Government so hellbent on burdening British businesses with more bureaucracy and red tape, and increasing their cost base?

First, let me say that there is a consultation taking place, so there is discussion on this. Secondly, £50 million has already been allocated as transitional support. Thirdly, particularly for colleagues in Northern Ireland, it is important that, far from restricting choice, we maintain it. That is exactly what the Windsor framework, which the House as a whole agreed to, is designed to do.

My right hon. Friend is right in that live exports from Northern Ireland to the Republic will be able to continue; that is good for the Northern Irish agricultural economy and we do not want to stop that trade. However, this Bill, when we get to debating the actual Bill, is about stopping those long journeys from GB into continental Europe. We have not seen those since Brexit, but we want to ensure that they cannot return in the near future.

This Bill is genuinely a Brexit benefit: we are able to take control of our ports within GB and stop the live export of animals for slaughter or for fattening. That is a genuine Brexit benefit and one that I hope we can now start to debate. I hope the right hon. Member for East Antrim will withdraw his motion.

I am grateful for the opportunity to speak from the Opposition Benches on the Animal Welfare (Livestock Exports) Bill. We have tabled amendments inspired by Labour’s track record of delivering on animal welfare, from ending the testing of cosmetic products on animals and stopping the cruelty of fur farming to cracking down on horrific hunting practices. They allow us to compare our record with that of this Conservative Government and their shameful failures. They have bottled their manifesto promises to end the import of hunting trophies and crack down on puppy farming, to name just two of their animal welfare failures. As I indicated on Second Reading, Labour welcomes this legislation, but we regret that it has taken so long to bring this unnecessarily cruel trade to an end. We will seek through our amendments to make the Bill as fit for the future as possible.

It will be no surprise to the public that Labour is the party of animal welfare. Before turning to the amendments in my name and those of my hon. Friends the Members for Croydon North (Steve Reed), for Kingston upon Hull West and Hessle (Emma Hardy), for Cambridge (Daniel Zeichner) and for Chesterfield (Mr Perkins), I would like to acknowledge and thank the many campaigners and stakeholders watching these proceedings for their hard work, campaigning and commitment. Our amendments do not seek to delay the Bill or to put the Government off doing anything at all. Labour wants to make this Bill as strong and purposeful as possible and see it signed into law at the earliest opportunity.

The Tories have taken a weak approach to animal welfare in recent years, from pulling Bills that were meant to be debated in this place to caving in to the extremists on their Back Benches.

The Labour party has long called for a ban on live exports for fattening and slaughter from and through Great Britain. Why does my hon. Friend think the Government have taken so long to bring in this Bill and why does she think they scrapped the Kept Animals Bill?

My hon. Friend makes an excellent point. I am not sure I know the answer to those questions, and I would be grateful if the Minister answered them in his winding-up speech. The delay has been too long, as my hon. Friend says, and for too long animals have continued to suffer unnecessarily. That is why amendments 2, 3, 4 and 5 are necessary and I am delighted to speak in support of them today.

The Minister will know that the export of live animals from the UK grew substantially during the 1960s and 1970s. Live sheep exports ranged between 85,000 to 411,000 from the 1960s to the 1980s. At the same time beef and veal, including live exports, increased from approximately 65,000 in the early 1970s to nearer 200,000 in the 1980s, and live pig exports rose dramatically from 30,000 to 60,000 in the 1970s, peaking at 619,000 in 1982.

Those dramatic rises and the patterns we have seen more recently make amendments 2, 3 and 4 more important. They are probing and preventive in equal measure. The amendments force us to think about the macro picture facing us and highlight a major inadequacy in this Bill: Ministers have chosen to list the species covered by this legislation on the face of the Bill. We agree and support covering the listed species, but what happens when they are banned? Where will those seeking to profit from the live export of animals look next? With apologies for the pun, Mr Evans, which species and which animals will be moved up the pecking order?

Amendments 2, 3 and 4, like amendment 1 in the name of the hon. Member for Westmorland and Lonsdale (Tim Farron), which we support, would help to force Ministers to take up and recognise a comprehensive, bigger-picture approach—not a race to the bottom to get the bare minimum over the line and no more of a Government simply wanting an easy life. We will demonstrate to our constituents, from Newport West to Northampton North and from Epping Forest to Erewash, that this Parliament takes animal welfare seriously and we have a plan to get things right.

I turn now to amendment 5 in my name and those of my colleagues. This important amendment would allow the appropriate national authority to extend, by statutory instrument subject to the affirmative procedure, the list of livestock species that may not be exported for slaughter. As clause 1 of the Bill sets out, the prohibition on live exports would currently apply to calves, sheep, pigs, wild boar, goats and equines. While those are historically the main farmed animal groups subject to live exports for slaughter, it is not an exclusive list, and other animals could potentially be exported live from GB.

It is also the case that a lack of historical precedent for a particular animal is not a guarantee that live exports will not take place in future, especially as UK livestock farming continues to evolve. That is why we must be vigilant and take whatever preventive measures we can, which we have a unique opportunity to do today with amendment 5.

Labour believes it reasonable for the Secretary of State and the devolved Governments in Holyrood and Cardiff Bay to have the power to extend the export ban to other species if they feel that the science justifies such a move. It may be that the power is never needed, but it seems sensible to allow for the possibility that other species may need to be added to the exclusion list in future, without the need for further primary legislation. Amendment 5 would provide that power, enabling the Secretary of State in England, and Ministers in Scotland and Wales, to add groups of livestock to the Bill through a statutory instrument subject to the affirmative procedure. That would effectively future-proof the Bill and properly make it fit for purpose.

I can try, but the task of finding clarity in the position of the Mayor of Greater Manchester in this regard is somewhat confusing. First he says he is in favour of tackling the issue of air quality—and, indeed, we have heard from Opposition Members how important that is—and then, when he has powers to take action, he seems to look to Westminster and expect us to act on his behalf. Of course I will follow up my hon. Friend’s request and seek clarity from the Mayor, but the ability to do so has, to date, been rather limited.

Let us look behind the rhetoric. Given that the Leader of the Opposition keeps telling us that he wants the Labour Government in Wales to be his blueprint, it is probably worth our taking a look at Labour’s record in this respect. [Interruption.] The hon. Gentleman asked the question, but he does not seem to want to hear about Labour’s record, which is not surprising. Under Labour in Wales, the average number of spills from storm overflows last year was 66% higher than the average in England. We have introduced unlimited fines and tougher regulation, and we have set strong targets in legislation. We can see what Labour in power would deliver—we can see it in Wales: a 66% increase in storm overflows.

The Government are committed to ensuring that victims are treated fairly and compassionately. We know that joined-up working across the criminal justice system works, and we know that supporting victims makes a real difference. That is why we are spending four times as much on victim support as was the case in 2010.

Shockingly, according to the latest figures, more than 6,400 Crown court cases have been waiting more than two years to be heard. That is up more than two thirds on last year alone. What does the Attorney General have to say to the victims, who, to their despair, have found that their lives have been put on hold while they are waiting for justice? And what does she say to those who can no longer cope with any more delay even if that means having to let their case collapse?

I am happy to say that the hon. Gentleman and I share a local Crown prosecution area in Thames and Chiltern where the local victim attrition rate is well below the national average. It is running at about 13%. Any attrition is too high, and we want to make sure that we support victims to enable them to continue to bring their cases. That is why we have put in place about 800 independent sexual violence advisers to help those victims feel supported and able to go to trial.

It is crucial for waste incineration plants to have the correct permits and to be correctly monitored, which is why the Environment Agency has imposed strict emissions limits and applies the permit scheme to a number of pollutants to ensure that people who live near incinerators are completely safe. All operators of incinerator plants must carry out their own monitoring and report back constantly on the safety of their plants, because human health is, of course, critical.

Halting species decline is a considerable task, but one to which we are absolutely committed. Again, I recommend the perusal of our environmental improvement plan, which summarises the significant action taken so far, but let me give a few examples. We have created or restored plant and wildlife habitats equivalent to the size of Dorset, we have established 40,000 agreements with farmers on nature-friendly actions, we have 22 landscape-scale restoration projects under way, and we have benefited from the conservation status and prospects of 188 species.

The UK is one of the most nature-depleted countries in the world. Research conducted by the Natural History Museum has revealed that when it comes to the amount of biodiversity that survives, we are at the very bottom of the list of G7 nations and among the lowest 10% globally. Thousands of badgers continue to be slaughtered unnecessarily; that, along with bee-killing neonic pesticides, has been authorised by this Government, who have also have failed to act to stop illegal hunting or effectively limit peatland extraction or moorland burning. Moreover, they have missed the legal deadline for the publication of their own environmental targets. Given all these facts, how can we now trust them to ensure that some of our most loved and iconic British animals do not become extinct?

I point to the Environment Act 2021. I also point out that the real priority for species abundance is creating habitat, and in a country where 70% of our area is farmed, that is exactly why we have our environmental land management schemes. We are planting more trees and creating more habitats. We are investing £750 million to create more opportunities to plant trees and hedgerows. We are improving the air that all species breathe and improving water quality. We are putting everything we can in legal targets and interim targets, as well as in moral ambition, on the back of our environmental improvement plan.

I am grateful to my hon. Friend not only for drawing that to my attention now, but for doing so in private. I can only imagine the stress and upset of someone having their dog attacked by another dog in a public place, and that ending up in the fatality of their pet. I am more than happy to meet my hon. Friend to discuss how we can assist her with it.

I and many other Labour Members have long called for the kept animals Bill to be brought back to the House so we can work collectively with the Government to deliver on animal welfare, not to mention to deliver on the Conservatives’ solemn pledge in their last election manifesto. However, many Tory Back Benchers are weak on animal welfare and on action, and today’s statement shows that Ministers do not have the courage to face down so many rebellious Conservative Back Benchers. The kept animals Bill was originally delayed because Ministers could not agree on policy in line with their Back Benchers. Does the Minister agree that today’s statement binning the Bill, and letting down millions of British animal lovers, demonstrates that the Government no longer have control over their Back Benchers?

That is just wrong. This demonstrates that we think there is a better and more efficient and effective way to deliver the things we have committed to. The good news is that the hon. Gentleman will have the opportunity to help and support the Government in delivering them as these measures go through the House, albeit in a different format. I look forward to seeing him in the Lobby supporting the measures we are going to bring forward.

I start by adding my voice to that of others who have paid tribute to Sir David Amess and James Brokenshire. I knew neither of them really, but I can see how much I missed in not knowing them. They sound like they were absolutely the very best of us and I send my love and thoughts to their families. My heart goes out to them.

This Bill is meant to be a once-in-a-generation piece of legislation. It has been described by the Government at various times as a flagship or a lodestar, and it is about time it started to live up to that kind of rhetoric, given that the UK is one of the most nature-depleted countries in the world with 15% of its species now threatened with extinction. With that in mind, I welcome the improvements that have been made to the Bill in the other place, many of which address issues that have been raised repeatedly in both Houses. I also welcome the amendments that have been tabled by the Government to set legally binding targets to halt the decline of nature.

The Bill has a very long history: it was first proposed in 2018, has been repeatedly delayed and, last year, was absent from Parliament for more than 200 days. I urge the Government not to now create further delays and to accept these crucial amendments from the other place to make the Bill law before COP26. That is the kind of leadership that people are looking for from the country that will host that key meeting.

On Lords amendment 1, which requires the Prime Minister to

“declare that there is a biodiversity and climate emergency domestically and globally”,

I am utterly dumbfounded that the Government cannot agree to it. They may argue that it does not meaningfully change the Bill, which may be the case, but it is none the less incredibly symbolically important. With the Intergovernmental Panel on Climate Change’s most recent report spelling a “code red for humanity” with 1 million species now threatened with extinction, we know that an emergency is upon us.

As Lord Deben said in the other place, refusing to accept this amendment

“will send the wrong signal, at a time when we should be united in sending the right signals, so that in all discussions people will know precisely where Britain stands.”—[Official Report, House of Lords, 6 September 2021; Vol. 814, c. 618.]

I therefore urge the Government to rethink their position and to listen to the scientists raising the alarm, to the young people on the streets worried for their future, and to the parliamentarians in this House. There are now less than two weeks until COP26 and if the UK is serious about demonstrating leadership, rejecting this amendment just seems so contrary to what we need to see—so perverse.

Soils and air are the very substance of what the Bill is about. Lords amendment 2, tabled by my noble Friend—I do not often get to say that—Baroness Bennett of Manor Castle, sets soil health and quality as a priority area for long-term target setting. Soils, as we know, are the complex ecosystems upon which all life on this beautiful planet relies. A staggering 25% of the world’s biodiversity lives in our soil. Britain’s soils alone store almost 10 billion tonnes of carbon. It is not simply dirt that can endlessly be abused and neglected; it is life itself. Its health is absolutely essential if the UK is to succeed in achieving its climate and biodiversity targets, yet we lose more than 3 million tonnes of topsoil every year in the UK. In its recent independent assessment of the UK climate risk, three of the Climate Change Committee’s eight urgent priorities relate to the impacts of the climate crisis on soils, and just today a new report was published that identifies poor soil health as a threat to national security.

I welcome the Government’s commitment to publish a new soil health action plan for England to ensure that soils are sustainably managed by 2030. That is desperately needed, but I am concerned that the draft outline will not even be consulted on until next spring. It is also positive to hear that the Government are exploring the possibility of a new target on soil health under future Environment Bill regulations, yet soil health merits proper referencing and legal protection through this Bill to take it beyond one Parliament. When our soils are rapidly degrading, we need that target now, so I urge Ministers to review their decision on Lords amendment 2.

Many hon. Members have spoken very eloquently about Lords amendment 3 on air pollution, and I would simply echo what others have said about the perversity of this. At a time when the WHO has just slashed the guideline limit for air pollution, the fact that we are refusing even to bring ourselves in line with the current—out-of-date—pollution target just seems to be incredibly perverse. Everyone has the right to clean air, as others have said, and we should be acting on it.

On tackling air pollution, does the hon. Member not agree that, to take people off road and on to rail, it is about time the Government built the western rail link to Heathrow? It would benefit people not only in my Slough constituency, but in the south-west, Wales and the west. That is the only way because if we are serious about tackling the climate crisis, rather than just talking about it—the Government committed to it in 2012, but have still not yet dug a single spade—it is about time that we moved forward on these transport infrastructure projects.

We have been speaking about this. I hear what my right hon. and learned Friend is saying, and I am listening. I am going to say that there is a dialogue, but I will leave it at that. However, there is so much more that will help with this issue, and the wider issue of water pollution, than what is in this Bill. I think he would agree that there are a lot of water issues to be dealt with that the water companies will be held to account for. One of the very strong things we are doing, which is not in the Bill, is producing our draft policy statement to Ofwat, the regulator. For the first time ever, we have put at the top of the agenda that it will have to get the water companies to address storm sewage overflows. I think we would all agree that they are necessary in an emergency, but they have been used far too frequently. I hope by all of this we are demonstrating what are doing, and that is why I am taking so long going through it. It has not started right now—well, not all of it—but when it does start, it will make a huge difference to the progressive reduction of harm.

As has been said, it is great to hear about these plans, and we have been hearing about them for some time. Once we set aside all the blurb and the peripheral extraneous issues being outlined, are there any targets or deadlines? When will all English rivers be sewage free?

I would argue that it is not blurb. The way we direct such changes is through policies such as these, and they will start to happen immediately. Water companies are totally aware of the policies, and through such measures we will cut down on harmful sewage storm overflows. Under the Bill we must also set a range of water targets. We have set up the storm overflows taskforce, which will report early next year on what the target should be for elimination. We will also have targets in other important areas of water quality, including phosphates, nitrates, waste water—all those areas are important and will be tackled. That is coming down the tracks imminently.

I would be delighted to meet colleagues to discuss this important subject. New measures in the Bill specify that a dog will be considered to be at large unless it is on a lead of less than 1.8 metres or the dog remains in sight of the owner, who is aware of the dog’s actions and is confident that the dog will return if called .It is important that we continue to work on these details to get this absolutely right.

We have amended the Environment Bill to require a new, historic and legally binding target for species abundance for 2030 to be set, aiming to halt the decline in nature. The details of that target will be set out secondary legislation and the target will be subject to the same requirements as the other long-term legally binding targets set under the Bill.

The UK is among the most nature-depleted countries; half our wildlife has decreased since 1970 and one in seven species is now at risk of extinction. Given a decade of huge cuts, all the rhetoric and the modest uplift in Natural England funding cannot hide the fact that the Government have consistently missed United Nations biodiversity targets. Minister, in order to show leadership and set an example to the rest of the world, should a natural target not be set now, rather than wait, so that we can stop and reverse the decline of nature by 2030?

I hope the hon. Gentleman will agree that the Government are taking this issue really seriously. We are the first Government to set a target such as this, aiming to halt the decline of nature, and indeed recover it by 2030. We are working on the detail of that target. It will be set, along with all the other targets, through the Environment Bill, which will enable us to work together to raise up nature everywhere, and we will be announcing those targets in October 2022.

Every aspect of this Environment Bill will have an impact not only now, but for decades if not centuries, so I am pleased to see it return to the House because we cannot afford to wait. Inaction risks the lives of our children, grandchildren and future generations, and legislation on targets, plans and policies is essential to turn the tide. Yet, sadly, this Conservative Government have not shown the ambition needed, while pushing back responsibilities on legally binding targets for two decades and failing to put in place concrete protections for the environment from trade agreements. Given their current record for making promises and not delivering, forgive me if I am not surprised.

Sadly, my Slough constituents know the impact of the environment on their lives acutely. Slough has the second highest death rate from the deadly air pollutant PM2.5. While excellent work is being done at local level by Slough Borough Council, with its low emission strategy and air quality action plan, if nothing further is done at a macro level by Government, we will continue to breathe these dangerous levels of pollution. So can the Minister outline why the Tories voted down the Labour party’s attempts to write World Health Organisation air pollution limits into this Bill?

It seems as though Government rhetoric far outweighs action when it comes to the environment. This is epitomised by the England trees action plan, with targets being missed, staggeringly, by over 50%. This has a real impact because, being a densely populated urban area, Slough has the lowest level of tree canopy in Berkshire and is below the national minimum target of 20% tree cover. While the Labour council with its limited resources is planting 9,000 trees locally, again, more must be done nationally by providing adequate funding, direction and resources to local authorities. As the WWF rightly notes, this Bill does

“not go far enough to protect the world’s forests and other critical natural ecosystems.”

How can the Minister and the Government allow this to continue?

Sadly, this trend extends to biodiversity and species conservation, with very real consequences for my constituency and our planet. Another local project I recently visited, the Wildfowl and Wetlands Trust, has seen this in Slough’s Salt Hill stream:

“Fish were dying. It was clogged up with old car tyres, carrier bags and household waste. Water quality had deteriorated and its future looked bleak.”

However, its incredible work with the community has meant improved water quality, new homes for wildlife, and engagement and education for local people, but it should never have got to this point. Why are the Government so slow to act to stop the ecological devastation brought about by the continual discharge of untreated sewage, plastics and other effluents into our rivers and oceans?

Nationally, over the past 10 years, wildlife in Britain has seen a 44% decline in species, with some charities calling it a “lost decade for nature”. Again, targets have been woefully missed. The Government conceded last year that they have failed on two thirds of targets agreed at the convention on biological diversity in 2010, but analysis by the Royal Society for the Protection of Birds later showed that on six of those targets the UK has actually gone backwards. We must set ourselves ambitious targets and ensure accountability so that they are achieved. This is not the time for complacency, and we should be under no illusion: warm words will not tackle the pressing environmental and climate crises that we are facing as a society.

I rise to speak to amendment 41. It is a probing amendment, which aims to strengthen this important Bill further by including a provision to enable local planning authorities to take unlawful tree felling and a lack of compliance with restocking orders into account when considering planning applications. I thank my former researcher, Annabel Jones, for her work in making the case for change that I am presenting today.

I very much welcome the work that my hon. Friend the Minister has done to make sure that the Bill is the groundbreaking measure that is before us today. I also give my wholehearted support to new clauses 26 and 27, which my hon. Friend the Member for Isle of Wight (Bob Seely) tabled. He spoke eloquently about the need for that change.

I want to focus my remarks on the provisions about tree protection. The Government should be applauded for the trees action plan and the measures in the Bill, which have significantly strengthened protection for one of our vital pieces of green infrastructure. I particularly welcome schedule 15, which directly addresses some of the problems that my residents experienced when a group of landowners illegally felled more than 600 trees, causing environmental devastation in what was an environmental buffer zone. With the Government’s support, the Forestry Commission used its enforcement powers to issue restocking orders, but the landowners did not comply with much of that. Under the Government’s new proposals, enforcement would be much tougher and that is welcome. However, I look forward to the Minister’s response to my amendment to see if we could strengthen it further.

The problem is not unique to Basingstoke. The illegal felling of trees is on the increase and a common motive is taking advantage of the housing development value of the land. In recent years, there have been countless flagrant breaches of felling regulations. My hon. Friend the Member for Isle of Wight mentioned a case in his constituency, but there are other cases—in the New Forest, Swansea, Horley and Langley—where trees have been unlawfully felled and in some cases not replanted, even after enforcement action from the courts.

Landowners flout the law because they think can get away with it. Schedule 15 roundly deals with cynical actions by landowners by allowing the courts to reissue planning notices, but amendment 41 is designed to create even more of a disincentive for landowners to flout the law by amending the Town and Country Planning Act to allow local planning authorities to take into account unlawful tree felling and a lack of compliance when considering planning applications. I hope that the Minister can consider that today because I and many of my constituents feel that it is inherently wrong for landowners to profit financially from their unlawful deforestation of land. I hope that this probing amendment will capture her attention and I am keen to hear her response.
