Question to the Ministry of Justice:
To ask the Secretary of State for Justice, what steps he is taking to ensure that section 41 of the Youth Justice Crime and Evidence Act 1999 which protects victims of alleged rape or sexual assault from being questioned about their sexual history during trial is properly upheld.
A judge will assess the merits of an application under section 41 of the Youth Justice and Criminal Evidence Act 1999 and may only allow it where a strict set of criteria are met.
