Commissioners of adult social care were given market shaping duties by the Care Act 2014 and must work with providers to determine a fair rate of pay for fair work based on local market conditions. The current legal position is reflected in updated guidance published by the Department for Business, Energy and Industrial Strategy, which seeks to provide clarity to care providers, commissioners and workers.
