Question to the Ministry of Justice:

To ask the Secretary of State for Justice, what recent assessment he has made of the merits of exempting road users injured in the course of their employment from the measures contained within the Civil Liability Act.

The provisions in Part One of the Civil Liability Act (the Act) apply to the occupants of a motor vehicle. This includes all such claimants, whether they are driving, or a passenger in, a motor vehicle, and whether or not they were injured in the course of their employment.

Wide ranging debates on whether road users injured in the course of their employment should be exempted from the Government’s reforms, were held in both Houses during the Parliamentary passage of the Act. The Government stated its clear position on this point during those debates (Civil Liability Bill [HL], Lords Committee Debate, 10 May 2018, Columns 278/279 and Civil Liability [Lords] Commons Committee Debate, 11 September 2018, Column 8).
