The Government has made clear that EU citizens resident in the UK before we leave the European Union on 31 October 2019 will have until at least 31 December 2020 to apply for status under the EU Settlement Scheme. We will publish guidance in due course on the scope for a late application to be made by those with reasonable grounds for missing the deadline.

We will also set out in due course the requirements to be met, from 2021, under the new points-based immigration system, by EU citizens and their family members who wish to remain in the UK and who have not applied for status under the EU Settlement Scheme or, for EU citizens moving to the UK after a no deal Brexit, under the European Temporary Leave to Remain Scheme.
