Question
To ask the Minister for Women and Equalities, with reference to the draft Equality Act 2010 (Gender Pay Gap Information) Regulations 2017, what sanctions will be applied to employers for non-compliance with the new reporting requirements.
Non-compliance with the regulations will constitute an ‘unlawful act’ and fall within the existing enforcement powers of the Equality and Human Rights Commission (EHRC) under the Equality Act 2006.
The regulations require that, in addition to publishing the information on their own website, employers must also publish the information on a government website. This will allow us to closely monitor levels of compliance and keep this position under review by establishing a database of compliant employers.
