Section 172 Road Traffic Act 1988 requires the registered keeper of a vehicle to identify the person who was driving it when a possible offence was committed. The requirement is however to do so only if with reasonable diligence he or she can. How the police enforce road traffic law is an operational matter for their discretion and professional judgement. This includes how they seek to confirm the identity of the driver of an alleged offence.
