To ask the Secretary of State for Culture, Media and Sport, whether she has made an assessment of the relationship between (a) the use of in-game loot boxes and (b) the likelihood of future gambling related harms amongst young people.

Following the Government response to the call for evidence on loot boxes in video games, the Government has welcomed new industry-led guidance that aims to address the concerns identified for all players, including young people.

Measures to protect players should ensure that the purchase of loot boxes should be unavailable to all children and young people unless enabled by a parent or guardian, and all players should have access to, and be aware of, spending controls and transparent information to support safe and responsible gameplay.

The Government has agreed a 12-month implementation period for the new guidance on loot boxes and has asked the industry, coordinated by Ukie, to report back to DCMS on the extent to which it has been implemented.

We will continue to keep our position on possible future legislative options under review, informed by academic scrutiny of the industry-led measures. We will provide a further update in due course, following the 12-month implementation period.

Under the Gambling Act 2005, gambling is defined as playing a game of chance for a prize of money or money’s worth. The prizes that can be won via most loot boxes do not have a monetary value, cannot be cashed-out, and are of value only within the context of the game. They therefore do not meet that definition. As set out in the Government’s response to the call for evidence, there are also a number of disadvantages to changing the definition of gambling including the likelihood of capturing unintended activities, creating logistical difficulties in increasing the remit of the Gambling Commission, and undermining gambling taxation.

To ask His Majesty's Government what measures they have in place to improve coordination between schools, colleges, universities and support services to better assist students struggling with gambling addiction.

The government is committed to tackling gambling-related harms. While education settings are not mental health or gambling-related harm specialists, they are well placed to identify where a child or young person is struggling and help them to access support, linking them to NHS support and specialist services as needed.

Where gambling problems are affecting the mental health of young people, our programme of Mental Health Support Teams and senior mental health lead training supports schools and colleges to identify individuals in need of further support and make effective referrals to external agencies, to help young people get appropriate, timely support.

The department works closely with the higher education (HE) sector to promote and fund effective mental health support for university students. £15 million of funding this year from the Office for Students (OfS) will go to mental health support and the OfS-funded Student Space continues to provide students with free online mental health resources and confidential support on a range of topics, including addiction support. The OfS has also brought together HE providers and NHS trusts across each region in England to deliver better join up between university wellbeing support and NHS services.

Additionally, schools, colleges and universities have access to the NHS webpage 'Help for problem gambling'. This covers common indicators which could help identify whether individuals may be experiencing gambling-related harm, as well as providing initial signposting to the sources of support available to those in need. As part of the NHS Long Term Plan commitment to expand geographical coverage of treatment for those experiencing gambling-related harm, the National Problem Gambling Clinic in London offers specialist treatment and support for children and young people.

The government White Paper ‘High stakes: gambling reform for the digital age’, published in April 2023, announced the introduction of a statutory levy on gambling operators to fund the research, prevention and treatment of gambling-related harms. This presents an opportunity to consider how best to improve awareness and understanding of gambling-related harms amongst young people, and how to ensure availability of effective support across all educational settings.

His Majesty’s Government recognises that, while millions of people gamble online without experiencing problems, for some it becomes an addiction with serious consequences. It is particularly important to take steps to protect those most at risk of problem gambling.

There are robust rules in place to ensure that gambling advertising is socially responsible and that it cannot be targeted at or strongly appeal to children. Gambling advertising is covered by the UK Advertising Codes which are regulated by the Advertising Standards Authority, and there are also specific Gambling Commission licence conditions which regulate how gambling operators advertise. The UK Advertising Codes were strengthened last year, with new protections for children and vulnerable adults.

Earlier this year, HM Government published a White Paper on gambling which outlined a comprehensive package of reforms to make gambling safer. This included measures to tackle the most aggressive and harmful advertising practices by preventing bonuses being constructed and targeted in harmful ways, giving customers more control over the marketing they receive, and introducing messaging about the risks associated with gambling.

The Gambling Commission has already consulted on improving marketing consents, and we are working closely with it and others to bring the changes into force as quickly as possible.

Following the Government response to the call for evidence on loot boxes in video games, the Government has welcomed new industry-led guidance that aims to protect young people from gambling harm.

Measures to protect young people should ensure that the purchase of loot boxes should be unavailable to all children and young people unless enabled by a parent or guardian, and all players should have access to, and be aware of, spending controls and transparent information to support safe and responsible gameplay.

DCMS has published a Video Games Research Framework to support high quality independent research into video games, building understanding of the impact of video games, including loot boxes.

In parallel to the framework, we are now working closely with academics to ensure specific and robust evaluation of the implementation and efficacy of the new industry-led measures on loot boxes in meeting the government’s objectives. We will provide an update following a 12-month implementation period.

The Government recognises that it is particularly important to take steps to protect young people from online harms and is aware of issues around online streaming of gambling content. We welcome the measures which some streaming platforms have taken to ban the streaming of gambling content where it may reach underage audiences.

Many online streamers of gambling content have affiliations with the gambling sites on which they play to target consumers in Great Britain and encourage them to gamble. This brings them under the current regulatory umbrella for gambling advertising. Where streams amount to advertising then they are subject to the robust rules that are in place to ensure that gambling advertising is socially responsible and cannot be targeted at or strongly appeal to children. This ensures licensees are held to account for the activities of their marketing affiliates.

Further, there are robust age verification requirements in place to prevent children from creating online gambling accounts or accessing facilities to gamble themselves, even where they have seen streams. As outlined in the white paper, the measures introduced in 2019 have been effective in preventing children from being able to gamble online with either their own or invented identities.

To ask His Majesty's Government what discussions they have had about processes for supporting patients presenting at GP surgeries with mental health issues related to potential gambling habits.

Primary care services play an important role in supporting people with mental health conditions, including in helping them to access the most appropriate services for their needs.

As set out in the NHS Mental Health Implementation Plan, 15 new National Health Service specialist problem gambling clinics will be opened by March 2024. This will include piloting provision for children under 18 years old. Twelve of these clinics are already operational with the remaining three expected to open by the end of the year. Through the clinics, representing every region of England, the NHS will be able to treat up to 3,000 people experiencing gambling-related harm each year.

In April 2023, the Government published its white paper, High Stakes – gambling reform for the digital age. This announced the introduction of a statutory levy on gambling operators to fund research, prevention, and treatment of gambling-related harms. Once operational, the levy will help to expand and improve existing treatment and support service to ensure those in need are able to access the right care at the right time. His Majesty’s Government recognises that, while millions of people gamble online without experiencing problems, for some it becomes an addiction with serious consequences. In our approach to gambling advertising, we have struck a balanced and evidence-led approach which tackles aggressive advertising that is most likely to appeal to children, while still allowing sports bodies and others to benefit commercially from deals with responsible gambling firms. There are robust rules in place to ensure that gambling advertising is socially responsible and cannot be targeted at or strongly appeal to children. The Government welcomed the voluntary whistle-to-whistle ban on TV betting ads during live sports programmes, agreed by industry. According to figures from the Betting and Gaming Council, the ban reduced gambling advertisement views by children (age 4-17) by 70% over the full duration of live sporting programmes. We also welcomed the Premier League’s announcement that it will ban gambling sponsors from the front of shirts, and are working with a wider group of sports governing bodies to introduce a Code of Conduct on responsible gambling sponsorship.

We continue to monitor research, and have carefully considered the findings in the study by the University of Bristol. Furthermore, we are introducing a statutory levy charged to gambling operators which will raise trusted, long-term funding for gambling research. We are clear that we will continue to look carefully at any further research that results from that and take action if necessary.

The Government welcomed the voluntary whistle-to-whistle ban on TV betting ads during live sports programmes, agreed by industry. According to figures from the Betting and Gaming Council, the ban reduced gambling advertisement views by children (age 4-17) by 70% over the full duration of live sporting programmes, with a 96% reduction in gambling TV advertising specifically during the restricted period.

As part of the Gambling review, consideration was given to a range of restrictions on gambling advertising. As set out in the white paper we have struck a balanced and evidence-led approach which tackles aggressive advertising and that which is most likely to appeal to children, while still allowing sports bodies to benefit commercially from deals with responsible gambling firms.
