Asked by: Lord Freyberg (Crossbench - Excepted Hereditary) Friday 3rd May 2024 Question to the Department for Science, Innovation & Technology: To ask His Majesty's Government, further to the Written Answer by Viscount Camrose on 12 April (HL3677), what practical steps data subjects can use to verify that their personal data are being processed (1) in accordance with any consent they have granted, and (2) only insofar as is "necessary" for the intended purposes; how they can exercise their right to object; and whether all of these processes will remain in place following the passage of the Data Protection and Digital Information Bill as currently drafted. Answered by Viscount Camrose - Parliamentary Under Secretary of State (Department for Science, Innovation and Technology) Data controllers should inform individuals of how they are going to use their personal data and set this out in their privacy notice. Individuals have a number of rights under the UK’s data protection framework, including the rights to access their personal data, to object to its processing and to rectification and erasure. If an individual is concerned about the handling of their personal data, they can contact the ICO for advice or to make a complaint. These rights, along with core data protection principles, will continue to apply under the reforms within the Data Protection and Digital Information Bill. |

Answered by Paul Maynard - Parliamentary Under-Secretary (Department for Work and Pensions) We are committed to tackling both fraud and error. DWPs quality assurance framework plays an important role in identifying common errors which contribute to over and underpayments. In addition, the department and HMRC has committed to provide assurance this winter over the integrity of the National Insurance records and how they interact with DWP’s benefit system.
The Department launched a robust plan to drive down fraud and error from the benefits system, alongside investment of £900 million that will deliver £2.4 billion of savings by the end of 2024/25. This plan includes proposed powers to require the transfer of data from third-parties, which has been introduced as part of the Data Protection and Digital Information Bill (No.2). This legislation is forecast to save up to an additional £600m over the Treasury scorecard period. |

Answered by Paul Maynard - Parliamentary Under-Secretary (Department for Work and Pensions) The department has assessed the impact of the third-party data measure in the regulatory impact assessment scrutinised and green-rated by the Regulatory Policy Committee. The department has fulfilled all the requirements of the Public Sector Equality Duty (PSED) as set out in section 149 of the Equality Act 2010 and in line with our statutory duty keeps the impact of this measure on groups with protected characteristics under continuous review.
In 22/23, DWP overpaid over £8bn due to fraud and error. This is unacceptable and we are taking robust steps to tackle this.
The third party data legislation we are seeking is one such approach. The focus of this power will be about finding signals of potential benefit fraud and error. The measure does not target a particular group of benefit claimant and we have tried and tested safeguarding procedures to protect vulnerable groups and will follow business as usual processes.

Bank Services: Fraud and Social Security Benefits
Asked by: Charlotte Nichols (Labour - Warrington North) Wednesday 14th February 2024 Question to the Department for Work and Pensions: To ask the Secretary of State for Work and Pensions, whether his Department plans to use the proposed powers under the Data Protection and Digital Information Bill to monitor the bank accounts of (a) people suspected of fraud and (b) all people who claim means-tested benefits. Answered by Paul Maynard - Parliamentary Under-Secretary (Department for Work and Pensions) The powers sought under the Bill would not give DWP direct access to citizen’s bank accounts. What this power will do is require designated third parties to look within their own data and provide relevant information to DWP that may signal where some claimants may not meet the eligibility criteria for the benefit they are receiving. This data may signal fraud or error and require a further review by DWP (through business-as-usual processes) to determine whether incorrect payments are being made. The power covers all DWP benefits and payments, including those that are means tested or have residency requirements, but it will initially be focussed on benefits where there is a significant fraud challenge. No personal information will be shared by DWP and only the minimum amount of information on those in receipt of DWP payments will be provided to the Department so we can identify those people whose claims have matched the criteria we have set. With fraud becoming a growing problem, accounting for over 40% of all crime, the welfare system is not immune to this. It is vital that the Government takes measures to address this issue and ensure the right support is provided to the right people. We expect this measure to save up to £600m in the next five years. |
Biometrics and Surveillance Camera Commissioner
Asked by: Lord Kempsell (Conservative - Life peer) Tuesday 6th February 2024 Question to the Home Office: To ask His Majesty's Government whether they have identified any current functions of the Biometrics and Surveillance Camera Commissioner that will not be transferred to the Investigatory Powers Commissioner under the Data Protection and Digital Information Bill; and if so, what plans they are making to continue those functions in the future. Answered by Lord Sharpe of Epsom - Parliamentary Under-Secretary (Home Office) The Protection of Freedoms Act 2012 sets out the functions of the Biometrics and Surveillance Camera Commissioner. Broadly speaking they are to promote compliance by police with the rules on DNA and fingerprints, and to promote good practice by police and local authorities in the use of surveillance cameras respectively.
Overall, the responses to the public consultation on data reform in 2021 indicated that oversight in these areas was crowded and confusing and there was support for simplification. In response the Data Protection and Digital Information Bill abolishes both posts but transfers the Biometrics Commissioner’s casework functions to the Investigatory Powers Commissioner’s Office.
A number of other bodies already operate in this space and will continue to do so. This includes the Information Commissioner’s Office, which amongst other things regulates and promotes good practice by all organisations’ in their use of biometrics and surveillance cameras, including police and local authorities; the Forensic Science Regulator, which ensures that the provision of forensic science services across the criminal justice system is subject to an appropriate regime of scientific quality standards; the Forensic Information Database Strategy Board, which oversees use of the police DNA and fingerprint databases; the College of Policing, which sets requirements, accredits, quality assures and delivers learning and professional development for policing; His Majesty’s Inspectorate of Constabulary and Fire & Rescue Services, which independently assesses the effectiveness and efficiency of police forces; the Independent Office for Police Conduct, which investigates the most serious complaints and conduct matters involving the police, and sets the standards by which the police should handle complaints; the Equality and Human Rights Commission, which regulates compliance with equality and human rights law; and the British Standards Institute, which develops British Standards. |

Asked by: Gregory Campbell (Democratic Unionist Party - East Londonderry) Monday 15th January 2024 Question to the Department for Energy Security & Net Zero: To ask the Secretary of State for Energy Security and Net Zero, when she plans to bring forward legislative proposals to require fuel retailers to publish price information. Answered by Amanda Solloway - Government Whip, Lord Commissioner of HM Treasury The Government will launch a consultation on the requirement for fuel retailers to provide up to date retail fuel price information shortly.
Part 3 of the Data Protection and Digital Information Bill will extend the Government’s ability to establish and mandate participation in smart data schemes via regulations.
Following conclusion of the consultation process and Royal Assent of the Bill, the Government will lay regulations using the smart data powers to set up the statutory open data scheme for road fuel prices. |
