Evidently, the UK Government and the parliamentary process is in absolute chaos tonight. It seems, as far as they have got, that the EU will be legally bound to good faith, and the UK Attorney General is agonising. Meanwhile, from Dublin we learn that the withdrawal agreement remains unchanged, and the joint statement is a legal interpretation of what is in the withdrawal agreement. It is all calm in Dublin, in utter contrast to what is happening here. It should be remembered that this is a debate between damaging the UK economy by 6% and by 8%. Given that, and with 18 days to go, we surely must be able to lay amendments tonight, so I hope this motion has now been tabled and that amendments can be laid to save people’s jobs, to save the economy and to save business. That is the damage the right hon. Gentleman’s Government are trying to do by deciding on the two points they are putting forward.

I agree with the right hon. Gentleman, and I do not think that what he has just said is any different from what the Prime Minister or other Ministers have been saying at this Dispatch Box for several months.

Unfortunately, my amendment (g), which sought to end the whole charade by revoking article 50, has not been accepted, and we have a series of Brexit-enabling amendments before us. I want to take the Minister back to his point about the concessions he is looking for from the European Union on borders. We know that the technology has not been invented and the idea is that we have derogations—so this involves concessions. If the EU is going to give concessions on that border, it will have to give them on every border, and the EU has multiple borders. So why would it not be doing this already? The reason is that we are back to UK pie-in-the-sky, fantasy thinking here—I hope the right hon. Gentleman accepts that.

The flaw in the hon. Gentleman’s logic is that it should be welcome to any Government or supranational authority such as the European Commission if technology and systems are available that streamline border processes, whether we are talking about the border between Northern Ireland and Ireland, the border across the short straits, or other external borders of the European Union with third countries.

I will try to abide by your instructions, Mr Speaker; thank you for calling me so early.

It is customary to say what a pleasure it is to follow the previous speaker, but I must suggest to my friend, the hon. Member for North East Fife (Stephen Gethins), that the SNP continually talks down the United Kingdom to such an extent that most people in Scotland do not even listen any more. SNP Members would do well to reflect on this. I gently suggest to the hon. Gentleman that he may be very critical of the UK at the moment—of how the Government conduct themselves and our parliamentary democracy—but we can be proud of the fact that this robust democracy is accommodating a very robust debate. In France, the Government can increase the fuel tax and there are people dead in the streets of Paris. In America, there has not been a Government for months. This is an important debate and there are differences across the House, but we can be proud of our parliamentary democracy in actually accommodating that debate.

As the hon. Gentleman is busy lecturing Scots and Scotland, I hope he will reflect on this point—that in Scotland today the EU is far more popular among the people, by about 18 percentage points, than the United Kingdom. He should bear that in mind the next time he wants to lecture Scotland.

I am so glad that my hon. Friend has made that point, because I was about to make it myself and now will not have to. I am as much against the backstop as I am against the article 4 arrangements, for reasons that both of us agree on.

We have to grapple with the fact that article 4 will apply across all the EU treaties, laws and legal positions adopted by the ECJ over recent years. It is inconceivable that the House would hollow itself out in such a manner as to preclude itself from being able to control such things. I am Chairman of the European Scrutiny Committee, and we get these regulations and directives week in, week out. We received one last week that intends to turn the veto procedure—or unanimity rule—over the making of national tax policy into qualified majority voting. If people really think that that is a minor matter, let them think again what effect it would have on their constituents.

Under article 4, our country would be reduced, as I said in my intervention on the Chancellor of the Duchy of Lancaster, to an undemocratic subjugation to the decisions of 27 other member states. In fact, not only that, but as I said, it would put us at the mercy of our competitors. In addition, the article would have the same effect with regard to the question of state aid during the backstop.

I do not think that the businesses that argued so strongly for this transitional period had any idea that this would be the consequence of the withdrawal agreement. That agreement emerged from the Chequers deal, which itself was an overturning of the withdrawal Act that we passed in June 2018 and had been planned long before that Act was given Royal Assent, without any reference to the Cabinet and in defiance of collective Cabinet responsibility.

If we do not control these laws, who will? It will be the 27 member states. In an important book, “Berlin Rules”, by our former ambassador to Germany, Sir Paul Lever, he says that before decisions are taken by European member states, or indeed by the Council of Ministers, they are cleared with Germany. He also says that it is a German Europe. He does not mince his words.

I wonder if the hon. Gentleman is aware of the utter irony of this situation. He moans and complains and raises grievances about Europe—he has a chip on his shoulder—but the reality for Scotland in the United Kingdom is worse than everything he says. We have a party in charge that we have not voted for in 65 years. The European Union is nowhere near as bad as what he is going on about.

I do not concede what the hon. Gentleman says for one very good reason: it is part of the United Kingdom.

That is my first point on control over laws. Article 4 is so offensive because it hollows out this House and hollows out our democracy. On that basis alone, one should not vote for the withdrawal agreement.

As I said in my exchanges with the shadow Secretary of State, I want to know why anyone would want to undermine the repeal of the European Communities Act 1972, which is the law of the land and is contained in section 1 of the European Union (Withdrawal) Act itself. I would also like people to be honest enough—those who wish to rejoin the European Union, including my right hon. and learned Friend the Member for Beaconsfield (Mr Grieve)—to say why on earth anyone would want to rejoin the European Union when it is in complete and total implosion. People are voting with their feet in so many countries, including in Italy.

In a nutshell, the withdrawal agreement is deeply, deeply flawed and we ought to vote against it. I believe that the decision at the moment—as I understand it, it has not been concluded—is that the amendments are going to be withdrawn, but I look forward to hearing from the right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper).

I absolutely agree with my hon. Friend, who is immensely knowledgeable on all these matters.

The House needs to clarify where it stands. I have seen many amendments and I suspect there are more to come, because that is the way that the Government are now playing their hand, for fear of Parliament’s taking control. Do MPs wish to leave the EU, or do they wish to stay in? That is the question. Some hon. Members are very concerned about no deal, and are tabling amendments in the genuine interests of our country, but for others they are a fig leaf for their wish to remain in the EU. How can we take no deal off the table and let the Prime Minister walk naked to the conference table? How can we do that? It is the last negotiating tool that a Prime Minister has.

We know that the EU always takes it to the last minute. Brinksmanship—that is the name of their game. And let us be honest: do any of us in this House think that we shall strike a fair deal before we leave? I do not think so, because the EU does not want us to go, and is making it clear that it wants to make it as hard as possible for us to leave.

Unfortunately, the behaviour of many in this House is signalling to the EU complete and utter chaos—no sense of purpose, no unity. Imagine if 650 MPs had said, “We are right behind the people of this country, and respect their decision.”

I shall not give way. I only have a very short time and I would like to continue, if I may.

Imagine if that had been the case—if everyone in this House had been backing leaving the EU. I would suggest that negotiations with the EU over the past two years would have gone very differently. Now we are facing what some would describe as a cliff-edge, although I would disagree with that description. As the right hon. Member for Leeds Central (Hilary Benn) asked, will moving exit day to April, May or June change the direction of travel—what we are trying to do? No. And in June there will be more amendments, and more efforts by Members in this place to stop us leaving the EU.

So we have to make up our minds. Are we going to leave with a fair deal? The backstop has been mentioned and, as we know, the backstop could go on indefinitely. We will be out of the EU, but with no one at the table. We will be at the mercy of the EU, we will be subjugated, we will be law takers. This is madness. We need a fair deal, and let us fight for it together. Together, we will get the fair deal. We are divided here, and the EU must be sitting back—the Champagne is out, the Chablis is being drunk, the lobsters have been consumed—and why? Because the EU is looking at the chaos in this place. United we stand: united we will get a fair deal, and we will get out of the EU.

I thank my hon. Friend for the point he makes; he is absolutely right that the vast majority of members of the public want to see this House delivering leaving the European Union and doing so in the best way for this country, and we will be working to ensure we get those changes as soon as possible. When I said there will be a vote by 12 March, I meant that that is the last date for a vote, and if it is possible to bring it earlier I will do so.

Listening to this mess it is no wonder that in Scotland the EU is more popular than the UK. The only sovereign decision this Parliament can take is to revoke article 50, to prevent leaving without a deal. An extension to article 50 means the Prime Minister has to beg the EU27 and put the UK at the mercy of the kindness of the EU27. Does she not agree that revoking article 50 is better than leaving without a deal, which is the current trajectory for the UK given the letter she wrote on 29 March 2017?

I do not agree that revoking article 50 is a better route for this country. Members across this House gave people in the country the opportunity to decide whether to leave the European Union or not; they voted to leave the EU and I believe it is imperative that we respect that vote and deliver on that vote.

We know that the business community in Northern Ireland does not want a hard border, so surely, if technology and connected promises do not avoid that, the backstop is an understandable insurance policy for Dublin and the European Union, as indeed the United Kingdom agreed in December 2017. Surely the Government will not be reneging on that promise, which is beneficial to business.

Well, unless I take too long, I hope to touch on the arguments behind the right hon. Gentleman’s excellent amendment, because that is one of the things that we should do in one way or another over the next few weeks.

Let me just deal with this question and then I will give way to the hon. Gentleman if his point is relevant.

The question is, what is the role of this House vis-à-vis the Government and what are our procedures? I must admit that, in the past month or two, I have listened to what I, as a fairly experienced Member here now, have regarded as the most extraordinary nonsense about sweeping away centuries of tradition and distorting our procedures because people have objected to the Speaker selecting amendments where they think they might not be on the winning side. There is a rather fundamental, underlying problem here. This Government did not start this, but Brexit brought it to its head. I think that it started with the Blair Government, because Tony Blair, with the greatest respect, never could quite understand why he had to submit to Parliament so often. He started timetabling all our business and so on, but that is now water under the bridge. I say with respect that, mistakenly, this Government began by saying that they were going to invoke the royal prerogative, and, as it was a treaty, they felt that Parliament would not be involved in invoking article 50 or any of the consequences because the monarch would act solely on the advice of her Prime Minister, trying to take us back several hundred years. That was swept away. Then we had to have defeats inflicted on the Government last summer in order to get a meaningful vote on the outcome of any negotiations. This has gone on all the way through the process. Today’s debate and the votes that we are having tonight are only taking place because the Government actually resisted the whole idea of coming back here with any alternative to the deal that they were telling us was done and fixed and the only way of going forward. That has worried me all the way through.

Now, I did take the Prime Minister today to be taking a totally different approach, and I hope that she will confirm that. It does now seem that, whatever course we decide on today, things are going to come back to this House. No deal of any kind is going to be ratified until we have had a vote in this House, approving whatever we are presented with. One problem is that we have not yet produced a consensus or a majority for any option, but if this House expresses a clear wish about the nature of the deal that it wants to see negotiated, the Government will consider—indeed, I believe that under our constitution, they are bound to follow—the wishes of the House of Commons, because British Governments have never been able to pursue these matters without the consent and support of a majority of the House of Commons.

The right hon. and learned Gentleman said that the House must test the various options. Will he “join the (q)”, as it were? Amendment (q) aims to revoke article 50. Is that one of the ideas that he thinks should be tested in this House—even for nothing other than that the people of Scotland would at least know the folly of sticking with Westminster, which is taking them out of Europe against their will?

I do not wish to revoke article 50 for the same reasons as the hon. Gentleman, although I do share some of his views. If I was trying to exercise unfettered autocratic power in the government of the country, I would of course still believe that the best interests of the United Kingdom lie in remaining a member of the European Union. I do not share enthusiasm, however, for what the hon. Gentleman wants. After the pleasure of the first referendum and all that it has caused, he now thinks that we will automatically resolve things by having a second referendum, which could be even more chaotic in its effects than that the one we have had.

As I have said, the Government of the day have got to give this House a far bigger role, which therefore means a much bigger responsibility on this House to create the intraparty, cross-party majority that is the only majority of any kind that might be available here for any sensible way forward.

As always, it is a pleasure to follow the right hon. and learned Member for Rushcliffe (Mr Clarke). I look forward to spending a considerable time with him in the Lobby this evening as we vote for amendments that offer hope to the people of all these islands.

I want to impress upon the Prime Minister the decision of the people of Scotland in the 2016 referendum and what she must now do to respect their wishes. During the Scottish independence referendum campaign in 2014, the Scottish Tory leader Ruth Davidson promised that voting no meant that Scotland would remain in the EU. Scotland did not vote for a Tory Brexit, but we are being dragged out of the European Union by Westminster against our will. The Prime Minister talks about this being a family of nations and says that Scotland’s voice will be respected. Where is the respect for the views and wishes of the people of Scotland, who have demonstrably said that they wish to remain EU citizens?

Is it not the reality that polling in Scotland shows that the European Union remains more popular with the Scottish people than the United Kingdom? That should be heard loud and clear in this place—the European Union is more popular with Scots than the United Kingdom.

That is correct, and it is little surprise, because the European institutions show respect to the people of Scotland, which this Government do not.

The Prime Minister promised that a no vote would see Scotland’s future as an equal partner, but we now see Westminster taking powers off the Scottish Parliament against the wishes of the Scottish Parliament and the Scottish people. [Interruption.] I should not do this, but I will. I hear from a sedentary position the hon. Member for Stirling (Stephen Kerr) saying, “What powers?” Obviously, he has forgotten that he voted for the withdrawal Act, which interfered with the powers of the Scottish Parliament laid down in the Scotland Act—powers over fishing, powers over the environment and powers over agriculture. The Tories sat back and allowed the Scottish Parliament to be emasculated. The 13 Scottish Tories acted against the interests of the people of Scotland, as they have done time and again.

The Westminster campaign against Scottish independence said that high street banks were making plans to leave Scotland, yet now, because of this Government’s Brexit, Standard Life Aberdeen is setting up a hub in Dublin, and Lloyds Bank is looking at a Berlin base.

Even last week during Prime Minister’s questions, the Prime Minister tried to tell me to drop the SNP policy of independence, yet in June 2017 the leader of the Scottish Tories, Ruth Davidson, said:

“Let me be clear: nobody, not me, not anyone, is expecting the SNP to give up on independence. That’s what it believes in & it’s a perfectly honourable position to take.”

It is a perfectly honourable position to take.

Let me be very clear: Scotland must no longer be left at the mercy of events. Whatever happens here, the SNP will not be dropping its policy of independence. Whatever turmoil and hardship this Tory Government try to drag our nation through, Scotland will and must have the right to determine its own future and to choose to be an independent nation within the European Union. I can see Members shaking their heads. They are shaking their heads because they are running scared. Like the Prime Minister, they fear they would lose an independence referendum. The Scottish people are sick and tired of being told what the Prime Minister wants them to do. Scotland’s needs are much more important than what the Prime Minister wants. Scotland needs the power to take its own decisions. That is the only way we can stop the Tories driving us off the cliff edge and into disaster.

I think I will treat it with the contempt it deserves, Mr Speaker.

By 1914, Scotland had nearly 25,000 European residents, mostly from southern and eastern Europe. Between 1891 and 1901, 25% of the immigrants came from Italy. The majority came mainly from Russia and Poland and settled mostly in the west of Scotland, and they were welcomed, just as migrants today are welcomed. Almost 50% of male immigrants worked in coal mining and about 12% in tailoring, while most of the Italian migrants became more involved with restaurants and retail.

We have so much to lose from Brexit and nothing to gain. I plead with Members to change course. If they do, history will remember their act of courage. Today, Members have an opportunity to preserve our opportunities with Europe—our cultural links, our shared values, our economic ties and our solidarity in coming together to find a way forward.

Voting for the SNP amendment will respect the votes of the people of Scotland in 2016. They must not and will not be dragged out of the EU against their will. Scotland’s voice has been ignored for too long. The SNP will continue to press for the best possible outcome for the people of Scotland, and if our voice is not respected —if Scotland is continuously silenced and sidelined by this Tory Government—this place will not be forgiven.

The days of Westminster having a veto over Scotland’s future are over. Only as an independent country can Scotland thrive; and friends, we will thrive. The discussions today about ditching the backstop are just internal Tory matters. They can fight and squabble, but the EU is united and clear. It will not accept any changes to the backstop in the withdrawal agreement.

One of the things that I think the Prime Minister did not quite convey or understand, or forgot, is that the backstop is a compromise. It is a compromise based on the fantasies of the technologies that she has promised will come. If she is right and those fantasies are true, she does not need to worry about the backstop. She would not need to worry if the technology that is being used on the Swiss border were available. I suggest that the Europeans have used a backstop because they know that the fantasies are exactly that.

We have 59 days to go, or, as James Melville said on Twitter a little earlier, 28 parliamentary sitting days to go.

Last time I spoke on this, as you probably remember, Mr Speaker, I mentioned Fintan O’Toole’s book, “Heroic Failure: Brexit and the Politics of Pain”, and the pain we are all feeling at the moment. The quote I used then was the Turkish proverb,

“An Englishman will burn his bed to catch a flea.”

It is worth reflecting a bit more on what Brexit has done. The methodology of Brexit, Fintan O’Toole points out in the book, is this:

“It will triumph by teaching the English to take trivial things—the petty annoyances of regulation—very seriously indeed, and to regard the serious things—jobs, communities, lives—with sincere and studied triviality.”

That is what we are seeing in the middle of this Brexit nonsense. All options of Brexit are bad. The Prime Minister knows this. In a sleight of hand today, she alluded to it by talking of the balance between the referendum and the economics. But of course, if we look at the economics alone, this is a bad deal.

The Government have got themselves into the invidious position of making promises to Ireland and making promises to other people that they would be outside the customs union and the single market and still have frictionless trade. I am talking of unicorns and made-up fantasies. They then had an opponent at a negotiation saying, “This is nonsense. Give us some assurance, have a backstop,” and the backstop came along. Now this House is saying, “See that backstop, that assurance we gave on the fantasies we were talking about—we now want you to negotiate away our assurance and our fantasies.” Westminster has got to take a step back and see the nonsense it is finding itself in.

Amendment (q) was not selected today, but I would encourage people in future to join the queue. It is an amendment to revoke article 50, tabled in my name and that of my hon. Friend the Member for Perth and North Perthshire (Pete Wishart). This is something the UK has control of until 29 March. The UK can get itself out of the hole it has dug for itself through the fantasies that Mr O’Toole expanded on greatly in his book. A lot could be done to prevent the damage that is coming down the road. If we leave on 29 March or in December 2020, MPs here, particularly whoever is in the governing party, will have to face that. Maybe this is one of the reasons Labour does not want a general election. Who wants to be the Government on 29 March or in December 2020 when you leave and you have queues in Dover, you are damaging the economy and you have empty shelves? Whoever is holding the parcel when that music stops is going to find themselves in great trouble.

Does the hon. Gentleman agree that the genius in any negotiation is to achieve an agreement and that agreement implies that two sides have come to a common cause? Is not the fatal flaw of what Europe has done that it has not accepted that Britain cannot agree with this?

No. The agreement was reached. This is the funny thing. The agreement was reached, and now the Prime Minister, having not talked to the House of Commons, comes back to the House of Commons and finds that it thinks that her agreement is a dud agreement. She has now been sent to scurry back to Europe to beg the Europeans because the shire Tories want something different. They had an agreement but then they were scared of the agreement and sent the Prime Minister to go and get another one. In the beginning, we did not want any parliamentary involvement at all. Conservative parliamentarians, in particular, were abdicating their responsibility as MPs and hiving this off to the Government. Then when the Government came back, it was not good enough, deepening the mess of Brexit. This is exactly the problem we have here today.

We should take a further step and consider this idea that going out of the customs union and the single market is bad for you. There are about 12 customs unions across the world between about 100 countries. The exceptionalism about the UK is utterly baffling, and it is so baffling because these people are trying to damage their communities and their businesses. It does not matter how often we say it, but this is the point of Brexit. This is what Brexit is going to end up with—damage to jobs and damage to business. Airbus and other companies are dismissed because, as Fintan O’Toole said, the serious things are regarded with “studied triviality”. I am at the end of my tether trying to talk to these guys. This is why Scotland is moving on. As my right hon. Friend the Member for Ross, Skye and Lochaber (Ian Blackford) said, we are moving towards independence—we have to. This is a mess.

The reason we are willing to take interventions and debate is that we have a clear position from the Prime Minister, whereas the position of the Leader of the Opposition is confused. Is he for a second referendum, like the shadow Business Secretary, or does he support the position of the shadow Education Secretary who thinks a second referendum would be a betrayal? Does he or does he not support the position of Len McCluskey, who is willing to engage with the Prime Minister?

The question should be turned the other way: has any estimate been made of the billions in extra revenue that will come to the Exchequer through trading in the best single market and customs union for an extra nine months—not the fee to be part of the club, but the money that is to be gained from trade while being in that club?

The whole point is that indecision and delay would flow from the amendment of the right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper), and indeed, as we saw in the debate, there is confusion as to what the date is: the amendment refers to the end of this year, yet in her remarks she said that it might not be that long; she said that it might be shorter. In an exchange, my very good and hon. Friend the Member for Grantham and Stamford (Nick Boles) said that there would be further iterations where we could look at the timing, yet, as my distinguished predecessor, my right hon. Friend the Member for Esher and Walton (Dominic Raab) pointed out, it is an empty vessel—in essence a Trojan horse in which there is indecision over delay.

Again, if I may very politely say so, I think the hon. Lady’s point of order, although it contains what is ostensibly an inquiry, is one in which she is making her point rather than seeking anything from me. The short answer to her is that, as I said a moment ago, there will be further debate. Members must speak and vote as they think fit. All these matters will be thoroughly aired in the days and weeks to come, and I am sure we all look forward to that—the hon. Lady from her vantage point and I from mine.

On a point of order, Mr Speaker. I hope you can advise. The House seems to have found itself in a contradictory position. First, it wants no deal off the table; and secondly, it does not accept the deal that the European Union is putting forward. Is it not the case that the United Kingdom Parliament is now at the mercy of the European Union, because if we are in a situation where no deal is off the table and we are not accepting the deal the EU is offering, where do we go from here?

The hon. Gentleman may wish to offer the views that he has just expressed to the news outlets that operate in Na h-Eileanan an Iar, and I rather suspect that that is what he will want to do. Local newspapers and radio stations will doubtless be very interested in the views that he wishes to express, but they are not matters of which I can treat now. The House has decided what it has decided—[Interruption.] The hon. Gentleman is saying that these matters are in contradiction of each other or have to be weighed against each other, but of course it is not a matter for the Chair to offer an exegesis to the House on the way in which it has voted. Members will make their own assessment. We know what statute says and we know what expressions of opinion have been recorded by the House today. The hon. Gentleman, although his brow is furrowed, is a perspicacious fellow, and I am sure he will get his head around these matters in the hours, days and weeks to come. We look forward to that with eager anticipation.

I am delighted that my right hon. Friend the Leader of the Opposition has tabled and secured this motion. I shall of course be voting for it and I hope it wins, because my constituents and the country desperately need a Labour Government. I was proud and privileged to serve in the last Labour Government, and I know what a transformative power for the better a Labour Government can be. We also desperately need a Labour Government to steer this country through and out of the current Brexit crisis. So I hope we win tonight’s vote and get a chance to change the Government, but we need to be honest with ourselves and the public. If we do secure and win an election, we will still be facing the worst crisis in our peacetime history, because of the mess the Tories have made of Brexit.

A general election in the current circumstances would, whether we like it or not, be a Brexit election. We would need to be absolutely clear about what our position was and what we would do in government. I have heard some suggestions that we should promise to deliver a better Brexit; given the overwhelming views of Labour members and voters, I am not convinced that that would be a winning strategy. I would hope that we would listen to our members and voters, and to the country, which is tiring of this Brexit shambles, and either campaign on a policy of staying in Europe or, failing that, promise to try to renegotiate a better deal before putting that back to the people in another referendum.

Let us be frank, though: the likelihood is that we will not win tonight’s confidence vote. In those circumstances, it is vital that we all put the national interest first and find some way out of the current crisis. More no-confidence motions, which some have suggested, are not the answer, and the shadow Chancellor, my right hon. Friend the Member for Hayes and Harlington (John McDonnell), was right absolutely to rule that option out on the radio this morning. There is no time for any more can-kicking at this moment of national crisis. We need decisions and we need leadership.

The Government—if they are still the Government after tonight’s vote—have the main responsibility here. They do not seem to have learned anything from last night’s catastrophic defeat. They are still sticking to their red lines and still failing to reach out to the official Opposition. It is absolutely extraordinary that after the Prime Minister’s assurances last night she has not bothered to pick up the phone to the Leader of the Opposition. It is a disgrace. The Leader of the House also indulged in yet more fiction this morning when she claimed on the radio that the Opposition did not have a policy. We do. She might not like it, but we do, and if the Government are serious, they need to talk to the Opposition about it.

The right hon. Gentleman absolutely hits the nail on the head in respect of the Prime Minister. In her response to the question from my hon. Friend the Member for Glasgow South (Stewart Malcolm McDonald) at Prime Minister’s questions today, she could not even think of a compromise on her red lines. That shows that she really is not in the right mode; she is still in the mode she was in yesterday afternoon, before she was thumped in last night’s vote.

The Prime Minister is in a total state of denial. We are not going to get anywhere unless that changes.

I am extremely doubtful that we have the time or the votes in this House for a renegotiation of the withdrawal agreement along Norway lines, or for any other Brexit alternative, but if people think we do, let us put that to the test in votes next week. If, when all the other options are tested, none can command a majority and Parliament remains gridlocked, the only option left will be to give the decision back to the people, as the shadow Chancellor also said on the radio this morning.

It is a pleasure to follow the right hon. Member for Birmingham, Hodge Hill (Liam Byrne). I do not agree with his conclusion in any sense because I think it would be grossly wrong for us to have a general election, but I do agree with him when he talks about some of the very real problems that exist in our country and that we have an absolute duty, as a Government, to start to address properly, ruthlessly in many respects and thoroughly. I am delighted that my right hon. Friend the Secretary of State for Work and Pensions is already beginning that work. She is already looking at universal credit to ensure that we are delivering a system that is absolutely fair—not just for the taxpayer, but for the person who comes to rely on universal credit.

I also agree with the right hon. Gentleman that it cannot be right that we live in a country where people in work are relying on food banks. That is wrong. That is not the sort of country that we should have in 2019. Equally, we have a system whereby people in need are given food vouchers and not often cash, which they also might need. Again, that cannot be right, but it is good and right that changes are beginning to be made.

There is another problem. The Government are undoubtedly set on the right course, but they are often being diverted because of Brexit, which has swamped almost everything that we want to do and that I know we can do. There is a real democratic deficit opening up in our country. I agree with what my hon. Friend the Member for Plymouth, Moor View (Johnny Mercer) said about the state of British politics and the extremism that is undoubtedly taking over. Anybody who tries to suggest that the Labour party has not been taken over by the far left is frankly living in fantasy land. Anybody who has any doubt about that only needs to look at the comments made on social media by Momentum and all the rest of it. The whole tone of British politics has been grossly diminished.

We all know—let us be honest—that many Labour Back Benchers are in fear of being deselected and fear the far left all the time. More importantly, this country should fear the far left, who have taken over the Front Bench of the Labour party. Goodness help us if they ever get into government, because they would undoubtedly cause the most appalling damage, especially to our economy.

The right hon. Lady talked at the beginning of her speech about fairness. I would suggest that the problem is not so much fairness as resources. There are plenty of resources in this country; it is the distribution of resources that is the problem. That is why the right hon. Member for Birmingham, Hodge Hill (Liam Byrne) is in the soup kitchens of Birmingham on a Sunday night—because of the inadequate fairness of distribution of resources in the UK. That is why people reached to Brexit. That is why people are looking to weird places in the far left.

I do not agree with that analysis at all. The problem is that if we do not get the economy of our country sorted out and we do not have a strong economy, we do not have the money to pay for the services that we need. We know that we need to tackle the greater problems, such as the fact that there is almost a crisis in social care, but there are no magic money trees. The great danger—I would say this, given my views on Brexit—is if we do not get Brexit right, and we know what the consequences of Brexit will be, whichever way we cut it, because the Treasury analysis has told us: it will make our country’s fortunes less prosperous, and it will not be good for the economy of this country.

I want to return to the problem about democracy, because I am concerned. Everybody has almost given up on the Labour party, but my party also has to get it right. The Prime Minister has done her best; I do not doubt that for one moment. However, she had many opportunities—Members on both sides of the House have talked about this, and I did earlier today—at the outset to reach out, especially to the 48%, and ensure that she formed a consensus at the beginning, working across the parties.

There was undoubtedly a time when we could have got a consensus and a majority in this place, but unfortunately the Prime Minister pandered to a part of my party that has been there for a very long time, banging on about Europe. In my opinion, they do not represent the moderate, one nation, pragmatic Conservative party that I joined. Unfortunately, she has pandered to that side of my party, with great harm to our party, because if we ever lose that centrist, sensible, moderate, pragmatic, one nation conservativism, we will not succeed in winning again, especially among young people. I hope the Prime Minister changes her tone. The problem is her deal. If she wants to get Brexit sorted and deliver it, she has to change her deal, rub out her red lines and work with everybody.

She raises an important point about the nature of the political declaration, and that concern is another issue that I have been raising with the European Union, because I want to ensure that right hon. and hon. Members are able to have full confidence in that future trade agreement.

The Prime Minister made a deal with the EU on Ireland, and Ireland is right to keep her in a cage of her own making to make sure that the UK cannot backslide on its commitments. Last week, the EU27 will have noticed the sleekit way her Government changed the laws and moved the goalposts when dealing with Scotland in the Supreme Court. The reality is that, where once Britannia said it ruled the waves, now the EU’s big fear, as we have seen with Scotland, is that, when given the chance, Britannia will waive the rules and will be away on holiday before voting on any deal.

I think the hon. Gentleman is referring to the Bill that the Scottish Parliament brought forward that challenged the changes made in relation to the withdrawal Act. On the relationship between the withdrawal Act and the decisions of the Scottish Parliament in relation to Scotland, SNP Members and, indeed, the Scottish Government were aware of the position when they brought that Bill before the Scottish Parliament.

During this debate, even my hon. Friend the Member for Altrincham and Sale West (Sir Graham Brady), the chair of the 1922 committee, urged the Brexit Secretary and the Prime Minister, in the strongest possible terms, to redouble their efforts to get reassurance on the backstop. Our Prime Minister has gone back to ask EU leaders to work again on the backstop, because Members of this Parliament instructed her to do so. Hard Brexit brings real risk, and rejecting the referendum result also brings real risk.

The proposals from the Labour Front Bench promising the exact same benefits as the single market without the obligations are fantasy fiction. This is not a game. The risks faced by our constituents are real. I urge Members on both sides of the Chamber to stop criticising our country’s negotiators. Members should roll up their sleeves, wrap a cold towel around their head and work out what sort of deal they can support, because unless we find support for a deal, our constituents and our neighbours across Europe will never forgive us.

I beg to move,

That this House approves for the purposes of section 13(1)(b) of the European Union (Withdrawal) Act 2018, the negotiated withdrawal agreement laid before the House on Monday 26 November 2018 with the title ‘Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community’ and the framework for the future relationship laid before the House on Monday 26 November 2018 with the title ‘Political Declaration setting out the framework for the future relationship between the European Union and the United Kingdom’.

At the start of five days of debate that will set the course our country takes for decades to come, it is worth taking a moment to reflect on how we got here. When the treaty of Rome was signed in 1957, the United Kingdom stood apart. It was 15 years later, at the third attempt, that we joined what was then the European Economic Community. Ever since, our membership has been a contested matter.

In the first referendum in 1975, the British people voted to stay in, but almost a third of those who voted wanted to leave. Indeed, there are those in this Chamber who campaigned to leave at that time. As the EEC evolved into a European Union of increasing political depth, the British people’s doubts about our membership grew. Ultimately, membership of any union that involves the pooling of sovereignty can only be sustained with the consent of the people. In the referendum of 2016—the biggest democratic exercise in our history—the British public withdrew that consent.

The right hon. Lady has lost in the Supreme Court and in the European Court, and today she has lost in this House. I hope that she will not compound that by opposing a section 30 order for Scotland when the Scottish Government want it. Her history of opposition is not a good one and she should respect the democracy that she is talking about; it applies to Scotland too, Prime Minister.

As I have just said, membership of any union that involves the pooling of sovereignty can only be sustained with the consent of the people. In 2016, that consent was withdrawn by the British public in relation to our membership of the European Union. In 2014, when the people of Scotland were asked whether to remain in the United Kingdom, they voted to stay in the United Kingdom.

As I just repeated, in the referendum in 2016, the British people withdrew that consent, and they confirmed that choice a year later by voting overwhelmingly for parties that committed to delivering Brexit. The referendum was a vote to bring our EU membership to an end and to create a new role for our country in the world. To deliver on that vote, we need to deliver a Brexit that respects the decision of the British people: a Brexit that takes back control of our borders, laws and money and a Brexit that sets us on course for a better future outside the EU as a globally trading nation in charge of our own destiny and seizing the opportunities of trade with some of the fastest growing and most dynamic economies across the world.

I am sure that the right hon. Gentleman read the Labour manifesto with great caution and detail. [Interruption.] Oh, he did. We were quite clear that we respected the result of the referendum. In our conference motion we discussed the whole issue at great length, and at the largest Labour party conference in our history, our party agreed unanimously to back the composite motion that we put forward. That motion opposed the process that the Government are bringing forward, and suggests that if the Government cannot govern—and it looks increasingly like they cannot—they should make way and have an election. That is our priority.

Should the backstop come into force, there is no time limit or end point. It locks Britain into a deal from which it cannot leave. As was said during proceedings on the Attorney General’s statement yesterday, this is the first time ever in the history of this country that we have signed up to a treaty that we could not leave of our own volition. That is quite a serious indictment of this Government. In the backstop, restrictions on state aid are hard-wired with an arbitration mechanism, but no such guarantee exists for workers’ rights, and new state aid rules could be brought in, whether they were in Britain’s interests or not. The Attorney General made that very clear yesterday.

Just before he does, I remind colleagues that it is legitimate to use mobile devices without impairing decorum, but it has just been brought to my attention that there is a very widespread use of them, and I gently remind colleagues that they most certainly should not be taking photographs in the Chamber. [Interruption.] Yes, I know exactly what I am doing and saying, and upon what advice. It requires no comment or contradiction, simply a recognition of the validity of the point.

Will he respect the mandate of the Scottish Government and the Scottish Parliament’s will to have a second independence referendum? How far does his respect go?

That is not actually relevant to today’s debate. We are talking about the deal that the Government have brought back, and that is what the debate is about. In the backstop, regulatory frameworks dealt with by non-regression clauses are non-enforceable by EU institutions or by arbitration arrangements, and would give the Government the power to tear up workers’ rights and damage environmental protections and consumer safeguards.

Let me make some progress.

Although we respect that England and Wales voted to leave the European Union, we ask that the Government respect that Scotland did not. However, it is clear that the UK Government have no intention of respecting the will of the Scottish people, as the deal we are asked to support will do nothing but bring harm and hardship—socially, economically and politically—to Scotland.

We must remember that this fight, this huge struggle and this burden on our society we now face from Brexit come from the Tory party, and from the Tory party alone. The European debate was an internal battle for the Tories, and they drove it into the public discourse, on to a bigger battlefield, not because of the interests of the citizens of this country but because of the deep divisions and narrow interests within the Tory party itself, not outside it. We know today that it does not have to be so. We know that the Prime Minister’s deal will be voted down—we know it and she knows it—and this House should also vote to remove no deal from the table. There is no scenario where we will be wealthier with Brexit. No Government should expose their citizens to economic risk, which is what will happen with Brexit. The Government’s own analysis shows that to be the case.

We must stop this madness. We can go back to the people of these islands and be honest with them on the consequences of Brexit. Today the advocate general, Manuel Campos Sánchez-Bordona, has advised that EU law would allow the UK unilaterally to revoke article 50. We can hit the reset button. That, Prime Minister, is called leadership.

I am going to make some progress.

Not content with ignoring the Scottish Government’s compromise option for two years, the Prime Minister now wants to shut Scotland’s voice out entirely. She cannot go on ignoring Scotland. Tomorrow, the Scottish Parliament will debate a cross-party motion that rejects this deal and a no-deal Brexit. Perhaps there are lessons for this place because at Holyrood parties have come together against a damaging Brexit, with a consensus and a desire to work collectively to defend Scotland’s interests. How many of the 13 Tory MPs from Scotland will stand up with us to defend Scotland’s interests? Where are they? I think we know the answer from the failure of the Scottish Tory MPs to stand up against a power grab when Westminster voted to take back control from the Scottish Parliament. We saw, when our powers over fishing, farming and the environment were to be trampled all over by Westminster, that the Scottish Tories turned a blind eye—Scottish Tories standing silent as the Scottish Parliament, our Parliament, which the people of Scotland voted for in such huge numbers in 1997, had its powers constrained.

The Prime Minister boasts that her deal has support, but her deal does not have the support of the people of Scotland. A poll published earlier this year found that almost two thirds of Scottish voters believe that the Westminster Government are ignoring their concerns during the Brexit negotiations. There is now more support in Scotland for remaining in the EU than there was at the time of the 2016 referendum. According to research carried out for the people’s vote campaign, 66% of Scottish voters support staying in the EU. The Prime Minister, like her predecessors, is out of step with the feelings of the Scottish people.

It is not just Scottish people: countless experts and professionals throughout the UK have said that it is a bad deal. Why is the Prime Minister not listening? Her proposed deal is unacceptable and must be defeated in this House. Some 80,000 jobs in Scotland will be put directly at risk as a result of Brexit. [Interruption.] I can see Ministers shaking their heads, but that is the analysis of the Fraser of Allander Institute. Indeed, the UK Government’s own economic analysis points to the fact that a no-deal Brexit would damage the Scottish economy and wipe out more than 8.5% of our GDP. How any Government can impose these risks on Scotland is simply breathtaking.

The UK Government’s intention to end the free movement of people will be hugely damaging to our economy. Inward migration has made an overwhelmingly positive contribution to Scotland’s economy, meeting our needs for workers in sectors such as health and social care, as well as in the tourism industry in the highlands and islands. Any reduction in EU migration could have a serious effect on Scotland’s population growth and its demographic composition. All the projected increase in Scotland’s population over the next 25 years is due to migration. According to the Scottish Fiscal Commission, with 50% less EU migration, the working-age population would decline by almost 1% and the proportion of children would decline by 4.3%. The Prime Minister’s deal totally fails to meet Scotland’s needs.

An example of exactly what my right hon. Friend is talking about came to my ears today. A pilot who works for a Scottish airline has a choice between having a strong EU Dutch passport or a UK passport. Having a UK passport would mean that he would have to pay around £10,000 for himself, his wife and his children to stay in the UK, and he would be left with a weaker passport. Or he can go with a Dutch passport and work internationally in the airline industry. That is the very damage that my right hon. Friend is talking about. The Government do not care about what they will do to the transport infrastructure of the highlands. They will carry on blindly, as they have been doing.

My hon. Friend is absolutely right. We must make the point right across Scotland that there is an existential threat to our living standards and our workers. We must make sure that we stop Brexit. If we cannot stop Brexit for the United Kingdom, we have to take seriously our own responsibility to protect Scotland.

Brexit uncertainty is already damaging our economy to the tune of £600 per household per year, as the value of the pound falls and inflation rises. That is not “Project Fear”; that has happened. That is what has happened since the sheer irresponsibility of the Vote Leave campaign, with ridiculous statements on the side of a bus, promoted by the ex-Foreign Secretary, the right hon. Member for Uxbridge and South Ruislip, who should be hanging his head in shame.

There is no certainty in the Prime Minister’s deal on future trading arrangements for goods and services, no certainty on future mobility, no clarity on law, and no guarantee on continued participation in the EU funding programmes that support our universities, communities, non-governmental organisations and businesses. Uncertainty leads to risks for investment and further risks for our economy. Under a free trade agreement, GDP would be £9 billion lower by 2030 than if we stayed in the European Union. That is equivalent to £1,600 per person in Scotland. That is what Brexit risks per year, making the people of Scotland poorer. That is why the Scottish National party, in all good faith, has offered a compromise. If we are to be dragged out of the European Union against our will, then, at the very least, we must remain in the single market and the customs union to protect our economy. Without single market and customs union membership, the future relationship can only be a free trade agreement, introducing barriers to Scottish companies’ abilities to trade. That will damage jobs, investment, productivity and earnings.

The Government’s own analysis proves that Brexit is bad for Scotland: trade volumes, GDP and wages would all fall, while Government borrowing and trade costs would increase. All the analysis shows that a no-deal scenario would be catastrophic and it is likely that the corporate sector in general is not well equipped to deal with a no-deal Brexit. It is more important than ever that we are not faced with a false choice between a bad deal and a no deal. We need to have more time. We must extend article 50 and take an alternative route to protect our economy. This deal and no deal are not options. Only those reckless enough to risk economic hardship will back this deal.

Despite what the Prime Minister said here today, her own Chancellor agrees with the SNP. He admitted on Radio 4 that, in economic terms, we will be worse off after Brexit and after leaving the single market. Even more telling is the admission from the Prime Minister herself in the House last week. In response to the right hon. Member for Belfast North (Nigel Dodds), she said:

“What we want to be able to do in the future is to have our independent trade policy. One of the issues in relation to the backstop is whether or not we would be able to do that—that is one of the issues that we would not want to see us continuing to be in the backstop for.”—[Official Report, 26 November 2018; Vol. 650, c. 32.]

So the Prime Minister is clear. There is a concern from this Government over their ability to be able to strike and implement free trade deals if the backstop comes into force. Why then is she arguing here that this deal delivers? Again, I ask the House: how can we support a deal and back the Government on delivering an outcome that would make our economy smaller and our communities poorer?

Ministers have tried to spin support in favour of this deal, citing the support from sectors across the United Kingdom. However, let me say this to those who believe that this deal is the only option: it is not and we deserve better. We know that frictionless trade at the border is crucial for Scotland’s food and drink exports, but there is no guarantee of that as, under the deal, border checks and controls will depend on the extent of the UK’s alignment with EU customs and regulatory regimes. Yet the declaration contains no commitment to a common rulebook on regulation. The SNP believes that our food and drink sector deserves assurance. It deserves cast-iron protections for the industry, not a false binary choice between a no Brexit and a blindfold Brexit.

Yet again, another UK Tory Government in Westminster have bargained off our fishing sector. The utterances from No. 10 are false assurances. The UK is reneging on its promises to support Scottish fishing by accepting a link between UK waters and access to EU markets. Its commitment to a separate fisheries agreement as part of the economic partnership could mean the UK ceding access for EU vessels to UK waters, or accepting tariffs and customs barriers on trade and fish, seafood and farmed salmon with the EU. That is not acceptable. That will mean that, again, Scottish interests are being traded off against each other. That is absolutely unacceptable and those Scottish Tories who profess to want to protect Scottish fishermen should hang their heads in shame. If the Tories go through the Lobby to protect this Government, they will once again have sold Scotland out for party political gain and they will not be forgiven for it.

The UK Government must respect the will of the Scottish people, who voted overwhelmingly to remain in the EU. It is a democratic outrage that Scotland has been dragged out of the EU against its will. The withdrawal agreement sidelines Scotland and sells out our vital national industries. How could any representative in good conscience support such a move? Let me be clear: next week, the SNP will reject the withdrawal agreement because it will leave Scotland poorer and rip opportunities away from future generations. Does the Prime Minister show any respect at all for our mandate? No. Do this Government have respect for the fact that every Scottish local authority voted remain and that the nation voted 62% in favour of staying in the EU? No. Well, in Scotland we will make our voices heard once again.

Northern Ireland has been given a differential deal that will put Scotland at a competitive disadvantage. There is no reason why a similar arrangement cannot be afforded to Scotland. The SNP will table an amendment to ensure that the voice of Scotland is well and truly heard in this place. Those who claim to be democrats—those who claim to have respect for the people of Scotland and for the mandate of the Scottish people and Parliament—cannot vote with the UK Government on this deal. It is clearer now than ever before that the only way to protect Scotland’s interest is to be an independent nation.

The First Minister has been very clear that she will set out the next steps on Scotland’s future once the terms of the Brexit deal are clear. The process of Brexit has demonstrated weaknesses in the UK’s constitutional arrangements. Scotland has been ignored, sidelined and undermined through the entire Brexit process. The costs to the people in Scotland of not being independent have been laid bare.

Today is a moment of huge historical significance. For decades to come, people will remember what this place decided to do—whether we, as public representatives with the responsibility to protect our communities and constituents, voted for a deal that would harm and hinder their opportunities, or whether we stood up for them. This is no ordinary time in our history and it is no ordinary time for our politics. Brexit has cast the politics of Westminster into a landscape of crumbling certainties.

We are at a defining moment. We must stand up for our constituents. We cannot ignore the economic analysis. We cannot drive blindfolded off the cliff edge. We must take back control in this place. We must have the courage of our convictions and wield the power gifted us to do the right thing. We must stop this deal and this Government railroading recklessly over our rights, our freedoms and the opportunities of our people. There is another way, there is time and we must take it.

I hope that the hon. Gentleman will reflect for just a tiny moment on the fact that Ireland, which became independent of the UK 96 years ago, will this year be growing five times faster than the UK. For further understanding of that, it will take the UK five years to do what Ireland does in one year.

The hon. Gentleman will know, I am sure, what is the fastest growing major European economy at the moment. He also knows the difficulties that Ireland had some years ago as a result of its membership of the euro—something that would be inflicted on Scotland by the nationalists if they had their way.

I think the Prime Minister has enormous good will on both sides of the House. I think that Members on both sides of the House know that she has worked phenomenally hard to try to secure the best agreement. I also think she is correct when she makes the point that the country feels ready to move on. There is palpable tiredness with this subject. People the length and breadth of the United Kingdom want to know that we are going to move forward and put into effect the referendum that took place two and half years ago.

I listened earlier to the Leader of the Opposition as he talked about fear and concern in business and said that uncertainty was affecting investment in our country. It is important that Members on both sides of the House understand that if there is fear and uncertainty in boardrooms in this country, it is because of the concern about what would happen if the right hon. Gentleman were ever to form a Government in this country, and if there is capital flight going on at the moment from our country, it is because of that concern, not because of concern about Brexit. Certainly, we on this side of the House are in no doubt that it is better to have a Conservative Government led by my right hon. Friend the Prime Minister than the alternative.

I was about to say something very similar. Others in this House are much better qualified than me to decide what mechanism would best make sure that all Members of Parliament have possession of the facts, information and advice that we need. Whether that is achieved through the exact wording of the motion or a better way can be agreed in discussions elsewhere is not for me to rule on.

I come to this debate with one significant disadvantage compared with a lot of others who will take part in it, and with one significant advantage. The significant disadvantage I have is that I am not, have never been and never intend to be a lawyer. The significant advantage I have is that I am not, have never been and have no intention to be a lawyer. That means that I have no conflict of interest in saying that the law and lawyers are there to serve the public. Parliament and parliamentarians are here to serve the public, not the other way round. In this context, the law and lawyers are here to serve Parliament; Parliament is not here to serve the lawyers.

A number of really extraordinary concerns have been raised about what the motion, amended or otherwise, would mean if it was agreed. As far as I can see, this is not about abolishing the convention that legal advice is privileged or confidential, or about insisting that from now on every Attorney General who ever gives evidence has to do so on the assumption that it will be on the front page of the Daily Express by the next day. It is not about that at all. Simply reading the wording of the motion makes it perfectly clear that that is not what is being asked for.

I have heard concerns from Conservative Members. People are worried that they will be expected to vote for something but then, after they have done so, somebody else will interpret what their vote actually means. Some of us have been thinking about that since 23 June 2016, because that was exactly what happened to 33 million people after they cast their vote in the EU referendum. There is a significant danger that that is precisely what has been set up to happen to us when we are asked to vote on the Government’s deal or no deal. We will be asked to give a commitment to agreeing to something without really understanding what we are being asked to vote for. When something is so fundamentally important, that is simply not acceptable.

We should be under no illusions whatsoever about the consequences of our getting it wrong when we come to vote on a proposed deal. Whether we end up with a bad deal or no deal, the Government’s own analysis points to an economic hit that would be bigger than the crash of 2008, including a 9% reduction in economic growth; hundreds of thousands of jobs put at risk; £2,300 per year out of the pockets of every family in Scotland; the rights of millions of citizens called into question; and, as has been mentioned, the very real risk of undermining that precious but fragile peace that allows people on both sides of the Irish border to do what most of the rest of us take for granted—live normal lives. It would be a criminal dereliction of the duties entrusted to us if we willingly took that decision in the knowledge of the possible consequences and the fact that there was expert advice about what those consequences might be, but did not even ask what that advice said.

My hon. Friend hits on a very important point about the best possible deal for Britain, or a good deal or whatever—I think I heard that on Radio 4 this morning. The reality is that whatever deal is good at the moment is the equivalent of having crashed the Rolls-Royce and heading down to the car shop to get the best second-hand car for Britain. What we have at the moment will not be repeated—things will be an awful lot worse—but the media are parroting a line and misleading the people. What happens under Brexit, deal or no deal, will be a lot worse than what we have today, and the chickens will come home to roost for this Government very quickly.

I am grateful to my hon. Friend for his comments. My views are perfectly clear: I do not think there is such a thing as a Brexit deal that can come close to being as good a deal as we have just now. If that argument is not going to be rerun—if we are not going to get a chance to correct the mistakes that have been made in the past—so be it, but it is my responsibility, and the responsibility of all of us, to make sure that the Brexit that is agreed is the least damaging that is possible.

I know that some Government Members will be concerned—some have already raised concerns—about setting a dangerous precedent. May I remind them that the Government’s mantra for months has been that this is an unprecedented situation? In an unprecedented situation, precedents do not apply. How can what we do in response to an unprecedented situation set a precedent for what happens next, unless the Government propose to hit us with more unprecedented disasters through their own blundering incompetence?

Thank you, Mr Speaker. As I was saying, if the Government’s key argument is that it is unworkable to have a set of rules that allows legal advice to Ministers to be disclosed under exceptional circumstances, that is shown to be nonsense by the fact that in Scotland a different set of rules applies, and does so very effectively.

Related to the precedent argument is the claim that Parliament is not allowed to see Government legal advice under any circumstances. Why not? The reason given is simply that we are not allowed to. I would love someone on the Government Benches who believes in the absolute sovereignty of Parliament to explain why this supposedly absolutely sovereign Parliament is not allowed to do anything it likes, because that is the argument we often hear from them. I do not believe in the absolute sovereignty of Parliament, but for those who do, how can it be that there are any restrictions on what this absolutely sovereign Parliament can ask or instruct Ministers, who are accountable to it, to do on our behalf?

I will not take any more interventions.

As has been said, the last time there was such a significant argument about disclosure to Parliament or providing it with Government legal advice was probably in the run-up to the decision to go to war in Iraq. SNP Members and others in the House argued then that Parliament should have sight of the Attorney General’s legal advice before being asked to vote in favour of war. The SNP was vindicated, as were others. We were shown to be right in asking for that advice to be disclosed, but tragically it was too late for it to make any difference. At the time, Parliament was in possession of the equivalent of what today’s non-selected amendment asks for—the Government’s version of advice, and of such parts of arguments, and of information and intelligence dossiers, that the Government wanted Parliament to see—but not of anything that did not suit the Government. Parliament was given incomplete and, frankly, biased and misleading advice, and it made a catastrophically bad decision as a result. If we are worried about precedent, we should think about the precedent that that might set. I do not believe there is any chance that MPs would have supported the invasion of Iraq if they had been in full possession of the facts that the Government had at the time.

Two days ago, I laid a wreath at a memorial to two young men from Glenrothes who I am convinced would be alive today if Parliament had had such advice at the time it took that decision. I am not suggesting, and nobody should suggest, that a bad decision on Brexit will lead directly to thousands of deaths, but it will lead to enormous financial hardship and huge social upheaval for millions of citizens—perhaps tens of millions—and it could set off an uncontrollable chain of events with the potential to result eventually in the deaths of innocent civilians in parts of these islands.

I want the House to be given the best possible opportunity to reach not the best Brexit decision, but the least worst Brexit decision. In order to do that, we need at our disposal all the advice and information that anybody has been able to provide. If parliamentary precedent or convention, or medieval practices, prevent us from doing our job properly, they have be to be either set aside or changed. The situation is too important to allow medieval procedures to get in the way of the right decision. The Government have already set aside the Sewel convention because we are in an unprecedented position. I suggest that the convention on the absolute confidentiality of legal advice has to be varied on this occasion to get us to the correct decision.

I want every MP who shares collective responsibility for the decision we will take in the near future to know that whether our constituents agree or disagree with our decision, each of us will have exercised our judgment in full possession of the facts. We will then be able to take the responsibility for the decisions that each of us will take. I urge the House to support the motion.

Yes. The Government are the client and the relationship is between a client and a lawyer, providing completely disinterested, impartial advice to the best of their ability. Of course, on top of that, it is not holy writ either; it is advice. At the end of the day, if the House gets the Government’s statement of a legal position, it can indeed go to other lawyers, who may wish to pick it to pieces, and that, I am afraid, is often almost inevitable.

Surely if the Government are the client, the client is at liberty to share the advice, and indeed the client should be sharing it, particularly in this circumstance.

I understand the hon. Gentleman’s point, and at the end of the day it is right to say that the Prime Minister can waive the privilege. It is open to a Government to decide to publish the legal advice, but, speaking as a past Law Officer, first I would be dissuading the Government from publishing legal advice for the reasons that I have just given, and secondly, that is a different thing from this House trying to coerce the Government into publishing legal advice. In my view, that undermines good governance and does not serve a purpose that is in the public interest, particularly in the light of the assurances that we now have as to how the Government will proceed, and which, I might add, I shall make it my business to try to ensure that the Government honour—and I am sure they will.

With that, as I promised I would a few moments ago, I bring my remarks to an end.

I absolutely bow to the right hon. and learned Gentleman’s expertise. I was going to make a second point, which may offer Ministers some comfort: also by definition, the legal advice the motion seeks to have released has not yet been written, because we do not yet have a withdrawal agreement. Only when we have a withdrawal agreement will advice be written about what it means, to advise the Cabinet and, I hope, Parliament.

The right hon. and learned Member for Beaconsfield (Mr Grieve) has just made clear why the legal advice, rather than a report on it, must be published. Remember Roger Casement, who said he was hanged on a comma—any change in wording seriously changes the meaning of the legal advice.

I take the hon. Gentleman’s point, but I think the House agrees that there could not be a difference between the two, for reasons that Government Members have clearly set out.

These are unique circumstances. It seems to me that, in his typically elegant way, the Minister went a long way towards meeting the requirements of the motion. If it is pressed to a vote, I hope he follows the logic of his own argument and supports it in the Division Lobby.

As a humble Back Bencher, I unfortunately have no idea what legal advice was made available to the Cabinet. It might assist the House to know that the ministerial code is clear—I cannot remember in which section, but in the same area—that if a Law Officer gives legal advice to the Cabinet, the whole of that advice must be provided as an attachment for the whole Cabinet to read. It is very important in these difficult times that we ensure that the ministerial code is complied with in full.

I pay tribute to the previous Labour Government and to previous Conservative Governments, who worked hard to improve the transparency of the process of government. Great advances have been made, for example in the field of freedom of information. It is relevant that legal officers’ advice is exempted from the Freedom of Information Act under section 42. It is also true that it is ultimately up to the client to decide whether or not legal advice should be published. I am concerned for future Governments, and for future Government legal advisers: I want them to be able to provide the fullest, frankest and most honest advice possible.

A few seconds ago, the hon. Lady was arguing that if the legal advice were to be published and more widely known, that would somehow compromise future advice. Is she suggesting that the skills and the general professionalism of legal people would be compromised in future—that they would compromise themselves, and would not give the fullest, frankest and most honest advice because of what might have happened in the past, and would then become different legal people?

That is absolutely what I am saying, and that is the basis of legal professional privilege. It is critical that lawyers are able to give a range of views to their clients about, for example, the chances of success in litigation, and the chances of success if various options are adopted. That is why legal professional privilege exists. It is absolutely critical for lawyers and their clients to be able to speak completely frankly to one another.

Let me end by echoing what was said by my right hon. and learned Friend the Member for Beaconsfield (Mr Grieve) about the ring of confidence. It is important, in my view, that the Attorney General’s advice is sacrosanct and should remain within the Cabinet, because if the ring of confidentiality is broken, that is a very serious matter. It is important for collective government and sensible decision-making that we maintain these conventions, even in difficult times—perhaps especially in difficult times.
