My Lords, the Covid-19 crisis has had an incredibly negative impact on the education of millions of children—at least 1.5 billion children in more than 150 countries were out of school at its height. We are working to ensure that we are pivoting our existing programmes to allow remote learning, through radio and television programmes. The important thing is to make sure that all pupils, especially girls, return to schools as and when they reopen. We know that children outside school are at risk of child marriage and violence, so the important thing is to get girls back into school and then ensure that we are doing more to deliver 12 years of quality education for every girl in the world.

I reassure my noble friend that we are working closely with the Commonwealth, which has an essential role to play in our global response. Most recently, on 14 May, there was a virtual meeting with all Commonwealth Health Ministers, which was also attended by the director-general of the WHO and representatives of Commonwealth organisations, such as the Commonwealth Foundation and the Commonwealth Medical Association. We will continue to work closely with our Commonwealth partners to ensure that we end this pandemic.

My Lords, as I said, the Commonwealth has an essential role to play in the global response to Covid-19. We obviously have a presence in the vast majority of countries that need our presence and, where we do not, we work closely with international agencies to make sure that they are delivering the help needed on the ground. However, I will certainly take the noble Lord’s suggestion of working with other Governments back to the department.

My Lords, we must of course recognise the challenges that are going to be faced by economies all around the world. We are considering carefully what that means for our 0.7% aid commitment, but we are proud that the UK is keeping that commitment; it is more important than ever. Given that we are in the early stages of the Covid-19 outbreak, we do not yet know the exact implications, but we will ensure that we use all possible financial levers to support our response. As my noble friend says, we must maintain and indeed increase the quality and quantity of our work to protect women and girls.

My Lords, fighting sexual and gender-based violence remains the most chronically underfunded sector in the humanitarian appeals of the United Nations. What consideration has been given to allocating a specific minimum percentage of the DfID budget to fighting sexual and gender-based violence not only during emergencies but as part of the regular allocation of funds?

I thank my noble friend for that question. She is of course right that during times of crisis, the rights of women and girls are often overlooked. In this time of crisis, when people are at their most vulnerable, women and girls need our support more than ever. We must learn the lessons of past epidemics and explicitly include the needs of women and girls as part of our humanitarian response, and in order to stop more lives being needlessly lost. We are therefore working with our international partners to act now, putting gender at the heart of our response. The impacts of coronavirus are not gender-blind, so nor should our response be.

A key element of nutrition-sensitive spending is universal health coverage, which is vital to building resilience to such pandemics. It is likely that the Nutrition for Growth summit will be delayed. Can the Minister assure the House that, if this year’s summit is delayed, she will ensure either that the Government pledge early, or will ensure a continuation of nutrition finance at current levels for another year to avoid a cliff edge in such financing at the start of 2022?

My Lords, we absolutely need an effective Covid-19 vaccine to be developed, trialled and approved for use as quickly as possible. We are doing that in three ways. First, we are the largest funder of the Coalition for Epidemic Preparedness Innovations. Secondly, we have launched a vaccine task force to expedite and co-ordinate efforts to research and produce a coronavirus vaccine. Finally, in June we are hosting a replenishment for Gavi, the Vaccine Alliance. That will be really key to the operational delivery of a vaccine at an affordable price to those who need it across the world.

DfID has given priority to strengthening health systems across Africa. Can we be assured that this will be maintained, if not increased, especially in the light of falling GDP at home? What does the Minister think about the WHO’s advice that there should be no restrictions on travel to Africa, given that the disease is escalating there and that this has proved to be a factor in spreading it worldwide?

My Lords, I agree that we need to strengthen the fragile health systems in the world’s poorest countries, where the chance of disease spreading rapidly is the highest. That will of course reduce the risk of having future waves of infection globally. I am not going to comment on the WHO’s advice on travel to Africa. I would say, though, that it is important that we maintain connectivity so that we can support our delivery of aid in the countries which are sometimes hardest to reach.

My Lords, I was unable to attend the Grand Committee because of business in the House. Will the Minister confirm whether this is one of the many hundreds of statutory instruments needed because of a possible no-deal exit from the European Union, which no one wants and which would be disastrous for this country, and on which many civil servants are spending a great deal of time when they should be doing many other more useful things?

My Lords, I want to move Amendment 1 and speak to the other amendments in my name in the group. Their purpose is to limit the scope of delegated powers to amend legislation conferred by the Bill. I am most grateful to the noble Lord, Lord Blencathra, and the committee for its considered response to the provisions in the Bill.

The Bill’s purpose is straightforward and clear: to enable the system for registering marriages to be flexible enough to include the names of each of the couple’s parents, while taking the opportunity to introduce a secure and reliable digital system of registration. The amendments, which are a direct response to the committee’s observations, put into sharper focus the changes in law that are needed for that specific purpose. In fact, the essence of the Bill is that its scope is restricted. It relates only to the registration of marriage, not any aspect of the solemnisation of marriage—that is, the who and when and how and where of marriage ceremonies.

I want to explain the proposed changes in more detail. I have worked closely with Home Office officials to consider the amendments that could be made to the Bill to limit the delegated powers it currently contains. The amendments are quite technical, but I assure noble Lords that they do not affect the policy intent behind the Bill in any way. I thank the Minister for making illustrative regulations available in the Library to demonstrate how the Marriage Act 1949 will be amended.

Clause 1 currently confers a broad power on the Secretary of State,

“to amend, repeal … any provision made by or under any Act of Parliament”.

That power is wider than is needed to bring in the required changes. Any changes to primary legislation will now be limited to amending the Marriage Act 1949. The regulations would change the current procedures in Part III, “Marriage under Superintendent Registrar’s Certificate”, to provide that a marriage can be solemnised on the authority of a single schedule for the couple instead of two authorities, one for each person, as is currently the case.

The regulations would also provide for a member of the clergy to issue the equivalent of a marriage document for marriages that have been preceded by ecclesiastical preliminaries, such as the calling of banns or the granting of a common licence. Once a marriage ceremony has taken place, the signed marriage schedule or document will be returned to the local registry office for entry in the electronic register and a certificate will be issued.

A sunset clause will also be included in Clause 4, which places a time limit on the Secretary of State’s use of their power to amend primary legislation to a period of three years, beginning on the day when the regulations are first made.

I assure noble Lords that the regulations that amend the Marriage Act to introduce a schedule system would be subject to the affirmative resolution procedure and will require the approval of both Houses of Parliament. I hope that this will assure the House that it will continue to oversee any changes made to primary legislation.

The committee raised concerns that the power for the Registrar-General to make regulations in Clause 2 may entail delegation on matters that are currently provided for in the Marriage Act. That was never the intention, so it is proposed to limit the scope of the powers to making regulations under Section 74(1) of the Marriage Act.

The provisions in the Marriage Act which refer to the Church of England are construed as referring also to the Church in Wales unless otherwise required, in accordance with Section 78(2). However, it is proposed to amend Clause 2(1)(f), which relates to the keeping of records of all marriages solemnised in the Church of England to include reference to the Church in Wales. This will enable the Registrar-General to make different provisions for the keeping of records, if required, in the Church of England and the Church in Wales.

The powers in Clause 2 would be used to enable the Registrar-General to make regulations to prescribe the content of the marriage schedule or document and for how long they should be kept. They would make provisions to correct or reissue a marriage schedule or document prior to the marriage taking place if any information, such as the couple’s occupations, has changed since a notice of marriage was given or after ecclesiastical preliminaries.

The regulations also make provision for the keeping and maintenance of existing paper marriage registers and how the entries should be corrected. These regulations made by the Registrar-General are procedural and intended only to supplement the relevant provisions in the Act.

We have included a consequential amendment in the Bill in Clause 3 to repeal the Marriage of British Subjects (Facilities) Acts 1915 and 1916. These provisions are rarely used and would no longer work with the introduction of a schedule system.

I hope that the amendments I propose to make to the Bill provide noble Lords on the Committee with reassurance regarding use of the delegated powers in the Bill. We very much value the scrutiny that the House provides through the legislative process. I beg to move.

My Lords, I congratulate the noble Baroness, Lady Barker, on her speech and on the work that she is doing in this area. I thank her for her remarks and I agree with all the points that she made. Perhaps I may also pay tribute to the chairman of the all-party group at the time, Pamela Nash, who is much missed in Parliament. Many important points are contained in the report on the availability of drugs, on generics and the rest, but the first part sets out the barriers to treatment.

I want to concentrate on one of those, the third barrier which is noted: the ways that key populations are left behind. Those key populations are injecting drug users, men who have sex with men, sex workers and transgender people. The one feature that unites these different groups is that they all suffer discrimination, prejudice, criminalisation and violence, and they are often given little or no political priority. This goes to the heart of the debate, because it all too often defines a position where access to medicine is denied. We are not talking only about developing countries in sub-Saharan Africa. When we talk about injecting drug users, we are quite often talking about countries like Russia, for example.

Globally, and particularly in the developing world, an even more formidable barrier is the discrimination against gay people, which takes its clearest form in the criminalisation of homosexuality. Many countries around the world still have laws, regulations or policies which present obstacles to HIV treatment—more than half the countries of the world, according to UNAIDS—and many of them are, of course, in the Commonwealth. The effect of criminalisation on access to medicine is clear enough. It acts as the strongest possible barrier for the people penalised in this way to come forward, and even more, it acts as a disincentive to prevention.

In their defence some officials around the world, particularly in Africa and India, say that the law is not strictly enforced in some countries, but that does not remotely settle the issue for it ignores the fact that the law also sets standards. That is why we have race relations legislation, for example. The standards in this case, however, are much worse. If the law says that certain acts are criminal, it provides an excuse for people generally to discriminate. It gives the green light to persecution. “The law is on our side”, they say. It encourages whole communities to ostracise gay people and for young men to be forced out of family homes, which happens all too often.

Perhaps I should say in passing, in response to something the noble Baroness said at the beginning of her speech, that I was half amused and half irritated to see in the official papers which were recently released that the internal advice from a civil servant at No. 10 to Margaret Thatcher on the AIDS threat was—I shall précis it—“Leave it to Fowler, Prime Minister. You would do better choosing a children’s cause”. I doubt very much whether that distaste for sexual disease has altogether disappeared in this country.

I want to make one last point. Apart from Governments, the obvious people who should be leading in the effort to fight the kind of discrimination that we face are the churches, and it is sad to note that there is precious little sign of that around the world. Uganda is not the only African country where the church is in fact on the side of repression rather than fighting it. Leaving equal marriage to one side, which we have debated in this House several times, not only would it be refreshing but immensely valuable if the Anglican church could back much more explicitly the right of gay people not to suffer from the injustice and discrimination that at present they do. There are some issues we can debate, but surely not the infringement of the human rights of any individual.

A wind of change in attitude is sweeping through many parts of the world, so surely the aim must be to encourage that wind of change to blow through Africa as well, and at the same time to blow down some of the barriers to treatment that are set out in this valuable report.
