The court will remain open because of concerns raised about the capacity of the receiving court at Northampton in light of the decision to close Daventry and Towcester magistrates courts.

I, too, remind the House of my former profession as a solicitor. I warmly welcome the Minister’s statement, particularly the welcome news that Bury county court will remain open. Will he confirm that that is not a temporary reprieve but a permanent decision? Also, I am slightly concerned that the decision to close Rochdale magistrates court will require a great deal of extra capacity at Bury magistrates court, especially as Rochdale already takes in the Heywood and Middleton benches. Has he taken that into account?

Yes, we have: we will be doing about £170,000-worth of work to accommodate the work from Rochdale magistrates court.

We are not just going to let IPP prisoners out—any of them. Release will be by the Parole Board. The Parole Board is currently experiencing considerable difficulty in evaluating whether prisoners can prove that they are a minimal risk when they are released, because it is very difficult to demonstrate that when the prisoner is in prison. We are going to readdress IPPs, to try to make them work as they were originally intended, for a comparatively small number of very dangerous offenders who pose a continuing risk, and look at the test that the Parole Board can apply. However, no one will be released until someone has assessed whether the level of risk is acceptable. It is impossible to guarantee no risk: there is nobody in prison about whom anybody could ever say, “This person is never going to be at risk of offending again.” I am afraid that, in the real world, there is nothing we can do about human nature. Quite a number of the people in prison will inevitably commit crimes when they come out, but the number who reoffend has to be reduced, the IPP ones have to handled very carefully, and the Parole Board has to be given a proper test to apply.

Further to the reply that the Secretary of State gave to my hon. Friend the Member for Suffolk Coastal (Dr Coffey), does he agree that if we are to restore the public’s trust in the criminal justice system, there must be honesty in sentencing and that convicted criminals should serve the full length of any sentence of imprisonment handed down by the court?

I agree with honesty in sentencing—I have always supported that idea—and we will certainly be addressing the way in which it is explained by a judge in court, so that it is clear and comprehensible to the public. That includes explaining the term of imprisonment and the term of licence that follows—what is currently called “serving half the sentence”. The first half is in prison; the second half is subject to recall to prison, but it is served on licence out in the community. To turn the full term into imprisonment, which no one has ever done, would merely involve doubling the sentence for every prisoner. The financial objections to that are only the first ones that I would raise.

Serious issues arise for parents in educational cases, and, obviously, the interests of the children should be paramount, as they are in most other cases. The difficulty is that the problem to be resolved usually relies more on educational expertise than on the law, and too often we are financing people who argue about the process that has been followed to resolve problems, instead of finding the best way of resolving the merits of how best to teach the child, where the child should be taught, or what support the child should have. We believe it is simply not right for the taxpayer to help inject an element of what is really legalism into problems that should in the end be resolved taking into account the best interests of the child from an educational point of view. Some of these cases can be turned into enormous legal battles, which seem to me to be very far removed from the object of ensuring that a child is best educated in school.

One group of people my constituents in Bury North would like to see excluded from the scope of criminal legal aid are Members of Parliament. Will the Lord Chancellor ensure that, in future, legal aid is not granted to any Member of Parliament accused of wrongdoing?

Considerable adverse comment was made about the unfortunate case of our recent colleagues who succeeded in obtaining legal aid for their defence because, I think, their case was listed in a Crown court that had not yet introduced means-testing. I can assure my hon. Friend that all Crown court cases that might involve legal aid will be subject to means-testing in future, and although MPs are not paid a king’s ransom, all are likely to have resources that will put them beyond the reach of full legal aid, which some of our colleagues recently obtained.

I think that the hon. Gentleman, too, is close to trying to make a political point on the back of these events. My right hon. Friend the Justice Secretary has made it absolutely clear that prison will continue to be reserved as the appropriate place for serious, violent and repeat offenders. We have no plans to fetter the power of magistrates or sentencers in that respect. The Government want the full force of the law to be brought to bear on those who committed acts of violence yesterday: they should be brought to justice.

In view of the decision made yesterday by a small minority of those involved in the demonstration to resort to violence and the destruction of property, does the Minister not agree that we should consider again whether the current sentences for such criminal behaviour are a sufficient deterrent?

We are conducting a review of sentencing, which will be published later this year. Of course there was no justification for the acts that took place, but I am not aware of any inadequacy in the sentencing powers available to courts. What is necessary is for the authorities to be able to collect the evidence and properly bring these individuals to justice.

I think we need to be clear about one thing: if the last Government had spent within their means, we would not now be having this debate and we would not be faced with having to reduce the police grant. As a nation, we simply cannot go on spending at the rate we are—borrowing £1 out of every £4 we spend. The reduction of the police grant must be seen in that context. It is a direct consequence of Labour’s economic mismanagement. I am confident that the police will have the managerial abilities to absorb the 1.46% reduction without front-line services being affected. Let us remember that even after the reduction, the police grant for this year will still be higher than it was last year. Compared with last year, this is not a cut, but simply a smaller increase.

In times of economic hardship, every area of expenditure has to be examined and we have to ask whether items of expenditure are really necessary. We have to ask whether what we are doing could be done more economically. The right hon. Member for Don Valley (Caroline Flint) talked about neighbourhood policing teams holding monthly meetings; we have to ask whether they really have to be monthly. Has any analysis been done of what percentage of local residents attend those meetings every month? As the chief constable of Greater Manchester police Peter Fahy wrote earlier this month:

“The numbers of staff in front line policing is important, but more important is what these staff are doing, the degree to which they are freed up from bureaucracy and the overall impact they are achieving.”

The Government have already scrapped Labour’s targets for the police force and have made it clear that the police’s only job is to cut crime. The only real test of an effective police force is not what it spends or the number of staff it employs, but how it protects the public it serves. Under this Government, police paperwork is being cut so that the police can spend more time out on the beat. That is what the public want to see, and I urge the whole House to support the motion.
