It is a pleasure to serve under your chairmanship, Mr Evans.

It is quite clear from the explanatory memorandum that the regulations apply primarily to England and Wales and Northern Ireland. However, the Trade Bill gives Ministers discretionary powers over procurement, which is a devolved area. It is one of the 24 powers that we are concerned about that may be grabbed back by the UK Government in the withdrawal Bill, which may have far-reaching consequences for businesses across a variety of sectors in Scotland, from food and drink to medical equipment.

In the UK, the Federation of Small Businesses reported that only 20% of public procurement contracts went to SMEs in 2017. We have set a target of 33% for 2020, which is encouraging, but in Scotland in 2018 78% of public procurement contracts went to SMEs and 60% of them went to companies in Scotland. That is a 46% increase in the SME contribution since 2014 and amounts to contracts worth nearly £5 billion. For us, public procurement is a big deal.

Since the SME involvement in public procurement in Scotland is such a success story and such a boon for Scottish businesses and economic diversity north of the border, it is completely unfair that the Government may be planning to maintain control of oversight of public procurement in London. Can the Minister assure me that he is not throwing the baby out with the Brexit bathwater?

My hon. Friend, the Chairman of the Northern Ireland Affairs Committee, is absolutely right to point out that these are devolved matters and that they need to be taken forward by a devolved Assembly and Administration—the Executive. We want to encourage all sides to get going again, because, clearly, these issues are important to the people of Northern Ireland and need to be addressed.

May I start by putting on record my thanks to my hon. Friend the Member for North West Cambridgeshire (Mr Vara), the former Minister?

The withdrawal agreement is the best way for Northern Ireland and the whole United Kingdom to ensure that we leave the European Union. It protects all the things that we value in Northern Ireland—the constitutional and economic integrity of the UK, and vital jobs and investment—and, for the people of Northern Ireland, it continues the progress that we have made over the past two decades under the Belfast agreement.

On Saturday 8 December, just five short days ago, the Secretary of State penned a letter to the people of Northern Ireland. The letter stated that the deal protects all the things that we value. As the Prime Minister is now desperately rushing around Europe to change that very deal, may I ask what the new letter will say this Saturday?

I stand by the comments that I made in the letter. This is the best deal to ensure that the United Kingdom leaves the European Union as one united kingdom. The Prime Minister, though, has recognised the concerns that there rightly are around the backstop, and she is seeking to address those concerns.

Many people throughout the United Kingdom are very excited about Brexit. They know about the blue passports that they will be able to hold and about the new Brexit 50p coin, and the prospect of Empire 2.0 is coming to the fore. However, the more people learn about the Brexit process, the more they are realising that we will lose more than we could possibly ever gain. In my constituency, 60% of people voted to remain in the EU, and recent polls have shown that the proportion of remain supporters has increased to 68% or 69%. I think that as people in Scotland become aware of the real impact on their lives and jobs, there will be a hardening of the pro-EU vote.

I want to focus, however, on the impact of the UK’s leaving the EU on the important areas of defence and security. In my view, the Government have drastically underestimated the negative consequences of Brexit for our ability to maintain safety and security in the UK without the full co-operation of our European counterparts and the ability of our defence industries to trade and operate freely across the single market. We have a strong, competitive defence industry here in the UK. Firms such as Babcock, BAE Systems and Rolls-Royce have successfully fulfilled Ministry of Defence orders for years, and even more newer companies are coming into the work stream. Those firms, like many others, have built up a valuable breadth of expertise and capability, and we should be doing all that we can to preserve their skills.

While the withdrawal agreement offers short-term stability to the defence industry, it provides no assurances in the long term to ensure that just-in-time supply chains and trading arrangements across the EU will be maintained. We must also consider the support that is currently given to the industry, particularly to small and medium-sized enterprises, in the form of European structural and investment funds and the European Investment Bank. The Government must commit themselves to continuing or replacing that support. Without it, we face further job losses in dockyards like Rosyth in my constituency and the gradual depletion of those skills from our industrial landscape. That would be an economic travesty, which I am sure neither Members nor our constituents wish to see.

In a report published in March entitled “Ministry of Defence: Acquisition and support of defence equipment”, the Public Accounts Committee said:

“The Department needs…to safeguard the interests of British industry after we have left the European Union.”

The Government have been warned time and again that they must protect our defence sector from the economic calamity of leaving the EU, and I urge the Prime Minister and the Ministers who are on the Front Bench tonight to take heed before it is too late.

Yesterday, as a member of the Public Accounts Committee, I co-led an evidence session with witnesses from the Ministry of Defence on the defence equipment plan for the next 10 years. The National Audit Office reports that the plan remains unaffordable, and the MOD itself admits that there is a black hole of between £7 billion and £14.8 billion black in its budget. Why is that affected by Brexit? We have established that, even under the Prime Minister’s deal, the UK will be worse off than it is with the current arrangements, and the Government themselves accept that. Almost every economic commentator who has produced anything of note also recognises that the public finances of UK plc will be in a much worse state beyond Brexit than they are at present. So given that the MOD is already struggling to realise its ambitions with the current budget, how will it cope with another blow to the economy when we leave the EU, especially under a no-deal scenario, and that is even before we start going anywhere near possible negative currency implications? With question marks already hanging over where the axe will fall in the equipment plan to bring it into balance, the Brexit situation puts at risk our defence capability.

Much has been said about our fishing industry, but what has been missing most in those discussions is a focus on securing our waters post Brexit. In particular, the north Atlantic is of key strategic importance, not only to safeguard fisheries and our oil and gas reserves and renewables, but to protect us from external threats. The MOD currently has a total of 19 Royal Navy escort ships, which is an historical low, while there are three Type 26 frigates on order at BAE Systems in the Clyde. That gives us nowhere near enough vessels to adequately protect our waters.

Another area of huge importance in defence is research and development. As a member of the EU, we currently benefit from numerous opportunities for collaborative research with our European partners through bodies such as the European Defence Agency. I recognise that it is possible for non-EU countries to participate in EDA projects, and I urge the UK Government to ensure provision is made to retain as much access as possible to these and to other defence funds as they become available.

One such project is Operation Atalanta, the highly successful EU-led anti-piracy operation off the horn of Africa in which the UK has played a leading role. At the height of Somali piracy in 2011, 736 hostages and 32 ships were being held by pirates. By April 2017, that number had fallen to zero. This demonstrates the value of joint EU efforts to tackle global security threats, and we must continue to be a part of those efforts.

The Galileo satellite system is another collaborative project that the UK is at risk of being excluded from as a result of Brexit. While the Government have put forward proposals for continued participation in Galileo as part of the wider security relationship, there is no guarantee they will be accepted.

With the Prime Minister putting forward the prospect of either this deal or no deal, Brexit will leave the UK exposed to a multitude of threats to our defence and security industry. In a recent article, Malcolm Chalmers, deputy director-general of the Royal United Services Institute, suggested:

“In security terms, the full benefits of membership—combining both shared decision-making and operational effectiveness—cannot be replicated under the proposed deal.”

He goes on to say:

“If the UK were to leave the EU without a deal, it would have severe and immediate consequences for the UK’s ability to combat crime and terrorism.”

On a recent visit to Culross, Torryburn and St Margaret’s primary schools, I discussed Brexit at length with the 12 and 13-year-olds there. It is perhaps a cruel irony that the EU came about through the end of two world wars that took many lives, yet that is the kind of legacy we are about to leave our children, and probably the saddest part of Brexit is the fact that we are ignoring the peace dividend we have had for the last several decades.

I see that the Prime Minister is in Glasgow today talking about Brexit and exports. Does the Secretary of State recognise the disruption and delays that are expected at UK ports as a result of the withdrawal agreement, which necessitates the development of Scottish ports as an alternative route for Scottish exporters? If he is pledging support for the Prime Minister for a poor deal for Scotland, will he also support the Rosyth-Zeebrugge ferry, which would help our exporters to get their goods to market?

I would certainly be happy to discuss the specific issue of the Rosyth-Zeebrugge ferry with the hon. Gentleman, but if he and his colleagues do not want to see disruption at ports and elsewhere, they should not, on 11 December, be voting for a no-deal Brexit.

I recognise my right hon. Friend’s concerns, and reassure her that we have been protecting police funding since 2015. We have enabled police forces further to increase funding through the council tax precept. This year, including council tax, there is an additional £460 million available to the police. However, I recognise the issue that my right hon. Friend has raised, and we will continue to ensure that the police have the resources they need to cut crime and keep our communities safe. There is also a role for chief constables and police and crime commissioners—as operational leaders and elected local representatives—to decide how best to deploy resources in order to manage and respond to individual crimes and local crime priorities.

Q3. I know the Prime Minister is visiting Scotland today, and I hear that there is already great dancing in the streets. But like most Scots, I have been horrified by the arrogant, shambolic and non-inclusive way in which the Government have gone about the Brexit negotiations over two torturous years. What lessons has the Prime Minister learned so that we can have very simple, more productive and faster negotiations when we decide to dissolve the Act of Union?

The hon. Gentleman will be well aware of the vote that took place in 2014 and the desire of the Scottish people to remain in the United Kingdom. We have been working with the devolved Administrations at every stage throughout the negotiations. Indeed, the Chancellor of the Duchy of Lancaster has been having regular meetings with the devolved Administrations, and officials have also been meeting them, so we have ensured that the voice of the devolved Administrations has been heard in our negotiations.

I am looking at a statement from @ScotTories that said:

“Let me be absolutely clear: As we leave the EU, we need complete control over UK fishing. #NonNegotiatable”.

In a reply to the BBC, one hon. Member was asked whether the final deal would affect how they might vote in the meaningful vote, and they said that it would and that it would be very important. How will the Prime Minister explain the whole Scottish backstab to @ScotTories, because the deal is not about complete control, is it?

Obviously, this question of the fisheries is a matter that my hon. Friend and others have raised previously. Let me reassure him that, during the implementation period we have negotiated, the UK’s share of catch cannot be reduced. This safeguards the livelihoods of our fishing communities and, importantly, also delivers a smooth and orderly Brexit. There is also an obligation in the agreement on both sides to act in good faith throughout that implementation period, and any attempts by the EU to harm the UK fishing industry would obviously breach that obligation. Obviously, in December 2020, we will be negotiating fishing opportunities as a third country—as a fully independent coastal state—deciding who can have access to our waters and on what terms for the first time in more than 40 years.

Q3. The Prime Minister will be aware that in my constituency we are putting the finishing touches to our second aircraft carrier the Prince of Wales, but as we near the end of that contract, more than 400 people in the Rosyth yard are now facing redundancy, with many more job losses in the pipeline. Will she visit my constituency to explain to the Rosyth workforce, face to face, why her Government intend to award a £1 billion shipbuilding contract to yards outwith these islands when we have the skills, talent and infra- structure to deliver right here?

What we are doing through our national shipbuilding strategy is focusing on giving the Royal Navy the ships it needs, while increasing economic growth across the country and investing in a more skilled workforce. We are encouraging a more competitive industry in shipbuilding and growing jobs across the country. The hon. Gentleman may have been referring to the future support ships for the Royal Fleet Auxiliary that are being procured through international competition. Three ships will be built in the fleet solid support programme. They will be subject to international competition to secure the best possible value for money for the UK taxpayer. Through our national shipbuilding strategy, we are ensuring that we develop that shipbuilding capability in the UK, so that we can encourage all UK shipyards with the necessary skills and expertise to continue to engage in that programme.

It is a sad irony that a week after the long-awaited Chilcot report highlighted the worrying extent of group-think in Whitehall and Westminster, a large number of MPs will be traipsing through the Lobby in support of the principle of renewing a deterrent that represents a 20th century solution to the 21st century defence and security problems that we all experience today. Those MPs could include those who believed the UK Government’s claptrap on Iraq. Perhaps nothing has been learned from Chilcot, and those MPs will be doing exactly the same on Trident.

The Defence Committee has recently completed an inquiry into the implications of an increased Russian assertiveness for UK security. In evidence session after evidence session, I struggled to find any real evidence of why I should support the renewal of Trident at a cost of up to £205 billion. In fact, as witness after witness listed the very real 21st century threats faced by the UK and our NATO and EU allies, most, if not all, could be filed under the heading of hybrid warfare, or terrorism.

Closer to home, we see an increase in Russian naval and air activities in our own territory, and the pattern is very similar to that experienced in Ukraine. There is no outright aggression, but a determination to poke, prod, check and test reaction times, which, from the UK perspective, have often been laughably slow. For example, the last time the Russian carrier, Admiral Kuznetsov, took shelter in Scottish waters, it took 24 hours for a frigate to arrive from Portsmouth to escort it from the Moray Firth.

One must realise that, as an independent nation, we could provide the same support to NATO as every other single small European country, such as Denmark, Sweden and so on. It is a shameful neglect of security around Scotland that we have not one single surface vessel to protect our shoreline, and it simply points out that the age of deterrence can be viewed in so many different ways.

That could certainly be the case. I am sure that my hon. Friend is better informed on that point than some members of the Ministry of Defence.

Recently, the Committee visited NATO and discussed the needs of Scotland and the UK. What we heard a lot about from NATO was how we improve and increase our conventional forces, particularly those who could respond to hybrid threats. Indeed, the most prominent commitment that emerged from the Warsaw summit just last week was for a multinational brigade to be placed in the Baltic States and in Poland, which we wholeheartedly supported. What also emerged was this principle of a modern deterrence, which Trident resolutely is not.

The UK focus should be on what we can deliver for our NATO allies, instead of desperately clutching to this vestige of a long-gone superpower status—please, wake up and smell the polonium. We need to do that very quickly. Our NATO allies would rather be focused on the most basic of tasks, protecting our UK territory and that of our neighbourhood. When that Russian carrier was carrying out its activities in the Moray Firth, there were no major surface ships based in Scotland—indeed there was none north of the channel. Trident endangered us by fooling us into thinking that nuclear deterrence is the only sort of deterrence that we need.

The Royal Navy is now reduced to only 17 usable frigates and destroyers. To put that into context, the force that retook the Falklands in 1982 had more than 40 ships. The Falklands is currently without major warship protection for the first time since that conflict and UK anti-piracy and people smuggling operations in the Mediterranean and Caribbean are frequently undertaken by vessels that are simply not fit for task. To put it simply, Trident is eating into our conventional budget, which leads me to the very nub of the argument—every penny spent on Trident means a penny less spent on conventional defence. It is hardly any surprise that Admiral Lord West recently told the Defence Committee that the Navy had effectively run out of money in support of the new Type 26 programme. Therefore, while the entire Successor programme has funds ring-fenced with added generous contingencies, projects such as the Type 26s, due to be built on the Clyde, face delay after delay with a knock-on effect on construction, affecting jobs, skills and the workforce and our capability to defend ourselves.

Finally, this vote tonight puts hundreds of years of shipbuilding on the Clyde at risk because the MOD has skewed every military budget it has to spend, and it is spending that on Trident. More morally repugnant weapons of mass destruction can no longer be tolerated—indeed we must look at using other methods of modern deterrence—and to quote the Prime Minister, they are a “reckless” gamble that the country can ill afford.

My position is clear: I believe that Scotland and the UK are better off in the EU under the reformed arrangement that the Prime Minister has already negotiated.

14. Will the right hon. Gentleman recognise that a recent survey confirmed that the Scottish Government were one of the most trusted Governments in Europe? Does he look forward to the re-election of Nicola Sturgeon and her team so that we can continue being the most trusted Government in Europe, including beyond 23 June?
