Q I want to ask a question similar to that asked by the Minister. Earlier, we were talking about the need to look not just at fuel stations as the only charging point locations. There is an issue of unintended consequences, arising perhaps from a lack of strategy and thinking over the deployment of charging points. Similar to the situation with village shops, in your view, is there a risk if we concentrate, for example, on large retailers, that we could see a further impact on high streets because there would be a disincentive to go there? A follow-up question would be, do you believe that enough work has been done and consideration given to other technologies such as in-road inductive charging as a possible solution to those conundrums?

Edward Woodall: Obviously we do not want further disincentives for people going to high streets. That comes back to the point I made earlier about how we can encourage this more widely. Perhaps we should look at the planning system and the national planning policy framework to ensure that people and planners are thinking about where to put charging points in future. I agree that we do not want to focus too much on one particular area. We should follow where the consumers—the people who have electric vehicles at the moment—are going. They are saying that they want to charge in locations that are convenient for them. It is not necessarily in fuel retailer sites, but in car parks and leisure facilities, on high streets and in other car park areas. That might include village shops and convenience stores.

Teresa Sayers: I support everything that Ed said. It is very much about destination and convenience. When you look at such criteria, a variety of alternatives offer themselves up as being appropriate for the positioning of EV charging points.

Q Mr Woodall, if I understood correctly—I listened very carefully to the answer about business models, because the same question occurred to me—you said you do not wish to be forced, but you would be happy to be paid one way or another to take charging stations. I am not surprised, but you did not mention profit as an incentive to provide this service to consumers. Can you elaborate? Why did you not mention the potential to make a profit out of charging?

Edward Woodall: Obviously there is a benefit to having charging on a site. I suppose I am focusing, in the context of the Bill, on how it will work in retailers’ thinking about investing in something that is developing in the long term.

Q On this insurance issue, there has been quite a lot of speculation about what might happen to the products that the industry offers, which will clearly have to evolve. We were told that again this morning. Is it your estimation that that will affect premiums? One would expect premiums to fall, given the fact that these cars will be safer; many of your claims are related to human error, after all. Is that how you see things developing? However, we are also told that many people who cannot currently drive will now be able to—the infirm, the elderly, some disabled people. In a way, that is the most exciting thing about this development. How would that affect your assessment of premiums?

Ben Howarth: On the first case, I would think of it more in terms of claims costs than actually speculating on what the premiums would be. Obviously, if the number of accidents comes down dramatically, that is going to have a significant impact on the costs that insurers face. Motor insurance is very competitive, and it is inevitable that, if we see a significant reduction in costs, we will see a significant reduction in the premiums charged. So I think we can be pretty confident of that. As far as we know, it is still four or five years before these products will come to market.

Looking ahead to the cars you are referring to, where, say, there is a severely disabled person who possibly cannot drive at all at the moment, we are probably thinking about a level 5 car that can go from A to B in fully autonomous mode. It is fair to say that this legislation is primarily aimed at cars that will be manual for some of the time, automated for the rest: more of a level 4 car. Once you get to level 5, that is probably the point at which the insurance system is going to have to change more significantly.

Where the Bill is really helpful is that it allows us to learn from the first developments, get an insurance function in place and see that that system works. It is probable that we are going to have to evolve further once we get to a fully automated car. David Williams, who was one of your witnesses this morning, is one of the insurers involved in trials of fully automated technology. There is a significant degree of interest from insurers in the next generation of technology as well; but it is probably fair to say that this Bill is more around a level 4 car. I prefer to think of it as a binary distinction between automated and not-automated. I am not completely convinced about the levels and how useful they will be for consumers. It is probably fair to say that we think of it as level 4.

Q Public confidence in autonomous vehicles will be critical in terms of how quickly we can take advantage of some of the benefits that are portrayed by the industry. Given that the technology largely exists, do you feel that the Bill is going to go far enough to encourage the uptake of autonomous vehicles? I am specifically interested in whether you feel that the connectivity will allow a truly UK-wide uptake and also in rural areas, given that, as we have heard previously about electric vehicles, range and the ability to get to the destination is one of the limiting factors.

Iain Forbes: The point about confidence is really important. Trust in the technology is going to be a vital factor in seeing some of the benefits we are talking about. It is part of the reason that the Government are investing with industry in demonstration projects, which will involve members of the public trying the technology, understanding what it might mean for them and helping the developers to learn from that in terms of their public messaging and how they take the technology forward.

With regard to connectivity, what is interesting is that different developers are following different development paths for the technology, some of which rely on connectivity and some for which do not. So, from a Government perspective, it is difficult to say exactly what the final technological solution will look like. Some time is needed to work that through, but we are actively trialling this technology with the industrial players to understand, from a Government perspective, what action we need to take to make sure we are prepared for it.

Q Just to press that point about the end-to-end availability, is enough being done to ensure that you get truly wide coverage to allow people from outlying areas to get out and back again in the new technology?

Iain Forbes: It is an important bit of work that will need to be done as we develop out the technology. We are investing in connected vehicle test-beds to understand what the requirement is, and certainly one aim of that work is to try to understand how it can benefit everyone, not just people in cities.

Q I would like to turn to clause 4, which relates to accidents resulting from unauthorised alterations or failure to update software. Hopefully, you have had a chance to look at this section of the Bill. It is all couched in terms of the operating system—interference with and failure to update the operating system. I am concerned that there are other aspects of software in a car that are relevant. Are you satisfied that the Bill is in the right shape, referring to the operating system, or would you prefer to see some other definition, in which case, what?

Iain Forbes: I guess it is my team that has been looking at the Bill, so I will ask Mr Howarth to comment first.

Ben Howarth: From our perspective, my initial reading of it was that it covered what we thought it was, and I am thinking it is the technology. I have to say, I am not a software expert, so if the wording could be clearer—the clause basically says you are not liable if a stupid individual mucks around with the car’s systems and does things that the manufacturer would not permit.

Q The other question I was going to ask reflects the point made by the hon. Member for Birmingham, Northfield about the post-Brexit deal on travel. We have been a leading player—one might say a trailblazer—in terms of providing protection for holiday makers, haven’t we? Post-Brexit, it is really important that we retain consumer protection across Europe. What are your views on that?

Richard Moriarty: I completely share that objective. To go back to the point that John made, I think there is a job to be done by the CAA, ABTA and other groups on raising awareness with UK consumers about the level of protection that they get from different types of products. You can imagine a future where we are in a less binary world in package travel than whether something is ATOL-protected or not. There will be a graduation of protections that consumers can get. It is important that we work with consumer bodies to raise the level of awareness.

We start from a solid and good basis. The scores for levels of awareness of ATOL, which is often seen as the gold standard, are about 75% or 80%, so we start in a good position for that work.

Q Some UK operators have stated that they feel that passenger rights go too far. Which passenger rights do you feel are most contentious in the industry?

Richard Moriarty: A number of airlines have expressed concern not about the principle of compensating consumers for delays, but about the tariff—the amount that is charged. It is important to get the balance right. It was not so long ago that airlines did not take the issue at all seriously. We saw long delays and a lot of consumer detriment as a result. I hear from a lot of chief execs of airlines that although they would wish for a lower tariff, because it is clearly straight off their bottom line, this is not front and centre of their urgent priorities. I do not know whether John would take a different view.

John de Vial: I think that our members would agree. If you look at the package travel directive—that particular piece of work has been updated to allow for a new directive—there is broad industry support for it. I do not think there are any great concerns about it. The EU regulation 261 regime on denied boarding and flight delays is a different issue. A much smaller number of airlines have concerns about the denied boarding piece, but the concerns are principally around the delay regime whereby, through the European Court of Justice process, the same sort of tariff for delays has been adopted as existed and was intended for denied boarding. That is viewed as a rather blunt and sometimes counter-productive regime. The loudest voices are heard around that and there is considerable merit in it being revisited.

On Richard’s point, it is about the level and proportionality of the tariff, where compensation for a few hours’ delay can be a multiple of the purchase of a low-cost ticket. That is seen to be an injustice—it is not the principle of providing the protection, but the way in which it operates.

Q I would like to come to NATS, which I understand expressed concern about economic uncertainty and market volatility following the Brexit vote. It thought that air travel demand and, therefore, its revenues might suffer. Has there been any evidence of that to date?

Richard Moriarty: Not that I can tell from the financial numbers that I look at. Indeed, in terms of the assumptions that we made with it for the last regulatory settlement, traffic has been better than we predicted.

Q I am interested in how we take further action to tackle reckless behaviour. You have said that, because of the previous legislation, it has been very difficult to get the numbers of offences that are actually being committed, but I imagine that, even if anecdotally, there is some evidence of serial offending in these cases of shining lasers at vehicles. Given that is the case, do you feel that there should be consideration within the work we are doing here on the Bill of future repeat offending to have further punishment?

Simon Bray: This legislation will allow the courts to do that in any event. It is an offence triable either way, which can be dealt with with summary powers and at a higher level, potentially, with short terms of imprisonment and so on. The fact that it will be a recordable offence means that we will be able, or required, to record all instances of it, which will give us a greater level of data about patterns and intelligence on where these happenings are taking place.

Martin Drake: The magistrates or judges can be informed by the Ministry of Justice and by the Crown Prosecution Service, which brings these prosecutions, of whether the offender has been prosecuted successfully before and, if they have, whether the case can be heard in the magistrates court or whether it is so serious that it needs to be pushed up to the Crown court. That can be done, given the span of punishments for somebody found guilty of that offence. Of course, there is also the question of the circumstances in which it occurred. If someone was using a laser slightly mischievously, that might be considered a lower offence, whereas if someone was doing that absolutely maliciously, it might be seen as a higher-level offence. The venue for the trial can be decided at the pre-trial hearing.

Q I want to pick up remarks that I made on Second Reading about the seriousness of the offence. As the Bill is framed, it is an offence only if the person shines or directs a laser beam at a vehicle that is in the course of a journey. As police officers, do you have adequate powers if a person is assaulted with a laser when not in a vehicle? You are nodding.

Richard Goodwin: If we are talking about retinal damage, we are talking about grievous bodily harm.

Q I want to explore some issues of public confidence in the potential uptake of autonomous vehicles and get your views on whether the Bill goes far enough to set the scene. Given that the technology is available, what measures are required to make the public accept it and want to take it up? We have heard about the confusion and resistance, perhaps, because of the different approach to electric vehicles, but what do you think is required for the future in the Bill?

Steve Gooding: First, the Government are right to focus on the insurance angle, because that strikes me and the foundation as the first thing that needs sorting for all the reasons that the Committee is thinking about. Following that, what will affect the public’s willingness to accept the technology is their sense that it is genuinely safe. It is understandable that the Bill is silent on such things as construction and use standards, because they will need to be negotiated in an international forum. That is definitely something—the Minister knows we have flagged this up—to get on with thinking about. How you move away from a construction and use safety regulation system that is very much based on traditional mechanical engineering to one that is based far more closely on one that we apply to human drivers, because we are dealing with artificial intelligence, needs a bit of a boost.

David Williams: I think that we need to be vocal about the capability of the technology. We often quote statistics: for instance, automated emergency braking systems reduce accidents by 15% and injuries by 18%, so even if they do not avoid the accident completely, they slow the vehicle faster than a human would and reduce injuries. That is one small component of what will be the driverless cars of the future.

We need to show people the testing regime that these vehicles will undergo before they are let loose on the road, but it is natural to expect some nervousness and resistance. I do not know if any of you have seen the trailer for the new “Fast and Furious” movie, “The Fate of the Furious”, where robot cars get taken over. That will not help and, therefore, we need to be particularly vocal about the positive benefits. I fundamentally believe that we will see fewer deaths on the roads and much safer roads and, therefore, we need to do whatever we can to encourage adoption.

There is also a massively positive business case in the haulage industry for the adoption of connected and autonomous vehicles. I think we may see more rapid adoption in the commercial vehicle space. People will then get used to being around autonomous vehicles, even if they are commercial vehicles and that will make the adoption at a personal level easier.

Denis Naberezhnykh: I would add that some excellent work is happening in the UK now. A project called MOVE-UK compares and contrasts the different styles of vehicle automation and how an autonomous vehicle would perform in the same situation that a human driver performs in. That kind of comparison and learning will enable those automated vehicles and semi-autonomous functionalities to be as palatable to users as possible, so that there is the least amount of discomfort or worrying about the functionality when they try those vehicles out for the first time. It will be the first early adopters—early users—who will form an opinion and then spread the word about whether it works or whether they feel comfortable or not. Getting that right is important and some great work is already happening in the UK to try to do that.

David Wong: I have four brief points on increasing acceptance. One is on messaging. In addition to what Steve has just mentioned about showing the public that the technology is genuinely safe, we have to be very careful, particularly with regard to the Bill, with public messaging in relation to insurance, to assure the public that this will not result in a hike in insurance. The public will rightly expect that the lowering of risks and fewer accidents will mean that insurance premiums should come down.

The second point is about convincing the public through public demonstration projects. We are pleased that the Government are backing a number of these collaborative R and D and demonstration in live trial projects. We would like to see some of the learning coming out of these projects on how the public might interact with autonomous vehicles.

Thirdly, on public demonstration projects, going forward, perhaps the consumer can pay, not unlike the very successful Go Ultra Low campaign for ultra low emission vehicles. It may be useful for connected autonomous vehicles at the right point in time, and particularly at the point when vehicle manufacturers are ready to deploy these vehicles on UK roads.

Lastly, we think as an industry that the gradual escalation of the levels of automation can perhaps help Joe Public to be more comfortable with the technology, as opposed to asking Joe Public to jump straight into a vehicle with no steering wheel from day one.

Q Very briefly, in terms of public confidence and liability issues, you mentioned safety. Do you feel the Bill should address public confidence in the maintenance of vehicles? How will that be conducted across the different standards?

Steve Gooding: We need the construction of new standards for whether a vehicle is judged road-worthy in the first place, to the subsequent—as we call it—MOT system, which continues to verify over time that that road-worthiness is being maintained. We need both systems to cope with the new technology.

Q I am conscious that cars can be converted to use LPG if they are petrol. It seems to me that potentially they could be converted to use hydrogen, as well. Mr Wong, is that something that the industry has considered?

David Wong: It is certainly in the mix. Cars today are being retrofitted as dual fuel vehicles, so, hydrogen in an internal combustion engine. For example, a company in the north-west called ULEMCo is doing that with a good degree of success. It is important to look at the outcome from such a conversion. Will it help to achieve the targets? Will it be below 75 grams of carbon dioxide per kilometre? The jury is still out on that, to be honest. We need to see whether technologies can help over a period of time to decarbonise road transport, not simply the conversion of any sort of technologies or even the hybridisation of any of these fuels.

Q I wanted to cover the issues of liability a little bit further, but I suspect we are going to run out of time before I can get an answer to those—in particular situations where there might be, for example, someone who is incapacitated in the vehicle. If they are incapacitated because of ill health, or for other reasons such as alcohol consumption, where would the liability sit, with such issues? Does the legislation need to go into more detail about some of those other causes? You mentioned the maintenance regime earlier.

Robert Evans: I am happy to make a start. The first thing to say is that the UK Electric Vehicle Supply Equipment Association and the industry support the progress of the Bill and believe that it is an appropriate set of powers for the Government to seek. As the industry views it, the Bill effectively says that the deployment of electric vehicle infrastructure into the market is progressing. The market is working, and it is likely to deliver the solutions for motorists to access those charge points easily, and for those charge points to become a sustainable asset on which businesses can be built. What the Bill recognises is that there is a stage by which the Government will step away from some of the seeding activities that they have done, in terms of creating different schemes such as Plugged-in Places, national infrastructure programmes and funding that it has put in, and let the market progress.

The Bill gives the Government an insurance policy, which is that they can act if the market does not deliver in any particular important aspect that starts to stall the uptake of electric vehicles. The view is that the market is progressing well, and these are reserve powers that the Government might wish to take later. Therein will lie the detail about what the particular nub of a problem might be on which the Government will need to intervene. At the moment we have 11,000 charge points in the UK; we have a lot of private sector finance investment interested in investing in the commercial operation of charge point networks and the further deployment of charge points. That is to be commended. At this stage the Government just need to have this insurance policy in the Bill so that they can act should they need to, but they should expect that the market will deliver.

Quentin Willson: The critical thing is the availability of rapid chargers. Rapid chargers are the game changer. You can charge your car within 30 minutes to 80% of its battery life. Therefore, you can do multiple charges in a day, bringing the feasible range from this notional 130 miles for a Nissan LEAF to as much as 300 miles. I did a journey from Birmingham to Milton Keynes and back, charged twice at a rapid charger and arrived at Milton Keynes with 90 miles still on my battery range. So the Bill must make sure that these rapid chargers are rolled out much more and we see many more at motorway service stations and at key points within cities, because they will enable people to believe that their range is much wider than they are led to believe.

Q I have a follow-up question on the infrastructure for charging points. Does more consideration need to be given in the Bill to connecting with different modes of transport—an intermodal approach? Or is it sufficient just to say, “There shall be charging points”?

Quentin Willson: What do you mean by “different modes of transport”?

For example, electric vehicles being able to connect with hubs at airports, railways, ports and so forth. Is enough thought being given to how the network will develop?

Quentin Willson: We need some intelligence on where these peak points are likely to be. It needs to be spread as widely as possible. Ultimately, the superordinate goal is wireless charging in the roads and as you park. The Bill needs to be aware of that as well. That is a technology that would revolutionise the whole EV market, but it is still some time away. There needs to be a charger in as many places as possible where there is public access—supermarkets, schools, businesses—especially in rural areas.

Marcus Stewart: The evidence we submitted focused on the impact on the electricity system, in terms of capacity and the role of smart charging, and rapid chargers help in that because they help people charge away from peak times. If you have rapid chargers at motorway service stations or supermarkets, where people can charge during the day, rather than charging in the evening at home, that smooths out the impact of the demand for energy. It makes for much more efficient usage of the energy system that we already have and allows us to accommodate more electrical vehicles.

Robert Evans: Charging at train stations is a very good idea, because the vehicle is parked there and they can start to be used for managed charging applications—vehicle to grid and the like. That is a very positive trend. There has been national infrastructure funding for railway stations, and that is an appropriate use. With airports, it depends. For long duration, if you are parked for two weeks while away on holiday, it is less of an issue. The rapid charger becomes a more useful item when you pick up your car, quickly fill with electricity and then move on. So more charge points in motorway service areas is definitely a good thing, and more dwell points that aid intermodal transport, so you take your electric vehicle and get on the train, for example, rather than adding to congestion in a city centre.

Q I want to ask about the effect of demand on the grid. You dealt with it after I signalled my intention to ask the question, but further to that, does the industry need to think a bit about how it could incentivise people charging at different points? There is a history of this, with Economy 7 and all kinds of other things. Are there ways in which the industry could respond by encouraging people to charge in the way you describe? On the point about the distribution of infrastructure, what about rural areas? The Bill provides powers for the Government to do more. Have we done enough or could we do more to ensure the spread of infrastructure? It is fine to have these things in supermarkets and at motorway service stations, but that does not really help my constituents in Surfleet Seas End or Gedney Drove End, who are a very long way from either. What do you think?

Quentin Willson: Rural charging is an issue that we should look at very hard, because otherwise we will have a disconnected electric community and there will be the connected and the unconnected. Scotland has been extremely good at this—Scottish Enterprise has financed quite a bit of it. We need to look at these rural areas, decide what the best place is and give a concerted route through rural areas where you have rapid chargers so that those communities can run electric cars with the same benefits as people in conurbations.

Marcus Stewart: Going back to the point about how the energy industry can respond, the industry has experience. I am a system operator, but the supply side can offer different tariffs for charging at different times. That is quite a popular approach. You mentioned Economy 7. I know people who have electric vehicles who use the Economy 7 meter to get a cheaper charge by charging their vehicle at a time when the system is under less stress. There are options like that.

Looking further into the future, when you have many more people using electric vehicles, there will be an opportunity for electric vehicles themselves, through some sort of consolidation, to provide services back to the system to enable balancing—“vehicle to grid” is a term that is used. There could be opportunities for suppliers to offer different tariffs to allow people to participate. There are lots of options there. We would say that the technology in the chargers needs to be smart enough to be able to do that. That allows you to optimise the value of the charging system and the car to the consumer, and also the overall cost to the total energy system. If you can optimise that, the total cost will be lower than it would be if you had effectively unabated charging.

Robert Evans: You raised two points. The first was about rural areas. At this stage, infrastructure follows the deployment of vehicles. The more vehicles there are, the more there is a case to deploy electric vehicle infrastructure to support them. In rural areas, we have a situation where you often have to travel a long distance to get to a petrol station, because there are fewer and fewer in those areas. That is an example of how charging your electric vehicle at home and occasionally using public charging makes an electric vehicle quite a virtuous vehicle to drive.

On your point about incentivisation on the grid management side—smart charging—we have a progression: the benefit of smart and managed charging is that it mitigates investments that the distribution network operator has to make in copper in the ground, for example. We need to work out how the incentives travel from the beneficiary—the reduced investment on the part of the DNO—through tariffs to the EV driver so that the EV driver is effectively part of the smart charging proposition and we do not have a situation where the smart charging proposition occurs without them being involved in the loop.

The Bill that we debate today is important, but our discourse on it focuses on existing, not future, technology. The Scottish National party welcomes the fact that we can support the Vehicle Technology and Aviation Bill in its general direction of travel, but we will suggest some helpful adjustments to its navigation if we feel that a wrong turn is being taken. We will also be ready to give the Minister a push if he looks like he is discharging badly.

If we are to change public perception and fully enjoy the benefits of new technology, we need to talk about how we move people not just physically, but emotionally. The reality is that planning for transport should be about planning for the future of people. Accepting only what we are presented with here and now misses the mark. If we are to make a success of the Bill, it is vital that we seek not only to address the known practicalities of the technology as they are presented today, but to have a vision for the way in which the future of transport can make life better for people. I am talking not just about those in the urban areas and those who are well off, but about those who constantly find themselves as an afterthought, be it through geography, different levels of deprivation, disability or lack of opportunity. The Bill must develop a more rounded and inclusive vision as it progresses through this House.

We welcome the sensible measures in the Bill. We will offer our views on those that need more work or more thought with regard to the future, and we will work constructively to progress the legislation. In return, we hope that our points will receive positive consideration.

Common ground can immediately be established on a number of current issues. I am talking about measures that encourage development of economic opportunities for growth and technology in autonomous and electric vehicle sectors; that simplify insurance processes and measures to keep people safe; that match the Scottish Government’s proposals to phase out all petroleum and diesel-fuelled vehicles by 2050; and that curb the malignant use of laser pens on all vehicles, including aircraft.

As has been intonated, there are many questions to be answered and much to add to the Bill to make progress successful. Let me start with autonomous vehicles. This is a global market that presents significant opportunities. KPMG estimates the value to be around £900 billion by 2025, so maximising advantage means acting with pace, but decisions should include ensuring that there are positive outcomes for people beyond the short-term economic reach. We advocate that there is an imperative to ensure that as many people as possible benefit.

There is the potential for a step change in transport for those with disabilities and those suffering from social exclusion as a result of mobility issues. We would also seek to ensure that, even if they do not live in a city, people are not left out and that those in rural areas are enabled to take part meaningfully. Thoughtful consideration must therefore be given to rural areas for the use of autonomous vehicles, and discussions should take place with organisations that represent disabled people to seek their views on the matter.

The Government must also take action to ensure that they grasp the opportunity to promote training and skills and create well-paid jobs. The employment opportunities within the technology and autonomous vehicles sector are new territory. We must therefore ensure that more people can access those opportunities, especially the still disgracefully untapped resource that is women. If the promised bounty is to be properly realised, work must be done to encourage girls and young women to be central to it.

Back in 2015, the Government provided £19 million to launch four driverless car schemes, based in Milton Keynes, Bristol and London. If further testing is to be undertaken, Scotland must be included in the next round. Similarly, although we welcome the industrial strategy in relation to an autonomous vehicle hub, we would look for co-operation between the UK and Scottish Governments to find suitable sites in Scotland.

Road safety is of paramount concern, as is clarity over responsibilities for insurance claims, and there is much work to be done to provide reassurance and put in place the safeguards required to create public confidence in driverless technology. It would be helpful to consider the needs as they will develop and provide guidance on aspects that may not yet be at the forefront of consideration, such as the possible certification of vehicles without steering wheels or control pedals. The right hon. Member for East Yorkshire (Sir Greg Knight) made an interesting point about responsibility. What will autonomous vehicles mean for drink-driving regulations, for example? In all circumstances, will a sole passenger be considered just that—a passenger—with those responsibilities, or will they be considered to be jointly responsible?

Consideration will need to be given to future support networks. Autonomous vehicles will need specialist test centres, which should be equitably located around the nations of the UK, and people deserve to know how that will work in future. There will of course need to be strong mobile 4G and 5G signals for the technology to operate properly, so yet again we call on the Government to ensure that the next spectrum licensing auction is conducted with a rural-proofing measure, or an “inside out” policy that has been shown to work in other European countries.

Of course, with the guidance systems also will come a huge amount of data. Vehicles will, by virtue of their use, be tracked and records of journeys will be collated. The data can be enormously useful for improving performance, but there is the potential for it to be misused, so what measures will be put in place to protect the rights of our citizens? A right, except in circumstances of investigating an accident or offence, should be given to the public to own the data and actively authorise any non-performance-related use.

On electric vehicles, we welcome the plan to make every car and van zero-emission by 2050, as that now complements the Scottish Government’s plan to phase out all petrol and diesel vehicles by that year. Encouragement for the public to use electric vehicles must now be stepped up. Incentives such as the grants to purchase vehicles, free installation of home charging points, no road tax and no company car tax for pure electric vehicles should be continued while new incentives are developed. At the start of 2015, Scotland had already seen the uptake of more than 200 electric vehicles across our local authorities. The Scottish Government invested more than £11 million to develop the ChargePlace Scotland network of more than 900 publicly available charging bays, and a £2.5 million grant has been offered to each of the 32 community planning partnerships to help them to buy or lease electric vehicles. That is in addition to the £13 million provided over the past five years to support bus operators to bring in new low-emission buses. Those are great incentives and, as I have said, more can and should be done to encourage further uptake.

Of course there are other zero-emission technologies. Hydrogen is of growing interest in the field, so I was glad to hear the Secretary of State say earlier that there would be encouragement to support alternative fuels such as hydrogen. Scotland already has the Aberdeen Hydrogen Bus Project—the Scottish Government are a key funder—and now Aberdeen has Europe’s largest fleet of hydrogen-powered buses on two routes within the city.

On civil aviation and ATOL, although we welcome the extension of the ATOL agreement, there is a pressing need for the Government to start addressing the questions posed over the UK’s leaving the EU. Will the Secretary of State now give an assurance that the EU package travel directive will be continued? There are similar concerns over passenger rights and compensation, and no word as yet from the Government about whether they will be maintained. I am happy to allow the Secretary of State to intervene if he wants to make comment. No?

UK travellers currently benefit from a huge range of protections. The collapse of Lowcostholidays last summer made the value of the EU package travel directive crystal clear. Given that 76% of UK holidays abroad are outbound to the EU, what will the Government do to guarantee that they will not cave in to the lobbying demands of companies such as Thomas Cook, which said that rights had “gone too far” in favouring passengers?

On vehicle testing, we will be seeking assurances over safety in future operations of DVSA functions. We have concerns over the relentless way in which the UK Government have sought to divest publicly owned and managed facilities. It is clearly an ideological approach, but public safety must be paramount and guarantees are needed that examiners will be regulated and must adhere to procedures at least as strict as those already in use. Will the Secretary of State commit to that?

We welcome clause 22, which makes it an offence to shine a laser beam at any vehicle to dazzle or distract the driver or operator. Laser pen incidents are on the increase. In Scotland, there have been more than 150 incidents in the past 18 months, and 24 at Glasgow airport in February alone. The Scottish National party and the Scottish Government take very seriously any actions that could endanger aircraft, crew and passengers. We strongly support the Civil Aviation Authority’s efforts to publicise the dangers, and Police Scotland’s efforts to prosecute those who maliciously threaten lives in this way. Shining lasers at pilots or drivers could prove fatal, and these moves give clarity over the offence and should greatly improve safety.

While talking about road safety, I urge the UK Government to follow the example of the Scottish Government by taking the opportunity to lower the drink-drive limits. In December 2014, Scotland introduced a blood alcohol limit of 50 mg per 100 ml—lower than the 80 mg per 100 ml in the rest of the UK—resulting in a 7.6% reduction in drink-driving in 2015 compared with the previous year.

In conclusion, we welcome the aims of the Bill, and will work constructively to ensure that it is strengthened and improved. We seek assurances that communities at the periphery in both geography and opportunity are included, that the benefits of the technological advances in vehicles and fuels are shared fairly among all our citizens, and that positive outcomes for all communities are the Government’s first consideration. We want to see clarity and vision in the regulation and public safety issues arising from new vehicles, to give the public the confidence to embrace this step change in transport.

We must now, finally, also have answers to the questions on what happens to the rights of our citizens travelling in Europe following the triggering of article 50. We need a commitment to continuing all of the raft of benefits currently enjoyed by our people.

I am generally supportive of the aims of this Bill, not least as the mother of an 18-year-old son who has just passed his driving test, as insuring him is almost impossible. The cheapest quote we have had so far is £1,700. Autonomous vehicles will offer young people and those who have given up driving—the elderly and the disabled—an opportunity to get into vehicles.

I am excited by the technology surrounding autonomous vehicles because much of it is powered by the photonics industry. It is really quite fortuitous that, only a few months ago, we set up the all-party group on photonics. I am delighted to be standing here as the chair of that group. It is almost as if the timing of this Bill has been set especially for us. Driverless cars are operated by light detection and ranging—LIDAR—technology, which allows for smooth traffic flow and reduced fuel consumption. Ultimately, the technology leads to safer transport.

The UK is perfectly placed to develop this technology. We have a world-leading photonics industry. In particular, I wish to highlight the photonics companies across the central belt of Scotland. I also want to mention a group at Oxford University that is developing a low-cost autonomous navigation system. A robot car will navigate using lasers and cameras linked to a computer. A horizontal laser on the number plate detects obstacles and halts the car to avoid a collision, while a vertical laser casts a curtain of light on the surroundings to make a 3D model of the environment. When the car takes the same route the second time, it recognises where it is and can drive accordingly.

A road train, which is a convoy of closely packed vehicles, might be one of the first applications of driverless cars. It is likely that it will appear first on motorways. The hon. Member for Wycombe (Mr Baker) raised concerns about his ability to continue to use his motorcycle, but I am sure there will be plenty of roads available that can be used by vehicles operating in a less autonomous fashion. There is certainly a real potential to get traffic moving on our motorways.

We have talked about the possibility of trials and pilots, and my hon. Friend the Member for Glasgow South (Stewart Malcolm McDonald) mentioned the grid system in Glasgow. I will add to that by saying that Glasgow is a perfect urban setting in which to hold a trial.

In Scotland, we have some difficult issues to overcome. We have heard about single-track roads, and while I will not talk about nuns and prams, there are often obstacles such as cattle grids and sheep that these cars will have to take into account. The bigger problem for rural Scotland, and for rural areas across the UK, is how these cars will communicate. Driverless cars have to communicate with their surroundings. If, as is the case in some areas, there is not a 3G network available, how will these cars be able to proceed?

I raised the subject of mobile connectivity earlier. Does my hon. Friend agree that it is vital that the UK Government take an outside-in approach with new licensing for the mobile spectrum auctions?

I thank my hon. Friend for his intervention. There is real concern that a lot of the spectrum that has been licensed before has been licensed for the benefit of companies, not consumers, and this is an ongoing problem for many people not just across Scotland, but in rural UK generally.

One of the challenges that we will face as this technology develops is dealing with our massive skills shortage in engineering and photonics. We currently have a huge number of EU nationals working in those fields, but we are yet to see any guarantees for those workers from the Government. We are talking about unilateral guarantees because those highly skilled workers have job prospects worldwide. We should be rolling out the red carpet for them, rather than for a certain President.

I also agree with my hon. Friend the Member for Inverness, Nairn, Badenoch and Strathspey (Drew Hendry) that women are a massive group who are ignored in STEM careers. Someone once asked me why I keep going on about getting more women into STEM careers and whether it is just about gender equality. Yes, gender equality is important, but we also have massive skills shortages and a huge group of people whom we are not tapping into. We need to start taking advantage of that raw potential.

I thank my hon. Friend for that intervention. One of the big challenges we face as a society is the need to look at the signals we give not just to girls who are considering their career options, but to parents. What are we saying to wider society? An engineer is not just somebody who wears an oily overall; an engineer can also be somebody working in the field of photonics and developing driverless technology. We really need to plug that. We need to see female engineers on programmes such as “EastEnders”, and then we might start to see some progress.

The industrial strategy Green Paper that was published a few weeks ago referred to key enabling technologies. If autonomous vehicles are to progress at a pace that keeps us up to date with the rest of the world, we must ensure that we properly support the photonics and engineering industries and ensure that enabling technologies are given proper priority.

Let me move on to low-emission vehicles. We have heard a few comments today about charging points. What will happen to the national grid when we all arrive home in the evening and plug in our electric vehicles? We already know that the national grid has certain peaks, for example during advert breaks in particular programmes. We can look at smart charging technology that will have different cars charging at different points, but we are still talking about a much higher current being drawn from the national grid, and the source of that energy will be power stations. Are we simply switching from dirty fuel in our cars to dirty fuel in our power stations?

Again, I thank my hon. Friend for being so generous in giving way. Is not it true that the use of renewable energy is the way ahead to ensure that we can cope with those loads? UK Government policy, by stifling renewable energy, is hampering a technology that could solve that very problem.

I thank my hon. Friend for that intervention. He has just taken my next point—thanks very much. Once again I will use the phrase “untapped potential”. Renewable energy really is the way ahead. I do not want to get pollution out of our cities only to put it into industrial areas with power stations, whether they are coal, oil, gas or nuclear.

Taxation is an issue for the Budget. Many representations are made by people across this House and across society to the Chancellor of the Exchequer about what he might or might not do in his Budget. I fear that the hon. Lady will have to wait for a short while to see what he has in store for us this year.

To reduce delays at UK airports, EU nationals who arrive in the UK are processed faster due to what is called a “soft border” approach, using special lanes and scanning. Will the Secretary of State confirm that the Government intend to continue those measures after the UK has left the EU?

We will decide the detailed arrangements as the months go by but, as I have said, it is not our intention to create queues at our borders. It will remain the case that people have to show their passports when they arrive in the United Kingdom. There is a warm welcome for people from all around the world who come to the UK as tourists, as visitors or to do business, and there will continue to be so.

Currently EU nationals can use the expensive but effective e-passport gates. Will the Secretary of State confirm that those machines will effectively become redundant? If so, do the Government intend to offer them second hand to our European neighbours at bargain prices to recoup some of the cost?

I am grateful to my right hon. Friend for his comments, and I am absolutely clear that we aim to deliver airport expansion long before 2040. What we have now is a much more streamlined process, set out in statute—it was introduced by Labour and I am grateful for that—for securing the initial consents. If, when we reach the end of this year, the consultation confirms the recommendation that the Government are making and this House does the same, I hope that we will have effectively reached a point of outline planning consent that allows the airport to press on with the detailed preparation work for the construction and the detailed planning consents.

I think that airspace modernisation makes a real difference to communities in the south-east, because it enables us to put planes on much more exact paths. Today, sat-nav technology allows a plane to follow a much more exact route than the traditional beacons did. It enables us to manage approaches to airports, airport descent and ascent rates, and the overall use of airports so that we do not experience stacking around the south-east as we do today. I hope that the second part of the process that I have announced, which I believe is as important to communities throughout the country as the airport expansion, will allow us to ensure that the sector becomes much friendlier to the communities that it affects.

I thank the Minister for giving me advance sight of his statement.

We welcome the decision to go ahead with the expansion of Heathrow and the new runway. After many years of waiting, it is time to get on with delivering that, as well as the specific benefits that it can bring. However, building a new runway is meaningless if we do not have access to the air and the EU-US open skies agreement. Does the Secretary of State intend to seek membership of that arrangement?

The Secretary of State mentioned regional airports, which are vital, and I agree that these connections need to be made. What guarantees will he give to regional airports in Scotland, especially the likes of Dundee and Inverness, about routes and slots following the Heathrow expansion? He also mentioned the need to deal with environmental issues and tackle carbon emissions. What targets will he specify to demonstrate ambition above the legal requirements to which he referred?

We and the Scottish Government do not always agree on everything, but I am grateful to the hon. Gentleman and his party, and to the Administration in Edinburgh, for their support for Heathrow expansion. Indeed, following these exchanges, I shall be heading off to the other side of Scotland—to Glasgow—to talk about the importance of my announcement to the United Kingdom as a whole.

The hon. Gentleman asks about regional airports. Heathrow will be under an obligation to fulfil its promises in respect of regional connectivity. I expect this capacity to open links not only between the United Kingdom and the rest of the world, but from within the United Kingdom to Heathrow and the rest of the world. That is important to airports in Scotland, the north of England, and other parts of the United Kingdom—Northern Ireland, the south-west, and so forth.

The hon. Gentleman asked about the open skies agreement. As I said earlier, that will be a subject for negotiation. We will obviously seek to provide the best possible arrangements for the future but, whatever the arrangements, the fact remains that there were flights to and from European Union capitals long before the European Union even existed, and that will continue after Britain has left the European Union. We will have strong aviation ties around the world. Of course, this expansion is not particularly about European Union links; it will open up ties between the UK and markets around the world, including emerging markets. It will provide Scotland, Wales, Northern Ireland and England with links to markets where there is great potential and opportunity for the future.

Devolution does not just occur within Governments and within Whitehall, and between Whitehall and Scotland. A significant amount of operational devolution is occurring within Network Rail as we speak. A Scottish route within Network Rail that will have much more independence and freedom of action is being set up. I urge the Scottish Government and Scottish Members to engage in that devolution process, not least because the Scottish Government are co-operating with the Office of Rail and Road on the periodic review that will determine the output for control period 6 within Scotland.

A report commissioned by Transport Scotland showed that Network Rail’s original cost estimates for Scottish projects were unreliable. Does the Minister agree that, especially when projects overrun by hundreds of millions of pounds, those who commission the work should have the power to hold Network Rail to account?

I reiterate the point that with the new devolution settlement within Network Rail and the growing independence of the Scottish route within Network Rail, there are ample levers available to Members here and indeed the Scottish Government to influence how the Scottish route director delivers those infrastructure projects.

That is fine. I am happy to speak now, so thank you very much, Mr Walker. It is a pleasure to serve under your chairmanship. I congratulate the right hon. Member for Orkney and Shetland (Mr Carmichael) on securing this important debate. I agree with the praise that he has given to seafarers and to the contribution that they make not only to island communities, but to coastal communities in Scotland and around the UK.

The Minister said that the right hon. Gentleman’s comments struck a chord. I hope some of mine will strike a chord as well, and I hope my questions will be answered, although I must give warning that I have many questions, so perhaps saving them might be the best thing to do. This is about the future of the UK maritime industry, and the right hon. Member for Orkney and Shetland (Mr Carmichael) said it was about leadership. He is right: the future needs a vision and a plan—for employment, fair conditions, business and safety, as well as to attract young people and, especially, correct the lack of young women in the industry.

To begin with employment and fair conditions, I join the right hon. Member for Orkney and Shetland in being delighted that there is now an agreement in principle to end the long-running issue about the freight vessel serving the Northern Isles. The new charter basis will allow the wage issue to be resolved and crew members will be paid the minimum wage. The new arrangements come into effect next month, which is to be welcomed. I shall not go through the details, which he covered.

I thank the hon. Gentleman for raising the important question of the number of women employed in the industry, because there is a significant shortage. The right hon. Member for Orkney and Shetland (Mr Carmichael) raised the matter of vacancies, training and how much more effort could go into bringing more women into the industry. I have seen in the Humber ports a number of women playing an important and valuable role in the portside industry.

I welcome that comment, and will talk some more about such opportunities.

The wage deal that has been struck adds to the CalMac public sector contractor deal that runs in Scotland; it was named the Living Wage Foundation’s Scottish champion in 2016. Let us be straight about it: fair pay and conditions attract people to the industry and we should support that. All seafarers should have the national minimum wage, as my hon. Friend the Member for Glasgow South West (Chris Stephens) mentioned. However, while the RMT and Nautilus International have welcomed the actions in Scotland, they have sounded a code blue over the health of the Maritime and Coastguard Agency in the UK. They say that it is in crisis over current rates of recruitment and retention:

“In the view of the Maritime unions, it is no exaggeration to say that the MCA is in crisis. At current rates of recruitment and retention it will soon reach the stage where maritime safety is compromised because the regulator simply does not have sufficient number of qualified staff to discharge its core statutory duties, particularly vessel safety surveys and inspections.”

They also say that they are

“disappointed that the Government rejected the Transport Select Committee’s recommendation for ‘an independent review of how the Maritime and Coastguard Agency will successfully take on new responsibilities without a proportionate increase in its resources.’.”

I join them in that disappointment over those opportunities.

While I am talking about the MCA, I want to mention that at the moment it has the final say over ship-to-ship transfers in the Moray firth. I hope that the Minister will take on board the strength of feeling of the communities around the coast in my constituency and those of my colleagues about the order for ship-to-ship, and that he will consider that we have many times called—and still do—for power over that to be devolved to the Scottish Parliament.

The UK Government will need to get their act together on employment opportunities. According to their own transport figures—this relates to recruitment—more than half of UK seafarers are over 41 years old. Only 3% are women. Women make up only 28% to 30% of uncertified officers and ratings, and the bulk of those jobs are in catering. Men take up almost 100% of the engineering jobs. Brexit will no doubt pose challenges, but we should also consider that a high number of EU nationals are employed. For example, Polish people alone make up 16% of non-UK holders of certificates of equivalent competency for the UK shipping industry.

Things will not be helped, either, by the approach that is taken to looking after cadets. I was involved in trying to arrange the rescue of cadets from the Hanjin Louisiana, when the ship was moored offshore because the company had gone into administration. Four young cadets from Scotland were trapped on board for well over a month, with supplies scarce and not knowing what was going to happen. They were stuck there with limited communication, through email only. The UK Government were slow to get into action and attempt to look after them.

To move on to the maritime sector plan for business, as the right hon. Member for Orkney and Shetland mentioned, a great deal of the economy is affected by shipping. The hon. Member for Isle of Wight (Mr Turner) mentioned the complexities that we will face in the future. Peter Karlsen of Norbulk Shipping has said:

“The shipping industry in the UK will view the referendum result negatively, as does most business. It is a potential disruption to trade, movement of goods and labour. We are facing years of complex negotiations to divorce ourselves from the EU.”

He continues:

“Whether it remains as attractive to foreign investors or entrepreneurs, especially from the EU, to establish and conduct business here is uncertain.”

A lot needs to be done to put confidence into the UK maritime industry.

Of course, there are questions: what is to be done about freedom of movement, migrant workers, a customs union, and rights to operate in domestic trades of EU members who maintain flag-based cabotage restrictions? Will there be slower turnarounds that affect volume? I could go on and talk about employment law and contract. There are many questions but no answers yet and the clock is ticking. Of course in Scotland our preference is to stay in the single market and maintain a customs union. That is what we should do.

I want to conclude with some points about the MCA and safety. There is a long-running issue in the west of Scotland in particular as to emergency towing vessels. Two are required in the north of Scotland. One should be berthed in Stornaway to cover the west coast, the Northern Isles and, in particular, the Minches. We have had near things with the MV Parida, the oil rig the Transocean Winner famously coming to ground off the coast, and even HMS Astute, a nuclear submarine, running aground off Skye. We need to make sure that action will be taken, and there will not be another six years of ignoring communities and their representatives.

I want to finish with some questions. As to the towing vessels, when will the UK Government stop ignoring the needs of the people who work and live in, and know, the west of Scotland, and the many warning incidents that have been racked up, each edging closer to the possibility of a disaster? What lessons will they learn from the Hanjin Louisiana incident, and will they ensure cadets’ rights under the maritime labour convention the next time such an incident occurs? Would they take action or make representations to shipowners and flag states if there was evidence of seafarers being mistreated, or of the contravention of MLC-ILO measures? What plans do they have to tackle the recruitment and retention problem in the MCA? What initiatives are they taking or have they planned with respect to the incredible age and gender imbalance in UK shipping?

It is a pleasure to serve under your chairmanship, Mr Walker. This has been a very full debate, with many important contributions. I pay particular tribute to the right hon. Member for Orkney and Shetland (Mr Carmichael) for securing the debate. I was going to say that Opposition Members welcome it, but judging by the tone of the debate as a whole, I think it is welcomed right across the House, and I look forward to what the Minister will have to say at the end.

I would like first to give credit where it is due. I very rarely give credit to the Scottish Government, but I will on this occasion. I welcome the announcement by the Scottish Government of changes to the charter agreement for the two Seatruck vessels operating between Aberdeen, Shetland and the Orkneys.

However, I have to be fair: we have heard a lot about maritime companies paying less than the national minimum wage. On Scotland’s only commercial maritime freight link to the continent, the hourly rate paid to Lithuanian seafarers can be as low as £1.64. Justifiably, we get angry when we hear about modern-day slavery on ships in the far east harvesting prawns, but we are prepared to see £1.64 an hour paid within our own waters, so I think that although a great job has been done, there is much more to do.

I am simply pointing out that the company is operating in our waters and that we need collectively to do something about it.

We are an island nation, a net importer, and we are now leaving the European Union. We have the largest port sector in Europe in terms of tonnage handled and, as has been said, we have millions of ferry passengers every year. Our economic, social and security interests will depend more than at any time since the second world war on seafarers and a resilient UK maritime skills base. It is probably worth putting this in context. At the time of the Falklands war in 1982, the UK had a strong merchant naval sector; we employed 58,000 UK seafarers. That figure has now shrunk by almost 60% to 23,000. That is the context in which we are working.

Sub-national minimum wages continue to blight the lives of seafarers working on UK domestic and short sea journeys. I have seen figures alleging that at least eight operators along 11 short sea routes to and from the UK are underpaying more than 800 crew. In my own area, on ships crossing from Newcastle to Amsterdam, DFDS pays its staff £2.93 an hour—less than £3. I took a recent weekend trip to Amsterdam, which I really enjoyed, but quite honestly, if I had known that—well, I feel really uncomfortable about it. As a result of this debate, I will be writing to DFDS and other companies to say that it is simply not acceptable.

At present, passengers and businesses are travelling on Condor Ferries to the Channel Islands on vessels crewed by seafarers earning as little as £2.40 an hour. On freight-only ships, the pay is as low as £1.64 an hour. That is not acceptable. Prior to the national living wage increase for over-24s last April, it was estimated that 8,300 ratings were working the UK shipping industry for rates of pay below the national minimum wage. That was in April last year; the figure is now considerably higher than 8,300. Increasingly, companies are recruiting outside the UK to crew their ships with non-UK seafarers, particularly ratings, in order to profit from these sub-national minimum wage rates.

This is not a new problem. It has to be said that this goes well beyond the current Government. Beyond the simple injustices, we can see the cost of not having acted in the past. This legalised exploitation has systematically undermined maritime jobs in the UK, damaged the skill base and driven up unemployment rates in seafarer communities across the UK. Since 2011 alone, the number of UK ratings has fallen by 25%. If we end the pay exploitation in shipping, we can help to reverse the decline of our merchant navy. This need not be a party political issue, but one of sense, fairness and humanity.

There are three points that I would like the Minister to take forward from this debate. First, he has already committed to review the application of pay legislation across the shipping industry imminently. However, as we have already heard, that has already happened—the Carter review did it—so this is just a case of setting a timeframe and getting it implemented. Secondly, can the Minister give a date for when we can expect publication of updated guidance to HMRC on enforcement of the national minimum wage for seafarers? Thirdly, when will he publish the outcomes of the review of the existing protections in part 5 of the Equality Act 2010 against nationality-based pay discrimination for seafarers? That work was completed in April last year, yet 10 months later it has still not been published.

However, as we have heard, pay is only part of the problem and part of the solution. More than 70% of deck and 74% of engine ratings are now aged over 40. We are heading for a shortfall in trained and skilled seafarers. If we take no action, that will be filled by non-UK staff. The Select Committee on Transport warned over two years ago that the Government needed to act on funding, on approved standards for maritime apprenticeships, on the take-up of apprenticeships in the industry, on setting annual statutory targets for seafarer training and on including the number of trainee ratings in annual seafarer statistics. We would like to know from the Minister when we will get some action on that.

One area of maritime growth where the Government have not dragged their feet is on the recommendations to make the UK shipping register more commercially responsive, in the form of a Government corporation. I would gently point out to the Minister some other areas where this and former Governments have rushed to privatise—the rail industry, the energy industry and the water industry come to mind. Recent attitude polls among the electorate now show that the majority of our constituents—in some cases over 90%—want to see those decisions reversed, because they see formerly Government-owned, privatised industries making massive profits, but customers paying massive bills and getting a poor service. I would gently ask the Minister whether he will properly and carefully consider the costs and benefits of transforming the UK shipping register, fully consider all the options and also promise that this House will be given time to scrutinise those options?

Before closing, I wish to press the Minister on leaving the EU. At the moment we know nothing about the Government’s wider maritime priorities, at a time when we need a clear direction on maritime issues that would inform the Brexit negotiations. How will any changes to the single market affect shipping and seafarers? Will there be customs checks? Will there be tariffs? Is his Department feeding into the Brexit negotiations on these matters? If it is, will he tell us how?

In closing, I hope the Minister can elaborate on his Government’s plans for Brexit, or at least recognise that maritime is an exceptional issue that needs to take precedence. He must also assure the House about the future of the shipping register, along with the timeframe and process for any reforms. Will he outline his priorities for seafarer training and skills, and say whether he will set targets for recruitment? Finally, I look forward to him addressing the key point to come out of this debate about seafarer pay and conditions.

That is absolutely right. It is very straightforward in areas where there is complete synchronisation between the Network Rail routes and the train operators, such as on the west coast main line, which has multiple operators. We also have to be careful to protect the interests of freight operators and open access operators. I am not planning to change the fundamental regulatory structure, but by forging teams together by letting franchises and structuring Network Rail in a way that allows them to integrate, we will be able to deliver better day-to-day performance and a more reliable railway over the vast majority of our network.

The Secretary of State is right to acknowledge the problems with our rail network, but he should not remedy them through further privatisation. There is higher passenger satisfaction and reliability in Scotland than on any other network in the UK, but Scotland could do better. Will he agree to devolve power over Network Rail to the Scottish Parliament?

The hon. Gentleman has just described progress in Scotland, but the point that he has missed is that Scotland is the one place where we have a working alliance of the kind I am talking about. What he is describing is a step on the road to the model that I want to create across the railway, which he says builds passenger satisfaction. That is why this is the right thing to do. It is not about privatisation; it is about teamwork to deliver a better service for the passenger.

It is a pleasure to serve under your chairmanship, Mr Hollobone. I congratulate the hon. Member for Huddersfield (Mr Sheerman) on securing this important debate. My only regret is that we do not have more time to discuss these issues today—obviously that is no fault of anyone here. The hon. Gentleman mentioned the human tragedy and the fact that we must work towards no lives being lost—a zero target. No one would disagree with his comprehensive review of what needs to be undertaken.

The hon. Member for Castle Point (Rebecca Harris) mentioned the importance of eye tests. When people go for an eye test, they get a subsequent reminder. Everyone should get involved so that they can keep their eyesight up to scratch for driving. The hon. Member for Rossendale and Darwen (Jake Berry) spoke about how horses can go into flight and the additional damage that this can cause. These are all important issues, and we all agree that road safety should concern us all, regardless of party colour or of where we live, work and do our business.

The Scottish Government are committed to addressing the public health issue of road traffic accidents, and they go further than the UK Government on measures to curb drink-driving and to promote safe cycling and active transport. The SNP Scottish Government have taken a wide range of actions to reduce traffic accidents in Scotland, including cutting the blood alcohol limit. We welcome figures showing a decrease in road accident injuries in 2015 in Scotland. My hon. Friend the Member for Kilmarnock and Loudoun (Alan Brown) mentioned that in December 2014 the Scottish Government cut the limit from 80 mg per 100 ml to 50 mg per 100 ml, which is lower than the rest of the UK. There has been a reduction in drink-driving compared with the previous year. England, Wales and Northern Ireland still have the 80 mg limit, which is the joint highest in Europe. We are disappointed that the UK Government are not following suit. I look forward to hearing how the Minister will proceed.

My hon. Friend and the hon. Member for Portsmouth South (Mrs Drummond) mentioned mobile phone use at the wheel. The SNP has backed the UK Government in doubling fines for drivers who use mobiles while driving, and we call on the UK Government to take further action to prevent accidents. We welcome figures in Scotland showing a decrease in road accident injuries in 2015. More than £250 million is spent annually in Scotland on the maintenance and safe operation of the trunk road network. In 2014, road death figures were 31% lower than the 2004 to 2008 baseline, but, as the hon. Member for Huddersfield said, we know that one fatality is too many. We are pleased that casualties in Scotland have fallen to their lowest number since records began. Car casualties fell by 1.1%, pedestrian casualties by 3.4%, motorcycle casualties by 11.4% and cyclist casualties by 11.1%.

We are investing in public and sustainable transport, because we know that it can be effective in reducing road traffic accidents. As the hon. Member for Portsmouth South mentioned, it is an important subject. On 2 November 2016, the Scottish Transport Minister, Humza Yousaf, announced plans for a cycling taskforce whose main aim will be to drive forward ambitious cycling infrastructure, such as segregated cycle paths and Community Links Plus. By the end of this financial year, the Scottish Government will have spent more than £8.2 billion to improve safety on Scotland’s motorway and trunk road network, including the £3 billion upgrade of the notorious A9 in my constituency to dual carriageway status. Safety cameras, which have been deployed for the past couple of years, have reduced deaths and serious accidents dramatically from previous figures. There are lessons to be learned, and I hope that the Minister will take that into account.

Finally, on safety, many people are unaware that they are committing an offence by driving with expired MOT certificates. There is currently no automatic reminder for MOTs like the one for tax discs, for example. As a result, people drive vehicles that they may be unaware are unsafe, and they may also be committing a road traffic offence. The onus should always be on them, but I am pleased to see that an idea I put to the motor insurance industry has been picked up by Aviva insurance, which I am told will issue reminders about MOT expiry dates to its customers as of next year.

My main concern in relation to this debate is with regard to ports services regulation. It is a perfect example of where the European Union has gone completely wrong, and of why, in this particular sector, it is vital that we leave the European Union. I will give a number of reasons for that, which are drawn from those who have the most knowledge of these matters, including those who are referenced in the latest Library briefing.

As has been said by the Major Ports Group, many of the issues that confront UK ports are affected by policy and legislation from the European Commission and the European Parliament. The European Parliament is about to hold a plenary session and, for present purposes, it is assumed that the regulation will go through. It will then go to the Council of Ministers, which is governed by qualified majority voting.

The European Scrutiny Committee and I have been following this for several years, and I will come on to the timetable and my concerns about the failure to have a proper debate on the Floor of the House on this issue exclusively. The port employers say:

“While UK ports receive virtually no financial assistance from the public purse, the situation is very different in most continental ports.”

That is hugely important. We are an island. We have 47 ports. They are incredibly important, and I accept, of course, that the Opposition spokesman, the hon. Member for Middlesbrough (Andy McDonald), has made clear his concern, but it does not alter the basic point: we cannot resolve the question of the port services regulation because of the qualified majority voting system. Even if we vote against it, we cannot stop it. That is the problem, and it is why I had to ask the hon. Gentleman twice about this. I will give a description in a few moments. I understand that that the Opposition have accepted the outcome of the referendum.

As the hon. Gentleman suggests, the Opposition in Scotland do not accept it, but there are reports in Scotland that many people there will be affected by the outcome of the regulation, so I shall continue. We are an island nation, but this is not just romantic blurb about this sceptred isle and the fact that we are surrounded by a silver sea; this is about whether we in this country can have an efficient port sector. As we are an island, we are heavily dependent on the ports as goods go in and out of them.

We have heard from the Secretary of State for Transport that we should have confidence; he has reassured us that we should have optimism, but, of course, we have heard no details.

The impact of Brexit on the different modes of transport—aviation, maritime and road haulage—will be immense, but its main effect will be on all the people in our communities, with rising costs for goods and mobility. There are also those who want to do business with us or to visit us as tourists. It is wrong for Ministers not to have a full explanation of how exiting the EU will impact on businesses, consumers and passengers.

Nobody doubts that we are facing stormy seas, yet instead of a plan we are told by the Foreign Secretary that Brexit will be titanic. That is scary enough, but time after time, in terms of plans and answers, we find it is just an empty vessel. The Government’s model is less a ship of state and more like the Mary Celeste. So let us see the Brexit rhetoric cast overboard, and let us hear some definitive answers.

People will be affected; they and our businesses deserve to know what the plan is. This failure to provide a plan is simply a plan for failure. People face additional journeys for connections, more expensive tickets, fewer rights to challenge delays and cancellations, additional insurance costs and long queues at border controls. When they call home, their calls could cost more because they will not have mobile phone roaming protection.

The Chancellor said today that he wanted the UK to be the No. 1 destination for business. Well, how are people going to get here? Let us start with aviation. Leaving the EU could restrict operations by UK airlines in Europe, and by EU airlines in the UK, leaving our constituents and visitors to the UK paying the price for Brexit through higher fares. Analysis from the independent Oxera economists states that such restrictions could lead to UK passengers’ airfares rising by 15% to 30%.

As an MP from the highlands, and as chair of the regional airports all-party parliamentary group, I am also extremely concerned about the increased cost pressure on regional airports. These airports have thrived with the increase in low-cost airlines, and the advent of cheap short-haul flights across Europe owes a large part of its success to the EU. As easyJet said:

“the single aviation area gives airlines freedom to fly across Europe and since its introduction passengers have seen fares fall by around 40 per cent”.

Without that agreement, fares will inevitably be higher.

Earlier this week, I met the proprietor of AirAsia, who has built an extraordinarily successful low-cost airline across south-east Asia. Countries there are not in a European Union-type institution. Can the hon. Gentleman explain to me and to the House why it is not possible to have a low-cost aviation set-up in Europe with us outside the European Union, but it is possible to have such a set-up in a part of the world where there is no such body as the European Union?

Let me answer that by giving the right hon. Gentleman the words of easyJet itself. EasyJet is currently registered in the UK and can fly largely without restriction from the UK to other member states—France and Germany, for example—and wholly, in terms of the domestic market, within countries such as Italy. EasyJet is now setting up a separate operation outwith the UK to ensure that it can continue to fly without restrictions after the UK leaves the EU. As its chief executive officer, Carolyn McCall, said, current EU flying rights might have to be renegotiated, and the new company will ensure easyJet can operate within the EU. She added:

“We are not saying there will be no agreement. We just don’t know the shape or form. We don’t have the luxury of waiting. But we have to take control of our own future.”

That is in no small part due to the lack of clarity from the UK Government over what aviation agreement the UK will eventually come up with. The Secretary of State and his colleague the Secretary of State for Exiting the European Union have said:

“Market access remains a top priority, and we want to make sure we have liberal access to European aviation markets.”

Strikingly, however, there was no guarantee that the UK would stay within the open skies agreement. The UK Government need to explain to us now how this is going to work. When open skies was agreed back in 2008, the UK market was one of the key attractions for the United States. At the time, the UK accounted for a 40% share of the EU-US market. If the agreement ceases to apply, as was mentioned earlier, will the UK have to revert to the Bermuda II bilateral agreement, signed in 1946 and last amended in 1991?

I am happy to allow the Secretary of State to intervene on that point if he wishes to do so, but obviously he does not.

The aviation market has changed considerably since the days of the Bermuda II agreement, and any reversion could cause disruption to UK airlines and transatlantic trade and passenger routes. If this is not the case, then what is the plan?

The implication of new border controls is negative in both ways. Ease of travel within the EU is attractive to our constituents and to those visiting the UK. Undoubtedly, passport checks and processing times for visitors from the EU will impact on our attractiveness to visitors. The fact that EU visitors will need to enter the UK through the non-EEA lines will require Border Force to commit significantly more resources at airports. Even with extra staff, queuing times for European visitors will still almost double to about 45 minutes. Those of us representing constituencies with a significant tourism economy find this extremely concerning.

Staying slightly on that topic, will my hon. Friend urge the Transport Secretary to engage with the US Government, who are currently considering Edinburgh airport for pre-clearance travel to the United States, as a positive way of showing the world that we are indeed open for business?

I thank my hon. Friend for his intervention; he has made his point and I will not follow it up any further.

One can imagine, under the future provisions, being a tourist from Europe, especially in the short break market, with the choice of going to the UK or somewhere else where there is a lot less hassle—somewhere more welcoming. Additional space will need to be allocated to immigration control operations in airports and other ports of entry. It is thought that the costs could spiral into tens of millions of pounds. This cost must be borne by airports and port operators, who then cannot invest that money in increased connectivity and improving the passenger experience. According to the Tourism Industry Council, if the 23 million EU nationals who visited in 2015 were to be subject to full border checks, Border Force would be required to increase resources allocated to this by 200%—on top of the problems that already exist. Manchester Airports Group says:

“Border Force provision at a number of airports is already inadequate, with a lack of long term planning meaning queue times for passengers can already be unacceptably long.”

So what is the plan?

Before the hon. Gentleman gets into the detail of the hypotheticals of border controls, does he accept that the single largest threat to ordinary travellers in the United Kingdom, and across the entirety of Europe, is none of the things he has mentioned but the package travel directive about to be introduced by the EU, which will put additional costs on every single traveller because they perhaps use sites like Expedia?

The hon. Gentleman makes a good point. So many issues are facing us that it is very difficult to pick out the single most important item. There are a lot of unanswered questions.

Is the plan to reach an agreement with the EU that the EEA channel will continue to operate in the UK, and that EU member states will allow UK citizens to use the EEA channel in the EU?

Regional airports are vital for connectivity within Scotland, but the reckless gamble with our EU membership has caused great uncertainty for these airports that could have a seriously detrimental impact on our economy. Scotland has a large number of regional airports, many of which are reliant on low-cost airlines and outbound tourism to survive and to be an economic success. The International Air Transport Association predicts that a 12% reduction in sterling would result in a 5% decline in outbound travel, while Ryanair has said that it is scaling back its expansion in the UK.

Is it not the case that since 23 June, there has been a significant depreciation of sterling and a surge of people coming into Britain to buy things, because everything is cheaper here? Is that not good for businesses in Britain, including those in Scotland?

I am happy to answer that. When I was a retailer many years ago, the UK Government introduced an increase in VAT. Before that VAT increase hit, there was a rush to the shops to buy goods. After that increase hit, things fell through the floor, and I think we will see a similar effect.

Scotland has a large number of regional airports, many of which are reliant on low-cost airlines and outbound tourism to survive and to be an economic success. As I have said, the International Air Transport Association predicts a reduction in outbound travel. Since the EU referendum, sterling is down 25%. For airports such as Prestwick, it is even more vital that we continue the open skies agreement to maintain the number of outbound passengers, so it is incumbent on the UK Government to give an unequivocal guarantee that the UK will stay in the single aviation market after we are taken out of the EU. With 76% of UK holidays abroad being taken in the EU, outbound tourism is key for the industry. Outbound tourism employs more than 215,000 people across the UK, and it is a key driver in ensuring that our regional airports are successful. Remaining in the open skies single aviation market is vital to ensure that our airports remain economically viable, and low-cost airlines are vital if regional airports are to be a commercial success.

My hon. Friend has talked about airports relying on bringing in tourists. Aberdeen airport is heavily reliant on business traffic, but with the difficulties that the oil and gas industry has faced, the airport has redirected its efforts towards sun destinations in the likes of Spain and towards eastern Europe. What kind of message does the lack of clarity about the plans send to an airport that is looking to diversify its offering?

The hon. Gentleman talked about exchange rates. I think that relative to the euro, sterling depreciated by far less than 25%. That is crucial, because that is where we have our serious trade imbalance. With the rest of the world, we have relatively good relations. The strength of the dollar has compounded the depreciation of sterling, but that depreciation will be beneficial to British industry, wherever we trade.

That is the kind of thing that somebody might want to put on the side of a bus. It has been a trait of previous UK Governments to take forever to make key transport decisions, but UK regional airports, including those in Scotland, do not have the luxury of waiting. For the sake of those airports, our businesses and our commuters, the UK Government need to provide a clear and unequivocal guarantee that any post-Brexit aviation agreement will not lead to a loss of investment and connectivity in Scotland if we end up outside the open skies agreement.

The current aviation policy framework sets out that airports cannot apply for a public service obligation or the connectivity fund because of the 60-minute rule, which means that a number of regional airports lose out. The Government’s EU gamble is putting potential investment in Scotland’s regional airports at risk. They need to think again and, in doing so, give regional airports a fighting economic chance.

The problems are not confined to aviation. Our maritime sector faces similar concerns. We have heard a fair bit about ports, but the maritime sector is worth €12 billion annually to the UK economy, and some 240,000 people are employed in the sector in the UK. Fifty-three per cent. of the UK’s imports and 45% of its exports are from the rest of the EU. It is estimated that approximately 3 million jobs in the UK are linked to trade with the rest of the EU. Currently, there is the freedom to trade. OECD rules could preclude any change, in so far as we are talking about the ability of a ship to call at an EU or UK port and to load and unload cargo and passengers, regardless of its flag and regardless of the nationality of its owner. UK-flagged ships could, however, lose their right to operate in the domestic trades of EU member states that maintain flag-based cabotage restrictions.

The British International Freight Association has said that its main concern is potentially losing the benefits of free trade and customs harmonisation with the EU single market:

“A return to tariffs for UK merchandise exports and imports, if this is the outcome...will be detrimental to UK trade with the EU, and may result in a…reduction in UK-EU maritime volume.”

As we have heard, the UK’s port sector is largely privately owned and run in a competitive environment, and is thus very different from those of many other EU member states. Oxera has also said that changes to the costs of trade with the EU are

“likely to affect the volumes and patterns of freight activity at ports, while the need for new customs checks on imports and exports is likely to cause considerable congestion at UK and mainland European ports.”

It suggests that any negative impact could be mitigated through EEA membership or free trade agreements, although delays in negotiations could mean a significant period trading under World Trade Organisation arrangements. Uncertainty will impact the industry and the people it employs, and drive up the price of goods, so what access arrangements will be in place?

I thank the hon. Gentleman for that; I think we are making a very similar point from very different perspectives. There needs to be a plan for how ports are handled, going forward. The difference in the regulation and operation of UK ports as compared with EU ports provides a significant obstacle. The UK Government have to give us an answer on what they are going to do and how they are going to take forward a plan on that basis.

No, I will make some progress.

What access arrangements will be in place? What is the plan for the millions of people connected with this industry? Will UK companies have access to a single European market, with no taxes or duties payable on goods?

There are a lot of potential uncertainties for UK road haulage companies as a result of Brexit, particularly in terms of employment, drivers’ hours rules, access to markets and border controls. Transporting a lorry load of goods from London to Milan in 1988 required 88 separate documents; the internal market replaced them all with a single piece of paper. In response to the balance of competences review, the Freight Transport Association said that the EU had created

“a market that logistics has served for nearly half a century”,

benefiting British businesses; the Road Haulage Association, similarly, felt that for its sector the overall judgment was a fine one. It said that

“‘competences in UK road transport are finely balanced in our sector. Although we have not got a 100% solution in terms of market access we have got the most of what we think the industry would want”.

That is largely a reference to cabotage, the practice whereby a haulier from the UK can carry goods between two other member states—for example, Spain and France. So, what is the plan?

The Secretary of State is trying to make an argument similar to that made during the Brexit campaign about how the EU has to buy cars made here because there is a bigger market for them. That does not square with the facts of what is happening in the European market. For example, what will happen when there is a shortage of drivers in the road haulage industry, as at the moment many of them are EU nationals, supplying our road transport network? We have not heard the plan, and I heard nothing in the Secretary of State’s remarks today to say that there was a plan in this regard.

The EU single market has delivered significant economic and social benefits for Scotland. The four freedoms of the single market—freedom of movement of capital, of people, of goods and of services—have removed barriers to trade and opened Scotland to a market of more than 500 million people. The single market has also generated direct benefit, and there are now unanswered questions about funding. As of October 2016, some £350 million had been legally committed for transport funding, meaning a further £450 million is available as long as it is committed before the UK leaves the EU. Some £13 million of that went directly to Transport Scotland, with the agency being available to seek a further amount from the remaining £450 million. However, there has been not a peep from the UK Government or the Chancellor on whether the funds will be committed up to 2020. Will the UK Government seek to top up the funding to Scotland after we leave the EU?

I will conclude now, but there are many further issues relating to rail and bus networks, including vehicle standards and testing, disabled badges and a whole lot more. There are so many questions on transport in the light of Brexit that I think we will return to the subject again and again. Those questions are being asked not just by me or my hon. Friends, but by industry and the public. They deserve answers. They deserve “the plan”, but instead they see that, on issues relating to maritime, road or air, they have a UK Government who are all at sea, taking the road to nowhere, and booked on an expensive and uncomfortable flight from reality.

This is a welcome and timely debate. Transport is vital to all that we do, whether it be the functioning of our economy or people engaging in a good life. It matters to everything we do, but there has been little discussion in public or in Parliament about the implications for transport of our exit from the European Union. In this short debate, I want to flag up a number of issues where there are concerns, some of which have gone unanswered. I shall also seek some further information from the Minister about how these issues are being addressed.

At the beginning of the debate, the Secretary of State made some fairly anecdotal remarks about how he was dealing with some of the issues of concern that have been raised. He referred to meetings that he has had with Ministers at conferences and said that he hoped to meet the President-elect of the USA shortly to discuss some of these issues with him. However, there is a more basic question.

Yes, there are big questions about how the negotiations might be conducted and what the Government’s objectives might be, but one key question is whether the negotiations on transport will be conducted in their own right or only as part of much wider negotiations, so that nothing agreed for transport will be finalised until there is agreement on all the issues involved in our leaving the EU. I have not heard that question properly discussed, but it is an issue of concern. Some transport issues might appear to be negotiated, but they could somehow be lost or given away as part of some bigger negotiation where other factors are under discussion. That is a fundamental issue and I would like to hear more answers from the Government about that. Providing an answer to that question is not really giving away a negotiating position; it is telling us how seriously the Government as a whole view transport issues. It might provide a guide on how far we should pursue some of the matters that have been raised today and that are likely to be raised again.

Members have talked about how different sectors of transport—road, rail, air and sea—might be affected. I shall come on to some of those later. There are also important cross-cutting matters to which very little attention has been given when it comes to Brexit. What of passengers’ rights, for example? Complex compensation packages are being negotiated in Europe, and I believe that one of them was either finalised recently or is nearing completion. It is not at all clear how that would affect British citizens. Would they be covered by those compensation packages, now or in the future? We simply do not know.

What about security matters? Reference has been made to cross-channel transport, of which security is an important aspect. How will that be affected? We have heard little about it. Environmental issues are very broad, but they certainly include transport. How will that affect us?

During the Transport Committee’s recent investigation of the Volkswagen scandal, attention was focused on vehicle type approval, the European system for assessing vehicles in terms of their environmental impact, performance and safety. Although the Volkswagen episode—the Volkswagen scandal;—I must keep using that word, because a scandal is what it was—did highlight some deficiencies in the system, it is important to recognise the importance of having a cross-European system for vehicle type approval. There might be a need to strengthen or change it in certain ways, but having it does matter. How would we be affected in that regard? Would the United Kingdom still be involved? Would we still be party to the system? Would we be partners in it, influencing what happened? Again, we simply do not know.

The question of accessibility to transport for disabled people has been raised briefly, in relation to the blue badge scheme. That scheme, which is very effective and very important here, has a European counterpart. What would happen to that? Has any thought been given to the issue, and has there been any discussion about it? There is a wider question. European directives call for proper access to buses, coaches and trains for disabled people to be implemented by 2020, and European legislation has driven improvements in their access to public transport. Will we still be involved in that, or will the United Kingdom decide that there is some get-out clause so that we do not have to continue to give proper attention to the matter? I hear little about that in the public arena.

Sometimes we are all so involved in talking about the major strategic issues—which are, of course, extremely important—that we forget about the practical issues, but they must not be lost. One way of ensuring that they are not lost in discussions about many other issues is to keep raising them in the House and, indeed, elsewhere.

A number of Members have drawn attention to the aviation sector, which in itself illustrates the importance of the possible impact on the sector of our exit from the European Union, and the importance of the sector itself. Aviation is vital to the economy as a whole, and to business and tourism specifically. In 2015, UK aviation transported 251 million passengers and contributed £1 billion a week to the UK economy, and it supports 1 million jobs. It is not just about transport, either. It is about skills, development, and a wide range of employment. It is literally a gateway to Europe and to the world. The UK currently has agreements to fly with 155 countries, 42 of which have air services agreements through our membership of the EU. That arrangement is critical. What will happen to it?

There are three broad areas of concern relating to aviation that require proper negotiation and a proper solution, rather than the uncertainty that currently hovers over the whole issue, causing great concern in the aviation sector and among the people employed in it. First, the single European aviation market allows EU registered airlines to have a base in another EU state and operate services between other member states and within them. It promotes growth and has reduced fares. It is critical. There may be an answer to what will happen to that as an alternative to our current arrangements. Are we going to consider joining the European common aviation area—we would be able to do that—or is the answer bilateral agreements? We simply do not know, and not knowing causes great uncertainty. It will affect business decisions being made by airlines now about where they want to locate. These are critical decisions about aviation and the people employed in the sector.

Lady agree that businesses are openly saying that they are having difficulty now with their business plans and are absolutely terrified of getting no forward vision from the UK Government about how things are going to work in the future, which is impacting directly on investment?

I do agree. That is a key area of discussion within the aviation sector. It is why it is so critical that this is addressed. There is great uncertainty. There might be a solution, but we need to move further on it.

The second area of concern within the aviation sector is the transatlantic aviation agreement, and particularly the EU-US open skies policy agreed in 2007. There are many aspects to that, including that EU airlines can operate to the US from any point in the EU. EU airlines can also lease aircraft to US airlines for use on international routes from the United States to any third country. That was opposed for a long time by the US authorities, but it is now agreed and it is extremely important not just for aviation itself but for this country and—I go back to the common theme of my speech—for employment in the sector and the retention of high-level skills. Will this agreement continue? The general view appears to be that it will, as it is too valuable and important to everyone for it not to continue, but again there is uncertainty. Is that being addressed?

The third aspect of concern is European airspace strategy. The use of airspace is critical and too often when we talk about aviation and runway capacity we do not think properly about airspace strategy. That matters, however; it matters in terms of efficiency and the environment. Capacity and efficiency have been added through having the single European sky. Will that continue in its current form? Will it be part of the negotiating process? Will the functional air blocks—UK and Ireland—be retained? How will this operate? It seems to be so critical that it has to carry on, but in what form, and how will the UK be involved?

I wanted to flag up those three areas of concern. They are well known—I am not saying they are being ignored—but my plea is that we need to know what progress is being made.

Ports are vital because 90% of the UK’s trade goes by sea, and the EU is the UK’s largest single trading partner. Yes, there are global markets and the maritime sector is global as well as European, but Europe is extremely important to it. It cannot be looked at in isolation. Access to the single European market is important to the maritime sector. What impact will discussions on that have on discussions about the ports and the maritime sector? How will changes in access to the single market affect shipping with Europe? Will there be new and complex tariffs? Will there be customs checks? How will transmodal movements be affected? Will there be complexity in paperwork, tariffs and customs? Nobody knows what is going to happen. Some solution has to be found as soon as possible, and the sector needs to know what is happening. We have had silence on these matters for much too long.

There are many other transport issues involved in our exit from the EU that are causing great concern. I have identified just these few issues today because they are critical to the UK’s future. They are important for our trade, for jobs and for the retention of skills, and I urge the Government to get more involved in those sectors and give us more information about what is happening. These transport issues might not be flagged up in the newspapers every day, but they matter a great deal to our economy and to the people of the UK.

I agree; the hon. Gentleman has put his finger on the fact that the issue extends not only to airports but to seaports as well.

Last week in the House, I pressed the Secretary of State about the United Airlines issue. He kindly said that the decision was “deeply unwelcome” and that a fair amount of effort had been done by his Department, working alongside the Northern Ireland Office and Northern Ireland Executive, in trying to make sure that this air route was sustained. He went on to say:

“The loss of the route because of EU action is deeply unwelcome and precisely the kind of unnecessary decision from Brussels that led this country to vote to leave the European Union.”—[Official Report, 17 November 2016; Vol. 617, c. 377.]

I say a hearty “Hear, hear” to those words. That action was pernicious and should not have taken place. The company should have been allowed to continue to operate in Northern Ireland. Many people in County Antrim who have seen the benefits of Europe have turned against it because of such decisions. I am glad that we as a nation have woken up to that.

We have also had the allegation that the Irish Republic—our well-known neighbour—wants to be supportive of Northern Ireland as it leaves the EU. Indeed, it has written to many of the hauliers in Northern Ireland to invite them to a tea party hosted by the Taoiseach in Dublin. He has called it the all-island civic dialogue, and he wishes to have a conversation about the implications of Brexit for the Republic of Ireland. Now, I am quite happy for the Taoiseach to do that, and for him to understand the conversation that is going on, but if he targets businesses in Northern Ireland with a view to getting them to go to the south of Ireland and to crank up opposition to the UK’s decision, that is where I draw the line. I therefore commend the words of our First Minister in Northern Ireland, who said that the Dublin Government are poaching some of our businesses, and that includes our haulage businesses. It is right that this House understands that, while we welcome the opportunity to work with our southern neighbours, we can also see when someone speaks out of both sides of their mouth—on the one hand saying they are concerned about our relationship, but on the other hand doing everything they can to undermine that relationship and poach businesses from us. I think we should put that on the record.

It is also important that we identify those EU transport regulations that hurt British businesses. In an intervention on the Scottish National party spokesman, the hon. Member for Inverness, Nairn, Badenoch and Strathspey (Drew Hendry), I mentioned the package travel directive. Expedia is an American company that employs over 2,000 people in call centres and outreach centres in the United Kingdom. It is based in England and Scotland, and it will hopefully soon be based in Northern Ireland. That company employs thousands of people, but it is now faced with the package travel directive. Ordinary business and tourism travellers who use sites such as Expedia or trivago as a one-stop shop for their airline ticket, their hotel, their car rental, the shows they wish to attend or other things they wish to book, such as restaurants, will find that this package travel directive, which comes from the EU to protect huge monopolies, will try to pass on a major charge to the companies—Expedia, trivago or others—or, more than likely, to the customer, because they are using a one-stop shop, when they should apparently be encouraged to use several different operators to place their orders. That package travel directive is wrong, and it should be opposed. That is another reason why many people in the United Kingdom see that, in terms of travel arrangements, we would be better off out of the EU.

I do not know whether that is the case, so I cannot say whether it would or not. I would certainly be happy to look at that, but we need to encourage our own insurance industry—perhaps we will have a debate about the insurance industry and Brexit—to pick up those issues to determine whether there is a way in which we can address them.

Companies such as Expedia are faced with this package travel directive. We need to be alive to the fact that Europe is not a great benefactor of the travel sector and that it is actually doing an awful lot to hinder it.

I thank the hon. Gentleman for that helpful intervention. Clearly we are part of the remainers, and we represent our constituents. The majority of our constituents across Scotland voted to remain, so we must represent them.

The hon. Member for North Antrim (Ian Paisley) made a bit of a play of highlighting opportunities, but really he highlighted some of the problems with the European Union rather than proper opportunities. He seemed to put a lot of faith in the myth that the Government will invest the money that will not be going to Europe. He trusts the Conservative Government to invest that money. He used the word “subsidy”, although he knows full well that no Tory Government ever volunteer to pay money for subsidies.

This has been a wide-ranging debate. I will focus on road transport, but just before I do, I want to go back to the open skies debate. Prestwick airport, which is in one of my neighbouring constituencies, is a big employer for my area as well as for the constituency it is based in. It would be good if the Minister confirmed that Brexit will not affect Ryanair’s flights from Prestwick and tell us what the Government will do to mitigate any effects. I will throw out one opportunity for Prestwick—to be fair, this is not to do with the European Union—which is its potential as a spaceport. It is high time the Government made a decision about that.

As I said, I will focus on road transport. The Secretary of State said quite correctly in his opening speech that road transport affects us all. Given the proportion of goods that are transported by road to shops, road transport is fundamental to the price of goods. According to Government figures, almost three times as many goods are moved by road as are moved by rail and water combined, which shows us that road is the transport king.

That brings us to the question: what has the EU done for road transport? Apart from the harmonisation of licensing, the harmonisation of vehicle design, European Union-wide regulations for the transport of goods, workers’ rights legislation such as the Working Time Regulations 1998, the Road Transport (Working Time) Regulations 2005, the Agency Workers Regulations 2010 and the Fixed-term Employees (Prevention of Less Favourable Treatment) Regulations 2002, and funding for road schemes in Scotland, the EU has not done much to help road transport.

What else has the EU given us? Apparently, as the guys who are not here continually tell us, the EU has given us endless red tape and regulation. Let us look at how the EU has actually meddled in the pan-European transport of goods by road—this point was touched on by my hon. Friend the Member for Inverness, Nairn, Badenoch and Strathspey (Drew Hendry). In 1998, a lorry travelling from Milan to London required 88 separate documents. The EU got involved, and after much wrangling, the number of documents now required is one. The number has gone from 88 down to one—that is the red tape that the EU has created for the transport of goods across Europe. In the 1980s, there were 100,000 sets of technical regulations across the member states. Thanks to the EU, they have been consolidated, and there is now one set of EU-level regulations.

We heard about ports earlier. Ports are integral to the import and export of goods for road haulage. As we have heard, ports handle 90% of the UK’s trade. Leaving the EU means that there is a risk that instead of a seamless journey on and off a ferry, there could be extended customs checks, which will slow progress. As we have heard, the infrastructure is not geared up for that, which could mean that ports will require additional parking. Some of the checks need to be repeated for each country that a lorry traverses. Given that the World Bank estimates that the customs clearance process for a single freight container adds around a day to the import process, it is clear that we could face a massive cost and logistics nightmare. Will the Minister therefore confirm that he is fighting for access to the single market and the customs union?

According to the Treasury’s figures, EU membership is estimated to increase trade with EU members by between 68% and 85%. I know that there has been a whole debate about how inflated the figures might or might not be, but even if they are inflated, they still show that there is huge benefit from our membership of the single market.

Has the Secretary of State and/or the Minister discussed the customs union with the automotive industry? At the moment, car components criss-cross the continent before returning for use in final assembly at car plants, so the customs union is a major positive for the automotive industry. The industry is completely appalled by the lackadaisical argument that simply claims that no tariffs will be applied because of the importance of the UK market. It has confirmed that tariffs are its No. 1 concern, so will the Minister touch on that when he sums up?

Nearly 300,000 HGV drivers were employed in the road haulage industry last year. In April 2015, only 1,165 jobseekers recorded their standard occupation as HGV driver, so it is clear that a HGV driver qualification is a pathway to full employment. Even so—we touched on this earlier—the road haulage industry is having to take advantage of EU nationals, using licence harmonisation, to plug the skills gap. There is a predicted shortage of 40,000 HGV drivers by 2020 and the Government do not challenge that figure. That situation will only get worse unless there is a post-Brexit reciprocal licensing arrangement.

I have repeatedly called for the Government to implement a grant scheme to allow small haulage companies to train new HGV drivers. Such a scheme would pay for itself from welfare savings. To date, I have heard nothing from the Government. The Secretary of State said that the idea was with the Minister of State, Department for Transport, the right hon. Member for South Holland and The Deepings (Mr Hayes), who is responsible for skills in the Department for Transport, but it is time we started hearing some concrete plans.

The last key topic I will touch on is road funding, which is particularly relevant to Scotland. Another dividend of the UK Union that we suffered from in Scotland for many years was a lack of investment in our road systems. It has taken an SNP Government coming to power to really push that agenda, in particular with the new M74 and M80 motorways, and the ongoing £500 million M8, M74 and M73 upgrades. It is ridiculous to think that there has never been a continuous motorway connecting Edinburgh and Glasgow; the SNP Government are having to rectify that.

Investment for the current motorway upgrades came from the European Investment Bank, which drew in other international investment. Will such avenues for investment still be available at affordable rates to the Scottish Government in the future? It would be good if the Minister provided some clarity on that.

Anyone who has travelled to the highlands will know how many roads there are still single track, with passing places for oncoming vehicles. Those roads are lifelines. One example is the Fort William-Mallaig road, the road to the isles, which was completed as a two-lane carriageway only in 2009; previously, it was known as the worst trunk road in Europe. That shows the lack of investment that came to us from Westminster. The upgrade was completed partly with European funding. The allocation included £3 million from the European regional development fund, as well as European transitional fund assistance. That is proof that the EU managed to get money to Scotland that would not have come from direct funding.

Scotland secured a total investment of €941 million from the European structural fund in the 2014 to 2020 programming period. Of that, £14 million has been allocated to the low-carbon travel and transport strategic intervention programme, which helps to fund low-carbon transport hubs and active travel hubs, and £10 million is being invested in the smart cities strategic intervention. ERDF money has also been allocated to Strathclyde Partnership for Transport for various public transport upgrades. What will happen to the money that has not yet been allocated? Again, we do not know, as there are no guarantees from the Government. It is time they started to provide some certainty. The Scotsman reported a couple of days ago that councils in Scotland were worried about the possibility of losing £46 million of EU funding each year. Much of that money goes to local transport-related projects.

I mentioned travel in the highlands earlier and my hon. Friend the Member for Inverness, Nairn, Badenoch and Strathspey (Drew Hendry) touched on it, too. One common sight is busloads of tourists traversing the country. Many rights of passengers, particularly in relation to disabled passengers, are incorporated in regulations covered by EEA membership. Tour operators entering Scotland and the wider UK may choose not to enter the country in the future because EU passengers might not want to have to apply for a visa as part of a tour package.

It can be argued that many of these issues are not insurmountable, but the fact is that 8% of all travel in the EU in 2014 was attributed to buses and coaches, with 6.5% to rail. The Department for Transport gave very little consideration to buses in its “Balance of Competencies” report released ahead of the referendum, despite the volume of regulations in place to protect coach passengers within the EU.

It is clear that EU directives have made our roads safer and protected the rights of HGV drivers. They have made the transport of goods easier, and therefore cheaper, within the customs union. The free movement of goods and people in conjunction with the licence harmonisation process has been vital for the haulage industry. Without it, there would have been market failure by now. There has even been harmonisation of the blue badge system for people with disabilities. Will that be reciprocated post-Brexit? As I outlined, the EU has contributed funds for much-needed road upgrades in Scotland. It is high time the Government understood that Brexit means a lot more than Brexit, and that we want clarity.
