We are waiting to see the result of the ballot this afternoon, but I hope that civil servants, who are imbued with a strong public service ethos, will recognise that we are seeking to achieve public sector pensions that continue to be among the very best available. However, because people are living longer, they will be asked to work for longer. Furthermore, because there is not a fair balance between what they pay and what other taxpayers—who have seen their own pensions take a hit—pay, we are expecting them to pay a bit more towards them.

My hon. Friend asks a good question. As he knows, in this country, we recognise countries rather than Governments. What matters is making contact and having communications with the transitional authorities, and speaking to and building a relationship with them. That is the right way to proceed.

May I, too, congratulate the Prime Minister and the Foreign Secretary on leading international opinion on the matter? I also welcome my right hon. Friend’s comments that we do not intervene unless in exceptional circumstances. That is an excellent contrast with the position on Iraq in 2003. This time, we have a positive legal opinion from the Attorney-General and the whole thing has been properly signed off by the United Nations.

I just wanted to ensure in the Cabinet meeting this morning that members could read the UN Security Council resolution, the Attorney-General’s legal advice and a draft of my statement. There will be difficult days ahead—these things never go entirely according to plan. There are always problems down the road. It is therefore important that the Cabinet makes a decision, drives it through and does what is necessary to achieve the goal that the whole House supports: the enforcement of the UN Security Council resolution, which will make our world a safer place.

The Electoral Commission meets Ministers regularly to discuss the delivery of elections and referendums, including how to ensure that all electors, whether overseas or in the UK, can cast their votes easily and securely.

My hon. Friend will be aware of the shockingly low participation by overseas electors in UK elections. Of the potential 5.5 million British subjects living abroad, only about 15,000 are registered. What work has the Electoral Commission done on the implications of fixed-term Parliaments for sending out postal ballot papers significantly earlier in the electoral cycle, thereby improving the participation rate of overseas electors?

My hon. Friend is a consistent advocate of overseas voters. The Electoral Commission has done work on the issue and submitted representations to the Deputy Prime Minister as part of a comprehensive modernisation strategy for our electoral system. We wait to see what the Government will do with that report.

Returning to the question asked by the hon. Member for Rhondda (Chris Bryant) on close relations with Colonel Gaddafi’s son Saif, was the Prime Minister as surprised as I was to learn that Saif Gaddafi also had many meetings with the previous Business Secretary, Lord Mandelson, and described the former Prime Minister, Tony Blair, as a “close personal friend”?

The Minister of State and I met last week with the Exchequer Secretary and Northern Ireland’s First Minister, Deputy First Minister, Minister of Finance and Personnel, and Minister of Enterprise, Trade and Finance to discuss the Government paper on rebalancing the Northern Ireland economy and promoting investment and growth.

Given the coming corporation tax cut, the national insurance contributions holiday for small businesses and the avoidance of Labour’s national insurance tax increase next month, does the Secretary of State agree that this Government are restoring Northern Ireland’s reputation as a destination for inward investment, which was badly damaged by the previous Government?

I think we need reform of the funding arrangements for political parties, and we are keen to work on a cross-party basis with all parties in the House to restore public confidence in the way political parties are funded, while at the same time proceeding with reform of the other place, as I described earlier, by publishing a Bill on House of Lords reform early in the new year.

T7. The Deputy Prime Minister will recall that last month I asked him about electoral registration fraud in Tower Hamlets. Will he agree to have a look at postal voter fraud, too? In Halifax in May, an astonishing 763 postal votes failed to match voter registration records. Does he agree that evidence is building of systematic electoral fraud in this country, which needs to be investigated?

As the hon. Gentleman knows, electoral registration officers already have the power to look into allegations of abuse, which are in some cases, as he has highlighted, very serious indeed, and where necessary and justified, refer them to the police. That is exactly what I would expect should happen.

The Electoral Commission discussed that issue as part of a round table event with Foreign and Commonwealth Office and Ministry of Defence officials in 2008, but the then Government failed to introduce the comprehensive strategy that the commission sought. The commission, however, has recently repeated its recommendations that the UK Government should introduce proposals for a comprehensive electoral modernisation strategy, including to address how it intends to improve voting opportunities for overseas electors.

I am sure that overseas electors will be delighted to hear that progress is being made. My hon. Friend will recall that I asked him a similar question last time round, after which I was inundated with e-mails from British ex-pats. One said:

“I have been abroad for 10 years now (ironically, working for the British Government) and have not once received our ballot papers in time to vote”.

Another says:

“As a result of poor planning on the Electoral Commission’s part, I was denied my vote.”

Will my hon. Friend agree that now is the time to consider having British subjects abroad voting in embassies and consulates, at least perhaps on a pilot basis?

My hon. Friend is a tireless campaigner on behalf of overseas voters. There is no question but that the cumbersome nature of registration requirements and the tight time scales for getting postal votes to and from overseas voters are part of the reason why so few register and vote overseas. As I mentioned earlier, the Electoral Commission has made radical recommendations to the Government about streamlining the procedures, and it is very much to be hoped that the Government will take those on board.

By allowing rents for new tenants, but not existing tenants, to be set closer to market rates—and by the way, rents for existing—[Interruption.] Rents for existing tenants went up by about 15% under the Labour Government. We are saying that we need to give registered social landlords an incentive to build new affordable homes—the building of which was at lamentably low levels under the previous Government—while all the time, of course, compensating those tenants through the housing benefit system. As I said earlier, we also think it is right for the Government to say that there needs to be some kind of limit for those people who are on housing benefit, and it seems fair for that limit to be set roughly at the level at which people who are going out to work would be looking for rented property in the private sector.

The Deputy Prime Minister will be aware of Labour’s catastrophic defeat in Tower Hamlets last week at the hands of the Ken Livingstone-backed independent candidate, but will he examine the issue of electoral fraud, because serious allegations of it were made at the local elections in May and again last week? Some 18 postal votes came from one four-bedroom house and eight postal votes came from a maisonette above a shop, and more than 5,000 new names were added to the roll just before the deadline. Will—

I think everyone recognises that being a vicar is not an easy job. Betjeman succinctly observed:

“When things go wrong it’s rather tame

To find we are ourselves to blame.

It gets the trouble over quicker

To go and blame things on the Vicar.”

Every clergyman deserves our full support for what they do in the community, and their spouses—whether pre-ordination or post-ordination—deserve our support, because they are often on the front line of helping parishioners in the community. I very much hope that if any clergy spouse does not feel that she is getting full support, she will get in touch with me and I will make jolly sure that her diocesan bishops and others ensure that she gets the support that she deserves.

The Electoral Commission runs campaigns to promote voter registration among British citizens living abroad. The Commission informs me that the campaign in the run-up to the 2010 general election resulted in more than 40,000 overseas voter registration forms being downloaded from its website. In its report on the 2010 general election, the Commission said that the election timetable leaves insufficient time for overseas voters to receive and return their postal votes, and recommended that the Government should undertake a thorough review of the timetable for UK general elections.

May I remind my hon. Friend what happened in the Polish elections of November 2007? Poland set up a number of polling stations in this country for its citizens to participate in their elections. Could we consider doing the same at British embassies or consulates abroad? The impression that I had in Hammersmith was of thousands of Poles queuing up at Ravenscourt Park to vote. It is something that we could quite reasonably copy.

I am grateful to my hon. Friend for the suggestion. We have looked at using British embassies abroad as places where expats can go and vote. There did not seem to be a great deal of interest when the suggestion was put forward by the Electoral Commission, but given the persistence with which my hon. Friend puts his case, we will consider it again.

I completely and utterly disagree with the hon. Lady. Of course one ought to strive towards equality in representation, but that is simply not the British way of creating the House of Commons. Historically, we said, “Okay, the shires need to be represented”, and consequentially the knights of the shires were brought into the first Parliament in the 13th century—incidentally, the only reason we know the names of any of those who first attended is that they presented their expenses chits and had them paid. Then we decided that the towns and villages needed representation, because the principle was that representation was based on communities—it was communities that were represented here. It was not just about the mathematical calculating machine system for deciding constituencies. There are countries that have used that system. The United States of America uses it for its House of Representatives. In fact, that is what led to the concept of gerrymandering—it was, I think, a Governor of Massachusetts, Mr Gerry, who was the first person to create a constituency designed to get him re-elected, and it was in the shape of a salamander.

May I return to the earlier point about urban under-registration, because it is an important point in seats such as mine? However, that is an operational matter for the electoral registration officer and the Electoral Commission; it is not an excuse for perpetuating a bias in the electoral system in favour of small urban seats. It is an important matter, but let us not confuse two things.

The hon. Gentleman is right in a sense, although I expect that the under-registration in his constituency is nowhere near as high as it is in, for example, Hackney North and Stoke Newington or Hackney South and Shoreditch, which have much more mobile populations, in part because the people there do not own their own homes and because of the ethnic mix. Clear evidence has also been provided showing that people from black and ethnic minority groups and poor people are far less likely to register. We need to bear that in mind. I shall refer to that again when we discuss how many MPs there should be.

Is the hon. Gentleman defending the status quo? Under the current system, we typically have boundary reviews every three Parliaments, with the population data that are fed in typically being about 10 years out of date. The new boundaries that were introduced in May were based on electoral registers from 2000, and they may still be in force in 2024 if we have three five-year Parliaments. Is he seriously defending the status quo, under which our data can be up to 24 years out of date?

I think that I am correct in saying that that system was set up by the previous Conservative Government, and no, I am not defending the status quo. I am not defending it in relation to the overall structure of the system that we ought to have, nor am I defending it in relation to the precise allocation of seats, and so on. As I have said several times in this debate, I would prefer to move towards closer equalisation. However, I want the boundary commissions to bear in mind other factors, which should include the political realities of the Union, along with ward and other political boundaries. Boundary commissions should also be able to bear in mind geographical features, such as rivers, islands and, in my case, valleys, as well as physical access, because it is pretty difficult to tie two places together that have no access between them.

The timetable for the boundary review is not driven by practical concerns about what would be suitable, but by crude and, I believe, partisan calculations that are the antithesis of the supposedly high constitutional principles that the Deputy Prime Minister invoked in his first speech in office. How quickly those noble ideals seem to have been cast aside. Back then he promised the

“biggest shake up of our democracy since 1832, when the Great Reform Act redrew the boundaries of British democracy, for the first time extending the franchise beyond the landed classes.”

Amendment 125 suggests that instead of using the register of voters for calculating the relative size of constituencies, we should use the best estimate of eligible voters, so that each MP represents the same number of people who are eligible to vote, not the same number of people who happen to have registered. I propose that because of the demographic bias in respect of the categories of people who are more or less likely to register, and my contention is that all those people have the right to vote. They may at some point register if there are better registration systems, and they should not be denied a proportionate voice. I also contend that those Members, particularly on the Government Benches, who have argued that there is a systematic bias in favour of the Labour party because the average number of registered voters in Labour seats is less than the average number in Conservative seats miss the point that that bias does not exist when account is taken of the number of eligible voters—those aged over 18.

I do not intend to run through a comprehensive list, although I have been provided with figures from the Library. I pointed out earlier that in Bradford West there are 77,848 people over 18, yet only 62,519 are registered. In Holborn and St Pancras in London, there are 119,000 people aged over 18 and the number on the electorate is 86,000, and the electorate as a proportion of the 18-plus population is just 73%.

To summarise, the top line of my argument is that we must have the right basis for doing the calculation before we have a big argument about whether we should then apply other criteria, such as community and geography. We should establish fairly and squarely the basis of the argument put by the Government, and decide who we should be counting. I say that we should be counting those who are eligible to vote.

I am following the hon. Gentleman’s argument, I think, but does he think that there is an easy way that can be picked up in his amendment to tell the difference between a set of electors—say, US citizens living in the constituency that he just named—who are not able to vote under any circumstances, and those who would be able to vote but are simply not registered?

I should certainly like to help the hon. Gentleman on that point. What the amendment actually says is that we should use figures by the Office for National Statistics for who is estimated

“to be eligible to vote in United Kingdom parliamentary elections”.

Obviously, the question is how the ONS would make that estimate. The answer is by using a combination of the register of electors, the census and other data forms.

As has already been pointed out and as we all know by now, there is a systematic bias against the registration of certain categories of people—ethnic communities, people in private rented accommodation, 17 to 24-year-olds and, generally, those in poorer areas. Those poorer areas tend to be more likely to be represented by Labour MPs. That explains the difference in the average figures for registration. The problem that I have with the current thrust towards quickly redrawing the boundaries on the basis of registered voters is that clearly there will be a bias in that, so people from poorer communities will be under-represented. That is not effective or fair democracy.

I will make a little more progress.

The commissions will continue to use the electoral register as the basis for their reviews. That has been a feature of the system for decades, under Governments of all shades. With registration in Great Britain at well over 90% and in line with comparable countries, the register remains the best basis for reviews. That is not to say that where people are not on the register, we should do nothing. That has been the attitude for far too long. Under-registration exists in coastal areas and the inner cities, among younger people, including students, and minority ethnic groups. There is no silver-bullet solution. We are investigating a number of solutions, including freeing up local authorities to use existing public sector databases to identify people who are not registered, and then actively encouraging them to register. We are also acting to tackle registration fraud, accelerating the shift to a system of individual, rather than household, registration—a process started by Labour Members.

Does the Deputy Prime Minister share my consternation that, for the first time in 50 years, under the previous Labour Government, the total UK electorate registered in this country declined when the UK population was rising—between 2001 and 2005? If Labour was serious about getting people on to the electoral register, it did a pretty poor job of doing so in government.

It is a distinguishing feature of this debate, and previous debates, that Labour Members are now very animated about matters that they did absolutely nothing about in government.

I now turn to the referendum on the alternative vote. Fewer, more equally sized and more up-to-date constituencies will help to bolster the legitimacy of parliamentary elections. However, in parallel with that step, we must address the question of reform of our voting system. Some believe that we are better served by sticking with the current system, which, they say, benefits from its familiarity and strong constituency link. Others believe that it leads to too many safe seats, giving many MPs jobs for life with only minority support from their constituents. Advocates of AV note that it would retain the current constituency link, but that it would give people more say over their vote by allowing them to rank candidates in order of preference. As a general rule, therefore, MPs would come to Westminster with the support of the majority of their voters.

I rise to support the Bill, although I shall talk mainly about part 2, on parliamentary boundary reviews, as somebody who was heavily involved in the boundary review in my own area of north London last time around. It was a very lengthy process that began in 2001 and ended in 2007. That is the important point—reviews are currently extremely long-winded affairs. It is crucial to understand that they are far too long and infrequent, and as a consequence we have electoral data that are far too dated to produce a modern electoral system and lead to far too many constituencies being either too small or too large when the boundary changes finally come in, as they did most recently this past May. In fact, the boundaries introduced then are based on electorates drawn up in 2000, so we have just kicked off with new boundaries that are already 10 years out of date.

Under the old system, we would normally be expected to have those boundaries for up to three Parliaments, which could mean that they are in place until such a time as 2024, for example. By that time, the electoral data will be a colossal 24 years out of date. In the last Parliament, the electoral data were already 16 years out of date in 2009. It is very important that we have more frequent and thorough boundary reviews based on current data.

I want to say a couple of quick words on the alternative vote, which I do not support. I will campaign for a no vote on AV, and if I had a free choice I would not put it to a referendum. However, it is clearly a constitutional matter, and it is important that such proposals should be put to referendums. I welcome the coalition Government’s commitment that such questions, including a proposal to change the voting system, should be put to a referendum. As it currently stands, and as I believe the Labour party offered to the Liberal Democrats in the abortive coalition negotiations in May, any Government can come along and arbitrarily decide to change the system through legislation without having a referendum. I therefore commend the Government for seeing that the matter needs a referendum, which will set an important precedent.

There are two possible objections to having more frequent boundary reviews, and especially to their being held every Parliament. One is cost, and the other is administrative inconvenience for Members of Parliament and others involved in electoral administration. Those are the only two possible objections to more frequent and regular boundary reviews, but unfortunately the Labour party has chosen not to have one of them as its grounds for objection. It is objecting, on absurd grounds, to the creation of equality for electors in a parliamentary constituency, something on which it and its predecessors have been campaigning since the early 19th century. Suddenly, Labour Members are the people defending the principle that constituents should be unequal, which is entirely wrong.

It is perfectly possible to have boundary reviews much more quickly. The previous one lasted six years, but the meat of it lasted about a year and a half from the time when the first proposals were made to the time when they were approved by the Boundary Commission. Thereafter, it mainly came down to approval by Parliament.

Given that it has been said that the savings would be £12 million, how many hundred million pounds does the hon. Gentleman estimate the reduction by 50 MPs will cost, given the judicial activity and so on that will happen?

That is a bit of a red herring because judicial activity that is happening through the current system, with the local reviews, is extremely expensive. I personally think that those matters are not for the court or lawyers—they are administrative matters. They should never have been given over to QCs and other lawyers because they are simply not matters of law. We are considering reviews of how parliamentary boundaries are drawn, and they should be more frequent and more effective.

I want to end by examining the Labour party’s position. It has set out to oppose equal-sized parliamentary constituencies. Let us consider that for a moment. The right hon. Member for Blackburn (Mr Straw) used the word “gerrymandering”. He should know better; his use of it was an abuse of the English language. One cannot describe a way of formulating a set of seats as gerrymandering, but one can so describe its execution, for example in an irregularly shaped constituency, particularly one made for party political purposes. However, that will be down to the Boundary Commission, so thankfully there cannot be any gerrymandering—we have an independent Boundary Commission to conduct the execution.

Let me mention three points of 19th-century history. The right hon. Gentleman studied law at university. Perhaps he is like Tony Blair, who, having completed his time in politics, thinks that he should have studied history instead of law. The Labour party did not exist in 1832, but many Labour party members believe that the Great Reform Act of 1832 presaged the development of the modern Labour party. Yet that was all about abolishing rotten boroughs and trying to create a system of parliamentary constituencies of equal size. Before that, we had constituencies such as Gatton with seven electors, Old Sarum with 13 electors, Dunwich with 32 electors and so on, while the whole of Yorkshire, including the great cities of Leeds, Sheffield and Hull, had some 20,000 electors.

I shall pray in aid the Chartists. The right hon. Gentleman knows that their people’s charter of 1838 is frequently cited as one of the origins of the modern Labour party. Many people in the Labour party hark back to the six points in the people’s charter. Point 5 is:

“Equal constituencies, securing the same amount of representation for the same number of electors; instead of allowing small constituencies to swamp the votes of larger ones.”

That is from the people’s charter of 1838, which Labour is seeking to revoke.

I welcome the commitment that AV is a constitutional matter. I welcome more frequent and faster boundary reviews, but I am afraid that Labour’s opposition to the Bill is cynical and self-serving. Their predecessors would be deeply ashamed of what they are doing today.

I am not sure that that is a matter for the Electoral Commission, but the hon. Gentleman will have heard the Deputy Prime Minister say earlier today that the Government were considering using existing databases to inform electoral registration better, and I think that that is probably one of the answers.

In recent years, thousands of Polish nationals in Hammersmith and Fulham have voted in Polish national elections at polling stations set up for the purpose in locations such as the Polish cultural centre in Hammersmith. Has the Electoral Commission had any discussions with the Government to establish whether we might be able to do the same for United Kingdom nationals based abroad, enabling them to vote in United Kingdom embassies and consulates?

My hon. Friend has made a good point. I believe that such discussions have taken place over the last two or three years. However, decisions of that kind are ultimately a matter for Government, and it will be for Government to make any changes to the existing law.
