I have had some dealings with the hon. Lady in the past. She is a wonderful woman, and she is a lot better than that question. Perhaps it is a Whip’s handout—that is not her. Much of her question has already been answered in this urgent question, but I am happy to say it again. We must ensure that at all times we are fair, that we are acting morally and also lawfully. As I have said, such important a decisions cannot be taken lightly. The facts must be weighed very carefully, and decision taken only when all alternatives have properly been taken into account.

The Home Secretary has an incredibly difficult job. The interests of the public in this country are paramount and he must keep them safe. We have a fine tradition in this country of not exporting our problems around the world, but of trying to solve problems around the world. Does he consider that we have sufficient powers to ensure that people coming from abroad who may pose a risk are contained? If so, does he also consider that it may be worse for humankind if individuals with problems are exported to parts of the world where there are not such safe containment laws as ours?

My hon. Friend asks whether we have sufficient powers. It is right that we keep our powers under review at all times. If we feel that things need to change, and if that change can be brought about, we would bring it to the House, as we did very recently with the Counter-Terrorism and Border Security Act 2019.

It is worth saying that no matter what powers we have, any prosecution would require sufficient evidence because of our absolute commitment to due process. That is incredibly difficult when people have gone abroad, joined terrorist organisations and carried out the most horrific attacks. It can be incredibly difficult to achieve justice by obtaining evidence that we can present in a court of law under whatever power we have. That is why, as Home Secretary, I must look carefully at all the powers at my disposal. In some cases—and only in some cases—when it is deemed that the best way to keep this country safe is through deprivation of citizenship for someone who has more than one nationality, that should be taken as a serious option.

I agree that the Bill should include appropriate safeguards for legitimate journalism, and I have listened carefully to the arguments as to what form those safeguards should take, while preventing those who might falsely pose as a journalist from hiding behind protections to which they are not entitled. The Government therefore tabled amendments 19 to 23, which my hon. Friend suggested, to ensure that, when journalistic data is sought, the journalist is notified of the application. This will give journalists and media outlets the opportunity, should they want to, to make representations to the court about whether an application for an overseas production order should be granted. That was always the Government’s intention, but our proposal was that the process be provided for in the criminal procedure rules—the relevant rules of court for production orders. Amendments 19 to 23 will now make these notice requirements explicit in the Bill so that there can be no doubt about the requirement to notify journalists of a relevant application.

I thank the Minister for listening to those representations. As he says, I declare an interest as chairman of the all-party BBC group.

The representations from the BBC show that the amendments will make the Bill completely consistent with the provisions under PACE and will help the administration of justice, as they may mean that many applications do not need to be spoken against. I am incredibly grateful to the Minister for listening to us, for working very closely with all of us and for filtering in our ideas.

All Members have raised the importance of protecting journalistic freedom, and I think we have struck the right balance between not excluding their material entirely—because I do not believe that anyone should be above the law, no matter what their profession—and giving them notice that other people would not be given, to allow them to make representations. All the way through this process, even in considering the controversial part of the Bill, we should not forget that this is done before a judge. It is not done between officials in two Administrations: these orders will be applied for in front of a court and granted by a judge. It will be for the law enforcement agencies to satisfy the range of tests and for journalists to make their representations. That will safeguard the process while at the same ensuring that we get data if it is needed to keep us safe.

I should point out that unlike the Opposition amendment—I think the shadow Front-Bench team largely supported the same change—the amendment that I tabled was realistic about the point that if the journalist could not be contacted, that would not mean that we would end the process. Ultimately, what is important is the protection of victims of appalling offences. My amendment will make sure that we strike that balance between the protection of journalists and the protection of victims, which is at the core of this excellent Bill.

Yes, my hon. Friend makes a true point. We have put in a carve-out for some very urgent situations, including if there is a threat to life or, indeed, if the journalist is impossible to track down and may in fact be a front for a foreign state, for example, in a fake news scenario or something else. All Members have had genuine views and made their points well. I am happy to accept my hon. Friend’s amendment, but there were many good parts of the amendments tabled by the Labour party, too. This is not a party political point. The exemptions get the right balance and we will be able to protect journalists, so I hope I will have the support of the whole House in asking that the relevant amendments not be pressed.

Before I finish, I should apologise for the length of my opening address. There were originally two groups of amendments, but that was changed to one group, so I needed to deal with everyone’s amendments in one go.

I think we have struck the right balance. The Bill reflects some of the day-to-day challenges that we face in keeping us safe. I urge Members not to support amendments 12 and 18, and some of the others tabled by the Opposition Front-Bench team. As I indicated at the start, throughout the passage of this Bill and other Bills, I have accepted a number of amendments from Government and Opposition Members. That is the spirit in which I have tried to conclude the passage of this Bill, and in which I hope to do so.

The first thing I should point out is that everyone in the House wants to see a way in which the mutual legal assistance treaty system is speeded. I do not think there is any issue with that in any part of this House. The issues to which I shall come in a moment in essence fall into two categories: first, the issue of death penalty assurances; and secondly, protections for journalistic data.

In respect of the intervention from the hon. Member for Bexhill and Battle (Huw Merriman), he has tabled an amendment that is essentially the same as the one that I pursued in Committee. I do not accept in any sense the difference that he suggests there is between the two. I am pleased that his amendment has been accepted and adopted by the Government.

I apologise if I have got this wrong, but my understanding is that the hon. Gentleman’s amendment would not have included circumstances in which the journalist could not be traced, whereas the amendment I have tabled takes that into account, meaning that it would not be a blocker. It is in that limited aspect that our amendments differ.

All I will say is that I had discussions about that amendment and others with the Minister, and they were things on which we were able to compromise. I am trying to assure the hon. Gentleman that the idea that I was trying to do something to scupper the treaty is completely wrong. I am sure he would accept that that was the case, whatever the differences between us on the detail.

Let me turn to the issue of death penalty assurances, which has clearly aroused a great deal of controversy, and explain our position. I should say to the Security Minister that I totally accept that new clause 1 is an improvement. The position the Opposition have ended up in today is a procedural one: unfortunately, because new clause 1 is the lead provision in the group and is therefore at the head of the list to be voted on, the only way that the Opposition can secure a vote on our own amendment is by voting against new clause 1. That is just the procedural position we have ended up in, but accept that it is a step forward and make that entirely clear from the Dispatch Box at the outset.

As the hon. Lady knows, the process is that any Bill that is introduced has to go through various Government committees to ensure, across Government, given that we have collective responsibility, that it meets with approval. I do not know of any such meetings with the DUP. I will happily take that away, but as far as I am concerned, I looked at the Bill, I have examined it very carefully, and I am afraid that the central point about devolved matters seems to me to apply.

I know that that does not meet with the hon. Lady’s approval, but the fact is that the law is the law, and we have to build a Bill around it. As I say, I have written to the devolved Assembly in Scotland and to the permanent secretary in Northern Ireland, and those communications are ongoing.

The Supreme Court judgment made it absolutely clear that lawmakers would have to change the law to give greater rights to women from Northern Ireland in the circumstances that were discussed. The women who my colleagues and I met and women such as Sarah Ewart should not have to go all the way through a court process to get their rights—it adds insult to injury for them. I ask the Minister, who always listens: if not this law, what law will be introduced by this Parliament, which unlike Northern Ireland is responsible for treaty compliance, to give those rights to women, who deserve them?

I am grateful to my hon. Friend. I know that he works on a wide range of issues tackling violence against women and girls. First, on the case that he referred to—I do not want to be legalistic about this, but he asked me about it specifically—he may recall that the Supreme Court judgment was unable to deliver a full ruling, because the litigant bringing the proceedings was not judged to have locus. I have to say that, because that is the situation.

I obviously must not comment on the specific case that has been referred to in the Chamber and that is going through the court process at the moment, but I return to the point that the Bill is about domestic abuse. We have to focus on the subject matter of the title of the Bill, and any matters in relation to devolved powers are part of a much wider debate across Government.

The Opposition will oppose the attempt to remove the amendment from the Bill. It is important as a matter of principle. This issue affects a tiny number of cases. We would urge the United States to think again about putting at risk the enormous amount of work that can be done to speed up the process of information exchange for a very small number of cases.

I agree with many of the hon. Gentleman’s arguments, but change that he is seeking will drive a coach and horses through this Bill, which will protect the vulnerable. Is he not using the wrong vehicle for that?

No, I am not using the wrong vehicle. This plug-in mechanism will have an impact on many other treaties. My answer to the hon. Gentleman is a rhetorical one: if we do not make a stand here, where will we make a stand? The idea that this huge amount of data and information relating to cases that do not carry the death penalty will be put at risk for a small number of cases—three in 20 years, as the Minister said—is, to my mind, not the most credible position.

While the Bill was based on some of the provisions in PACE, its powers extend to further offences, such as terrorism investigations. In the Terrorism Act 2000—the legislation that law enforcement agencies currently use for terrorism investigations—confidential journalistic material is not excepted data. The Bill creates a new power to obtain an overseas production order, drawing on existing powers available to law enforcement domestically for the acquisition of content data overseas, to help to prevent unnecessary delays in tackling serious crime.

It is sensible to ensure that we do not have significantly different legal tests in the Bill. The existence of different court procedures for different sorts of court orders leads to unnecessary confusion, avoidable litigation and further delays in investigations.

My right hon. Friend touches on a point that has struck me, in relation not only to this clause but to measures further on in the Bill. The Bill applies a test that relates, on a domestic basis, to where our terrorism laws relate, but it could actually be a lot broader. I know that he has just touched on the fact that it would actually make things more complex, but would it not be possible to have a two-tier test, depending on whether the application is terrorist-related or non-terrorist-related?

I hear my hon. Friend’s point. The whole point of the Bill is to increase the speed of the process and smooth it. What we will come on to later is obviously that in this process there is notification for journalists; other people do not get notification. Journalists are brought into the process early on, so that they are able to make representations to a judge in a way that does not apply to the rest of the public. Indeed, it does not apply to Members of Parliament; if MPs are under investigation, they will not get a chance to make representations to the judge. But a journalist will get that chance.

Our view is that the terrorism law is domestic law, and that judgment has been in existence since the last Labour Government. What is important is that the judge uses his or her discretion, guided by the fact that any judgment needs to be proportionate, necessary, in the public interest, targeted at an individual and in line with the range of domestic laws. So, yes, there is POCA, PACE and the Terrorism Act 2000. However, all of those laws are established UK pieces of legislation.

If we add the notification to the judge’s discretion—the point of it has to be proportionate and necessary—and to the fact that the laws are already established, I believe that journalists will have the protection that they need. I am happy to look at the issue, which we will come to in later amendments, about effectively improving the definition of journalistic material to make sure that it is not broad and spread wide.

In this case, we must remember that the appropriate officer will need to provide evidence against each of the access conditions, and the judge will scrutinise them carefully. It is almost inevitable that in any situation where the police attempt to obtain journalistic material, there will be understandable resistance from the journalist or media organisation that holds it. Both are well versed in the process of making representations to court, and it is rare that access to confidential material is granted through PACE.

It is the Government’s intention that journalists’ interactions with their sources should be protected, but that does not mean that journalists should receive blanket protection from legitimate investigation, simply because of their chosen profession. The Bill takes a reasoned balanced approach, so I ask the hon. Gentleman to withdraw amendment 13.

Amendment 14 seeks to redefine “confidential journalistic data”. The definition in the Bill is taken from the Investigatory Powers Act 2016, which the Government feel is sufficient protection for source material.

Although the Bill offers a public interest test and a substantial value test, it does not include a relevant evidence test. Nor does it speak about a requirement that all other means of obtaining the information have been exhausted. I am pushing the Minister on the relevance test. Adopting a threshold for what data are relevant to an investigation is necessary and proportionate. It enables clarity and constituency in all cases, and is in line with our human rights obligations. As the Minister pointed out, the judges who will be considering these applications will be familiar with the application of a relevance test. It is a recognised legal standard, and it would be a simple, sensible safeguard that would bring these provisions in line with those under the Police and Criminal Evidence Act 1984. I ask the Minister to consider carefully the inclusion of a relevance test.

It is a pleasure to serve under your chairmanship, Mrs Moon. I wish to speak to amendment 4. I declare an interest: I chair the all-party parliamentary BBC group, but my concerns relate to all organisations. As the hon. Member for Torfaen said, under schedule 1 to the Police and Criminal Evidence Act, there are three conditions that must be met. One is that there are reasonable grounds for believing that the material is likely to be of substantial value. That is replicated in this Bill. Another is that it is in the public interest to have regard to certain matters. That is also included. What is not included is the requirement that there are reasonable grounds for believing that the material is likely to be relevant evidence. I support the move to add that third limb to the Bill.

Let me use as an example a typical application that I have received for all material relating to a matter. It relates to all journalistic material including but not limited to audio, visual recordings and documentation related to and arising from interactions with X and Y in respect of allegations linked to certain addresses. That can be incredibly wide, so the relevant evidence test is very important.

Journalists and media organisations rely on individuals to come forward, and their investigations can be incredibly broad. There could be a large onus on them to supply a lot of information, which could include legal advice and editorial content back and forth. Without this amendment, I believe that there would be difficulties. The amendment would make the Bill entirely consistent with the Police and Criminal Evidence Act, which should be its benchmark.

The Bill states:

“The judge must be satisfied that there are reasonable grounds for believing that…the electronic data…is likely to be of substantial value”.

I recognise that there are additional bulwarks in the Bill to give us assurance, but I gently suggest to the Minister and his excellent Committee team that, if we extend the Bill to include the third limb, that would make me comfortable.

Amendments 4, 5 and 6 seek to include in the Bill an additional test of relevant evidence, which the judge must be satisfied has been met before granting an overseas production order for journalistic data, and the additional requirement that all other avenues for obtaining the data have been exhausted before applying for an overseas production order. On the relevant evidence test, under schedule 1 to PACE, there are certain conditions that must be satisfied before the judge can order the production of special procedure material. Under these conditions, first, there must be reasonable grounds for believing that the material is likely to be of substantial value to the investigation in connection with which the application is made. Secondly, there must be reasonable grounds for believing that the material is likely to be relevant evidence, which means, in relation to an offence, anything that is admissible in trial for that offence. Thirdly, it must be in the public interest, having regard to certain matters, for the material to be produced.

Only the public interest and substantial value conditions are included in the Bill. That was deliberate drafting to ensure that our law enforcement agencies have the powers they need to gain access to material that could help further investigation, even if that material is not necessarily admissible as evidence in court. Although the intent of the powers is to allow for data gathered to be used as evidence in court, we do not intend admissibility as evidence to be a barrier to obtaining material that has been identified as being of substantial value to an investigation. My officials have worked closely with operational partners to understand the need for this. Investigators from law enforcement agencies advise that there are often cases in which access to data is fundamental in discovering certain leads in an investigation, although they will not necessarily be used as evidence in court. For example, if someone is being investigated for storing inappropriate images of young children, an overseas production order could reveal further references to other platforms where inappropriate content was being stored. While the images themselves would be used as evidence in court, the lead to the platforms on which they were stored might not be.

I will give another reason. Unlike PACE, the Bill allows for the investigation of terrorist offences. It has been drafted to mirror the relevant parts of the Terrorism Act and POCA, neither of which has a requirement for relevant evidence tests to be met.

The concept of relevant evidence works only if an application is made in relation to a particular offence. That is why it does not exist in the Terrorism Act, under which an application does not have to be made in respect of one particular offence, but only for a terrorist investigation. Given that an overseas production order made under the Bill could be served in support of a terrorist investigation, we cannot simply import a relevant evidence test into the Bill, as in PACE. I do not believe that introducing a markedly different legal test depending on the investigation is helpful.

I reiterate that the Bill deliberately brings different police powers under one piece of legislation. The intention is to create a single set of test criteria, which the Government believe provides appropriate safeguards to accessing content data.

In a way, the Minister has answered my point, but I will still prod him in this direction. If we will not have the same three limbs as in PACE, is there no justification—notwithstanding what he just said, which makes it more complex—to have two separate related texts? One could have terrorism-related activity under the Bill, and one could not and could follow the three limbs of PACE.

We are in the process of trying to balance the safeguards. Let us remember that the Bill effectively covers a relationship between the law enforcement agencies, the courts and the CSPs—not the journalists or the person under investigation or anybody else. Journalists will be notified effectively to make a representation to a court about why, for example, half of their address book is irrelevant. They have an opportunity to make that point to the judge. Nobody else does. That provides a different type of safeguard from what my hon. Friend is looking for.

The point is well made about an investigation. Many of these investigations are about discovery and are very fast moving; starting with one mobile telephone number or one individual, it very quickly becomes a plot in a terrorist case. It is therefore about giving our law enforcement agencies the ability to pursue an investigation. However, when the investigation comes across journalistic material, the journalist will be given a notification that they are allowed to make a case for why it is irrelevant and effectively influence the parameters of that request. I venture that a judge would take that very seriously.

Some 99.9% of journalists do not have anything to fear from this process. The ones who do have something to fear are those who call themselves journalists at the Dabiq or Inspire magazines from Al-Qaeda and IS and so on, who pump out propaganda and journalism, as they see it, around the world. They have something to fear because this Bill will help us catch those people much quicker. I do not call them journalists, however; I call them first-class terrorists. Ultimately, they are the ones who would love to see bureaucracy slow down the investigation. I do not think our journalists—mainstream journalists, law-abiding journalists, and not even mainstream journalists—have anything to fear from this.

Another point was made about exhausting all avenues of accessing journalists’ data before an overseas production order is granted. First, if the amendment were incorporated in the Bill, that could have the adverse effect of compelling a judge to ensure law enforcement agencies have tried the mutual legal assistance route, which is the route we are currently trying to fix because that can take up to two years before an overseas production order can be granted. That would defeat the point of our creating this new process to prevent up to two years of delays via MLA. The caveat the hon. Member for Torfaen has added to his amendment with the phrase,

“tried without success or have not been tried because it appeared that they were bound to fail”,

would not mitigate this risk either. We are not worried about MLA failing, but about the length of time it takes to gain access to vital evidence.

It is worth noting that, in practice, law enforcement agencies would have exhausted less coercive methods of obtaining data, if they exist. Agencies will only go through the process of applying to court for potential evidence as a last resort in the investigation, for example, should suspects refuse to release or unlock access to their phones and so on. I therefore urge the hon. Gentleman to withdraw his amendment.

Clause 12 states:

“An application for an overseas production order must be made on notice if there are reasonable grounds for believing that the electronic data specified or described in the application consists of or includes journalistic data that is confidential journalistic data.”

Amendment 3 is designed to broaden that notice requirement to include material that might not be counted as strictly confidential but is nevertheless sensitive. When there is an application for journalistic data, amendment 10 would mean that the court must not determine that application in the absence of the journalist affected, unless the journalist has had at least two business days to make representations, or the court is satisfied that that would not be appropriate on a number of other counts. These two matters are important, and I urge the Minister to consider them carefully.

The notice requirement often enables a negotiation to take place between the media organisation to which the journalist belongs, or the journalist themselves, regarding what data it is appropriate to provide. It would also enable the media organisation or journalist formally to oppose the application if necessary. We believe that those are important safeguards. The notice requirement is helpful for the overall protection of journalistic material that we have discussed during our deliberations on a number of different clauses, and it is a fundamental aspect of fairness in such situations. It is not that there is a blanket exception to material becoming available in appropriate circumstances, but the amendment would introduce an appropriate balance that allows the journalist or media organisation to put forward their concerns and try to ensure that we protect our free press and investigative journalism—something I am sure all members of the Committee wish to do.

I will be brief because the hon. Gentleman said much of what I wish to say, but I wish to endorse it. The amendment would make the clause consistent with the Police and Criminal Evidence Act 1984 and apply it to all journalistic information, rather than just confidential information. I would be pleased if the Minister considered such a provision.

The point has been made—perhaps I can extend it—that such a measure would also save a lot of time and administration. If journalists are given an opportunity to negotiate with more notice, we will not find that matters reach the stage where it is too late. I am led to believe that the procedure works very much on a negotiation basis. On that basis, I think this measure is fair and consistent with domestic matters, and that it will also make for more administrative justice through our court process. I therefore support the sentiments behind the amendment, and I hope that the Minister will consider it.

I say gently to Opposition Members that, to a certain extent, and judging by what the Minister said earlier, we could perhaps have flexibility in this area and make the Bill work better if they do not seek to drive a coach and horses through the Bill with an amendment that is completely outside its scope and could potentially take it to pieces. I make those gentle points to those on both Front Benches.

The hon. Lady, who has done so much work in her constituency and in the House on knife crime, not least through chairing the all-party parliamentary group on knife crime, is absolutely right. Sadly, we know that more young people are carrying knives because they think, wrongly, that it will offer them protection. That is where education is critical.



I am extremely grateful for the work the APPG and the associated charities are doing to try to educate young people. One has only to visit the Ben Kinsella Trust, for example, to see the powerful message it delivers, as one makes one’s way around the exhibition, that carrying a knife simply does not offer such protection. Indeed, many young people are killed by their own knives. That is very much part of the early intervention work, which I will outline in detail.

Social media is a driving force in serious violence and in escalating gang violence, due to the reaction of young people to supposed signs of disrespect or, indeed, encouragements to commit violence. A range of risk factors can affect a person’s vulnerability and susceptibility to becoming a victim or perpetrator of serious violence through a range of adverse childhood experiences, such as domestic abuse, truancy and exclusion. The strategy also sets out the evidence and support for targeted interventions that can help to mitigate, and protect children and young people from, these factors.

I will talk first about tackling county lines and the misuse of drugs, because county lines is the first of the four key areas of action set out in our strategy. County lines is a horrific form of child criminal exploitation, and it involves high levels of violence. I am grateful to colleagues on both sides of the House for raising awareness of county lines. Sadly, in the last year or so, we have all become familiar with county lines, and it is precisely because of the questions posed in debates in this place, as well as a very informed campaign by the police and others, that the public are now much more aware of this type of crime.

We have a cross-Government programme of action to tackle county lines, which includes investing £3.6 million to establish a new national county lines co-ordination centre to enhance our intelligence capability and to support cross-border working to disrupt county lines criminality, while also ensuring that vulnerable children and young people are identified and safeguarded.

The new centre became fully operational in September, and it carried out its first week of intensification, to use the police terminology, in October, which resulted in 505 arrests and 320 individuals being safeguarded. That is an extraordinary amount of work in one week, and it shows the scale of the challenge to policing and social services colleagues. The serious violence strategy sets out further measures we will take to enhance our response to drugs, building on the drugs strategy of 2017 and providing further support in targeted areas, such as through heroin and cocaine action areas.

As has already been mentioned, the evidence to support early intervention is set out in our strategy, and a focus on early intervention and prevention is at the heart of a public health approach. That is why we have already delivered on our early intervention youth fund, allocating £17.7 million to 29 projects that will focus on diverting vulnerable young people and those who have already offended away from crime. The projects, supported by police and crime commissioners across England and Wales, will work with young people who are already involved in criminality or who have already offended, and with organisations safeguarding those at risk of gang exploitation and county lines, to deliver interventions to help them into positive life choices. Earlier this year, we also launched a major social media advertising campaign aimed at teenagers, #knifefree, to raise awareness of the consequences of knife crime and discourage young people from carrying knives. That has been supported with the creation of a #knifefree lesson plan and resources for teachers to use in schools.

As I have said previously, a multi-agency approach and local partnerships are vital. That is why we placed PCCs at the heart of our early intervention youth fund and why we are running a series of engagement events for interested and relevant agencies and partners across England and Wales. The aim of the events is to increase awareness of the strategy’s key messages and actions, and understand what action is being taken locally. The events allow partners to share good practice and feedback on further support and what further action needs to be taken. Three events have already taken place in London, Luton and Bristol, and at least 10 further events will take place next year. I have attended one of them and they are very powerful programmes, allowing people to give good advice and to ask questions to improve their local response. We have also made available funding of £1.5 million for 68 projects from the anti-knife crime community fund. The funding supports communities to tackle knife crime, including through early intervention and education, as well as mentoring and outreach work. I hope hon. Members have received letters from me informing them of local projects that have received those donations.

Finally, the strategy sets out further action we will take to enhance the law enforcement and criminal justice response, including tackling social media and continued targeted action on knife crime. On 17 June, the Home Secretary announced funding of £1.4 million to support a new national police capability to tackle gang-related activity on social media. This new police “hub” will be fully operational early next year and will focus on disrupting gang criminality online, as well as identifying and referring more content to social media companies to be removed. In addition, we are taking action to ensure the police have all the powers they need to tackle violent crime. We have introduced a new Offensive Weapons Bill to strengthen our legislation on knives, corrosive substances and firearms. The Bill has completed its passage through this House and had its First Reading in the House of Lords on 29 November. We have continued to encourage police forces to undertake a series of co-ordinated national weeks of action against knife crime under Operation Sceptre. The last operation was in September, when all 43 forces in England and Wales took part, as well as British Transport police. Our newly published serious and organised crime strategy also sets out a framework for how we will use our national, regional and local capabilities to disrupt and target serious violence activity through county lines, for example.

Will the Minister, in her conversations, encourage the police to use the powers they have? Let me give one example on this. A gang who were glorifying violence were convicted and banned from making any music videos—putting them online—unless the police gave their approval. The police then approved one video that had shocking lyrics glorifying gun violence. No wonder campaigners have their head in their hands when the police make decisions such as that.

I thank my hon. Friend for his intervention, and I was grateful for the particular interest he took in the Offensive Weapons Bill. I am not familiar with the case he has raised, but if he provides me with the details, I will certainly look into it. When the police ask us for powers we do our level best to provide them, but I, too, would like to see those powers used sensibly when they are provided.

I listen to and consider that with great care, but I must make the point that I would like to support our young people and give them the reassurance that if they do not want to be listening to or watching videos that are incredibly violent—as I say, I am not familiar with the example my hon. Friend the Member for Bexhill and Battle (Huw Merriman) provided—we can take a stand and say, “Actually, we don’t want to see those levels of violence online, because it helps feed a narrative and a very negative atmosphere for our young people.” This is one of the debates we will continue to have, not least through the introduction of the online harms White Paper, and in the context of not just serious violence, but depictions of women in music videos. This is one of the big debates of our time, but I would not want our young people to think that we feel it is okay for music videos to be targeting them with images of extreme violence, with foul language and with foul depictions. We should be doing a bit better than that for our young people.

I will indeed write to my hon. Friend, but I should make it absolutely clear that I was not talking about an “environmental issue” and I am not a prude; this video referred to taking a gun, going into a block and using it, pop by pop—and the rest. So this is shocking stuff. The other point I wish to make is that TimWestwoodTV is still on YouTube. There are 32 examples where breaches of the law have been found, with glorifications of violence and misogyny and shocking lyrics about gun and drug use. Some 100,000 people watch each of these videos. He is an absolute disgrace, but so is YouTube for even hosting him.

It is a pleasure to follow the hon. Member for Cumbernauld, Kilsyth and Kirkintilloch East (Stuart C. McDonald), although I was rather hoping to follow the hon. Member for Streatham (Chuka Umunna)—not just because he has an easier constituency to pronounce, but because I will be referring to parts of my life when I worked in his constituency. The Minister mentioned that many Members want to speak about their constituency, but I want to speak primarily about a time in my life when this issue was a real cause and passion, and not to use my voice in this place to carry that on would seem a complete waste.

My time was spent working in a youth organisation in Brixton. It was formed after the Brixton riots of the ’80s, and we had two sites—one was on the Moorlands estate and the other was further down Coldharbour Lane towards Camberwell Green. I spent my time there because originally I had worked as a barrister and found myself dealing with a lot of young offenders on the criminal side of things, when it was frankly just too late. By that time, it was hard to change their path, even if they got an order that would allow them to do so, rather than going into custody. I left the Bar and then went into finance, where I was surrounded by people whose life was great. I thought to myself, “I need to put something back and reach out to see where I can help” so that I could stop young people getting into the situation in which I had met them in my previous career.

That is what took me to that organisation as a trustee, fundraiser, staff manager and volunteer, and my goodness, we did some amazing things together. We funded teachers to provide after-school education, particularly for young children who were excluded or were just skipping school. We made it more fun, so that they would actually turn up. We also had a whole range of sports activities, which included horse-riding in inner-city London. We had a huge amount of environmental projects. Our football teams were absolutely fantastic. We basically got kids out of a life where it was all about gang culture and we made it interesting, exciting and gave them something different. To actually see their choices and the paths that they went on, and the success that many of them achieved, despite the odds, was absolutely incredible. I then moved on and spent five years as a governor in a failing school, when I moved to another part of London. Again, it was interesting to see the educational impact and, again, how a situation could be transformed through great leadership, great funding and everyone working together. That is what brought me here.

This morning, I tried to track down that organisation, and while doing so, I ended up speaking to a remarkable person, who I think is just outside the hon. Gentleman’s constituency in Denmark Hill. It was interesting chatting to that community and family worker about how things are now compared with how they were when I was there in the five years from 1997 to 2002. It confirmed to me that things have got worse, which is so depressing. She feels that young children are more at risk than they were when I was there, and talked about the impact of smartphones and the fact that people can get their gang together quickly—it is so fast and people do not get the chance to think, “What am I doing?” and turn around. She specifically mentioned the music lyrics, which she believes incite young people to commit violence. I heard what the hon. Member for Walthamstow (Stella Creasy) said, but when I speak to people such as that lady, who is on the frontline—she has kids and sees it—they tell me that they absolutely believe that it causes others to follow and glamorises that culture. That is why I say what I say. I am not a big fan of censorship, but when things get this serious, we have to look at it, and do something about it and the people who do it.

I completely and utterly agree with the hon. Gentleman. There have been incidents in my constituency. Drill music went up online from one gang calling out another gang bragging about a murder in the constituency. The music should have been taken down fast but my police services did not have the resources they needed to do it, and we did not have the access we needed.

We talked a bit about this earlier. I gave an example of when the problem was not police resources—in my example, the police had the power but allowed videos to be published. We heard about police funding earlier. Hopefully, if that was the problem, things might get a little better.

Companies such as YouTube should be forced to take those videos down. I mentioned Tim Westwood. A number of gangs have appeared on his YouTube channel and people have lost their lives. The evidence seems clear to me and I find him to be incredibly irresponsible in how he promotes this music.

The lady I spoke to was interesting. Her youngest is 22 and has gone on to do great things. She said that things have got so bad now that, if he was of primary school age, she would have moved out of London, which makes it incredibly stark. She also made the point that teachers no longer have the respect of pupils. We have spoken before in the House about teachers spending far too much time on too many other matters, which has an impact on their ability to be seen as leaders in the classroom. Youngsters know that they can get away with it. She also gave me a shocking example of young boys who have located here from Nigeria being sent back to keep them safe. It is incredibly frustrating that I spent five years in that area and now find that things are not getting better, but are in fact getting worse, which is why more must be done.

I pay tribute to the hon. Member for Lewisham, Deptford (Vicky Foxcroft). I cannot remember a week in Parliament when I have not heard her say that we need to be talking about this, and we finally are. I had expected to see her name on the Order Paper, but this is a Government debate. I congratulate her.

The question is what to do. I welcome the Government’s £200 million youth endowment fund and note that bidders are being sought. The fund is to be independent, but does that mean independent of profit or independent of the Government? Perhaps it is both.

Ultimately, as the title of the debate suggests, as experience tells me, and as the shadow Home Secretary said, we cannot arrest our way through this process. It is all about tackling the early signs and making interventions to ensure that we never reach the point at which that young person is arrested, or where there is a victim. I am thinking not only of the victim of a crime, but of the perpetrator, their families, and the hospitals and trauma services—there are so many victims of that one fleeting moment when someone uses a knife. I support the money, but it is critical that it is well spent. We have seen the examples from Glasgow, which is a model we need to follow or at least look at closely because the results have been extraordinary.

Alongside that, I want to press the Minister again because knife crime has got so out of control. The Offensive Weapons Bill is currently going through this House, and I welcome that, but on Report, as the Minister will remember, I supported a couple of amendments tabled by Opposition Members. One was about the ability to get hold of knives. If people shoplift and knives are not in locked cupboards, they have their weapon. The Minister told me that there was a code of practice to which many retailers were signing up, but what worries me is the number of irresponsible retailers who will not do so, and who might even see knives being taken and do nothing about it. I was talking to someone from the Ministry of Justice who had walked past a place—again, I think it was in Streatham—and saw a meat cleaver hanging from a rope.

Let me say to the Minister that if we are not seeing a reduction in this type of crime in six months’ time, I think it would be responsible of our party to look at that amendment again. As I said then, if I decide to kill myself by walking into a shop to buy a packet of cigarettes, I will find that the packets are in a locked cabinet. If I decide to walk into a shop and shoplift a knife to kill someone else, the knife will not be in a locked cabinet, which makes no sense to me at all. Public space protection orders, which the Minister has considered before, might work to that end as well.

The other amendment that I thought had a lot of worth was tabled by the hon. Member for Hampstead and Kilburn (Tulip Siddiq). It would make moped use in knife or acid crime an aggravating factor. If there is no reduction in that type of crime, I think that the Government should discuss such a measure.

Let me make one more point. Have I hit nine minutes yet, Madam Deputy Speaker? You will tell me, anyway—or you will just look daggers at me.

I have talked about the constituency of the hon. Member for Streatham, and I will listen with interest to what he has to say about where we are at the moment. The sad reality is, however, that I have covered 200 square miles, largely rural, where I would not necessarily have expected to be dealing with this issue. After I spoke in the Offensive Weapons Bill debate, a constituent reached out to me because her son—she told me, in desperation—had been taking knives, and stealing them as well. She had been told by another parent that their child had been threatened with a knife by her son. He then went missing with the knife. She contacted the police, who said that she would have to wait until the next day to report him as a missing person, and did not take the knife aspect at all seriously or do anything about it.

I take the point about police resourcing, and it is great news that we have additional police resources, but I also think it is incredibly important for all of us, as Members of Parliament, to press our police to ensure that they are doing their job and taking this issue very seriously indeed. While we cannot arrest ourselves out of the situation, when a young person is out there with a knife, the police need to take that seriously and deal with it. It is not a missing person; it is another crime statistic about to happen, and another person about to become a victim.

I am not sure whether those people are primarily ex-servicemen and women, but I am sure that a lot of them shoot. A lot of children learn to shoot on the range in my constituency, which is an important part of the community that provides an important sporting outlet for disabled people, who cannot do other sports and hugely enjoy their shooting.

I thank my hon. Friend for giving way; he is being extremely generous. I would ask him to consider this scenario, which happened in my local shooting club. Somebody who was clearly quite troubled was able to book up all the shooting lanes and then held up the shooting range official, took the guns and murdered two women a mile away from my constituency border. My hon. Friend talks about the illegal versus the legal and about the risk being minimal, but when things go wrong, even in minimal-risk circumstances, it can have devastating impacts. That is why I find myself a little hesitant about what is now being changed.

My hon. Friend makes a very fair point. Firearms are potential very dangerous things to use. I can only say to him that, as I said before, the number of legally owned weapons used in crimes is very limited, although that is not to say that we do not have a gun problem in this country. We certainly do, and we need to address it.

I am grateful to the hon. Gentleman for reminding me of the proposals that were brought in for Northern Ireland.

New clauses 18 and 19 are reasonable. A lockable cabinet and a lockable trigger guard will ensure that children and young individuals, who do not realise the potential power of these weapons, have more difficulty accessing weapons whose legal owners may currently keep them in an unlocked cabinet and without a trigger guard. I think the Minister needs to look at this, and I hope that she will support the new clauses. If she will not do so, I hope for a good explanation why not.

I wish to speak to Government amendment 26 and other related amendments. I had not intended to speak, but I feel duty bound to do so. Some time back, when the proposal to ban .50 calibre weapons came to the fore, like many of my Conservative colleagues, I wrote to the Minister to ask for the evidence base for it. The response I got back did not ultimately persuade me that there was such an evidence base. I think of myself as a libertarian, and if we are going to ban anything, there needs to be a justification for doing so. I was very much part of raising that query and concern.

I absolutely supported the amendment tabled by my hon. Friend the Member for The Cotswolds (Sir Geoffrey Clifton-Brown), which would have tightened up some of the rules around gun clubs with regard to these weapons. I am speaking in order to do almost an about-turn—I touched on this in my intervention during my hon. Friend’s speech—and this has really come to light for me. The issue is not so much about the .50 calibre weapons. I take the point, and it is well made, that one would not be able to remove and use this type of weapon in such a way; they are used for a specific purpose. None the less, if we are not careful with our gun clubs and do not make sure that the rules are tight, there will be situations where there are breaches that have tragic consequences. I want to reference what I touched on in my intervention.

I will run through the exchange that happened during the court process. Mr Craig Savage, the constituent I referred to—in fact, this happened just into a neighbouring constituency—managed to book his local gun club. It is my local gun club—I have actually used it—and the same one that has written to me to try to persuade me how safe it is and what a great pursuit the sport is.

I refer the House to my entry in the Register of Members’ Financial Interests. Does my hon. Friend not agree—I am aware of the point he is about to make—that gun clubs provide a sport that is gender-blind, ability-blind and age-blind, and that target rifle shooting is one of the most egalitarian sports available?

My hon. Friend is absolutely right. Gun clubs do, indeed, provide such a sport. I will suggest to the Minister where we can support them in their endeavours and actually make things better. Quite frankly—and gun clubs are aware of this as well—if they do not fulfil their role in a safe and secure manner, they know full well that it will be very hard for us, as their representative MPs, to justify their continued existence.

I want to take the House through the transcript involving the defendant and 1066 Target Sports. The defendant had asked whether he and a friend could book a live fire at 6.30 pm on the Friday. In one email, he asked whether it was busy during that time, and he later took up the offer of booking out all the lanes so that he and his friend

“could have the place to ourselves”.

I am sure colleagues are wondering why, at this point, nobody smelled a rat. The next day, he emailed to say that his friend had dropped out and he would have to “swing back another time”.

The defendant arrived at the complex at about 5 pm on the Friday of the shooting and was met in reception by Mr Graves, the deputy manager. Mr Graves said that the defendant had mentioned that he had prostate cancer and did not have much time to live. During the live firing he spoke about religion and rifles, and he made reference to “police-assisted suicide” and wanting to be “remembered as a man”. The defendant then went to the toilet. While the deputy manager was reloading, the defendant returned, wrestled the gun away, aimed it at his chest and said, “I will not hurt you, but I will need you to open the door”, which he duly did.

The defendant then made the 10-minute journey to Bexhill Road, where at 7.40 pm Raven Whitbread, her mother Heather Whitbread and her sister Michelle Savage were sitting in the lounge relaxing and eating a meal. Suddenly the defendant smashed through the window. Raven was told by her sister and mother to hide, as she was seven months pregnant. Raven said that she saw Craig Savage standing over her sister, and then she saw her body jolt. She ran into the annexe to call the police. Her mother was shot dead thereafter.

That is what happens if we do not get this right. People lose their lives in tragic situations because sometimes we too blindly see the risks as being so small that they will not occur. But when the law is broken, tragic events occur and people lose their lives. I think that we are duty bound not to say that the risks are so small that we should not control legitimate behaviour. We should ensure that those risks are minimised even further, and reduced to zero if possible.

I am asking the Minister whether we can look at gun clubs to ensure that they are made more secure, along the lines that my hon. Friend the Member for The Cotswolds talked about, and really to look at a wholescale review and reform of gun clubs. If we do—I will tell my local gun club this—I just cannot support them.

I will keep my remarks brief, as you have requested, Madam Deputy Speaker, because we are shortly to vote. That was a brave speech by the hon. Member for Bexhill and Battle (Huw Merriman). I hope that the Minister would accept that I am prepared to support the Government when they do the right thing on national security, and that therefore it is not out of overt partisanship that I think this cave-in is truly shameful.

I feel sorry for the Minister, because I think that it is the Home Secretary, or indeed the Prime Minister, who should really be here to account for why they are now disregarding all the advice they have received from the police and intelligence officials and caving in to—I have to say it—the backwoodsmen and, occasionally, women of their own party, rather than seeking to govern in the national interest on security. There was a way here whereby a Government who either had a level of authority or were prepared to reach across the House to do the right thing on national security could have got a clear majority for this important measure.

The threat of terrorism in this country is growing. It is inadequate, and potentially morally bankrupt, simply to say that because there has not been an attack recently, since the IRA threat, then there will not be one in future.

My right hon. Friend makes a really important point. That is just another huge loophole in the Bill that will have an impact on British businesses, forcing them to be unable to compete. Ahead of Small Business Saturday, I really hope Ministers will take that under consideration.

In response to my question earlier, the Minister responded that the simple difference would be that people would just have to go to a post office to sign for these goods. In areas like mine, people often travel as far as six or eight miles to get to the nearest post office. That is a long way, so why would they not go to the nearest B&Q or other big store to buy all their DIY needs? We are driving out small online businesses who have struggled to get themselves up and running. They are losing out yet again to major stores, because we are making their customers’ lives more difficult.

My constituent is just one example of many small and medium-sized businesses across the country that could be inadvertently affected by the Bill. Small businesses are the lifeblood of our economy and local communities, and we will all be celebrating them this weekend. I am sure the Government did not intend for the Bill to unjustly penalise online retailers and I am sure this is just an oversight in the drafting. The proposed legislation already makes very specific exemptions on bladed items for activities such as sporting or re-enactment. It would therefore not be unreasonable to extend that flexibility to decorating items which similarly support a genuine public purpose and are used regularly by law-abiding citizens.

I would also like to speak in support of amendments 8 and 9, tabled in the name of my hon. Friend the Member for Sheffield Central (Paul Blomfield), which seek to address the same problem. There will obviously be a number of other businesses—we have already heard today about the importance of Sheffield steel and Sheffield knives—affected by the poor drafting of the Bill, including in the catering and the arts and crafts industries. The amendments would create a trusted trader status entitling qualifying businesses to sell bladed products to residential premises, creating another means of protecting such legitimate businesses. As long as there was not a resulting excessive administrative burden or unnecessary delays to trading while registering, the trusted trader approach could be an effective means to ensure a satisfactory balance between necessary restrictions on the sale of blades to those who intend to use them as weapons, and ensuring legitimate businesses can continue to operate.

The Minister raised the point about overburdensome regulation in opposition to the amendments. Again, she is already asking people to send their customers to the post office, so that we try to make sure that they are not selling to those under the age of 18. We are already putting such restrictions on people. I do not think it is that burdensome to ask someone to register as a trusted trader, which is a positive thing for them to sign up to and would enhance, not jeopardise, their businesses.

I hope that the Government will look again at the amendments and recognise that there is, I am afraid, a serious flaw in the drafting of the Bill. I hope that they will work with the Opposition to amend the Bill as it continues its passage through the House, while engaging fully with the retailers and others affected. Otherwise, I am afraid that the Bill as it stands will have a disastrous effect on many of our hard-working small businesses, which are the lifeblood of economies such as mine.

It is a pleasure to follow the hon. Member for Redcar (Anna Turley), who is a fellow Arsenal fan and one of the nicest people in this place—[Interruption.] There was no career to lose—at least for me.

I want to speak about new clauses 5 and 26. I am conscious that the hon. Member for Hampstead and Kilburn (Tulip Siddiq) has not yet spoken, so I will leave time for her to do so. Generally, I am very supportive of the Bill, and I am very concerned that the number of offences of violence against the person recorded by the police in 2017 was 21% higher than in 2016. That demonstrates the need for more to be done across the House to support the police. There was also the highest level of offences involving knives or sharp instruments since 2011, so we clearly have a problem. This should not be a party political issue; it should be for all of us as constituency MPs to work together to deliver a solution. That certainly came through to me last night, when I was due to be meeting a friend—not just a friend to me, but to many in this place—who works for Save the Children and who I went to the Syrian border with. She did not turn up to the meeting that we were due to have because she was attacked and mugged by somebody carrying a large knife. She is well known to us all, so this is going on in our communities.

Let me deal with new clause 5. I am indebted to the Minister, who is not in her place, but we spoke at length this morning. When I look through the clause, which was tabled by the shadow police Minister, the hon. Member for Sheffield, Heeley (Louise Haigh), it is very difficult to see anything in it that I would not agree with. I can see that the issue may be the impact that it could have on small businesses. However, if I wished to harm myself by going into a shop and buying a packet of cigarettes, those cigarettes would be behind a counter locked in a cabinet, often in very small premises, yet if I wished to harm somebody else, I could go into a shop and pick up a bladed article to do that. Of course, the issue is with regard to shoplifting. Although I absolutely agree with the need to support small businesses and be proportionate, I say to the Minister, through the Front Benchers who are here now, that if we find out from a review over a period of months that we still have difficulties with knives, and that the measures taken on internet restrictions and delivery to addresses have not dealt with this matter, the new clause will need to be looked at again. I therefore ask those on the Front Bench, in return for me supporting their position and the Bill overall—notwithstanding that I think the new clause is excellent—to ensure that we see the new clause again if it is absolutely demonstrated to be necessary.

When I was speaking to the Minister, I had the feeling that we were looking for other solutions, because if we compare the scenario in south London, where knife crime is prevalent, with my constituency, where it is not as prevalent, we see that a one-size-fits-all ban across every single shop may not be proportionate. However, we do have public spaces protection orders, which were brought in to allow local authorities to put orders in place to prohibit certain behaviour relevant perhaps just to that community. Such an order can be applied for if the activities are being carried out in a public space within an authority’s area and those activities have a detrimental effect on the quality of life of those in the locality and are likely to be persistent, unreasonable and justify such a restriction—so, something as crucial as knife crime should fit within that.

I understand from the Minister, who is back in her place, that the difficulty is that the definition of “public space” would not include a shop. I am sure that that has been tested legally. I was trying to find the research, and in the short time I had I could not do so, but I did notice that the US definition would actually include a shop because, in effect, it only precludes areas relevant to a private gathering or other personal purposes. I understand that a “public space” would tend to be open, but I would ask if lawyers could reconsider whether that is relevant and, if it is, whether local authorities in areas where knife crime is prevalent should be able to apply for such orders. That would have the same effect as the new clause.

I understand it is the law, but it also sends out a certain message, does it not? The police are looking for our support in dealing with an incredibly difficult problem. I have mentioned how it is blighting many constituencies, including those of Opposition Members. To send out a message that they should not be doing this, and thereby to focus on the police rather than the perpetrators—I made a similar point to the hon. Member for Sheffield, Heeley about new clause 5—is rather demoralising for the police.

Unfortunately, there is not time for me to address all the amendments in the group, but I thank my right hon. Friend the Member for East Ham (Stephen Timms), my hon. Friends the Members for Bristol South (Karin Smyth), for Sheffield Central (Paul Blomfield) and for Redcar (Anna Turley), my right hon. Friend the Member for Delyn (David Hanson) and my hon. Friend the Member for Hampstead and Kilburn (Tulip Siddiq), who have all tabled reasoned, evidence-based amendments that would significantly improve the Bill. I support them all wholeheartedly.

The hon. Member for Bexhill and Battle (Huw Merriman) was very kind in offering his support to new clause 5, which would introduce a simple prohibition on the display of bladed products in shops. The new clause is the result of a huge amount of work led by my hon. Friend the Member for Lewisham, Deptford (Vicky Foxcroft), who is chair of the cross-party Youth Violence Commission. One of her most important recommendations was the prohibition of knife displays in shops, a matter that was discussed when experts gave evidence to the Committee. The Union of Shop, Distributive and Allied Workers said that it would be helpful to put knives behind displays in shops. A representative said:

“Obviously, now big retailers are increasingly going down the route of making it more difficult for customers to get their hands on the product until they have been age-checked and the transaction is safe. The problem with it, of course, is that all sorts of bladed things are being sold and it is about where you draw the line.”––[Official Report, Offensive Weapons Public Bill Committee, 19 July 2018; c. 98, Q239.]

Obviously we want retailers to check people’s ages properly when they seek to purchase knives, but the fact of the matter is that many young people who want to access knives will go into shops and steal them if they are readily available. Ultimately, there is little point in having the provisions in the Bill, and putting all the restrictions and burdens on online retailers, if we are not asking face-to-face retailers to abide by the same regulations.

There are a number of restrictions under the law relating to other products—most obviously, the extremely restricted provisions relating to the sale of tobacco, which prohibit the display of tobacco products except to people over the age of 18. The Tobacco Advertising and Promotion Act 2002 specifically refers to under-18s, so the principle already exists in law. New clause 5 simply transposes to knives the already sufficient and proportionate response to tobacco. As the hon. Member for Bexhill and Battle said, if we walk into a shop and buy cigarettes with which to kill ourselves, they will be behind locked cabinets. A young person, or any person, who walks into a shop and steals a knife in order to kill another person is free to do so: as things stand, the knives are not even behind locked cabinets. We see no reason why that should not be extended to bladed products. Given that the Government are so committed to clamping down on online sales, we hope they recognise that face-to-face sales are a clear issue that needs further consideration.

While we are on the topic of restricting the supply of knives, let me turn briefly to the amendments tabled by my hon. Friend the Member for Sheffield Central. The clause to which they relate was debated extensively in Committee. We fully support the Government’s intention, but are worried that the clause may punish businesses while having little impact on the ultimate aim—to reduce violence.

I remain baffled as to why the Home Office has not simply put strict age verification controls on the sale of knives online, as it does, for example, with gambling, but instead has chosen to punish the online sales industry and traders such as those mentioned by my hon. Friend the Member for Redcar. My hon. Friend’s amendments are very reasonable compromises, put forward by the very businesses that the Minister claims have complained that they are too bureaucratic. I fear that the clause has not been thought through sufficiently, and will have untold consequences.

New clause 1 was tabled by my right hon. Friend the Member for Delyn, whom I congratulate on his incredible, impassioned speech and the fantastic campaign that he has mounted. We have made clear from the outset that we are prepared to support amendments to protect shop workers. In Committee, we heard powerful evidence from USDAW and the British Retail Consortium about the increase in the number of attacks on shop workers as a result of restricted sales, and we wholeheartedly support any measure that which will improve their protection. I congratulate USDAW on its brilliant campaign.

Let me now deal with new clause 31. The death of a pregnant woman, Sana Muhammad, just a few short weeks ago in the constituency of my hon. Friend the Member for Ilford North (Wes Streeting) has, in his words,

“shocked people…to the core.”—[Official Report, 14 November 2018; Vol. 649, c. 310.]

She was attacked in front of her five children by a man with a crossbow, and was tragically pronounced dead a short while afterwards. That tragic case has brought to light, once again, the remarkably weak controls on crossbows, which have lethal effects. It is incumbent on us as a Parliament to decide whether we are comfortable with circumstances in which a lethal weapon is freely available to anyone over the age of 18, with no licensing restrictions at all.

There have been many tragic and disturbing incidents involving crossbows, and the law as it exists has developed only incrementally. Our new clause would create a licensing system. That is not a step that any Parliament should take lightly, but we believe that it has the potential to remove the unregulated sale and possession of some of the most lethal crossbows, while also ensuring that the law-abiding community who use crossbows for sporting purposes are still able to carry out their legitimate pursuit. The clause also creates safeguards which allow further consideration of the power under which a crossbow would become subject to licensing provisions, allowing the Secretary of State to make regulations determining the appropriate draw weight.

Our new clause 6 calls for a report on the causes behind youth violence, a topic that is not discussed much in the entire debate around offensive weapons. The new clause goes to the heart of our issues with the Bill and the Government’s seriously weak serious violence strategy. The strategy was published only in April yet we have already seen a U-turn from the Home Secretary, finally agreeing that the public health model must be adopted and that agencies need to be working better to tackle violence. We have been telling the Government all of this for at least the last year, so we are pleased to see progress, but we are alarmed that the strategy is so desperately short on detail. Members hear almost every day from constituents about the levels of crime and the cuts to policing in our constituencies.

The police service is at risk of becoming almost unrecognisable to the public and irrelevant according to the Home Affairs Committee. “Panorama” reported recently that up to half of crimes are being “screened out” by some forces, meaning they get no investigation at all. This is just the latest indication of a police service creaking under the strain of soaring demand after eight years of austerity. When crimes are not being investigated, deterrence reduces and crime rises further still. It is a vicious circle and one the present Government have locked us into with little recognition of their role in it.

Axing the police was a political choice that has done incalculable harm to our communities, and it is a choice that I suspect many Conservative MPs who voted for swingeing cuts privately regret.

I shall not talk for long; the Whips are worried that I might inadvertently talk out the Bill, which of course I would never want to do because I absolutely support it.

As I did not do so earlier, I thank my hon. Friend the Minister for giving me a lot of her time and reassuring me about some measures about which I was concerned. Across party lines, some great suggestions have been made this afternoon. A lot of them came from the Opposition Benches, and I would struggle to vote against them. I hope that in a few months the Minister will assess whether the measures in the Bill as passed will fix some of the issues; if not, we should reconsider new clauses 5 and 26, and perhaps some of the other proposals, because they have a lot to recommend them. Overall, I support the Bill and hope that the House will give it a Third Reading.

The hon. Gentleman absolutely puts his finger on it. I will develop that point in a moment. One thing that I have experienced in my time in practice, particularly in relation to this kind of offence, is that the approach and the attitude of the officer in the case is absolutely crucial. If an officer understands precisely the point that the hon. Gentleman makes, which is that individual instances are not necessarily picked up and allows them to slide, then it can become a problem. On the other hand, if a police officer, because he has been properly trained or is particularly engaged in the case, is excellent at collating that evidence and material to build that picture, that can have a dramatically different impact, first, on the way the victim feels about it, and, secondly, on the remedy that they are likely to get.

I want to develop this other point. One thing that we have not dealt with in this piece of legislation, and that we need to go on to, is to look at the role of technology in all this. What do I mean? An individual victim will always be better and more effective at recording the litany of instances than the bureaucracy of the police. That is not a criticism of the police, but a statement, I would imagine, of the blindingly obvious. What we need to do is to put into the power of individuals the right, in appropriate circumstances, to record and list episodes as they take place. We might say, “Well, hang on, why don’t you just do that on a sheet of paper?” No, what we should be doing is potentially looking at an app, so that when the police, for example, authorise an app and say that they are going to open an investigation, the complainant or victim can, when there is an incident, record it on this app—what happened, the time that it took place and any photographs that go with it—and that can then be reviewed and assessed by police officers in due course. Otherwise, the danger is that if a person has to go down to a local police station every time their stalker walks past their house, it is terribly bureaucratic and inefficient.

I do not want to go down a rabbit hole, but there is an important role in ensuring that victims are best able to record and collate what, ultimately, will make the difference to an effective prosecution in due course. It becomes 10 times more powerful if the individual can say, “I remember that, at that precise moment, he walked past my house, or he knocked on the door, or he put the letter through my door, or he terrified my children and I will record it at that precise moment, and this is the evidence that I have collated.” That is powerful evidence and we should be helping to facilitate that.

My hon. Friend is making a very persuasive speech. Of course, what will be required is for the police to prioritise their resources to police this new offence. What that will also mean is that they may have to deprioritise other areas, or receive additional resources. I understand that an extra £410,000 is being allocated. Does he think that that will be enough to deliver the measures that he rightly talks about this morning?

It is an extremely important point, and it does build on the point that I was making just now. There is no doubt that if this is not handled correctly—if it is not arranged correctly—there is a danger that it becomes more onerous than it needs to be. The example that I want to develop is the one on which I have just briefly touched. Principally, the old analogue techniques are that if somebody is robbed in the street, the police officer will say, “You are making a complaint, I understand that. Please come to the police station on a certain date and we will sit down and prepare a statement. You, the complainant, will make the allegation of what happened to you in the street. I, the police officer, will write it down. It will be in longhand, running to various sides of paper. You will then sign each page and so on.” That process could easily take an hour and a half. It then gets logged onto a system and so on.

That might be perfectly appropriate where the allegation relates to an incident that took five minutes in, say, a high street, but where the allegation relates to a cumulative total of ongoing events, innocuous in isolation but insidious in combination—to coin a phrase—we need to have a more digital approach. That is why I invite the Home Office to consider digital techniques to allow the police to work as effectively—and to take up my hon. Friend’s point—and efficiently as possible, otherwise there is, of course, the danger of resources being mopped up. The only point that I would say on this resource issue is that there can be few more compelling priorities in circumstances where the evidence suggests, compellingly, that if we do not address this behaviour early it can have very serious consequences. In other words, this is a worthy candidate, I respectfully suggest, for the prioritisation to which my hon. Friend refers.

I thank the hon. Gentleman for that intervention. He is right to highlight that there is a real issue. It is not just physical violence; it can be verbal violence. It is about someone trying to gain power over someone and have them under their control, whether through direct violence, intimidation or other actions, such as constant emailing or the sending of cards, as we have heard. My hon. Friend the Member for Cheltenham made the point that sending a Christmas card might seem innocuous, but it must be seen in the context of the overall behaviour. It can be about the perpetrator being constantly in the victim’s life.

The hon. Gentleman mentioned violence against women. I am a supporter of the white ribbon campaign in my constituency, and I hope he is doing the same—I am sure he is—in his own constituency. This is about men standing up and saying that other men’s violence against women is unacceptable. I have a close relative who experienced a violent relationship for a significant period. She was physically abused—in one case, she was hospitalised by the attack launched against her—but what sticks is the constant name calling and running down. One of the points she used to make was that if someone who did not know them had observed what was going on and then asked what her name was, they would have been given not her name but two swear words put together. I do not need to repeat such language in the Chamber; Members can work out for themselves what sort of language I am referring to. She felt that that was how she would be known.

There was constant denigration and running down, and then when trying to move away from the relationship, there were constant phone calls and texts. Bluntly, it was only when BT’s choose to refuse service became available that a lot of that could finally be brought to an end through blocking the numbers. I wonder whether, if something like the Bill had been available, it might have helped to build confidence in tackling those situations.

It is right that we have clear penalties. We have been clear that this is an additional way of protecting potential victims of stalking, not about replacing existing legislation. For me, this is not just about those who have been in relationships. As I touched on in my comments about the Civil Nuclear Constabulary, such actions may in effect be stalking but are due to other reasons, such as political reasons.

Yesterday, along with my hon. Friend the Member for Witney (Robert Courts) and the hon. Members for Cardiff North (Anna McMorrin) and the hon. Member for Dudley North (Ian Austin), I had a very interesting visit to the Community Security Trust, which works with the Jewish community, and heard about the experiences of some of the people there. The reason for someone in effect stalking or harassing in such cases is based on their faith. Again, it would be interesting to hear what the Minister thinks about someone engaging in the completely unacceptable behaviour of targeting people for that reason, but doing so in a way that looks very much like stalking. She is an eminent lawyer in her own right—a learned Member—and I am sure she will outline how some of these powers might be of assistance.

My hon. Friend is making an excellent speech. Does he agree with me—I make this point not specifically to my own Front Benchers but about successive Governments—that although Parliament is very good at creating new laws, if money, resources and guidance are not provided, the authorities responsible for enforcing those laws cannot deliver on that, which calls the laws into question in the first place? I found that as a district councillor under the previous Labour Government and I am afraid it is happening again. I absolutely support this Bill, but there is a wider point. When Parliament passes a new law, should there be a money resolution not for the Bill to be carried forward but to make sure that it can be enforced and delivered on the ground? Otherwise, we are, I am afraid, misleading people.

My hon. Friend is right. There clearly needs to be an intention not just to pass a piece of legislation—it makes us sound very virtuous, and we can pop our speeches on to our websites when we get back to the office—but to ensure it has a real and clear effect. I am sure that the Minister, who I see has already made some notes, will talk about how the Home Office will seek to work with police forces to make sure this power is used and brought into effect.

I have one slight disappointment. My hon. Friend the Member for Christchurch (Sir Christopher Chope) was due to talk this morning on his amendment 7, which is about when the Bill will be brought into force. Again, when we move on to Third Reading—I hope the Bill will be given a Third Reading later today—it would be interesting to hear the Minister’s thoughts about when she intends to bring it into force. We do not just want to pass the Bill and then leave it sitting on the statute book, but to bring it into force.

I thank my hon. Friend for yet another very well thought through and incisive intervention. I am obviously encouraged to hear that news, as I am sure Members from across the House will be. We probably should be clear that this law is gender-blind—the victim of stalking could be male or female. I remember a case in Coventry, where a male vicar was targeted by a female stalker. I absolutely welcome the funding, which is a sign of the intention to tackle a problem from which, sadly, too many women suffer. When a relationship is breaking down, or even when it is still going, it can go from love and affection to aggression, control and domination.

My hon. Friend should give himself more credit. This comes back to the point made by my hon. Friend the Member for Croydon South (Chris Philp). The Government of course focus resources on certain policy areas. I absolutely agree. They have spent £802 billion—that is what this Government do and they do it well—but when we state that we are spending this amount on a generic area, and that it is not ring-fenced to a particular offence or new legislation, people are somewhat left short. I am thinking of the free bus passes that the previous Government brought in. I was a district councillor, and we found that they were not funded at all, and the district councils took the rap.

My hon. Friend—I visited the Battle part of my hon. Friend’s constituency, at his invitation, earlier this year—makes a valid point. When I was deputy leader of Coventry City Council, the funding for free swimming passes was distributed. Bizarrely, some councils with swimming pools struggled with the amount of funding they received, yet one council received the funding even though it did not have a swimming pool. One council got the bill and another got the funding, so it was a bizarre situation.

To return to the Bill, I know that the Minister, who is in her place on the Front Bench, will be keen to reply to us to confirm how we see it being taken forward, implemented and explained in guidance. We should not get drawn into the amount of additional resource because this is also partly about the police officer who is looking for legal options to deal with a case and a victim. The Bill gives them that option. In many cases, that can be done with existing resources. It is about assisting officers in dealing with a situation that may otherwise escalate into a worse one—with a much more serious crime being committed, necessitating even more police resources—or one where they have to let it run, because at the moment the law does not quite kick in. The Bill gives officers an opportunity to make an application. I am certainly satisfied that the protection of requiring the application to be made to a court means that there will be a fair process, and this cannot just be used arbitrarily. As Members will have noticed, there is also provision for an interim order, pending a full application, if the court feels that is appropriate.

I would not necessarily say that this should be codified in an amendment, but it might have been helpful if my hon. Friend the Member for Christchurch had spoken to his amendment to allow us to discuss the exact time the measure will be brought in. However, we certainly want to reflect on the fact that we need not just to pass legislation, but to provide an element of funding to ensure that it becomes of real help on the ground.

The amendments tabled by my hon. Friend the Member for Totnes make eminent sense. They will strengthen the Bill and introduce additional tweaks to those measures introduced in Committee, and they will make the Bill even more robust as—hopefully—we send it in the not-too-distant future for scrutiny by their lordships. The Bill will be welcomed. I hope that hon. Members will support the amendments and that we will not be forced to spend time on Divisions that could otherwise be spent on Third Reading. I congratulate again my hon. Friend on the progress of the Bill so far.

I recognise that there is an unbudgeted cost, and I have given an undertaking to work very closely with the Treasury and with the Home Secretary to find a solution to both this and the additional resources and capacity needed to meet the very real demand pressures on the police.

With Sussex police having welcomed 150 extra staff at the end of October, funded by council tax increases, will my right hon. Friend work with me and Katy Bourne to ensure that the police force has all the resources at its disposal to carry on increasing police numbers?

The public’s safety is the priority of this Government. We have made clear the priority we attach to police funding, and the Home Secretary has made his priority clear personally. We are absolutely determined to make sure the police have the resources they need. As we heard the Chancellor say in answer to questions before this, we are in an increasingly strong position because of the recovery of the economy, and austerity is ending, which means that the Conservatives, uniquely as a party, can take these steps—that is in stark contrast to the fiscally incredible Labour party.

To continue on that theme, does my hon. Friend agree that the security elements of the White Paper on the future relationship will be essential in guarding our borders because they will ensure that we continue to work very closely with our European Union neighbours to tackle this as 28 countries, rather than just one?

I agree. Terrorism is a global threat. It affects us in this country, but, as we remember on 11 September, it has affected the United States, and it continues to affect countries throughout the world. It is absolutely right that we share information with trusted countries. We have the “Five Eyes” security grouping, and we also have the EU. It is important that we work with all our international friends to keep our country safe.

I thank my right hon. Friend the Member for South Holland and The Deepings (Mr Hayes) for his intervention. I agree with him profoundly. I think it is scaremongering to suggest that for some reason the EU would not wish to share security information with us, and that we would somehow become less of a security partner or friend because we had left the EU.

There is not a country that has left the EU yet. We are that test case. The reality is that the EU27 will rely on us hugely when it comes to security, because we are such a great provider of that. Perhaps I could urge Opposition Members to be a little more ambitious and recognise that we have a lot to gain from this, instead of running up the white flag.

Again, I agree profoundly.

The Bill is the result of a thorough review carried out by not just the Government but the security services of how we can best protect our citizens. I believe that we can best protect them by ensuring that the Government, the police and the security services have to hand all the tools that they need to deal with the modern threats that are posed to this country.

I do not believe that the death penalty is something that this country should have. I do not think it is what the public, or indeed this House, would support. However, I also respect the will of a number of countries around the world, including the United States, that have decided to have the death penalty in certain circumstances. As an ex-soldier, I am also aware that all states, including those that oppose the death penalty, use lethal force when they have to do so to keep themselves secure. We risk being seen as hypocrites if we say that we will never make an exception for assurances, while being prepared to use lethal force on the battlefield to kill people without due process. That is the balance that we always have to strike. It is not easy, but we do it to try to keep people safe.

While I understand the concern of those who oppose the death penalty, I also understand the concern of my constituents that if this country has information or evidence that is not passed on to our closest ally, the United States, that will send out a very wrong signal indeed when this House calls for more action in countries where there is a war that directly impacts my constituents. Will the Minister confirm, in order to reassure us all, that if advice has been taken and if decisions have been overreached in terms of ministerial responsibility, they will of course be subject to the courts?

Yes, my hon. Friend is correct. All Ministers took these decisions in line with the law. They were acting lawfully, within international law and within our domestic obligations.
