I agree with all that. I know that this will surprise some Conservative Members, but I do believe that there are unscrupulous employers out there. I believe that unscrupulous employers already use existing anti-trade union legislation to try to stop industrial action taking place with some daft minutiae over lists of members and so on. The point I was making is the Government have already imposed extremely high thresholds that trade unios must cross before industrial action takes place.

The draft code of practice does not achieve the necessary clarity of what the duty will mean in practice for trade unions. Instead it presents issues for trade unions over how they will be able practically to implement the proposals. It creates incredibly unrealistic timescales on unions, requiring them to start identifying members

“as soon as reasonably practical”

after receiving a work notice. Such weasel words threaten vindictive penalties for being unable to guess what a Conservative Minster thinks is “reasonable”.

I will refer to some surprising comments from the Royal College of Nursing. They are surprising because the RCN was advised that the legislation would not affect it at all, but perhaps it was not too surprised to discover that that was not the case. A Minister at the Dispatch Box told nurses that the Strikes (Minimum Service Levels) Bill was “not about nurses.” That was always flagrantly untrue, as the RCN clearly stated at the time. Specifically, the Leader of the House said on 26 January 2023 that the Bill was “not about nurses”, and that it was “wrong” to suggest that it was.

Through its draft regulations for NHS ambulance services and the NHS patient transport service, the Government are now explicitly seeking to impose minimum service levels that apply specifically to nursing staff in ambulance services. The RCN asks that Parliament, including Members present here, should hold the Government to their words and reject regulations that would impose minimum service levels on nursing staff.

Like my hon. Friend, I am a member of Unison in Glasgow. All the concerns that he has raised about how the code applies to the NHS, and particularly how it applies to nurses, have been raised with me by constituents. They are incredibly concerned about the pernicious nature of the Government’s legislation and their actions more generally. My hon. Friend was right to say earlier that the way to avoid strike action in the NHS and across our public services is to have decent industrial relations, to invest in them properly, and to welcome people into this country who are willing to supplement the workforce, which is so desperately crying out for more pairs of hands.

My hon. Friend makes an excellent point. I hope that the Minister takes that on board because good industrial relations mean a happy workforce, and there is actually less industrial action when we have good industrial relations.

I will conclude, Ms Nokes, with some comments about Scotland. That will not surprise you, nor anyone in this Committee. I have already referred to how a different and more respectful approach towards public service employees in Scotland has resulted in greater harmony and far fewer strikes. The RCN explicitly recognised that the imposition of the proposed code of practice on Scotland and Wales would be additionally problematic, as it would explicitly contradict the wishes of the elected devolved Administrations. We will look to see whether the UK Government can echo a similar respect for Scottish rights and autonomy as that shown by trade union colleagues south of the border.

It is a great pleasure to serve under your chairmanship, Ms Nokes. As others have done, I declare my trade union membership—I am a member of Unite. I found it mildly ironic that in the course of a debate about minimum service levels, at least one Conservative MP disappeared for the majority of the sitting only to come back, presumably to vote. I will not go as far as identifying that individual.

Before I go any further, I will pose a question to official Opposition Front Benchers. Can we get a commitment that any incoming Labour Government would repeal today’s legislation within their first 100 days? I am not the only one who has been slightly alarmed by the deviation of the current Labour leadership in terms of its commitment to workers’ rights. I think it is important to get that on record.

We find ourselves scrutinising this delegated legislation because earlier in the year, the Government brought forward a measure for a reason we all know: to have a pop at the likes of Mick Lynch. We know what happens when Governments try to legislate on the hoof as a result of press coverage: legislation tends to be rushed through and in the form of a dog’s dinner, and they then come forward with delegated legislation to try to tidy it up. I rather suspect that we will not be surprised to see further legislation at some point down the track. Members have outlined holes that are already in this code, and that is within only 75 minutes or so of scrutiny.

The first thing that concerns me is that the commencement of the regulations will come straight after approval from both Houses. The code of practice has to come into effect; that would be in mid-December, which is only a matter of weeks away. The very idea that Parliament, which we were told during the Brexit process was somehow taking back control, is having this kind of thing foisted upon it in a Delegated Legislation Committee raises a number of questions.

The regulations impose an effective strike ban. I do not want to detain the Committee for too long, but I draw attention to annex A of the draft code, which is absolutely wild. I do not know how many members of the Committee have actually looked at the Government’s draft code, but the idea is that a trade union official would be compelled to send a letter to its members, suggesting that they are required to work—the word “required” continues throughout the letter—beggars belief. The letter says:

“[Name of union] advises you not to strike…You should ignore any call to strike…we encourage you to notify the picket that you are required by the work notice to work at that time.”

The idea that the trade union official, who will probably be the picket supervisor, would be asked to send a copy of this letter, or a variation of it, really does beggar belief. It strikes me that whoever drafted this in Whitehall has absolutely no understanding whatever of trade union organisation, although that might not come as a surprise to many.

Is my hon. Friend concerned about the increasingly authoritarian approach of this Government? People are now required to turn up to polling stations with photo ID, and now they will need a slip to allow them to cross a picket line. Is this the kind of libertarian approach that people had originally expected from the Conservative party?

My hon. Friend makes a good point. It was not that long ago—only a couple of weeks back—that we had a Home Secretary who called for insurrection in Whitehall. The reality is that this Government have a questionable record when it comes to libertarian values, whether it is these restrictions, the—frankly—voter suppression mechanisms that they have brought forward, or the Public Order Act 2023, which seeks to curtail people’s basic rights to assemble and to demonstrate. We know that many provisions in the Government’s legislation have been criticised by the ILO for the fact that they go against the basic and most fundamental right for an employee to withdraw their labour.

I have particular concerns about the identification of members. The Strikes (Minimum Service Levels) Act mandates extremely tight timelines for the identification of members in work notices. Even Conservative Members struggled to keep a straight face when confronted by the contradiction of requiring a postal ballot for taking part in industrial action, but the issuing of work notices within the space of three or four days. That rather suggests that the Government are on shaky ground. The Minister would do well to reflect on that in his summing up.

Where union members do not have an email address, or have not shared their email address with the union, the union is expected to rely on sending information via the postal service. The code does not recognise that challenge. Given the way Royal Mail has decided to run its business in recent months and years, it is not uncommon for there to be a postal strike. We could have something of a perfect storm there.

The code states that unions should also tell a worker who is named in a work notice that they must

“carry out the work during the strike or could be subject to disciplinary proceedings which could include dismissal”.

I know that it is perhaps not normal for Conservative Members to be completely au fait with how the trade union movement works, but the absolute nonsense of a trade union writing to a member who has joined that trade union to collectively organise being threatened with disciplinary proceedings or dismissal really does make a mockery of the situation.

Many other hon. Members have referred to the fact that the original legislation, which was rushed through on the Floor of the House, made absolutely no reference to pickets. Yet—surprise, surprise—we get legislation that is pushed into a Delegated Legislation Committee. A rather stuffy delegated legislation Committee, in which I suspect most people are either playing Candy Crush or considering what to write in their Christmas cards, is debating legislation about strikes and picketing, when we were promised on the Floor of the House that that would not be the case.

The Strikes (Minimum Service Levels) Act 2023 is draconian legislation that attacks individuals’ fundamental rights while doing nothing whatever to improve industrial relations. At a minimum, the associated regulations—the provision that we are looking at now and the regulations that we will be looking at this evening—intended to implement it should be subject to proper scrutiny. Parliament must be given more time, sufficient time, to examine each of the regulations in proper detail and to consider the analysis of the Regulatory Policy Committee.

All of this makes the point that my hon. Friends the Members for Glasgow North and for Glasgow South West and I, and indeed many other SNP Members in this place, have been sent here to stand up and make the argument for stronger workers’ rights. We were promised during the period of the Brexit referendum that Brexit would not be a bonfire of workers’ rights. Six or seven years down the line we are once again served up legislation in here that Scotland did not vote for, that Scotland opposes at every turn, and that I suspect in about six or seven minutes’ time will pass, because there is a democratic deficit in this place—and that makes the case for Scottish independence.

I thank the hon. Gentleman for his question. The UK will continue to show global leadership in encouraging all states to uphold international human rights obligations and to hold those who violate or abuse human rights to account. The UK has successfully included labour, environment and gender provisions in the free trade agreements that we have signed—with Australia and New Zealand, for example. Those both contained dedicated chapters on trade, gender equality, labour and the environment. They uphold human rights but, crucially, also level the playing field for our UK businesses.

Food prices are driven by many pressures, including the global economic climate. We recognise the important role that trade can play in improving food security through diversification of supply chains. Our programme of free trade agreements is securing access to global supply chains, removing barriers and lowering costs for traders. Furthermore, in 2022, 84% of agricultural and food imports entered the UK tariff-free. By delivering trade deals and working with international partners, we are ensuring that British consumers have access to good-quality and good-value food.

Will the Minister explain how the Government’s plans for a £43 inspection fee on each consignment of food imported from the European Union represent barrier-free trade? Can she tell small food retailers, restaurants and their customers in Glasgow North when or whether they will have to pay this Brexit tax and the higher prices it will lead to? Can she also remind the House whether higher food prices as a result of Brexit were part of the Leave campaign prospectus?

I know the hon. Member wants to put all these anxieties on Brexit and forget about all the opportunities we are securing with trade agreements around the world. The issue he raises fundamentally sits at the doorstep of the Cabinet Office and the Department for Environment, Food and Rural Affairs, and we are working very closely with them to resolve it.

I was with Harland & Wolff just last night for London International Shipping Week, and the firm is really excited about the shipbuilding credit guarantee scheme, which provides Government-backed loans of up to £500 million to ensure that shipbuilding continues to thrive in the UK. That is a product for which the industry has been asking for many years, and we have been able to deliver it this year.

Ministers have spent the past hour or so telling us, in the face of overwhelmingly contrary evidence, that Brexit is just the most wonderfullest thing ever to have happened in the history of the entire universe. Will the Secretary of State level up with us for a minute and tell us whether there is anything at all about Brexit that she finds regrettable, disappointing or frustrating?

The hon. Gentleman is right—there is one thing that I find regrettable, and it is the fact that he continues to bang on and on about this even after the rest of the world has moved on post the referendum. The fact is that we have left the EU and we are not going back into it—certainly not under the terms that would require us to do so. He should be focusing on the benefits of Brexit, such as having more control over our laws, our borders and our money, as well as being able to deregulate, including through our smarter regulation programme. If he looked at that, there might be opportunities he could deliver for the people of Scotland.

I thank my right hon. Friend. Again, I really appreciate the recognition that the deal will benefit all nations and all regions of the UK. In Wales, for example, there are currently 281 CPTPP-owned businesses employing more than 16,500 people, and we expect that to go up. There are trade opportunities in so many areas covering both goods and services. That is a really important point: as we negotiate a lot of trade deals around the world, one thing we notice about many of the deals done by the EU on our behalf is that they did not cover services, yet services are over 70% of our economy, so it is great that we are now negotiating deals that fit our modern economy.

Even if the world was flat—for the benefit of the Minister’s Back Benchers, it is not—the Pacific would still be very far away compared to Europe, so how does the deal benefit fresh seafood producers and shellfish producers on the west coast of Scotland who cannot get their fresh produce into the much-closer European market as a result of Brexit? How on earth are they supposed to get that fresh produce even more quickly halfway around the world?

Again, I am sorry to hear hon. Members conflate different points. We have left the European Union—that was a democratic decision—and we have a good free trade agreement with the European Union that will continue. CPTPP creates opportunities in areas of the world with considerable growth where we did not previously have deals. Surely the hon. Member must recognise that that is a positive thing right across the country, including for his constituents?

I regularly discuss with my Cabinet colleagues promoting trade in Scotland as well as the United Kingdom as a whole. Just this week I chaired a meeting of the Board of Trade that focused on trade promotion across the nations, and held discussions, alongside the Secretary of State for Scotland, on ensuring that the Department’s work delivers for the whole UK.

That sounds just wonderful, but I would like to know how the Secretary of State thinks ending freedom of movement has helped to promote Scottish trade and culture overseas. Does she think it is a good thing that musicians in Glasgow North now find it much more difficult to tour in Europe—one of the most important markets for traditional Scottish music nowadays —and that their merchandise can no longer be manufactured in Scotland but must be manufactured in the countries to which they are travelling because the customs costs have become so prohibitive?

I welcome the hon. Gentleman’s early-morning snarkiness as he asks about what we are doing for Scotland. We understand that there are issues that people have across borders, and my Department works closely with musicians and with all those who trade across borders to see what we can do to resolve those issues. If there are specific cases in the hon. Gentleman’s constituency, the Department is well placed to help his constituents with the issues he has described.

The hon. Gentleman raises a very good point. He is right that we need to make sure there is resilience across the sector, and I think our regulators are best placed to do that. They are carrying out a number of reviews at the moment, and I and colleagues across Government are working closely with them.

The Secretary of State earlier told my hon. Friend the Member for Gordon (Richard Thomson) that she did not accept that Brexit was having a negative impact on the Scottish seafood industry. It is a bit like saying she does not accept that the earth is round—although, admittedly, sometimes people on her Back Benches need to be persuaded of that. If she does not think that Brexit is having a negative impact on the Scottish seafood industry, does she think it has been positive, or does she think there has not been any change at all?

The hon. Gentleman is entitled to his opinion, as I am entitled to mine. He has done absolutely nothing except try to re-litigate Brexit over and over again. The fact is that we are not going back into the EU. We are using our independent trade policy, negotiating with countries around the world and delivering more for the UK as well as for Scotland. Scottish businesses are happy with what we are doing, and in particular they are happy that the grown-ups in Westminster have stopped them making the catastrophic decisions that are destroying the internal market.

It is a pleasure to serve under your chairmanship, Mr Dowd.

I warmly congratulate the hon. Member for Caithness, Sutherland and Easter Ross (Jamie Stone) on securing the debate. I share with him a heritage in the highlands. I grew up in Inverness and I recognise much of what he describes. Everyone has spoken today with passion about the heritage sites in their area, whether they are world heritage sites, scheduled monuments, listed buildings or community assets of local value, and whether they are in the far north, Reading, Stoke, Llanelli, Woking, Orkney or the Lake district. I am sure I will be able to mention a couple in Glasgow. All such assets have a value in their own right as tangible and sometimes intangible connections to our past, our culture and the role they played in shaping our society.

In Glasgow North, we have a portion of the world heritage site of the Antonine wall, which was part of the frontier of the Roman empire. Much can be learned from the wall and associated sites about the Roman presence on these islands. Apparently, the first Romans who came here were chased away from the white cliffs of Dover, and people threw rocks and stones at them. These days the Government might call them illegal migrants and try to deport them to Rwanda. Nevertheless, the legacy is there to see in all the assets we are talking about. That important economic and social value remains in the here and now. These places bring people together and attract interested visitors who spend money on site and in the local economy. That in turn provides further benefit for the local community.

In Glasgow North we have the Maryhill Burgh Halls and in the east of the city Provan Hall. They are fantastic examples not just because my younger sister has worked on their heritage and regeneration, but because the projects to save and restore those facilities have themselves supported the local economy. They will be developed into functioning buildings that provide a place for people to make new memories, as well as to share their memories of them in times past.

The development and redevelopment of such sites is rarely, at least in the first instance, a purely commercial endeavour. Many heritage sites rely on charitable giving or funding from grant-making organisations, not least the National Lottery Heritage Fund, and from statutory bodies. The Charles Rennie Mackintosh Society, which marks its 50th anniversary this year, has received support from Historic Environment Scotland and has maintained and developed Mackintosh church at Queen’s Cross in Glasgow North as an attraction in its own right and as a venue for performances, weddings and other events. Currently, it is hosting Luke Jerram’s famous Gaia installation, last seen in Glasgow at COP26, where of course we were all encouraged, as the hon. Member for Caithness, Sutherland and Easter Ross rightly said at the start, to think about how we tackle climate change and work towards reaching net zero targets.

In Glasgow’s west end, the Arlington Baths Club, of which I am a member, benefited from lottery heritage funding in the past. This recognised its value not only to the club’s members, but to the wider public. The facility is used by schools and is open throughout the year to those who wish to learn more about the building’s architecture and history. It is also a good example of how sites can adapt to a changing climate while becoming more sustainable at the same time. It recently produced a very ambitious plan to reach net zero. It will reduce carbon emissions, which is good for all of us, but also save money through energy efficiency and local generation. Supporting such projects should not just be seen as some sort of nice to have or luxury extra by Governments. Investing in heritage sites pays dividends for both the economy and wider society, and failure to invest results in either long-term maintenance costs or costs associated with the loss or even the destruction of assets.

The hon. Gentleman touched on a range of devolved areas. The Scottish Government invest what they can from the resources available to them. That includes the £278 million for the culture and heritage sector in the current year’s budget. We would, of course, welcome further investment at a UK level, because that would result in Barnett consequentials. I hope the Government will keep up with EU regulations in this area despite their insistence on a hard Brexit. There has been consensus on the value that these heritage sites bring to our culture, economy and society, but preserving them for future generations will not happen by magic. I hope the Government are prepared to step up to meet the challenges ahead.

I will echo a lot of what we have heard from the hon. Member for Bristol South on the Labour Front Bench; there were some very fair points, well made. These innocuous-looking regulations actually cover a very wide range of devices, many of which our constituents find essential for going about their daily business and daily lives.

Here we are, in a Commons Committee Room, not taking back control, not doing things differently, but extending regulations that have already been in place and operating very successfully across the European Union for many years—but now with the added Brexit bonus of all the bureaucracy and resources necessary to approve a statutory instrument that has the effect of maintaining the pre-Brexit status quo. I am sure that that is what all the Conservative Back Benchers who campaigned so hard for Brexit were looking forward to when they were out knocking doors and then found themselves elected to this place. The necessity of these regulations demonstrates exactly the kind of policy and legislative cliff edge that the Government were repeatedly warned about, particularly as they brought forward the Retained EU Law (Revocation and Reform) Bill, which of course they are now having to retreat from in the face of amendments made by the House of Lords.

The Minister says that the Government want to bring forward their own framework for regulating medical devices, so perhaps she can give us a preview of her vision for that and how it will diverge from the European Union’s. Will the United Kingdom have higher standards than the European Union for the production and manufacture of medical devices? I am sure that she will also want to reassure us that the Government have absolutely no intention of allowing poorly made, poorly tested or otherwise substandard devices to enter the UK market, and certainly not as part of any trade deals that they might be looking to make with non-European countries.

In the meantime, we will have to continue to consume time and energy and much passion—as is visible on the Conservative Back Benches here today—dealing with these kinds of extensions, carry-overs and all the rest, because Brexit has not been the great liberation that was promised. It has made many aspects of life more difficult, more complex, more bureaucratic and more precarious for many people—particularly, in this case, people who rely on access to medical devices and want confidence in and assurance of the quality of what they are going out to access through the NHS or on the UK market. The statutory instrument is yet another example of how Brexit has not lived up to any of the promises that were made.

I thank the hon. Member for Motherwell and Wishaw (Marion Fellows) for the fantastic job she does as chair of the all-party parliamentary group on post offices. I met the Post Office leadership this week to reiterate our commitment to ensuring the long-term sustainability of the post office network. We have funded the network to the tune of £2.5 billion over the last 10 years, and have set access criteria to ensure that vital services remain within local reach of our citizens.

The hon. Lady raises an important point. Drop and collect locations offer important services for our citizens, and can be counted towards the commitment to having 11,500 branches. Having said that, the access criteria overlaid on that commitment ensure that branches offering core services, including the sale of mail products, access to cash, and banking and bill payment facilities, remain within 3 miles of 99% of our population.

The report to which my hon. Friend the Member for Motherwell and Wishaw (Marion Fellows) referred found that the social value delivered by the Post Office is 16.5 times greater than the financial input it receives from the Government, so will the Minister carry out an analysis of how additional investment in the post office network will allow it to continue to grow, so that it can help our communities and small businesses to grow and develop?

That is a very good point. We are working all the time with the Post Office—as I said, there was a meeting earlier this week. Around half of its 11,500 branches are in rural areas. They are hugely important to our local communities, as the hon. Gentleman says. The Government’s funding for the network helps to ensure the viability of rural branches. Of course, this will always be work in progress. We are keen to make sure that the facilities are there for our communities.

The hon. Gentleman is right that we want universities to become more entrepreneurial. We had fantastic work at Oxford University with AstraZeneca. Many of them are doing quite well. I am keen to hear his suggestions of what I can do to encourage universities. The Secretary of State for Science, Innovation and Technology is working on this issue, but from a business perspective, we want to ensure that we are continuing to facilitate relationships with both businesses and universities, especially in clusters where universities are essential to the local economy.

Why is the Secretary of State perpetuating the myth that the Retained EU Law (Revocation and Reform) Bill is a good thing, necessary or going to receive Royal Assent in anything like the shape in which it was first presented to this House? What is the target date for Royal Assent? Should she not prepare now to drop the thing entirely?

It is a pleasure to serve under your chairmanship, Mr Hollobone. As the hon. Member for Ellesmere Port and Neston said, nobody is going to object to any kind of rise in the minimum wage, especially in these difficult times and given the inflationary pressures being experienced across the economy, which I hope the hon. Member for Basildon and Billericay will recognise are at least in part the result of the extreme hard Brexit forced on this country by the Conservative party, with the acquiescence of the Labour party. He might be right that unemployment is low, but I can show him businesses across the country and in my constituency that are crying out for labour—for staff—because of the labour shortages that have happened as a result of that hard Brexit.

I say this in the spirit in which the hon. Gentleman made his point: he needs to see the bigger picture. It is quite interesting that there is almost a balance between the number of job vacancies and the number of people who are unemployed. That actually suggests that the economy is doing quite well. There may be a mismatch for whatever reason, but those vacancies are there; we just need to ensure that we encourage people into work more.

Indeed. There are plenty of asylum seekers in my constituency who have a huge amount of skills and talent but are unable to deploy them, because this Government will not give them the right to work, earn a fair wage and pay tax back into the system. Perhaps that is a place where we could start or, if the Government want to make working more attractive, perhaps—getting to the heart of the debate—people should be paid a fair day’s wage for a fair day’s work.

We have heard about litmus tests, one of which is the rate of unemployment. Does the hon. Gentleman agree that one litmus test is whether workers have enough money to live on and to pay their bills?

Yes, precisely. That is why the rises today are welcome, but they are not necessarily sufficient for a lot of people.

The way in which the Government have co-opted the use of the term “living wage” to describe their statutory minimum wage is unfortunate. It causes a lot of confusion, and is particularly unfair to people looking for a real living wage, which the Living Wage Foundation has calculated since long before this Government adopted that language and it consistently comes up with higher rates; its proposals for the coming financial year are £10.90 an hour for the UK as a whole and £11.95 in London. The £10.90 compared to the £10.42 might not, on paper, sound like a huge difference but in reality, in a seven-hour day, that is about £3.36 extra a day or, over a five-day week, £16.80 a week. That starts to make a significant impact on the pound in people’s pockets.

Of course, that is only the upper rate for workers aged over 23. We agree entirely with the arguments being made for the extension of a real living wage to everyone in employment without distinction for their age. As other Members have said, people do not pay differential prices when they go to the supermarket or use consumer goods or utilities and so on. People should be paid the same for the same kind of work.

The Government could be doing more, and they could learn from the Scottish Government in that regard. The Scottish business pledge, introduced by the Scottish Government, encourages employers to pay the real living wage, to end zero-hours contracts and to take action in their businesses to close the gender pay gap. The Scottish Government also offer a wider social contract to workers, including free prescriptions, tuition fees for their children going to university, the Scottish child payment—which is a real game-changer—the baby box and all the other actions that show just how much we have been able to do with the powers of devolution, and point to what we could achieve when Scotland becomes independent.

As welcome as the rise today might be, it does not go far enough. I do not think anyone in Scotland will look very much at what is on offer from the Conservatives or, indeed, the Labour party and think that this is as good as it gets.
