Thank you, Mr Hollobone; I am grateful for the chance to resume my remarks.

Before we were interrupted, I was talking about the facets of an east midlands rail hub, and I know the massed crowds in the debate will be excited to hear some more about it in the next 18 minutes. That could be completed in phases, starting in 2024 and finishing in time for the arrival of HS2 in the east midlands in 2033. That staggered approach would minimise disruption to passengers and would prevent a worsening of the issues that we are suffering.

As I said before, this debate came more quickly than I expected, so the full details of the proposal for the hub from Midlands Connect will not be published until next week. I will test the principle that the best place to tell a secret is on the Floor of the House of Commons by letting Members in on some of the highlights, ahead of time.

Broadly, the proposal would give capacity for 24 new east-west and west-east passenger services every hour on the midlands rail network, with 36 additional freight paths per day, shifting 4,320 lorries from road to railway each day. Some 1.6 million more people would be brought within an hour’s journey by public transport of the midlands’ biggest towns and cities, and the extra capacity would add £650 million to the economy of the midlands every year.

The hub would be a win-win for our region on so many fronts. It would bring huge economic dividends every year to our industries and local businesses. A more joined-up public transport system would be a good idea as it would reduce traffic on our overcrowded roads and help to tackle the climate emergency we are all too aware that we are facing. The additional tourism it would bring to the region would also be a benefit, as my hon. Friend the Member for High Peak (Ruth George) mentioned.

It is clear as day that this a project whose time has come; it needs to happen. The case for the midlands rail hub is persuasive, the details Ministers see will be good and it is time that midlands communities were backed in this way. I hope Ministers will put the full weight of the Department for Transport behind this project; if they want the midlands engine, they will have to have the rail hub as a constituent part of it.

I know Transport Ministers have a tough job and there are competing priorities, but I believe there is a strong business case. This is not the politics of the begging bowl or saying, “London gets so much per head and we get so much less per head.” It is easy to say that stuff, but there have to be backable propositions; this is one of them. We think it will lead to good infrastructure in the region and economic benefits.

I ask the Minister to read the report from Midlands Connect when it is released next week and put it at the top of his in-tray for approval. We know there will be significant political change in the next few months and there may be ministerial changes too. If the Minister is not in his role in the future, I ask him to pass it on to his successors, so that they understand that this is a good project. We would make sure that they got a copy of the report, but I hope the Minister would pass a copy on too.

Far too many people in my constituency think that progress in our economy is stalling. There are significant gaps in our development that have not been exploited. I mentioned briefly when the hon. Member for Mansfield (Ben Bradley) intervened that the reality for my community since the mid-1980s has been significant deindustrialisation. We could have a day’s debate on the reasons for that, its inevitability and what came in its place, but to a certain extent that is now for the birds. What comes now is what matters, with the midlands rail hub being a critical component part of our economic development around that triangle.

Currently, on average, two East Midlands trains per hour call at Kettering northbound on weekdays, with one going to Corby and one to Nottingham. From December 2020, double the number of trains will call at Kettering: two will be on a dedicated St Pancras to Corby service and two will be on the long-distance Nottingham service.

Kettering is a well-used, popular station with rising passenger numbers. Will the Minister confirm when electrification will arrive at Kettering and what other benefits to passengers there will be from the new train franchise?

The roll-out of the midland main line electrification is obviously a key project, and I will keep the House posted on its progress. I can inform my hon. Friend that the station will get many new benefits from the East Midlands franchise. They will include station wi-fi, LED lighting and help points. There will be improved lay-out and a bus interchange, a multimodal customer information system, drinking water fountains, customer lounges, refurbished toilets, new cafés, customer waiting areas, a third-party west side station entrance development, 60 new secure cycle spaces, six electric vehicle charging points, ANPR car park technology, 200 additional car park spaces and air quality monitors. Basically, it is all happening at Kettering station.

I certainly recall that point. I have to confess that I do not know whether it has been followed through. We will wait to see whether the Minister is able to confirm that.

I understand that in the past decade, Network Rail has made a great deal of effort to improve the safety of level crossings. Initiatives such as the introduction of level crossing managers and ever-improving technology have proven successful in improving behaviour at level crossings. From a practical perspective, technology is probably the most effective means of changing outcomes. It is a huge factor in the reduction of deliberate misuse and human error across the country. I see no reason why Network Rail could not implement technology to aid pedestrian decision making at Suggitt’s Lane. Perhaps it could include supplementary audible warnings and overlay miniature stop light solutions.

In September 2013, the Law Commission published a report and a draft Bill containing a series of recommendations aimed at improving the safety and regulation of level crossings. Its suggestions included providing tools to support health and safety regulation, including level crossing plans and enforceable agreements between railway operators and other duty holders, and giving the Secretary of State the power to issue directions if necessary. Those proposals, if properly implemented, have the potential to make level crossings much safer, so that Network Rail feels less incentivised to close them on a whim.

Clearly, a vast number of alternatives to closure are available to Network Rail. I have no doubt that this decision was taken as it was the easiest and cheapest option. There was no need for Network Rail to take into consideration the trouble the closure would cause elderly and disabled residents, given the lack of powers for any person or institution to hold it to account. That is unacceptable, and it must change.

Installing a modern footbridge with disabled access at Fuller Street would prove extremely expensive. Whether the funding for that came from the owner of the bridge, North East Lincolnshire Council, or from Network Rail, it would be public money. I question whether public money should be spent on eliminating a theoretical risk at Suggitt’s Lane when there are thousands of level crossings, many with trains passing at 125 mph, where the money could be better spent.

I referred to the 15 near misses to which Network Rail referred. Remember, that is 15 near misses in 10 years, during which time more than 2 million people will have passed over the crossing. On 9 April, Mr Ian Stuart from the Rail Accident Investigation Branch emailed one of the local campaigners, Lynn Sayles. He wrote:

“We have reviewed our records from when we were established in October 2005 and have found details of only one Incident at Suggitt’s Lane level crossing, which occurred on 13 January 2011. The circumstances of this particular case were unclear, but involved an individual being found with an injury in the vicinity of the crossing. However, there was no direct evidence that the injury had actually been caused by a train. The RAIB received no formal notification from the industry about the accident and the circumstances could not be substantiated so no further action was taken.”

Only one of the 15 near misses was considered significant enough to involve the RAIB. That is one near miss, in which the circumstances could not be substantiated, against more than 2 million crossings. Why close the crossing and cause massive inconvenience on the basis of those results?

Of course people should not trespass on the railway, and of course people should not act foolishly, but, sadly, some do. We all suffer to some extent as a result, but in this instance the massive inconvenience simply is not justified. Anyone who is determined to trespass on that stretch of railway can go along to Cleethorpes station at any time of the day or night and wander down the platform and on to the track.

I urge Network Rail to do the right thing: to admit that it has not fully appreciated the strength of local feeling, that full, proper and meaningful consultation should take place, and that while those discussions happen, it should reopen Suggitt’s Lane crossing. My plea to the Minister is that he uses his good offices to find a solution.

Let me deal with the hon. Gentleman’s questions one at a time. In a complex procurement process such as this, or indeed in other complex public sector procurements, it is a matter of course that there may be small technical non-compliances. These could include, for example, incorrect font sizes or submitting bids in the wrong format—in docx rather than in PDF, or vice versa. This does not constitute a material non-compliance, which would affect the compliance of the bid as a whole. What would be a serious issue would be something like the reallocation of risk, or acceptance or non-acceptance of the commercial terms that have been offered. That is where the difference between material and non-material would come in.

We have been clear at the outset that non-compliance risks exclusion and Stagecoach chose to put in a materially non-compliant bid rejecting the commercial terms on offer. In doing so, it is responsible for its own disqualification.

On the bid leak, I am aware that an email was sent incorrectly by Network Rail, which was received by one of the bidders, but that has been investigated and it was proved in that investigation that the email was not opened and none of the information that was possibly within it was accessed, so it has not been material to this award.

The hon. Gentleman said that franchising is dead and buried. I could not disagree more. Franchising has been a significant part of the turnaround of our rail industry. It has led to more entrants into the market. It has led to investment from the private sector. It has led to over £10 billion of investment. It has led to a renewal of focus on customers in the rail sector. It has been an ingredient in the turnaround we have seen, with the more than doubling of passenger journeys on our railways over the past 20 and a bit years. So franchising has been a success. We of course need to evolve it because what we face now is how to take the process on to the next stages. That is the question that the Williams review has been tasked to solve.

Mr Williams is starting to give us some of his thinking. He has made speeches at various rail conferences. We look forward to receiving his report in the early summer, with a view to a White Paper in the autumn.

The comment from the hon. Gentleman was that the Secretary of State had misled the House. The Abellio bid was won in a competitive franchise process and it won with a compliant bid. The comments by the Secretary of State were, therefore, accurate. I am aware of the media story, but it is wrong. He does not need to correct the record. The Abellio bid was compliant and has been won in an open, fair and consistent way. We look forward to seeing the benefits of that for the passengers on the East Midlands network.

Can the rail Minister confirm that under the terms of the new franchise passengers from Kettering will enjoy the reintroduction of two trains an hour going north from Kettering, which had been taken away, extra seat capacity on the Corby to London service and the introduction of electrification to Kettering by 2020?

My hon. Friend makes, as ever, a wise point on behalf of the constituents he serves so well. The point about this franchise, and indeed all our franchises, is that they bring benefits for the travelling public. This franchise will do just that. It will be delivering more trains from Kettering, it will be delivering more seats from Corby, and the Government as a whole through their electrification of a significant part of the midland main line will be delivering the electrification that he specified. So his constituents will be receiving a better service in both quantity and quality as a result of this franchise award.

I look forward to the Williams review’s response to Virgin’s submission. I see Virgin’s point, but I have to say that the turn-up-and-go principle that has always been part of our rail network is important and, I think, valued by passengers. I understand the hon. Gentleman’s point about the impact on passengers and those who work on the railways, but the underlying turn-up-and-go principle is a fundamental part of our rail network, and we would only challenge that with extreme care.

Far too many rail passengers have to stand, which is especially inconvenient for those on lengthy journeys. Many other countries successfully run double-decker trains. Why do we not, with a bit of vision and ambition, introduce double-decker trains on our network?

My hon. Friend makes an interesting suggestion. Our challenge is that we have a very old infrastructure, including many cuttings, tunnels and bridges. Cuttings are perhaps less of a problem, but the tunnels and bridges would be more of a challenge. The height capacity, which also impacts on freight, is being considered, but the way to deliver the capacity that my hon. Friend seeks for his constituents and that we want is perhaps not through that route, which would require huge interventions and a large capital budget, but to use other forms of technology and development.

When we prepared the ANPS and when the Airports Commission prepared its recommendations, it was done in the context of the recommendations of the Committee on Climate Change. We have continued to work with the Committee on Climate Change, and I am confident that we will deliver that expansion and continue to fulfil our obligations to reduce carbon emissions and move towards what was set out this morning.

T3. The new east midlands train franchise is likely to increase capacity southwards from Kettering, but will it improve connectivity north on the midland main line? The previous Labour Government cut our half-hourly service northwards and it is about time that we had it back.

I can confirm that, compared with today, there will more trains from Kettering going north. The trains will be new, so they will have more seats, which means that, in terms of capacity, there will be more trains and better trains. On timing, we will see the start of more services for my hon. Friend’s constituents from December 2020.

Right. Well, that franchise is still under consideration and we will be announcing the results in due course. The point in the letter to the hon. Lady was that while that evaluation is taking place, there has been a short extension to the existing franchise to ensure that passenger services can continue to operate.

The main concerns of Kettering rail users are finding a seat on crowded peak time trains to and from London, the low frequency of services north on the main line to Leicester and the level of fares per mile being among the highest in the country. Does the winning bidder address any of those issues?

As the hon. Gentleman will know, the highway code already mentions horse riders in several of its provisions. At the end of last year, as he will recall, we published a safety review aimed at all vulnerable road users, including horse riders. It included, specifically, work on close passing, on which, as he will be aware, West Midlands police have taken a lead. That review contained 50 actions to be undertaken over a two-year period, and we are still in the middle of that, but I absolutely recognise the concern that he has.

Far too many road traffic collisions are caused by uninsured drivers, and there are far too many uninsured drivers on our roads. What is the Minister doing to tackle this issue?

Of course, that is a serious question. As my hon. Friend will be aware, we have very vigorous enforcement action being undertaken not only by the police but by the DVSA and the Driver and Vehicle Licensing Agency to try to crack down on this problem.

Dear oh dear, they keep trying, don’t they? We have hundreds of civil servants across Whitehall working on no-deal preparations to make sure that we are ready in case it happens. I am clear that we do not want no-deal, but we are taking the necessary precautions. The problem is that the Labour party does not believe that should be happening.

With regard to no-deal preparations, will the Secretary of State confirm to the House, once again, that we have signed the common transit convention, which means that import duties and customs declarations do not have to be sorted out until goods arrive at their final destination? In his reply, will he also mention that the mayor of Calais has said that Calais will be open for business even in the event of no deal?

Both of the points made by my hon. Friend are absolutely correct. My view is that the common transit convention solves many of the problems. We cannot be 100% certain, because we have not had confirmation from the French yet about how they would manage border posts in Calais, notwithstanding the common travel convention, but he is absolutely right that it should enable trade to flow through smoothly. I have been clear in saying regularly that I expect those ports and the tunnel to operate pretty much normally, but we have contingency in place just in case that is necessary.
