To ask Her Majesty's Government what discussions they have had with (1) local authorities, and (2) police forces, to prevent the illegal (a) purchase, and (b) use, of e-scooters in England.

Legislation was amended in July 2020 to allow for rental e-scooter trials around England which will run for 12 months with the trial period beginning in each area as and when e-scooters become available to the public. It remains illegal to use privately owned e-scooters on the road as they do not meet the requirements of stringent construction regulations, registration, road tax, insurance and MOT testing.

It is not illegal to sell an e-scooter as they can be used legally on private land. However, under the Consumer Protection from Unfair Trading Regulations 2008, there is a general obligation for traders to give consumers sufficient information about goods and services at the point of sale, so consumers are not misled.

Electric scooters have to abide by the same road traffic legislation as mopeds and motorcycles. To drive or ride any motor vehicle without permission onto a footpath, common land, moorland or land of any description that does not form part of the road is an offence under section 34 of the Road Traffic Act 1988. To drive or ride a powered scooter on a pavement, as with pedal cycles, is an offence under section 72 of the Highway Act 1835.

Enforcement of road traffic laws on the illegal use of e-scooters is an operational matter for individual Chief Officers who will decide how to deploy available resources, taking into account any specific local problems and demands. Where e-scooters amount to anti-social behaviour, then local authorities make byelaws/injunctions and Anti-Social Behaviour orders to curb the misuse of vehicles.

To ask the Secretary of State for Transport, what steps his Department is taking to raise awareness that owners of tax-free vehicles must register their vehicle with the DVLA.

By law, all mechanically propelled vehicles that are used on public roads must be registered and licensed. Information about registration and licensing is available on GOV.UK and can be found https://www.gov.uk/vehicle-registration

In 2019, the Driver and Vehicle Licensing Agency introduced a vehicle excise duty reminder form specifically for vehicles that are subject to a zero rate of vehicle excise duty. The reminder is sent shortly before a vehicle needs to be relicensed and it advises vehicle keepers that they are responsible for making sure that their vehicle is licensed even where there is no payment required. The Society of Motor Manufacturers and Traders (SMMT) provide monthly statistics on the registration of new vehicles in the UK. The latest statistics were issued on 6 January 2021 and are summarised as follows:

The SMMT’s statistics for new car registrations for 2020 show the UK new car market fell by -29.4% to 1.63m cars compared with 2.31m cars in 2019. This is consistent with the impact of COVID restrictions on sales in other major car markets in Europe. Within the UK market, Electric Vehicle (EV) car sales continue to grow and accounted for 17.5% of the 2020 new car market: Battery Electric Vehicle sales were up 186% to 108,205; Plug in Hybrid Vehicle sales were up 91% to 66,877; and full hybrids were up 12% to 110,117. Mild hybrid sales are also growing, accounting for 13% of petrol and diesel registrations.

The Department understands that these are challenging times for the automotive sector and manufacturers in general. The Government has been working closely with key industry stakeholders throughout the pandemic to understand how we can support the resilience and continued competitiveness of UK automotive manufacturing at this time.

To ask Her Majesty's Government what arrangements they have established with the EU, if any, to share data on (1) vehicle number plates, (2) vehicle owners, and (3) vehicle keepers, from EU member states, in order to enable UK enforcement authorities to impose penalties or charges relating to the use of such vehicles.

Following the end of the Transition Period, the UK has no formal arrangements with the EU or Member States for the automatic exchange of vehicle/driver information on road traffic offences. However, UK authorities may choose to make enquiries of EU motorists using the 1959 Convention on Mutual Legal Assistance, which allows UK officials to make requests and seek information where criminal activity has occurred. Any information received through this mechanism will inform further enforcement activity. The UK-EU Trade and Cooperation Agreement contains provisions for the fast and effective exchange of vehicle registration data in relation to criminal investigations.

Since 1 March 2020, and as of Monday 20 July, the Government has laid 127 statutory instruments in response to the Coronavirus pandemic. This has enabled the Government to swiftly put in place the legislation needed and we will continue to bring forward further SIs for Parliament to consider, as required. Question to the Department for Transport:

To ask the Secretary of State for Transport, when the DVLA will resume accepting (a) online and (b) postal applications and documentation from people wishing to register car purchases.

The Driver and Vehicle Licensing Agency (DVLA)’s online services are operating as normal, including those for registering new vehicles and notifying the DVLA that the keeper of a vehicle has changed. Customers may also submit paper applications and notifications, but these will take longer to process.

To ask the Secretary of State for Transport, pursuant to the Answer of 13 March 2020 to Question 27569 on Motor Vehicles: Compressed Natural Gas, how many of the 61 zero and low emission heavy good vehicles participating in the Low Emission Freight and Logistics Trial are registered in Wales.

Vehicle registration data is not captured as part of the project reporting for the Low Emission Freight and Logistics Trial. The two consortium leads running Compressed Natural Gas (CNG) vehicles as part of the trials operate vehicles from various depots, including Swindon, Bristol, and Milton Keynes.

Question to the Department for Transport:

To ask Her Majesty's Government what measures they are taking to raise public awareness that (1) drivers travelling in the EU after 29 March may need to obtain a Green Card from their insurers before departure, and (2) those using trailers may need to ask the Driver and Vehicle Licensing Agency whether they need to register their trailer, and ask their insurers whether they need to obtain a separate Green Card for that trailer.

The Government has provided guidance to motorists travelling in the EU after 29 March through various channels.

The technical notice ‘Vehicle Insurance if there’s no Brexit Deal’ was published in September 2018. It outlines that, in the event of ‘no deal’ and the European Commission not taking a decision to allow the UK to remain in the Green Card-free area, drivers of UK registered vehicles will need to carry a motor insurance Green Card when driving in the EU and EEA. The guidance also encourages UK registered drivers towing a trailer to contact their insurer to obtain two Green Cards, one for their trailer and one for their towing vehicle.

Guidance has also been published on trailer registration. UK motorists must register commercial trailers weighing over 750kg and non-commercial trailers weighing over 3,500kg before they can travel to or through most EU and EEA countries. UK motorists can also voluntarily register non-commercial trailers that weigh over 750kg. The Government issued new communications in February 2019, which echoed the guidance in the technical notice. The campaign is live with radio, digital ads and social media directing citizens to gov.uk.

We continue to work constructively with the Motor Insurers’ Bureau, the Association of British Insurers and the rest of the insurance industry to ensure motorists are aware of these messages and are prepared for a ‘no deal’ scenario.

On motor insurance, our intention is to remain part of the Green Card-free circulation area as the UK will continue to meet all of the requirements when we leave the EU. This would allow UK drivers to continue to be able to drive in EU Member States without the need for a Green Card. We continue to urge the Commission to issue a decision on the UK’s membership in the Green Card-free circulation zone.

What steps he is taking to ensure the compliance of foreign-registered vehicles with UK laws and regulations.

UK road traffic legislation applies to everyone who use our roads irrespective of where the vehicle is registered.

It is for the Police to decide what action to take against foreign drivers detected committing criminal traffic offences. This may include impounding.

For traffic offences subject to civil enforcement, persistent evaders found in contravention may have their vehicles immobilised or removed. Some local authorities use international debt recovery agents to recover payment.
