My Lords, I thank and congratulate my noble friend Lord Dykes on securing this debate on an issue of such significance to the United Kingdom. It has been a great starter for the main meal of a debate which I sincerely look forward to tomorrow. I am sure that many of the issues that have been raised today will be raised again tomorrow.

This Government are clear that membership of the EU is in the UK’s interest. We are also clear that the EU urgently needs to reform. As the Prime Minister and Deputy Prime Minister set out in speeches last year, the EU needs to become more competitive, more flexible and more democratically accountable, with powers flowing both ways and fairness between eurozone and non-eurozone members. I am delighted to hear the noble Lord, Lord Liddle, say that he agrees with almost 80% of the Prime Minister’s speech from last January. He also agrees with the need for reform, and it would be interesting to hear specifically the areas that he does not agree with. I certainly look forward to hearing from the Benches opposite in relation to how they feel the British people could also have their say in relation to these matters.

It is the Government’s priority to engage with all member states and the European Union institutions to make these reforms, which we feel are essential, a reality. Some have suggested that the UK is seeking special treatment in Europe. I want to be very clear on this. The reforms that we seek are for the benefit of all member states, and we are working with them to achieve this. My noble friend Lord Howell of Guildford said exactly that.

It is not as the noble Lord, Lord Giddens, described. I am pleased to say that we are already making significant progress, and I do not accept what my noble friend Lord Dykes said in his analysis. Let me give him a few examples of what I think our approach is already doing in terms of making a difference. We worked closely with countries such as Sweden to achieve a double majority voting rule, which provides a safeguard for non-eurozone members in banking union decisions and makes sure that our voice is heard.

Will the noble Baroness tell the House the reasons which make it not in the national interest to be part of the banking union?

To be part of the banking union we would have to be part of the euro, and I am certainly not going to spend this debate debating the benefits of membership of the euro.

The noble Baroness is, with respect, wrong about that. A number of countries are joining the banking union who are not members of the euro, though they may join the euro of course. The banking union involves a common supervisory, common bank resolution and a common retail deposit insurance system which can be applied to countries which are not currently in the euro.

I will look into this matter again. My understanding was that the banking union flows from the single currency and not from the single market, and therefore I will look at this question again and write to the noble Lord once I have considered it.

I was talking about work that we had done with the Danes, the Germans, the Swedes and the Dutch to abolish the policy of “discarding” caught fish as part of a wholesale reform of the common fisheries policy. We have secured the first ever exemption of micro-businesses from new EU proposals from 1 January of last year. We have worked with a coalition of countries to secure the first ever cut to the EU’s budget. We could have done none of this alone. Our engagement with other member states has been, and will continue to be, key. We will continue to work closely with our partners to further the good work on international trade agreements and cutting red tape to make Europe more competitive. We will work with others to ensure that the rights of eurozone-“outs” are protected as the eurozone puts in place the necessary governance arrangements to secure its long-term stability and safeguard the position of the single market.

We will continue to seek greater democratic accountability within the EU, particularly through strengthening the role of national Parliaments, and ensuring that the principles of subsidiarity and proportionality are respected. We will continue to position ourselves at the heart of the debate on the interests that matter most to the United Kingdom.

I think that the reading of the Government’s position on the part of the noble Lord, Lord Davies of Stamford, is simply wrong. We have been clear that membership of the EU is in the UK’s interest. On many occasions, the noble Lord has heard me detail at this Dispatch Box what I feel those interests are.

My noble friend Lord Howell also spoke about the respect for more subsidiarity and national Parliaments needing a red card. I fully agree with that. The Foreign Secretary has, indeed, called for a red card for national Parliaments, and others, such as the Dutch Foreign Minister, have made it clear that they, too, agree. We support the principle set out by the Dutch—namely:

“Europe where necessary, national where possible”.

My noble friend Lord Howell is absolutely right to say that follow-up is now needed. The noble Lord, Lord Davies, also said that we should focus on substance, not rhetoric. I wholeheartedly agree with that. Progress is being made. For example, the Prime Minister worked with Germany, the Netherlands, Sweden and Denmark to secure the cut in the EU budget. The PM and Commission President Barroso co-chaired the meeting of leaders from Germany, Italy, the Netherlands and others in the Business Taskforce, which presented a report on cutting red tape. These are but a few examples.

The noble Lord, Lord Kakkar, has raised the working time directive before. This Government are committed to limit the application of the working time directive in the United Kingdom. The noble Lord made some incredibly important points in relation to specific professions where this has had a disproportionate impact. The evidence suggests that a one-size-fits-all approach in the working time directive limits the time available for training and reduces operational flexibility in relation to particular professions and, of course, in relation to medicine and surgery. The Government will continue to prioritise this important issue which came up in the first set of balance of competences review reports. I do not have details of the clinical trials directive in my brief but I will certainly write to the noble Lord.

My noble friend Lord Dykes asked why the European Union Act 2011 excludes enlargement treaties from the referendum lock. The referendum condition is focused on treaties that expand EU competences or change the voting rules. Extending the geographical scope of the EU does not currently fall within the relevant section because it does not curtail the competence of existing member states such as the United Kingdom.

The noble Lord, Lord Giddens, asked me four questions. I will try to answer some of them. He spoke about the first set of reports from the balance of competences review. I dealt with some of this in an Oral Question earlier today. Although the first set of those reports mainly concern non-contentious areas, even where they lay out the benefits of EU membership they go on to say that further improvements could be made. Therefore, there is a real need for reform outlined in those reports. The noble Lord asked about the restrictions on EU migrants. I do not think I could put it better than my noble friend Lord Howell who commented on that point. I wholeheartedly endorse his comments. The noble Lord has asked me before about the PM campaigning for an exit. I can tell him that my right honourable friend the Prime Minister is campaigning for a referendum. We need to get back behind the idea of giving people the right to decide. We can then campaign in whatever camp we want to as to what we feel the outcome of that referendum should be, but we should at least give people the choice.

The noble Lord, Lord Liddle, suggested that treaty change would not happen or that there would not be the possibility of treaty change. A number of ideas have been considered in European capitals and in Brussels that we feel would require treaty change. Europe is changing because of the eurozone crisis, among other reasons, and we expect that process to include treaty change.

I conclude by thanking the noble Lord, Lord Dykes, again for giving us the opportunity to examine this interesting issue. We have covered some ground and I am sure we will cover more ground tomorrow. The noble Lord, Lord Dykes, in setting out the debate, asked specifically about the vision for reform. I will simply repeat what I said at the beginning about a Europe that is more competitive, more flexible and takes account of the diversity of its different EU member states and the differences between those which belong to the single currency and those which do not; a Europe that is more democratically accountable, so that the connection between citizens and the EU can be strengthened; a Europe where powers flow both ways; and a Europe that ensures fairness between those that are in the eurozone and those that are not.

Many European leaders welcomed the Prime Minister’s January speech and the debate that it has provoked. Many voices across Europe—in the Netherlands, Germany, Sweden, Italy, Austria, the Czech Republic and elsewhere—have spoken out in support of European reform. The Government will continue to prioritise this issue, working closely with our partners across Europe to deliver a Europe that works for all its member states and that works better.

To ask Her Majesty’s Government what assessment they have made of public reaction to recent ministerial statements about United Kingdom membership of the European Union.

My Lords, I start the year by wishing all noble Lords a very happy new year. It is clear that there is wide support for the United Kingdom’s membership of a reformed European Union, both in the United Kingdom and across Europe.

I thank the Minister for that Answer and wish her a happy new year. Will she reassure the House that the Government will be earnestly rebutting the nationalist hysteria in some of our newspapers in this country and in UKIP about various aspects of European policy and will she constantly remind the public—and the Government too—of the enormous benefits that accrue to us from membership of the European Union?

My Lords, membership of the European Union is in the United Kingdom’s interests and we will continue to make the case vigorously as we progress with our proposals for reforming the EU. My noble friend is absolutely right that there is no doubt about the huge benefits that membership of the European Union brings to us, including the 3.5 million jobs in the United Kingdom which are dependent upon trade with the EU.

Is the Minister aware of the enormous damage that the Government’s constant criticism of this country’s membership of the European Union is doing to Britain’s reputation within Europe? Increasingly we are seen as a semi-detached part of Europe, and that does us immense damage.

There are voices across European Union countries that echo our sentiment that we need to move forward with a reformed European Union. Indeed, after the Prime Minister’s speech, we heard voices from the Netherlands, Sweden, Austria and across the European Union who, too, felt that we need to have a Europe which is much more flexible and democratically responsive to the needs of its members.

Surely the noble Baroness did not suggest that, were we to leave the political construct of the European Union and maintain our free trade, as of course we would because it sells us much more than we sell it, any jobs would be lost. She was not saying that, was she?

Does my noble friend agree that, not only is there an overwhelming desire among the British people to have their say on this matter, such an opportunity gives all of us a first-rate chance to make the case for strong membership of Europe?

My noble friend makes a vital point. The question about the direction in which the European Union is heading is out there and ignoring it will not make it go away. Therefore it is right that the Conservative Party’s political view is that we will negotiate a fresh settlement and then hold an in/out referendum before the end of 2017. We on these Benches feel that we need to let Britain decide, and I hope noble Lords will follow in the referendum Bill we have at the end of the week.

I will repeat the question and try to put it in simple terms. Are we as the new leaders of a grouping in Europe advocating that others should undertake a referendum in the form that we are likely to take in this country?

I think the Conservative Party’s position is that this country needs to have the option to decide and that is why we feel that a referendum should be held in this country before the end of 2017.

My Lords, does my noble friend accept that the leadership of the EU, which will of course be renewed post the European elections in 2014, would be advantaged by having a senior Briton among its leadership team? We have had the noble Baroness, Lady Ashton, who we know has done such a super job. Does she agree that in seeking a British candidate on the leadership team it would be again be highly advantageous to have a female in those positions?

My Lords, I am always supportive of Brits holding leadership positions in all institutions, including EU ones. Certainly, strong female leaders from this House have made a great impact in those institutions.

My Lords, does the Minister think that the Government are going about it in the right way to win friends and influence people to carry through their legitimate programme of reform for the EU? In the last month we have seen Ministers of the Crown stigmatising Bulgarians and Romanians as benefit tourists, threatening, to the great annoyance of the Polish Foreign Minister, Poles with benefit changes in the UK and attempting to blame Germany for all the horrors of the First World War. Is this the right way to go about winning friends in Europe?

It is important that Ministers do what they can to make sure that the best possible outcome for Britain is achieved. I think the noble Lord would accept that the first ever cut in the EU’s seven-year budget last year and protection of the UK’s rebate were two great successes. He would also accept that changes and reforms to the common fisheries policy—again Britain putting its interests on the table but doing so in the interests of all of the European Union—are progressive steps. We can therefore show that the Government can act in the interests of the United Kingdom in a way that is also beneficial to the rest of the European Union.

As a former MEP, can I ask the noble Baroness to tell us what the great benefits of membership of the European Union are, other than the single market?

Of course, the single market is one of its greatest benefits, both in relation to the amount of trade—the large marketplace that the European Union presents—and the free movement of persons around the European Union. Let us not also forget that the ambitious trade treaties that the European Union has managed to negotiate with larger developing economies around the world have had great benefits for Britain.

My Lords, the UK is deeply concerned by the terrible violence in South Sudan that began on 15 December 2013. The UK has supported political talks between representatives of President Kiir and former Vice-President Machar. We have provided additional humanitarian assistance on top of our existing commitments to South Sudan and consular support to British nationals.

My Lords, I thank the Minister for her comprehensive reply. Does she agree that one of the most disturbing aspects of this tragic situation is Riek Machar’s delaying the peace talks, thereby prolonging the fighting that has killed more than 1,000 people and displaced more than 200,000, who are now living in life-threatening conditions; and that he has a disturbing track record of changing allegiance and of brutality, including responsibility for one of the worst massacres of the previous war? Will Her Majesty’s Government provide all possible support for the African Union and IGAD to promote a political solution as a matter of urgency and press Riek Machar to join President Salva Kiir’s serious commitment to a ceasefire?

My Lords, unfortunately, the fighting continues in South Sudan. As we are in the middle of sensitive negotiations on the substantive issues between the two parties, rather than procedural matters, it would be the wrong time to try to attribute blame. It is clear that both sides have a case to answer for the violence that we have seen over the past few weeks. The UK is engaged in encouraging participation in the peace negotiations led by the Intergovernmental Authority on Development, which is leading the mediation efforts.

My Lords, I think it is generally accepted that the present conflict arises from the power struggle between Riek Machar and Salva Kiir, with scant regard for some 200,000 displaced Sudanese citizens and more than 1,000 killed so far, as the noble Baroness pointed out. What is the Government’s reaction to the call for urgent additional humanitarian aid, not just bringing forward an existing programme but additional aid to help these people in such a desperate situation? With regard to the negotiations that have begun in Addis Ababa, what discussions are the Government, as a member of the CPA troika, having with like-minded parties: for example, Wang Yi, China’s Foreign Minister; Omar al-Bashir, the President of Sudan; and the chair of the AU, Madame Zuma? What discussions are they having with the EU’s representatives to the African Union?

On the humanitarian question, I assure my noble friend that, as regards the £60 million already allocated to South Sudan, the relevant programmes continue. We have allocated an additional £12.5 million specifically to address the current humanitarian emergency. In terms of the support for the political process, he is, of course, familiar with the troika partners. We, the US and Norway have been involved over a number of years in taking forward work in relation to South Sudan. I assure him that the Foreign Secretary has been in touch with the Sudanese Foreign Minister, the Ugandan Foreign Minister, the Ethiopian Prime Minister, the Ugandan President and, indeed, with Secretary Kerry on the negotiations. The main challenge was to get representatives of both sides to the table. That has now been achieved. They have met in Addis Ababa from 2 January and, as of today, they have started substantive discussions.

My Lords, this is probably one of the most deeply depressing developments experienced by those of us who have spent time in Juba trying to deal with peace, health and food security issues with President Salva Kiir and his original team. The fact that negotiations are taking place in Addis Ababa is, of course, welcome, if the participants take the process seriously. The United Nations Security Council passing a resolution demanding a ceasefire while the negotiations took place would at least indicate the world’s abhorrence for this violent outbreak. I do not believe that it would impede the African Union’s work at all. Will the United Kingdom and its friends sponsor such a resolution immediately?

The Foreign Secretary has issued a number of statements in which he has called for the violence to stop. As the noble Lord is aware, the United Nations Security Council resolution, which I think was passed on Christmas Eve, was specifically intended to ensure that further troops were put on the ground quickly to try to stop the situation deteriorating. They also strengthened the existing UN mission in South Sudan to support its humanitarian work so that the human rights abuses that were occurring were properly documented to ensure that responsibility follows these acts. The negotiations between the representatives of the two parties are ongoing. We have done a huge amount of work in the background but also in leading these negotiations. The Foreign Office’s political director, Simon Gass, was there throughout the Christmas period, working with the US and his other counterparts. If it is felt that a further UN Security Council resolution is required over and above the statement issued on 30 December, I will certainly take the noble Lord’s views back.

My Lords, in her written reply to me on 3 January, the Minister said that the unanimous adoption of United Nations Security Council Resolution 2132 authorised a significant increase in the number of troops in the UNMISS force in South Sudan. Can she tell us what the numbers actually are and whether she believes that they will be up to the task of dealing with the situation, which, as we have heard, has led to a displacement of 200,000 people? Does she not also agree that there is a real danger that these events in South Sudan will distract the world from looking at what is happing just over the border in Blue Nile, South Kordofan and Darfur, where the campaign of aerial bombardment by Khartoum goes on as we meet?

The noble Lord, as always, makes an informed and important point. In relation to the UN Security Council resolution, a further five battalions were committed, which amounts to about 5,500 troops. Three police units were specifically granted, which amounts to about 480 personnel—those are the increased numbers at this stage. The noble Lord makes an important point about regional challenges, but one of the positive features of this current tragedy is how, for example, Ethiopia, Uganda and even Sudan have acted in a much more responsible way. There has certainly been a suggestion that there could be some joint working between Sudan and South Sudan, maybe in relation to keeping the oil flows going.

My Lords, North Korea continues to have one of the worst human rights records in the world. The recent execution of Chang Song-thaek provides further evidence of its disregard for even the most basic human rights. We are closely monitoring the situation, and we are consulting allies in order to understand the implications of recent events.

My Lords, is the Minister aware that even before last week’s execution of Chang Song-thaek, the Times reported that there had been 80 public executions in seven cities on one day alone, the victims tied to stakes, hooded and killed by machine-gun fire? The United Nations estimates that there are some 300,000 people in the gulag network in North Korea—a network which, according to Amnesty International, is being expanded. Will the Minister read the report An Unmet Need, launched this morning at Westminster, which calls for the extension of BBC World Service broadcasts to North Korea as a way of breaking the information blockade, of exercising soft power—as we have done so successfully in places such as Burma—of promoting democratic values and of challenging a regime that relies on Stalinist purges, show trials, the obliteration of opposition and a cruel reign of terror?

I will of course read that report, and will ensure that it is brought to the attention of the Minister with responsibility for North Korea. I understand the noble Lord’s position in relation to the BBC; indeed, he has asked questions on this subject in the past. I also understand that the BBC has recently conducted a feasibility study of, for example, radio broadcasting in North Korea, but has concluded that because of the North Korean Government’s ability to jam broadcasts, the reach that would result from such broadcasting would not provide sufficient value for money. The noble Lord will know that the BBC has full editorial, operational and managerial independence on such issues, and we understand that it is not currently persuaded that a Korean language service would be an effective use of its funds. However, I will look at the report.

My Lords, the whole House is of course united in its condemnation of recent shocking events. The Opposition are at one with Her Majesty’s Government in their concern about the impact of this unpredictable regime on regional stability. Given China’s important role, both now and in the future, did the Prime Minister discuss North Korea with his Chinese hosts during his recent visit? In any event, is it the Government’s intention to have some discussion now, as a matter of some urgency?

The noble Lord may well be aware that Chang Song-thaek was closely involved with China. At the time of the execution, China issued a statement but said that it was an internal matter for North Korea to deal with. The noble Lord is right that this is an incredibly unpredictable regime. We engage with human rights in North Korea in so far as we can, but he will also be aware that North Korea has refused to engage in any form of meaningful dialogue on human rights.

My Lords, the noble Lord, Lord Alton of Liverpool, has regularly and rightly brought our attention to this matter in terms of the internal implications within North Korea. However, I think that the situation is now coming to the point where the whole Korean peninsula is at risk and there are wider elements. Did the Prime Minister in his engagement with the Chinese raise this wider question of whether the problems within North Korea are now in danger of spilling into the wider peninsula and perhaps even beyond?

My noble friend will be aware that there are six-party talks which deal with the issue of the wider peninsula, which involve China, South Korea, Japan, Russia, the US and North Korea. We are not a party to those talks but we feel that that is the best forum to take some of these discussions forward.

My Lords, what specific measures are Her Majesty’s Government taking to pursue a twin-track approach with the DPRK regarding accountability for crimes against humanity, which we have been hearing about this morning, alongside robust, critical, constructive engagement, in an attempt to open up that most closed nation and alleviate the suffering of the peoples of North Korea who have suffered at the hands of that regime, which acts with impunity, for so long?

We are taking exactly that approach. The noble Baroness will be aware of the UN commission of inquiry, which we co-sponsored, which began in March this year and I think is due to report to the Human Rights Council session in March 2014. Human rights, including the issue of prison camps, will be dealt with as part of that report. We also engage with North Korea bilaterally. As I said earlier, North Korea does not engage in any form of meaningful dialogue on human rights, but it must be remembered that we are only one of 24 countries that have an embassy in North Korea. We have had a diplomatic relationship with it for the past 30 years, which provides us with some opportunity to engage with it.

My Lords, my right honourable friend the Foreign Secretary met Navi Pillay, the United Nations High Commissioner for Human Rights, during her visit to London on 6 November. The High Commissioner discussed with the Foreign Secretary a range of human rights issues including Syria, Burma, Sri Lanka and Iran, and our preventing sexual violence in conflict initiative.

My Lords, the noble Baroness has left out one of the items which I know the High Commissioner discussed with Ministers, and that is the call that she made for the strong and swift implementation by the Government here of their new legal obligation to extend the Equality Act to include caste in the list of protected characteristics. Postponing that question until the other side of the general election is incompatible with the obligation. In the light of the High Commissioner’s advice, can my noble friend say whether the Government will speed up the timetable?

My Lords, the Government are committed to outlawing caste discrimination. However, we are aware that legislating on the basis of limited evidence carries a serious risk of unintended consequences, and we need to get the detail of the legislation right. My noble friend has been a huge campaigner on this issue. I can assure him that the Government are committed to it, but it is important to ensure that the consultation on what that legislation would look like is completed, as well as making sure that the relevant groups that would be affected are fully brought into the process. He will be aware, of course, of the report of the National Institute of Economic and Social Research, published in December 2010, which unfortunately proved to be quite divisive because people used it to support both sides of the argument.

My Lords, Navi Pillay has called for an international inquiry into war crimes committed during the Sri Lankan civil war and has said that the regime is now showing signs of moving in an increasingly authoritarian direction. Following the Prime Minister’s attendance at the CHOGM, what diplomatic efforts are the Government making to secure support for a strong resolution on Sri Lanka at the March 2014 session of the UN Human Rights Council?

Of course, at the time that Navi Pillay visited the United Kingdom, the CHOGM had yet to happen. It was one of the issues that was discussed with the Foreign Secretary. We are keen to see some incredibly robust language and text at the Human Rights Council in March 2014.

My Lords, given that the visit of Navi Pillay took place just a few days after the United Nations Commission of Inquiry was here at Westminster taking evidence about the egregious violations of human rights in North Korea, and given the events of last week with the execution of Chang Song-thaek and the Amnesty International report which shows the expansion of political prison camps as part of the gulag system that incarcerates more than 300,000 people, can the Minister say whether Navi Pillay spoke to Ministers about the situation in North Korea and whether this was one of the issues we had on the agenda for that meeting?

She did discuss that matter with the Foreign Secretary and it was one of the issues on the agenda. The noble Lord may be aware that an Urgent Question has now been granted for Wednesday specifically on North Korea. I look to the Lord Speaker to confirm that but, if that is the case, I can, I hope, answer that question in much more detail on Wednesday.

My Lords, to return the Minister to the Question asked by the noble Lord, Lord Avebury, the paving legislation on caste discrimination was agreed by this House in 2010. There was an overwhelming majority in the House in favour of including caste discrimination in our legislation not that long ago but it looks like that will not be implemented until after the next general election. The United Nations High Commissioner has asked for strong and swift implementation of the legislation. Can the Minister say whether that is compatible with her statement and the fact that it will now have taken more than five years to implement if the Government stick to their current timetable?

As it stands, the timetable is that the public consultation will be held around February and March next year. That will be followed by some targeted sector-specific engagement with groups that need familiarisation with the new legislation, including certain employers, public authorities and the judiciary. It is anticipated that the legislation will come into force in October 2015, but I am quite happy to take back the noble Baroness’s comments to the Minister who deals with equality issues.

My Lords, freedom of religious belief is becoming a bigger issue, sadly, around the world. What are the UK Government doing in terms of working, particularly with the Human Rights Commission, to promote freedom of religious belief?

My noble friend will of course be aware that freedom of religion and belief is one of the six priorities for the Foreign and Commonwealth Office. Indeed, it is a personal priority of mine and something into which we have put additional resources and energy since my appointment at the Foreign Office. We are dealing with this matter on a number of levels through both the Human Rights Commission and our support for Resolution 16/18, which determined, among other things, tolerance towards minority religions. We have also instigated and chair a political track to this process. The first meeting was held at the beginning of this year and the second at the UN General Assembly in New York in September. We are proposing that a conference on freedom of religion and belief should be held in the United Kingdom next year.

My Lords, will the Minister perhaps say a word about the resources available to the High Commissioner for Human Rights? I understand that the Government have in fact found an extra £500,000 voluntary contribution—a matter on which I am still waiting for a reply from the noble Baroness, following the debate in the name of the noble Lord, Lord Alton, some weeks ago. What are the Government doing at the UN to ensure that the resources for the High Commissioner for Human Rights in 2015 and 2016 are not constrained and reduced, as they currently are? Are we supporting an increase in those resources?

I apologise to the noble Lord for the delay in responding. I did in fact sign the letter on Saturday so I know it is on its way to him. It may be on his desk this morning. In relation to funding, the noble Lord will be aware that as well as making our contribution to the UN general budget, which is about 5%, we make voluntary contributions to OHCHR of about £2.5 million a year. On top of that we make additional voluntary contributions, which can be anything between £2.5 million and £4 million. We were the seventh largest donor to the office during 2012. The 2013 figures have not yet been published but I assure the noble Lord that we are incredibly aware of the pressures on OHCHR in terms of its funding and that we do feel that it should be properly resourced. However, that does not stop us from making quite strong representations for better budget management. We are asking OCHCR to do more but we also think that it should do more with the money that it has.

My Lords, at the OSCE ministerial council in Kiev on 5 December, chaired by Ukrainian Foreign Minister Kozhara, the Minister for Europe, Mr Lidington, reiterated his concerns about violence being used against peaceful protestors and journalists. He stressed the importance of Ukraine, particularly as an OSCE chair in office, upholding OSCE values, including freedom of assembly and expression. While welcoming the Ukrainian authorities’ commitment to a thorough investigation, he emphasised that the investigation must be rigorous and fair.

My Lords, I was in Independence Square in Kiev on the night that the demonstrators were attacked. I confirm to my noble friend that the demonstrators, who had been democratically calling for closer trade links with the European Union, had been both peaceful and good humoured and that the violence came entirely from the Government’s security police. I am not sure what will be served by an investigation to further establish that. Is it not a political fact that the Ukrainian Government have caved in to the financial blackmail of Russia while the demonstrators have rejected the bribes, are acting out of principle and very much deserve our support?

I agree, of course, with my noble friend’s comments. The demonstrators are acting within their right to freedom of expression and are expressing their views about the direction that the country is going in. I was at the Vilnius summit at the end of the November, where it was anticipated that Ukraine would sign the association agreement, which it had initialled in 2012. We were disappointed that that progress was not made. However, I stress that the door remains open and it is for the Ukrainians to walk through it.

My Lords, today, on the 65th anniversary of the Universal Declaration of Human Rights, the EU high representative, my noble friend Lady Ashton, arrives in Ukraine to assist the country to resolve its current difficulties. The House will wish our colleague all good fortune in that task. The Minister has just confirmed that the EU’s door remains open as far as the EU-UK association agreement is concerned. Beyond that, can she tell the House what steps our Government will take to try to make sure that it gets back on the table as quickly as possible?

The noble Lord will be aware that we have been acting through the Eastern Partnership, which includes the European Union as a whole and six countries of eastern Europe. I, too, pay tribute of course to our noble friend Lady Ashton, who is on her way to Kiev as we speak. There is a meeting today between President Yanukovych and three former presidents to try to find a way through the current protests. We of course wish the noble Baroness well, on behalf of the European Union, in trying to find a solution to this matter. I repeat that the door is open for Ukraine and it is for Ukrainians to decide in what direction they want to take their country.

Along with our European Union partners, we will of course keep all measures before us as to how we respond to this. We understand that at the moment there are still many thousands of protestors on the streets. It is important at this stage that the Government establish a positive dialogue to find a way through this without an escalation of violence.

My Lords, does my noble friend accept that while Russia’s intervention just before the association agreement was mostly unhelpful—clearly, pressure was applied—the European Union was also at some fault for pressing Ukraine so firmly to be ready to sign in Vilnius, rather than giving Ukraine more time to prepare itself in terms of its economic engagements when it signs up to the association agreement? In light of the specific question about what the UK Government might do, have we contemplated working with the opposition groups? The opposition in Ukraine is still fairly divided and, looking forward to the 2015 elections—or any change of Government before then—it is vital that we get a united opposition to Mr Yanukovych’s Government.

My noble friend makes an important point. We are engaged with both the Government and the opposition. I stress that with regard to the association agreement, and in terms of a potential IMF programme that may happen in Ukraine in 2014, conditionality is important. Those conditions are not placed upon Ukraine—and, indeed, Georgia and Moldova, which did make progress in Vilnius—because we are trying to be awkward but because we feel that these are fundamental reforms which are in their interest and set them on the path to much more constructive engagement and a more balanced economy.

My Lords, does the noble Baroness agree that the media oligarchs have an enormous influence on the way things go? Does she think that they are becoming more sympathetic to the opposition?

I have not been following the media inside Ukraine but I am aware that journalists have been targeted as part of the government crackdown on some of the protests. As we can see from the hundreds of thousands of people who have taken to the streets in Kiev and elsewhere, opinion in Ukraine is divided. The views of its leadership are not the views of the street.

My Lords, we welcome continuing talks between the Burmese Government and ethnic groups, including the Kachin and Shan, towards a nationwide ceasefire and political settlement. We are, however, concerned by recent reports of fighting in Kachin state and continue to argue for full humanitarian access. We continue to monitor tensions in Rakhine state and press for improved security and accountability, better co-ordination of humanitarian assistance and a solution to the question of Rohingya citizenship.

My Lords, I thank the Minister for her encouraging and helpful reply. Is she aware that I have visited Kachin and Shan states, where I have seen massive civilian displacement, widespread suffering caused by the Burmese army’s continuing military offensive and violations of human rights? Therefore, the proposed engagement of the British Army with the Burmese army is causing such anxiety that ethnic national leaders have written a letter highlighting their concerns. What assurance can the Minister give that this co-operation will provide no enhancement of Burmese military capacity for further assaults on its civilians but will be conditional on progress on the protection of human rights and a genuine peace process?

As ever, my Lords, the noble Baroness comes to Question Time with the most up-to-date information, and I very much value her input. As she will be aware, the Burmese military is a core political force in Burma. It is therefore important that professionalism and human rights as an essential element of the work they do is part and parcel of their training. The focus of our defence engagement in Burma is on adherence to the core principles of democratic accountability, international law and human rights. We have been delivering a course—a course which has been delivered in many other parts of the world—that specifically focuses on the professionalisation of the work that the army does. The Chief of the Defence Staff visited Burma earlier this year to deepen that engagement. I can assure the noble Baroness and other noble Lords that we will not be involved in the sale or transfer of arms or military equipment or play a part in military combat. We are involved in the professionalisation and accountability that the Burmese army needs to be aware of when conducting operations.

My Lords, Aung San Suu Kyi stated that Nelson Mandela made us all understand that nobody should be penalised for the colour of his skin or the circumstances into which he was born. Sadly, the Rohingya Muslims are still being persecuted on grounds of their race, ethnicity and religion. What representations are Her Majesty’s Government making to the Burmese Government that they should sign up swiftly to the basic international norms in the International Covenant on Civil and Political Rights? Without such a commitment, how can the Minister assure the UK taxpayer that our aid is being distributed without discrimination?

The discrimination against the Rohingya community and, indeed, against Muslims in other parts of Burma, is a matter of huge concern. It was raised at the highest level by the Prime Minister in discussions with President Thein Sein when he visited earlier this year. It is important for us to respond to the deteriorating humanitarian situation on the ground in relation to the Rohingya community and to deal with the long-term issue of citizenship. My noble friend has made an incredibly important point. The basis of the argument used by the Minister who raised the issue with me was that the Rohingya were not really members of the Burmese community because they looked different, they had not been in the country long enough and they were from a different religion. I am sure that the irony of that was lost on the Burmese Minister when he was talking to me.

My Lords, a national census is due to take place in Burma in 2014, as I am sure the noble Baroness knows. It has largely been funded by the United Nations and, as I understand it, the UK will contribute $16 million. In view of the appalling levels of religious and ethnic discrimination in Burma, does the Minister anticipate that the Rohingya—who are not officially recognised, as we have heard, as one of the country’s ethnic groups—will be included on equal terms in that census? In view of that reality, how do our Government intend to ensure that the UN guarantees a complete count of the population of Burma?

This is a hugely controversial issue in Burma. There are concerns about the way in which the Government would like to define the Rohingya community, not so much as Rohingya but as Bangladeshis—I think that they want to define them as Bengalis. We have raised this issue. Some recommendations were made in the internal report that was done, and the President made some positive comments. We have also put forward evidence that shows the length of time that the Rohingya community has lived in Burma. I am not sure that I can give the noble Baroness a specific answer but I will write to her with further details.

My Lords, given that my noble friend has mentioned humanitarian assistance, can she tell us what discussions the Government are having with Burma’s neighbours about the people from all the tribes that the noble Baroness, Lady Cox, mentioned, who are displaced across Burma’s boundaries? Particularly in light of the forthcoming census, are the Government supporting efforts to identify those who should rightly be identified as Burmese but are displaced externally?

We have of course had discussions not just within Burma but with the Thai authorities. I had an opportunity to discuss the matter with the Bangladeshis and, indeed, had an opportunity to visit Cox’s Bazar, where there are large numbers of the displaced community. We have committed £180 million up to 2015, which is specifically humanitarian assistance. Some of that is for use in relation to individual communities, such as the Kachin and the Rohingya, within Burma, but some is for peacebuilding and support along the Thai-Burmese border. I am not sure that I caught all of my noble friend’s question because of the noise but I hope that that answers it.

My Lords, has the noble Baroness had the opportunity to look at the Human Rights Watch report that has categorised what is happening to the Rohingya people as genocide, and said that what is happening in Kachin state amounts to war crimes in the perfectly technical sense, not just in the rhetorical sense? Given those allegations, can she tell us what the Government are doing about raising that issue, particularly in the Security Council? Does she accept the underlying point that the ethnic minorities in Burma are in grave danger of being exploited more and more as the country opens up, and that more needs to be done to protect them during this process of opening up?

Yes, I am familiar with the report; and alongside that report we have our own disturbing and specific allegations which have been backed up by comprehensive evidence. However, at this stage we feel that rather than a UN-mandated inquiry, it would be better and probably more likely to be effective if it were done internally by the Burmese, and we have been encouraging them to go down that route. The noble Lord will also be aware that the Burmese Government have agreed to open up an OHCHR office. The President made a commitment to an office with a full mandate but it has not at this stage been fulfilled. The noble Lord may also be aware of a recent UN Third Committee resolution which focuses on concerns about the delay to the opening of that office. We think that the opening of an office with a full mandate is one of the ways in which we could take forward some of these concerns.

My Lords, after that last question I am really looking forward to the debates in January. The Government have impressed on Iran the importance of it playing a constructive role in Syria—for example, in pressing for greater humanitarian access. However, its current actions are far from that. Iran continues to support the Assad regime financially and militarily. We are using the upgrading of our diplomatic relations to engage Iran on a range of issues, including Syria.

I thank the Minister for that Answer. Bearing in mind the remarkable success of my noble friend Lady Ashton in chairing the nuclear talks, the importance of the links that have developed between Iranians and civil servants in the European Union and the western powers, and the effect of the international sanctions that have brought Iran to the table, is it not time to expand those contacts with Iran to try to use extra influence on them both against the Assad regime and with Hezbollah?

We are expanding our contacts with Iran. The noble Lord will be aware of the meetings between Foreign Minister Zarif and my right honourable friend the Foreign Secretary, William Hague, and the telephone conversations between the Prime Minister and President Rouhani. He also will be aware of our decision to appoint the chargé d’affaires last month. I can inform the House that our chargé d’affaires, Mr Ajay Sharma, visited Iran this week on 3 December. We are hoping that the chargé d’affaires from Iran, Mohammad Hassan Habibollah-zadeh, will visit the United Kingdom this month.

Following on from the Minister’s helpful answer, could Her Majesty’s Government cease supporting with quite such pressure the fractured, and in some ways poisonous, opposition in Syria? Could they ask Iran, with its concessions already in the bag, to be at Geneva II with a guaranteed seat and a proper invitation?

The national coalition represents a broad range of Syrian opinion. We could not proceed with the Geneva II discussions without the views of the Syrian people being at the table in a wide and broad way, so possibly I disagree with my noble friend on that point. Any constructive role that Iran can play in relation to Geneva II is good. However, Iran must first and foremost say that it supports the communiqué that was agreed at Geneva I. It could not possibly be part of a process where it does not agree with the outcomes as detailed in the communiqué.

My Lords, in Her Majesty’s Government’s discussions with Iran, have the Government stressed the need for progress on regional co-operation, however difficult that might be to achieve? Do the Government have a view on how to lessen the distrust, particularly between Iran and Saudi Arabia and between Iran and the Gulf states, so that this level of distrust in regional geopolitics does not perpetuate the battles in Syria beyond the point that they are already at?

The noble Lord raises an important point. It was right that we communicated properly the discussions that we were having with Iran and the outcome of those discussions. We must bear in mind that this is an interim discussion relating specifically to Iran’s nuclear programme. I think that our partners, whatever their reservations, and they are right to have reservations in the light of Iran’s previous conduct, accept that an Iran with nuclear arms, which was where Iran was heading, was not the right way forward, and therefore to halt the programme and in some ways to unroll it must be the way forward. This is an interim agreement with a view to a final settlement agreement in due course.

My Lords, Iran was unable to accept the conclusions of the first Geneva conference. Can the noble Baroness assure the House that that is not a sufficient reason in itself for excluding Iran from Geneva II?

The noble Lord will be aware that that communiqué, among other things, reiterates the need for a transitional Government who have full executive powers and for that to be done with mutual consent. If Iran cannot agree with that statement, I am unsure what constructive role it could play by being at the table in Geneva. Iran can play a constructive role in advance of that—for example, by leveraging its influence in Syria to give us better humanitarian access. That is an early win that Iran could put on the table to show that its intent and actions supported its words.

I am sure that the House welcomes the dialogue taking place between Iran and Syria while they continue to supply Hezbollah with arms and training. During these cosy talks with this butcher who is the new President of Iran, could the Government ask him to spare a thought for the executions in Iran of its own people that take place almost daily?

My Lords, we feel that the discussions with Iran are constructive and that the intent that we have seen so far has been sincere. I take on board the noble Lord’s strong views but I also take the view that closer diplomatic relations mean that we can start to tackle the difficult issues around human rights, including the use of the death penalty, face to face.

My Lords, the UK is working with our international partners, including in the UN Security Council, the UN Office for the Coordination of Humanitarian Affairs and the Friends of Syria core group, to ensure full implementation of the UN Security Council presidential statement of 2 October to allow free and unfettered access for the delivery of aid to all Syrians. As stated by the UN, the primary onus is on the Syrian regime to comply with these measures, and we are actively engaging with Russia to reinforce this message to the regime.

My Lords, I hope that the Minister accepts that my call on the Government to resume contact with the Government in Damascus in no way means that I condone the appalling things that have happened in Syria on all sides—any more than I condone the many other breaches of human rights named by the noble Lord, Lord Alton of Liverpool, during his astonishing debate on 21 November. Does the Minister accept that nearly all the Governments named by the noble Lord enjoy diplomatic contact with Her Majesty’s Government, and that with one of them, Iran, we have recently resumed diplomatic relations? Given that the Syrian Government appear to have restored their authority over most parts of Syria in recent weeks, is it not time to resume our diplomatic presence in Damascus, both for the reasons mentioned in my Question, and to perform the necessary consular functions to protect the remaining British community?

I of course hear the point that the noble Lord makes. There has been some limited contact in relation to consular matters. We have not formally broken all diplomatic ties with the Syrian regime. It has withdrawn its people from the embassy here, and we have done the same in relation to our people in Syria. We have maintained some contact via other embassies that still have personnel within Syria. We have felt that, in terms of progress on humanitarian work and in relation to the chemical weapons work that is going on, the UN is the right body through which to engage. That is the process that we have been adopting.

My Lords, is the Minister aware that 500,000 children have not been vaccinated against polio over the past two years because of the conflict and the lack of humanitarian access? What is the UK doing to secure guarantees of respect for what Save the Children calls a “vaccination ceasefire” that which will allow unconditional, safe access by humanitarian workers, before this highly infectious and crippling disease becomes an epidemic across the whole of the Middle East?

The issue of providing access specifically to vaccinate children was raised at the high-level meeting chaired by the noble Baroness, Lady Amos, on 26 November. So far, about 10 cases of polio have been confirmed and 12 more potential cases have been identified, but it is thought that hundreds of children are carrying polio in a country where it had been completely eliminated. This is one of a number of humanitarian issues that we are hoping will be dealt with in the run-up to the Geneva 2 meeting in January.

My Lords, just a few minutes ago I spoke to the staff of Médecins Sans Frontières, who emphasised that it is essential to establish many more humanitarian corridors, especially in the disputed areas, to allow the entry of essential antibiotics and anaesthetic agents. Will the Government continue and, indeed, redouble their efforts to establish these corridors?

My noble friend makes an important point. This is one of the ideas that have been put forward. However the noble Lord will be aware that humanitarian corridors are not defined in international law and, although there have been some successes in the past, such corridors require all parties to agree to their establishment. In the absence of such agreement, establishing these zones usually requires foreign military intervention, which is not on the table at the moment. The noble Lord will also be aware that humanitarian corridors and safe areas have not always worked in the past. A case that comes immediately to mind is the Srebrenica genocide, which occurred in a safe area.

Does my noble friend agree that the most enduring solution to the humanitarian crisis in Syria is a successful conclusion of the Geneva 2 talks and the implementation of the Geneva communiqué’s plan for a transitional Government? In the light of that, have the Government moved on their position on the attendance of Iran at the Geneva 2 talks and on the continuation of President Assad in any form of transitional Government?

We have very clear priorities in Syria. The first is to ensure that we alleviate humanitarian suffering. The second is to prevent Assad from using chemical weapons on his own people again. However, this is against a backdrop of finding a political solution that brings the conflict to an end. It is good that the date of 22 January 2014 has now been set for Geneva 2. In relation to Iran, parties to Geneva 2 are those that have formally endorsed the Geneva communiqué. Iran has not yet done so publicly. There is a sense that Iran is not playing a positive or helpful role in the current crisis.

My Lords, have the Government yet formed a view as to what part the Assad regime should play at Geneva 2? If they have formed a view, are they yet in a position to be able to inform the House?

We expect the regime to play a part in Geneva 2, which is all about coming forward with a proposal to establish a transitional governing body. This has to be done with mutual consent, so the regime must play its role. However, it seems incredibly unrealistic to expect real progress in Syria if Assad has any role in a body that has full executive powers and, therefore, control over the military, security and intelligence apparatus. Large parts of Syria do not accept him or expect him to play such a role.

My Lords, to what extent do the Government actively support the efforts of the noble Baroness, Lady Amos, head of the United Nations office for humanitarian assistance, to set up a humanitarian corridor in Syria? What, if any, are the objections expressed by any member of the UN Security Council to the establishment of such a project?

Of course, we fully support the work of the noble Baroness, Lady Amos, who is another great example of a Member of this House playing an incredibly important role on the international stage. We pushed and worked with the noble Baroness on the UN Security Council presidential statement during the UN General Assembly meeting in October this year. That asked specifically for humanitarian agencies to have immediate, unfettered access to all parts of Syria. Therefore, the establishment of a humanitarian corridor is part of a process; it is one of a number of options that could bring that about. However, first and foremost it is about having unfettered access. We have access to all 14 governorate regions of Syria, but unfortunately not to all the populations within those regions. Tragically, millions of people still have not had any humanitarian support for nearly 12 months.

My Lords, I thank my noble friend Lady Hodgson for highlighting this important issue. This is a timely debate. Along with her, I had the privilege this morning of addressing the Afghan Deputy Minister for Women’s Affairs, Fawzia Habibi, and her fellow parliamentarians Shukria Barakzai, Dr Nilofar Ibrahimi and Raihana Azad at the Chatham House event on the status of Afghan women post-2014.

I share my noble friend’s deep concern—echoed, I know, by everyone who has spoken in this debate today—that the considerable progress that women have made over the past decade in Afghanistan may be eroded and some gains may be lost. The protection and promotion of women’s rights in Afghanistan is a central pillar of our activities in Afghanistan and a cause to which I am personally committed; indeed, my maiden speech many years ago was on the issue of Afghan women’s rights.

Despite having been a cynic when we first intervened in Afghanistan, I have seen the progress and the transformation that have taken place and the contribution that women are making at all levels of Afghan society. I have had the privilege to meet some of the truly inspirational women who are risking their lives and leading the way on this issue. It is a central issue against which we will be judged when we consider the sacrifices that have been made in Afghanistan and whether they were worth the state in which we leave it.

I had hoped that more Members of your Lordships’ House would take part in what I think is an incredibly important debate. All noble Lords said that the gains made must not be lost, a message that we continuously reiterate to the Afghan Government. Last week my right honourable friend the Secretary of State for International Development highlighted the importance of this with President Karzai during her visit to Afghanistan. My noble friend Lady Jenkin referred to the gains on education, employment and political participation. I co-chaired the joint commission on the enduring strategic dialogue between the UK and Afghanistan, and I stressed those gains when we had that meeting a few weeks ago in Afghanistan, which I co-chaired with the Afghan Deputy Foreign Minister, Mr Ershad Ahmadi. There is one female vice-presidential candidate in the forthcoming presidential elections, Habiba Sohrabi, who is an ex-governor of Bamyan province. When I spoke with presidential candidates, I said that it is not just about having front-facing candidates but whether you have women in all aspects of your decision-making, in terms of your policy, the inner circle and the campaigning theme which is going to take these elections forward. I think I gave them some food for thought, given that at least two of the candidates could not mention a single lady.

Challenges, therefore, remain in many parts of the country, but Afghan women are starting to take control of their lives. They rightly want a voice in deciding Afghanistan’s future. Next year’s elections are a real opportunity for women to play an even greater role in shaping their society. As the noble Lord, Lord Collins, mentioned, through the Asia Foundation DfID will provide up to £4.5 million to strengthen women’s political participation as candidates and leaders and in other ways.

The noble Lord, Lord Collins, and my noble friend Lady Jenkin raised the issue of girls’ education. We welcome DfID’s commitment to provide education for 250,000 of the poorest girls in Afghanistan, and this complements the UK’s existing funding for education there. As my noble friend Lady Jenkin notes, virtually no women were in education in Afghanistan in 2001, and to date over 2 million girls have been educated, largely thanks to funding by international donors including DfID.

My noble friend Lady Hodgson, followed by the noble Lord, Lord Collins, asked about the new DfID programme announced by my right honourable friend Justine Greening. DfID will provide a further £8 million to the UNDP’s Elect II programme, bringing DfID’s total support to £20 million, and this will support the three key Afghan election institutions, including the independent election commission’s gender unit. The UK will also provide £7.5 million to strengthen political governance in two main ways: first by capacity building for parliament, and secondly by developing skills for women provincial councillors.

I was pleased that the Afghan Government reaffirmed their commitment to implement the measures included in the human rights reform agreed under the Tokyo mutual accountability framework, the TMAF. At the Afghan Government’s request, the UK will co-chair the first ministerial review of progress against the TMAF in 2014. The final timings and venue of that have not yet been fixed, but as soon as I have more information I will update the House.

Achieving lasting peace and stability in Afghanistan must be our primary aim, but we will continue to make clear that any political settlement involving the Taliban must preserve the progress made to date and respect Afghanistan’s constitutional framework, including the protections it provides for women and minorities. Reconciling the Taliban must never be at the expense of gains made in women’s rights.

It is for the Afghan Government to ensure that women’s rights are protected. We welcome their intention to publish a national action plan for the implementation of UN Security Council Resolution 1325 on women, peace and security, and the fact that UN Women and other partners, including civil society, are being consulted in its formulation. The British Government will continue to provide assistance where appropriate. It is important that the Afghan Government ensure that a strong political will is galvanised behind implementing it fully.

With regard to women’s rights generally, I think I said this morning that we must keep them on the agenda. It will be so easy, when we have withdrawn our combat troops at the end of 2014, for this to start slipping. One way to do that is through the Afghanistan universal periodic review at the Human Rights Council in Geneva. The review will take place in early 2014, and that will provide an opportunity for us and the rest of the international community to raise our concerns, and for the Government of Afghanistan to show the strength of their commitment to safeguard women’s rights.

Afghan civil society also plays a vital role, and our support for it will have to endure. The British Government recognise their contribution through the DfID-funded Tawanmandi programme, which has been referred to in today’s debate. This includes a specific focus on women’s rights. To date, for example, 66% of grants awarded either focus specifically on gender issues, or have a strong gender component. Funding for this is going to continue until at least 2016.

We must also acknowledge that Afghanistan, as many have said, is a deeply conservative country. Substantial improvement to the situation of Afghan women is likely to take place over the long term, and progress is likely to come in short steps. Against this backdrop we should recognise the courageous efforts of all those across Afghanistan who are working to defend the rights and fundamental freedoms of others. In particular I applaud female human rights defenders, who face enhanced risks from conservative elements of their society. The Government will continue to support and defend these brave individuals who, by seeking to protect the rights of others, are challenging historic and very conservative social norms.

We continue to contribute to the work of the Afghanistan Independent Human Rights Commission. We will continue to work closely with all our international partners to improve our understanding of the risks faced by human rights defenders so that they can be mitigated. Every time I visit Afghanistan—I think that I have visited four times in the past 12 months—I make a point of meeting the Afghan Independent Human Rights Commission and Sima Samar, an incredibly inspirational individual at its head. We will continue to raise our concerns and, where appropriate, to issue public statements condemning violence. These days, with the progress in terms of social media and being Twitter-linked to many female Afghan parliamentarians, it only takes a direct message for us to become aware almost instantaneously when things are starting to go wrong in Afghanistan.

My noble friend Lady Hodgson also raised the issue of stoning for adultery and the penal code, which of course has been in the media. The Secretary of State for International Development raised concerns about these reports in her meeting with President Karzai last week. I think that we saw some rowing-back from what was then described as a consultation. However, even a consultation is dangerous territory for the Afghan Government to be starting to venture into. The UK opposes abhorrent practices such as stoning, which are a disturbing reminder of the type of justice carried out under the Taliban. That has no place in modern Afghanistan.

The noble Lord, Lord Collins, asked about recruitment of Afghan women to the police. The UK agrees that the recruitment of women in the police has not been a high enough priority. The Afghan Ministry of Interior has set up a working group. The EU police commission to Afghanistan is seconding in some expertise to come up with a comprehensive approach to the role of females in the police. Its aim is to increase the number of police women by adjusting selection procedures, improving working conditions and providing better training. However, the risks are incredibly high for these individuals. I saw a tragic case. One female officer whom I had met on a recent visit to Helmand was attacked and killed by the Taliban purely for being a member of the local police.

My noble friend Lord Alderdice raised India, which, of course, is an important regional power and an important country in terms of the future of Afghanistan. It is actively involved in Afghanistan, including among other things through the development work that it does there. The Pakistan-UK-Afghanistan trilateral procedure is one of a number of forums created to try to create a better process between countries in the region in order to progress on issues such as women’s rights. Other processes are, for example, the Heart of Asia and, of course, bilateral relationships. It is not an either/or situation between Pakistan and India in terms of Afghanistan. We regularly keep the Indians updated on the trilateral process. Indeed, the Prime Minister did so on his recent visit to India when he spoke with Manmohan Singh. At the last trilateral meeting, both Afghanistan and Pakistan indicated that they would like us to continue with this and to try, effectively, to act as an annoying friend to allow the two to develop their bilateral relationship further.

My noble friend Lady Hodgson spoke about the Elimination of Violence Against Women law being a key deliverable in the TMAF. Our £7.1 million of assistance to the Ministry of Interior includes a strong focus on developing Afghan policy and promoting human rights in the security sector and protecting women from violence. The UK also supports the Afghan national police response unit, which investigates domestic violence and provides support to female victims of crime. DfID has made tackling violence against women and girls a strategic priority for its work in Afghanistan. It will make announcements in the near future on what more it can do to address this issue. As my noble friend is aware, this issue is incredibly close to the Foreign Secretary’s heart in terms of preventing sexual violence in conflict.

In conclusion, the Government have made long-term commitments to Afghanistan’s future through financial aid and political support. In return, we expect to see clear progress from the Afghan Government on a range of issues, including on human rights. UK support to the women of Afghanistan will remain long after our combat forces withdraw. Afghanistan has come a long way since 2001 but we are not going to be complacent. We know that it still has a long way to go.

I can assure this House that the British Government will continue to support Afghanistan as it continues on this journey. On a very personal basis, it was part of my maiden speech and I am sure that it will be part of many more speeches and debates in this House. We owe it to the women of Afghanistan to keep this matter on the agenda by ensuring that this House continues to discuss these issues.
