Commons ChamberAlthough good work is being done to encourage initial reforms, decisions such as today’s in the European Court of Human Rights suggest that its focus is wrong. Through the work of our commission and discussions across the coalition, we will put considerable effort into ensuring that the human rights framework in this country is something that we can all have confidence in, as the Minister for Policing and Criminal Justice, my right hon. Friend the Member for Ashford (Damian Green) said earlier.
T10. What assessment has the Department made since the riots last year of the initial lengths of the sentences that were imposed, the extent to which those sentences were reduced on appeal, and the extent to which proper pre-sentence reports were available at the initial hearings?
I have not yet had a chance to look at the detail of the sentencing packages after the riots, but it is clear that members of the judiciary responded in a robust way to a set of circumstances that was wholly and utterly unacceptable, and I praise them for it.

Commons ChamberYes; courts offer several types of enforcement method which, collectively, are intended to make it as difficult as possible for debtors to avoid their responsibilities. We are currently reviewing how those enforcement methods might be improved and modernised, in particular through updating information orders and requests, which can be an important step in calculating the assets of the debtor.
10. What steps he is taking to protect the right to anonymity of victims in rape cases.
It is an offence to breach the anonymity of a complainant in a case of rape or any sexual offence. Allegations that a complainant has been named will be investigated.
I thank the hon. Gentleman for that response, and I hope that he shares my concern at the online outing of the victim in the Ched Evans rape case who had her name emblazoned all over the social media. I am pleased that a number of arrests have been made, but does the hon. Gentleman share my concern that rape victims will be even less likely to come forward if they think that they might be outed in this way?
The hon. Lady raises an important point. I want to make it absolutely clear that the anonymity of rape victims is there for life. When it is breached, the full force of the law must be brought to bear. My understanding of the case that she mentions is that, as at 10 May, 13 people had been arrested. It is right that the law should be enforced, but it is also noteworthy that we clearly need to monitor the internet and ensure that we supervise it a lot better than we perhaps have in times past.

Commons ChamberWe certainly were impressed by the speed with which the criminal justice system responded to the disorder, and we are grateful for the efforts of those working in it. Cases were dealt with in a matter of hours and days, rather than the routine, which can be weeks and months. We seek to learn the lessons from that and we will shortly come forward with proposals for how we can ensure that we have a justice system that is swifter and more sure.
14. What recent assessment he has made of the potential effect of the Legal Aid, Sentencing and Punishment of Offenders Bill on victims of domestic violence.
The Legal Aid, Sentencing and Punishment of Offenders Bill is designed to protect victims of domestic violence. It protects funding for advice and representation in private family matters for victims of domestic violence, as well as public funding in respect of protection orders for victims of domestic violence. We will also continue to waive financial eligibility limits in these cases.
I thank the Minister for that response, but he will be aware that when the matter was debated in another place, serious concerns were raised that genuine victims of domestic violence would not receive the legal aid support and ability to take action that they need, because of the legislation that the Government are bringing through. Organisations such as Refuge have expressed similar concerns. Will the Minister assure us that all victims of domestic violence will receive the help and support they need?
Again, the Government were disappointed by the position taken by the Lords and will return to the matter when the Bill comes back to the Commons. We are very concerned about the victims of domestic violence. Indeed, it was because we are removing legal aid for private family law that we realised there will be certain categories, such as domestic violence, that will not be suitable for mediation, which is why we are concentrating on that area.

Commons ChamberWhen people provide services, of course it is necessary before giving them the contract to do one’s best to check on their financial health, but this issue has moved beyond arguments about whether a provider should be from the voluntary sector or a for-profit or not-for-profit provider. I wish to maximise the service given to the public by those who provide community-based sentences in this country, and we need to encourage innovation and best practice wherever we can.
14. What arrangements his Department has put in place to deal with any future shortfall in prison places.
On Friday 27 January, the prison population was 87,668 against a capacity of 89,399 places, providing headroom of 1,731 places, so there are sufficient places for those being remanded and sentenced to custody. We will keep the prison population under careful review to ensure that there is always sufficient capacity to accommodate all those committed to custody by the courts.
I thank the Secretary of State for that response. I understand that possible shortfalls are predicted in particular regions as opposed to on a national level. The Minister will know that maintaining family links during a period of imprisonment is a critical factor in reducing reoffending on release. Will he assure the House that steps will be taken to ensure that prisoners are kept as close to their family and their place of origin as possible?
In many cases, a high priority is given to trying to house prisoners in places where they are reasonably in contact with their family and home. Of course, the more pressure the service comes under, the more difficult it is to maintain that, but I am sure it remains an objective of those who allocate prisoners to the correct prison once they receive their sentence.

Commons ChamberFirst, I have already praised the staff of all the services involved for the service that they delivered, and I think that we have all noticed that it was possible to handle certainly the straightforward cases much more quickly than we have become too used to regarding as the norm elsewhere. Obviously, we realise that we cannot expect such extraordinary efforts to be made all the time and in all normal circumstances, but efficiency can be improved. My right hon. Friend the Minister for Policing and Criminal Justice is taking a particular interest in improving the efficiency of the system and learning the best lessons that we can from our welcome experience of the riots.
It seems that in the immediate aftermath of the riots, in many cases, courts completely dispensed with asking for pre-sentence reports. One of the consequences was that parents of young children received custodial sentences, and no regard at all was paid to what would happen to those children. Does the Secretary of State agree that when parents are sentenced to custody, there ought to be automatic checks on what happens to the children?
My colleagues and I have just been checking with each other, and we all think—well, we all know—that pre-sentence reports were provided. One cannot proceed to swift justice without getting the necessary information about the circumstances of the client and their family. I am sure that pre-sentence reports were, in fact, required by courts, and they can certainly be obtained at adequate length in the time available if one is moving briskly. Of course, all the sentences are open to appeal, and the situation and the consequences can all be looked at in the normal way that always follows a sentence involving someone with family responsibilities.

I share my hon. Friend’s concern about that issue. Methadone has been used increasingly to tackle heroin dependency, and the number of clinical interventions has gone from 21% in 2007-08 to 39% in 2009-10. Although we do not dispute that methadone has a role to play, we agree that drug treatment in prison ought to have a greater focus on recovery and should provide a clearer route to abstinence either in prison or when offenders return to community, and preferably on a pathway that includes both.
I very much welcome the announcement this week about funding for the national liaison and diversion service, which will try to divert people with mental health issues from the prison system. Does the Minister think that, in time, that model could be used to divert people with drug addiction from prison, too?

I am grateful to the hon. Lady for her endorsement of our policy on addressing mentally ill offenders and delivering on that very substantial element of the Bradley report. There will not be quite the same method of having a liaison diversion service at courts and in police custody suites, but we will be looking at the drug recovery pilots as the model for the future, with local assessment and referral centres that identify the appropriate place for people to get drug treatment in the community.

Commons ChamberI entirely agree with my hon. Friend. She has long experience, and much more recent experience than I have, of dealing with such problems in the courts. What we must do through, among other things, the payment-by-results approach and bringing in more private, independent and not-for-profit providers, working in co-operation and partnership with statutory providers, is find better ways of achieving better results in drug rehabilitation, the ending of alcohol abuse and the treatment of mental illness.
Following on from the previous question, will the Secretary of State confirm that he will lobby for drugs funding, not just in his Department and the Home Office, but in the Department of Health? Unless drug treatment programmes are funded, we will not be able to treat drug addicts and prevent them from moving into the criminal justice system.
I will. My right hon. Friend the Home Secretary takes the lead in the Government in tackling drug problems and the Minister of State, Cabinet Office, my right hon. Friend the Member for West Dorset (Mr Letwin), is heavily involved too. We will use payment by results widely across the piece, not just with regard to offenders, to find out what works. We will put more emphasis on genuine rehabilitation, not just keeping people dependent on methadone for as long as happens in far too many cases in prison and in the community.

Commons ChamberI think the right hon. and learned Gentleman is confusing quantity with quality when it comes to legal advice on asylum and immigration. Just because there are lots of people coming forward to provide it, it does not mean to say that they are providing good services. Every day in my constituency work I see people who are not getting good advice. Does he agree that it is a false economy for people to go to firms that will not provide them with the service they need? It just means that they then go through the appeals process and make further representations, and that clogs up the system. We should focus on getting reputable organisations, such as the one in question, up and running and providing the services that people need.
The contract operation is based on both quality and quantity. My hon. Friend the Under-Secretary and I will certainly ensure that the Legal Services Commission follows through on the fact that there are meant to be quality standards; it is not just a matter of making bids for the work. However, we cannot intervene and take money out of the legal aid fund to rescue one voluntary body. That body is briefing everybody through very extensive public relations activity: archbishops are writing to me, and everybody seems to be informed that the body has gone broke, but someone is still producing a great deal of campaigning material on its behalf. It does very valuable work, but it is no good diverting money from the fund to it because it is the only one that has gone bust.

Commons ChamberAgain, my hon. Friend makes a very good point. Where do we draw the line in establishing someone’s identity—whether on arrest or charge—and then allowing other victims the time to present their experiences? We are meddling in something that should not be meddled in. Plenty of other parts of the justice system need to be attended to, and this is not one of them.
I share my right hon. Friend’s relief that the Government seem to be showing signs of back-pedalling or U-turning, or at least having a serious rethink on the issue, but does she share my concern that the proposal was not in either of the other two parties’ manifestos, yet it suddenly appeared in the coalition agreement? Does she share my hope that the Minister will explain why the proposal ended up in the coalition agreement and who was responsible for pushing the idea forward?
Yes, it was in neither the Conservative nor the Liberal Democrat manifesto at the general election, although I would have thought that that was the platform from which to make such a proposal. I really think that it was nine short words that conveyed this policy in that coalition agreement, and those nine short words developed a policy that has not been thought through, but is very dangerous.
