I agree with the noble Baroness that this project will help to improve the environmental record of our travel, by ensuring that people travel using high-speed rail rather than roads. That will be a benefit. I have seen the plans for the green spaces and green bridges. HS2 is committed to environmentally friendly practices including woodland areas, and is considering those plans carefully.

Does the Minister share my concern or perhaps she even recognises the inevitable: many sections of the House are following a long tradition of this House in opposing the building of railways anywhere and at any time. beginning with the London to Birmingham railway in 1830? Can she assure us that this investment, which is essential to the people of the Midlands, will go ahead, especially in view of the fact that there never seems to be anything like the same level of objection to hugely expensive schemes such as Crossrail in London—which I also support? They appear to go ahead much more easily than anything which might benefit the Midlands.

My Lords, the last time we built new rail links to the centres of our great northern cities Queen Victoria was on the throne, and I entirely agree that it is high time we built more. When HS2 is up and running, by 2033, up to 18 trains will run each hour, carrying up to 1,100 passengers each and serving 100 million passengers each year. This investment will continue.

As the noble Lord is aware—we have already had an exchange on this—first, we hold the company to account. My honourable friend the Rail Minister meets the company once a week. Secondly, we have levied penalties in accordance with the current contract. Thirdly, as he is fully aware, the operator has invoked force majeure clauses. We need to look at each case before we decide on further action, and that work is nearly complete. However, to put it into context, as some noble Lords may know, there were 10,000 different cases and claims of force majeure between April and June, and that underlines the challenge that we face.

Does the Minister agree that anyone who suggests that we close railway lines should be referred back to the vandalism of the Beeching era, when thousands of miles of track were closed, viaducts were smashed up and tunnels were filled in? Now many communities up and down the country are trying to reopen lines that were closed. Perhaps that is a lesson that everyone should take on board.

The noble Lord is right. Indeed there are lines that were disused in the past that we are currently looking at to see how they can be brought back into service. I do not think any noble Lord, including my noble friend, has at any time suggested closing or tarmacking over railway lines. Instead we are trying to see how we can use innovation and technology in adapting for our railways of the future.

My Lords, I am not quite sure whether I can help the noble Baroness. I asked the same question about a mined tunnel in Committee and the noble Viscount, Lord Astor, explained it all to me. The problem is that I have forgotten the explanation. It sounded very plausible at the time. I am sure if the noble Baroness consults her noble friend she will get all the details of what should be done.

I listened to the noble Baroness who spoke earlier from the Conservative Benches. She made a fleeting appearance in Committee and said pretty much the same thing; I hope she will forgive me for saying so. I do not think emotive language about a two-track railway destroying the countryside takes this House or this debate any further forward. What did she say: “Just another 8.7 kilometres of tunnel”? That is in addition to the 47 kilometres of tunnel out of the 210 kilometres of the high-speed railway line. This is expensive lunacy in my view. I make a plea again on behalf of those who travel by train. People do not travel by train to gaze at a tunnel wall. Some of the semi-hysterical comments—I exempt my noble friend Lord Stevenson, he will be relieved to know—about the damage that the railway line will do to the Chilterns are just that, sheer hysteria. They were all made 30 years ago at the time of High Speed 1 across Kent, and none of it proved true then. Indeed, the economy of Kent has benefited enormously from High Speed 1.

The secondary point—the great unmentionable in this debate on the demand for tunnels—is of course that some people making these points about additional tunnelling do so on the grounds that there is no benefit from high-speed rail passing through the Chilterns to those who live there because there are not any stations. Well, there may be at some time in the future, as we have heard. Again, I exempt my noble friend from that; he is my Whip and I had better tread carefully. Once you get out of London, the M40 passes through the Chilterns without a mile of tunnel. Has that motorway destroyed that part of the world? I do not think it has. My noble friend nods his head but I do not think most people agree. Mind you, of course many of them use the M40 and that they are not going to be able to use the train is behind a great deal of the opposition, in my view. I hope that the Minister resists temptation. Whether it is cheaper to build a mined tunnel or go ahead with the existing proposals, as the Select Committee recommended, I know not. Nobody could have worked harder than the committee to look at those objections. I think there is quite sufficient tunnelling already so far as this high-speed railway is concerned, much of it expensive and unnecessary.

Will my noble friend answer a question that I feel I should know the answer to? How much has all the additional tunnelling that has come on as a result of the various stages of this Bill added to the cost of HS2? I have a slight suspicion that there may be the odd person—I am sure no one in this House—who has demanded a tunnel, for whatever reason, and then complains about the overall cost of the railway once the tunnelling has been accommodated.

I am sure that the Minister, who is listening, will be able to give my noble friend a detailed answer to that question. We see with this project, as we have seen with others, that many of those against the project as a whole for reasons including its cost are the first to demand special provision in their part of the world, regardless of the additional cost. I hope the Minister will resist temptation, as 47 kilometres out of 210 is—I repeat—quite enough for me. Whether or not I will be around in 2026, who knows, but I will do my best and I wish the same to other noble Lords on both sides of the House. I think we deserve better than an extended view of a tunnel wall. Let us see this glorious countryside, that we hear so much defence of in the context of this Bill—mistakenly in my view.

My Lords, I thank all noble Lords for their participation and contributions to the debate. I am minded to start with the comments of the noble Lord, Lord Snape. Certainly when he suggested that I should not be tempted by these amendments, I was reminded that we start proceedings in the House every day with the Lord’s Prayer, which says:

“Lead us not into temptation”.


I will fulfil that prayer’s requirements in my response this afternoon.

We have already touched, even this afternoon, on the cost of HS2. I say again to all noble Lords that the costs of HS2 have been the subject of intense analysis and review over several years, as we have already heard. As I indicated earlier this afternoon, we will continue to review costs for years to come. Let me once again praise the incredible work done collectively by the two Select Committees of both Houses. Let us put this into perspective: it is a combined period of two years of hearing evidence, considering all aspects of the proposed Bill, and on many occasions reviewing the costs for elements of the phase 1 scheme when asked to consider potential alternative options. It is sometimes suggested, and has been suggested again, that somehow there has not been an exhaustive examination; I challenge that. The best way to do so is to read the detailed analysis, recommendations and reports of both Select Committees. I recommend that to all noble Lords who have not yet had the pleasure.

I thank the noble Lord, Lord Young of Norwood Green. As he noted in Committee, and as he has reminded us, the Select Committee considered all options that were presented for additional lengths of tunnelling in the Chilterns and in Wendover. It was not convinced of the need to recommend any further work on any of these options. As I have already said, these were exhaustive discussions, and I believe that that decision should be respected.

The Select Committees of both Houses also considered in detail the provision of additional environmental mitigation measures. It pains me to say it, but I disagree with my noble friend Lady Pidding that the Government have not published details of how certain things have been considered during the process of the Bill. It is worth noting, as I hope my noble friend will acknowledge, that many assurances have been given to the areas covered by the Chilterns area of outstanding natural beauty, including the provision of a £3 million fund for additional environmental mitigation measures.

My noble friend raised the issue of publishing tunnelling costs. The information used to assess the decision on whether it is appropriate to undertake a bore tunnel past Wendover and an extended bore tunnel through the Chilterns was published as part of the exhibits placed before both Select Committees that were used to establish the Government’s position regarding the decision not to provide any additional tunnelling. It was that information that the Select Committee—I refer to the Commons Select Committee here—used to recommend an extended tunnel in the Chilterns and an extension to the tunnel in Wendover. The exhibits included figures for several Chiltern tunnel options, which I mentioned in Committee. They range from £82 million to £485 million. The additional extension of 2.6 kilometres to the Chilterns tunnel, which I hope my noble friend acknowledges, was agreed following a specific recommendation from the Select Committee in the other place. That was at a cost of £47 million.

Turning to the costs more generally, an updated cost estimate for the project is published, as I said earlier this afternoon, at every iteration of the business case. I repeat that the next iteration is due for publication in the summer of 2017. The project as a whole, including its cost estimate and business case, is subject to regular independent review from the Infrastructure and Projects Authority—

I could not keep all those figures in my head. Will the Minister be able to tell us at some stage, not necessarily now, the total additional cost of tunnelling on top of the other costs of the railway?

I referred to the specific addition, but I note what the noble Lord has said. I will write to him in that respect and ensure that a copy of the letter is laid in the Library of the House for the benefit of all noble Lords. I reassure noble Lords that this is an area that the Government have considered very carefully. Indeed, it has been scrutinised specifically by the Select Committees of both Houses.

I want to pick up on a couple of points that have been raised. The noble Lord, Lord Stevenson, asked specific questions. I will write to him in detail on some of the issues that he raised, but my understanding is that the response on Section 85 was set out in the Government’s response to the 2011 consultation, which was subsequently published in January 2012. The other issue, of environmental mitigation, is also included in the business case, as was assessed according to the department’s guidance. As I said, the noble Lord raised some specific points and I will write to him in that respect.

The noble Lord, Lord Berkeley, raised the issue of the ideas that contractors may put forward. As I am sure the noble Lord is aware, contractors come under the powers in the Bill, including the limits on deviation. Contractors are also limited by the environmental statement. Within those limits, contractors will be encouraged to be innovative. Indeed, a key commitment to Parliament in the environmental minimum requirements is that we will seek to reduce the environmental effects beyond those in the environmental statement itself. That will be done by innovation, much akin to what the noble Lord suggests.

I reiterate the point that the Public Accounts Committee in the other place and the National Audit Office will continue to examine the costs of HS2 as we move into the detailed design and construction stage and more detailed cost information becomes available. I hope my detailed response demonstrates what has been done, the analysis that has been undertaken and the revisions that have been made in response to issues that have been raised, particularly in the area of the Chilterns. I hope it demonstrates to noble Lords that the tabled amendments before us this afternoon are unnecessary. I underline that these issues have been fully examined, not by one Select Committee but by two. I have already underlined the amount of time they took and detail they went into in their careful consideration. As a Government, we feel that any further cost review at this stage would serve only to delay the railway, which I am sure is not the intention of the majority of Members in your Lordships’ House. I hope that, with the detailed explanation I have given, the noble Lord is minded to withdraw his amendment.

I suppose that is a question that I as a Liverpool fan should also raise; perhaps my accent does not quite give away the team that I support. The noble Lord talks about the importance of connectivity across regions. The Government are working—I referred earlier to northern powerhouse rail as well—on how to ensure that, with the new body that has been set up, we can look to improve connectivity not just between the cities that I have just mentioned but across various parts of the north-east and the north-west to link up the northern part of the country more effectively. I also assure the noble Lord that, as I mentioned previously, HS2 is being made safe and will accommodate any other changes or accommodations that we will need to make on additional line investment across different parts of the north-east and the north-west.

I warmly welcome the Minister’s Statement. Will he at least reflect that it is a question not just of how swiftly other countries manage to do these things in comparison with ourselves but of how we do them these days compared with how we managed to do them in the 1840s? Then we built thousands of miles of railway with picks and shovels but we have been told for some time that this link, which is ultimately maybe 300 miles of railway, cannot be completed until 2033. What did the Victorians have that we do not have today, and is there any possibility of this being speeded up?

What we probably have now is ensuring that there is proper consultation. I suggest to the noble Lord that planning laws have moved on since the Victorian age. The issue of airports was raised previously. I remember travelling to other parts of the world where they were building six runways, and it was suggested to me that we had had a challenge over the last 40 years in building a single runway. I am acutely aware, as are the Government, of the importance of pressing ahead with these infrastructure projects while ensuring that we effectively consult and adhere to the planning requirements presented by such large infrastructure projects.

I am not sure that I fully understood the noble Lord’s last point. There will be the fast, specially designed HS2 trains, but the line can also take the classic-compatibles—diesel or otherwise—that can go off to a whole variety of other connections on the west coast main line and other routes. This frees up the west coast main line, the east coast main line and the Midland main line to take a whole complexity of other services. That issue has been raised by others on the Floor today. The expectation of an enhanced service from a much greater number of cities than those absolutely directly connected to HS2 is entirely viable. We just have to make sure that it is deeply embedded in our planning.

My Lords, I warmly welcome the Statement, representing as it does an increased and restated commitment to this project from the Government, added to by my noble friend Lord Davies, who spoke for the Opposition. It is extremely important that it is restated in that way, and it is encouraging to see what questions have been asked as well. However, I share some of the concerns raised by my noble friend Lord Snape. I certainly do not wish to delay anything—the quicker the better, in terms of preparing the scheme and getting it going. However, with regard to the statement:

“I will also commission a study into options for ways to improve connections to the continent which could be built once the initial stages of HS2 are complete”,

I would like it to be spelt out in a little more detail what this commission is going to do and within what timescale, and I would like just a clue as to what the other conceivable options would be if there were not to be a direct link between HS1 and HS2, because that must be a concern for those of us in the Midlands and the north.

The decision to not develop the proposed HS1-HS2 link is very recent. A lot of work and thought needs to go into framing the study. As soon as we are able to do that, I will be glad to share it with the House.

The noble Lord, Lord Faulkner, gets to the heart of the problem. Under a system in which this was a Government-run industry, an essential feature was the constant stop-start and underinvestment. It is by putting in place a structure with the ability to set up arrangements that force the Government into long-term decision-making and long-term commitment that we have been able to rebuild the infrastructure.

Did not the privatisation of the railways simply follow the pattern of previous privatisations, which was that priceless national assets acquired by the great Labour Government of 1945 were sold off at knockdown prices by a Tory Government to a small number of investors, who made huge sums of money overnight? Does the Minister share my near despair that precisely the same pattern has been followed with the sale of Royal Mail, which was grossly undersold against the wishes of its previous owners—that is, me and everyone else in the country? Incidentally, as my assets have been sold off against my will, at the very least I ought to receive a cheque for the value of the assets sold.

My Lords, I will resist the temptation to go into the territory of Royal Mail. The privatisation of the railways may not have been perfect; we certainly had Railtrack going into administration in 2002, and there have been other issues. The question is: do we have a system that has delivered a significantly better railway for customers and freight in this country? I would argue that we very evidently have. Does this give a basis for moving forward and providing yet further improvement? I think that argument is also made.

My Lords, I welcome not only the fact that the noble Lord, Lord Greaves, has introduced this debate, but also his splendid, comprehensive opening speech, which covered so many of the arguments. Inevitably, a debate such as this will be pretty polarised; you cannot be half way in favour of this, stopping it half way along the tracks somewhere—you are either for or against it, and I am unequivocally, unashamedly, massively for it. I hope that there is no uncertainty about that.

I thought it would be helpful to look at some of the objections—and of course we acknowledge that people who are directly affected by the route will be very concerned indeed. Whether you are for or against this proposition, you will acknowledge and recognise, as with other major developments, that there must be proper compensation and recognition for those who are directly affected.

It is worth taking a little trip down memory lane, because when the original proposal for a London to Birmingham railway was put forward in 1832, the House of Lords threw it out. We know, due to a splendid article by Nick Serpell, that many of the grounds for that were stunningly similar to the objections that are being presented today. The effect on wildlife was mentioned, as well as the demolition of rural communities and the big estates.

I would richly enjoy reading out all these quotes, but here is just one, from one of the contributors to the early part of the debate:

“You are proposing to cut up our estates in all directions … If this sort of thing be permitted to go on, you will in a very few years destroy the nobility”.

That is the kind of objection that was going around at the time. Most of the objections were very similar. Why do we want to go so fast? By the way, the first trains took five and a half hours. I am sure that whether you are in favour of HS2 or not, you will prefer the present service to one that would have taken five and a half hours. Thank heaven—I hope we can all agree on this—that the objections that were originally presented were overcome and that at least we had a railway from London to Birmingham. We did not require the people of the 19th century to get from here to Birmingham by canal or stagecoach; there was a mechanism other than that, which was terrific. So many of the objections proved to be false. The wildlife comes back amazingly soon after the cuttings and the embankments have been built. Of course, the investment has been repaid—I was going to say 100 times over— 1,000 times over. I could not begin to calculate the economic benefit of the original London to Birmingham railway.

I mentioned that it was a Victorian railway. Essentially, we rely, in the 21st century, on a Victorian railway. It is a marvellous railway; wonderful engineers built it, and phenomenal engineers kept it patched up over all the years and made improvements, keeping the trains running, by and large, while they did all that. However, a Victorian railway serves us today. There is one big exception—that it is not even as good as the Victorian railways because large chunks of the system have been closed down. Routes, railways and stations all over the place were closed. One railway in particular that was closed down was a fine north-south route between London, Leicester and Nottingham—the Great Central Railway—that was closed down in 1969. Therefore in proposing a new railway we are not revolutionary in adding to what has historically been available; we are trying to repair some of the damage that was done by the vandalism of the Beeching era, when so much damage was done. Therefore I say, “Thanks very much” to the Victorians, but that will not do for the 21st century.

I now come to the very common argument from the people who are opposed to this new line. I am sorry that there is no easy way. They say, “Let’s improve the existing railway. Let’s make some modifications to it so that trains can run through at greater capacity levels, with bigger trains”. We have been doing this for more than 80 years. We have kept on patching up, making do and mending, and amazingly, we have kept the trains running while we have done that. However, that is saturated. That argument has gone—there is no easy solution to that proposal. Interestingly, people do not ever say that about the motorways. I do not remember people saying, “We should not have built the M1 or the M5. We should have built loads of bypasses, strengthened the bridges and got more traffic running through on the old roads”. There comes a point when that proposal becomes ridiculous, and as far as the railway that we need for the 21st century is concerned, it is a ridiculous proposal.

If people are serious about massive improvements on the north-south routes in this country to be done on the existing system, please do not travel by train while it is being done. You have seen nothing yet of weekend closures, bus substitute services and holiday closures. You cannot rebuild a railway to 21st-century standards while you are trying to run the trains on the existing routes. There would be huge dislocation if that approach was adopted.

This is a visionary proposal. I salute my Government —the previous Labour Government—for introducing the proposal in the first place. I congratulate the coalition Government on sticking to their guns and acknowledging that this essential part of our country’s infrastructure has to come about. I salute the people involved: the former Secretary of State, the noble Lord, Lord Adonis, and the present Secretary of State, Patrick McLoughlin. It is not an easy thing to do, because the opposition is so widespread in so many ways, and so personal. However, I appeal: let us think for a moment of the astonishing vision and engineering skills of the Victorians who built our rail network, which, as I have said, miraculously serves us today. Our railway-engineering expertise was exported all over the world. They had that vision which we massively benefit from today; it is part of our responsibility to have a similar vision to ensure that future generations have a modern, 21st-century rail network.

My Lords, the future for the east coast main line includes the intercity express programme to replace the existing high-speed trains, which are very old. There is an option to extend the IEP to include replacing the 225 trains. The Government will have to decide later this year whether to take that option.

My Lords, is it a fair summary of the Government’s position that if an organisation in the private sector is making a mess of things and losing money, the taxpayer should pick it up and sort it out and that as soon as it is profitable again it should be returned to the private sector?

The noble Lord knows perfectly well that that is not a fair analysis of what went wrong with the east coast railway line. I am sure he would not suggest bringing an airline into direct operation by the Government.

My Lords, the Government are not being wet on the issue. If the noble Lord would like to start negotiations with Mr Willie Walsh, he is welcome to do so. However, I accept that the noble Lord’s analysis about the effect on tourism and leisure activities. That is a very good point. I am acutely aware of it when I attend the Great Dorset Steam Fair in September, because by 8 o’clock it is getting dark.

The Minister talked about going back. Is it not worth while looking at the history book rather than the crystal ball on this issue? It has been tried once and Parliament, the Government and presumably public opinion—my memory is not that precise—decided that it was an experiment that had not been successful and that we should revert to the previous situation. In the spirit of openness, will the Minister place in the Library a copy of the arguments that were used in order to end the experiment that was deemed at the time to have been unsuccessful?

My Lords, I suspect that the debates in Hansard will be very illuminating as to why at that point it was decided not to persist with the experiment. As the aviation industry has developed considerably since the trial, it would have much greater effect on that industry. It would probably not have such an adverse effect on the construction industry and in agriculture, however, because much more artificial lighting is now used by them.
