I hope it is no disrespect to my hon. Friend to confirm that he is not the most intimidating tribunal I have addressed this week. He is entirely right that we should look at examples abroad, as well as at domestic practice, to make sure that we are doing all we can to deal with corporate criminal offending. He is right, too, that we must address the issue of whether it is easier to prosecute those in charge of small companies than those in charge of large companies because of the complexity of the latter’s management structures, because that cannot be right.

During the passage of the Criminal Finances Bill, the Government have so far refused to extend corporate economic crime beyond tax evasion. Does the Attorney General agree that companies should only be criminally liable for failure to prevent tax evasion?

The hon. Lady’s question reflects precisely why we are asking for evidence on this subject. We will then conduct a consultation to see whether there is a case to extend the type of “failure to prevent” offences that she describes beyond bribery, where it currently exists, and tax evasion, where it will shortly exist, assuming that Parliament passes the Criminal Finances Bill. There is an argument to say that we should look at this, because, as I say, there are other types of offending where it would be sensible to consider whether a “failure to prevent” offence would be appropriate.

As the hon. Gentleman will know, the welfare system provides a safety net for those experiencing hardship. We have made it very clear that we have already provided £1.1 billion in transitional concessions. The Government have published a great many figures on this subject. It is very difficult for the Government to publish further statistics on proposals that have come forward from both the WASPI campaign and Opposition parties when it is very unclear what provisions would be included around those transitional arrangements for women as well as men.

With the effects of austerity being felt disproportionately by women, another Government policy affecting women is the 4% tax on child maintenance. Does the Minister accept that this places an additional tax on survivors of domestic violence, and will she ensure that that is addressed?

I thank the hon. Lady for that question, although I am not sure how it relates to the WASPI campaign. As she will know, I answered questions on this very subject at the Select Committee yesterday. Interestingly, no mention was made of the charges to parents in the collect and pay system. We are determined to encourage as many families as possible to have family-based arrangements. Indeed, even in cases where there has been domestic violence, the child maintenance service can step in to make sure that bank details can be passed safely, including using bank accounts that do not have a geographic location—they have a centralised sort code—so that we protect women and have as few families as possible within the collect and pay arrangements.

I thank the Backbench Business Committee for accepting this debate, which gives us an opportunity to discuss the Government’s response to the “Transgender Equality” report. I should also like to thank LGBT Youth Scotland, Stonewall, the UK LGBT Consortium on Trans Organisations, the Equality Network and the Scottish Transgender Alliance. I also want specifically to thank Tim Hopkins from the Equality Network and James Morton from the Scottish Transgender Alliance for their invaluable briefings and their work with the Scottish Government to continue the progress of LGBTI equality.

As an advocate for LGBTI equality, I am very proud that the first report from the Women and Equalities Committee focuses on the problems faced by the trans community. In the spirit of true equality, every sector of society should feel truly equal and it is our responsibility as members of the Committee and in life to ensure that that is the case. I believe that the Government’s response to our report is woefully inadequate. We need to ensure that the individuals who contributed to the inquiry and those who experience daily discrimination feel that the Government are heeding their calls for more equality. Trans equality must be the priority of every Government across the UK. I know that the Minister shares my passion for equality and I hope that today’s debate will give her an opportunity to respond, to hear the cross-party calls and to take action. I should also like to thank my friends and fellow Committee members, the right hon. Member for Basingstoke (Mrs Miller) and the hon. Member for Brentford and Isleworth (Ruth Cadbury), for securing this important debate and for their continued commitment to the cause of transgender equality.

We have only to look at the statistics from any mental health charity to understand why this debate is necessary. When one in four of the children in Scotland who identify as trans face bullying, discrimination and hate crime on a daily basis, we must do more. Statistics from Mind indicate that more than 40% of trans individuals have contemplated suicide and that, tragically, some of them have ended their own lives as a result of their experiences. This group of people is among the most marginalised in society. Trans individuals face disproportionately high levels of mental health problems and very high suicide rates. Discrimination against members of the trans community is an everyday aspect of their lives. Transphobia is endemic in the workplace, when accessing healthcare, in public services, in schools, in the media, in the criminal justice system and online. A sizeable percentage of individuals face this discrimination and prejudice on a daily basis.

The existing legislation provides some protections, and they are to be respected and admired. There was a time when the UK was a world leader in its approach to transgender equality. The Gender Recognition Act 2004 allows a trans person the right to a gender recognition certificate, should they wish their affirmed gender to be recorded as such on their birth certificate. This was applicable whether or not someone had undergone surgery or hormone therapy. However, this does not allow for people in the trans community who do not identify as either male or female to be recognised and protected within the law. During our inquiry, we heard from non-gendered and non-binary people who felt that they had been forgotten in the legislation. Additionally, we heard that the Act was rooted in clinical methods, requiring consent through a psychological diagnosis of gender dysphoria. The criticisms levelled at the legislation reinforce how outdated it has become. The Government must make changes to the Act to allow an approach of gender self-declaration.

Similarly, the once world-leading legislation for the trans community in the Equality Act 2010 is fast becoming outdated. It gave members of the trans community protection from discrimination, but we have heard that its provisions are routinely breached in relation to the trans community. The Act uses outdated terminology such as “gender reassignment” and “transsexual”; these are now considered inaccurate descriptors. Such terms have given rise to the misapprehension that the Act provides only for trans people who have undergone medical gender-reassignment treatment. To clarify, the protected characteristic should be amended to “gender identity”.

Does my hon. Friend agree that the essence of today’s debate is that gender is a social construct, and that that should be recognised in law? It is not primarily a biological construct, but because the law is based on that outdated concept, it is failing us.

I thank my hon. Friend for that intervention. I reiterate that the law must be updated to recognise an individual’s gender identity, which has nothing to do with their birth gender and everything to do with the gender that they believe they are.

I congratulate my hon. Friend and other hon. Members on securing this important debate. Since 2007, the Scottish Government have been using the Yogyakarta principle, a fully inclusive definition of gender identity, in all their trans equality policy work. Does she agree that the use of that principle is desirable because it was devised by an international commission of jurists in recognition of the fact that gender identity is a human right?

Yes, and I will clarify again that the protected characteristic in the Equality Act 2010 should be amended to “gender identity”, which explicitly covers the whole spectrum of trans identities. This point was rejected in the Government’s response to the Committee’s report. Ministers believe that the current terminology is adequate, contrary to the testimony of the very people it affects.

I am prone to mentioning the word “Scotland” often in debates, and I shall do so again now. In 2017, we will mark the year of trans equality and the progress that has been made on this issue. In Scotland, we have committed to reforming the Gender Recognition Act 2004 in line with international best practice in countries such as Malta and Ireland. In Scotland, we have committed to ensuring that all trans, non-binary and intersex individuals feel protected, because it is their human right to have their gender identity recognised in law and in life. I urge this Government to follow the example not only of Scotland but of the many other countries that are leading this best practice.

The United Nations International Civil Aviation Organisation recognises M, F and X as gender markers on passports. A number of countries, including Denmark, Malta, New Zealand, India and even Australia—which is sadly not known these days for a liberal and open approach to border control—issue and accept gender X passports. Does my hon. Friend agree that it is high time the UK followed suit?

I wholeheartedly agree. One area that is not currently devolved to Scotland is the ability to change passports. I urge the UK Government to consider this important aspect of recognising a third gender—gender X—on passports. That could be done, and the Committee heard that it would be beneficial and would make a sizeable difference to individuals who travel for work, life and general leisure purposes. This is an opportunity to amend and correct that error.

I call on the UK Government to match the Scottish Government’s commitment: 2017 marks the year of progress on transgender equality in Scotland, and the UK can continue that progress. This debate highlights the need to address transgender equality and the remaining challenges that trans and non-binary people face. Although Scotland has made huge progress towards achieving LGBTI equality in recent years and is now rated the best country in Europe for LGBTI rights, the SNP is not complacent. We are determined to tackle the unacceptable levels of prejudice and discrimination that trans and non-binary people continue to face. I hope that, as we move into 2017, we can make it a year of progress for transgender equality not just in Scotland but across the UK. In Scotland, the SNP has pledged an important step forward for transgender equality by reforming the gender recognition law to meet international best practice, so that all trans and non-binary people are fully recognised and can access their human right to a legal recognition of their gender identity.

Scotland is the best country for LGBTI equality, and the UK can continue to lead on this agenda, too. One of the distinctive parts of our equal marriage law is its more progressive approach to transgender recognition, and the UK could follow that example as well. I am not simply preaching to the choir; a multitude of countries across the world are leading on this agenda.

I wish to finish with the words of Reina, one of many trans women who wrote to me before this debate. She wanted to give testimony about what it is like to be trans in a rural community in Scotland. She said:

“Being trans is not a choice. It isn’t something where the person wakes up and just decides to be a particular way. Being this way is something that a person is born with, and which they have to try and struggle with throughout their lives, in a society that hates diversity and constantly attacks them”—

and their friends and family, and

“even kills them, for not conforming to the restrictive ideals of control freaks. Life is hard and usually short for someone who’s trans. There is a lack of respectful education and health care. There is a lack of support and understanding.”

Her words exemplify just why we need to take action: life is incredibly difficult for trans people, and the changes we can make in this place will make a huge difference to their lives. The Government must today commit to the recommendations of the “Transgender Equality” report, and offer the support and understanding that this community definitely needs. I urge the Minister to join me in making sure that 2017 is the year of transgender equality not just for Scotland, but for every transgender individual across the UK.

I have listened with real interest to the arguments made by Members about how the Gender Recognition Act 2004 and the Equality Act 2010—the first legislation I ever whipped—ought to be amended to better protect transgender equality rights. I hope the Government take these arguments seriously and respond appropriately, even if it takes them a further couple of months to do so.

I want to focus on the health aspect of the excellent report by the Women and Equalities Committee: the services provided for transgender people by the NHS. Trans people experience worse health, both physical and mental, than the general population. The Equality and Human Rights Commission has found that a higher proportion of transgender people say that their physical health is “poor or very poor” compared with other LGBT communities and non-LGBT communities. Levels of poor mental health are also higher in the transgender population, with about half of young trans people and a third of trans adults reporting that they have attempted suicide. It is therefore imperative that transgender people have full access to general medical services—appropriate ones.

Transgender people also have specific health needs; untreated gender dysphoria, which, as Members will know, is medically defined as when a person experiences discomfort or distress because of a mismatch between their biological sex and gender identity, can and does take a real toll on someone’s mental health. Dr John Dean, the chair of the NHS national clinical reference group for gender identity services, has said that

“not treating people is not a neutral act—it will do harm.”

I could not agree more with Dr Dean. Some trans people’s health and wellbeing would be greatly improved by gender confirmation treatment through our specialist gender identity clinics. Trans people have to be able to access those treatments on our NHS if they need them.

The Committee heard from individuals who had gone through harrowing experiences. They had gone to quite extreme lengths to receive the treatment that they wanted in order to have their gender identity recognised in countries where the practices were not as safe as they would be here in the UK. Does the hon. Lady therefore support the aim that the UK must ensure that we can cater for everyone who needs to access these health services?

I do indeed. The Committee’s report demonstrated that our NHS is not providing even a basic service, let alone a good service for trans people. The Committee report found:

“The NHS is letting down trans people”.

One of the first problems identified by the report was discrimination faced by trans people when they tried to access general medical services. Dr James Barrett, president of the British Association of Gender Identity Specialists, told the Committee:

“The casual, sometimes unthinking trans-phobia of primary care, accident and emergency services and inpatient surgical admissions continues to be striking.”

CliniQ, a specialist sexual health and wellbeing service provider for trans people, told the Committee that

“there is at best considerable ignorance and at worst some enduring and mistaken and highly offensive stereotypes about trans people among the public at large, amongst whom we must unfortunately number some health professionals.”

Sadly, this discrimination has real consequences. Terry Reed, of the excellent Gender Identity Research and Education Society, told the Committee that trans people were often nervous about accessing services because they were “not treated sympathetically” or even “politely” by doctors and staff. Brook, an organisation that provides sexual health and wellbeing services and advice for young people under 25, told the Committee that

“prejudice against trans people among medical staff”

was one of the reasons for poor health outcomes in trans people.

In addition, trans people report real difficulties in accessing specialist treatments and gender identity services. GPs have a legitimate role in acting as gatekeepers to NHS specialists, but I am afraid there is evidence that prejudice and ignorance among our GPs is preventing those who experience gender dysphoria from receiving the services they need. Dr James Barrett has said that there is a “persistent refusal” on behalf of some GPs to make referrals to gender identity clinics. The Beaumont Society has heard of one trans person being told by their GP at their first assessment—and let us think about how much courage someone needs to go to their first assessment:

“You’ll be taking money away from more deserving cancer patients.”

How wicked is that? It is a complete disgrace.

Where someone experiencing gender dysphoria is referred to a gender identity clinic it can take a very long time for them to receive specialist services such as hormone therapy or genital surgery. The process requires an independent assessment from two separate consultants, and a large amount of information needs to be gathered by the consultants about the individual before they can begin to proceed. That process typically takes months and spans several consultations. An additional precondition for genital surgery is that the patient must undergo at least a year of “real-life experience” of living “in the role” of their affirmed gender—it is an enforced pause. I have read the guidelines that explain the rationale behind this enforced pause, and I understand that the social aspect of changing one’s gender role is challenging and that clinicians do not want people to take on surgery until they are fully aware of those challenges, but that does not explain why the pause is often much longer than 12 months. The Government should assess the arguments made by some in the trans community that decisions over whether to go ahead with surgery should be based on the informed consent model. Under that model, doctors could immediately approve medical interventions if they are satisfied that a patient is fully aware of the implications of their decision. It is my understanding that the model is already used in parts of the United States of America. Given that it has already been tried and tested, the Government should be in a position carefully to assess its strengths and weaknesses, and bring that back to us.

It is important that the Government understand that delays in receiving treatment can, and do, cause real suffering. In the 2012 trans mental health study, one trans person said:

“Not having had my gender confirming yet has a constant effect on undermining my self-esteem and self-confidence as well as social transition—I hate every day that I have to live with ‘boy parts’ and I can’t wait to get rid of all recognisable ‘boy bits’.”

Another person told the same study:

“Permission for my chest surgery was delayed and I waited double the usual waiting time...This caused me to go into a deep depression. I had panic attacks when I left the house. I lost my job and then found I couldn’t leave the house.”

Such suffering could be prevented if we improved the speed at which our NHS works for trans people. Delays should not be any longer than is strictly necessary from a clinical point of view.

As a result of the problems that I have outlined, the Select Committee recommended that the Government conduct a root-and-branch review of how NHS services can be improved to better serve trans people and completely stamp out transphobia in our NHS. I am disappointed—I am sure that I speak for many Members here today—that the Government did not accept this clear recommendation. Instead they responded by stating that they will look into broadening the terms of reference of NHS England’s existing task and finish group for gender identity services. When such systematic failure has been identified, the Government should question the governance arrangements that are in place, rather than relying on them even more. I say that gently to the Minister and hope that she has had those conversations with her opposite numbers in the Health team. I invite the Government to give fresh consideration to a root-and-branch inquiry as part of their commitment to the cause of gender and transgender equality.

I could not agree with my hon. Friend more, and she is a doughty champion for equalities. The issue of intersections in our society—how they meet, how they interact with each other and how we support them—is hugely important.

As a relative newcomer to the LGBTI community, I have to say that one reason I am particularly glad we are having this debate is that it is of the utmost importance that we better familiarise ourselves with the language surrounding this topic. I will be honest: I was not wholly familiar with all the language and terminology. As someone who came out relatively recently, I felt there was almost an assumption that people would be totally familiar with all aspects of the LGBTI community and LGBTI life. However, like many, I am on a journey of discovery and learning, and I have to say that, after the research I did today, and having listened to the contributions from both sides of the Chamber, I feel more enlightened, and I hope others do, too.

When I was growing up, there were not enough LGBTI role models for me, and others have spoken about powerful role models, particularly in the trans community. We are now seeing actors and others coming forward—people such as Jack Monroe—and speaking so openly and passionately about their lives. There are also people taking on roles in various soap operas and normalising members of the LGBTI community and representations of them.

I read one of Jack Monroe’s interviews when I was preparing for the debate, and the passion about confusion and experimentation with identity came across. Fox Fisher has also been a fantastic role model, and has made some incredibly pioneering and powerful films about transgender issues and people’s journeys. We should take a moment to congratulate and commend all those in the transgender community who fight on a daily basis, as well as all the charities and other organisations, many of which my hon. Friend the Member for Lanark and Hamilton East mentioned, because they are at the forefront every day of the battle for equality.

Language is very important, because the truth is that correct language is not being normalised in our society and particularly, as has been said, in our media. We should be working towards a day when all our names can be preceded by Mx, because people should not have to choose their identity. For example, whether I, as a woman, am a Ms, a Miss or a Mrs defines my marriage status, which seems ridiculous. Why is it that, on the most mundane forms, we are still required to identify our gender and our marital status? I find it maddeningly unnecessary.

Beyond language, there is a huge amount of work to do, as many have said, on the Gender Recognition Act 2004. It is time to simplify the procedure for the self-declaration of gender and to put an end to the requirement for medical or psychiatric evidence. It is time that we allowed 16 and 17-year-olds access to the same process granted to 18-year-olds and up. It is time to fully and properly recognise trans, including non-binary, people in the Gender Recognition Act.

The LGBT Consortium provided some excellent briefing ahead of today’s debate and crystallised some of the really worrying challenges facing the trans community. It explained:

“When someone applies for a gender recognition certificate they are assessed by a panel…they never meet”.

Imagine someone who has perhaps spent years struggling to work out who they are, facing that panel process to be assigned. They do not meet the panel and, worst of all, there is no appeal. This is not like applying for a job; this is about people’s lives and identities. We must make sure that any process anyone has to go through is properly sensitive to their situation and to the challenges and battles they have had to go through.

The Scottish Government are publicly committed to all those changes to the Gender Recognition Act, and I hope the UK Government will now follow suit, because countries such as Australia, India, Denmark and Nepal are actually ahead of us on this front. They have the option on their passports to place an “X” next to the holder’s gender. Of course, no one’s gender makes them any less or more of a citizen of a country. As my hon. Friend the Member for Lanark and Hamilton East said, the UN’s International Civil Aviation Organisation has an internationally acceptable gender marker for passports.

Yes. Some of the legislation is very new, including that of our friends in the Republic of Ireland. We will keep it under review and we are determined to learn all the lessons of best practice from around the world, as indeed we always have.

On that specific point, will the Minister meet Angela Constance, the Cabinet Secretary for Communities, Social Security and Equalities in the Scottish Government, to have that discussion, given that Scotland is now embarking on that process? Perhaps there could be a shared learning experience to ensure that we take matters forward for trans equality.

Yes, I am more than happy to do that and I am keen to collaborate in any way with those from whose experience we can learn.

My right hon. Friend the Member for Basingstoke presented her Bill today. We have not yet heard a convincing case for introducing gender identity as a protected characteristic. The Equality Act, and criminal, hate crime and employment legislation all offer protection for trans people. However, we will continue to keep an open mind, listen to testimony and monitor evidence to find ways to improve the lives of trans people.

My opposite number, the hon. Member for Rotherham (Sarah Champion), asked about hate crime. We have improved the recording of hate crimes against LGBT people to support more effective prevention and action. Police forces are now required to collect those data, and the first set of data was published as official statistics in 2013. We have committed to review legislation on hate crimes and we are currently considering the options. The Crown Prosecution Service also recently launched a consultation on draft guidance on prosecuting cases of offences involving transphobic hostility.

The hon. Member for Lanark and Hamilton East spoke about gender markings and gender X on passports. As she pointed out, UK passports currently recognise only male and female genders. Legal recognition is more broad than just changing passports and would need to be considered across Government. Introducing a third category, such as that denoted by an X in a passport, would require a change in UK primary legislation. However, on gender markings, as set out in the response to the Select Committee report, the UK has agreed with the International Civil Aviation Organisation to lead on a survey of member states on gender and passport markings. The gender questionnaire was circulated in October and member states had until the end of November to provide their views. We will review the responses, compile a report and submit it to the working group early in 2017.

The evidence about the adverse effects of poverty on educational attainment and achievement is undeniable. My constituency has one of the highest child poverty rates in Scotland. In some parts of my constituency, one in three children are living in poverty. Data from the 10-year study “Growing Up in Scotland” show that children living in poverty are much more likely than others to face social, emotional and behavioural difficulties, to be overweight and to have multiple other problems. All those factors will have an impact on their future attainment and achievement.

Poverty ruins childhoods and reduces life chances. I am proud that the Scottish Government are focusing on closing the attainment gap and that the First Minister has made education a priority. A higher percentage of entrants to Scottish universities are from our poorest communities. The gap in academic achievement between our 20% most deprived pupils and our 20% least deprived pupils has reduced. The gap between those from the most and least deprived communities in positive school-leaver destinations is narrowing. Part of that is down to the fantastic work of many of our universities and colleges, which are working on positive routes into higher education. I pay particular tribute to Ayrshire College, Scotland’s Rural College and the University of the West of Scotland, all of which have campuses in my constituency, for the efforts that they have made to encourage and support students in the transition between further and higher education.

In Scotland, we are far from complacent on this issue. More needs to be done, and more is being done. When we see the attainment gap starting long before children get to school, it is clear we need to focus on early learning and education. While the UK Government pursue their damning and divisive obsession with grammar schools, the Scottish Government are doing everything possible to ensure that each child has access to the same opportunities, no matter what their background is.

Friend agree that the education system in Scotland, which prioritises the ability to learn, not the ability to pay, enables more students to attend university because their tuition fees are covered by the Scottish Government, whereas the English system denies students that opportunity?

Our curriculum for excellence is combining academic excellence with the attitudes and skills for success, and it is giving young people the opportunity to gain vocational qualifications without being seen as second best. In Scotland, we are making progress on ensuring that every child has the ability to reach their full potential—from baby boxes to free university tuition, we are working hard to improve life chances and aid social mobility—but, ultimately, our efforts in the education system are tackling a symptom not the cause of inequality.

The Prime Minister has said that her Government are committed to fighting injustice wherever it arises. A substantial body of research shows that poverty has a devastating impact on the lives of young people across the UK. We live in a society where the rich enjoy the trappings of wealth and the poor rely on food parcels from charities. Far from fighting injustice, this Government are driving people further into poverty while offering to syphon off a few of the brightest poor kids for a place in their grammar schools and pretending that that is equality. A two-tier system is totally unacceptable.

The Scottish National party commissioned independent research by Landman Economics that found the inequalities facing many of the WASPI women can be rectified if the UK Government implement the report’s recommendations for the sum of £8 billion, rather than the previously cited £30 billion. Will the Minister urge her Treasury colleagues to prioritise this issue ahead of the autumn statement?

A range of potential options have been proposed by a number of different campaigns, but nothing that is specifically aimed at those most disadvantaged by the state pension age increases, and none of them has proposed something significantly better or, indeed, affordable and at an acceptable cost to the taxpayer.

As always, Mr Davies, it is a pleasure to serve under your chairmanship.

I thank the hon. Member for Halifax (Holly Lynch), who truly has been a champion on this issue, and there is no doubt that we share the same interest in addressing it.

I have made this point before, but I will make it again to echo the sentiments expressed by the hon. Lady. She said that this is not a national living wage and, in fact, the Government are showing audacity in using the words “living wage”, because it is not. The accredited Living Wage Foundation has already made that clear—it is a national minimum wage. There has been a welcome increase, but it is simply not good enough that there is discrimination against an entire generation of young people.

I will speak from my own experience. I stayed on at school when I was 16, but I had to get a part-time job because I was from a single-parent family and the only way that I could continue my studies was to work part-time. I worked twice as hard, for twice as long, for the same amount of money as some of my colleagues, and that is the exact same position that many young people are faced with 13 years on. That is absolutely ludicrous and I honestly do not know how the Government can defend that policy at all.

I will take this opportunity to highlight some of the comments made by my hon. Friends and by other hon. Members today. The hon. Member for Halifax said that there is absolutely no proof that young people are not as productive as older people and I am pleased to hear that the Government have no statistics to that effect, because I am absolutely certain that it is not the case. I hope that the Minister, when he gets to his feet, will confirm that the idea that young people are not as productive is a complete falsehood.

The Government do not want to be on the wrong side of equal pay for equal work, so it is about time they got on the right side of history. To cover the points made incredibly well by my hon. Friend the Member for Glasgow Central (Alison Thewliss)—I have also held that same convenorship role in the SNP youth wing, for my sins—it is essential that we dispel some of the myths around young people taking more time to train and it being harder to get them up to speed with their colleagues. There are some incredibly hard-working young people across the country, and this Government fail to recognise that through their policies. When will they reconsider this policy? Age discrimination sanctioned by the state should never be legitimised.

I asked some of my constituents how they felt about things. Being under 25, were they excited by the new national minimum wage? Were they excited to be discriminated upon by their own Government? While Hailey is not under 25, she said that they were discussing it in college, and she was shocked to hear that a girl in her class, who was under 18 but over 16, was getting less than £5 an hour for the same job on the same hours. In fact, Hailey said, the girl was working more hours to get the same money. Will the Minister respond to Hailey? Ali said that it is despicable that companies—and, I would add, the Government—would allow people to get away with paying someone less because of their age. She said:

“That’s age discrimination. I thought that was illegal—it’s certainly immoral.”

I hope the Minister will respond to those points, which were made so well by Hailey and Ali.

The figure of £7.20 an hour, which the Government have set as their new minimum wage—if people wish to call it a living wage, carry on, but it is not—does not reflect the fact that the Living Wage Foundation has stated that £8.25 an hour for those living outside London would be more reflective of a real living wage. For those living within London, the real living wage would look more like £9.40, which is a far cry from £7.20. Forgive me if I am being presumptuous, but the Minister has perhaps been away from the labour market for some time, so he has not been subject to a minimum wage. I am not necessarily so far away from the labour market. I do not remember receiving a minimum wage, and £7.20 is a far cry from any sort of living wage. It fails to take account of the fact that many people under 25 have families, children and homes to provide for. All it assumes is that every young person has the luxury of deep-lined pockets and a family on whom they can rely. I do not think that is the case, and I am pretty sure that many young people, who are absolutely crucial and are working every hour God sends to make money, would not be happy to hear that the Government genuinely think their labour is worth less than some of their colleagues. I look forward to the Minister responding to each of those points.

We should consider the further aspects of age discrimination, which could take the shape of younger workers being employed in preference to their older counterparts—I am sure that the Government do not want to encourage that—as a cost migration strategy. I respect the comments made by the hon. Member for Strangford (Jim Shannon). Many employers will have difficulty balancing the books due to the new minimum wage, but the reality is that the pressures on small and medium-sized businesses will continue. I am sure that the Government, because they take business so seriously, will do all they can to support small and medium-sized enterprises to deliver a real living wage, instead of creating a further disparity between young people and their voters, who they perhaps prefer.

The ultimate question is this: when will the Government put young people first, instead of simply prioritising businesses, their own agendas, bankers or whatever else they seem to think is their priority? Young people are our future. They are our labour force and our economy—when will the Government start looking out for them?

I congratulate the hon. Member for Mitcham and Morden (Siobhain McDonagh) on securing this debate, and I wish her well with her recovery. I am only sorry that she could not be in the Chamber to deliver her speech, but I thank the right hon. Member for Enfield North (Joan Ryan) for opening the debate.

As a signatory to this motion, I want to recognise that the idea of a living wage sounds positive and a great thing. In fact, it sounds like a boost for people on low incomes. Who would argue with an increase to the living wage or to any wage? However, the fact is that this is not a living wage. I do not often find myself agreeing with the hon. Member for Shipley (Philip Davies)—in fact, I do not think I ever have until today, when he stated that this policy is nothing more than an increased minimum wage.

The fact that we are already witnessing the unintended consequences of this policy—the reality of an adverse effect on workers’ benefits—only proves that this Government have once more undermined the role of workers in favour of businesses. Once more, the hard-working people of this country will pay, while the bankers, businesses and tax avoiders continue to profit. As employers seek to manage the impact of wage bills, the reality is that no business wants to lose profit. Reducing staff numbers, cutting hours, misusing or abusing zero-hours contracts and reducing employee benefits are just some of the ways in which businesses are managing to subvert the cost of paying people real living wages, while expecting more from their employees.

Let us be clear: the real living wage, as defined by the Living Wage Foundation, takes into account living costs, whereas this Government’s so-called living wage is calculated on median earnings and completely fails to take into account the cost of living. How can it actually be called a living wage?

I have listened to several speeches from Opposition Members and the hon. Lady is making the same argument. It is important to understand that the living wage should be seen in the context of hourly pay. She is right to say that employers look at the total wage bill and look for other changes, but she should not conflate the two. I think she wants to support the Government’s intention of increasing the hourly pay of workers. Does she agree?

We can agree that workers deserve a real living wage, but this is not a real living wage. To go back to my argument, it is merely an enhanced minimum wage. While I would welcome a living wage, this does not meet the mark. Sadly, this does not even apply to those under 25. Try telling a 17-year-old part-time worker that their work is of less value than that of someone who is a few years older. Is that really what we think of our young people? Is that really the value we place on the work of our young people, who are all too often forgotten in this Government’s priorities?

The term “living wage” is important. In Scotland, we recognise that. We set a target to have 500 real living wage employers by the end of this Parliament and we have already exceeded it. Last year, the Scottish Government announced that they had become an accredited living wage employer. The SNP Government have introduced a requirement to pay the real living wage as an integral part of the public sector pay policy. Since 2011, we have invested £1.5 million per year in paying the living wage rate across the parts of the public sector where the Scottish Government control the pay bill, directly benefiting 3,000 workers. Scotland has a higher proportion of workers who are paid the living wage than any other nation of the UK.

There are some positive examples in my constituency, such as Hamilton citizens advice bureau, Bluebird Care in Larkhall, the medical centre in Lanark and Emtec contractors in Uddingston, all of which are leading the way as real living wage employers and showing what can be achieved. In many ways, what the Government are doing will undermine the incentive for employers to achieve a real living wage.

Despite what the Government have said, they must do more to ensure that no worker is worse off as a result of this change. We have all seen the worrying reports about employers mitigating the cost of the new rate by cutting hours and premium rates for overtime and bank holidays. The hon. Member for Mitcham and Morden asked the Prime Minister whether he would guarantee that no worker would be worse off as a result of the national living wage, but she never received a response. Perhaps the Minister will give that commitment today.

I am depressed by the negativity of this debate. People who have come to me in my constituency are pleased that they will have £900 more in their pockets. Some 40% of people will get a wage rise. This is something that the Government have been speaking up for. People want more money in their pockets and they are going to get it. On the whole, businesses in my constituency are in favour of the national living wage. It is difficult, but they are for it.

Although it will always be welcome if people have more pennies in their pocket, the Government are not looking at the full picture. When cuts to universal credit outweigh any benefit from the so-called national living wage, how can it be defended as a national living wage at all?

My constituent, Andrew Larmour, sent me a message to say that although he got a pay rise on 1 April because of the living wage, he received a pre-printed letter on 31 March about a change of circumstances for his benefit entitlements, which indicated that he will not be better off but worse off.

I thank the hon. Gentleman for making that valid point.

Despite the Chancellor’s claim that the lowest-paid workers need a pay rise—indeed, they do deserve a pay rise—his actions will result in the rich getting richer while people in low-wage jobs see no real benefit. Indeed, they will experience an erosion of any employer benefits that they once had.

It is telling that the Government believe that women will benefit most from this change in policy, because it means that they recognise that women are more likely to be stuck in minimum wage, part-time, uncertain employment. That tells the story of gender inequality, whereby women are systematically paid less than men. It perpetuates the gender pay gap—something that the Prime Minister has pledged to end in a generation. His deeds do not appear to be matched by words. Once again, the Government know the cost of everything and the value of nothing.

It is an honour to serve under your chairmanship, Mr Howarth. I congratulate the hon. Member for Brentford and Isleworth (Ruth Cadbury) on securing such an important debate.

Gender equality is not a dream, or at least it should not be. Often when we debate gender inequality in the workplace, we hear the usual apologist grumbles from Members. We are told that, in many ways, it is a fact of life; it is the way the world works and we cannot continue to complain because it will not change—“Life is unfair. Men are men and women are women. That’s it. Accept it and get on with it.” Well, I will not accept it. That response, which I have come to expect, is not only lazy but wrong, and it does not address the real issues women face. If we think along those lines, of course nothing will change. Inequality will continue. Women will continue to be discriminated against for having children. They will continue to be refused access to justice and will always be paid considerably less than men. We cannot, should not and must not allow that attitude to go unchallenged, because it is that attitude that put us in the position we are in today and it is that attitude that will keep us here.

On 9 November, we marked equal pay day, when women across the United Kingdom started working for free, while men continued earning—a day that we should be talking about in history lessons, not in the 21st century. Forty-five years after the passing of the Equal Pay Act, men still earn two months’ more wages than women every year. The gap between men and women stands at a staggering 19% in the UK, with women earning 81p for every £1 that a man earns. Even in professions dominated by women—hairdressing, catering and cleaning—the pay gap still exists, while women in skilled trades, including plumbing and mechanics, suffer the biggest pay gap, earning close to 30% less than their male counterparts. That is a damaging indictment of successive UK Governments, employers and industry, and it is something we should be collectively ashamed of.

In Scotland, the gender pay gap is substantially lower than across the UK, which is welcome, but it still exists and it should not. More work must be done across these islands. In my constituency, gender inequality has been at the heart of the political debate for years. In my own local authority, South Lanarkshire Council, hundreds of women have fought for equal pay for equal work, and many of them have now received a payout, totalling the massive amount of £70 million. However, just a few months ago, figures published for South Lanarkshire Council showed that the gender pay gap was a staggering 16%, and many more women continue to fight for equal pay, so we are not there yet. I say that not to play politics but to show that the gender pay gap still exists, particularly in the public sector.

Scotland is one of the leading countries in Europe for reducing female unemployment, and we have done it through practical policies such as expanding childcare for two, three and four-year-olds and paying all Government employees the real living wage. We continue to move closer to the goal of equality. Scotland’s First Minister has made the business of redressing inequality a priority for her Government. Labour market figures show that female employment in Scotland has reached a record high, while youth unemployment is at its lowest level in six years and the number of people in work continues to grow. That is a testament to the strong actions taken by the Scottish National party in government, with the economic powers it currently holds, but women should not have to wait another 45 years—or 70 years, as the UN has estimated—for equal pay in Britain.

We have heard from Members about the campaign group Women Against State Pension Inequality and the impact of this issue on the entire generation of women born in the 1950s. What do the Government intend to do to address the issue of those women’s pensions? How will they rectify that, to ensure that women do not continue to experience inequality?

I am glad to hear the hon. Lady raise the same point I did. Is she aware how much it rankles with and angers the women affected that they have not received the transitional protection the Government promised them? It is very harsh to impose the change on people without the protection the Secretary of State promised.

I absolutely agree with the hon. Lady and thank her for that point. I hope the Minister will address that in his remarks.

This fight is not reserved to half of the population. We do not fight against injustice for one sex; we fight for everyone. No man wants his wife, daughter, sister or mother to earn less simply because they are women. We need to send a strong message to employers, Governments, local authorities and industry that there is simply no excuse for discrimination. As things stand, we are damaging families, diluting gender equality and doing no favours to the economy that is so important to this Government. Now is not the time for excuses; we have heard them all before. Let us take strong, decisive action and put gender inequality where it belongs: in the history books.

Absolutely. There is nothing that I can disagree with in that intervention, and I will come to some of those issues later in my speech.

Returning to the contribution from my hon. Friend the Member for Lanark and Hamilton East, the gender pay gap still exists even in what would be traditionally or stereotypically described as “female jobs”. That is still wrong and needs to be addressed. No man wants to see his daughter suffering a gender pay gap—that is absolutely right. I speak as a the father of a one-year-old daughter who I hope will go on to employment where she will earn the same as her male counterparts, so I stand here today on that basis.

The hon. Member for Coventry North East (Colleen Fletcher) effectively highlighted the issues of gender inequality in her city of Coventry. Again, I highlight the contribution made by the hon. Member for Coventry South, who, as I said, also made noteworthy contributions to the debate on pensions yesterday.

It is disappointing that in 2015 we are still discussing matters of gender equality. Nevertheless, it is important to take cognisance of the fact that a real pay gap between men and women remains. Low pay affects women disproportionately. In 1999, the gender pay gap for full-time employees in Scotland stood at 16.7%, but by 2014 it had been reduced to 9%, and it is 9.4% in the rest of the UK. This year, the Scottish Government launched the Partnership for Change programme, wherein public, private and third-sector organisations make a voluntary commitment to work toward a 50:50 gender balance on their boards by 2020. As of 9 November, 160 organisations and businesses have signed up, which I am delighted to see, although more work is clearly needed. On this year’s equal pay day, 9 November, First Minister Nicola Sturgeon pledged to do everything she can to advance equal pay and gender equality in Scotland as part of the Fawcett Society’s pay gap pledge campaign. The First Minister has been leading the way on the issues, starting clearly and publicly with her 50:50 gender balanced Cabinet.

Many women shoulder a disproportionate amount of childcare or family responsibilities, and they are unable to take up promotion and other opportunities because they do not have alternative care arrangements. The Children and Young People (Scotland) Act 2014 provides further assistance to women and young families by providing that all three and four-year-olds and the most disadvantaged two year-olds are entitled to 600 hours of early learning and childcare. By the end of the next Parliament, the Scottish Government will have doubled the hours from 16 to 30 per week. Increasing childcare will not only improve outcomes for children, but support more women into work.

The Scottish Government have also provided Skills Development Scotland with additional funding as part of a wider £3 million allocation in 2014-15 to develop a range of equality activities, including tackling gender segregation. The Scottish Government are doing all they can with the tools on offer to provide tangible improvements.

Absolutely—I wholeheartedly agree with my hon. Friend.

In Scotland, councils are now responsible for meeting legal obligations to their employees, including on equal pay, but clearly more work needs to be done. My hon. Friend highlighted the issues in South Lanarkshire. My constituency falls under North Lanarkshire Council’s jurisdiction. The council has been embroiled in a long-running and legally very costly equal pay dispute in which the council has dragged equal pay claims through the courts for several years. That is utterly shameful and needs to be addressed urgently. All equal pay cases need to be resolved with urgency and commitment, so that those affected receive their legal entitlement. Again, I am making the point not on a party political basis, but on the basis of doing what is right by our workers.

To conclude, despite the passage of the Equal Pay Act 45 years ago, more work needs to be done to address low pay. Although it is important to recognise that female employment in Scotland is at record levels, that the gap between male and female employment is at its smallest ever, and that the gender pay gap is smaller than in the rest of the UK, a great deal of work remains to be done to ensure women receive parity with their male colleagues. Low pay for women is both a symptom and a cause of gender inequality. We must do all we can to eradicate the gap between men and women to create a fairer and more prosperous society.

It is a pleasure to serve under your chairship, Mr Howarth. I congratulate my hon. Friend the Member for Brentford and Isleworth (Ruth Cadbury) on securing this important debate, and I pay tribute to the many people on Twitter who are tweeting this morning on #WomenandLowPay, and are contributing to this debate as part of the digital opening up of Parliament.

We have heard this morning that the gender pay gap in the UK remains, and that women earn 81p for every pound that men earn. Many reasons have been given for that, including a system of occupational segregation in the UK; all too often, women find themselves in low-paid sectors such as retail, hospitality and care, and work part time because they have caring responsibilities. Women face barriers in going to employment tribunals because of maternity discrimination. They face barriers to training and development, including apprenticeships. Sadly, this Government have failed to build on Labour’s achievements, and their cuts are hitting women hardest.

My hon. Friend gave a good example of women’s work being valued less than men’s. She referred to a Father Christmas earning £12 an hour and a Mrs Claus earning the national minimum wage—half the hourly wage of Father Christmas. That got me thinking about a few things, including the message that sends to the children who visit that Father Christmas—that we value his work more than Mrs Claus’s. Frankly, I doubt whether Father Christmas could get round the world in one night without the support of a wife like Mrs Claus.

The majority of low-paid workers in this country are women. Three in five national minimum wage jobs are held by women, and over a quarter earn less than the living wage; the figure for men is one in six. Women are pushed into clerical, caring, catering, cashiering and cleaning occupations, as we have heard, and I will add another “C” to the list: classroom assistant. That brings me to my mother, who was born in the 1950s and works as a classroom assistant. With her union, she challenged her employer on equal pay legislation and on why classroom assistants were earning far less than men who were working for the council in similar jobs of equal worth.

My hon. Friend the Member for Worsley and Eccles South (Barbara Keeley) referred to pensions discrimination. I call on the Minister to outline what transitional protection he will introduce for women who have been caught in that trap.

The Resolution Foundation estimates that care workers, 78% of whom are women, are collectively paid £130 million below the national minimum wage, because employers fail to pay for travel time between appointments, and make deductions for items necessary for their job, such as uniforms, mobile phones and petrol. Women are forced into work in which they are undervalued and low paid. For example, 63% of those in retail and customer service are women.

What are the Government doing to end gender segregation and undervaluation of women’s work? Will the Minister give a commitment to take action to encourage women to consider traditionally male-dominated jobs, especially in science, technology, engineering and maths—STEM careers—as well as encouraging men to consider, for example, the caring professions, to ensure that these careers are properly valued and paid at the rate they deserve? We should ask ourselves as a society why we do not value the work that women do to the same extent as that done by men. Some 42% of women are employed part time, but the average part-time hourly rate is less than a third of the full-time hourly wage.

Does the hon. Lady agree that zero-hours contracts only exacerbate inequality? Will she join me in calling on the Government to ban exploitative zero-hours contracts, particularly as we are coming up to Christmas, when the retail industry in particular exploits such contracts?

The hon. Lady predicts where I am going. I agree that zero-hours contracts make it very difficult—for women, predominantly—to plan, especially at this time of year. Reference has been made to Father Christmas; this is an important time of year for families to come together. It can be an expensive time of year. Budgeting when on low pay is essential, but if someone does not know what wage they will take home at the end of the month, it is very difficult to budget at all.

What are the Government doing to create more well-paid jobs with reduced hours or flexibility? The TUC has researched the issue of single-parent families, who are twice as likely as couple-parent families to live in poverty, and 90% of single parents are women. Women’s low pay arises hugely from the fact that they are often a single parent in a household. Single mothers are more likely than mothers in couples to be in low-skilled work, reflecting the difficulties in finding well-paid work that fits around caring responsibilities.

Research from 2005 showed that 30,000 women were forced out of work through pregnancy discrimination, but 10 years later, that figure has almost doubled to 54,000. What are the Government doing to tackle maternity discrimination, and to ensure that women who are victims of such discrimination have access to justice?

As part of my research for the debate, I contacted the National Union of Students and asked it for the information that it has about apprenticeships as part of the work that it is doing. I pay tribute to Shelly Asquith, its vice-president, welfare, who provided me with the information. On average, young men earn 21% more than young women while doing an apprenticeship. According to the poll, female apprentices earn just £4.82 an hour, compared with £5.85 an hour for male apprentices. What steps are the Government taking to improve training opportunities for women, and to ensure that apprenticeships do not discriminate by gender?

My hon. Friend the Member for Brentford and Isleworth set out Labour’s record on equality issues. The Equal Pay Act 1970, the minimum wage, the Sex Discrimination Act 1975 and the Equality Act 2010 were all introduced by a Labour Government. In government, we have also strengthened maternity and paternity rights. What we have seen from the current Government is a lot of job losses in the public sector. Of the local government job losses since 2010, 96,000 have fallen on men, while 141,000 have fallen on women. With the pay for low-paid work being 8% higher in the public sector than in the private sector, how many of these women are being forced out of their public sector jobs into equivalent private sector jobs and in effect receiving a pay cut?

Will the Minister commit to developing all tax and spending in a way that takes on board the likely impact on women’s equality? I ask that because 85% of the tax credit and benefit changes have fallen on women, and 70% of the savings made by cuts to tax credits have fallen on women. Will the Minister include in the new gender pay gap reporting regulations a requirement for employers to publish information on the earnings distribution of men and women in their workforce? I ask that because unless women know that they are receiving less pay for an equal-value job, it is very difficult for them ever to take any action to challenge that.

The full-time gender pay gap is 9.4%, but that masks the adverse experience of those working part time, where pay is typically lower, resulting in an overall gender pay gap of 19.1%. Indeed, the UK’s gender pay gap is above the EU average, and at the current rate of progress, it will take 50 years to close it. Although I am a young MP, I plan to be retired in 50 years’ time. I am not prepared to wait that long, and I am sure that the Minister is not, either. I therefore hope that he will have positive answers to my questions. I leave him with this thought: why do we value women’s work so much less than we value the work that men do?

I rise to oppose the Bill. It is being a member of the Unite trade union and the daughter of former trade union shop stewards that underpins my advocacy of workers’ rights.

The Bill is deeply damaging to workers’ rights and is just the latest example of how out of touch the Government are with the hard-working people of this country. The Bill denies the important role that trade unions provide in protecting and enhancing workers’ rights. As the Scottish National party’s spokesperson for equalities, women and children, I, along with colleagues across the Opposition Benches, recognise the important role that trade unions play in collective bargaining power that has benefited many women across my constituency to obtain fair pay for fair work in the recent equal pay dispute.

The SNP strongly opposes the proposed reforms, because they will erode democracy in the workplace. The Bill would restrict the power of devolved Administrations, local governments and other public bodies to determine their own industrial relations. Do Members on the Government Benches not see that good employment practices are key to economic competitiveness and social justice? Workers across the UK deserve the right to strike. It is an important outlet to promote social justice and improve employment conditions. The reforms would not allow social justice in the workplace to be pursued.

The UK Government’s Trade Union Bill starts from the false premise that unions are bad and that our activities should be curtailed. The Scottish Government have actively sought to promote the very constructive role that unions play in the workplace, the wider economy and civil society.

I echo the sentiments of trade unions that rightly criticise the Bill for allowing

“businesses to behave badly by undermining the right to strike”.

Trade unions helped to establish the Equality Act 2010, protecting thousands of individuals from discrimination on the basis of gender, race, religion or sexuality. Those protections in the workplace allow those with additional needs or physical barriers to make a significant contribution to the workplace. Perhaps the Government should consider the hypocritical rhetoric of helping people back into work on one hand, while gradually eroding the role of trade unions in the workplace on the other.

I close by reiterating the fundamental point outlined in article 11 of the European convention on human rights, which provides the qualified right to

“freedom of peaceful assembly…and to join trade unions for the protection of…interests”.

Are the measures in the Bill necessary in a democratic society? I place the burden on the Government to justify them as proportional, and I implore the House to oppose this arbitrary Bill.

The Minister will be aware that children with special educational needs have a range of needs. Will he detail his Department’s plans to ensure that sport is available to all pupils and, in particular, describe his plans to ensure that classroom assistants are available to support the needs of all children?

One of the core principles of our reforms to special educational needs is making sure that every aspect of the system, whether it be education, health or social care, is working relentlessly to a single assessment of and plan for the child, so that we have a whole-school and whole-system approach—and a nought-to-25 system as well. It will mean that we move away from different parts of a child’s educational experience being truncated and re-started as they move to the next part. We are working hard to make sure that support is consistent, and we are building on great programmes such as Achievement for All, in which we have had excellent results.

Will the right hon. Lady acknowledge that we face a large task in addressing the gender pay gap? Will she note that the average percentage difference in the UK is 19.6%, with the figures for England and Scotland being 19.5% and 17.4% respectively? There is still much to do to address these issues. Will she also note that the industries she speaks of do not address the acute problems that arise in low-paid sectors and industries? We are talking not only about businesses, but other areas.

I echo the sentiments of my hon. Friend the Member for Livingston (Hannah Bardell) in congratulating the First Minister on making top place in the list of the 100 most powerful and influential women in the UK. I also recognise the work of the Scottish Government in creating a 50:50 Cabinet, and the importance of ensuring that this Chamber, and all Chambers of democracy, receive 50:50 representation.

It is my pleasure to speak in this important debate and to open on behalf of my party. I regret that, in this day and age, this debate has to take place, but it does and I welcome the consensus from all parties on the fact that progress has to be made. Across my constituency, I have met many women who say life is still tough for them and their families. They say that, despite the optimistic forecasts from the Chancellor, the recovery he speaks of is not reaching their pay packet. In fact, a report last year showed that it could be almost 100 years until women can expect to be paid the same as men—this while three quarters of company directors, three quarters of MPs and more than three quarters of national newspaper editors are men. That simply is not good enough and more action needs to be taken. More than 40 years after the Equal Pay Act 1970, the pay gap between men and women in the UK remains substantial.

I thank the hon. Lady for her intervention, but she is in fact mistaken, as the gap has reduced to 17.4%.

The gender pay gap is not a surprise, as it is women who bear the brunt of the Government’s welfare cuts. But devolution has proved to be a success. It has shown that when the Scottish Government have the power, they take action. The Scottish National party Government are the first Administration ever to pay the living wage to all employees covered by their pay policy—something that has yet to be replicated by the UK Government.

Last year, the Scottish Government’s Finance Secretary, John Swinney, announced that the living wage would rise to £7.85 per hour. My message is clear: giving the Scottish Government powers over employment policy would benefit thousands of women across Scotland and the UK and bring about real progress in tackling low pay. The SNP Scottish Government have taken great steps to help parents, especially mothers, back into work or education by extending access to childcare. Provision for three and four-year-olds is up 45% since the SNP took office in 2007, saving families up to £707 per child. The entitlement has been extended to thousands of two-year-olds from Scotland’s most disadvantaged families. Some of the powers that we need to go further remain in this Parliament.

If the UK Government are not willing to take action on equal pay, they should not stand in the way of the Scottish Government. They should give the Scottish Parliament the powers it needs to make real change. As parliamentarians, we have a duty to ensure that, once and for all, pay inequality is a thing of the past. But the problem of unequal pay extends beyond this Conservative Government. The Labour party may talk a good game on equal pay, but the facts tell a different story.

South Lanarkshire council, on which I was a councillor before I joined this House, has a Labour majority, but the gender pay gap is a staggering 16%, and substantially more men than women are in higher grade posts. It was only a year ago that the council had to make a £75 million pay-out mainly to female workers in the equal pay scandal that has swept many local authorities. This situation is simply unacceptable and the Labour party in South Lanarkshire must get its act together when it comes to paying women the same as men.

Thanks to my colleagues in the Scottish Parliament, new labour market figures published a few weeks ago showed that female employment in Scotland has reached a record high. They reported that female employment now stands at 72.5%, that youth unemployment is at its lowest level in six years and that the number of people in work continues to grow. That is a testament to the strong action taken by the SNP Government with the economic powers that they currently hold, which is exactly why we need more economic powers to be transferred. We should have the power to create even more jobs and better jobs for women, rather than the current situation where those powers are held by the UK Government. The SNP Government have proved their record on gender equality. They have proved their commitment to equality in the workplace, which is why they should and must be given the power to build on their success.

I completely agree. This is about empowerment, enabling all children to reach their potential both at a young age and as they grow up, and the direct impact that being treated with disrespect has on their potential to reach their full financial and economic growth, which directly affects their immediate family.

I am not advocating teaching little children about sex, but I am saying that every child at key stage 1 should understand about valuing themselves and others. They should understand their rights to respect and privacy, and understand what to do if those rights are violated. We cannot protect children 24/7 from abusers, but we can teach children to protect themselves.

Violence against girls and women is not a problem that can be fixed overnight, but perpetrators do not reach adulthood and decide one day that they are going to abuse a girl. It is not an on/off switch where one day they are fine and the next day they are a perpetrator of domestic violence or child abuse. It is a slow erosion of boundaries that happens over years. Instead of waiting to deal with the crime, we need to empower our young people with positive examples of relationships, using their years in education for positive interventions in an attempt to prevent violence occurring. Building on that, I intend to work with a number of the leading charities to try to engage the country and decision makers in challenging the stereotypes that are repressing women.

I completely agree, which is why I spoke about educating children, and why at the very beginning I said that this was not a women’s issue, but a society issue. Unless we address it at that level, we will not move forward at all. We need to empower all children, but young girls in particular need to be given support and encouragement so that they can reach their full potential.

I thank my hon. Friend for her interesting intervention. I do not know whether she knows this, but my daughter played cricket for Somerset, so I am very keen to promote women’s sports. Indeed, during my campaign, I became very involved in promoting women’s sports down at the football ground with our Taunton football club. I urge the Government to do exactly as my hon. Friend suggests as much is to be gained from incentivising and encouraging women’s sports.

The women in that bull semen company, many of whom have children, work effectively, intensively and flexibly. Flexibility is the key for women in the working world, and we need to give them the tools to get the job done. I am pleased that a number of my hon. Friends mentioned flexibility earlier in the day and I am confident that the Government are supplying the tools in an increasingly thoughtful and practical way to enable that to happen.

Women, with their talent, are a key to driving this country’s economic success. Obviously, the more successful the economy, the more pay will rise and the more women will benefit. Of course, women’s pay must always be equal to that of men across the board, and our female children—to join the team, I have two girls aged 23 and 20—should never have to think about whether they might be paid less than men. We really do need to get those girls, who are so good at taking their exams, into science, engineering and even manufacturing—all areas that have been highlighted today.

I praise the Government’s recent moves to modernise the workplace by introducing rights to more flexible working for employees, which will increasingly help women, and I also very much welcome the 20% support for childcare costs for up to £10,000 a year for each child.

Does the hon. Lady accept the point made earlier by one of my colleagues about the Fawcett Society’s research suggesting that 85% of cuts to benefits, tax credits, pay and pensions have a greater impact on female members of the household than on their male counterparts, and that that has a substantial impact on child poverty figures and women’s ability to move on in the workplace?

That is why we need to get the economy moving to improve all those areas and why childcare support is so important in helping to top them up. That support is very much welcomed by all the women I speak to.

I welcome the introduction of 15 hours a week of state-funded early education for three and four-year-olds. Although I welcome that support, I know from speaking to a range of women in work that many of them are calling for it to be introduced when children are even younger, to enable those women who want to do so to get back to work sooner. I support my hon. Friend the Member for Portsmouth South (Mrs Drummond), who said that we must recognise those women and even fathers who want to stay at home to bring up their children, because nothing is more important than what we do for our children in bringing up the next generation.
