I have been contacted by many constituents who are owners of leasehold flats in buildings under 18 metres in height that are covered in cladding, and the freeholder has not replaced that cladding or produced an EWS1 form. Some of these residents are desperate to move but cannot because their flats are effectively valueless without the form. Will the Prime Minister update the House on what progress is being made by the Royal Institution of Chartered Surveyors and the National Fire Chiefs Council to develop the urgently needed risk prioritisation matrix, so that my constituents can move on with their lives?

I have deep sympathies with people who face this problem. It is not right or fair because if your building is under 18 metres you do not need one of these EWS1 forms, and you would hope that lenders would understand that. But we are working as fast as we can to make sure that all the buildings in question are identified and that we remove cladding wherever it is necessary and give assurance and security wherever that is necessary too.

It is a pleasure to speak in the debate and to follow my hon. Friend the Member for Wolverhampton South West (Stuart Anderson). When my hon. Friend the Member for Wrexham (Sarah Atherton) was in her place, she outlined the concept of lawfare. There can be no doubt that that exists and has been exploited, leading to vexatious claims against our brave armed forces personnel over a considerable period of time.

Cases such as that of Major Robert Campbell are absolutely scandalous. This man had to face eight separate investigations over 17 years into a single incident that took place back in 2003. He is only 47, so we are talking about more than a third of his life. Each investigation cleared him, only for the goalposts to be moved for each successive investigation. The toll taken on that completely innocent man, who put his life on the line for his country, is enormous.

Tragically and shamefully, he is not alone. To put it into perspective, a long-running streak of claims have been dismissed as far back as the 2009 al-Sweady inquiry, which took five years, cost £25 million and the conclusion of which was that the allegations were

“wholly without foundation and entirely the product of deliberate lies, reckless speculation and ingrained hostility”.

Furthermore, the Iraq historic allegations team determined that 70% of cases did not have a case to answer or that it would be disproportionate to conduct an investigation. Similarly, as of June, the service police legacy investigations had closed or were in the process of closing 1,200 allegations. Operation Northmoor, which took three years and cost £10 million, resulted in no charges, but all that takes significant time and causes huge distress to those under repeated investigation.

Our servicemen and women make enormous sacrifices on behalf of our country and the practice of hounding them must come to an end. It is therefore right that the Government seek to raise the bar for prosecutions in overseas operations by requiring prosecutors to have proper regard to the uniquely challenging circumstances into which we send our personnel to risk their lives on our behalf, as we heard from my hon. Friend the Member for Wolverhampton South West.

Opponents of the Bill have said that it would issue an amnesty for torture and war crime offences, but that is simply not the case. As the Minister has been at pains to make clear, the Bill does not provide blanket immunity from prosecution; it merely raises the threshold for the prosecution of alleged offences. Those opponents have also claimed that it would damage the reputation of our armed forces. I question instead what sort of a country we would be if we allowed our armed forces to continue to make enormous personal sacrifices only to return back home and be at the mercy—for years—of tank-chasing lawyers such as Phil Shiner, who was, of course, struck off for his actions. The Minister has outlined at length how the Bill meets the UK’s obligations under domestic and international law. I look forward to hearing him do so again in his closing speech.

Most Members on both sides of the House sincerely support our armed forces, but there have always been some who have taken sides against our armed forces and shown no respect whatsoever for our veterans. I am not among them. I am inclined to agree with my hon. Friend the Member for Tonbridge and Malling (Tom Tugendhat), who said that the Bill goes some way to protecting our armed forces but probably not far enough. However, it does improve the current unacceptable position. I therefore support the Bill to protect our armed forces.

May I say at the outset that I am extremely proud of our armed services and their conduct, their calibre and their gallantry? They are well renowned and well supported across Ulster. They are applauded, and have been for many years, even through the dark years when people did not like the armed services so much, because people know the sacrifice that young squaddies made to hold the line between peace and chaos in a part of the United Kingdom. They were, and are, applauded.

In principle my party welcomes the Bill and wants to support it. We do think there are many ways in which it could be improved, and we hope the Minister is listening to those calls for improvement. We are bitterly disappointed that the legislation will fulfil only part of the Government’s manifesto commitment—part of the commitment on which Members canvassed around the whole of this nation to obtain support. I will come to the detail of that in a moment.

When I was a student at university, I had a tutor from Germany. She recounted to me a story about one of her earliest and most confusing experiences of Northern Ireland. She wanted to call a colleague here at King’s College London, and for her it was not a problem. She picked up the phone, she dialled the number, and she was told by the switchboard operator at Queen’s University, “That’s fine—that’s a local call.” Some time later, she had to call a colleague at Trinity College, Dublin, but she was not able to make the call, and was told by the switchboard operator, “Oh, that is an overseas call, down to Dublin.”

So I understand the confusion that some people might have, and indeed the justification that the Government have put into this piece of legislation to leave Northern Ireland out, and leave Operation Banner soldiers out, because in theory Northern Ireland is not overseas, and service in Northern Ireland is not an overseas matter: it is a local matter—a domestic issue. But the Government’s manifesto commitment was to all of their personnel, and no matter what way we cut it, and no matter what the small print may now say, those brave and gallant people and soldiers who served in Northern Ireland under Operation Banner have been jettisoned by this piece of legislation.

The hon. Lady simply cannot be unaware that the campaign to get the world’s leaders to sign up to a leaders’ declaration on biodiversity has been led over the past few weeks by this Government. [Interruption.] She knows that, Mr Speaker. It is this Government who devised the charter. It is this Government who are leading the world in protecting biodiversity across the planet, and we will put in the funding. We pioneered the 30% idea, and we will certainly put in all the funding required.

There is growing concern in my constituency, and across the country, about the rising number of illegal crossings across the channel. To stop those dangerous journeys, save lives and protect our borders, the UK must deter people from making those crossings. The law in this area is complex. Will my right hon. Friend assure my constituents and the country that, at the very latest, a comprehensive Bill to deal with this problem will be brought before the House following the next Queen’s Speech?

I thank my hon. Friend, and he is completely right that the legal position is currently very difficult because of the inflexible and rigid Dublin regulation on returns. What is happening now is that people think there is a way in that is legally very difficult to resist, and it is tragic for those who are coming across in rubber dinghies or children’s paddling pools and who are being cheated by gangs, as they are. We must find a better way of doing this. Once we are out of the EU and able to make our own return arrangements and settle our own laws on this matter, I have no doubt that we will find a way forward.

The Bill is necessary to secure free trade and prosperity throughout the United Kingdom, but the focus of much of the debate has not been on that; rather, it has been on the legality or otherwise of the Bill and the proposals before us. In response, it must be noted that Parliament is sovereign. Parliament is supreme. Parliamentary sovereignty is one of the cornerstones of our constitution and always has been. Legislation and the content of legislation, whether to pass it or otherwise, is for Parliament and Parliament alone.

The withdrawal agreement signed by the EU and the UK acknowledged that there might be difficulties with the Northern Ireland protocol. That was acknowledged earlier by the right hon. Member for Doncaster North (Edward Miliband). The agreement states that if the application of the protocol leads to

“serious economic, societal or environmental difficulties that are liable to persist, or to diversion of trade”,

the European Union or the United Kingdom may unilaterally take appropriate safeguard measures. Provision was made for exactly this contingency in the European Union (Withdrawal) Act 2020, section 38 of which states:

“It is recognised that the Parliament of the United Kingdom is sovereign… Accordingly, nothing in this Act derogates from the sovereignty of the Parliament of the United Kingdom.”

That was done because of the ambiguities of the withdrawal agreement relating to Northern Ireland. The agreement holds simultaneously that there will be unfettered access between Northern Ireland and the rest of Britain after the transition period and that the EU’s customs code will have direct effect in the territory of Northern Ireland. At best, and at the very least, that is ambiguous; at worst, it is a direct contradiction, because it means that access would be fettered to one place but not to another. This was always going to have to be dealt with in subsequent negotiations.

The main clauses in contention this evening—clauses 42, 43 and 45—will come into effect only if the Joint Committee cannot reach agreement. We know that the Joint Committee negotiations have been going badly, particularly in relation to third country listings. It has become apparent that the EU is taking a direction that we cannot possibly support. We also know that the EU is fearful. Why would it not be? A strong, independent Britain prospering on its doorstep is not something the EU would necessarily welcome.

In saying that, I am sure that both sides in the negotiation want to secure a free trade deal, and I wholeheartedly support that outcome. A free trade agreement would be a win-win for both sides, but it must not be at the expense either of our independent sovereignty or of the Union of the United Kingdom of Great Britain and Northern Ireland. We must be honest: the EU is negotiating with its members’ best interests at heart, not Britain’s. It has always sought to use Northern Ireland as a weapon to gain leverage in free trade talks. We must give the Government the tools to push the EU in the direction of agreeing a strong free trade agreement. The Bill seeks to do just that, and I will support it unamended.

Does the Prime Minister agree that global Britain is not just about pursuing an ambitious independent trade policy, but that at its heart it is about championing values? Does he further agree that to make that a reality we must strengthen our voice on the world stage and be unafraid to call out countries that threaten those values and the rules-based international order?

I believe that this will be a profoundly beneficial change for both the FCO and DFID. It will infuse the whole of our foreign policy with the missionary zeal and sense of idealism that characterises the very best of our aid experts. They are the best in the world, and they will now be at the absolute heart of UK foreign policy. That is the right place for them to be.

The UK Government work in 35 low and middle-income countries to implement legal, regulatory and policy reforms to make it easy for business, including from the UK, to operate. Business-enabling environment reform was also discussed at the UK-Africa investment summit, which secured commercial deals between UK companies and African partners worth more than £6.5 billion.

I could not agree more with my hon. Friend. He makes a good point. The Government are committed to working with our Commonwealth partners to support and deepen intra-Commonwealth trade, to improve the business environments in Commonwealth countries to enable them to be more globally competitive, and to facilitate the economic empowerment of women and young people by providing more business and educational opportunities. He will have an opportunity on Monday to take part in the Commonwealth debate.

I should like to start by congratulating the hon. Member for Jarrow (Kate Osborne) and my hon. Friends the Members for Keighley (Robbie Moore) and for North Norfolk (Duncan Baker) on their excellent contributions to the debate. I must say that I envy them the huge relief that I am sure they must now be feeling. I look forward to feeling it myself in a few minutes’ time.

I rise to speak as the seventh Member of Parliament to be elected to represent Orpington since the constituency was created in 1945. I follow some distinguished predecessors, who are noteworthy for a variety of reasons. Time does not permit me to talk about all of them, but I will touch on a couple. The first is William Sumner, who represented the seat between 1955 and 1962. The reason that I mention William is that he did something very rare indeed. In order to secure the Conservative nomination, he defeated a young lady called Margaret Thatcher. That defeat led her to resign from the candidates’ list and to temporarily abandon her political ambitions. Fortunately, however, history shows that she recovered reasonably well from the setback. Baroness Thatcher, as she later became, and the values that she championed are what drew me into public life. She made Britain great again, and we on these Benches are the inheritors of her world-shaping legacy.

I directly follow in some famous footsteps, because my immediate predecessor was Jo Johnson, a man with impeccable family connections. However, he is significantly more than merely the sibling of his famous older brother. He is known for his great intellect, his glittering academic achievements and his distinguished career in journalism. He rose to high office in Government and continues to be highly regarded for having been extremely diligent and hard-working for his constituents. This was shown most clearly by the fact that he quadrupled the majority of slightly under 5,000 that he inherited when he was selected to almost 20,000 at the last election he contested, in 2017. I truly have a tough act to follow.

The Orpington constituency was included in the boundaries of the newly formed London Borough of Bromley as part of the London Government Act 1963. While officially part of Greater London, it is in reality a collection of idyllic villages in the county of Kent. Country lanes, country pubs, village churches and farmers’ fields are spread across great swaths of the area. That is what makes it the best place in the country—contrary to what I heard earlier—to be a Member of Parliament. It is the largest geographical constituency in Greater London, and two thirds of it are rural. The Darwin ward alone is larger than the Royal Borough of Kensington and Chelsea.

Given the rural nature of large parts of the constituency, much of Orpington has not received adequate broadband investment over the years, so the Government’s pledge to roll out full fibre and gigabit-capable broadband to every home and business across the UK by 2025 is especially welcome. I will be pushing for this to be expedited locally as swiftly as possible. Similarly, the rural nature of Orpington means that I have a keen understanding of the huge benefits that open green spaces bring, and any attempt to dilute or remove planning protections for outer London’s green belt would have significantly adverse consequences for my constituents. I will therefore lobby for such attempts to be resisted. The main town centre has a vibrant high street, ably supported by the Orpington 1st business improvement district, and I will always stand up for my local businesses.

Orpington has had its fair share of famous residents. The aforementioned Darwin ward is named after its most famous resident. Charles Darwin lived in the village of Downe, where he wrote his groundbreaking work, “On the Origin of Species”. Challenging orthodox thinking is not restricted to historical figures, however, as the constituency is home to contemporary figures who have made an impact on public consciousness. By a quirk of fate, that same village has been home to one of my new constituents—a certain Nigel Farage, who, although never a Member of this place, has had an undeniable impact on British and European politics.

We are fortunate to have some of the best schools in the country, and I am looking forward to visiting those that have kindly invited me to do so. St. Olave’s Grammar School can trace its roots back to 1571 and its long list of notable alumni includes my hon. Friend the Member for Croydon South (Chris Philp). Its counterpart, Newstead Wood School for girls, has as its most famous alumna the reigning women’s 200-metre world champion, Dina Asher-Smith, who grew up locally and of whom we are extremely proud.

Orpington has also played its part on the national and international stage, including in the hour of this country’s greatest peril. Biggin Hill airport is now a general aviation airport that caters mostly for private aircraft, but during the second world war it was an RAF base and played a major role in the battle of Britain. Spitfires and Hurricanes from a variety of squadrons were based there, and its fighter pilots destroyed more than 1,400 enemy aircraft. Many of the nearby housing developments are named after those RAF personnel who gave their lives to defend their country. Reading of those pilots’ exploits, and in particular of the age at which so many of them made the ultimate sacrifice, is truly humbling.

I shall turn now to the business at hand: local government finance. With the fair funding review ongoing, this is an opportune moment to examine that subject, and I speak as someone with 22 years of local government experience. The economic shambles left behind by the previous Labour Government in 2010 obliged the incoming coalition Government to make significant reductions in public spending. It is true to say that local government has had to share a considerable portion of that burden, but careful management of the country’s finances over the past decade means that this Conservative Government are now able to address the long-term structural problems that the Blair and Brown Governments created.

Critically, there is now an opportunity to review historical baseline funding and to recalibrate it, with particular consideration being given to factors such as current population levels and future growth projections. A number of qualitative actions can also be taken, such as conferring greater flexibility on local authorities to raise and spend their own resources, as well as improving business rate retention. Most importantly of all, we need to recognise and reward those local authorities that have delivered high-quality public services while continuing to make efficiencies, such as my own excellent London Borough of Bromley.

The scale of the Conservative victory in Orpington on 12 December, with more than 63% of the vote, was a ringing endorsement of our campaign to “get Brexit done” so that we could move on to the people’s other priorities. In sending me here to represent them in this place, the people of Orpington have done me the greatest honour of my life. It is a great privilege to be here and I pledge to serve them, and my country, to the best of my ability in the years to come.
