It is a pleasure to serve under your chairmanship, Sir George. I congratulate the hon. Member for South East Cornwall (Mrs Murray) on bringing forward this important debate.

I will make a few points. With devolution re-established in Northern Ireland, the Minister will have a friend in Northern Ireland under the Ministry of Edwin Poots, who has a proven track record in dealing with environmental issues as a farmer himself and as a person who has dealt with the fishing community over the years. I hope that that leads to a good rapport between the Department here and the Department in Northern Ireland, because we require good partnerships between Westminster and the devolved regions to make sure that we get our act together and that fishing interests across the entire United Kingdom are properly and fairly met. That is absolutely essential.

Northern Ireland promotes evidence-based protection of our marine environment, side by side with a sustainable and profitable fishing industry, which can only be done when there is good co-operation between fishermen, producers and processors, industry leaders and advisers and the Department. It is essential that those good relationships are honed and developed.

In the Irish sea, 80% of the UK’s fishing effort comes from Northern Irish fishermen, who need to be treated fairly and allowed to continue to have a profitable industry. The fishing industry expects to be part of realising the full potential that Members rightly alluded to, and the opportunities that people say will exist with Brexit have to become tangible and meaningful. As with Norway 40 years ago, the EU will have to accept a diminution of the share of catches from EU waters, which means that catches for non-EU boats will have to be properly negotiated and shared out. We want to make sure that our fishermen’s rights are properly enforced and protected by our Government; that sovereign British waters remain sovereign British waters; and that we get the lion’s share of the catch in those waters.

The Irish election throws up a particular challenge for Northern Ireland. With Sinn Féin now the largest party in both parts of the island, will it defend the EU policy that annually loots Northern Ireland fishermen’s rights? Let us see if it actually protects the interests of fishermen in the Republic of Ireland against the rights of fishermen in Northern Ireland. That will be a huge challenge for Sinn Féin, and no doubt for the Minister whenever he negotiates arrangements and agreements between our nations. It will be interesting to see what side Sinn Féin falls on. I would not like to hazard a guess; I suspect I know, but let us wait and see what ultimately happens.

There are four or five key issues that the Minister has to address. Crews have already been alluded to by several Members, and I know he will want to speak on that. However, there is a challenge for the Government as to how they will apportion catch within the UK to UK regions. That is absolutely essential. Fishermen are waiting to know the plan, and trust that it will be fair and proportionate. While the crews issue needs to be finalised, remember that Northern Ireland stands on the frontline with the EU, in terms of its land border and its sea border, and it is therefore absolutely essential that Northern Ireland’s fishermen are given protections and the absolute right to fish our sea without being encumbered by threats from Ireland.

A 2018 Select Committee report mentioned that we need a proper processing hub and a new harbour at Kilkeel, and I encourage the Minister to deliver that. Finally, what plans do the Government have to manage catches of lobster, salmon, mussels, oysters and other crustaceans on the north coast for smaller fishermen?

The Secretary of State knows Northern Ireland well, so she will know that the big issue facing agriculture is farm incomes, which have fallen by 23% in the last two years. What assurance can she give to farmers listening in Northern Ireland tonight that the Bill will encourage an increase in both farm productivity and farm incomes?

My hon. Friend will appreciate that agriculture is a devolved matter, but the Government’s manifesto does commit us to maintain the same overall levels of support for our farmers in each year of the current Parliament. We do clearly recognise the importance of ensuring and securing prosperity in the farming community in Northern Ireland, and we will work closely with the Department of Agriculture, Environment and Rural Affairs on these matters in the weeks and months ahead.

We are going to put the broken system of the CAP firmly behind us. We are replacing it with an approach based on the principle of public money for public goods. We have committed in our manifesto to support that new approach with an overall level of funding to match 2019 levels for every year of the current Parliament. The Chancellor has already announced that the Government will provide £2.852 billion of direct payment support for the 2020 scheme year.

The objective of the Bill is a productive, profitable, resilient farming sector, empowered to produce more of the high-quality food that is prized around the world and appreciated so much here at home, all the while meeting the highest standards of food safety and traceability, animal health and welfare, and stewardship of the natural environment. Now more than ever before we need to recognise the vital importance of the work that farmers do because our climate is changing, because our ecosystems are under increasing pressure and because by the end of this decade 9 billion of us will share this planet.

I am sorry to hear that Labour wants to talk down British farming. The reality is that well-managed livestock production can provide important environmental benefits, including for biodiversity. I think we need a debate on livestock farming that reflects the facts, which include the fact that our livestock farmers are some of the most carbon-friendly in the world in the way they produce their products.

We know how vital it is to protect soil health. Soil is clearly one of our most precious national assets, and we have added it to the list of purposes underlying the schemes that we can pay for under the Bill. This is a direct response to the views expressed in this House about the previous version of the Bill. A further addition is to include in clause 1 the conservation of native breeds and plants, so that the species that sustained our ancestors are kept safe for future generations. Work is already well under way to prepare and implement these crucial reforms. Our environmental land management scheme is the cornerstone of our new agriculture policy. Extensive tests and trials are under way in different parts of the country. We will launch the ELM national pilot in England in late 2021, and the scheme will launch fully in 2024.

ELM will provide a powerful driver towards meeting the goal set out in our 25-year environment plan, which is to leave the environment in a better state than we found it. Getting ELM right is crucial for meeting our commitment to net-zero carbon emissions, and to meet the tough targets set out in our forthcoming Environment Bill. I emphasise that our goal is to design ELM schemes that work for farmers and land managers, and in which a very wide range of farmers and land managers can take part.

I welcome the points that the Secretary of State makes about protecting our environment, because without a good environment we cannot produce the good, tasty, and traceable food for which Britain and the United Kingdom are famous. Does she recognise that the UK currently imports 16% of its milk? Why can we not buy more British milk from British farmers and close that deficit?

I would encourage everyone to do that. We produce some of the finest food and drink in the world, and I encourage everyone to reflect that in their shopping habits.

We fully recognise the particular challenges faced by upland farmers—indeed, I discussed that issue just a few days ago with a group of farmers in Northumberland National Park. We are determined that ELM will also work for upland farmers, and the incredible work they do to safeguard our beautiful natural landscapes will put them in a strong position to take part in our environmental schemes.

I agree with the right hon. Gentleman: it is important to back British. Indeed, if he had been present, as many of us were, during debates on the Direct Payments to Farmers (Legislative Continuity) Act 2020, he would have heard my call for us to buy British, buy local, and especially buy food from the south-west, a region that I and the Farming Minister—the Minister of State, Department for Environment, Food and Rural Affairs, the hon. Member for Camborne and Redruth (George Eustice)—can be very proud of. Look for the red tractor, because it supports our local businesses and our country.

This issue is fundamental for the future. This is not just a minor amendment that can be put in place; it is fundamental to the direction that we are going in as a country and whether we leave the door open to cheap imported food that undermines our standards. That is why we have tabled this reasoned amendment. That is why it matters and why I am making this case today.

Another fellow west country MP—the recently re-elected Chair of the Environment, Food and Rural Affairs Committee, the hon. Member for Tiverton and Honiton (Neil Parish)—put it very succinctly:

“Imports produced to lower standards than ours pose a very real threat to UK agriculture. Without sufficient safeguards we could see British farmers significantly undermined while turning a blind eye to environmental degradation and poor animal welfare standards abroad.”

He proposed a very good amendment in the previous Parliament that won cross-party support, although sadly, not the support of his Front Benchers. He said:

“Our suggested amendment calls for agricultural goods to be imported into the UK only if the standards to which those goods were produced are as high as, or higher than, current UK standards.”

We could all get behind that.

I want to try to get my head around this: is the Opposition’s opposition to chlorinated chicken about chlorinating all foodstuffs? Every single lettuce grown in the United Kingdom is dipped in chlorine, so do they have a principled objection to using chlorine in foodstuffs, or is it just about Trump-bashing? [Interruption.]

A Member on the ministerial Bench says, “Tell us about the vegetables.” The important thing is to tell us about the standards and the produce. The hon. Gentleman raises a good point: some people in the House might not be familiar with all the agricultural practices that go into producing our food each day. The issue with chlorine-washed chicken is not the chlorine that washes the chicken—he is right that we chlorine-wash some of our vegetables in the UK that are on sale in supermarkets—but the reason why it needs to be chlorine-washed in the first place. That is because it frequently compensates for poor hygiene standards, such as dirty or crowded abattoirs, cages packed with birds, which would be unlawful in the UK, diseases and infections. The reason why the chicken is chlorine-washed, rather than the chlorine, is what is most concerning.

We cannot wash away poor animal welfare standards with swimming pool water. The realities of how the chicken was reared remain. Refusing to set out legal protections against that in the Bill leaves the door open to allowing such food into our food chains in future trade deals. Here is my challenge to the Secretary of State. She has heard, effectively, from both sides of the House—

It is a huge honour to follow a quartet of excellent maiden speeches from Members from across the House, each of whom has big shoes to fill and a big personality to match. My advice, as someone who has been there, is: be yourself, and you will do wonderfully well and be a big personality in your own right.

The Secretary of State was right when she said at the beginning of this debate that farming is a devolved matter in Northern Ireland. Therefore, some of the issues could be wrongly dismissed out of hand when we consider farming, its impact and what it means for the British mainland. Northern Ireland produces an awful lot of the food consumed on this side of the channel, so it is important that we have a joined-up approach to our agrifood matters. I am delighted that my colleague in the Northern Ireland Assembly Edwin Poots is the Minister for agrifoods and the environment there. I hope it will make a relationship with the Secretary of State easier because of the good connections and good support we have had from the current Government.

However, the Secretary of State and this Bill have to address the fears that too many farmers in Northern Ireland have about potential tariffs east-west, on the movement of foods, grains and other products from the British mainland to Northern Ireland. The potential for those tariffs creates a volatility in prices and has helped to drive down farm incomes in previous years. Those and threatened tariffs will only serve to do much more. This Bill is important, providing a new opportunity for agricultural product and agricultural payments that should be flexible, to meet the needs of the regions of the United Kingdom. I say that because the needs of Northern Ireland and what we produce will be different from those of Wales, Scotland or England. Therefore, these things must be flexible. They must address and support the primary producer where it matters most; help increase his or her sustainable productivity; help put money back into the pockets of our farmers; improve food security; and protect our naturally beautiful countryside.

In Northern Ireland, agriculture is king, with 75% of all its land being used for agriculture. It is used to produce meat, dairy and eggs, which account for 80% of our food output. In Northern Ireland and Ireland, animals use more land than is used to grow any crops, including indigenous products, such as potatoes. Therefore, it is essential to understand how important land and agricultural produce are in Northern Ireland; our turnover is £4.5 billion, employing one in eight people, which works out at more than 25,000 farm businesses in our country. That is threatened by volatility in the market. The big issue is that farm incomes have fallen by 23% in the past year and a half, from £467 million to £360 million in the past year.

I go back to the key point: the tariffs between Great Britain and Northern Ireland that could be introduced as a result of Brexit would drive that down further, which is why all the commitments made from the Dispatch Box about ensuring that those tariffs will be minimal or non-existent, and ensuring that things are frictionless, have to be met in reality, otherwise farmers will be put out of business in Northern Ireland. What will that do? It will help to destroy food security here in the United Kingdom. In Northern Ireland, we produce most of the milk consumed on this island. We produce some 73% of the beef consumed on this island. Do not destroy your food basket in Northern Ireland, and make sure that our products are protected by this Bill.

We export about 800 litres of milk a year to the Republic of Ireland, so we are also an export nation in food production. I have already given the figure for the amount of beef eaten in the United Kingdom. We want to produce so much more of that product, and if this Bill does anything to encourage agrifood production, to increase the opportunities for farmers to produce more, that will do more to sustain farming and increase farm incomes, and will address many of the problems and concerns people have about cheap food coming into the UK.

Agritech has been mentioned in the debate. I am sorry to get on to this subject, but in Northern Ireland every year 1.1 million tonnes of solid animal waste is produced. Its calorific value is 15 millijoules per kilogram. At the same time, Northern Ireland’s heating demand represents around 24,650 GWh. If we bring those two things together with agritech, we will be able to utilise that solid waste, which could account for around 20% of Northern Ireland’s heating need. There is a huge opportunity that has to be grasped, but how? Can the Bill support such innovative technology? Can it ensure that those who wish to get behind such technologies have the financial support to allow them to invest and create not only jobs but the opportunities that arise from addressing those needs? Of course, that would also give environmental support. As we all know—it has already been raised—phosphates are destroying much of our land and affect water pollution, which can also be addressed by agritech.

The needs I have described require investment, and the only way that we can do that is to ensure that the Bill really gets to the heart of it and addresses the needs of the primary producers, who care most about the environment because they work in it and need a good environment to make the best, tastiest food on these islands.

I absolutely agree with my right hon. Friend. The challenges in farming are certainly very different from the uplands to the lowlands and to the flat areas of some of the eastern counties, and we need schemes that reflect that without their being so overly complex that nobody knows which ones are right for them.

We have £3.5 billion, which comes in part from the UK Government budget and in part from the EU— although one should perhaps reflect on the fact that the EU money coming back to us was probably ours to start with. I have a few questions for the Minister. We have committed to keeping the budget the same in this Parliament. Is that the total budget that would have come from the UK Government and the EU, or is it just from the UK budget? It is likely that costs will increase over time—tractors and fertiliser become more expensive. Will the money come in the form of a cash budget, or will it increase in line with inflation over the next four years?

I also have a question about the currency. Today, €1 is worth 85 pence, but it might not be in September. Normally, the budget is set in euros and, in September, the currency is reviewed and the money for British farmers converted into pounds. This will affect our farmers’ costs and competitiveness, so if, in September, it looks like they will receive less as a result of the currency changes between now and then, will that be adjusted accordingly?

I understand that when the CAP is abolished under the withdrawal agreement payments to farmers will be exempt from state aid rules, provided they are equivalent to the CAP. How would the currency fluctuations affect that rule?

I wish now to look at the different types of payments that are made. As I have said, 80% goes broadly to acreage, but 10% of people get 50% of that money, and the smallest 20% of farms get only 2% of the money. This fact is often published in the media. Indeed, £2.8 million is given to farmers in Westminster when there are no farms in Westminster. This does make it a less popular scheme, and it makes it very difficult for new entrants to farming—people who want to be farmers but who were not born into a farming family—and creates an increase in the drive for size of farms. That is why I welcome the changes that the Government are making. Their new schemes will be much more sensitive, because they will look at what the farmer delivers rather than how much land the farmer owns. That is a much more positive scheme.

Many of my constituents write to me almost every day with their concerns about the environment. This is something that the country can really get behind. They want farmers to produce good food and they want the environment to be supported, so giving farmers money on the basis of what they do, rather than on how much land they have, is a very positive change. Indeed, 96% of farms are run by families—combinations of parent, child and grandparent—who see themselves as generational custodians of the land, rather than the owners of property. They also care about ensuring that the land is well looked after and that the environment is cared for so that it can be a profitable and productive farm, producing great food in the next generation.

I know that my farmers locally in Sleaford and North Hykeham welcome the Government’s scheme to produce clean air, clean water, quality soil, biodiverse habitat and a beautiful rural environment and to continue all those things. None the less, I do have a couple of points on this matter, too. The first is about size and complexity. At the moment, one criticism of the scheme is that the money goes to the very richest farmers. If there is a plethora of different schemes—we recognise from the contributions made so far that there needs to be different schemes for different types of farming—or if they are too difficult to understand, only the largest farms with an office full of staff, who are able to weigh up the pros and cons of different schemes, will be in a position to take advantage of them. Farms run by small family combinations, or even a solitary farmer, will find it much more difficult to work out which scheme will work for them.

That is also true of the design of the schemes. For example, one of the laudable aims of the Government is to increase the accessibility of the countryside to the public. However, that is much easier for a huge landowner who does not live on their farm to achieve than it is for a farmer who lives in a very small farm and who may be suffering from the effects of rural crime and not really want people coming through their farmyard.

I appreciate that the hon. Member has given way. She is making an absolutely excellent point about how these schemes work. I am sure that, like my farmers, farmers in her constituency will work out quite quickly which schemes benefit them the most. Does she agree that the key issue in this direct payments matter is to ensure a rebalancing of the relationship between the primary producer—the farmer—the supermarkets and the processors in between? If that relationship is right, farming really can flourish for all of our nation.

I thank the hon. Gentleman for his intervention. He is right that, for too long, farmers have not necessarily been treated fairly by all the supermarkets. The Groceries Code Adjudicator and some voluntary schemes by some of the supermarkets are improving the situation, but I do agree that there is still a long way to go to ensure that farmers receive a fair proportion of the reward for food production.

Will the Minister elaborate on what guidance and help will be available to smaller farmers to ensure that they can easily understand the scheme options, rather than having to go through lots of government papers?

Finally, I want to echo a couple of points that have been made on the multi-year settlements. Minette Batters, head of the National Farmers Union, and some Members in the Chamber today have talked about the importance of a multi-year settlement. This Bill does great things in ensuring that farmers know what they will get this year, but, as yet, although we know the size of the envelope, we do not know how the money will be targeted for the year after. When designing environmental schemes, I would encourage the Minister to design longer-term ones as far as possible, because if a farmer is to plant trees or plough up fields to create a meadow, they need to know that that will be there for a long time, and that they will not have to change it again, or be incentivised to plough that meadow up again in two years’ time.

The purpose of this Adjournment debate is to highlight the vital importance of the Lowestoft tidal flood barrier, which will provide much needed protection for many homes and businesses in Lowestoft. Moreover, it will act as a catalyst for inward investment in the offshore wind sector, the post-Brexit fishing industry and the town centre, where the high street is under considerable pressure at present and businesses need reassurance that their investments will not be at risk from flooding.

East Suffolk Council has prepared a flood risk management project, which includes the barrier in the outer harbour. At present, the project is only partially funded and while work will be starting this year, the outstanding money needs to be secured so that the project can be completed in its entirety and it delivers its full benefits to the UK’s most easterly town, which has been exposed to the worst excesses of the North sea for far too long.

It is appropriate that this debate is taking place at the beginning of the Environment Agency’s Flood Action Week. At the outset, I shall provide the national context. It is good news that in the Conservative manifesto at the December election and in the subsequent Queen’s Speech, which we have just concluded debating, the Government have committed an additional £40 billion to flood defences.

The National Infrastructure Commission has highlighted that this investment is badly needed. It points out that over 5 million homes in Britain are at risk of flooding and coastal erosion; management of floods in the past has been short term and reactive, rather than preventive; and while the six-year capital programme to 2020-21 has provided certainty on funding for the issue of floods, there remains no clear long-term objective for flood resilience and defence. It makes a variety of recommendations for how the situation can be improved. First, it proposes a national standard so that by 2050 we can be sure that communities are resilient to flooding for 99.5% of the time whenever feasible.

As the hon. Member knows, he is my brother’s Member of Parliament, and this is an issue that affects him. I understand that one of the key questions is whether there are predictions of tidal surge in the area. If there are, how devastating an impact could they have on his constituency, and indeed my brother’s home?

I am grateful to the hon. Member for raising that issue; it is one I will come on to. The tidal surge in 2013 gave a clear indication of what could happen in a worst-case scenario and we need to put in place measures to avoid that devastation to people’s lives.

I beg to move,

That the draft Animal Health, Seed Potatoes and Food (Amendment) (Northern Ireland) (EU Exit) Regulations 2019, which were laid before this House on 3 April, be approved.

Let me first echo the points that were made during the last debate, not least by the right hon. Member for Lagan Valley (Sir Jeffrey M. Donaldson). I too would much prefer decisions of this type to be made by a functioning democratic Executive in Stormont.

This is one of a number of affirmative procedure statutory instruments to be considered as the United Kingdom leaves the European Union. It will ensure that legislation concerning the control of salmonella in the poultry sector, beef and veal labelling, and seed potato inspections and marketing will continue to function in Northern Ireland after exit.

Did the Minister speak to the companies that process potatoes in Northern Ireland? The two main processors are Glens of Antrim Potatoes Ltd, which is in my constituency, and Wilson’s Country Ltd. It is essential for them to know that this is going to happen, and that their interests have been taken into consideration.

The hon. Gentleman is right: the potato processing sector is very important. Seed potato production in Northern Ireland is worth about £2 million a year. Ware potatoes are not grown solely for ware, but are also a by-product of seed potato production. Potatoes that are too big to use for seed purposes go into the ware market, which is worth £20 million, but the processing will value-add £200 million. In Scarborough, in my constituency, McCain Foods processes potatoes and slices 1,000 tonnes per day. The processing sector is vital, not least because of the employment that it provides not just for UK citizens but for EU citizens who come here to work in the sector.

Does the Minister realise that the scale of potato production on the British mainland is so much more vast than it is in Northern Ireland? In fact, one processing line in England could probably take over the entire capacity of the Northern Irish processers. They have to be protected; otherwise, we will see our potato industry in Northern Ireland diminished.

The hon. Gentleman makes another very valid point. That is why it is so important that we get this piece of legislation through to enable the current situation to continue.

Northern Ireland people are keen to support the crisps produced locally in Northern Ireland. If I may, I will also just touch on Comber new potatoes. They are renowned throughout Northern Ireland, which grows the variety Maris Piper in the main. They are a protected designation of potato, and I gather that they are grown in the constituency of the hon. Member for Strangford (Jim Shannon). That is another important part of the Northern Ireland potato market.

This legislation is important for the protection of human, animal and plant health and for maintaining important safeguards to ensure food safety information for consumers. The Government can easily ensure the maintenance of such safeguards by agreeing with Labour that there should be a permanent and comprehensive UK-EU customs union, close alignment with the single market, dynamic alignment on rights and protections, and clear commitments on participation in EU agencies. That would ensure that we continue to share knowledge and expertise with EU bodies, avoiding extra costs and burdens for business, saving jobs and protecting our livestock, trees and plants from pests and diseases.

This statutory instrument is another in the series of Department for Environment, Food and Rural Affairs EU exit SIs, of which there have been over 120 to date, using powers in the European Union (Withdrawal) Act 2018 to make technical changes to retained EU and domestic legislation. This SI covers salmonella in poultry, labelling of beef and veal, and seed potato marketing, all of which are devolved matters for Northern Ireland, and it is a real shame that there is no functioning Northern Ireland Assembly to scrutinise it.

Labour believes that it is vital that we maintain protections for imported eggs and poultry food products. Despite the discreditable chlorinating process that is supposed to prevent infection, citizens in the US still suffer around 1.2 million cases of salmonella food poisoning a year, and there were 450 deaths last year. What is the current assessment of the level of risk of salmonella in poultry in Northern Ireland? What assessment has been made of the level of risk of salmonella in eggs and poultry food products expected to be imported into Northern Ireland after the UK leaves the EU?

Northern Irish seed potatoes are highly prized and commercially valuable, so it is important to maintain the EU classification and certification regime and protect them from imports that might be of inferior quality or bring in pests and diseases. Similarly, the high quality of Northern Irish beef needs continuing protection via the EU labelling regulations.

The hon. Gentleman will appreciate that Northern Ireland processes about 2.6 million birds every week. The poultry industry is one of our most vital and supplies about 30% of the entire UK market. Protecting the sector is much more important to our farmers and processors than anything else, and we do not want to implement anything that would damage our local UK market.

I thank the hon. Gentleman for his strong point. Clearly, where the major market is within the UK, that needs to be protected. However, there is always the danger not just that other markets will be lost, but that the UK market may be lost if inferior and cheaper poultry were able to be imported into the UK. The protection of good-quality food from the EU is one of the major planks that it has operated and this SI is an attempt to try to salvage some of that, but whether it will be successful largely depends on all sorts of other issues.

The succession of different versions of this statutory instrument, each with errors and omissions, does not inspire confidence. Despite now being on its fourth version, there may still be an error in regulation 9(b), which amends regulation 4(3)(b) of the Seed Potatoes Regulations (Northern Ireland) 2016. Can the Minister confirm that the substitute wording should have two “where”s, rather than one “where” and one “were”? It is a minor point but, with the vast amount of work being done on all these SIs over a very short period of time, there have been grammatical errors that might lead to them being difficult to enforce.

Why was Regulation (EC) No. 2160/2003 not included in the three Northern Ireland poultry salmonella orders referred to in regulations 2, 3 and 4 when they were originally made? Numerous changes have been made between the four different versions of this SI that have been presented to Parliament so far. Can the Minister explain whether there is any significance and why the wording of regulation 8(f) and (g) in the previous version has been omitted, why the reference to point A7 of annex III was added to proposed new paragraph (b)(iii) of regulation 2 of the Seed Potatoes Regulations (Northern Ireland) 2016 and why the wording in regulation 9(a) and (c) was omitted in this version? Various changes have been made, and it is extremely difficult to follow them and to work out why they have been made. Will the Minister commit to correcting any errors that are identified and to ensuring Parliament has the opportunity to consider how stakeholders can be better engaged in the scrutiny of secondary legislation in future, as suggested by Green Alliance?

After 120 different statutory instruments over the past three months, I put on record my admiration for the stupendous amount of hard work done by civil servants in producing all this necessary work, and I crave the Minister’s indulgence in also registering my profound thanks, and the profound thanks of my hon. Friends, to our Opposition staff for their enormous work in preparing us for these statutory instruments. In particular, I thank Roxanne Mashari, Rob Wakely, Will Murray and Eliot Andersen.

We take all these matters extremely seriously and intend to do everything we can to maintain and enhance this country’s record of high standards and scientific excellence as we prepare to leave the EU. I hope the Minister will respond seriously on the matters I have raised. Having said that, we do not intend to vote against the regulations on this occasion.

I have a few points to add to what has already been said in this important debate. I commend the Department for bringing forward these regulations and for being on top of it.

The hon. Member for Ipswich (Sandy Martin) spoke about the issue of scrutiny, and of course we would prefer all these matters to be taken through the Northern Ireland Assembly. I used to chair the Assembly’s agriculture committee, and this place has probably given the seed potatoes bit of these regulations just as much scrutiny as they got from the Northern Ireland Assembly, so the House should not take as punishment the criticism that seed potatoes are not getting enough scrutiny tonight. It is usually just two or three Members who care about these issues when they are addressed in the Northern Ireland Assembly. That is not to shirk the responsibility we would like the Assembly to have once again for these matters.

Northern Ireland produces the best, the tastiest and the most traceable food in all the United Kingdom. It is what we are expert in doing, and any Member who visits Northern Ireland, whether they are drinking liquids from Northern Ireland—Coca-Cola, of course—or indulging in our best food, knows we produce really good food. It is in all our interests to make sure that our primary industry is protected and assisted at this time of immense, radical change.

Yes. The Minister makes a key point. Perhaps there is less familiarity with some of the other species that we export, and export very valuably, to the EU markets.

Let me return to the point about tariffs, which we touched on. There was the publication this morning that referred to 11.9% on protected lines. That is the most preferred nation rate. It is what, in the event of no deal, we will be trading on. Can the Minister explain that in greater detail? The information came out only this morning. I have gone to various sources, including the Library, to try to get more detail about exactly which species will be affected and how, but perhaps the Minister can put that on the record here today. If he cannot do so, will there be a ministerial written statement to explain the implications of the tariffs and what they mean for the UK sector?

We are in a fortunate position, in that the Minister’s predecessor set a very positive tone from the start of the negotiations to leave the EU. I expect that tone to continue under this Minister. He is a very reasonable gentleman, and I expect him to recognise, in the same interest of standing up for the UK fishing sector, that an unnecessarily aggressive approach is not one that he should take. I do not think that there is any desire on either side to start so-called tariff wars. There is a mutually beneficial industry. The common fisheries policy may continue to be a bone of contention, but in more recent years the relationship has improved, and the changes that have been made in the CFP have struck a good balance between the environment and the catching sector. I hope that that will continue, so I hope that the scenario that the hon. Member for North Antrim (Ian Paisley) highlights and perhaps foresees does not come to pass. That would not be in anybody’s best interests.

It is a pleasure to serve under your chairmanship, Mr Stringer. It is always an honour to follow the hon. Member for Waveney (Peter Aldous), who is well known for his knowledge of these matters. As he knows, I have family connections to Lowestoft, and it is good to hear him.

The Minister was a member of the Select Committee on Northern Ireland Affairs and had the honour of visiting Northern Ireland on many occasions during that time. He of course visited Portavogie and other ports, and met fishermen there; he was a keen Committee member. We prepared a report on fisheries in Northern Ireland, and the conclusions and recommendations were welcomed by the fishing industry there, as he will know. Unfortunately, however, the Committee and industry have still not received a substantive response to the report from the Government. Now that the Minister is effectively a poacher turned gamekeeper, perhaps when he is in the Department he could rustle up a powerful and positive response to it, to ensure that the industry and indeed the Committee is better informed about Government thinking on the key issues we identified. The report recorded the enormous potential that Brexit offers the industry in Northern Ireland. The common fisheries policy has had a detrimental impact there, and we want to rectify that—something that the industry looks forward to.

The United Kingdom has previously stated its intention of leaving procedures for importing seafood unchanged. Today that has been reinforced by the Government’s announcement of no tariffs on produce entering Northern Ireland from the Republic. Clearly that must be reciprocated by Dublin and the EU. Otherwise, as I said in an intervention, it is the Republic of Ireland that stands to lose more in a tariff war with the rest of the United Kingdom, given its dependence on British sea waters. No one wants that; we want to be good neighbours to the Republic of Ireland, and we have been good neighbours. However, it is important that people recognise that the hard border in Northern Ireland is actually a hard sea border, where the fishermen of the Republic of Ireland have denied access to our fishermen. That has to be rectified. I wait with interest to see whether an amendment going through the Irish Parliament in Dublin will rectify the situation and ensure that the reciprocal voisinage agreement once again operates fairly for our fishermen in Northern Ireland.

Our report came out in December, at which time the Minister for Immigration would have been aware of the issues that affect the Minister’s constituency in this regard. The Minister met fishing representatives in Northern Ireland, and heard that among the issues that affect them is the fact that Whitby Seafoods, based in his constituency and employing 250 people in Kilkeel in Northern Ireland, needs to maintain supplies of raw material to its factories. Without crews, one of the trawlers is clearly going to stop operating. Over two years and longer, there has been no resolution, although, interestingly, owners will shortly pay Her Majesty’s Revenue and Customs tax for their crew who are not from the European economic area. That seems a little ironic given what a grey area the question of status in the United Kingdom is.

We look forward to those issues being resolved by a Minister who had his hands on the issues while in other service. I hope that the concerns of people who raise the harvest from the sea will be identified appropriately and resolved to our satisfaction.

We will be taking part in bilateral and multilateral negotiations in the run-up to December 2020, in anticipation of being, as I have said, a fully independent coastal state from January 2021. We will be negotiating with all our neighbours to ensure that we get the very best deal for our fishermen. On the right hon. Gentleman’s second point, which was very fair, about collaboration with fishing organisations, in preparing the Bill we have worked with the Scottish Fishermen’s Federation, the National Federation of Fishermen’s Organisations and a variety of other producer organisations, and every single one of them has said that it wants to see the Bill on the statute book. Of course there will be debate in Committee, and there may well be amendments that can refine and improve what we want to do, but there is not a single representative organisation that speaks for the fisheries industry or for fish processors anywhere that does not want to see the Bill on the statute book as quickly as possible.

The one fly in the ointment is, of course, the elephant in the room: the withdrawal deal that the Prime Minister has produced in recent weeks. Can the Secretary of State confirm that article 6(2) of the protocol relating to Northern Ireland could be interpreted to read that every EU fisheries regulation in existence will continue to be applied to Northern Ireland fishermen alone if the backstop is applied?

I do not believe that is the right interpretation. I do recognise that a number of colleagues across the House have concerns about the backstop arrangement, but let me underline one point. Under the backstop arrangement, were it ever to come into place, the United Kingdom would be an independent coastal state. Some people have read the withdrawal agreement and taken it to mean that somehow the common fisheries policy would be extended if the backstop were to come into operation and that we would not have control over our territorial waters and our exclusive economic zone. That is not the case. Even in the event of the backstop coming into operation, we will be an independent coastal state, and fishermen, whether they are in Northern Ireland or anywhere else in the United Kingdom, will be able to take advantage of the additional fishing opportunities that arise as a result.

It is an honour to follow my friend the right hon. Member for Witham (Priti Patel) in this important debate. As Members have said, this is the first time in over 40 years that the House has considered primary legislation on what is one of our most important industries. While some Members might be churlish and blame the Conservatives for taking us into the CFP, the fact of the matter is that I hope they take us out properly, and get us out totally, completely and absolutely—free, unfettered and unbowed, with a new policy for our fishing industry once and for all. Little wonder there have been waves across the Chamber because of the excitement of our getting out of the European Union. The only reason why we are having this debate is that the people of this United Kingdom took a decision—“It’s time to leave.” I hope that the Bill honours that decision by over 17 million people and that we will leave the EU and do so properly. I look forward to that.

Those member states that wish to stay with the common fisheries policy and to be supplicant to the EU should consider their priorities. My nearest neighbour, the Republic of Ireland, takes 40% of its total allowable catch from our British waters and is further dependent for processing on British trawlers that have landed their catches from the seas of Northern Ireland.

Will the hon. Gentleman accept that I, as the Member for Argyll and Bute—a constituency that overwhelmingly voted to remain in the EU—am indeed listening to my constituents when I stand up and fight for their right to remain in at least the single market and the customs union?

I have no doubt that the hon. Gentleman represents his constituents in the way he wishes, and does so valiantly. He is of course entitled to do that and to have a different opinion on this matter, but we do have to leave the EU.

I want to address the issue of how the Irish Republic currently treats its neighbour, Northern Ireland. We have the voisinage agreement, which has not been raised today. It disgusts me that the Republic of Ireland keeps talking about not wanting a hard border in Northern Ireland and says that that would be a disgrace, yet has created what is effectively a hard border for County Down fishermen by breaking the voisinage agreement time and again. How is the Irish Republic going to treat Spanish fishermen when they are not allowed to fish in British seas after we leave the EU? How is it going to treat people from other member states? If it treats them in the way it has treated the people of Northern Ireland, those fishermen will feel a hard border within Europe also.

The Prime Minister talks about taking back control of our fishing, yet for the last two years, the Republic of Ireland has reneged on that agreement. We could have taken back at least that bit of control by saying, “Sorry, we’re not going to let your fishermen come into our area,” but the Government have not done so.

I thank the hon. Lady for making that point. We all know why the Republic of Ireland has decided to have this debate about the hard border: it has taken away from its having to address the important, hard questions that it should have been considering, such as what sort of trade relationship it should have with its biggest trading partner, the United Kingdom of Great Britain and Northern Ireland. It did not want to address that matter; it wanted to hide behind the issue of the hard border to confuse things and camouflage the real, important issue.

I raise that matter because according to the European Union’s most recent report on fishing and agriculture, if the Republic of Ireland does not get a trade agreement with the United Kingdom, it will lose a staggering €5.5 billion from its agri-food and fishing industry. It has been reported that the study

“prepared for the European Parliament’s Committee on Agriculture and Rural Development lays bare the full potential impact of a hard Brexit and singles out the Ireland as one of the most badly hit member states.”

Yet what has that member state done? Has it tried to help in this? Has it tried to make the voisinage agreement work? No, it has done everything to penalise Ulster fishermen and Ulster farmers, and it should be ashamed of how it has behaved.

I hope that that sends the message to the Spanish and the French that that is how the Republic of Ireland is going to treat them, and about what sort of hard border it will have when it suits it. Little wonder that we have had so many problems with the Republic of Ireland over the past two years during this negotiating period.

The Fisheries Bill should lead to a revival of our coastal towns, as we have heard from across the Chamber today, and I hope that it really does. There is one way in which we could achieve that, and I appeal to the Secretary of State and the Minister to do this. During the transition period, will they use every effort possible, and every investment opportunity available, to invest in our coastal towns and put them in a state of preparedness by increasing their production ability and improving their harbours? I hope that we can do the same for Scotland as well. It is critical that we have harbours across our nation that are able to land the catches that will be available to us and that we have processing industries in place from Argyll and Bute in Scotland to Portavogie and Kilkeel. All those things should be put in place, and we can do that only during the transition period. If we are not ready then, we will not be ready when we leave the transition period. I hope that we actually do this.

There is a fear that the withdrawal agreement, the Fisheries Bill and the transition period, when they are taken together, all mean different things to different folk at different times. As the right hon. Member for Witham said, we need clarity in this debate. We have heard something of that today from the Secretary of State, but we need to hear more. We also need to ensure that all these things dovetail properly so that our fishermen receive the clarity of language and meaning that they are entitled to. We have already heard some discussion about whether article 6(2) actually means what it says. Will it, for example, penalise our fishermen if a backstop is brought into place? I believe that it will, although the Minister assures me that it will not. We need more certainty on that point. If the Secretary of State were a lawyer, he would not be recommending article 6(2) to a client, and if it will penalise our fishermen, we should not be accepting it for one of our key industries in Northern Ireland.

The Bill fails to account for crew shortages. The immigration White Paper is not yet ready, and we will be able to make sense of this matter only when we get that White Paper. I hope that we will hear words today that will address that issue and that we will know sooner rather than later what the immigration White Paper will say about addressing the key matter of crew shortages. In addition, Northern Ireland demands fairness in how it is treated in the sharing out of quotas between Scotland, Northern Ireland, England and Wales. It is essential that we get that fairness; otherwise, it could be catastrophic for how we behave internally as a nation.

I also regret that the Bill does not refer to an advisory council to help with management. Such bodies have proved most beneficial in Norway and Australia. There is also the key issue of our Crown dependencies. The European Union is able to take fish freely from the seas around our Crown dependencies, and we need to ensure that we have some sort of an agreement with Crown dependencies such as the Isle of Man and the Channel Islands. Finally, I pay tribute to the Minister as he prepares for his penultimate or final December Fisheries Council meeting. I wish him all the very best as he wishes bon voyage to Europe.

It is always a pleasure to speak in any fishing debate, as I have done every year that I have been in the House. I would like to begin by thanking the pre-legislative scrutiny Committee for the incredible work it has put into the Bill. It was a pleasure to work on submissions to the inquiry, as a member of the Northern Ireland Affairs Committee, and to have the Committee over to Northern Ireland to see at first hand the success and the needs of the industry in Portavogie in my constituency. I was also pleased to have input from Ardglass and Kilkeel, and I am pleased to see a representative from the Anglo North Irish Fish Producers Organisation in the Gallery, to oversee what we are saying.

I have been contacted by a number of fishermen and fishing bodies, and all have welcomed certain aspects of the Bill, such as the powers for the UK to set quotas and control access over who may fish in UK waters and under what conditions, the expectation of bilateral agreements with the EU, Norway and others with which it shares stocks and the Secretary of State in a position to endorse the content of those agreements. It is important to get that right.

It is also important to ensure that the principle of equal access is upheld when issuing any additional quota gained from leaving the EU. It is essential for Northern Ireland that quota is allocated according to individual vessels active in the fishery or by existing fixed quota allocations. While there is support for the principle of equal access for UK vessels to operate in any of the waters within the UK exclusive economic zone, there is some concern that these freedoms could be compromised if devolved Administrations introduce their own separate measures. Other Members have said that, and I want to reinforce it.

I would like to briefly talk about clause 10. I would add that all licences granted under the authority of the Bill—in other words, those issued from the date of the Act coming into force onwards—are non-transferable. I am an advocate of reviewing the licence system, and I believe that it would be a mistake for us to fail to close the loophole that caused massive issues to begin with.

The Bill sets ambitions and measures to minimise discards. The National Federation of Fishermen’s Organisations is one body that contacted me to highlight the belief that reducing discards is an important element of sustainable fisheries management, and it is pleased to see the Government taking a positive and workable approach. Much good work has been done. The Government should establish a formal advisory council to guide policy, promote collaboration between central Government, devolved Administrations and the industry and allow for ongoing dialogue in a naturally variable industry.

It is understandable that the Bill refers to maximum sustainable yields as an approach to sustainable fisheries management. However, if MSY is set as a rigid timebound objective, it will, as with the CFP, prove unworkable. Instead, the UK must develop an approach to sustainable fisheries management that learns from the failings of the CFP. The NFFO is calling for a more balanced and workable approach, with oversight from the advisory council, and I concur with that.

There is still nothing in the Bill to address the access to labour issues. The natural counter-argument is that labour is outside the scope of the Bill, but it is in fact a critical pillar of the sustainability objective. I believe we can and must address that matter through the Bill, and an amendment can and should be tabled to incorporate access to labour.

I see the Minister in his place, and just for the record, he and I have had discussions on various occasions about the voisinage agreement, which my hon. Friend the Member for North Antrim (Ian Paisley) mentioned earlier. We have brought it up on every occasion we have met in this House, and in our meetings the voisinage agreement has been at the forefront of my mind and of his. He has told us in the past that it is his intention to pursue this legal matter through the courts and to ensure the waters covered by the voisinage agreement that belong to the United Kingdom of Great Britain and Northern Ireland are returned. Will the Minister respond to that in a very positive way?

In my last minute, I want to quote the words of a constituent:

“Setting aside the complex and controversial questions surrounding parliamentary approval for the withdrawal agreement, much still hinges on the negotiations ahead. The UK’s legal status has altered and its leverage in fisheries negotiations has dramatically changed but unless that new status is used to address the gross distortions in quota shares, fishermen will question what it has all been for.”

My constituent says there are

“many examples of where the UK has been systematically disadvantaged by the CFP over 40 years. To deliver the fair share of fishing opportunities”,

all the fishermen of the United Kingdom of Great Britain and Northern Ireland

“in this second round, will expect our negotiators”—

we look to those who will be responsible for this—

My hon. Friend raises an important issue. One thing that we hope to be able to do is to use additional quota, which we can allocate to UK vessels to help deal with that particular challenge. It is also the case that the White Paper includes proposals, which we hope will make it easier for individual fishermen who catch over quota to be able to land all the fish that they have caught in a way that ensures that we can have environmentally effective management. We look forward to responses from the industry to our proposals.

I thank the Secretary of State for producing this paper and thank him especially for meeting the fishermen and the industry in Northern Ireland, ensuring that some of the points that they raised are reflected in this White Paper. That is a positive message. In his recent meeting with Minister Creed, did he discuss voisinage agreements, or good neighbour agreements, with the Republic of Ireland? Did he take the opportunity to remind the Republic of Ireland that a good deal for us with Europe will mean a good deal for the Republic of Ireland in our sea fisheries waters?

It is a pleasure to serve under your chairmanship, Mr Paisley. I congratulate my hon. Friend the Member for North Cornwall (Scott Mann) on securing this debate.

Lowestoft in my constituency was previously the fishing capital of the southern North sea; today it is a pale shadow of its former self. Brexit provides an opportunity to revitalise fishing off the East Anglian coast, and to maximise the economic and social benefits that the industry can bring to local communities and businesses in ports such as Lowestoft. I shall briefly outline the three ingredients required to bring about this renaissance, for which the forthcoming fisheries Bill must provide.

First, East Anglian fisherman must be given the opportunity to catch more fish. The region’s catch sector predominantly comprises the inshore fleet which, as has been well documented, does not get a fair slice of the cake. Moreover, we suffer from the worst excesses of the flagship debacle, with six vessels of the Lowestoft Fish Producers Organisation never coming near the port and landing their catches in the Netherlands and in Peterhead.

If the quota system is to continue, we need a radical reallocation in favour of locally based fisherman, so that they can earn a fair living and the full benefit of their hard work, often carried out in extremely harsh conditions, can be secured for the ports and communities in which they live and work. Secondly, going hand in hand with landing more fish in East Anglian ports, we need to invest in the infrastructure, skills and supply-chain businesses in those ports and the surrounding areas. While in many respects it is surprising how much of this supporting sector remains in Lowestoft and other East Anglian ports, my concern is that it does not have the capacity to cope with a significant increase in landing. The European Maritime and Fisheries Fund runs until 2020. Beyond that date it is necessary for the Government to assess the likely needs of the industry on a regional basis, then make the necessary funds available for a wide range of projects.

The research work to establish what is needed in East Anglia is now under way. The level of funding should at least match the current EU structural funds for fishing. It represents a good investment in UK plc. It will secure a good deal for coastal communities, providing a more diverse and secure economic base. It will help to rebalance the national economy in favour of areas that have suffered a great deal in recent decades. Finally, it is necessary to put in place a management system that has the full confidence and respect of all those working in the industry. This system must be based on science and it should be local, sustainable and collaborative.

In conclusion, we have a great opportunity to revitalise a uniquely British industry for the benefit of local communities that feel that they have been dispossessed and ignored for too long. This task will not be easy, as the industry differs in its make-up and needs around the country. We require a national policy framework that has the flexibility to respond to different demands, so as to allow the industry to flourish locally, all around the UK coast. I look forward to welcoming the Minister to Lowestoft next month, so that he can set out his vision for this national framework, and so that locally we can set about the task of providing that local plan that will enable the industry again to play a leading role in the East Anglian coastal economy.

I refer the right hon. Gentleman to the opening speech, where we had a nuanced approach. That will be in the discussions. Access to markets will be important for our fish, but having control of our waters is incredibly important. The Government will have to strike that balance as they go into the negotiations, which is what we are reflecting on today.

In contrast, the Conservative Government have moved from saying that they want trade with the EU after Brexit to be tariff-free to saying that they want trade to be as tariff-free as possible. It is starting to feel as though we are moving only backwards against the Government’s, if not the leave campaign’s, initial bold assertions for a post-Brexit fisheries policy.

It is reassuring that there is firm common ground between the fishing industry, conservationists, recreational fishers and consumers alike that a sustainable approach to a new fishing policy is the only game in town. That was the theme running through a fisheries discussion of experts that I chaired on behalf of the Parliamentary Office of Science and Technology just last week. For a sustainable approach to work, however, we need two things if we are to have confidence in managing fish stocks responsibly. We need a means of robustly enforcing our approach, and we need to get the science right. Those two things have been mentioned in the debate today, and I am sure they will be considerations for the Minister in the coming weeks and months.

There is renewed public awareness of the need for action to preserve our marine environments—a point made passionately by the right hon. Member for Newbury (Richard Benyon). I am hopeful that consumer movements will play an important role in reducing the plastic waste in our waters. The success of the Marine Stewardship Council certifications shows how environmentally aware consumers can bring about positive change. However, we will need Government action to prevent plastics and protect marine environments.

Labour are proud of our record in government and of introducing the Marine and Coastal Access Act 2009. We included bold commitments in our manifesto ahead of last year’s general election. We support the blue belt proposals for our overseas territories, and our recently released animal welfare plan announced a consultation on the creation of national marine parks. I hope that those matters will not be overlooked as the negotiations on the future of the UK’s fisheries policy move forward.

Marine protection and fisheries management, as we have already heard, are two sides of the same coin. If we get it right and set the standard both domestically and in our waters around the world, we can secure a flourishing marine environment and a strong and profitable fisheries sector. However, on many of the biggest questions faced by the fisheries sector, hopes are high, but we are still in the dark on much of the detail. There are plenty of opportunities for our fishermen and women and our coastal communities as we leave the EU, but what we desperately need from this Government is the road map, outlining just how we deliver against those opportunities.

I have raised with the Department for International Development on number of occasions the need to help Christians return to their ancient homeland. I can tell my right hon. Friend that the Nineveh Reconstruction Committee, which is a collaboration between the Chaldean Church, the Syrian Catholic Church and the Syrian Orthodox Church, has so far restored 1,700 properties, enabling just over 4,700 Christian families to return home.

Next week marks the 500th anniversary of the Reformation. What is the Church doing to promote and celebrate an event that led to major religious and social freedom in this nation?

There are already a number of events to mark the Reformation. Indeed, you can hardly fail to turn on the radio without hearing about the commemoration of this great occasion. However, in the spirit of the question, I want to share with the House something that a Minister of State said yesterday at the reception in the Speaker’s house: “It is incumbent on us all—all of us of faith and those of no faith—to speak up for the tolerance to hear each other.”
