I beg to move,

That this House has considered reopening the Stoke-Leek line.

Or, as I like to call it, the Leek-Stoke line.

This is a first for me. It is an honour to serve under your chairmanship, Mr Paisley. I know you are an impeccable Chair and your timing is even more impeccable, so I am delighted to serve under you. I am not sure whether you have visited the Staffordshire Moorlands. It is very much like the constituency that you represent—a beautiful rural area. It has amazing scenery, lots of great dairy farms, which you will understand, and some great tourist attractions, although, unlike the Giant’s Causeway, we have Alton Towers.

Many people come to visit the Staffordshire Moorlands. They come to see our amazing scenery. The Roaches, for example, is a place that people travel to from all over the world to do rock climbing and just to observe the views; from there it is possible to see lots of different counties—I think I once counted 16 of them—and all the way to Snowdonia. We cannot quite see the Isle of Man or Northern Ireland, but we can see into Wales.

We have the Manifold Valley, the beautiful Thor’s Cave, and a bit of Dovedale, which is also one of the great tourist attractions. As well as Alton Towers, we have the Peak Wildlife Park and Biddulph Grange Garden—beautiful places that people come to visit. We have amazing hospitality venues such as the Lazy Trout in Meerbrook, the Yew Tree at Cauldon, the Stafford Arms at Bagnall, and the Auctioneers—a community-run pub in Caverswall that I helped the community to buy and is a fantastic place to visit. We have wonderful independent shops in all our towns and villages, but in Leek we are very proud of our “Totally Locally” campaign and our local markets. We have a heritage railway in the Churnet Valley railway. We have so much to offer.

The question one might ask when looking at the map and seeing those wonderful attractions is, “How on earth can I get there?” I am afraid to say that unless someone has a car it is a struggle. Last summer—we are seeing it again at the moment—the villages of the Staffordshire Moorlands were totally overwhelmed with traffic; we got to the point where emergency vehicles could not get through. Villagers felt like prisoners in their own homes because of the cars that were parked, and there is simply no other way to visit the Moorlands than by car.

We have a fantastic mainline station only a few miles away in Stoke-on-Trent; the same line runs on to Macclesfield, of course. The train from Euston to Stoke takes one hour and 24 minutes when we are not on a reduced timetable as we are at the moment. If I can make a plea to Avanti rail: we need two trains an hour to Stoke-on-Trent as soon as possible, because it really is not working at the moment with only one an hour.

We have some buses, but I am afraid they are an endangered species. They are very difficult to find. If someone does find a bus, they might be able to travel into the Moorlands, but it is not easy. If someone gets to Stoke train station with a view to visiting Alton Towers, which puts on special buses, or the Roaches, the Manifold Valley or any of the other great attractions, they find that the only way to get public transport is to walk about a mile and a half to Hanley where the bus station is—because, of course, the bus station is not in the same place as the train station in Stoke-on-Trent. That person would then have to wait for a bus that is usually hourly. Perhaps they might be lucky and the buses might be every half hour, but it is not easy and it takes a significant amount of time to get to the Staffordshire Moorlands.

Even if someone can get to Stoke-on-Trent station by taking a taxi or finding a very amenable friend to give them a lift, to get from the station to Leek—which is where I live: the centre of the constituency—they could drive along the main Leek road, which is the A52, the A5009 and the A53. To do so means travelling through the constituencies of my hon. Friends the Members for Stoke-on-Trent Central (Jo Gideon) and for Stoke-on-Trent North (Jonathan Gullis) before reaching the Staffordshire Moorlands.

This route passes through some amazing parts of the city: Joiners Square, Abbey Hulton, Milton, then entering Stockton Brook and then on through Endon, Longsdon, and finally into Leek. The problem is that it is a single-lane carriageway. Actually, there is not a dual carriageway anywhere in the Staffordshire Moorlands constituency. One cannot legally go faster than 60 miles an hour, even though some motorcyclists believe otherwise. It is a genuinely beautiful route, which runs along a disused railway line. It is absolutely stunning, but it is a very slow road.

Alternatively, there is the A520, taking a route through the constituency of my hon. Friend the Member for Stoke-on-Trent South (Jack Brereton) and then on to the Moorlands. That goes through Fenton and Longton, Weston Coyney and Meir, to Cellarhead, Wetley Rocks, Cheddleton, Leekbrook and then into Leek. All of these places are beautiful, ancient villages; they do not have capacity to make the road any wider. On visiting Wetley Rocks, one discovers it really is rocks, driving along the edge of the cliff, so there is nowhere to go to extend that road.

So I ask: what can we do? If you are lucky, Mr Paisley, you might find you could get off the train at Stoke and I would be waiting for you with my car, because I would be delighted to give you a lift to Leek—obviously socially distanced with appropriate facemasks and so on. If we were lucky, it could take about 30 minutes. However, I must say that I have driven from Stoke-on-Trent station back to my home in Leek, and it has taken over an hour and a half. During rush hour, those two A roads that are the main roads into Leek from the city are absolutely full. They happen, at the moment, to have an enormous number of roadworks on them as well, which does not help, but in normal times they are still absolutely full. There are some very difficult junctions on them, particularly the junction at Endon going up to Clay Lake and Brown Edge and on the A520. My hon. Friend the Member for Stoke-on-Trent South and I both know about the issues around the Advanced Proteins site and the fact that we have an awful lot of very heavy vehicles travelling along that road and turning into the plant, causing congestion.

It really is not an easy journey, and it is getting harder. Given the volume of traffic and the demand for journeys between the Moorlands and the city, I do not see that it is going to improve any time soon, and the fact is that the Moorlands is missing out on the advantages of being only a few miles from the west coast main line. It is missing out on the opportunities that the Government’s investment in Stoke-on-Trent as part of the levelling-up agenda is bringing to the area, because people simply cannot rely on being able to work or live in the Moorlands and commute to the city given that the commute is so unreliable. We really do need an alternative.

There are two alternatives, and the debate title gives us a clue about what one of them is. There is another one, however, and it is that we could use the canals. We have a fantastic canal system built by James Brindley for the purposes of Wedgwood, to bring the raw materials from the Moorlands into the city where the potteries were founded in Burslem—the mother of the potteries in my hon. Friend for Stoke-on-Trent North’s constituency —but also around the whole city.

There are still fantastic potteries in the city, but it was the canals that made that possible. I love being on the canal—it is a really wonderful day out—but I think we would agree that it is probably not a good alternative for commuting into the city, given the speed at which one could travel. That then leaves us with one remaining alternative: to reopen the railway line between Leek and Stoke-on-Trent that closed as a victim of the Beeching cuts. When it closed it was probably not very well used, but I know now that the demand is there, and that people want to get back to being able to commute into the city from the Staffordshire Moorlands. Not only do we not have a dual carriageway, but we do not have a mainline train line running through the constituency. It would be wonderful to bring these things back.

This could be a fantastic clean, green alternative to roads. Residents live very close to the road, with houses along the whole way. My hon. Friends from the city will describe the experiences of their constituents who live alongside those roads, and the pollution and noise they suffer. We have this alternative; the line is there. Only a couple of weeks ago, the four of us here—myself and my hon. Friends the Members for Stoke-on-Trent Central, for Stoke-on-Trent North and for Stoke-on-Trent South—together with the leader of Staffordshire Moorlands District Council, Councillor Sybil Ralphs MBE, visited where the line travels between the Moorlands and the city at Stockton Brook. The line and track bed are there and we stood on them. There is quite a lot of weed but the line is there; it can be reopened. We were pleased to be there and see for ourselves that that could be done.

A bid has gone in to the Restoring Your Railways Fund. The bid is led by Staffordshire Moorlands District Council and Councillor Sybil Ralphs, and is supported by Stoke-on-Trent City Council, and its leader Councillor Abi Brown. We have the support of the local enterprise partnership, Staffordshire County Council, North Staffordshire Chambers of Commerce, the Peak District national park, local businesses and the key partner, the Churnet Valley railway. As I mentioned earlier, we have this wonderful heritage railway in the Moorlands, which has kept the track going for pleasure visits around the Moorlands on its steam trains. That heritage railway, with its use of the line, is a really important part of the bid.

I know the Minister is stepping in for my hon. Friend the Member for Daventry (Chris Heaton-Harris), who has sent his apologies. It is wonderful, though, to see the Minister in her place. I am hoping she will say that she will put personal endeavour into pushing this bid through. The bid has been submitted and we want to ensure that we get the funding we need, so that we can explore the possibilities.

We can see what could be achieved. We can see what the opportunities are for passenger services. That might be light rail; it might be different from what was envisaged when people closed the line—what it looked like then and what it might look like today. We want to see what the possibilities are for freight on the line, but we need to have that time and the expertise of officials at the Department for Transport to work with, to explore what is possible.

The line could not only go to Leek, but the line that the heritage railway uses now—to Froghall, through Cheddleton and Consall—could be used. That line goes to the village of Alton, where Alton Towers is. We have one of the largest cement plants in the UK at Cauldon, which is also the line used by the heritage railway. There are real opportunities to get freight off the road and on to the railway line.

In conclusion, I say to the Minister that all we want is a chance to see what is possible. I know she will use her best endeavours to support us on this. I look forward to hearing from my hon. Friends, who are all fully behind this bid.

The hon. Gentleman makes exactly the point that my right hon. Friend the Member for Harlow made to me last night, and I know how frustrated he is by this situation.

Let me move on to Divisions, because we have had debates about hybrid proceedings and, as I say, I look forward to seeing the Government’s motion, hopefully before the end of this debate. I am an ex-Whip; I have every sympathy with the desire to get back to fully physical voting. That is the way that Whips manage the business and the party, and it is how we Back Benchers interact with our colleagues and with Ministers. But I say to the Leader of the House that we will perhaps shortly have the chance to test the proposals that we have put forward, and I look forward to seeing what Members feel about them.

I back up the comments about deferred Divisions made by the Chair of the Public Administration and Constitutional Affairs Committee, my hon. Friend the Member for Hazel Grove (Mr Wragg), who is no longer in his place. I support the Government’s bringing forward of changes to Standing Orders that will allow deferred Divisions on Second Reading and other debates, so that we will not have to have so many physical Divisions. I would welcome tests of other forms of voting, but when we introduced remote voting, we did so after we had tested it and tried it; nobody has tested and tried the current proposal for physical voting. Will the Leader of the House please consider accepting the amendment to allow remote voting to continue for a short period of time? We will all work together to find a form of physical voting that we can all be happy with.

My party is minded to support amendment (d), which the right hon. Lady has tabled on behalf of her Select Committee. We take exception to the fact that Northern Ireland Members face a double restriction: fortunately, as far as I know, none of them are shielding, but not being able to get here denies them the fundamental right that is at stake, which is for them to be able to get on the record in respect of the vital issues that affect their constituents and on which their constituents expect them to be on record. Resolving the voting issue would go a long way. Members can be denied the chance to speak but not to vote.

I understand exactly the points the hon. Gentleman makes. He will know that in the past I had personal experience of enjoying that journey very, very frequently.

The Procedure Committee has worked long and hard to find arrangements that we think are in the interests of the whole House. We received an unprecedented level of feedback on our work and I thank all colleagues who have taken an interest in it. As one of my hon. Friends observed to me, “Perhaps the Procedure Committee really is the most interesting Committee after all.”

There has been a certain amount of discussion about how the hybrid arrangements have delayed the Government’s legislative programme. Let me be clear. On 21 April the House brought in hybrid arrangements for the Chamber. There was no requirement for the Bill Committees to operate in hybrid form. A great deal of work was done to prepare for hybrid or virtual Bill Committees in case the Government wanted to use them, but there has been absolutely no bar, in the weeks since 21 April, on the Government arranging for wholly physical Bill Committees to meet in the rooms large enough to take them. They are: Committee Rooms 10 and 14, the Grand Committee Room and the Boothroyd Room. Members should take any suggestion to the contrary with a large pinch of salt.

Let me make one other thing absolutely clear. I was elected by the House to Chair a Committee to advise the House on its procedure and practice. I was also elected to this House as a Conservative on an ambitious manifesto to get Brexit done. I make a personal commitment to the Leader of the House that that is what I am determined to see we deliver. Nobody on the Conservative Benches is trying, in any way, to stop that happening.

The Procedure Committee is concerned that we make sure all Members of the House have their say. A very distinguished Conservative Lord Chancellor, when in Opposition, once described the constitutional arrangements in the UK as “elective dictatorship”. I hope the Leader of the House will listen and remember that what is sauce for the goose is also sauce for the gander.

I welcome the Secretary of State’s claim that this Government are no longer neutral on Northern Ireland, which sets aside what was previously said about “no selfish, strategic… interest” in Northern Ireland. Will she put together promotional literature, and a promotional programme, that expresses the economic, social and cultural benefits of the Union that can be promoted not only in Northern Ireland but around the world?

I do not want to comment on what is going on in the talks, but I agree that we need to reach consensus, which means that all parties will need to come together and agree on a way forward that means we can restore devolution.

The Secretary of State, in reply to the shadow Secretary of State, said that decisions have to be made. She will know that at least five decisions have to be taken before the end of June. She has already covered the issue of historical inquiries, and there is also the issue of contaminated blood and compensation, the fallout from the renewable heat incentive report—the Select Committee will be reporting on that before the end of June—and the jobs initiative retention programme with regard to my constituency. There is also a decision to be taken on a new event for Northern Ireland next year. Will she commit now that those decisions will be taken by the end of June?

The hon. Gentleman made a number of points, the final of which related to the investigation of previous atrocities and murders. He will know that we have conducted a consultation into setting up the institutions that were agreed in the Stormont House agreement. We will publish our findings from that consultation shortly, but I would be very happy to sit down with him and work through where we are on that.

May I too express my personal condolences to the family of Lyra McKee—to her nearest and dearest, her loved ones, her partner, her friends and her colleagues? Grief is an awful bitter cup of which to taste, and no doubt the family feel that tragedy at the moment.

Lyra was on one of the first “Lessons from Auschwitz” visitations run out of Northern Ireland by the Holocaust Educational Trust; she took part just a few years ago. I understand from the leader of that group, whom I was in communication with this morning, that Lyra was clearly moved by her visit to Auschwitz, where she learned the vital lesson that people want to live for their beliefs, not to be murdered because of them.

Humanity has taken a terrible blow in the last few days and over this Easter weekend. That humanity is unbowed by terrorism, but it is only unbowed if we take action, and the actions that have been called for across this Chamber tonight will eventually fall to the Secretary of State. We cannot continue just to hope that something will happen. There has got to be more than words. The Secretary of State will have to take brave actions in terms of calling the Assembly together and in terms of putting it up to those parties reluctant to take action to either form a Government or not form a Government. That will fall to the Secretary of State.

The 17, 18 and 19-year-olds have no excuses. They do not have years of discrimination, and they have never known a terrorism war or mass unemployment. They have no excuses, yet there are people around them who will try to make those excuses. Pretty soon there will be no excuses for no action by this Government. We need action and we need an Assembly back; and you, Secretary of State, have to play your role in achieving that.

I want to assure the hon. Gentleman that I am determined that we will see the Executive re-formed. I will come to this House to talk about that at an appropriate time. I think that tonight, as I said earlier, is a moment for us to reflect on the life of Lyra McKee, but also, as the hon. Gentleman said, to reflect on the fact that this weekend we have seen the most heinous, barbarous acts across the world, reminding all of us of just how precious human life is. That is something that none of us wants to see, particularly over an Easter weekend. I, as Secretary of State for Northern Ireland, am determined that we will take the measures that we need to in Northern Ireland to ensure that it does not happen again.

We discussed the matters of cross-border security and east-west relations at both British-Irish Intergovernmental Conferences in the past 12 months. Close work between the Garda and the Police Service of Northern Ireland is imperative to ensuring the safety of us all.

As I say, I have enormous sympathy for people in this situation. I have met the Ulster Farmers Union and my officials have met individual farmers to talk about it. I well understand the concerns but, faced with a choice between no subsidies at all and cost cutting at 12%, I think this is the right and only legal approach we can take.

I thank the Secretary of State for at least acknowledging how grossly unfair this is to many people, but she must recognise that the Bill the Northern Ireland Office has put before the House today does far more than she has indicated. Less than half a page of the Bill deals with the regional rate. The rest—five pages—deals with the RHI scheme, and her proposal for the scheme will bring all renewable activity to an end for a generation. No one will ever again apply for a renewable scheme or a Government-backed deal in Northern Ireland. That will be the effect of her proposal.

I thank the hon. Gentleman for his comments. I will come on to the detail of the renewable heat measures and the work undertaken.

The Department for the Economy in Northern Ireland undertook an extensive public consultation in the last year to ensure that revised measures could be introduced in time for new legislation to come into effect from 1 April 2019. The tariff levels set out in the Bill are based on an analysis of the additional costs and savings of operating a biomass boiler in Northern Ireland. The Department has also engaged with the European Commission in developing the long-term tariff. The Commission has indicated that it is not in a position to approve a tariff that delivers a rate of return higher than 12%. Recognising that a small number of participants with lower usage needs or higher capital costs could see returns below the intended 12%, the Bill makes provision for the introduction of voluntary buy-out arrangements.

I recognise that some scheme participants in Northern Ireland will be concerned about these new tariffs. Both the Department for the Economy and my own Department have heard their views in person and in writing in recent weeks, as I said earlier, and I empathise with those people and businesses across Northern Ireland.

I thank the Secretary of State for going into the detail. She mentions the 12% rate of return. Why can the rest of the UK set a rate of return on the same scheme fluctuating between 8% and 22%? Why are our officials being told that Europe will only accept 12% for Northern Ireland, but will accept a differential rate for the rest of the UK? Officials have a duty to tell the public why that is.

We cannot easily compare schemes: there are different set-up costs and fuel costs in different parts of the United Kingdom. Differences apply. The work done by the Department for the Economy with the Commission is thorough and has ensured that the recommendations it put to me and the tariffs we are legislating for today mean that the scheme remains legal. That is the important point. If we do not have a legal scheme, there will be no subsidies.

The Secretary of State says there are different set-up costs, but under state aid rules that is not allowed. State aid rules declare that the set-up costs are X for the provision of the boiler. In England, different set-up costs are being used, and our Department in Northern Ireland is changing those set-up costs according to its interpretation of what the law demands. Does that not ultimately reflect the need for more scrutiny? To rush the measure through the House is not right, fair or equitable.

There are differences in fuel costs and transport costs. There are differences between different parts of the UK. I am interested in making sure that the scheme in Northern Ireland remains legal so that people with boilers can continue to receive some subsidy. I know it is not at the levels they were receiving previously, but it is still some subsidy.

It is always an honour to serve under your chairmanship, Sir Lindsay.

I support the new clause. It has the overwhelming support of the parties here and of the Select Committee, which has been rightly identified as the Committee that should try to organise the scrutiny. I approve of the requirement in the new clause that the Secretary of State should bear in mind

“any relevant recommendations made by any select committee of the House”.

A number of points were made on Second Reading but, in particular, Members asked where the evidence came from and on what we were basing this, and my hon. Friend the Member for North Down (Lady Hermon) asked whether we could see the material. Yesterday was the first time that I, and many of my colleagues, were able to see the material on which tonight’s discussion is based. I have it in my hand. There is not a lot of it: it contains 300 words and three graphs. On the basis of a 300-word document with three graphs, we are being asked to agree a multi-million-pound subsidy cut in Northern Ireland. That is not right.

This requires scrutiny. Those 300 words may have convinced some people, and the Minister made a very good fist of making the case, but they are not a compelling argument. We need to be able to see the evidence that has convinced the Department that it is doing right and the rest of the United Kingdom is doing wrong, and that, if the Irish Republic comes on stream, it too will be doing wrong. We need to see the evidence for those claims.

I asked a few questions that need to be answered by the Secretary of State or her senior officials. That can happen only in a Committee, because they have not been answered on Second Reading, and I do not know if they will be answered in Committee. I welcome the new clause that has been tabled by colleagues; I hope that it attracts support and that the Secretary of State can demonstrate to us, if she does not want us to accept it, that she will take cognisance of what a Committee will say and of scrutiny that will actually take place.

I recognise the concern of Members and the spirit of this amendment, which seeks to provide for additional time and scrutiny. As I have said, I empathise with the participants in the scheme. I have been very clear, during discussion both of yesterday’s legislative measures and today’s, that this situation and this process are far from ideal. What I and I think everybody in this Chamber wants to see is scrutiny of Northern Ireland policies by locally elected politicians. Nevertheless, I am committed to bringing forward measures on behalf of Northern Ireland where they are critical to good governance, as these two Bills are. I remind Members about the point I raised yesterday about the normal estimates process: by taking this legislation through as primary legislation in this House, rather than subordinate legislation, as it would have been in the Assembly, we are affording a higher degree of scrutiny and accountability to these measures.

My hon. Friend the Member for South West Wiltshire (Dr Murrison), the Chair of the Northern Ireland Affairs Committee, is right that full and proper scrutiny is what we need, and he is right to challenge us. He is also right to say that we must get this right, and I appreciate that his amendment would afford more time for scrutiny and offer a mechanism by which more scrutiny could be delivered.

The Northern Ireland RHI scheme has probably received more public scrutiny than any other. I have already mentioned the public inquiry into the scheme, which has interrogated myriad aspects of the scheme in detail, but additionally and specifically on these new tariffs, the Department for the Economy held an extensive public consultation from June to September 2018. That included making public the evidence base used by the independent experts who generated the tariffs. I believe that information is on the Department for the Economy website and we are looking to see if we can find it quickly and provide a link to it as soon as possible.

The Department held pre-consultation events for stakeholders, including all the local political parties and key representative groups, including the Ulster Farmers’ Union and the Renewable Heat Association Northern Ireland. Following the closure of the consultation, the Department set out its analysis and response in January 2019 and said that final proposals for the revised tariffs would be delivered in February this year. The Department and my officials have in recent weeks briefed parliamentarians and local parties on the new tariffs and the new legislative measures before us, including the new buy-out clause. My hon. Friend’s suggestion that there may be a role for further scrutiny in either his Committee or another Committee in the House is very welcome and I certainly would appreciate that.

With regard to the timing of the legislation today, it is important to recognise the comprehensive and technical nature of the work involved. As I have mentioned, the Department for the Economy engaged independent experts to carry out a painstakingly detailed review of the scheme, went through a full public consultation exercise and more recently an extensive discussion with the European Commission on state aid. These discussions only reached a conclusion at the end of January, meaning the Department for the Economy could not finalise its position any earlier. The current legislation is sunsetted and a failure to enact the clauses before us will mean more than 1,800 participants will not be able to be paid by 1 April.

On that point—I think this is critical and is probably subject to the judicial review at the present time—is it the case that payments stop? Is that the opinion of the barristers advising the Department? Or is it the case that this reverts to the original payments scheme? There is contrary advice on this and the Secretary of State must be clear with us which advice she is taking and why.

The advice I have received is that the payments will stop, because there will be no legal basis on which to make any payments. The payments that are currently being made have been found to breach state aid rules, so there is no legal basis on which to continue to make payments. The payments with the cost-capping involved expire on 31 March. The Department cannot go back to the original payments, because they would be illegal payments, and we will not have any other mechanism by which legal payments can be made after 31 March. I recognise that this is far from ideal, but the facts of the situation have meant that an expedited process is required.

The Secretary of State says that we cannot go back to the original payments, but I do not think that anyone is asking for that. However, the payments were stepped down, and I understand that she could continue with those stepped-down payments.

I cannot continue with those, because the advice that I have is that to continue with them would be illegal. Under the ministerial code, I cannot, as a Minister of the Crown, legislate for something that I am advised is illegal. So I am left in a very difficult situation. I understand how people feel about this. I empathise with people and I understand the implications for them of a reduction, but as Secretary of State, legislating for something that none of us wants to be legislating for in this place, I am faced with the choice of legislating for something that is legal, to allow some subsidies to continue, or not legislating, which would result in no subsidies happening after 31 March. The legal basis on which the reduced subsidies, as set out by the Executive, are paid expires on 31 March.

I am well aware of the frustration and anger that there is in the general public with the situation we have. As Secretary of State, I have ensured that we do what we need to do to ensure good governance continues in Northern Ireland, but there are of course difficulties, constitutionally, with taking new policy decisions in this place that had not previously been agreed by Ministers in Stormont. I have been very clear that the actions that I have taken—setting a budget, or public appointments, such as to the Policing Board, which was mentioned earlier—were on the basis of continuing existing policies and ensuring that public services can continue to be delivered, but without creating new policy areas or deciding on new policy areas in the absence of Ministers. The hon. Gentleman made the point at the end of his question: the answer is to get Ministers back into Stormont, and I am determined that we will do that.

He indicated that the backstop, which the Secretary of State supports, would undermine the Belfast agreement and that there is a better way out of the paralysis. Has the Secretary of State studied that article and looked at the better way out of the paralysis?

The PSNI and the security services do a fantastic job every single day in thwarting plots to disrupt life and to cause injury and harm to innocent civilians in the way we saw on Saturday night. As was said earlier, the terrorists need to get lucky only once; we must work relentlessly. The Government consider business cases for additional resources, as they do all such business cases, to determine what is appropriate.

Gentleman is right to say that the threat from Northern Ireland-related terrorism in Northern Ireland is severe, but the threat from Northern Ireland-related terrorism in Great Britain is moderate. Those threat levels are assessed independently of the Government. We are governed by the assessments of the security services and others in determining the threat levels.

The hon. Lady is nothing if not persistent. She quizzed me extensively about that matter at the Northern Ireland Affairs Committee on Wednesday. As I said to her then, we have received the Chief Constable’s recommendations and are considering them across Government. She is right to say that we are stepping up no-deal planning, as the Prime Minister stated. It is also worth saying that the deal agreed by the Cabinet at Chequers is one that works for the whole United Kingdom. It is very important, from a Union point of view, that we have a deal with the European Union that ensures that our red lines for Northern Ireland of no hard border on the island of Ireland and no border on the Irish sea are adhered to.

The hon. Gentleman is also persistent in his questioning. As I said last Wednesday in front of the Select Committee, we have received the Chief Constable’s report and are looking at it.

The emergency powers under section 59 of the 1998 Act are intended to be used only in the absence of more orthodox legal authority. I do not consider those emergency powers to be appropriate for managing Northern Ireland finances for a second financial year.

I assure the right hon. Gentleman that we examine all such points. If he wishes to write to me specifically on the instances he has learned about, I will be more than happy to have officials in my Department speak to those in the NICS to establish what has happened. We are very clear where the money needs to be spent. It was agreed in the confidence and supply arrangement, and we are taking the steps that we need to take to ensure the money is spent as intended.

I want to be very clear that this Bill is not legislating for the £410 million. That was approved by Parliament for release as part of the UK Supply and Appropriation (Main Estimates) (No.2) Bill, while this Bill gives the NICS the authority to allocate that funding. More detail on funding allocations is contained in the supporting Command Paper. Just to be clear, we are following on from the estimates process on which we voted in the Chamber last week. On Tuesday evening, we voted to make sure that the Northern Ireland block grant was properly allocated. Today, we are in effect carrying out the estimates process that would normally be done at Stormont. In the absence of Stormont, we are dealing with this through primary legislation here.

I appreciate what the Secretary of State is saying, and yes, by and large, that is exactly what is happening, but it is not quite as benign as that. The Secretary of State has personally signed off a change in the budget by which £100 million has been taken from capital spend to revenue spend. Civil servants are of course very delighted about that, because some of it will go towards redundancy packages for them, but that is not the point. The Secretary of State has taken the decision on advice, so why does she not take the other decisions that are necessary to make Northern Ireland function?

I said that the hon. Gentleman was persistent. The decision to allocate spending from the capital budget to the revenue budget was taken to make sure that the budget balanced. It was taken after consultation with all the main parties in Northern Ireland, which all understood that that decision was taken to ensure that the budget balanced and that additional revenue raising from the people of Northern Ireland was not required.

Let me turn to the second important issue to which I would like to draw the attention of the House. As well as placing all Northern Ireland Audit Office audits and value for money reports and the associated departmental responses in the Libraries of both Houses—to be accessible and visible to all interested Members and Committees—I will also write to the main Northern Ireland political parties to highlight the publication of the reports and encourage them to engage with the findings. This is as robust a process as is possible, but the best form of overall accountability and scrutiny of Northern Ireland public finances would of course be that undertaken by a fully functioning Executive and a sitting Assembly in Northern Ireland.

Is the Secretary of State travelling to the point in her speech at which she acknowledges that what we are debating is not about Northern Ireland, because what is in front of us is a proposal that would fundamentally change forever the rules governing abortion across the whole United Kingdom? That should not be done in the heat of the moment following something that happened in a foreign jurisdiction—the Republic of Ireland.

I thank my hon. Friend the Chair of the Select Committee for that point. As I said earlier, the forward-looking expenditure is merely to approve, in the way we would do in the normal Budget process in this House, 45% of spending. We have done exactly the same allocations as in the previous year to enable the moneys to be spent, but the Bill does not give decision-making power to say how the money should be spent; it merely gives approval for money to be spent by those Departments so that they can continue to function. I appreciate that it is not an entirely satisfactory situation, but it is what is required to enable the Departments to continue to function and provide public services. In summer we will of course come through with the full budget process, which I hope will be done by a restored Executive at Stormont. If not, it will have to be done in this House.

The Secretary of State will know my interest in making sure that it is the perpetrator who pays and is punished, not the taxpayer. Will she ensure that if there is not an Assembly in six months’ time, it will be the institutions that perpetrated those false and indeed horrible, pernicious attacks on innocent individuals that are made to pay, and that it will not be the taxpayer picking up the bill?

The hon. Gentleman’s comments indicate to the House that there is perhaps not universal support for every recommendation from the Hart inquiry. That is why it is important that we have a restored Executive in Stormont that can make the decisions about those recommendations and enable justice to be delivered.

I am sure the Secretary of State sees through some of the “Bah, humbug!” of those on the Labour Benches, considering that their former leader warmed the bed of this media mogul and ultimately became a godparent to James Murdoch’s stepsister. Given that some of us have been hacked by the Daily Mirror and by journalists from the BBC and Belfast newspapers, we take all of that with a great pinch of salt. However, may I congratulate the Minister on the way she has conducted herself today and on the handling of this report? I look forward to being able to make representations to her. Will MPs be able to meet her personally, or will we have to write to her to make our case?

As acting Chair of the Select Committee, my hon. Friend has done sterling work. The Select Committee’s report very much influenced the work we did on the charter over the summer. As I said in my statement, I expect the new board to be in place and all the regulators working by 3 April next year. I expect the new chair of the board to be appointed before that date.

Does the Secretary of State accept and acknowledge that many of us do not share the doe-eyed sentimentality often expressed about the BBC, especially when they have borne the brunt of its bias over several years? On the issue of transparency, why has the publication of expenses or salaries been limited of amounts over £150,000? Why can it not be brought into line with MPs’ expenses of £75,000 and include all other expenses, including travel and accommodation?

The hon. Gentleman has, I know, had long-term issues—that might be the best way of putting it—with the BBC and a view of bias, but I am sure he would agree that he enjoys many BBC programmes on radio and television. We should cherish and really want to protect that. When it is at its best, it is Britain at its best. The Rio Olympics was a prime example of when the whole of Britain came together. The proposals are in line with civil service obligations on pay transparency, but the first disclosures will across bigger bands than we have in the civil service.

The Minister refers to some of my party colleagues. My hon. Friends the Members for South Antrim (Dr McCrea) and for Upper Bann (David Simpson) mean no discourtesy to the Minister, whom I know they are very fond of, but they have had to leave the Chamber because of a meeting tomorrow morning with a Minister in Northern Ireland. I hope the Minister will appreciate that they had to catch their flight.

I appreciate that intervention, apart from anything else because I am not going to have to answer yet another question from those hon. Gentlemen, who gave me a significant number to try to address. I do understand completely the time pressures we all face, however.

I understand that HMRC is making sure it has the best and most appropriate roadside marker testing equipment, further to strengthen testing capability. From day one of the new marker implementation, its road fuel testing units will be able to use their existing battery of tests to identify suspicious samples, and I should repeat the point that this is not a replacement marker initially; this is a running-alongside marker with the existing marker, to ensure we have full evidence and information. I also understand that, in addition, HMRC expects to have ground-breaking roadside testing equipment by the summer.

The hon. Member for North Antrim made a number of points and I understand that HMRC has written to him on many of them, in particular the point about the new marker being easily laundered and that that can be done on a commercial scale. I urge him to provide details of any trials about which he believes HMRC may be unaware. It does want to review the report he has laid in the House, and it will respond to him. The Government will of course review the report as well, and HMRC has investigated whether this can be done on a large scale. The hon. Gentleman says he has seen the test to prove that that is the case. If he provides that evidence to HMRC, it will review the report and write to him, but the only large-scale test that we are aware has been undertaken, which was with 25,000 litres, fully supported HMRC’s conclusion that this is not easily translated to large-scale operations in the field. We do take these claims very seriously, however, and HMRC will look at any reports that the hon. Gentleman provides.

The hon. Member for South Antrim talked about the number of arrests and prosecutions for this crime. In the period 2011-14 there was a total of 56 arrests for fuel fraud, and 47 of them were in Northern Ireland, while just nine were in the rest of the United Kingdom. We have not, of course, yet got the full figures for 2014-15, but the latest information is that there were 25 arrests, 13 of which were in Northern Ireland and 12 in the rest of the UK. That shows that we take this crime very seriously, including in Northern Ireland.

Confiscation was also mentioned. In 2013-14, the last year for which we have figures, £113,001 was applied on confiscation orders relating to this type of crime, of which £113,000 related to confiscation orders in Northern Ireland, with only £1 relating to the rest of the United Kingdom. The hon. Member for Birmingham, Erdington and I have enjoyed many debates on the topic of asset recovery, and we agree that we want to see more confiscation orders and more recovery. The Government take this issue seriously and progress is being made.

HMRC’s anti-smuggling strategy is effective, and we continuously adapt it to accommodate changes in criminal behaviour. Since it was first launched, we have reduced the illicit cigarette market by half and the illicit hand-rolling tobacco market by a third, but we all recognise that more can be done. The hon. Member for East Antrim contributed to yesterday’s debate on the order to bring the National Crime Agency into Northern Ireland. I want to put it on record that, in regard to the priorities for policing and the NCA in Northern Ireland, the Northern Ireland Policing Board will agree the NCA annual plan. That will allow key crime types, which may include fuel laundering, to be prioritised for the NCA in Northern Ireland.

One of the blockages to having full support in Northern Ireland has been the limit to the NCA’s ability to provide support to HMRC and the PSNI in Northern Ireland. That related to the powers issue, and thankfully that issue is now resolved. Yesterday, we debated and approved in Committee here, and in another place, the draft Crime and Courts Act 2013 (National Crime Agency and Proceeds of Crime) (Northern Ireland) Order 2015. The order will enable the NCA to operate with police powers in Northern Ireland from around the end of May. It puts in place accountability arrangements for the NCA that have been agreed with the Northern Ireland parties. It also extends civil recovery provisions and civil recovery investigation provisions under the Proceeds of Crime Act 2002 to Northern Ireland. This will increase activity and improve performance, alongside the efforts of other accredited financial investigators in Northern Ireland, such as the Serious Fraud Office, the PSNI and the Environment Agency. Perhaps that will answer the question from the hon. Member for Foyle about waste crime.

We are also strengthening the provisions of the Proceeds of Crime Act through the Serious Crime Act 2015. The hon. Member for Birmingham, Erdington and I served on the Committee that considered that legislation. Its provisions will make it harder for criminals to move, hide and use the proceeds of crime through the better enforcement of existing court orders and the better recovery of hidden assets overseas. These steps are important, as denying criminals the proceeds of crime is one of the most effective ways of disrupting their activities. We agree that, so far, not enough has been recovered, but with these enhanced powers, the NCA, working with law enforcement, will be able to recover more. I urge the courts to ensure that confiscation orders are applied whenever possible, and that compensation orders for victims are also put in place.

The hon. Member for Foyle also raised concerns about engagement with communities. The Crime and Courts Act 2013 (National Crime Agency and Proceeds of Crime) (Northern Ireland) Order 2015 that we approved yesterday provides that the Northern Ireland Policing Board must make arrangements for obtaining the co-operation of the public with the NCA in the prevention of crime. The hon. Gentleman will recall that, as part of the Justice Minister’s proposal paper, there will also be a requirement for NCA officers to have a duty to secure the support of, and to act in co-operation with, the local community. Additionally, the order provides that the NCA’s director general must obtain the Policing Board’s prior consent to the Northern Ireland aspects of the NCA’s annual plan.

Serious and organised criminal groups do not respect borders or force boundaries. The PSNI estimates that there are around 150 organised crime groups active in Northern Ireland. Nearly a third of those groups are assessed as having links to international criminality, and another third are linked to criminality in the rest of the UK and the Republic of Ireland. HMRC operates across the UK as a whole, and the National Crime Agency has both national and international reach. They are working more closely than ever before with the PSNI and other partners to disrupt organised criminal groups undertaking fuel laundering and smuggling in Northern Ireland and to deny criminals the proceeds of that crime. As has been said, we will not oppose this motion, and I want to thank everybody for the debate. I look forward to Northern Ireland seeing the benefits of the NCA that the rest of the UK has benefited from since October 2013.

That this House notes with concern the continued prevalence of serious organised criminal activity in Northern Ireland on a cross-border basis in relation to fuel smuggling, fuel laundering and the counterfeiting of consumer goods; recognises that this has had a significant and detrimental impact on HM Treasury; regrets the lack of prosecutions in relation to this activity; and calls on the Government to ensure greater co-operation between HM Revenue and Customs, the National Crime Agency and the PSNI so that this criminal activity can be eradicated.

I want to be clear: I am talking about trivial examples of how we respect devolution in order to show the many ways in which devolution is respected across the United Kingdom, whether in the devolved Administrations, with the powers and competences devolved to them, or our local councils. We must all respect that, and recognise that point.

The Minister should be under no illusion. We have not called lightly for her to intervene. This is the only issue on which the parties have united to call for the Government to intervene. We respect the devolution settlement—we are part of it, and we helped negotiate it—but there are times when there is a logjam and the Government of our nation must act.

If the hon. Gentleman will forgive me, I will get on to the specific points about that. I accept the points he makes, and they have been made throughout the debate, but I will get to those specific points shortly.

The consequences of not acting are potentially devastating. This is about drugs and violence on our streets, children being abused and vulnerable people defrauded. Organised criminals make money out of other people’s misery and undermine the fabric and cohesion of our communities. That threat costs the UK more than £24 billion a year, and it is not just the financial cost—it is the emotional and physical cost, and the impact on families and communities. We should not underestimate the importance of the threat.

The hon. Member for East Londonderry (Mr Campbell) opened the debate very well and made a number of important points, some of which were followed up later. He set the scene very well and his example of drug smuggling and the co-operation required on that powerfully highlights the importance of this matter.

The shadow Minister, the right hon. Member for Delyn (Mr Hanson), and I spent many happy hours in the Modern Slavery Bill Committee recently. I am pleased to say that he, like us, is supporting the motion before us today. He wanted to know what extra steps the Government are taking, and the hon. Member for North Antrim (Ian Paisley) and others asked about that, too, including the right hon. Member for Belfast North (Mr Dodds) and my hon. and gallant Friend the Member for Beckenham (Bob Stewart). The UK Government have been fully involved in the discussions, rightly led by the Northern Ireland Justice Minister David Ford, and in developing the package and supporting the discussions. The package represents a sound proposal to enable progress and it has the Government’s full support. We remain ready to support David Ford in those discussions, including by meeting the parties if they would find that helpful. I will pass back to the Justice Minister the comments that have been made about setting deadlines.

Comments were made about whether the UK Government should legislate for the NCA in the absence of agreement, and I want to be absolutely clear. As my right hon. Friend the Secretary of State for Northern Ireland said recently:

“Be in no doubt, it may have ‘national’ in its name but the UK Government completely accepts the crucial importance of ensuring that NCA’s operations in Northern Ireland are fully consistent with the devolution settlement.”

We have to accept that devolution settlement. That is what this Westminster Government agreed to do when that settlement was set up by the previous Government, and we must continue to respect it in order to maintain that settlement.
