My Lords, with the leave of the House, I shall now repeat a Statement made in another place by my right honourable friend the Prime Minister. The Statement is as follows:

“With permission, Mr Speaker, I would like to make a Statement on last week’s European Council, and on the proposals we are publishing today, which, on a reciprocal basis, seek to give reassurance and certainty to EU citizens who have made their homes and lives in our country.

This Council followed the formal start of the negotiations for the United Kingdom’s departure from the EU, as well as marking the first anniversary of the referendum that led to that decision. In that referendum, the British people chose to take back control of our laws, our money and our borders, to restore supremacy to this Parliament and to reclaim our sense of national self-determination, and this Government will fulfil the democratic will of the British people.

But the referendum was not a vote to turn our backs on our friends and neighbours. Indeed, as we become ever more internationalist in our outlook, and as we build the global Britain we want to see, we will continue to be reliable partners, willing allies and close friends with all the member states of the European Union. We want to work with one another to make sure that we are all safer, more secure and more prosperous through our continued friendship. We want to buy each other’s goods and services and trade as freely as possible. We will continue to celebrate and defend the liberal democratic values that we share, and to project those values that are the foundation of our freedoms and our way of life. In short, we want to build what I have described as a new, deep and special partnership between a confident, self-governing, global Britain and all our friends and allies in the European Union.

That is the positive and constructive spirit in which my right honourable friend the Secretary of State for Exiting the European Union began the formal negotiations last week, and it is the same spirit in which the United Kingdom made a full contribution to all the issues at this Council, including on security, migration, climate change and trade.

On security, I thanked our European partners for their condolences and for their resolve in standing with us following the appalling terrorist attacks that the UK has suffered in recent weeks. Those attacks have seen citizens from across Europe tragically killed and injured, but they have also seen our citizens standing together in some of the most inspiring ways. At London Bridge, we saw a Spanish banker tragically killed as he rushed to the aid of a woman being attacked, and we saw a Romanian baker fighting off the terrorists and giving shelter to Londoners in his bakery. These moments of heroism show how, far from dividing us, such attacks on our way of life will only ever serve to strengthen our shared unity and resolve.

But these attacks also show that we need to respond to a new trend in the threat we face, as terrorism breeds terrorism and perpetrators are inspired to attack by copying one another using the crudest of means. So, building on the bilateral agreement I reached with President Macron earlier this month, at this Council I argued that we must come together to defeat the hateful and extremist ideologies that inspire these attacks, and to stop the internet being used as a safe space for extremists. When one-third of all links to Daesh propaganda are shared within the first hour of release, it is not enough for technology companies to respond reactively to extremist content on their platforms. So the Council agreed to put pressure on these companies to do more to remove this content automatically, and also to ensure that law enforcement agencies can access encrypted data. This was a significant step forward. We will continue to work together with our European partners to combat this evil, to defend our values and to keep our citizens safe.

Turning to other issues, on migration, the Council recommitted to the comprehensive approach that the UK has advocated, dealing with the drivers of migration while also doing more to stem the flow. At the summit, I confirmed a new UK commitment of £75 million to meet urgent humanitarian needs in the central Mediterranean, while also facilitating voluntary returns of migrants making these treacherous journeys.

On trade, as the UK leaves the European Union we will be forging trade deals around the world with old friends and new allies alike, but this will not undermine the EU’s trade agenda; it is not even in competition with it. So for as long as we remain part of the EU, we will continue to press for an ambitious trade agenda that can deliver jobs and growth across the continent. That is what I did at this Council, where there was a particular focus on work towards deals with Japan, Mexico and the Mercosur bloc of South American countries.

On climate change, the Council reaffirmed the commitment of all member states fully to implement the Paris agreement. The UK has already reaffirmed its own commitment, and I have expressed my disappointment to President Trump that he has taken a different decision. We will continue to make the case to our American allies to think again.

Turning to citizens’ rights, EU citizens make an invaluable contribution to our United Kingdom: to our economy, our public services and our everyday lives. They are an integral part of the economic, cultural and social fabric of our country, and I have always been clear that I want to protect their rights. That is why I initially sought an agreement on this before we triggered Article 50, and it is why I am making it an immediate priority at the beginning of the negotiations.

But that agreement must be reciprocal because we must protect the rights of UK citizens living in EU member states, too. At the Council, I set out some of the principles that I believe should underlie that reciprocal agreement, and there was a very positive response from individual leaders and a strong sense of mutual good will in trying to reach such an agreement as soon as possible. So today, we are publishing detailed proposals to do exactly that. Let me set out the key points for the House.

First, we want certainty. I know there has been some anxiety about what would happen to EU citizens at the point we leave the European Union. Today, I want to put that anxiety to rest. I want to completely reassure people that under these plans no EU citizen currently in the UK lawfully will be asked to leave at the point the UK leaves the EU. We want you to stay.

Secondly, any EU citizen in the UK with five years’ continuous residence at a specified cut-off date will be granted settled status. They will be treated as if they were UK citizens for healthcare, education, benefits and pensions, while any EU citizens with less than five years’ residence who have arrived before the specified cut-off date will be able to stay until they have the five years’ residence to apply for UK settled status.

Thirdly, the specified cut-off date will be the subject of discussions, but it will be no earlier than the date we triggered Article 50 and no later than the date we leave the EU.

Fourthly, no families will be split up. Family dependants who join a qualifying EU citizen here before the UK’s exit will be able to apply for settled status after five years. After the UK has left the European Union, EU citizens with settled status will be able to bring family members from overseas on the same terms as British nationals.

Fifthly, there will be no cliff edge: there will be a grace period of up to two years to allow people to regularise their status. Those EU citizens who arrived in the UK after the specified cut-off date will be allowed to remain in the UK for at least a temporary period, and may still become eligible to settle permanently.

Sixthly, the system of registration that citizens go through will be as streamlined and light touch as possible, and we intend to remove some of the technical requirements currently needed to obtain permanent residence under EU rules. For example, we will not require anyone to demonstrate that they have held comprehensive sickness insurance.

Seventhly, we expect this offer to be extended on a reciprocal basis to nationals of Norway, Iceland, Liechtenstein and Switzerland. The reciprocal agreement on citizens’ rights will apply to the entire United Kingdom and Gibraltar.

Eighthly, this is all without prejudice to the common travel area arrangements that exist between the UK and Ireland. We will preserve the freedoms that UK and Irish nationals currently enjoy in each others’ states, and Irish citizens will not need to apply for permanent residence to protect these entitlements.

Finally, the UK will continue to export and uprate the UK state pension and provide associated healthcare cover within the EU. We will continue to protect the export of other benefits and associated healthcare cover where the individual is in receipt of those benefits on the specified cut-off date. Subject to negotiations, we want to continue participating in the European health insurance card scheme, so that UK card-holders can continue to benefit from free or reduced-cost healthcare while on a temporary stay in the EU, and vice versa for EU card-holders visiting the UK.

This is a fair and serious offer. Our obligations in the withdrawal treaty with the EU will be binding on the UK as a matter of international law, and we will incorporate commitments into UK law guaranteeing that we will stand firmly by our part of the deal. So our offer will give those 3 million EU citizens in the UK certainty about the future of their lives, and a reciprocal agreement will provide the same certainty for the more than 1 million UK citizens who are living in the EU.

One year on from that momentous decision to leave the EU, let us remember what we are seeking to achieve with these negotiations. We are withdrawing from a system of treaties and bureaucracy that does not work for us, but we are not withdrawing from the values and solidarity that we share with our European neighbours.

As a confident, outward-looking and self-governing nation, we know that it is not just our past that is intertwined in the fortunes of our friends and neighbours; it is our future, too. That is why we want a new, deep and special partnership and it is why we approach these negotiations with optimism, because a good deal for Britain and a good deal for Europe are not competing alternatives. They are the best single path to a brighter future for all our children and grandchildren. That, I believe, is the future that the British people voted for, and that is the future I want us to secure. I commend this Statement to the House”.

My Lords, I too thank the noble Baroness the Leader of the House for repeating the Statement. The two principal issues debated at the Council that are of relevance to the UK were, first, security and, secondly, citizens’ rights.

On security, the Prime Minister rather patted herself on the back that she had taken the lead in having had discussions with President Macron and then, at the Council itself, in moving the technology companies to responding more effectively to extremist content. It is clear that whatever happens over the coming months in respect of the technology companies, the area of security, which faces the whole of Europe, will not become less of a priority or less of a concern. My question for the Government is: what plans do they have to have a continuing voice on European discussions on security? They will not be at the EU table. Will they put proposals to the EU about how they will have a continuing voice in European security discussions? If we lose that voice it will undoubtedly be the case that the UK will be less secure.

The biggest area of interest for the UK, not so much in the summit but subsequently, is around citizens’ rights. We have now seen the Government’s paper. As the noble Baroness, Lady Smith, pointed out, when your Lordships’ House debated this issue four months ago, it took the view that the UK should unilaterally guarantee the rights of EU citizens in the UK. We on these Benches continue to believe that the Government should unilaterally guarantee EU nationals the right to stay in the UK now. It is to be regretted that it has taken so long for the Government to attempt to provide any certainty about their future status. The very fact that the Government have today announced a series of issues and proposals that are dependent on reciprocal decisions by the EU means that there is still no certainty or clarity for EU citizens living in this country.

I turn to some of the specific proposals in the Government’s document today. First, there is still no specified cut-off date. Can the Leader of the House explain why the Government have left that open and, in doing so, extended the uncertainty of people who are thinking about whether they might come from the EU to the UK at some point over the next couple of years, when they could have made a decision to specify the date today? At what point and by what process do the Government plan to announce a cut-off date?

Secondly, it is not clear how long the application process for residence status will take. We know about the huge backlogs in dealing with such questions at the moment. Do the Government plan to resource the relevant agencies properly so that applications, albeit in their cut-down form, can be dealt with speedily? What assessment have the Government made of how many EU citizens currently resident in the UK will need to apply for the new residence status?

The Government talk about avoiding a cliff edge at the point at which EU citizens cease to be able to settle freely in the UK, and propose a two-year period during which there will be a generic umbrella of temporary leave to remain. Do the two years apply to the period during which EU citizens must apply for residence status, or do the Government envisage that we will have processed all requests for residence status within the two years—and, indeed, that everybody wishing to achieve that status will need to have achieved it by the end of the two-year period?

The document states:

“Obtaining settled status will be subject to meeting certain requirements. The eligibility criteria will be set out in UK law”.


Could the Leader of the House give some further idea of what sort of requirements are envisaged? Will the UK law referred to be in primary or secondary legislation? Is this what is envisaged to be covered in the new immigration Bill and, if so, when do the Government plan to publish that Bill?

Finally, to take up another point mentioned by the noble Baroness, Lady Smith, today’s documents states that:

“Obtaining documentation showing their settled status will enable EU citizens resident here to carry on living here lawfully”.


But it then states about that documentation:

“The Home Office may also need to capture evidence of EU citizens’ biometric information during the application process”.


That raises concerns that what is being proposed is ID cards just for EU nationals with settled status. Can the Government guarantee that this new status will not require EU nationals who receive it to carry documentation signalling their status and this will not amount to an ID card? If there were to be some kind of ID card, could the Leader of the House set out how much the Government would expect such a policy might cost and how they might expect it to work—particularly given that it would result in only a small minority of those living in the UK being required to carry such cards?

This Statement and the policy paper begin to answer the many questions that EU citizens have about their future status in the UK, but it leaves many unanswered. The Government need to answer those questions quickly to bring about the certainty that they claim to seek.

My Lords, I am grateful to the noble Baroness and the noble Lord for their comments today. As I said, this Council is the first to follow the formal start of negotiations for our departure from the EU, and it shows that we will continue to play a full part in Europe as reliable partners and as friends and neighbours.

The noble Lord and the noble Baroness asked about the Prime Minister’s involvement in the summit. As the Prime Minister made clear in the Statement, she led on the discussion on internal security and tackling online extremism, which built on discussions that she had had bilaterally with President Macron—and, of course, also complements work that has been done with the G7 and which will be pushed within the G20. We will obviously need to work with our EU partners on how we have a continuing voice in these discussions at an EU level, but it is clear that we have a voice at a global one. We are a member of a variety of institutions and organisations in which we will continue to play a key role. It is also clear that we have very strong expertise and knowledge in this area. Our EU partners value this and we want to continue to work together to make sure we can all benefit from joint communication and collaboration. As the negotiations continue it will become clear that that is as much in our interests as it is in those of our EU partners.

The noble Baroness asked about defence. The Prime Minister made it very clear that the UK supports the development of capabilities, such as the European action plan and European defence fund, which contribute to our collective resilience and our ability to combat shared threats. We must continue to create a genuine internal defence market, not a protectionist one, and we will continue to work with the EU to achieve that. I do not have the information to hand to answer the noble Baroness’s questions about the number of employees in agencies and relocation, but I will write to her with it. The Prime Minister welcomed the recent progress made across the EU on delivering the digital single market strategy and we want to continue that work. We have been clear in our support of the letter on the joint digital initiative and welcome the Commission’s plan to introduce a legislative proposal to prevent unjustified data localisation.

The noble Baroness asked about the Northern Irish and Irish border. She will know that we agreed, in the first negotiation last week, that there will be regular and technical talks. There was a very early emphasis on four key issues: the rights of citizens is one but that border is another. We are absolutely determined to try to move those discussions on as quickly as we can.

The noble Lord and the noble Baroness asked a number of questions about the paper on EU citizens. Once we exit, we will be asking EU citizens to have a new status and document. I am not saying it will be an ID card—we have not discussed in detail what it will be—but it is true that there will be new documentation. We will be asking EU citizens to apply to the Home Office for this documentation demonstrating their new settled status in due course, in line with what most nationals in the EU currently do. As I also said in the Statement, the reaction from EU leaders was broadly positive and this is a good basis for discussion. The fact that we have published such a detailed proposal shows the seriousness with which we are taking this issue. Noble Lords have discussed it at great length and we have had a lot of passionate debate about it. The fact that we have come out early and now have a detailed document as a starting point shows the seriousness with which we also take the issue.

The noble Lord, Lord Newby, asked about the specified cut-off date. This will be a matter for negotiation and, as I said previously, we made it clear that this will be an early priority. He also asked about the legal basis. We want to see the outcome of our negotiation with the EU on citizens’ rights included in the withdrawal treaty. This will be binding on the EU 27 under EU law and on the UK as a matter of international law. Rights will be enforceable in the UK legal system up to and including the Supreme Court. The new immigration Bill will be about setting out our future system and we will be bringing forward proposals before that, later in the year.

My noble friend makes a very good point. Certainly, the initial discussions were positive. We are both starting to identify our priorities. We all want to achieve the best possible outcome and the strongest possible partnership, one that works for the UK and the EU. Now that we are around the negotiating table, that is what we will all be working for.

Will the Leader of the House confirm that what I am about to say is accurate? Everyone in this House has two citizenships—one is normally United Kingdom citizenship and the other European citizenship. European citizenship is conferred by the treaty of Maastricht and the rights it confers are enforceable and protected by the European Court of Justice. Therefore, my first question is: if that is right, does my doctor, who is a German living in this country, have European citizenship rights protected by the European Court of Justice? My second question is: what about people like me, who are British citizens and European citizens under the treaty of Maastricht? The Government cannot take away the rights of EU nationals under the treaty of Maastricht, which are protected by the Luxembourg court. However, do they intend that British citizens will be in a worse position as we will no longer be protected by the European Court of Justice and will not have the rights conferred by the treaty of Maastricht?

I believe that our legal system is second to none and we should be very proud of it. The proposed agreements will be enshrined in UK law and enforceable through the UK judicial system, up to and including the Supreme Court. We are also ready to make commitments in the withdrawal agreement which will have the status of international law. We will discuss with the EU how to ensure that UK nationals in the EU will be able to rely on their rights that are agreed.

My Lords, I welcome the Statement, which contained some very important principles on citizens’ rights. However, will my noble friend confirm that the actual outcome will depend upon negotiation, and therefore it is rather important not to set out any premature red lines? Furthermore, we must be imaginative in trying to resolve differences. For example, with regard to judicial supervision of the ultimate rights, surely we should contemplate the possibility of EU judges sitting alongside UK judges in British courts or tribunals in appropriate cases.

I thank my noble friend. The Government believe that we have set out a fair and serious offer. We have put a detailed proposal forward which will now be for negotiation. The next round of negotiation and discussion begins next month. We now have a fair and serious offer with which to begin our discussions.

My Lords, the noble Baroness was keen to say that the residence documentation that EU citizens will be required to hold is not an ID card but a residence card backed by a biometric database. If and when EU citizens say that it is discriminatory to require them to hold ID cards, does this herald the backdoor introduction of a national ID card scheme, which was one of the issues which caused Secretary of State David Davis to resign in 2008, calling it an,

“insidious and relentless erosion of civil liberties”?

I have been pretty clear that we have said that once we leave the EU there will need to be a new settled status and documentation. I have been very clear as well that we have not specified exactly what that will be. However, I am sure that everyone will be pleased to know that the administration of the system will be streamlined and as user-friendly as possible, and that we intend to improve the process and remove some of the technical requirements currently needed to obtain permanent residence under EU rules, such as not requiring anyone to demonstrate that they have held comprehensive sickness insurance.

My Lords, with reference to the comments made by the noble Baroness, Lady Smith, Belgian MEP Guy Verhofstadt has suggested an associate membership for any UK citizen who wishes to retain a European passport to travel, work and study abroad. Can that membership be considered as part of future discussions?

My Lords, the Prime Minister has said that Britons who live elsewhere and are pensioners at the specified cut-off date will, as at present, have access to healthcare elsewhere in Europe after we leave the European Union. Are we therefore to infer from that that those who live elsewhere in Europe and become pensioners after the specified cut-off date will lose access to UK-funded healthcare; and that people who move elsewhere in Europe after the specified cut-off date, even though they are pensioners, will not have access to healthcare? On the European health insurance card, can my noble friend explain the rationale for the British taxpayer funding health insurance after we leave the European Union for a family that visits France but not for a family that visits Florida?

We intend to treat EU citizens with settled status in the same way as if they were UK citizens for the purpose of not just healthcare but education, benefits and pensions, and we intend to protect the current healthcare arrangements for EU citizens who are ordinarily resident in the UK before the specified date. We will also continue to export and uprate the state pension and provide associated healthcare cover within the EU. We want, subject to negotiations, to continue to participate in the European health insurance card scheme, and we will try to achieve that.

My Lords, will the noble Baroness agree that when it comes to jobs requiring foreign language skills, the UK is highly dependent on other EU nationals? For example, over a third of public service interpreters who work in the National Health Service and the criminal justice system are from other EU countries, as are 35% of language teachers and 85% of language assistants in our schools. Therefore, while the possibility that EU nationals already here might now be able to remain is welcome, does the noble Baroness agree that future recruitment of EU citizens needed for their language skills also needs to be safeguarded and prioritised through whatever new immigration regime emerges from these negotiations?

I know that this issue is very dear to the noble Baroness’s heart and to many of us in this House. Of course, we want to continue to attract the bright and the best. As I mentioned, later on there will be plenty of opportunity for noble Lords to discuss the future immigration system, which her question alludes to. It will of course be implemented in primary legislation, so there will be plenty of opportunities for noble Lords to have an input. We also want and intend to continue to recognise professional qualifications obtained in the EU 27 prior to the UK’s withdrawal from the EU and vice versa. We will certainly keep those issues in mind, because we want to ensure that we continue to attract the bright and the best from the EU.

My Lords, if, as my noble friend said—I welcome it—we want to recognise the special status of EU citizens resident in this country, what is the overwhelming argument against what this House decided it wanted, by a large majority: namely, a unilateral declaration, where we take the moral high ground and give these rights, and hope very much that they will be reciprocated? Why cannot we begin the negotiations by taking control and putting this issue behind us?

My Lords, is the noble Baroness aware, as I am from several emails, of families of joint EU nationals whose lives are being directly affected by this? We could move very swiftly to guarantee our citizens’ and EU citizens’ rights by remaining within the single market and reinforcing the conditionality of freedom of movement.

As I said, we believe that this is a fair and serious offer. It is one that we want to implement because we want to provide as much certainty as we can to the 3 million EU citizens in the UK and to the 1 million UK nationals in the EU, and that is what we are working towards.

My Lords, does my noble friend not feel that she is in a no-win position? On the one hand, people are saying that she ought to make a unilateral declaration and abandon the rights of British citizens living in Europe; on the other, she is being told that it is wrong to put forward red lines at this stage in the negotiations.

I thank my noble friend. As I said, we are taking this matter extremely seriously and it is one of the first issues that we have raised in the negotiations. We have put forward a comprehensive offer and look forward to discussions. As I said, our partners in the EU are keen to sort out this issue as soon as possible, as are we, and this is a starting point from which we hope to begin detailed discussions next month.

My Lords, the Brexit Secretary has stressed that in the negotiations nothing is agreed until everything is agreed. Does that not mean that on some issues there will be so much delay that particular interests, whether individual citizens or financial institutions, will take action ahead of any agreement and may, for example, have already left the United Kingdom?

My noble friend raises an important issue and that is why we are trying to discuss this matter at a very early stage. We want to see whether, with the EU, we can come forward with proposals that give people the certainty they want, and we believe that we have put forward a fair and serious offer to begin those discussions.

Are the Government considering extending the new proposal for some form of identification card for immigrants from the EU to the majority of immigrants to this country who come from outside the EU? Will that be in the forthcoming immigration Bill? It seems rather illogical to introduce this sort of scheme for people moving to this country from inside the EU but not for the majority of immigrants who, every year since we have worried about immigration, come from the rest of the world. Therefore, would it not be appropriate for the Government to propose a general scheme for foreigners within Britain—perhaps under something called the “Aliens Act”?

My Lords, the noble Baroness talks about a fair and serious offer but it is not heard in that way by those affected. Is she aware of the number of EU citizens who are now leaving this country because they feel unwelcome and because they feel that, if they do not get back to their country of origin, they may lose the opportunity of finding work there? For them, settling this is a very urgent matter.

I am very well aware of the issues that concern many people and of the anxiety felt by some. That is why we have brought forward these proposals urgently; it is why we have been very clear that under the plans we would like to bring forward no EU citizen who is currently in the UK lawfully will be asked to leave; it is why the Statement makes it very clear that we do not want families to break up; and it is why we have brought this proposal forward at this point and why we will be attempting to get an early agreement.

Is this issue representative of the way the Government are going to conduct these negotiations as a whole? I was very taken by the point made about the potential for people and businesses to take action and vote with their feet in the absence of a clear commitment on this issue. I must admit that I find that to be true in respect of other issues that will be part of the negotiations.

There are two points that I should like the noble Baroness to respond to. First, if we keep going round in circles saying that this “might” be the proposition but it depends on the other side coming up with something sensible, we will potentially never resolve anything. Secondly, in spite of the way that the Conservative Party has been trying to portray the Brexit vote, it was quite marginal. The reality is that we are a deeply riven country. When will the Government come forward with a proposal to deal with the issues in the negotiations that includes wide, involving engagement with opinion formers, decision-makers and the public of this country, before they go to Europe with a proposition? At the moment, it feels as though the Government open the black box and let us peer in, then ask, “What do you think of that?”. We all say it is terrible and then they shut the box and the issue remains unresolved.

Over the past year, since the referendum result, the Government have engaged extremely widely with a range of representatives from groups and organisations to feed into our thinking. For instance, DExEU has conducted analysis of more than 50 sectors of the economy, covering financial services, retail, agriculture, energy, infrastructure and transport. In your Lordships’ House we have had a lot of debate, and the Select Committees have published very useful reports to help feed into that thinking. We have put in place a solid foundation for further discussions, admittedly under an ambitious timetable. The UK and EU teams will meet every four weeks, coming together for a number of days at a time to progress discussions as quickly and effectively as possible. We have now started the negotiations and therefore hope that we will see progress, which we have not seen over the past year because we had not triggered Article 50.

My Lords, although I regret that this announcement did not come earlier and is not unilateral, I none the less welcome that the Government have at least made some progress. However, there is discussion in the document about the fees for the new scheme being set at reasonable levels. Given that the current fee for settled status is almost £2,000, and given that the change of status for EU citizens has come about through no fault of their own but by a decision from which we are excluded, does the Minister think it right that the Government should carry this out with no fee whatever to EU citizens?

I can certainly assure the noble Lord that fees and charges are being looked at as part of the negotiations. I can only repeat that our aim is to offer a streamlined and high-quality service for everyone and to keep fees at a reasonable level.

My Lords, I am sorry to return to the noble Baroness, but I asked two questions on settled status that she was not able to address. First, can we do anything better than ask 180,000 people who have already applied to apply again under the new status, alongside the costs that that will incur for them? Secondly, will all the applications be dealt with in two years and, if not, are the Government guaranteed access to EU databases to get the information required? The Minister did not answer either of those questions, and if she is unable to do so today, will she write to me?

My Lords, with the leave of the House I will now repeat a Statement made by my right honourable friend the Prime Minister in another place. The Statement is as follows:

“With permission, Mr Speaker, I would like to make a Statement on the disaster at Grenfell Tower. I would like to start by apologising to the Leader of the Opposition for the short notice he has had of this Statement. I received an important update in the hour before making this Statement which I felt was essential to bring to the attention of the House this morning.

What happened in the early hours of last Wednesday morning was one of the most unimaginable tragedies our country has seen in many years. As of this morning, 79 people have been confirmed dead or listed as missing presumed dead, and with work ongoing to recover the bodies, sadly the death toll may rise further. We already know that many children are among the dead and that in some cases whole families perished, and that those who survived have lost loved ones, friends, neighbours and in many cases everything they own.

It should never have happened. In a few moments I will say how we are going to discover why it did. But, as I said yesterday, that initial failure was compounded by the fact that the support on the ground in the initial hours was not good enough. As Prime Minister, I have apologised for that second failure and taken responsibility for doing what we can to put it right.

On my first visit to north Kensington, I met with the emergency services. These extraordinary men and women put their lives on the line in an effort to save others, and my first responsibility was to check that they had all the resources they needed. I then visited Chelsea and Westminster Hospital, where I met some of the most seriously injured survivors—it was from that experience that I decided we had to have an emergency fund. I also met a group of residents in Kensington, whom I then invited to Downing Street last weekend. I returned to Kensington again last night to hear directly from them about the progress that we are making.

What became clear very quickly was that the Royal Borough of Kensington and Chelsea could not cope, and it is right that the chief executive officer has now resigned. It is also why I set up the Grenfell Tower Recovery Taskforce, which I have been chairing personally.

But this is not just about the steps we take in the first few weeks; it is about a lasting commitment that we are making to supporting the families affected, long after the television cameras have gone. So let me set out in detail the steps that we are taking to support the victims and rehouse those who have lost their homes.

On Friday morning, the Government established a central command centre under the leadership of John Barradell, the chief executive of the City of London and former lead for London local government on resilience, and Eleanor Kelly, the chief executive of the London Borough of Southwark. On behalf of the whole House, I want to thank John and his team for all the work they are doing.

I also want to pay tribute to the fantastic response from London boroughs, including a number of chief executives who are currently working at the command centre, as well as the Mayor of London and leading figures from a number of councils from outside London. I want to thank the army of volunteers who stepped in to provide shelter, sustenance, comfort and practical support. And I want to thank my Communities Secretary and the Ministers for Housing and Planning, the Minister for London and the Minister for Policing and the Fire Service for the work they have been doing.

There are currently around 600 people on the site and in the immediate area who are working to provide support to the victims. The Westway sports centre has been transformed into an emergency community hub, staffed by 40 officials from six government departments. They are making sure that people have essential documents such as driving licences and passports that are fundamental to carrying on with their lives. They have also been joined by experts from organisations such as Transport for London, Citizens Advice and the Red Cross, and by NHS mental health staff, nurses, care managers and a GP. Anyone affected by the blaze can walk in and access the support they need, and so far there have been almost 700 visits to the centre. The centre’s on-the-ground work is supplemented by the victim support unit, whose emergency helpline provides a single point of contact for victims who need to deal with multiple government services in the wake of the disaster.

Each family whose home was destroyed is receiving a £5,000 down payment from the emergency fund so that they can buy food, clothes and other essentials, and outreach workers are seeking to make sure that everyone gets the money they are entitled to. We are also paying all additional adults over 16 in these households £500 in cash. Other cash payments are being paid out by the council on a discretionary basis—for example, to those whose home has been severely impacted but not permanently destroyed. As of midday on Wednesday we had made payments of over £700,000.

It is absolutely essential that people understand that they can keep the money they receive; these grants are not loans and they will not be expected to repay a single penny. Neither are they waiving any legal rights as a result of accepting this financial help. The payments will be disregarded for means-tested welfare payments, so no one in receipt of benefits will see their benefits cut if they accept emergency support.

I would also like to reassure people that we will not use this tragic incident as a reason to carry out immigration checks on those involved or on those providing vital information to identify victims or those assisting with the criminal investigation. We will make sure that all victims, irrespective of their immigration status, can access the services they need, including healthcare and accommodation.

In terms of local schools, Kensington Aldridge Academy, the school right next door to the tower, remains closed. However, all its pupils have already been accommodated at other schools in the area. The Department for Education is working with Ofqual to ensure that children who are sitting their GCSEs receive an appropriate exam dispensation, and specialist counselling has been offered to local schoolchildren and also to teachers affected by the fire.

Turning to rehousing, 151 homes were destroyed in the fire—most in the tower itself but also several in the immediate vicinity. All those who have lost their homes have been offered emergency hotel accommodation, and all will be offered rehousing within three weeks. Already, 164 suitable properties have been identified, and they are being checked and made ready for people to move into.

In the longer term, everyone whose home was destroyed will be guaranteed a new home on the same terms as the one they lost. Sixty-eight of those will be in a brand-new low-rise block that has just been built by Berkeley Homes. The developer has generously offered to turn over the entire block at cost price. Contractors are on site now, working 24/7 to speed up fit-out so that the first families can move in this summer.

Within the wider cordon area, many more homes were damaged by smoke or water or have lost gas, heating and hot water. Emergency hotel accommodation is available for anyone who does not want to remain in a damaged property, and over 100 hotel rooms have already been provided. We are also putting in place practical support to help accelerate necessary repairs and yesterday drew on expertise from the Army to assist with this.

Some survivors have said that they want to leave the local area, and we will of course support that and help them find a home elsewhere. But I want to be absolutely clear: nobody is being forced to move somewhere they do not want to go. If any honourable Member thinks they know of anyone being treated in this way, they should contact my office in Downing Street with the details.

As the scale of the tragedy became clear, we quickly decided that there had to be an independent public inquiry. As I said to the House yesterday, it will be chaired by a judge to get to the truth about what happened and who was responsible, and to provide justice for the victims and their families, who suffered so terribly. All those with an interest, including survivors and victims’ families, will be consulted about the terms of reference, and we will pay for legal representation for those affected.

Listening to survivors last night, it also became clear that they want support to come together as a group to have their voices heard, and the Government will play our part in helping them to do so. For too long, residents have been overlooked and ignored. We will ensure that they are involved in every step of this process. No stone will be left unturned in this inquiry and, for any guilty parties, there will be nowhere to hide.

I am also clear that we cannot wait for ages to learn the immediate lessons, and so I expect that the chair of the inquiry will want to produce an interim report as early as possible.

I know that many others living in tall residential buildings will have concerns about their safety after what happened at Grenfell. All social landlords have been instructed to carry out additional fire safety checks on tower blocks and ensure that the appropriate safety and response measures are in place. This is being done in co-operation with local fire and rescue services. We have also taken steps to make private landlords aware and have made our checking facilities available to them for free.

The House should, of course, be careful on speculating what caused this fire, but as a precaution the Government have arranged to test cladding in all relevant tower blocks. Shortly before I came to the Chamber, I was informed that a number of these tests have come back as combustible. The relevant local authorities and local fire services have been informed and, as I speak, they are taking all possible steps to ensure buildings are safe and to inform affected residents. Immediately after this Statement, the Department for Communities and Local Government will contact any MPs whose constituents are affected, and the Communities Secretary will provide a further update later today.

We can test over 100 buildings a day, and the results come within hours. I urge any landlord who owns a building of this kind to send samples for testing as soon as possible. Any results will be communicated immediately to local authorities and local fire services. Landlords have a legal obligation to provide safe buildings and, where they cannot do that, we expect alternative accommodation to be provided. We cannot and will not ask people to live in unsafe homes.

It is clear that the Royal Borough of Kensington and Chelsea was not able to cope with the scale of the tragedy, so we will also develop a new strategy for resilience in major disasters, which could include a new civil disaster response taskforce that can help at times of emergency.

Finally, we must learn some of the lessons of this and previous disasters where bereaved families have not had the support they need. We will introduce an independent public advocate for public disasters, a strong independent voice for victims and on behalf of bereaved families, supporting them at public inquests and inquiries.

In the past week, a lot of remarkable people have gone above and beyond to help deal with the fire and its aftermath. First and foremost, of course, are the incredible men and women of the emergency services who did so much to save so many lives. I cannot imagine the kind of bravery it takes to run into a burning building and head upstairs when any normal person would head for the exits. But we have also seen sterling work from people across the public sector—teachers, nurses, staff from various local authorities and civil servants—who are doing all they can to help. We have seen incredible acts of generosity from private businesses, and we have seen the people of this great city and this great country stepping up to help in any way they can, by donating money, clothes, toys and food, volunteering their time, and so much more.

But, above all, I want to pay tribute to the people of Kensington, who have opened their hearts and homes to people affected by the fire, coming together and showing what a real community looks like. The selfless actions of local people and the courage and resilience of the survivors should give us all pause for thought.

Right now, our focus is on supporting the victims, finding homes for those made homeless and making sure this country’s housing stock is as safe as possible. But as we move forwards, so we must also recognise that for too long in our country, under Governments of both colours, we simply have not given enough attention to social housing. That itself is actually a symptom of an even more fundamental issue.

It should not take a disaster of this kind for us to remember that there are people in Britain today living lives that are so far removed from those that many here in Westminster enjoy—that in this tower, just a few miles from the Houses of Parliament, and in the heart of our great city, people live a fundamentally different life, do not feel the state works for them and are therefore mistrustful of it. So, long after the TV cameras have gone and the world has moved on, let the legacy of this awful tragedy be that we resolve never to forget these people and instead gear our policies and thinking towards making their lives better and bringing them into the political process. It is our job as a Government, and I believe as a Parliament, to show we are listening and that we will stand up for them. That is what I am determined we should do. I commend this Statement to the House”.

My Lords, I, too, thank the noble Baroness the Leader of the House for repeating the extremely comprehensive Statement. I take the opportunity to pay tribute to all those who lost their lives in the tragedy; our sympathies are, of course, with all those residents who will have to rebuild their lives after such a horrific event and with the families of those affected. I also put on record again the huge debt of gratitude that we owe to those in the fire service and all the emergency services who worked tirelessly to rescue residents and support families in the immediate circumstances of the fire, and in the almost as bad circumstances of having to sift through the building day after day to see what they could find in the wreckage.

There was a huge gulf in the response to this tragedy between the public and the Government. The public acted immediately and with great generosity. Government, both national and local, acted slowly and, initially at least, without the same energy or generosity. It took the Government 48 hours to establish a central command centre, for example, and the borough council seemed unprepared and overwhelmed. If this had been a terrorist attack, the response would have been far more effective—we saw that in London only a few days ago. Things that have, for example, taken 48 hours in this case, would, in the case of a terrorist attack, be in place within 48 minutes. There was clearly a failure of emergency planning for this kind of incident, which we do not see for terrorist attacks, for which emergency planning is clearly extremely good. So I ask the Government: what immediate steps are being taken to ensure that such a failure will not be replicated in any future non-terrorist incident?

The Government say that they welcome—and indeed precipitated—the resignation of the chief executive of Kensington and Chelsea council. But what about the leader of the council? It was a political decision to stockpile huge cash reserves while apparently skimping on safety measures. Will the Government now be asking him to resign also?

We welcome the public inquiry that has been announced by the Prime Minister. We must obviously ask a raft of difficult questions, including why the fire spread so quickly and why the lessons of the past seem not to have been learned, but there are obvious concerns about how long such an inquiry might last. History is not very encouraging in this respect. Can the Leader of the House give any further assurances in terms of both the speed with which any interim recommendations might be produced and how we can ensure that the full inquiry does not drag on for years?

The Statement says that a number of tests already carried out have shown other blocks to be clad in combustible materials, and the Government claim that all local authorities and fire services are now taking all possible steps to ensure buildings are safe. Given that some—indeed many—of these steps will be costly, can the Government give an assurance today that they will not be delayed by any shortage of funding? In the case of such buildings which are privately owned, what steps beyond exhortation will the Government take to ensure that the owners fulfil their legal obligations to provide safe buildings?

It is clear that, when the tests on all these buildings are complete, there will be a need for large-scale remedial action. If there are 600 blocks, there will be a vast amount of work that needs doing quickly. This can be undertaken only by skilled workers in the construction sector. Given that there is already a shortage of such skills, particularly in London, and that 50% of the construction workforce in London is from the EU, can the noble Baroness give an assurance that, as the Brexit talks proceed, every encouragement will be given to such workers to continue to come to London, as any major labour shortage in this area could be literally a matter of life and death?

There are a number of issues in the Statement that could legitimately give rise to anger. But what got to me was the Prime Minister’s peroration. She said:

“It should not take a disaster of this kind for us to remember that there are people in Britain today living lives that are so far removed from those that many here in Westminster enjoy”;


and she went on,

“let the legacy of this awful tragedy be that we resolve never to forget these people and instead to gear our policies and our thinking towards making their lives better and bringing them into the political process. It is our job as a Government … to show we are listening and that we will stand up for them”.

This is a leader of a party who has just stood on an election manifesto to cut spending in schools by 7% and impose big further cuts in welfare payments and local government expenditure. This hypocrisy makes me very angry. Will the noble Baroness the Leader of the House suggest to the Prime Minister that if she really wishes to stand up for people such as the tenants of Grenfell Tower, she should start to adopt policies which follow her words?

I express my thanks to the noble Baroness, Lady Smith, and the noble Lord, Lord Newby, for their comments and contributions today. As we have all recognised, this has been one of the most unimaginable tragedies that we have seen in many years. I once again reiterate that our thoughts at this time are very much with the families and all those affected. I reassure everyone that the Government’s focus is on doing everything possible to help those affected.

Before I respond to some of the points the noble Lords have made, in the light of the tragic events, my noble friend Lord Bourne will provide time to update Peers on the events and the Government’s response. He will host an all-Peers briefing session on Monday 26 June at 3 pm in Room 10A. As the noble Baroness said, given that things are changing regularly, we hope that the comments of my noble friend Lord Bourne on the latest issues will be a very useful update for noble Lords.

I will try to answer as many questions as I can but I shall read noble Lords’ comments, and I apologise if I do not respond to everything at this point. I will try to follow up where I can afterwards. Both the noble Baroness and the noble Lord asked about the public inquiry. I reassure everyone that we want to leave no stone unturned, which is why we have ordered a public, judge-led inquiry. Draft terms of reference have been shared with the Lord Chief Justice and discussions about a potential chair are ongoing. We hope to have a confirmed appointment very shortly. I also reassure noble Lords that the families of victims and other interested parties will be consulted on the terms of reference, as it is essential that their voices are heard, and, as the noble Baroness rightly said, that the whole range of issues that need to be investigated are included in this inquiry.

The noble Baroness asked about the 600 figure, which I should clarify. We think that there may be around 600 buildings which have cladding. That is not to say that is combustible cladding but we think that about 600 buildings have cladding. Landlords are now examining these to see which have aluminium composite material which may need to be tested. Testing will reveal how many have the wrong type of cladding. It is important also to stress that aluminium composite material cladding itself is not dangerous, but it is important that the right type is used. Not all those 600 buildings may have an issue; that is the range of buildings which may need to be looked at. I can also confirm to the noble Lord that the testing being undertaken is free. The Government are providing the funding for that, so funding should not get in the way of testing. Indeed, we are urging all landlords to make sure that they send in samples as quickly as possible. The labs can test about 100 a day and results can be turned around very quickly so we can get very quick responses. Indeed, Camden council announced this morning or this afternoon that it needs to investigate one of its buildings. It has acted very quickly on the information it has received. Therefore, we very much hope that everyone will send their samples in and we will be able to take action as quickly as possible.

The noble Baroness, Lady Smith, asked about the building regulations. Cladding using a composite aluminium panel with a polyethylene core would be non-compliant under current building regulations, as this material should not be used as cladding on buildings over 18 metres in height. It is also important to note that tests are ongoing to identify the exact causes of the fire, but we will, of course, take all steps necessary to prevent this happening again. The cost of dealing with the cladding on buildings will, of course, vary depending on the buildings. It is the landlord’s responsibility to ensure that people are safe but cost considerations should not, and cannot, get in the way of that, so we will look at how we can provide support. We will also obviously work with local authorities where they identify issues to ensure that they have the resources they need to deal with the issues that they may find.

The noble Lord, Lord Newby, commented on the initial response. The Prime Minister has been very clear that we absolutely accept that the initial support for families was simply not good enough. She has apologised and I do so again on behalf of the Government. In terms of actions going forward, one of the actions that we will take is to set up a new civil disaster response task force. That will be part of our procedures going forward, so that we can try to ensure that the suffering people experienced after the event because the response was not good enough does not occur again.

My Lords, I knew this block of flats well as it was part of a complex—about six or eight of them—which was included in the Hammersmith area which I represented for many years. I often went into Grenfell Tower when campaigning for elections. It is important to say that those flats were very spacious inside and were not at all unpopular with residents if—this was the crucial bit—they were managed well. There are questions about management on which my noble friend and others have touched. That is a matter for the inquiry and I do not wish to second-guess it. However—this is very important—my understanding from many people who have made comments, such as residents and organisations or individuals representing residents in that block, is that they warned of a fire risk. If residents or residents’ associations or representatives express concern about fire safety, that should be dealt with as a matter of urgency and immediately, whatever the other concerns. It is far too serious to be put to one side to be looked at later. Sadly, in this context, I note that the chief executive has resigned. I guess that is probably the right thing to do. Having heard the leader of the council’s comments on television soon after the event, I felt that he was out of his depth and did not understand the extreme nature of the horror that had overtaken that block of flats. In those circumstances, I also think that he should consider his position.

I disagree with nothing that the noble Lord has said. As I have said, we want the inquiry to look at all elements of this tragedy to make sure that such things do not happen again. The noble Lord is absolutely right: we have heard a lot of reports of the residents’ groups complaining and putting forward their points of view about their concerns and not being listened to. That is why it is crucial that we get the inquiry set up, that it is judge led and that the voices of families and victims are heard so that we can make sure this does not happen again. I know that is of no comfort to the families who have lost their lives in this but we will have to learn these lessons and make sure that we follow through.

My Lords, as my noble friend outlined, 151 homes have been destroyed. However, has an accurate list been compiled of all the residents of the block? My noble friend outlined that homes will be provided to people on the same terms as the ones they had. Has a clear communication been given that for residents who may have resided in the block without a tenancy agreement, or with a tenancy agreement not authorised by the landlord, that does not matter one jot when it comes to rehousing people and considering the effects of this incident on them? I welcome the Government’s response that the immigration status of anybody in the building is utterly irrelevant to their receiving compensation. Will my noble friend the Leader of the House ask my noble friend Lady Williams to consider earnestly what the Home Office policy will be? Some people may end up in front of Home Office decision-makers. What will be the Government’s policy in relation to any victims who have irregular immigration status?

I am very happy to reiterate that the Government will not use this tragic incident as a reason to carry out immigration checks on those involved and those providing vital information to identify victims. I also reassure the House that we will make sure that all victims, irrespective of their immigration status, will be able to access the services they need, including accommodation and healthcare.

My Lords, I was a councillor in an adjoining ward of Golborne and I am a long-term resident in the area. The Government’s response at last appears to be closer to the scale of the tragedy. How can one justify a council which has given priority to keeping council tax down and which has placed so much emphasis on outsourcing what are in effect its responsibilities in management and housing generally? On visas, will the funeral visas be extended to family members who want to come to this country to help those who have been affected? Finally, did I hear the Leader correctly when she said that she agreed with my noble friend Lord Soley that the council leader should consider his position?

I said that I agreed with much of what the noble Lord, Lord Soley said. It is not for me to make those decisions, but we have all accepted that the response was not good enough, so I think everyone is looking at themselves to see what we can do better in the future. On the noble Lord’s questions about visas, my understanding is—I might need to write to confirm this—that a number of family members in cases where their loved ones and relatives have been involved have already been able to come over. I do not know the exact numbers, but we are already working hard to ensure that at this awful time family members can come over to be with their loved ones.

My Lords, accountability is very important in political life to ensure that the people we take decisions for trust those of us who represent them. The noble Baroness has so far failed to respond to direct questions from my noble friend Lord Newby and the noble Lord, Lord Soley, about the position of the leader of Kensington Borough Council. This was a council-owned building, the council had invested in renovating it, and it went up in flames, destroying the lives of, so far, 79 people. For accountability to be real, should not the leader of the council resign?

As the Prime Minister said in her Statement, we believe that it is right that the chief executive resigned because we have acknowledged all along that there has not been good enough support for the families. As I have also said, the judge-led inquiry will allow us to look at the broader circumstances leading up to and surrounding the tragic fire at Grenfell Tower so that all lessons can be learned by everyone involved.

My Lords, I welcome the Statement and the eventual comprehensive response, and I particularly welcome the speech given by the noble Baroness, the Leader of the Opposition, which was especially powerful and helpful. Having been with voluntary groups at the Grenfell Tower during the day following the fire, I have two questions. First, one of the fire officers we were talking to said, “This is the third once-in-a-generation event in a few weeks”. The number of emergency service people, who for the third time in a very few weeks put their lives on the line and found themselves in a situation of the most absolute horror, seeking to save the victims who were caught in the fire as well as in the previous terrorist incidents, is much higher than would normally be expected. Can the Leader of the House confirm that there will be no budgetary constraints on the emergency services in providing support for those who have been involved in taking these huge risks and that those services will be adequately funded above and beyond their normal provision in supporting those who may need extra support after such a traumatic period? Secondly, one of the other notable things is that around the site of the fire on the following day the faith communities—there is reference in the Statement to volunteers—were working together in a way that completely gave the lie to the divisions that the terrorist attacks had sought to create. This was the most powerful visual image of unity, and of unity around the suffering. Would she agree that those communities also merit mention and commendation?

I am happy to agree with the comments of the most reverend Primate. We also saw a similar coming together of community after the Finsbury Park mosque incident, so I am very happy to endorse everything he said. With regard to the emergency services, again, I think we have all agreed about the emergency services and the bravery of the fire services—the noble Baroness, Lady Smith, spoke very well about that. We saw in their response that they were able to act very quickly and to do everything within their power to save as many people as possible. Of course, we commend all the incredible work that they do.

Is it possible to take into account that there were a lot of people to put the fire out, but where were the people to stop the fire from happening? If you know that particular part of London—Notting Hill and Latimer Road—you will know that over the last 30 or 40 years the council has shifted and ethnically cleansed other parts of the Royal Borough of Kensington and Chelsea, moving them into an area that has become pretty troubled. I want to know what we are going to do about councils that have very rich parts of their borough but do not know how to deal with the poor parts. This has been going on for a considerable period of time. By the way, I speak as an ex-employee of the Royal Borough of Kensington and Chelsea.

Obviously, a lot of work is going on within government to learn the lessons. We are focused on dealing with the immediate aftermath, but as I have also said, we want the inquiry to look at the broader circumstances that led up to the tragic fire, and we will work across government to make sure that we address the issues, whatever they may be, to make sure that this does not happen again.

My Lords, surely the most disturbing aspect of this is that people forecast a terrible fire. Should we not conduct some sort of survey of those living in tower blocks around the country? We are having the cladding examined, but should we not try to find out whether in other parts of the country people living in similar tower blocks have warned the local authorities of their fears? This was an unspeakable disaster, but for another one to happen would be totally unforgivable.

I am sure that local authorities are considering the sorts of issues that my noble friend has mentioned. As I said, what is most important is that we get the cladding checked on these buildings to make sure that we can truly identify where there may be issues and act quickly. That is why we have set up these testing centres, why we are turning round results as quickly as possible, and why we were very pleased, for instance, to see Camden’s very swift and impressive response once it discovered an issue with one of its blocks.

Going back to the inquiry, quantity surveyors, the architects, the main contractors, the subcontractors, the building control officers and the planning officers of the council will all be asked many questions. Will their answers all appear in the interim report and will the findings of the inquiry at that stage also be in the interim report? In particular, I ask that the specifications originally set by the architect and approved, we have to assume, by the building control officers and the fire authorities, will be in the appendices of the interim report so that we can all see them, along with all the approval documentation and survey reports by all the organisations involved. Some of us will be more interested in seeing what is in those documents than reading the report itself, because we will probably want to make up our own mind.

Obviously, it will be for the head of the inquiry to decide exactly how they want to conduct the inquiry. However, as I have said, we want to ensure that voices are heard and that the terms of reference of the inquiry cover all the issues that, rightly, families, victims and others want to see. I therefore assume that the judge who is appointed will be taking soundings and will have views on the terms of reference. I cannot speak for them about what the interim report will include but I think we are all very conscious of the fact that we want this to be done speedily and that we expect an interim report.

Perhaps I may follow on from the questions in relation to the public inquiry and the reference that has just been made to the legislation. Can we please ensure that when people give evidence, they do so in full and do not hide behind the fact that, if they answer certain questions, they might incriminate themselves, which could result in a criminal prosecution? People expect a public inquiry to be full and public, not partially full and partially in public.

As I hope I have made clear to noble Lords, we want a judge-led inquiry. It will be for the person appointed to lead the inquiry and to determine how it works. However, as we have said, we want to make sure that all voices are heard, and I am sure that whoever leads the inquiry will refer to this debate with interest and take account of noble Lords’ comments.

Can the noble Baroness confirm that the Fire Brigades Union asked the Department for Communities and Local Government to update Part B of the building regulations—the fire safety regulations—some time ago and that this has not been done? Especially as she confirmed the element of illegality of certain types of cladding, does she know whether the request was to look in any way at the nature of cladding? Can she also take the opportunity to answer the question asked by my noble friend the Leader of the Opposition about the Government’s future attitude to regulation? It is significant that the Prime Minister says in the Statement that the state has not worked for many people. I suggest that the reason for that is that in recent years it has been so whittled away in respect of important and defensible regulations, not least in relation to planning and housing.

Having listened to the Statement and the comments from the House, I cannot help thinking, as a former housing officer, that this dreadful tragedy is a terrible episode in a systemic failure. I recognise that the Government are making every effort to respond to the tragedy—albeit too late—but I wonder whether the Minister might respond to the systemic issues. There is evidence that a letter was sent to the Housing Minister by the APPG—which consists of experts who know about fire safety in buildings—asking for the regulations to be updated. That advice and request should have been responded to some time ago and it would be a shame if a public inquiry stopped it being responded to now. Equally, the concerns that the Grenfell Tower residents sent to their landlord appear to have been ignored, and it would be a shame if a public inquiry stopped those concerns too being responded to immediately. Similarly, the comments from the noble Lord, Lord Bird, about ethnic cleansing cannot be ignored. I cannot help but notice that the skin colour of a number of the people affected by the tragedy happens to be nearer the shade of my skin than that of others. If we are to respond to the systemic issues of this tragedy as well as the episodic ones, we have to look at the allocations policy in local government housing, at the design of social housing and at the paucity of policy leadership in this area. Perhaps the Minister would care to respond to that.

I can certainly reassure the noble Lord that, although the findings of the public inquiry will of course feed into the work that we are doing, that work will not stop, and we are continuing to work on simplifying the guidance on the fire safety building regulations. Therefore, there will not be a stop on the action but the public inquiry will of course play an important part in helping us to ensure that we have a suitable response across all the issues that have led to this tragic accident.

My Lords, besides the issues of the public inquiry, it will also be necessary to look at the structure of local government taxation. Those of us who live in the middle of London—I live in the City of Westminster, not in the royal borough—are acutely aware of the very low differential between the taxes paid by those of us who live in desirable properties in desirable areas and the amount paid by people who live in less desirable properties in less desirable areas. There really ought to be a bigger bandwidth between the two.

My Lords, it is a pleasure to follow the noble Baroness, Lady Smith, and the noble Lord, Lord Newby, and to support her Motion. I also join all noble Lords in wishing the Duke of Edinburgh a speedy recovery.

It is a great honour to stand here again as Leader of the House following the general election. Now that it is over, this House will once again play an important constitutional role, ensuring that our collective expertise is used to improve the legislation in front of us and to debate the important issues of the day. I have been grateful as Leader to have had as my opposite numbers the noble Baroness and the noble Lord. While we have very robust exchanges at the Dispatch Box, I can reveal that, behind the scenes, we actually have quite friendly and constructive relationships, which are vital to the running of this House. I very much hope that they continue through this Parliament.

It is also a pleasure to add my congratulations to those already expressed to my noble friends Lord Forsyth and Lady Bertin for moving and seconding the humble Address. My noble friend Lord Forsyth has had a long and illustrious parliamentary career, both in your Lordships’ House and in the other place. After serving as the chairman of the Scottish Conservative party under Lady Thatcher, he became the Secretary of State for Scotland between 1995 and 1997—the last time that Scotland had about a dozen Conservative Members in the other place. As a strong supporter of the union, it was very clear from his remarks that he was at least delighted with the results in Scotland.

My noble friend Lady Bertin is the youngest Member of the House. As someone who was also at one point the youngest Member of this House, we share a few things in common. While in my early days here I was not ushered into the officials’ Box, I was regularly mistaken for a researcher and had to show my pass on many occasions to confirm who I was. While I, perhaps luckily, dodged the bullet of giving a seconding speech, youth has been no impediment to my noble friend today, who, as everyone has said, has made an excellent contribution.

On these great days, we recognise the work of the House authorities in making today such a success; they always ensure the smooth running of your Lordships’ House. I know that all noble Lords will join me in thanking all staff for their hard work and good humour, which is hugely appreciated by us all. While we now see a different make-up in relation to Members of the other place, there have been a few changes in your Lordships’ House, too. A number of noble Lords have recently made the decision to retire, and I extend my deepest gratitude to them for their many years of dedicated service and offer my warmest wishes for a relaxing retirement. Sixty-six noble Lords have chosen to retire since 2014, showing that reforms to this House can be successfully implemented if they have support across all Benches.

There have also been a number of changes on the Government’s Front Bench, to which the noble Lord referred. I am very grateful to those who have stepped into new roles, but I put on record my thanks to those stepping down from Front Bench roles—the noble Lords, Lord Bridges and Lord Dunlop, and the noble Baronesses, Lady Neville-Rolfe and Lady Shields. I look forward to their continuing work in the House.

As we have heard, since we last met, our country has endured a number of terrible events: the terrorist attacks on a concert at Manchester Arena, on London Bridge and Borough Market and, only this week, on worshippers outside a mosque in Finsbury Park—and, of course, there was the devastating fire in west London last week. I know, and we have heard, that the whole House is united in horror at these events, and we all express our deepest sympathy and support for the victims, their families and loved ones. I would like to join noble Lords in applauding the professionalism and bravery of our emergency services—the police, ambulance, fire and health services—in the care of those affected. The stories of heroism and generosity that have emerged from these tragic events are a sign of the strength of our great country and people.

With regard to the unimaginable tragedy at Grenfell Tower, the Government are committed to ensuring that all those affected get the right support as quickly as possible and are rehoused at the earliest opportunity. There will be a full public inquiry into those tragic events and, as the noble Baroness, Lady Smith, said, residents’ voices must be heard, so the Government will provide funding for their legal representation to make sure that that happens. I am sure noble Lords will want to discuss what we can learn from this awful tragedy over the coming weeks and months ahead.

The legislative programme laid out today is about recognising and grasping the opportunities that lie ahead for the UK as we leave the EU. It is about delivering Brexit in a way that works for all parts of the UK, while building a stronger, fairer country by strengthening our economy, tackling injustice and promoting opportunity and aspiration. While the election result was not the one that we hoped for, this Government will respond with humility and resolve to the message that we were sent by the electorate. We will work hard every day to gain the trust and confidence of the British people.

First, we need to get Brexit right and so we will have a busy legislative Session, which, your Lordships will be aware, will last for the next two years, with a number of Bills geared towards making a success of leaving the EU. Much has been said recently about what the general election signified about Britain’s decision to leave the EU. The fact is that over 80% of the electorate backed the two major parties, both of which campaigned on manifestos that said we should honour the democratic decision of the British people. While this Government will be one that consults and listens, we are clear that we are going to see Brexit through, working with Parliament, business, the devolved Administrations and others to ensure a smooth and orderly withdrawal.

Secondly, last year’s referendum vote was not just a vote to leave the EU; it was a profound and justified expression that our country often does not work in the way that it should for millions of ordinary working families. For that reason, we will work to build a stronger economy so that we can improve people’s living standards and fund the public services on which we all depend. At the same time, we will work to build a fairer society where people can go as far as their talents will take them and no one is held back because of their background. As the noble Baroness highlighted, we will improve protection for victims of domestic violence and we will make further progress to tackle discrimination on the basis of mental health—as was so powerfully expressed by my noble friend Lord Forsyth—sexuality, faith, disability, gender or race.

Thirdly, keeping our country safe is the first duty of any Government. We will bring forward measures to give those who bravely serve our country in the Armed Forces more flexibility in the way they live and work and to ensure that critical national infrastructure is protected to safeguard our national security. We will also set up a new commission for countering extremism.

Finally, the Government will do everything in their power to strengthen our union, taking seriously our responsibility to govern for the whole country and seeking to work closely with the devolved Administrations. We will also work with all parties in Northern Ireland to support the return of devolved government that we all wish to see.

This is a Government with purpose: we are determined to deliver the best Brexit deal; intent on building a stronger economy and a fairer society; committed to keeping our country safe, enhancing our standing in the wider world; and bringing our United Kingdom closer together. We want, as I know noble Lords across this House do, to put ourselves at the service of millions of ordinary working people for whom we will work every day in the national interest. I support the Motion.

My Lords, I beg to acquaint the House that a Commission has been issued under Her Majesty’s Great Seal to several Lords therein named authorising the said Lords to declare in the name and on behalf of Her Majesty Her Majesty’s approbation of the choice of the Commons of Mr John Bercow to be their Speaker.

Then, the Lords Commissioners (the Lord Privy Seal (Baroness Evans of Bowes Park), the Lord Speaker (Lord Fowler), Baroness Smith of Basildon, Lord Newby and Lord Hope of Craighead) being robed and seated in front of the Throne, the Lord Privy Seal directed Black Rod as follows:

Let the Commons know that the Lords Commissioners desire their immediate attendance in this House.

Then, the Commons being at the Bar, Mr Speaker-Elect (Mr John Bercow), addressing the Royal Commissioners, said:

My Lords, I have to acquaint your Lordships that, in obedience to the Royal Command, Her Majesty’s faithful Commons have, in the exercise of their undoubted rights and privileges, proceeded to the election of a Speaker, and that their choice has fallen upon myself. I therefore present myself to your Lordships’ Bar and submit myself with all humility to Her Majesty’s gracious Approbation.

My Lords, it not being convenient for Her Majesty personally to be present here this day, she has been pleased to cause a Commission under the Great Seal to be prepared for proroguing this present Parliament.

When the Commons were present at the Bar, the Lord Privy Seal continued:

My Lords and Members of the House of Commons, Her Majesty, not thinking fit to be personally present here at this time, has been pleased to cause a Commission to be issued under the Great Seal, and thereby given Her Royal Assent to divers Acts which have been agreed upon by both Houses of Parliament, the Titles whereof are particularly mentioned, and by the said Commission has commanded us to declare and notify Her Royal Assent to the said several Acts, in the presence of you the Lords and Commons assembled for that purpose; and has also assigned to us and other Lords directed full power and authority in Her Majesty’s name to prorogue this Parliament. Which commission you will now hear read.

A Commission for Royal Assent and Prorogation was read, after which the Lord Privy Seal continued:

My Lords, in obedience to Her Majesty’s Commands, and by virtue of the Commission which has been now read, we do declare and notify to you, the Lords Spiritual and Temporal and Commons in Parliament assembled, that Her Majesty has given Her Royal Assent to the Acts in the Commission mentioned; and the Clerks are required to pass the same in the usual Form and Words.
