I thank the Backbench Business Committee for agreeing to hold this important debate. We had a similar debate in September 2015, initiated by the hon. Member for Bath (Ben Howlett) and myself.

Hartlepool magistrates court and county court are scheduled for closure by the Government, which is why I wanted to raise the issue in September. That debate obviously fell on deaf ears, as Hartlepool remains scheduled for closure, as do 86 of the 91 magistrates courts that were identified. I mentioned in September that I had serious reservations about the proposals. Those reservations remain. My concerns are shared by the Law Society, which recommends that Hartlepool magistrates court and county court remain open.

There is nothing lacking in the facilities in Hartlepool. I understand that in other parts of the country magistrates courts have been earmarked for closure because they have failed to comply with the Equality Act 2010 or are lacking in security. Hartlepool has none of that. We have a prison video link, separate waiting facilities for prosecution and defence witnesses, and interview rooms. The consultation document itself concedes that if the proposed closure goes ahead, reconfiguration of the hearing space at Teesside magistrates court, which is where the magistrates would go, would be required; and I do not know how much that would cost.

That brings me to an additional point—that of the costs that will be saved by the proposal to close Hartlepool. I understand that the consultation is being driven primarily by a desire to reduce costs. The Minister has said on many occasions that the courts estate costs around half a billion pounds a year, and that he wants to drive that down, but I question whether the closure of Hartlepool magistrates court will reduce costs at all.

There is a real lack of transparency on this matter. Hartlepool magistrates court and county court have operating costs of about £345,000 a year. The Minister has never been able to explain to me how savings will be made. I would imagine that a large proportion of those costs will be staff expenditure. Eight members of staff work at the magistrates court and seven full-time members work at Hartlepool county court. If there is going to be redundancy, which I imagine is the only way forward although it is still difficult to find out why, those are job losses that Hartlepool can ill afford.

It was announced last week that unemployment in Hartlepool increased in February, to 2,747 claimants. Although unemployment in the UK fell in the past year by 11%, the jobless rate in my constituency actually rose in the past 12 months, by 11.8%. Hartlepool is now the 11th worst-affected constituency in the entire country for unemployment. At a rate of 6.5%, it is over two and a half times the national rate. We simply cannot afford any more job losses, especially those that have been initiated by the Government.

Another reservation is about the building in which Hartlepool magistrates court and county court operate. It is not freehold. The Government cannot realise any value by selling off the building. The consultation document states that the Government want

“To maximise the capital receipts from surplus estate for reinvestment in HM Courts & Tribunals Service”.

That aim will not be met by closing Hartlepool down. It is a leasehold property with a significant number of years still to run. The building is owned by Hartlepool Borough Council. I asked the Minister this before, and I have never received an answer so I will ask him again: how much will it cost to break the lease? Is the Minister considering whole-of-government efficiencies rather than taking a silo-based approach in terms of what he has to achieve for his individual Ministry? Does he not think that he is transferring financial pressures from his own Department on to hard-pressed local government?

I mentioned in the September debate that the criteria by which the courts would be closed seem opaque. On 9 September 2015 I tabled a parliamentary question about the cost-per-case across magistrates courts in England and Wales, including those in Hartlepool and Teesside. That seemed to me to be a reasonable metric with which to evaluate relative efficiencies across different operating units—it is what business does all the time. But the answer I received from the Minister stated:

“The information is not available centrally and could only be provided at disproportionate cost.”

If that metric is not being used, what is? How can relative performance and effectiveness across the estate be evaluated in a consistent manner? I contend strongly that I do not think the closure of Hartlepool magistrates court will save the Government any money.

However, my central concern, which has been raised by several hon. Members throughout today’s debate, is that my constituents will be inconvenienced in their access to local justice. The consultation document “Proposal on the provision of court and tribunal services in the North East region” said of Hartlepool that,

“there are excellent road, rail and bus links.”

The person who wrote that has never been to my part of the world. It is absolutely ludicrous to suggest that. Public transport in Teesside is appalling. Somebody from Hartlepool required to be at Teesside magistrates court for an early morning hearing and without access to a car would struggle to make it. The proportion of Hartlepool residents who have access to a car is 41%—more or less half the UK average of 81%. Victims, understandably, need a period of calm before having the stress of giving evidence, and they will be inconvenienced. I asked the Minister in September and I will ask him again: is this what the Government really want—to make justice and access to justice more stressful and inconvenient for innocent victims? Justice is not served by making victims travel longer distances.

The consultation document itself concedes that, at the present time, 99% of those accessing Hartlepool magistrates court can be there by public transport within 60 minutes. After the closure, scheduled to take place in January 2017, 91% will take between one and two hours. That fails directly the Government’s intention of ensuring that people would not have to face longer journeys, and it is one of the key reasons why the Law Society is opposed to the closures of the courts in Hartlepool.

Finally, I want to raise another point on Government policy, taking an holistic view of law and order and security. Police staff and officers at Cleveland police fell from 2,628 in March 2010 to 1,634 in September 2015—almost 38%. Total crime reported to Cleveland police in the past year has gone up by 22%, and in Hartlepool, offences of the type on which cases would be seen by the magistrates have risen sharply. Year on year, violence without injury has gone up by 46.7% in the Hartlepool area; non-domestic theft has risen by 10.9%, shoplifting by 19.5% and personal robbery has gone up in the past year by 63.6%.

That will put enormous strain on the whole judicial system. I ask the Minister again to reconsider the proposed closure of Hartlepool magistrates court, in keeping with the holistic view of good local law and order. Please think again. Please think about the representations made by me, my constituents and the Law Society, and ensure that Hartlepool magistrates court and county court can remain open.

I congratulate the hon. Member for Bath (Ben Howlett) on his 100% record in securing Backbench Business Committee debates.

I want to focus my remarks on the proposed closure of Hartlepool magistrates court and county court, as I have a number of serious reservations about that. The first is that there is nothing lacking or missing from the magistrates facilities in Hartlepool. I understand that magistrates courts in other parts of England or Wales are earmarked for closure in part because they fail to comply with the Equality Act 2010 or are lacking in security. Hartlepool has a prison video link, separate waiting facilities for prosecution and defence witnesses, and interview rooms for confidential consultation. By contrast, the consultation itself concedes that if the proposed closure of Hartlepool’s courts goes ahead, a reconfiguration of the hearing space at Teesside magistrates courts will be required to accommodate a further waiting room and create a disabled access door. No figures are provided as to the costs of this work.

That brings me on to an additional point: the costs saved by the proposal. I understand that, as the hon. Gentleman has said, this consultation is being driven by a desire to reduce costs. The Minister has said that the courts estate costs about half a billion pounds a year. I would question how much will be saved if Hartlepool magistrates court is closed. There is a lack of transparency as to what will be saved. I understand that the court in Hartlepool has operating costs of about £345,000 a year. Does the Minister expect to save all or part of that figure? If it is the latter, how much does he expect to save?

I suspect that a large proportion of those operating costs will be staff expenditure. Eight members of staff work at the magistrates court and seven full-time members work at Hartlepool county court. Will they be made redundant as a result of the proposed closure? Unfortunately, Hartlepool still has a high unemployment problem, like the rest of the north-east. At double the national average, our level is the 40th highest among all constituencies.

Any redundancy in Hartlepool, especially that initiated by the state, does not help that unemployment problem, but if staff are not being made redundant will they be transferred to Middlesbrough, and how much does that save?

The building from which the magistrates and county courts operate is not freehold, so the Government will not be able to realise any value by selling it. According to the consultation, the Government’s wishes are:

“To maximise the capital receipts from surplus estate for reinvestment in HM Courts & Tribunals Service.”

That aim will not be met by closing Hartlepool magistrates courts, a leasehold property on a 99-year lease that currently has 60 years left to run. The building is owned by Hartlepool borough council. How much will it cost to break the lease? If the Minister is considering whole of Government efficiencies rather than a narrow, silo-based approach to achieving cuts for his own Department, what impact does that have? Does he realise that, by closing Hartlepool magistrates court, he is not saving the taxpayer anything, but is merely moving financial pressures to the local authority, which has already had cuts totalling 40% to its budget in recent years.

The criteria by which the courts will be closed seem opaque. I have asked a series of parliamentary questions on this matter. Like my hon. Friend the Member for Stockport (Ann Coffey), I asked about the cost per case across magistrates courts in England and Wales. That seemed to be a reasonable dashboard metric to evaluate relative efficiencies across different operating units. It is what business does all the time. However, the answer I received from the Under-Secretary of State for Justice, the hon. Member for North West Cambridgeshire (Mr Vara), who is a genuinely lovely and decent man and whom I am proud to call my friend, stated:

“The information is not available centrally and can only be provided at disproportionate cost.”

If this metric is not being used, what is? How can relative performance and effectiveness across the estate be evaluated consistently?

I understand that one of the central considerations of this proposed closure is the utilisation of the estate. Those 91 courts are used, on average, a third of the time. What is the magic utilisation figure that makes some courts safe and others not? I have seen the Minister quoted as saying that a third of all courts and tribunals were empty for more than 50% of the time.

Hartlepool has a utilisation rate of 49%. In an answer to a parliamentary question that I received this morning, the Minister revealed that Hartlepool’s utilisation rate is actually higher than the England and Wales average. With the exception of Wakefield, Hartlepool has the highest utilisation of any court proposed for closure in the whole north-east. Will the Minister take that context into consideration when deciding which courts to close, or should Hartlepool resign itself to closure simply because it has missed, by 1 percentage point, the magic 50% utilisation rate?

The hon. Gentleman cites the lack of information. My hon. Friend the Member for High Peak (Andrew Bingham) says that the Department has provided inaccurate information. Given that we are talking about unavailable information, inaccurate information and consultations where things are ignored, does he think that this is an example of the Ministry of Justice going rogue?

The hon. Gentleman makes an important point. Given what is coming out in this debate, the Ministry of Justice needs to scrap this consultation and start again on the basis of meaningful and accurate information.

I have mentioned costs and utilisation rates, but my central concern is access to local justice for my constituents.

My hon. Friend mentions access to local justice. Does he share my concern about the impact that this could have on recruiting magistrates, who serve their communities and understand their local areas? Without a strategy for the magistracy, there could be detriment to the principle of local justice.

My hon. Friend makes an important point. My central focus is the victims, rather than the magistrates—with the greatest respect to those people who provide an invaluable public service.

The consultation on the proposed move to Teesside magistrates courts states that there are

“excellent road, rail and bus links.”

Whoever wrote that has a budding career in writing gags for a living, because that is just not the real experience. Public transport provision in Teesside is appalling. Somebody from Hartlepool who is required to be at Teesside magistrates court for an early morning hearing and has no access to a car will struggle to make it. Victims, who might understandably require a period of calm and reflection before enduring the stressful and arduous process of giving evidence, will be massively inconvenienced. Do the Government really want to make justice more stressful and inconvenient for innocent victims? Justice is not being served by making victims travel longer distances. The consultation says that at present 99% of those accessing Hartlepool magistrates court can be there by public transport within 60 minutes, even taking into account the appalling local public transport provision. The consultation states that after the proposed closure 91% will take between one and two hours. That fails the Government’s intention of ensuring that people will not have to face long journeys, and I hope the Minister will consider that.

Finally, I finish on a wider point that is perhaps not the direct concern of this debate and of the Minister but has implications for relatively small towns such as Hartlepool. We have endured the movement of local hospital services from Hartlepool to other areas. Retail units are moving from the high street and the shopping centre into other areas. There is a drift of services from places such as Hartlepool, but what does that mean for the future? Does it mean dormitory towns, at best, or, at worst, ghost towns in which there is no sense of community and where economic activity is stopped?

We have to think about this as widely as possible and, given the concerns, I hope that the Minister will think again and ensure that Hartlepool magistrates court remains open.

I congratulate my hon. Friend the Member for Bath (Ben Howlett) on securing this debate, as well as the hon. Member for Stockport (Ann Coffey). I am taken back five years to my first election to this place and the proposed closure of Goole and Selby magistrates courts, which affected my constituency. I was not as successful as the hon. Member for Bath in securing a debate in the main Chamber; I had to settle for Westminster Hall, so in that respect he is already doing a better job for his constituents than I managed to do for mine five years ago. Things have improved since, however.

It is also a pleasure to speak in another debate with my friend the hon. Member for Scunthorpe (Nic Dakin) and the hon. Member for Hartlepool (Mr Wright), who is also my friend. We have been a triumvirate of common sense in three debates this afternoon.

As my hon. Friend knows, our legal firms and educational establishments are great assets to this country. The Ministry of Justice continues to work very closely with UK Trade & Investment and the profession to promote those wonderful services overseas. I am sure that my hon. Friend would take great joy in looking at the Unlocking Disputes campaign, which is a good example of recent fruitful activity.

T4. The Teesside coroner takes almost twice as long as the national average to conclude inquests, causing further anguish to grieving families. This matter has been raised many times with the Ministry. Why on earth, given his failing and unprofessional service, is the coroner still in post? What steps will the Secretary of State take to remove him?

What can I say? Someone said earlier that no empathy is being shown, but I think that empathy is being shown—to the insurance companies. We can take our guidance from that.

The Minister talked about the compensation culture, but it is very easy to stop that culture: tell employers to stop killing people at work and to stop poisoning people at work. Then people would not be able to claim compensation. That is exactly what needs to be done. We are talking about employers who have contempt for workers and their families. They let workmen go home in dirty work clothes that their wives then washed, and became infected with mesothelioma through doing so. What happened was known by employers. We are talking about employers who were using young kids in Namibia to fill plastic sacks with raw asbestos. They put young kids of seven, eight or nine in the sacks to tamp the asbestos down. That is the type of people we are dealing with—people with no regard for human life. Some successful cases were brought by a trade union in South Africa and they got £38 million in compensation. That £38 million was welcome but it did not save the lives of any of those kids.

We have had 42,000 people die in the past 40 years in this country and 60,000 more will die in the next 50. That is more than 1,000 people a year and more than were being killed in the coal mines in this country in the disastrous years of the 1930s. That is why this is a special issue. We should be looking to people such as Chris Knighton in the north-east of England who has led a campaign on behalf of her husband who died 15 years ago—a man who was fit enough to ride from Newcastle to Berwick on a bike on a Sunday morning and think nothing about it. He fell down one day in the local club and when he went to see the doctor, the doctor told him, “You’ve got mesothelioma.” He asked, “What does that mean?” The doctor said, “It means you’re going to be dead in nine months’ time.” Those are the people we are standing up for today. We are not standing up for big business or insurers—we are standing up for ordinary people who have been exploited for years. If we do not support the amendments to this legislation we will be letting those people down. I say to the Liberal Democrats in particular, “If you ever want to claw back from where you are now, support these amendments tonight. You will never be forgiven if you don’t.”

I rise briefly to support Lords amendment 31. It cannot be right, as my hon. Friend the Member for Wrexham (Ian Lucas) and others have said, that victims of asbestos-related diseases should be required to surrender a quarter of the damages they have been awarded to pay for legal costs. Those damages are awarded to recognise and compensate men and women, if it is at all possible to compensate them, for the pain, suffering and life-shortening illnesses they got from their work. In my constituency, the number of cases of asbestos-related diseases is far too high. The link between mesothelioma and exposure to asbestos in the shipbuilding industry is well known, as we have heard tonight. There is a common pattern involving high levels of mesothelioma and areas of shipbuilding or areas that contain ports and dockyards. Hartlepool is a former shipbuilding area and it is the 16th-worst affected place in Great Britain for deaths caused by mesothelioma.

In considering Lords amendment 31, I ask the Minister to consider one harrowing case out of many from Hartlepool. Mr C was diagnosed with mesothelioma after he had complained of breathing difficulties and a pain in his rib cage. Originally it was thought he had pneumonia but a CT scan and a bronchoscopy showed that he had mesothelioma. Mr C had left school at 16 and worked at South Durham Steel and Iron Company for the best part of a quarter of a century. He was regularly exposed to asbestos dust in the air and was not provided with any protective clothing or equipment. He was awarded £67,000 in compensation in recognition of his excruciating pain and suffering. He died five months after receiving that award.

The Government’s argument against the amendments—that the Bill protects against frivolous or fraudulent claims—is offensive in the extreme. The idea that these constituents of mine are ambulance chasers or people looking for a quick buck is risible. The notion that tens of thousands of pounds of damages should be taken from workers and their families who have suffered the harsh effects of a painful illness is another insult and injustice to them.

In a little over 10 days, the country will observe workers memorial day to commemorate those who lost their lives as a result of injury or neglect at work. Having listened to the Minister tonight and seen him in his place, I have to say that he does himself no credit with the smirking and the body language that are offensive to every single sufferer. The best way in which he could make amends is by honouring the spirit and values of workers memorial day, accepting Lords amendment 31 and getting rid of this huge injustice.

We were concerned that there was a belief that it was not possible to name offenders on the run for reasons of, for instance, data protection or human rights. When offenders are unlawfully at large, it must make sense for there to be a presumption that they can be named by the authorities. The Government will take steps to ensure that that is made clear and that there will be such naming unless there are specific operational reasons why that would not make sense.

T4. The Office for Judicial Complaints has been investigating the poor performance of the Teesside coroner since August but, seven months on, we still have no indication of when the investigation will conclude. Has the Minister set a finish date for the investigation? When will matters improve? Has he merely kicked the subject into the long grass?
