I thank the right hon. Lady and say, entirely fairly, I hope, that the merits in this response—and it can reasonably be observed that there are a great number—are due in considerable part to her efforts in engaging with me to make changes and improvements.

On the issue of the independent public advocate, for example, there is no doubt—others have fed in as well, not least my right hon. Friend the Member for Maidenhead (Mrs May), the former Prime Minister—that the IPA will be permanent. That was not the original proposal. It will be able to make reports of its own motion come before this House, and not just at the instigation of the state. It will also be able to make recommendations about what sort of inquiry should take place afterwards. That could be, as the right hon. Lady knows, some sort of independent panel along the lines of the ones set up by Alan Johnson as Home Secretary, or it could be a statutory or non-statutory inquiry. This IPA is of a different order of muscularity from the one originally envisaged, and the right hon. Lady has played an important part in that.

The right hon. Lady and I have discussed the Hillsborough law. There are countervailing considerations, as she knows, but the point is that my door remains open, the conversation remains live and we will have a debate about the issue, I hope, in the new year. I look forward to discussing these matters further.

My right hon. and learned Friend’s statement goes some way to tackling the institutional behaviour that puts the reputational damage of organisations and public confidence in them ahead of the interests of the people they are meant to serve, but his comments have been very much in the context of major public incidents. How far does he think the expectations enshrined in the charter can be applied to individual cases? I speak with particular reference to suicide. Quite often, bereaved families attend inquests where the players are keen to avoid any suggestion of liability; that could conflict with what he has described in terms of a duty of candour.

I am so grateful to my hon. Friend for raising that critical point. The issue is not just about major disasters, important though they are. When something dreadful has happened, the victims and families do not want to find themselves in an unnecessarily adversarial situation or one where people are, frankly, trying to save their own skins and showing institutional defensiveness.

A lot of the issue comes down to culture, frankly; we are aware of that. There are two things to say. First, on the equality of arms, if exceptional case funding is involved—that is to do with article 2; there are certain thresholds—there will be legal representation. On culture, we have provided a new document, which includes the principles guiding the Government’s approach when they hold interested person status at an inquest. Those include approaching

“the inquest with openness and honesty, including supporting the disclosure of all relevant and disclosable information to the coroner.”

In other words, the state should not be in the position of being defensive, whether there has been a major disaster or the case relates only to an individual.

The first thing to say is that our prison programme is the largest since the Victorian era—20,000 places. If I may say so, that stands in stark contrast to Labour. Jack Straw stood at this Dispatch Box and said, “We will build three titan prisons, each one of them 2,500”. Did it happen? No, it did not. This is the party that has put the money behind it. In fact, it was this Prime Minister, as Chancellor, who did that. We are rolling them out. By the way, I will make no apology for taking offline old and inadequate accommodation and replacing it with modern, secure, decent prisons. That is something the hon. Gentleman should welcome.

My right hon. Friend will be well aware that people who have been through the care system are overrepresented in our prisons, as are people with neurodiverse conditions, as he has mentioned, and many existing victims of crime and abuse. It is a mark of a civilised society that when those people first touch the criminal justice system, we take the opportunity to support them to make them functioning members of society, not simply lock them up and throw away the key. We have heard all that across the Chamber, but that message does not survive the retail nature of our politics. Will he assure me that the Government will continue to walk the walk and talk the talk on those messages?

A male Member of the House is shouting at me across the Dispatch Box while I am trying to explain. This is a deeply serious subject, and it must be—I would hope—a matter on which we can find measured and constructive ways of working together in order to improve justice for victims, because that, surely, is what we should all be focusing on.

Support for victims of rape is essential to ensuring that more of these crimes are brought to prosecution, but rape victims often say that, having gone through the trauma of the assault, they are then dehumanised by being treated, effectively, as a piece of evidence when they report it, and then have to prepare themselves to be traumatised yet again when they appear in court. What discussions is my hon. Friend having with the Department of Health and Social Care to make good the NHS’s commitment to giving all victims of rape a lifetime care pathway, so that they can be confident enough to appear in court?

I thank my hon. Friend for identifying not just the immediate impacts of sexually violent attacks but the lifelong impacts that they can have. The Department of Health and Social Care and NHS England are involved in all the discussions that the Deputy Prime Minister and I have on this. NHS England is particularly keen to roll out support to victims longer term as well as short term, and also to roll out the further provision of more independent sexual violence advisers, which we have committed to do by 2024-25, bringing the total to more than 1,000 ISVAs nationally. They will be critical as part of the recovery process. Having met many of them recently, I understand how valuable they can be for victims both in their recovery and in giving them the support they need to take these important criminal cases forward.

The world in the 21st century is having to grapple with some of those factors that we have seen emerge on the internet over the last two or three decades. I genuinely think this is the moment for our country to draw a line in the sand and say, “Enough is enough. We expect better from tech companies and we expect better in terms of regulation of tech companies.” That is what the Online Safety Bill will involve.

I think we have all been very patient as women, to be brutally frank. I want to return to the point made by the right hon. Member for Kingston upon Hull North (Dame Diana Johnson). Let us call it what it is: this is male violence against women and girls. I hear what my hon. Friend the Minister says. There are probably more men here than I have seen in a debate of this kind, which is fantastic, but we are only really going to tackle this if we get full societal change. That means that our communications outside this Chamber must make it very clear that it is not a women’s problem that men are committing these crimes against them; it is the fault of everyone in society. People should stop looking the other way and we should cease just sucking all this up. Let us call it what it is—male violence against women and girls.

I would very much welcome my hon. Friend’s views on the “Enough” campaign. We set out three scenes to tackle exactly that tendency to turn away, giving people the courage to call out so-called banter among their mates, and helping people who see behaviour in the street that they are not sure about to offer a helping hand and say, “We’re here if you want to talk.” That sort of approach is going to make the sort of societal change that I know we all want.

However, it is also vital that, when crimes sadly occur, victims get the support they need and deserve. That is why we have committed to increasing funding to vital support services to £185 million by 2024-25. Importantly, that includes increasing the number of independent sexual violence advisers and independent domestic violence advisers to more than 1,000. That is pivotal. The right hon. Member for Normanton, Pontefract and Castleford rightly said that there are various stages in the criminal justice system, and as I move on to the rape review I will try to explain a little more the very technical work that we have been doing on this. We know that there are certain pressure points, and there is emerging evidence that the role that IDVAs and ISVAs play in supporting victims can really help to tackle victim attrition rates. It can mean that victims are nearly 50% more likely to stay engaged with the criminal justice system.

We are also—again, I have listened to the responses that we have received and to charities and campaigners—in the process of setting up a national sexual violence helpline in England and Wales. That will be available 24 hours a day, seven days a week, so that victims of sexual violence can get immediate access to support when they need it and when they want it. I think that will be a step change for many victims, knowing as we do just how important the domestic abuse helpline has been in offering support. We are also, of course, introducing a victims law. That is a critical part of our plans to ensure that victims’ voices are at the heart of the criminal justice process. It will strengthen the accountability of the players in that process and improve support for victims.

On another point of agreement, we want to see perpetrators of violence against women and girls ruthlessly pursued and brought to justice. Yesterday the Safeguarding Minister—the Under-Secretary of State for the Home Department, my hon. Friend the Member for Redditch (Rachel Maclean)—confirmed to the House that we will be adding violence against women and girls to the strategic policing requirement, meaning that it will be prioritised just as terrorism offences, for example, are prioritised. That is essential. I appreciate that it is the sort of technical thing that is all words and has very little meaning if one has just been raped and been the victim of a crime, but those of us who work in this process know how significant a commitment it is. We are now prioritising nationally the very crimes we are all so concerned about, in the way that serious organised crime and terrorism, for example, are prioritised.

However, we know that we cannot just look to criminal justice, so in the Domestic Abuse Act 2021 we committed to giving the police new powers to help bring perpetrators to justice and to stop the abuse. Domestic abuse protection notices and orders were a very strong part of the Act. We will be publishing a comprehensive perpetrators strategy, which will set out our approach to detecting, investigating and prosecuting offences involving domestic abuse, assessing and managing that risk, and reducing the risk that individuals will commit further offences. The strategy will form part of the domestic abuse strategy, which is due to be published in the coming months.

My hon. Friend will be aware that those of us who visited the refugee centre in Doha a little while ago were very concerned to hear about the unaccompanied children with links to British families, who did not seem to be processed as quickly as those of other countries. Can she assure the House that she will ensure that those children are processed as quickly as possible? The longer they are in limbo, the more harm will be done to them.

I am aware that colleagues on the Doha trip met those children, and I thank those colleagues for taking such an interest. I can assure my hon. Friend that this is being worked through. As always, there are safeguarding and other matters that we must turn our minds to, as we are doing, but we are trying to work through this as quickly as we can.

The Chair of the Select Committee is right that such offences or allegations need to be dealt with swiftly and robustly, but she will understand that the decision to suspend a police officer primarily lies with the chief constable, for important reasons. Obviously, we are working with the National Police Chiefs’ Council to make sure that we have a consistent approach to those kinds of offences across all police forces, but that is definitely a matter that falls into the area of operational independence, so the policy is decided on a force-by-force basis, albeit that the College of Policing issues guidelines. Given her long history in the area, I know that she will recognise the importance of a chief constable taking responsibility primarily for the suspension or otherwise of the officers in that force.

The truth of the matter is that sexual violence against women is too common and, as a consequence, it shows up in our police service. A few weeks ago, my right hon. Friend the Prime Minister spoke at the Conservative party conference about the need for a broken windows theory of tackling crime. Against that background, what thoughts does the Minister have about applying that principle to the whole area of sexual violence? The simple fact is, if we let low-level sexual banter escalate, that is exactly what we end up with. Is it not incumbent on the whole of society to make every bit of sexually aggressive behaviour towards women and girls totally socially unacceptable?

The hon. Gentleman talks about saving money, but I have waited in vain to hear how Labour would address the spending challenge. Last week, Labour Members said that they would deliver a spending reduction in this and other Departments year on year, but as of today we have no idea how they would do it.

My right hon. Friend recently visited Purfleet in my constituency where he saw the mile long fly tip that has been left following an unauthorised Traveller encampment. Does he agree it is important that the police and local authorities use the powers at their disposal so that public confidence in our justice system is maintained?

The scale of what happened in my hon. Friend’s constituency is shocking and the local police, local authority, and police and crime commissioner must learn the lessons to ensure that such a thing cannot happen again. If powers need to be taken at national level to help in that battle, the Government will certainly consider how we can contribute.

We are in regular dialogue with the judiciary—indeed, I have had a meeting with Sir James Munby—but we have had to take some tough decisions on legal aid. At some £2 billion a year, it was the most expensive legal aid budget in the world, and even after the reductions, it will remain one of the most generous in the world.

My constituents believe that the emphasis on human rights is leading to an excessively light touch when dealing with unauthorised Traveller encampments. Does my right hon. Friend agree that to enjoy the benefits of human rights, individuals should also acknowledge their responsibilities to abide by the law?

I absolutely agree. I cannot offer my hon. Friend change under this Government, but my intention is that a future Conservative Government would include in our proposed Bill of Rights a specific limitation to stop people claiming article 8 rights and overriding the law of the land that applies to the rest of us. That should not happen.

This Government have done more than any previous Government to give victims of domestic violence access to justice, and we are continuing to improve how such people, normally women, are treated in the operations of both the courts system and the police. As I said earlier, we have backed up that commitment with £40 million of ring-fenced money.

Theft and vandalism against small businesses costs jobs. Will my right hon. Friend confirm that his changes to the victims code will mean that courts can take into account the economic consequence of crime from now on?

I can confirm exactly that, and I pay tribute to my hon. Friend and her constituents. Her work in this area is clear evidence that a Back Bencher bringing a genuine constituency case to the Government can make a real difference. She did that, she has made a difference and the world has now changed for such businesses, so the impact will be known.

I shall make some progress first.

The Justice Secretary seems to come out in a rash at the mere suggestion that he should pilot the plans. Back in January, when I challenged him on that, he put his gut before hard facts and evidence when he said:

“Sometimes we just have to believe something is right and do it”.—[Official Report, 9 January 2013; Vol. 556, c. 318.]

That from the man who brought us the Work programme. He will forgive me if I do not base my opinions on what we should do with a probation service employing thousands, supervising hundreds of thousands and serving millions on his hunch, because his hunch led to billions being spent on a Work programme that performed so badly that someone who was unemployed stood a better chance of being in work after six months if they had not been on it. The Public Accounts Committee’s verdict on the Work programme was that

“providers have seriously underperformed against their contracts and their success rates are worse than Jobcentre Plus”.

Fast forward two years and the same model has resurfaced in probation, but this time the fallout from failure is of an altogether different magnitude—[Hon. Members: “Give way!”] Madam Deputy Speaker, you know that I am extremely generous in giving way to colleagues on both sides of the House. It is just a shame that it took an Opposition day debate to drag the Justice Secretary here to discuss his plans, which we are quite keen to scrutinise. I will make some progress before giving way.

The Economist hit the nail on the head when it stated:

“If the work programme fails, the cost is higher unemployment; if rehabilitation of offenders fails, the cost is worse: more crime. Which is why those now-disregarded pilots were set up in the first place.”

As if that is not criticism enough, the article goes on to refer to the Justice Secretary’s plans as “half-baked”.

The hon. Gentleman has some audacity. The Conservative party voted against the Offender Management Act 2007, in which we tried to change how probation works. Which voting Lobby did he go into? Was he with us? No, he was not, so I will take no lectures from him on our plans to reform probation.

The right hon. Gentleman quoted rather selectively from the Public Accounts Committee report—I know because I am a member of the Committee. One of the points we were keen to make was that we were talking about people in a long-term relationship with providers. We had to take a very balanced decision on the success of the programme after two years of engagement with people who had been unemployed for a long time and needed a lot of help. He should look at the Committee’s full conclusions, in which we said that the direction of travel was positive.

Let me make some progress.

The Justice Secretary would like us to believe that the companies will not be paid unless they deliver, as if payment by results means payment only by results. In fact, nearly the whole fee will be paid to the private companies regardless of the results. Private companies are intent on squeezing the fraction of the payment that is dependent on results as close to zero as possible. The Government are so keen to suck up to the big companies that they have caved in. So much for payment by results. No doubt the Justice Secretary will claim that he is doing only what the Offender Management Act 2007—which the Conservatives voted against—gave him power to do. In fact, that Act established local probation trusts, empowering them to commission services locally from whom they see fit. It was not about abolishing local probation trusts or commissioning services directly from Whitehall.

My right hon. Friend the Member for Delyn (Mr Hanson) was at the time the Minister responsible for the legislation, and he knows exactly what it was for. [Interruption.] I can hear some chuntering but do not worry, Madam Deputy Speaker, it is not putting me off. In 2007 my right hon. Friend said that

“there will also be a need for local probation trusts to act not just as service deliverers but as commissioners of services from the voluntary sector, or from others, providing a proper service to help prevent reoffending at local level.”

I have heard empty rhetoric from Opposition Members before, but this afternoon it is particularly poor. The hon. Member for Batley and Spen (Mike Wood) tried to position the debate as a public versus private one. The entirety of my career before becoming an MP was in the public sector. The ethos of public service flows through my veins. We are talking about having effective vehicles to deliver our policy objectives. Whether delivery is public or private is not important; the important thing is that we achieve the outcomes we intend. That is why the instinctive opposition to the proposals from Labour Members is disappointing. As all hon. Members recognise, the rate of reoffending remains stubbornly high, notwithstanding the efforts of Governments of all colours. Unless we show some imagination in tackling that, we will not win the fight against crime and we will continue to fail people who are trapped in the cycle of reoffending. I welcome the initiative and imagination shown by the Government. As we have heard, the National Audit Office has estimated that the cost of crime committed by offenders released from short prison sentences is up to £10 billion. For the sake of those offenders, their potential victims and the economy, we must not allow that to continue.

Let us focus on the outcome we are trying to achieve, not on the inputs or on maintaining a provider-led system that is failing to deliver. I was most motivated to speak in this debate by hearing the comments of the right hon. Member for Tooting (Sadiq Khan), who desperately tried to pray in aid the Public Accounts Committee to back up his position. The role of the PAC is to assess proposals on the basis of value for money. It is getting increasingly tiresome to hear it being prayed in aid to attack Government policy, because that is not its role. We examine the effectiveness of the machine at delivering the policies.

The right hon. Gentleman was right to highlight the report by the PAC on contract management by the Ministry of Justice, and we never hold back on criticising poor contract management across the public sector. It is well known that Whitehall needs to learn a lot in that regard. One of the things that we did in our earlier report on the Work programme was praise the approach to that particular aspect of contract management, which was based on payment by results so that the private sector providers taking those contracts bore the risk. That is a principle that needs to be read across government, and it is an important principle for the proposals that we are talking about.

I bow to no one in my admiration for the Committee Chairman, the right hon. Member for Barking (Margaret Hodge), and the way that she is extremely inventive at spinning our reports to give maximum comfort to the Labour party. It says a lot about the lack of talent on the Opposition Front Bench that she is their most effective weapon.

As I have said, the risks will be borne by the providers. If they succeed in transforming the lives of people who are caught up in the cycle of reoffending, what is not to like? If they succeed, people are freed from the cycle of reoffending. If they do not, they do not get paid. What is wrong with that?

I was delighted to hear about the nature of the blood flowing through the hon. Lady’s veins, but could she address the question of the percentages in the contracts? The latest figures suggest that private companies will get 90% of their money whether they succeed or not.

If that were the case, I would consider it exactly the kind of poor contract management that I have been talking about. The important point is that we pay for results. Equally, we should reward those companies that are helping the most difficult.

My hon. Friend is making some extremely good points, and I hope that the Opposition are listening carefully. The hon. Member for Batley and Spen (Mike Wood) keeps referring to private contracts, but the Lord Chancellor has confirmed twice today that probation trusts can bid for those contracts in conjunction with someone who can take the financial risk. Does she agree that the hon. Gentleman should stop slagging off the private sector?

My hon. Friend pre-empts my next point. We have been talking about private versus public, but it is not like that. We are not just talking about the Sercos and the G4Ss. We want public servants to come together and create mutuals. We are most effective when we all work in partnership. The “us and them” culture perpetuated by the Opposition does nothing to improve outcomes for anyone, whether in jobs, tackling reoffending or anything else. This stale thinking has had its day. We are in the 21st century, not the 20th.

Police and crime commissioners will have a massive role in bringing together successful partnerships to bid for contracts. I pay tribute to an imaginative approach in my constituency, spearheaded by the police and crime commissioner, working with the youth offending team. The team had to find a new home. One of our police stations had closed. The PCC brought together a partnership between the council and the youth offending team, which enabled the re-opening of the police station, with a front-facing desk, that also provided a secure working environment for the team and its clients. That is a great example of partnership working and of how police and crime commissioners can make a difference. I commend what the Government are doing on this agenda.
