I am afraid I have to say directly to the hon. Lady that I diametrically disagree with her. I am not in any way embarrassed, although, of course, when it comes to leaks, I neither like nor approve of them. However, this is the final decision. I do not think it is deplorable. Certainly in my direct experience, and looking at the evidence—and, indeed, in response to a consultation where so few people actually said, given what they thought the conditions would be in living there, that they wanted to go—it is not deplorable or a breach of human rights to say that, in our judgment, this would be creating a community that would actually not be sustainable and that, probably, at the end of the day, would be neither safe nor happy.

This is a sensitive decision, but it is the right decision. Is the Minister of State aware that, when I was Minister for overseas territories, I actually travelled out to the Chagos Islands and also went out to the outer islands? I think I am the only person in the House today who has visited. It was certainly quite a difficult experience; over five days, I spent only 15 minutes on land in a bed. This is a massive area, and it is very difficult to get to. It would be wholly impossible to populate the islands, as other Members of the House have argued. Does the Minister agree that, while this is a sensitive issue, it is good to have what I hope will be closure on it going forward?

As always, the hon. Lady makes an excellent point and gets to the heart of the issue. I only wish that I could give her an answer. Perhaps the Minister can. I certainly know that it is not down to the United States of America because, as a member of the Select Committee on Foreign Affairs, I have raised the matter every time I have been to Washington. When I ask why it is not possible for the Chagossian people to go back and why Washington blocks it, the Americans say, “We’re not blocking anything.”

I find it astonishing that the situation has gone on for 50 years—half a century—and that no one has got to the bottom of it. Of course there are financial implications. Any responsible Government cannot just agree to something without working out how things will be funded, but we have a moral responsibility. This has gone on for so long and it has been handled totally differently from all our other overseas territories, where self-determination has been paramount.

I hope to catch Mr Betts’ eye later and make a contribution, but I have visited the islands with the Americans. They were very clear when we were on the island and in subsequent discussions with me when I was a Minister and with the Government more generally that they unequivocally oppose resettlement. I am not sure exactly who my hon. Friend has spoken to but, as far as I am concerned, the Americans have always opposed resettlement.

I thank my hon. Friend, a former Minister, for his helpful intervention, but that is not what I have discovered when I have directly confronted the Americans. I would love to know which particular American said that they oppose resettlement because when I speak to senior level Americans in Washington, they are baffled and do not really understand.

The Leader of the Opposition has raised the matter with President Obama, and I understand that even he had no understanding of what objections there could possibly be. It is completely contrary to the attitude when Americans have air bases elsewhere, where the local community work on the bases. There is no sense and there is no moral justification.

I had the privilege of travelling to the islands last November during a two-year stint as a Minister for various parts of the world, including the overseas territories. My views are personal and not those of Her Majesty’s Government, but they are based on two years of looking into the matter. I certainly read every word of the KPMG report and every piece of consultation that came across my desk very fully, and I have spoken to all the key people involved.

We cannot undo an historic wrong, but we can mitigate it. In all candour I must say to hon. Members that I do not believe it is right to repopulate the islands as part of that mitigation, but there are things we can do. I want to explain why. I visited Diego Garcia, the military base that formed a part of the main island, and I visited the part of the island that does not have a military base and the outer islands. During my five-day visit I slept in a bed for 15 minutes; the rest of the time I spent travelling. The time that I got to actually do any visiting was quite small.

I mention this because it was a very expensive trip to get there. This is the line of route that everyone will have to take, as will every block of cement, every video recorder or TV, or—in many cases—the foodstuffs we will have to take. I travelled via Singapore and Bahrain on a military flight. I then travelled on a rough fishing vessel for nearly 20 hours to get to the outer islands, where I got on to a military RIB that was able to conduct assaults on islands. We were unable to get on to the island and we had to jump into the water to wade to the outer islands that had coconut palms right up to the beach and there was foliage hanging off the beach area into the water. I am not saying one could not populate the islands, but the concept that the outer islands are an idyllic possibility is for the birds. They were difficult, overgrown, humid areas that were accessible only where the Marines had gone in and chopped down foliage.

I asked to look at a memorial that was put there and I asked whether we could cut through to the cemetery, which was a depressing place with lots of small graves of children and babies. When the outer islands were depopulated, they were very difficult places to live. Had it not been for the British Government depopulating those islands, I am not sure how viable they would have been within five years, given the only revenue stream was coconut oil, which was already declining. It was difficult to support life even at that time.

I will try to give way in a second if I can.

On the main island, the military element of the island is not just a runway. There is space for tens of thousands of troops to be potentially deployed on hard standing. In the conservation area going up into the old town, the houses are falling apart. There is no real infrastructure there at all. I met British and American military there. During the whole of my trip I was with Americans and Brits. I am unequivocal as to the American position on a political and diplomatic level.

The former Minister is painting a wonderful picture for someone like me who would love to undertake such a journey. When he was a minster, a consultation was undertaken with members of the Chagossian community. The then Minister said on 12 April:

“I recognise that Chagossians have urged us to announce a decision soon, and we very much hope to do so.”—[Official Report, 12 April 2016; Vol. 608, c. 171.]

Can he give us his recollection of that time and when he thought a decision would be made by the Foreign Office?

I think the hon. Gentleman is citing a debate in this room. It was certainly not my intention that things would be left quite so far. We have had a change of Prime Minister and the focus has been elsewhere, but at that time we were waiting for the full consultation to complete. I also met other hon. Members, so I extended the consultation. There is a broader process; it is not simply one Minister making a decision.

The islands have a great use for prepositioned ships. I went on board one of the five prepositioned ships. They have five or six storeys—like multi-storey car parks—with the smallest vehicles being almost the width of this room. Two Afghanistan and Iraq style wars could be conducted for a month using those ships. They are absolutely essential to American, British and global security. Many other nations use that area.

I also met the Filipinos who worked there. They lived in not great accommodation, in what I would describe as a prefabricated hut with rooms on either side and a shared bathroom in the middle. Those cost contractors about £1 million to put in place for accommodation for two, because of the costs of getting all the equipment on to the island. I do not think we can underestimate the costs.

I also visited a hospital that was used by the Americans, the Brits and the Filipinos. Provision was basic, so anyone giving birth or experiencing complications needed to be flown off the island, and it was very difficult to move around the island.

Is the former Minister suggesting that we go round the world and perhaps depopulate lots of other British overseas territories, such as Pitcairn, St Helena and Tristan da Cunha? Shall we just depopulate? Is that the right thing to do?

Certainly, if Tristan da Cunha or Pitcairn were unpopulated, I think it would be wrong to repopulate those islands. If the Americans were not on the island I am not sure it would be the right thing to repopulate Diego Garcia. We cannot provide the level of services that people demand. In the United Kingdom we are already providing benefit to people in Diego Garcia as members of the British public. After I stopped being a Minister, I visited Mauritius, where I saw the community—[Interruption.]

I apologise for taking longer than I might have over my speech and for not taking more interventions. I am happy to attend the all-party group—and, indeed, to join the group, if I would be accepted as a dissenting member—and to discuss my visit and experiences with parliamentarians in a bit more detail.

May I first pay tribute to the work the hon. Lady does on the all-party group on Africa, and indeed to the work of all such all-party groups and of the Prime Minister’s trade envoys, many of whom are in the Chamber? That work reflects our desire to do more business post-Brexit. We are trusted, we are engaged and indeed we are committed to doing more in those countries, and South Africa is just one example of that. She raises the very important point that a number of countries have signed deals or are about to sign deals with the European Union on trade; some of them are now bowing out, saying, “Let’s wait to see what happens with Brexit.” It is important that we strike the necessary bilateral deals as we move forward.

As well as encouraging trade with Africa, what can Her Majesty’s Government do to increase trade between African countries, particularly in the Great Lakes area?

I pay tribute to my predecessor as Minister for Africa for the superb work he did in pioneering and strengthening Britain’s relationship with this important continent. These countries want to do business with us: we want to do business with them. It is important that they are also encouraged to do business with each other. The Great Lakes is a great example of that—a massive infrastructure project is being carried out to get oil out of the country through a number of other countries. It will also assist countries such as South Sudan, which could do with the revenue. Britain can come forward with our expertise in that area.

On 10 December 2015, Official Report, column 56WS, I informed the House that the UK Government had published a report by Sasha Wass QC on allegations surrounding child safeguarding issues on St Helena and Ascension Island. The report was independent and comprehensive, and I welcomed its conclusion that no evidence had been found of corruption or cover up in the St Helena police service, the St Helena and Ascension Island Governments, the FCO or DFID.

However, the report did find evidence of systemic failings by social services and police in the past. The report made a number of recommendations in relation to child safeguarding. The Government accepted all of its recommendations, and on 29 January 2016 the FCO appointed Ms Ginny Ferson to St Helena as UK Government special representative: Wass inquiry implementation. Ms Ferson went immediately to St Helena, visiting Ascension Island en route. She established good relationships with local Government officials, police and other stakeholders and worked alongside them on implementing the Wass inquiry recommendations. This included an analysis of previous reports commissioned by the FCO and DFID to determine which previous recommendations remained outstanding but valid. Those recommendations that remained valid but outstanding have now been implemented.

To ensure full transparency, the St Helena and Ascension Island Governments collated the recommendations of the inquiry report into a risk-rated action plan which has been published on their respective Government websites. Ms Ferson’s report will be available on gov.uk.

Good progress has been made in implementing the recommendations of the inquiry report. The UK Government have increased the funding they provide to the St Helena Government for child safeguarding and for health and social care more generally, and improved co-ordinated efforts are bringing about real change. For example, Jamestown hospital is undergoing a £2.8 million refurbishment of its medical wing, due for completion by the end of July 2016. In addition, a funding uplift has enabled the rebuilding of a dedicated community nursing team and re-opening of three local health clinics. The safeguarding directorate and police service have rolled out a locally adapted version of “Working Together 2015” based on the UK model. The Ascension Island Government have done likewise. All schools now have a designated child safeguarding lead. Most recommendations have been fully implemented, others are on course to being completed. One relating to secondments to a UK police investigations team will be implemented as soon as staffing levels allow.

It is important that the improvements are sustainable and Ms Ferson includes advice on future-proofing in her report which we, alongside the St Helena and Ascension Island Governments, have taken on board.

We are determined to build on this work on child safeguarding across our territories. The FCO’s child safeguarding unit has promoted the recommendations of the inquiry report throughout the overseas territories to maintain focus on continuing to strengthen child safeguarding measures. We have intensified our work with key UK departments and bodies such as the National Crime Agency, Crown Prosecution Service and social work experts, to provide additional expertise to territory Governments on improving safeguarding measures across the board.

FCO Services operates as a trading fund of the FCO. I have set the following performance targets for 2016-17:

An in-year surplus before interest, tax and dividend.

A return on capital employed of at least 7% (weighted average).

A productivity ratio of at least 80%, measuring actual billable hours versus available billable hours.

To deliver the efficiency savings of £12.1 million as reported over the corporate plan period.

A customer satisfaction result of at least 80%.

To provide an annual discretionary dividend to the FCO of at least £1.5 million.

An overall improvement of 2% on the average 2015 index Your Say score for My Manager.

Target 2016-17 = 65%

FCO Services will report to Parliament on its success against these targets through its annual report for 2016-17.

Through the conflict, stability and security fund, we are seeking to reduce the impunity and address the causes of conflict. We are working with the Burundians in general and with the international community, the country’s human rights commission, the truth and reconciliation commission and the court system. I met human rights organisations in private in Bujumbura in December to hear their detailed concerns, and I addressed the UN Security Council in March. I am pleased to report that the Arusha talks have now started under the chairmanship of former Tanzanian President Mkapa. I look forward to hearing reports about how they are going.

As a region, sub-Saharan Africa has seen uninterrupted economic growth over the last 20 years. The IMF regional economic outlook for sub-Saharan Africa projects a growth rate of 3% on average across the continent. Kenya, Rwanda, Tanzania and Senegal are all expecting to grow well in excess of double that figure, with the Ivory Coast growing from 8% to a potentially staggering 10% growth annually. Africa clearly continues to offer some great investment opportunities for UK business.

T4. What recent representations has the Minister made to his counterparts in the Nigerian Government on the continued detention of the British citizen Nnamdi Kanu of the indigenous people of Biafra? Is the Minister confident that Nnamdi is receiving all his rights under international law?

I have continued representations with the Nigerian Government on Biafran and other issues and I will continue to do so. I have met a series of Members of Parliament who have constituency interests in Biafra, and I am happy to continue to do so. The British Government recognise Nigeria as a geographic area that holds together as one country, not as separate countries.

What is the Minister doing to assist families in marking this anniversary in peace? What are the Government doing to assist the Tunisian Government in promoting security and the country’s economy?

It is indeed a pleasure to be here at a slightly earlier time than billed. Before starting on the substance of this very important debate, may I pay enormous tribute to my hon. Friend the Member for Congleton (Fiona Bruce)? For me, today marks 11 years since I entered this House; for others, it is election day. Going forward, we should name today Congleton day. Looking at the Order Paper, I can see that my hon. Friend had questions for the Department for Environment, Food and Rural Affairs and for the Church Commissioners. I cannot see on the Order Paper whether she raised anything in business questions—hopefully, at that point she had a short break before having debates on faith organisations and Burundi. It should be Congleton day from 5 May to celebrate this active and effective campaign. I look forward to receiving a copy of her local paper with that quote in next week.

I also pay tribute to the work of my hon. Friend the Member for Stafford (Jeremy Lefroy). I thank both he and my hon. Friend for phoning me, emailing me, bending my ear in the Lobby, and providing important information from their friends and colleagues in Burundi and from others in the world who have a particular interest in Burundi.

At the outset, I would like to say that I am answering on behalf of the whole of Her Majesty’s Government. The Under-Secretary of State for International Development, my hon. Friend the Member for Ruislip, Northwood and Pinner (Mr Hurd), and I work incredibly closely on this and all issues. We are one Government, one HMG.

The United Kingdom is playing a leading role in trying to build a strong and coherent international response. I visited Burundi in December 2015 and have consistently urged the Burundian Government, in the strongest terms, to end the violence and engage in inclusive dialogue. We have suspended development aid, as was mentioned earlier. We have also imposed travel restrictions and frozen assets of those who have undermined democracy and fuelled conflict.

In June 2015, the UK appointed a special envoy to the great lakes, Danae Dholakia, who is very active in delivering our messages on Burundi. In fact, I spoke to her yesterday when she was in Stockholm, working with other special envoys. Through the conflict, stability and security fund, we will be increasing our efforts on the ground. These will include deploying a Burundian co-ordinator in Bujumbura. I know that hon. Members present today, and those on the Select Committee, are keen for us to do more on the ground in Bujumbura, and that message is very much understood.

DFID offices in both Kigali and Dar es Salaam have significantly stepped up their analysis and coverage of the crisis, to ensure that they can respond to an evolving situation and increasing humanitarian need as necessary. My hon. Friend the Under-Secretary has visited the refugee camps in Tanzania, where we have consistently provided support to refugees, and in fact increased that support. When I was in Uganda, I spoke to UN non-governmental organisations and DFID, which is providing refugee support in that country, as well as looking at the political relationships across the region.

I can assure my hon. Friend the Member for Congleton that when I was in Burundi, I met both the UN and human rights organisations in private to hear their detailed concerns, which are not dissimilar from those that hon. Members expressed. In March I addressed the UN Security Council and regional leaders of the great lakes, highlighting the need for urgent action in Burundi. When I visited Rwanda and Uganda last year, I stressed the importance of the countries in the region playing a constructive role. I also met the African Union’s peace and security commissioner, Smail Chergui, in the margins of the African Union summit in January. The African Union is continuing to lead the international response to the crisis. The British ambassadors and high commissioners across the region continue to lobby their host Governments on the importance of taking action to resolve the situation in Burundi, using all parties, be they regional or international.

As this debate has highlighted, the situation in the country remains extremely fragile. The UN estimates that nearly 500 people have died in the past 12 months, and that 280,000 people have fled to neighbouring countries, although you will appreciate, Madam Deputy Speaker, that it is very difficult to monitor precise numbers, and actual figures may well be higher. The International Criminal Court has opened a preliminary examination of the violence committed in Burundi to date. We will continue to work with our partners, including the UN Security Council, to promote accountability through every means available.

Burundi was rightly identified as one of the Foreign and Commonwealth Office’s 30 priority countries in our 2015 human rights report, published last month. The report makes it clear that the human rights situation in Burundi

“poses a threat to the stability of the country and wider region”.

We are extremely concerned about a further deterioration, which is one reason why I welcome this debate and a continued dialogue around the actions that we can take that militate against further deterioration in that conflict.

In recent weeks, there has been an alarming increase in assassinations, with about 30 in April, compared with nine in March. There seems to be a move from indiscriminate to more targeted killings. Most recently, Brigadier General Kararuza and his wife, to whom my hon. Friend the Member for Congleton referred, were assassinated on 25 April with their family on the way to school. I thank my hon. Friend for showing me those photos, along with our hon. Friend the Member for Stafford. As harrowing as the photos are, we have a responsibility to see the reality of the atrocities in order to understand what is happening in Burundi. I condemn these killings unreservedly and call on the Government of Burundi to ensure that the perpetrators are brought to justice. I will be writing again to the Foreign Minister and, I hope, speaking to the Foreign Minister of Burundi next week to make these points yet again.

Looking beyond the individual tragedy of each death, we are concerned that these events indicate that, far from abating, the cycle of violence fuelled by the Burundian Government is getting worse. Some of that violence is, I think, directed by the Burundian Government and some is conducted by people outwith the direct command and control of the Burundian Government. It does appear that the nightly violence that was a feature of the conflict has subsided. However, this is no cause for optimism, as more and more people have left the country, are not coming out at night or have gone into hiding.

The Burundian Government continue to encourage a climate of fear and intimidation with abductions, disappearances and arrests still commonplace. Some of those people are taken into police custody, but many are being held by the intelligence services in secret detention facilities, without access to due process. Families fear that they will never see their disappeared loved ones again. Recently there has been a small but significant increase in reports of sexual violence—systematic multiple rape organised as a way of punishing and subduing a community.

The UN High Commissioner for Human Rights has indicated that many detainees show signs of torture. There is an increase in torture in Burundi, over and above the initial killings. Reports suggest that torture and ill treatment are not limited to the capital, where the majority of arrests have taken place. A pattern of abuse is emerging across the country. That may be a result of a time lag in our finding out what is happening outside Bujumbura. The Government of Burundi claim that the security forces are arresting only those suspected of serious crimes. I do not believe that that is true, but even if it were, there is no justification for the ill treatment of prisoners, who have the right to expect the state to protect them, and certainly not to pass them on to the Imbonerakure or other third parties who may be responsible for the torture and killings.

I know that many Members are concerned at reports that the violence is increasingly ethnic in nature, and that the spectre of ethnically driven mass violence is hovering over the conflict. Although I share those concerns—there are some indications that ethnicity is an increasing factor—we must steer clear of assuming that the whole conflict is racially motivated. The conflict was primarily political and remains so. My hon. Friend the Member for Congleton explained the history of President Nkurunziza’s attempts to cling on to power for a third term. That was the origin of the conflict. It was not primarily a Hutu-Tutsi conflict. Hutu opponents of Nkurunziza are also being targeted, and initially were targeted in larger numbers, both by the state and by the Imbonerakure, the youth militia, but there is an increasingly ethnic tone to the conflict, which makes the neighbours of Burundi deeply worried and the international community even more worried than we would otherwise have been.

I want to see an end to the conflict and an end to the human rights abuses in Burundi. When I spoke to former Tanzanian President Benjamin Mkapa yesterday, we agreed that the only route to a lasting solution lies in an inclusive political process. I give him my full support in his role as the facilitator of the dialogue established by the East African Community. It is right that we let that dialogue take place, and Benjamin Mkapa is the right person to lead it.

I was disappointed by the postponement of the Burundi dialogue, which was due to take place in Arusha this week. Following my conversations, however, I am encouraged by indications that talks will begin on 21 May. President Mkapa is using the intervening period to bring more people to the talks and to have more bilateral talks before the talks themselves happen.

It is essential that all parties, including people who have taken up arms or who have now left Burundi, are part of the engagement and peace process, because a peace process without all the participants is not a proper peace process and will not lead to peace in Burundi. Everybody needs to be included, and by not engaging in an inclusive dialogue, the Government of Burundi are actively obstructing the national reconciliation process. In my phone call to the Burundian Foreign Minister next week and in my letter to him, I will call on the Government of Burundi to come together with all participants and to allow them in some way, shape or form to be in Arusha for the week of 21 May so that the talks can commence.

It is essential that the talks are based very much on the Arusha accord, but I am flexible about the details of how they take place. Like the rest of the international community, I will follow the lead of President Mkapa when he agrees a strategy for the talks.

We are working with our partners on the UN Security Council to agree a deployment of UN police to Burundi. The force will be tasked with monitoring the situation, promoting respect for human rights and advancing the rule of law—all with the aim of creating conditions that will allow a political dialogue to go forward.

The UN Secretary-General has brought forward three options for the police force. The first is a protection and monitoring force with around 3,000 personnel in uniformed units. The second is a monitoring operation with over 220 officers. The third would involve more of an assessment mission, with 20 to 50 officers working with the Burundian police force to increase its capacity.

The UK Government are trying to seek UN agreement on what should happen, but we want the UN police to work with the African Union’s deployment of 200 military and human rights observers. The monitoring mission will have to go across the whole of Burundi and have an authoritative way to report back to the UN Security Council. Once the mission is in place, there will be the opportunity to scale it up, but it is important that we get individuals on the ground as soon as possible to assist with the mission.

The protection and monitoring option is desirable, but, to be frank, highly unlikely to get the support of the Government of Burundi or, indeed, the agreement of the UN Security Council as a whole. Although this option would be tempting for the British Government, it would take a lengthy time to recruit 3,000 French-speaking officers, and we really need them on the ground now. However, discussions are ongoing in the UN Security Council, and I am more than happy, through parliamentary questions or any other method, to keep the House updated.

My hon. Friend the Member for Stafford has raised with me specific cases of detention and of people who have died in Burundi. I thank him for doing that, because it has been very helpful. He discreetly did not go into details of those cases, but we are working on them, and we will continue to do so. For anyone listening to the debate who knows about those cases, let me say that Her Majesty’s Government are actively pursuing them. People should find some comfort in that, although it does not immediately provide the certainty that I would like them to have.

Let me assure Members that I am as concerned as they are about the human rights situation in Burundi. The UK Government and our international partners want to end these dreadful abuses and find a peaceful way forward. Only then will the people of Burundi be able to live freely without violence and without intimidation. As I said, I visited Burundi last December. I also visited it way back in 2006, when I met President Nkurunziza. Burundi can be a great country again. It needs our help now, but it has the help and attention of the UK Government.

As always, it is a pleasure to serve under your chairmanship, Mr Rosindell. I congratulate my hon. Friend the Member for Twickenham (Dr Mathias) on securing the debate and particularly thank my hon. Friend the Member for Filton and Bradley Stoke (Jack Lopresti) for making insightful interventions, given his history and expertise in this matter.

With your permission, Mr Rosindell, I will interpret the subject of the debate widely and will refer to small arms and light weaponry—rather than small weapons—a term that is more established in the trade and in Government policy, as a way of encompassing the totality of what is happening. I will also try to draw a distinction between traders and brokers, because I think there is a bit of a misunderstanding. A broker is someone who arranges a deal, perhaps through a third country, and the goods more traditionally come through the individual trader.

The effective control of small arms and light weaponry is a goal that clearly unites us all, because, as we have heard, the potential consequences of their misuse are so grave. I see that across my portfolio and particularly on the African continent. When states fail to control the supply and sale of these weapons, they not only jeopardise the safety and security of innocent people worldwide—including a disproportionate number of women and children—but fuel instability more generally and threaten international peace and security.

The debate has focused on national arms trade and controls, so I would like to deal with that up front. The UK Government operate one of the most rigorous and transparent arms export control systems in the world. My hon. Friend the Member for Filton and Bradley Stoke indicated that. My hon. Friend the Member for Twickenham talked of Sir John Stanley, whom I served with in two Parliaments. For the last five years, he was the Chair of the Committees on Arms Exports Controls, on which I briefly served as a member of the Select Committee on International Development, which contributes to that work. Sir John Stanley has previously acknowledged that the UK operates

“one of the most transparent export licensing systems in the world”.

So we really are at the cutting edge of what is being done. That is not to say that we should not do more, but I do not want the House to be left in any doubt as to whether we are a laggard on these issues; we are right at the forefront. However, I will deal with the points that my hon. Friend raises. Just because we are right at the forefront and doing the right thing globally does not mean that we cannot and should not do, and aspire to do, more.

It is right that the Government facilitate responsible exports by British companies, and support them in winning such contracts. In many cases, the export of arms is of benefit. It brings security and stability. It is in the interest of the importing country and it is in the British national interest.

Does my hon. Friend the Minister agree that it is vital that we protect our sovereign defence capability, not only for jobs and exports but for our very protection, our expertise and our ability as a sovereign country to conduct our own operations with our own kit?

Absolutely, and I defer to my hon. Friend, with his military expertise. It is important to maintain that capability overall, in terms of critical mass. Also—I travel from country to country with conflict areas—there are issues of interoperability between weapons, particularly large weapons as opposed to small arms. Having a production facility with similar arms and munitions is very helpful in theatre, as well as in building critical mass to maintain the British Army.

All export and trade licence applications are fully assessed, very carefully, on a case-by-case basis, in line with international legislation but also domestic—national—arms licensing criteria. That takes into account all the factors at the time of application, including the prevailing circumstances in the recipient countries, the nature of the goods that are being sent, the nature of the end-user and, in addition, the stated end-use. The Government follow a clear procedure for each application. That is informed by expert advice from a number of Departments. My hon. Friend the Member for Twickenham asked about the degree of co-ordination. I think that some of her interactions have been with BIS. The Foreign Office takes the lead on a lot of these matters, but the Home Office and a number of other Departments are also involved. A licence will not be issued in any way, shape or form if it would be inconsistent with the provisions of our export regime in its totality.

If there is a clear risk that the goods may be used for internal repression or external aggression, a licence is always denied. The UK has one of the world’s most effective enforcement regimes for arms exports. Enforcement of the UK’s arms export controls is led by Her Majesty’s Revenue and Customs, which works jointly with Border Force to detect and prevent unlicensed arms exports. HMRC and Border Force work closely with other Government Departments and with other intelligence agencies across the world to ensure that arms are not exported through the UK in breach of the UK’s licensing controls.

Additionally, HMRC works with the Department for Business, Innovation and Skills to engage with legitimate arms exporters and to help them to comply with the law, but we are vigorous in actively pursuing those who either deliberately or carelessly circumvent legislation. We remain committed to transparent exchange control systems, as demonstrated by the publication of export licensing decisions and details of export controls policy in the UK annual report on strategic export controls, as well as in the European Union annual report on arms exports.

The Government recognise and respect the public interest in export licensing decisions, and therefore we took the decision to publish quarterly statistics on all export and trade licences issued, refused or revoked. I understand that my hon. Friend would like us to publish more information. That has a cost. If we were to do that in looking at the overall picture of reducing the number of atrocities, we would focus too much on already law-abiding providers supplying more detail. There is a much bigger picture in respect of the supply of small arms and light weaponry. If someone is looking to source weaponry for nefarious purposes, there are many places across the world where they would look before looking to the United Kingdom, both in terms of laxer export controls and in terms of price and quality—such countries offer lower quality but, all importantly, lower price.

In parallel to our work on our own system, it is important that we ask others to step up and meet the same exacting standards to which Sir John Stanley referred when he said that we operate

“one of the most transparent export licensing systems in the world”.

If I were able to do one thing on this issue, it would be to get others to do as well as we are, not to improve an already excellent, but not perfect, system in the UK.

Among other things, in terms of data, we are committed to a reporting timescale and the provision of data analysis. The Government are a world leader on transparency, and we are fully compliant with European Union and other international requirements.

The brokering of arms sales continues to be controlled on a rigorous case-by-case basis through the licensing assessment process. The idea of creating a pre-licensing register of arms brokers was explored by BIS, and my hon. Friend’s predecessor as the MP for Twickenham, in a call to evidence in 2014. I have reviewed BIS’s correspondence. I am sure that my hon. Friend has tales of campaigning against Liberal Democrats in Twickenham. In my 10 years in the House, and during the coalition, there were occasions when—I say this gently—the Liberal Democrats over-promised and under-delivered. If that had been a priority, and if it had been the right thing to do, it could have been pushed forward at the time, but in letters to constituents her predecessor promised a lot but did not deliver. The consultation showed that, actually, delivering that was the wrong thing to do. In a sense, it would have layered in extra bureaucracy without addressing the fundamental problem.

In the last 10 years, the UK has successfully prosecuted eight UK nationals for arms trafficking and brokering outside the UK. Customs investigators work jointly with law enforcement officials across the world to gather the necessary evidence to enable such prosecutions. Additionally, we continue to work with international partners to prevent and disrupt arms transfers before they occur, including through the sharing of intelligence. The global control of arms requires an overall global commitment to marking, record keeping and tracing weapons. Without the proper management of stockpiles, weapons may end up in the wrong hands, fuelling crime, terrorism and conflict, so we need everyone to up their game.

The UK has signed and supports various politically binding agreements, including the international tracing instruments, which promote effective national controls over the full life-cycle of small arms and light weapons. We encourage and support states to improve their stockpile security, including by funding projects through, for example, the counter-proliferation programme fund, which is FCO-led but delivered across Departments, in priority countries such as Libya. We look at how we can prevent arms from disappearing out of that country, as has happened previously.

In conclusion, the Government support the responsible trade in defence equipment but always apply rigorous and accountable national export control systems. The Government have one of the most rigorous and transparent export control systems in the world. I welcome the continued high level of scrutiny—including debates such as this one—which remains central to our goal of achieving global security through responsible exports.

I congratulate the hon. Member for Kilmarnock and Loudoun (Alan Brown) on securing this debate, on his strong interest in Western Sahara and more generally the work of the all-party group on Western Sahara. I thank other hon. Members from all three main parties for their contributions. In my briefing, I was not prepared for questions about the Scottish referendum, but I congratulate the hon. Member for Glasgow North (Patrick Grady) on getting that in.

I am sorry to disappoint hon. Members who were expecting the illustrious Under-Secretary of State for Foreign and Commonwealth Affairs, my hon. Friend the Member for Bournemouth East (Mr Ellwood), who would have been delighted to respond to the debate, which is within his portfolio. He was, until very recently, engaged in another debate on the Floor of the House. It is therefore my pleasure to respond to the debate, particularly because, as the hon. Member for Leeds North East (Fabian Hamilton) alluded to with great foresight, both of us went to Western Sahara while on the Back Benches in order to be better briefed for this very occasion. We specifically visited the UN headquarters in Laayoune to see its work for ourselves first hand.

The Government’s position on Western Sahara is consistent and long-standing. The Government consider the final status of Western Sahara as undetermined, and we support the UN-led efforts to reach a lasting and mutually acceptable political solution that provides for the self-determination of the people of Western Sahara. In line with the debate, I will first speak about the underlying principles of self-determination and our support for those, then move on to the situation in Western Sahara and how it applies to the broader issue of self-determination.

In his statement of principles for world peace nearly a hundred years ago, President Woodrow Wilson said:

“Self-determination is not a mere phrase. It is an imperative principle of actions which statesmen will henceforth ignore at their peril.”

I am not sure he had the hon. Member for Leeds North West and me in mind when he said that, but nevertheless, I think I can speak for both of us in saying that we hear that principle. Wilson was unsuccessful in his attempts to include the principle in the covenant of the League of Nations.

More than two decades later, in the midst of world war two, Winston Churchill and Franklin Roosevelt came up with a set of principles that defined the Allies’ goals for the post-war world, which included

“the right of all peoples to choose the form of government under which they will live”.

Their Atlantic charter is widely recognised as a precursor to the 1942declaration of United Nations, which was the foundation of the charter of the United Nations. This charter, and many other treaties and agreements to which the United Kingdom is signatory, set out clearly the right to self-determination.

The principle of self-determination is about freedom to make one’s own choices. This country demonstrated its commitment to that principle in 2013, when the Government gave residents of the Falkland Islands the freedom to choose whether they wanted to remain a British overseas territory. Self-determination has allowed, and continues to allow, countries and territories around the world to determine their own fate and chart their own course.

Turning to Western Sahara, the UK supports UN-led efforts to reach a lasting and mutually acceptable political solution to this long-standing dispute that provides, crucially, for the self-determination of the people of Western Sahara. Morocco and the pro-independence Polisario Front both claim sovereignty over Western Sahara. An International Court of Justice ruling on the issue in 1975 means that the territory is “non-self-governing” under chapter XI of the UN charter, and that its people therefore have the right to self-determination. Following Spanish withdrawal in 1975, most of the territory has been under Moroccan administration.

In 1991, after more than 15 years of hostilities between Morocco and the Polisario Front, a ceasefire was brokered by the Organisation of African Unity and the United Nations. It was agreed that both sides would stop fighting and the UN would monitor the ceasefire. The UN would also prepare for a referendum in which the Sahrawi people would exercise their right to self-determination, choosing either to be an autonomous region within Morocco or an independent state. That was the mandate for the UN MINURSO, which we have discussed, and which I visited with the hon. Member for Leeds North West in 2014. That body has succeeded in monitoring a ceasefire. The UN has persisted, through rounds of discussion, negotiations and renegotiations, in trying to find a political solution to the conflict. However, despite engagement and credible efforts over the years from both sides, little real progress has been made on the political track.

On 11 April 2007, Morocco put forward a proposal for advanced autonomy for the region. I think that is what the hon. Member for Kilmarnock and Loudoun was referring to when he asked about the Government’s views on the proposal. UN Security Council resolution 1754 of 30 April 2007 took note of the proposal and welcomed the serious and credible Moroccan efforts to move the process forward towards resolution. It also took note of the Polisario Front’s proposal presented on 10 April 2007. However, neither proposal was accepted by the other party and no further proposals have been put on the table. The solution has to be UN-led. The UN has to move things forward.

In March this year, the UN Secretary-General made comments, which a number of Members have referred to, during a visit to the region. That led to disagreement around the UN troops and to withdrawal of the 84 civilian members of the UN deployment. While the Secretary-General has since clarified his statement and expressed regret for the misunderstanding caused, the civilian staff still have not returned. The UK Government are concerned about the lack of a civilian component in the force. Without that vital support, the UN mission is unable to fulfil its existing mandate, let alone an extended one. It is unable to assist the UN and thus the UK’s interest in finding a political solution, but it is still maintaining peace and security in the region.

We have urged the UN secretariat and Morocco to engage in dialogue that will allow the individuals to return as quickly as possible to enable the full functionality of the mission, allowing it to carry forward the full scope of its existing mission. We are hopeful that a way forward can be found. The situation is not totally gridlocked, but more effort is needed.

Turning to some of the additional points made during the debate, the hon. Member for Bridgend (Mrs Moon) and a number of other Members talked about Daesh. We are concerned about the presence of Daesh throughout the broader region, although the Moroccan authorities have disputed the assertion that cells have been encountered. On the other hand, the Secretary-General’s personal envoy, Christopher Ross, has told the permanent under-secretary for the middle east and north Africa that about 15 individuals have travelled to fight with extremist groups in north Africa. I do not think 15 can be described as endemic, but we are aware of some people travelling from the region.

A lot of points were made about human rights. Although it is primarily a UN process, the UK, through its position on the Security Council, stresses the importance of humanitarian rights on an ongoing basis in Western Sahara and the camps. That was clear in the UN Security Council resolution of April 2015. The United Nations High Commissioner for Human Rights visited Western Sahara in 2015 and the findings of that report will be reflected in the Secretary-General’s report, which we believe will be published later today. As I stand before the Chamber, I have not seen that it has been published. That is only one way that the UN looks at human rights in the area.

There was a specific case that the all-party group would like me to look into. If it writes to me with details, I am more than happy to look into that and circulate a letter that can be sent around to the rest of the group.

There has been progress on human rights. The Moroccan authorities recently took steps to improve human rights, including ratifying the protocol to the convention against torture and ending the practice of trying civilians in military courts. That is good progress, but I still hear calls to do a lot more. We are considering our position on the mandate renewal but, as I have said, actually getting the existing mandate delivered is troublesome without extending it further. I was asked by the hon. Member for Leeds North East about commercial activity. We do not consider commercial activity in Western Sahara to be illegal, as long as it respects the interests and wishes of the people of Western Sahara and benefits them. The UK does not prohibit companies from engaging in commercial activity, but they should take legal advice before doing so.

The Office for the Co-ordination of Humanitarian Affairs supports refugees in the camps in Algeria through all the UN agencies, most notably UNICEF, the United Nations High Commissioner for Refugees and the World Food Programme. This is a situation that we are very much aware of and very keen to engage in, and I look forward to progress being made through the UN and through working with the all-party parliamentary group.

This is much more familiar territory for me.

Officials met over 500 Chagossians in their communities in the UK, Mauritius and the Seychelles. The public consultation we published in January received over 800 responses. I recognise that Chagossians have urged us to announce a decision soon, and we very much hope to do so.

Does the Minister agree that the £60 million estimate for the resettlement of the Chagos islanders, at 0.002% of the international development budget, is a price that the Government must pay this year so that the Chagos islanders can return home? Every day they are not allowed to do so is a day of shame for this country.

Perhaps I might outline for the House some of the costs. We estimate that the initial costs would range from £55 million for a 50-person pilot on Diego Garcia to £256 million for a 1,500-person resettlement on Diego Garcia and the outer islands. In addition, operating costs would range from £5 million to £18.5 million a year on a potentially open-ended and escalating basis.

The Prime Minister said yesterday that all of Britain’s overseas territories and Crown dependencies, apart from Anguilla and Guernsey, have now agreed to provide our law enforcement and tax authorities with full access to information on beneficial ownership. Why will there not be public access to the registers, given that the Prime Minister wrote to the overseas territories on 25 April 2014 to say that making such information open would help “to tackle crime”, and given that, from June this year, the British register of beneficial ownership will be open to the public? If openness is good enough for the UK, why should we accept a different position in our overseas territories?

It is disappointing that the shadow Secretary of State does not congratulate the overseas territories on the enormous progress they have made on tax transparency and on opening up for law enforcement agencies. This is really superb progress, but as the Prime Minister outlined yesterday, it is not an international standard, and we need to move towards eliminating all corrupt, terrorist and money laundering practices across the globe. While there are states in the US where people can open companies and not have full public registers, it is only fair to say to the overseas territories, “Congratulations on progress so far.” Longer term, the Prime Minister and the Government are clear that we want greater transparency, and that will be about a move towards public access.

I do welcome progress; I was just asking why the overseas territories will not meet the standard Britain is going to set.

Our membership of the European Union helps us in the fight against money laundering, terrorist financing and tax evasion—an example being the fourth anti-money laundering directive, on which the UK has taken the lead. The directive will, for the first time, oblige all member states to keep registers of beneficial owners and to make those open to tax and law enforcement authorities and to others who have a legitimate interest, including investigative journalists. Does that not show that leaving the EU could hinder the fight against financial criminality in Europe, because the best way to tackle such criminality is to work in partnership with our neighbours?

Last week I visited the scene of the attack in Grand Bassam in Côte d’Ivoire, which killed 19 people and injured more than 20, and laid a wreath on behalf of Her Majesty’s Government. Furthermore, I met President Ouattara and discussed how the UK can support efforts to prevent the radicalisation of young people in his country. We all offer our condolences, support and, indeed, solidarity.

T9. Developing countries lose three times as much to tax havens as they gain in international aid. Although yesterday’s announcement was a welcome, partial step in addressing that, registers of beneficial ownership will be ineffective unless they are public. Does the Minister agree that the Prime Minister’s anti-corruption summit next month would be an appropriate deadline to insist that all of the UK’s overseas territories and Crown dependencies adopt public registers of beneficial ownership?

First, we should congratulate the Prime Minister. This is the first international conference on anti-corruption. We have already made great progress on beneficial ownership, but it is not the only issue of corruption. Having visited Ghana last week, I know that many other issues need to be tackled. Although beneficial ownership is an important issue, it is not the only issue for that corruption conference.

T5. The huge Mosul dam is crumbling and might collapse. If it does, Mosul will be covered with up to 70 feet of water and 1.5 million lives will be threatened in Tikrit, Samarra and Baghdad. What work is under way to maintain the integrity of that structure?

I am sure the whole House will join my condemnation of the human rights abuses, documented by the United Nations and Amnesty International, that have been committed by the South Sudanese Government forces, which included deliberately suffocating men and boys in a container and allowing government soldiers to rape women in lieu of wages. Following his recent visit to South Sudan, can the Minister tell the House what representations he has made to the Government of South Sudan and what process is in place for peace?

I made a number of representations to President Salva Kiir and to Riek Machar during the African Union meeting. The UK Government secured agreement at the UN for a new commission on human rights, and the Government of South Sudan must now fulfil its commitment to co-operate with the commission, which is charged with investigating gang rapes, the destruction of villages and attacks on civilians that may even constitute war crimes.

T8. Many of my constituents have expressed concern about the possible admission of Turkey to the EU. Is it still the Government’s policy to support Turkish admission? Bearing in mind public hostility, are they prepared to reconsider their position?
