It has been some four years since I stood at this Dispatch Box, so it is a pleasure to be back. I took part in Transport orals a few weeks ago, but that was on one of the screens above us. I am very pleased to be here shadowing the Minister today. We have already established a constructive relationship. We debated our first statutory instrument together yesterday in Committee. As I said to her, I will be writing to her and scrutinising what she does, but in a spirit of constructive working. We have the decarbonisation of transport brief and the EU transition brief, both of which are incredibly important in the current circumstances.

The statutory instrument that we are discussing today is uncontroversial in that we accept that, now that Britain has left the European Union and the end of the transition period is in sight, we need to transfer relevant powers away from the European Commission and to the Secretary of State for Transport as smoothly as possible. I understand, a number of statutory instruments will be issuing forth from the Minister in the coming months, and that could be seen as a mechanistic process to ensure continuity. That does not mean to say, however, that we will not scrutinise and challenge if we have concerns about the way that the Government are doing things.

As the Minister said, the function of the measure is to ensure that there are minimum insurance requirements for air carriers and aircraft operators in respect of passengers’ baggage, cargo and third parties. My understanding is that that stems from the 1999 Montreal convention, whereby airlines are responsible for compensation in the case of death and injury to passengers, and are required to be adequately insured to cover any liabilities. The EU civil aviation insurance regulation sets out the minimum level required.

I have one question, which the Minister may have answered in her opening remarks. Given that the statutory instrument transfers power from the European Commission to the Secretary of State to set those minimum requirements, and that he—or she in future—can do so by regulation, is there potentially a risk that the minimum insurance levels will not be the same as they would be if we were still part of the EU scheme? I think that is quite an important point to note.

The statutory instrument is one of many that the Government are having to rush through Parliament as a result of what I would say is an unnecessary focus on an arbitrary date in our exit from the transition period. Given the limitations on parliamentary scrutiny at the moment because of the need for social distancing and the fact that not as many Members can take part in proceedings, as well as the delay that we have had over the past few months, there is a danger that we could be rushing delegated legislation rather than giving it the proper attention that it deserves. Given the need for certainty for the people who will be affected by such legislation, we do not want a logjam towards the end of the year, giving rise to uncertainty about whether arrangements will be put in place or not.

The fact that we have now got started, and that we have dealt with two of the statutory instruments this week, is a good start. I do not think, however, that fixing in law the end date for the transition period has been beneficial to the legislative process, and I am uneasy about the apparent lack of progress in ongoing negotiations with the European Union. The concerns about a damaging exit at the end of the year are very real. That is particularly important for the aviation industry, given that we are in a time of unprecedented economic upheaval for the sector.

The aviation sector’s need for certainty has never been greater. Brexit will inevitably have an impact on a business that is, by its very nature, about crossing borders and relationships with other countries, and the global pandemic has hit aviation especially hard. There has been a devastating collapse in air traffic of approximately 90%, which is putting at risk an economically vital industry that supports 230,000 jobs.

We need clarity from the Government on three major policy areas. The first is the one that we are discussing today—the legislation related to the European Union and the transition period. We also need clarity on the financial support for the industry, and on the nature of the measures that the industry must implement to avoid further spread of covid-19.

I am pleased that today we are establishing a degree of clarity on one aspect, as it relates to the EU transition period, but confusion still reigns over the Government’s quarantine for new arrivals, and we continue to wait for a specific conditional support package for the aviation industry. I and my colleagues in the shadow Transport team are very happy to work with Ministers to try to ensure that the aviation industry is given the certainty, the clarity, the direction and the support that it needs.

It is a pleasure to see you in the Chair, Mrs Cummins. I do not intend to take up too much of the Committee’s time, which I am sure everyone will appreciate, but I want to place a few things on the record. First, I thank the Minister for the pre-briefing with her civil servants that she offered me earlier today. Particularly with what, on the surface, can seem to be quite obscure statutory instruments, it is always helpful to have access to the same advice as the Minister. I thank the civil servants for taking part in that.

The statutory instrument is not controversial and I do not intend to oppose it, but it is important for the reasons that the Minister outlined. Obviously, air traffic management is an extremely important aspect of the successful and safe operation of the aviation industry, so it is right, now that the UK has left the EU and the end of the transition period looms, that the relevant powers in relation to air traffic management are transferred to the Secretary of State and authorities such as the Civil Aviation Authority and NATS Holdings to ensure that all air traffic flows can safely continue. We might have our own views as to the wisdom of leaving the EU and having to replicate all this or take it back into our hands, but we have probably exhausted that debate, and I do not intend to revisit it, although I cannot promise that I will not at some point in future, particularly as we get towards the end of the year.

The European Union’s single European sky legislation successfully enhanced air traffic safety for many years, so I am glad to see a broad continuity in policy throughout these regulations. We certainly support smooth legislative continuity for the aviation industry as the transition period ends.

There was much uncertainty for the sector because of Brexit, but that has obviously been heightened by the ongoing covid-19 crisis and the fact that so many flights have been grounded. The need for certainty and safety in aviation is why we will not oppose this statutory instrument, and why we will try to work with the transport team as much as possible. I do not have the aviation brief; I have the EU brief, and the brief for things such as decarbonisation of transport, on which the Minister and I have worked closely; I appreciate her doing that. I sent her another letter this afternoon—just to flag that up—about car scrappage. I am sure she looks forward to seeing that in her inbox when she returns to the Department.

At a time when the industry faces such immense economic difficulties because of the ongoing pandemic, it is right that we do not put up any more legislative barriers for the sector. The priority must be providing clarity on the future for the sector post transition, and that is what we are attempting to do today by ensuring that the legislation passes and the responsibilities are transferred away from the European Commission without further hold-up.

As negotiations with the EU continue, albeit far from smoothly—I am sure the Minister will agree there is a lot to get through before the end of the transition period—I hope that the Government ensure that there is close co-operation between the UK and the EU on the research, development and deployment of new air traffic management technologies, regulation and network management functions in future.

Air traffic management and aviation generally is an area where close international co-operation will always be absolutely vital, and the UK’s relationship with the European Union can be no exception to that. I thank the Minister, and you, Mrs Cummins, for giving me the opportunity to speak. I very much look forward to working with the Minister in future.

I am happy to provide my hon. Friend with that reassurance. The integrated rail plan is looking at various transport investments in the north, and we very much intend that still to report by the end of this year. On the dualling of the A64, I can assure him that that is now officially in the road investment strategy 3 pipeline, and it will be investigated carefully as we prepare to make decisions for the next strategy.

It is so good to see so many cities and towns now putting in place infrastructure to support active travel, particularly cycling, but not everyone can work or cycle to work, not everyone has a car and no one wants the new normal to be cars clogging up the streets and despoiling the clean air. Why are the Government not working with city regions and other councils on a safety-led scaling up of passenger transport, why did they not talk to local leaders about public transport before urging a return to work and why is there a support package for Transport for London but not for other major cities?

My hon. Friend is right to observe, as I did earlier, the importance of these services to the oil and gas sector in particular. The Department and the CAA as a whole are examining the economic impact of any changes that may occur across all our regional airports, but our focus is on working hard to ensure that we get the right result.

I entirely accept the importance of regional airports to jobs—Bristol airport is on my doorstep and I was a director of London Luton airport in my days as a councillor in Luton—but the fact that the Minister can come to the House to answer an urgent question about domestic flights without mentioning decarbonisation and climate change once just shows—[Interruption.] He has mentioned them in response to questions but did not mention them in his initial response. He has been prompted to do that. It is not enough to kick it into the long grass and say, “This is something we’re going to deal with in the future.” Decarbonisation and climate change need to be factored into the Minister’s response to the Flybe emergency and APD now.

I have mentioned decarbonisation at least three times. I tried to obey Mr Speaker’s instruction to keep my opening statement brief. I entirely recognise the importance of decarbonisation, and a significant amount of work is occurring in the Department, between two Ministers. I ask the hon. Bus patronage varies across the country, and as a bus champion I am pleased to say that catching a bus is the most popular form of public transport. Hon. Members will want to know that we continue to invest in our bus services with further additional funding of £220 million through the better deal for bus users package, which will also include £30 million paid directly to local authorities to improve current or new services.

I thank the hon. Lady for her question which enables me to elaborate on the further funding that is available, but of course we know the importance of bus services; not only do they get people to work, but they ensure connectivity across our communities. As well as the £220 million of additional funding, we have the £1 billion for concessionary fares, but also the transformative £2.5 billion for the transforming cities fund, which also looks at reducing congestion. The hon. Lady talked about the reduction in services in England, but she may want to know that the highest number of bus services cut in the United Kingdom are of course in Labour-led Wales.

Bristol has bucked the trend of declining bus use, and under the Bristol bus deal we are investing in bus prioritisation measures and infrastructure, and in return the bus operators are investing in new commuter services, but we remain the only core city without a mass transit system; what can the Government do to help us realise our ambitions on that front?

I was pleased to visit Bristol and jump on a bus there, and it does indeed have a fantastic service. Patronage has gone up by 50%—[Interruption.] Well, it is getting better and better, and the numbers are indeed going up. One reason why the numbers are going up is that bus service operators are open to working with the local authority and making data available. One thing that we are doing, because of our Bus Services Act 2017, is ensuring the bus open data digital service is available for even more people. We know what people want, especially younger people: absolutely accurate detail on when their bus is arriving, how along the journey will take, and how much it will cost.

It is a pleasure to answer the debate of my right hon. Friend the Member for North Somerset (Dr Fox). I thank everyone who has contributed to the discussion, including the Bristol massive, who are lined up on the Opposition Benches—the hon. Members for Bristol North West (Darren Jones), for Bristol East (Kerry McCarthy), and for Bristol South (Karin Smyth)—ably assisted by the hon. Member for Strangford (Jim Shannon) in his support for his old right hon. Friend. I also congratulate my right hon. Friend on securing this debate on the future of the Portishead railway line and, indeed, the railway group that he named in his speech.

My right hon. Friend has always been an advocate of this important proposal and for improved transport links in and around his constituency. He describes the town of Portishead as one of the fastest growing in the south-west. Its population has risen by more than 3,000 since 2001 and is expected to increase by another 8,000 in the coming decade.

Reopening the Portishead line is an important part of the MetroWest scheme. This is a project that is led by North Somerset Council and the West of England Combined Authority, which have been leading on devolved matters in the area since 2017. I understand that good progress is being made—the business case for the Portishead line is being developed, and North Somerset Council will very shortly be taking a big step forward by submitting a development consent order for reopening the line to the Planning Inspectorate. I am very confident that our decision to provide £31.9 million of funding, subject to a satisfactory business case, provides the necessary commitment for North Somerset Council to submit the application and supporting funding settlement.

As my right hon. Friend knows, it is the Planning Inspectorate’s responsibility to assess and decide on whether to grant the consents necessary for construction to commence, and he mentioned that in his speech. Once the outcome is known, we expect to carry out a full assessment of the business case for the scheme. He asked me to be as speedy in that process as I possibly can, and I give him the guarantee that my Department will be.

Although the development and delivery of MetroWest and the Portishead route are ultimately the responsibility of the local authorities and have been since their inception, the Government are committed to working closely with Network Rail, North Somerset Council and the West of England Combined Authority to support the reopening of the line and all elements of MetroWest, because improving rail services for the people in the Bristol area and the west of England has been, and will remain, one of the Government’s key priorities. The importance that we place on the Greater Bristol area is demonstrated, I hope, by the recent investments that we have made. For example, we are investing £5 billion into the electrification and upgrade of the Great Western main line, from Paddington through to Bristol Parkway and Cardiff, delivering better services and new trains with thousands more seats.

Modernisation of the line will improve more than 100 million rail journeys each year and stimulate economic growth from London, through the Thames valley, to the Cotswolds, the west country and south Wales. It includes major rail infrastructure projects in the Greater Bristol area, such as the four-tracking at Filton Bank. This, combined with the biggest signalling renewal of its kind undertaken by Network Rail in the Bristol area, has increased capacity and contributed to reducing end-to-end journey times for Bristol to London Paddington services.

I wish to reaffirm my support for what the right hon. Member for North Somerset (Dr Fox) said in his speech. I remember back in 2005, when I was first elected, that we talked about the urgent need for the Portishead line to be reopened. And here we are some 14 years later still waiting. All these rail improvements for Bristol are a really good thing, but we do also need to look at the very short local journeys on the suburban branch line, because they are as important for getting people around as the commuter services.

Yes, I agree with the hon. Lady. She is absolutely right in what she says. As a Minister in the Department, I welcome the cross-party nature of the support that is being given to my right hon. Friend and this proposal.

The services that I was talking about when I took the hon. Lady’s contribution will ensure that the rail network can meet the growing passenger demand and will allow more trains to run in the future. My officials are working with Network Rail to secure funding to upgrade Bristol East junction to support future service enhancements and, importantly, to enable the capacity needed to run the second phase of MetroWest services. These works will also improve the resilience of the network, so passengers in the area will benefit from a more reliable railway.

As my right hon. Friend knows, the coming December 2019 timetable change will bring a significant increase in services making use of this new infrastructure, which is already providing performance benefits along the route.

The investments that we are making in the area are not just on the railways. As I am told by many people who live in and around Bristol, it is an exciting time for Bristol and the wider area. There are plans to develop the Bristol Temple Quarter enterprise zone, including Bristol Temple Meads station, for business, housing and education, including a new university campus. That work is progressing and is being led by the West of England Combined Authority and Bristol City Council. The combined authority will also receive £103 million from the Government through the transforming cities fund to transform connectivity in the city region.

On roads, the area has benefited from £36 million through the local highways maintenance challenge fund. Three separate awards provided by the Government, totalling £113 million, have been provided towards the metrobus scheme, which will provide a 50 km bus rapid transit network in the greater Bristol area.

Then, of course, there is MetroWest. The Government continue to be highly supportive of its development and recognise the benefits it will bring to the area. The plan is that MetroWest will help to reduce congestion in the centre of Bristol, get people out of their cars and create a cleaner environment for people in the city with a decrease in carbon emissions. That demonstrates the Government’s commitment to decarbonisation through moving journeys from road to rail and helps to meet our ambitious, legally binding target of net zero carbon emissions by 2050.

I do agree with the hon. Gentleman, who has highlighted one of the many problems, which is the lack of information. We all understand that problems on the network can cause trains to be delayed, but in the 21st century providing information in advance can enable passengers to work out a different route. Sometimes such information is simply not forthcoming. I well recall being at Southampton Airport Parkway station and buying a ticket for a train that the member of staff knew had already been cancelled, and I was then expected to take a convoluted route to get to Waterloo. Had he told me at the point of purchase, I could have simply got back in my car and driven to this place.

I want to start by giving credit where credit is due. Last Thursday, I returned from this place to Southampton on a train which ran ahead of time. That was a novelty. I wonder if it was a coincidence that it occurred a day after Mr Speaker granted this debate. Perhaps one should be granted every week and Mr Speaker has magical qualities of which we were previously unaware. It helped to strike up many a happy conversation among travellers when we stopped at Woking for a full five minutes, so far ahead of schedule was the train running. Oh, to have that driver again: truly his marvellous skills could be deployed on many a route across the network.

I would also like to give credit to the train staff who are in the main unfailingly polite and even jolly, sometimes in the face of extreme adversity, lack of information— as the hon. Member for Strangford (Jim Shannon) mentioned—and understandably bad-tempered passengers. But that is where the compliments cease.

I do not want my hon. Friend the Minister to think that I have come here just to whinge. I have not. I am seeking the opportunity to air the legitimate grievances of my constituents, but also to offer some constructive suggestions as to how the improvements identified as part of the Holden review might be encouraged in some instances, in order to improve the passenger experience.

Some of the railway’s services come to Bristol, although it is not the preferred route for getting to London as it takes so long, so I appreciate the right hon. Lady’s concerns. One group of passengers most affected by unreliable services of the types she describes are those with disabilities. It is easy to say that if information is made available passengers can change routes, but people with disabilities have to plan their journeys well in advance and it causes huge disruption for them if they cannot rely on the service.

I thank the hon. Lady for making that point. It may try her patience, but I will come on to the issue of disabled passengers at the end of my remarks. A constituent of mine has been in touch about a terrible experience he had on a train from London Waterloo to Basingstoke. As a disabled passenger, he was trapped on the train and unable to make alternative arrangements, and he had a distressing and dreadful experience.

I am concerned by the circular firing squad we sometimes see between South Western Railway, Network Rail and the Department for Transport. At times, all can appear keen to blame and turn on each other, when perhaps they might do better to establish a constructive relationship with clear accountability, instead of the obfuscation and fudge we have at the moment. It is not only in this House that we achieve more by working together.

I shall move on to the specifics of where it still seems to be going wrong. The independent review commissioned by my right hon. Friend the previous Secretary of State for Transport, and chaired by Sir Michael Holden, reported over a year ago now, making a number of important recommendations. This is perhaps a good time to consider those recommendations and allow my constituents the opportunity to reflect on the progress they think has been made. It is also a good time to pose questions to my hon. Friend the Minister about what oversight he has of the progress of South Western Railway against those recommendations, which particular ones he regards as the highest priority, and what sanction he might consider imposing if there is not adequate improvement. As I indicated earlier, SWR has had a year since the review, and the patience of my constituents—if not the Minister—has run out.

I would like to highlight in particular the frustrations regarding overcrowding. Of course, I welcome the additional trains introduced following the timetable changes in May, but there is a nagging suspicion that this has been achieved by pinching carriages from other services. As my constituent David Willey explained to me, the most significant change on the service he uses has been the reduction in capacity by 17% from 720 seats in 12 carriages to 600 seats in 10. This has meant he has had to stand in his carriage usually two mornings a week.

Barnaby Wilson of Chilbolton let me know that he could not remember the last time his commuter train in or out of London was not short-formed and/or late. He comments on the regular occurrence of a 10-carriage train running with just five, thus halving the capacity at rush hour. And we all know the consequences: people crammed in like cattle, standing for the entire journey, or forced to wait for the next train as they simply cannot get into the reduced number of carriages.

I am grateful for that question, and delighted by Labour’s recently rediscovered interest in emissions. The hon. Gentleman will know that many of the areas that he mentions—I say this as former Energy Minister—have been colossal successes. In the offshore wind industry, for example, the required levels of subsidy have fallen dramatically over time, as have the costs. As I said, we have the “Road to Zero” strategy. We also have the “Aviation 2050” Green Paper and the “Maritime 2050” strategy, all of which are designed to reduce emissions.

Over the past decade, Bristol has seen a 40% rise in bus use, which is obviously really good, but there is a downside in that buses and coaches contribute almost a quarter of NOx emissions in the city. We have been doing what we can to retrofit the bus stock, but we have just put in a bid for £2.5 million from the clean bus technology fund so that we can retrofit another 170 buses. Will the Government support that?

I am grateful to the hon. Lady for that question on an issue of great importance—reducing emissions from buses. We have done quite a lot of that already. I am sure that the Under-Secretary of State for Transport, my hon. Friend the Member for Wealden (Ms Ghani), will look forward to receiving the bid and will carefully examine it with her officials.

Indeed; I have experienced that, particularly with services departing from Paddington, which should be one of the easiest places to have train crews available, as well as relief train crews if there is a problem.

As a result of all that, GWR has had the third largest increase in complaints rates in the country—behind Northern and Grand Central—with complaints rising in the last quarter. Like Grand Central, a reason for the increased volume of complaints is the quality of the train, as well as delays and cancellations.

My hon. Friend has not yet mentioned the problems faced by people with disabilities and mobility issues when travelling on trains. I was at a recent meeting with a group people who were mostly wheelchair users or had other mobility issues, and they have problems with ramps not arriving, the wheelchair space being blocked, and not being able to get through the train because it is so packed. Does he share those concerns?

As I said to my hon. Friend when we discussed this issue a few days ago, the south-west is a vital part of our rail network. I am looking forward to discussing these issues with him further, as well as with the Peninsula Rail Task Force, which I hope to meet next week when I am in Cornwall discussing rail issues. The CrossCountry franchise offers passengers the ability to travel to Birmingham and on to the north-east and Scotland, or they can change at stations en route to connect on to trains that take them to other parts of the country.

The Minister just mentioned the Peninsula Rail Task Force. In the Government’s response to the recommendations in February, they said:

“we will look at improving connectivity between the Peninsula, Bristol and beyond”.

However, as we have just heard, that does not sound like it is happening, particularly with the CrossCountry franchise. Can the Minister explain what is meant by “improving connectivity”?

No decisions have been taken on any options for the next franchise. This consultation is a way for us to gather the views of the travelling public and of Members of the House, so that we have the best-informed choice of possible options when we take those decisions.
