We are seeing a record number of people prosecuted for sexual crimes, but I make it clear that victims and witnesses should be able to come forward. We are having more pre-trial cross examinations so that people do not have the difficulty of appearing in court. I recently held a summit with victims’ organisations about what more we can do to protect vulnerable victims.
Does the Secretary of State recognise that, in relation to the Human Rights Act, the Good Friday agreement requires the European convention on human rights to be directly enforceable in Northern Ireland?
As the hon. Lady knows, it is important that all matters to do with devolved arrangements are fully considered in that context and, in the light of my announcement today, there will be more time for that.

Commons ChamberI am grateful to my hon. Friend for raising that important point. The Government have been looking at this issue. I do not think we have made a formal announcement on it yet, and therefore I will write to him giving him the absolute latest position.
What assessment has the Minister made of the recent report by Amnesty International, which has found that insufficient resources for legal aid are creating a two-tier judicial system?
It is important that legal aid is available in the most serious cases, such as those in which life or liberty is involved, a person’s home is at risk, domestic violence is involved, or children are being taken away from their families. That is the legal aid provision that we have here. The hon. Lady claims that that is a two-tier system, but we claim that it is one that is targeted on need.

Commons ChamberMy hon. Friend will be aware that the transfer of prisoners from one prison to another is based on a careful assessment of the risks involved. I am sure that that will have taken place in this case, but I would be happy to discuss the matter with him in more detail if he wants to do so.
Does the Secretary of State accept that the Human Rights Act 1998 is an indispensable part of the Good Friday agreement and that, whatever the plans are for elsewhere, the Government, as a co-guarantor of the agreement, are obligated to retain the Act in Northern Ireland?
The UK has led the world in human rights, from Magna Carta to habeas corpus, and the Government are committed to bringing forward a British Bill of Rights further to build on those ancient protections. The Prime Minister has already met Nicola Sturgeon to make sure that the UK works together—[Hon. Members: “This is about Northern Ireland.”] As the Secretary of State said, we intend to meet all those across the United Kingdom who have concerns about this.

Commons ChamberYes, absolutely. That is one of a number of recommendations of the review by Dame Sally Coates. We are looking actively at how we can implement her inspirational vision, which did so much to transform the teaching profession.
Will the Minister tell me when he intends to meet the new Minister for Justice in Northern Ireland and when they will have an opportunity to discuss a range of issues including the Open University’s distance learning programme, which is an important rehabilitation and educational tool for prisoners and the wider society in Northern Ireland?
I thank the hon. Lady for her question. I know that she takes an ongoing and serious interest in these issues. The Secretary of State tells me that he has already written to the new Northern Ireland Justice Minister and issued an invitation to her. We will learn from and co-operate as fully as possible with the prison service in Northern Ireland.

Commons ChamberToday we celebrate International Women’s Day, an opportunity to celebrate great women and also to reflect on what more we can do as parliamentarians. It is true that there are more women in Parliament today than ever before, which is primarily why it is incumbent on us to take this opportunity to ensure equality across the board.
Women’s rights are human rights, yet when it comes to employment, women repeatedly suffer discrimination. We have seen Women Against State Pension Inequality campaigning vigorously for transitional arrangements.
Does the hon. Lady agree that there is a compelling need for the Government to resolve the WASPI issue through transitional protection, perhaps with an announcement in the Budget next week?
Absolutely. I would wholeheartedly welcome an announcement in the Budget next week that the Government will make transitional arrangements for those women.
We have heard about the issues of pensions, employment and domestic violence. I recognise the powerful contribution of the hon. Member for Birmingham, Yardley (Jess Phillips), which highlighted the fact that too many women lose their life to violence every day.
On welfare, more women than men are lone parents and carers, a fact that must be recognised. The Government must ensure support for those women. There are many gaps that need to be addressed before we have full gender parity. I have called on the Prime Minister to take five key actions for International Women’s Day. First, the rape clause in the Welfare Reform and Work Bill must be scrapped. A woman who has a third child as a result of rape will be required to justify her position to a Government official in order to claim tax credits. That proposal is abhorrent. I thank my hon. Friend the Member for Glasgow Central (Alison Thewliss), who has campaigned tirelessly against it, and I support her efforts unequivocally. I hope the Government will remove that barbaric proposal.
I have urged the Prime Minister to ratify the Istanbul convention and to take serious action to tackle violence against women. Every day in the UK, women lose their life to physical violence. Ratification of the treaty would not only co-ordinate the policies of Government, local authorities and charities, but would send a clear message that the UK is committed to tackling all forms of violence.
The tampon tax must be scrapped. Labelling women’s sanitary products a luxury item is ridiculous. Those items are a necessity, so an additional VAT charge is wrong. Instead of the Government forcing the European Commission’s hand to lift the unfair tax, women will continue to pay that charge, and as a result continue to pay for their own services. We must remove that unfair tax, and the UK Government must use the money to support services.
We must also take firm action on the gender pay gap. The Scottish Government have committed to 50:50 by 2020, to encourage public sector, third sector and private sector companies to ensure equality on boards. The Scottish Government plan to legislate to ensure that public authorities with more than 20 employees will publish information on that. I hope the UK Government will consider that, as the current threshold of 250 employees is not good enough to tackle the gender pay gap in the way that they hope it will.
Unlawful maternity and pregnancy discrimination is more common in Britain’s workplaces than ever before, with many women being forced out of their employment. The Government are trying to help people into work, yet they are introducing employment tribunal fees that may be a barrier to many women tackling rogue employers. The Government must look at those fees and challenge discrimination in all its forms.
I have presented those five points to the Prime Minister. We need deeds, not words, and I urge the Government to take those recommendations on board. As parliamentarians, let us be bold in delivering the kind of society we want to achieve—a more equal future for everyone. Let us deliver it—it is possible.

According to academic research, up to 70% of prisoners are likely to have had a mental health problem, often related to drink or drug abuse. It is therefore in all our interests that we do everything possible to ensure that appropriate therapy and rehabilitative activity are available to those prisoners.
What steps is the Secretary of State taking to ensure that young people in custody are given adequate safe time outside to protect and safeguard their mental health and wellbeing?
The hon. Lady makes a very good point. As part of the youth justice review, I have tasked Charlie Taylor with making sure that purposeful activity—education, sporting activity and time outside—is part of the regime that all young offenders in custody can enjoy.

I absolutely agree. There is a sense that exploitation is going on. It is fantastic that we are able to use this debate to bring these issues to the fore.
I congratulate the hon. Lady on her very fine presentation, her compelling argument and the research she has done. Does she agree that for many women, particularly those on low incomes and those who depend on benefits, it is difficult to purchase the more expensive gender-based products?

Once again, I completely agree.
If there is no discernible difference or advantage to purchasing a product designed for women, but the consumer is led to believe that there is, we must ask questions about advertising standards and whether consumers are able to make properly informed choices. What is it about a multipack “for her” ballpoint pen that makes it more custom-fit or specially designed for a woman? If female consumers are told that they should purchase a specific product because it is the only version suitable for women, when in fact there is no discernible difference in the product, it can be argued that they are being misled.
This debate raises concerns about the kind of choices and information available to female consumers when they make purchases and whether discriminatory practices are taking place, but we should also consider the worrying pattern of gender economic inequality under the Government. The UK gender pay gap currently stands at 19.2%—well above the EU average. Low pay and poor employment practices persist in sectors in which women are the majority of employees, including the care, retail and hospitality sectors. Analysis by the TUC found that more than half of the job growth for women since 2010 has been in low-paying sectors, and that 29% of women earn less than the living wage, compared with 18% of male workers. Women are paid less and are expected to spend more on products and services. They are charged more simply for being women.
Will the Minister agree to Labour’s calls for a cumulative gender impact analysis of the Government’s policies since 2010? If the Government will not do anything to tackle intrinsic gender economic inequality, they must at least not make matters worse. The recently published research raises numerous issues about consumer rights, fair advertising and gender economic inequality. Women are paid less but are expected to spend more on products that are often not discernibly different to the equivalent products for men.
In the absence of a Government gender equality strategy, I ask the Minister to respond to the following questions. Will the Government ensure that independent analysis and further study is conducted to identify the extent of unfair gender pricing and marketing practices in the UK? Will they seek to quantify the full cumulative impact of gender differentials in pricing for women? Will they meet the UK’s major retailers to identify what steps they are taking to rectify the situation?
Once again, I welcome the news that Boots has taken steps this afternoon to change some of its pricing, but I have just received an email from Tesco suggesting that its pink razors are significantly more expensive than the blue or black versions because they are produced in smaller quantities. I struggle to see how that justifies the extra cost. We need to meet retailers and have that discussion.
How will the Government discern whether gender pricing differentials amount to discriminatory practice? Will they produce a cumulative impact analysis of their policies on women since 2010 to understand the true extent of gender economic inequality in the UK?

Thank you for calling me, Mr Hanson. I thought I had withdrawn my name. I would like to make a few points that have particular relevance to Northern Ireland and my constituency.
We debated this issue in the Chamber some weeks ago. I hope that the Minister has reflected on our debate and has some answers about how to give transitional protection to the women sitting behind us and those in the devolved regions and England who are affected by the changes. They deserve it, and the Government must see that it happens.
There are particular issues in Northern Ireland affecting women who left school between 1947 and 1957. The school-leaving age in Northern Ireland was different from that in other parts of the UK. About 500 of those women have lost about two years’ contributions and are not getting their correct pension. Many of them are now in their 70s—it is a different group to those in their mid to late-50s. I ask the Government, in the interests of social justice, fairness and equality, to give those women protection.
Everybody understands that the changes were made to ensure equality, but women’s pensions are riddled with inequality. When I started at the NHS in 1982, I could not accrue death in service benefits to leave to a husband and children, if I had any. When that was finally remedied, it was backdated only to 1988. It is exactly the same for women who worked as cleaners and auxiliaries in the NHS and never had protection for their families.
I thank the hon. Lady for that very compelling intervention. That is absolutely right. Women in the lower age brackets will be deeply affected, because they will have to wait longer for their pensions. Many of them are in caring roles, perhaps because their partners are not in good health, so their family income levels are desperately below the level needed to live on.
I speak on behalf of the many women in North Down who are furious about the changes to their pension arrangements. I am one of the 1950s ladies—I am not going to declare my date of birth—so I have a personal interest in this matter. I wrote to Baroness Altmann—I had enormous regard for her before she became Baroness Altmann—at least three weeks ago and invited her to Northern Ireland to meet the affected women face to face. As the hon. Lady said, the situation in Northern Ireland is slightly more complicated than elsewhere in the United Kingdom. Does she share my bitter disappointment that I am still awaiting a reply?
I thank the hon. Lady for her very helpful intervention. Of course I share her disappointment and disgust at the position being adopted by the Minister. In the other place, the Minister for Pensions did not take on board our points about the forgotten 14s. She did not acknowledge their financial position, and offered them no form of redress. I hope that the Minister here today, who responded some weeks ago, has had time to reflect and has realised that women will be expected to work for longer for a smaller pension than they had expected and planned for. We have been asked to ponder and reflect on solutions today, and the clear solution is to introduce transitional arrangements. The women behind us in the Public Gallery and throughout the UK should not have to lose out and pay the cost of a financial crash that was not of their making.

Commons ChamberI congratulate the hon. Member for Paisley and Renfrewshire South (Mhairi Black) and my hon. Friend the Member for Worsley and Eccles South (Barbara Keeley) on introducing this important motion. The hon. Lady spoke with passion and force and characterised the problem facing many women born in the 1950s throughout Britain and Northern Ireland who are now faced with decisions they did not think they would have to make in such an accelerated fashion. Many of them are in receipt of, or have been in receipt of, low pay and undertake onerous and strenuous jobs in caring professions—for example, as nurses or home helps providing care within their own families to ageing parents. This places an additional strain on their health, yet, despite that burden, they will, because of this pensions ordeal, have to work for longer and for a smaller pension.
Women in my constituency, many of whom are associated with the WASPI campaign, which I congratulate, will be affected by these changes, because of the mirror legislation passed by the Northern Ireland Assembly. The equalisation of the state pension age is, in principle, to be welcomed, but it would be better if this symbol of gender equality was accompanied by transitional protections to ensure that women do not lose out. I recognise that, as life expectancy increases and many people stay in education longer before entering employment, the pension system must adapt. However, women in lower-paid work—home helps and carers, for example—and more physically straining jobs might not necessarily enjoy such an increase in life expectancy, yet they are the people likely to suffer most as a result of these changes, without being given adequate time to prepare.
That injustice and unfairness is the issue the Government need to address now. The previous coalition Government failed to recognise it, and instead wanted ordinary women to pay for a financial crisis they had nothing to do with. The responsibility for it should not lie at the door of women born in the early 1950s, yet they will be expected to work for longer and for a smaller pension than that which they had expected and planned for. They did not plan for this because they did not realise it was happening.

Commons ChamberI am very happy to have the opportunity to answer that question. Obviously, sentences are based on the individual offence. Male offenders are, and will continue to be, supported through existing processes to address their needs, but let us not forget that our Prison Service and probation service were designed with male offenders in mind, because they make up 95% of their customers.
Will the Minister outline what levels of support will be available or are being considered for those women’s dependants, many of whom are quite young children?
The hon. Lady makes an excellent point. That is why our women’s prisons have made an enormous effort to engage with families and children, and some of them give women the opportunity to hold overnight visits with their young children. That is what the pilots are about: they are about recognising offending behaviour very early on, so that we can bring in third sector organisations and local authorities to divert women from ending up in prison.
